संख्या ः पीसीएच-एचए(1) 19/2008-III-20020-178.--इस विभाग की समसंख्यक अधिसूचना तारीख 19 फरवरी, 2024 के अन्तर्गत, हिमाचल प्रदेश पंचायती राज (सामान्य) संशोधन नियम, 2024 का 27—राजपत्र/2024-06-05-2024 (1087) 1088 राजपत्र, हिमाचल प्रदेश, 06 मई, 2024/16 वैशाख, 1946 प्रारूप, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक 4) की धारा 186 के उपबन्धों के अधीन यथा अपेक्षित जनसाधारण से आक्षेप(पों) और सुझाव(वों) आमन्त्रित करने के लिए राजपत्र हिमाचल प्रदेश में तारीख 28 फरवरी, 2024 को प्रकाशित किए गए थे;

और नियत अवधि के दौरान इस निमित्त कोई भी आक्षेप/सुझाव प्राप्त नहीं हुआ है;

अतः राज्यपाल हिमाचल प्रदेश, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक 4) की धारा 186 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, अधिसूचना संख्या पीसीएच-एचए (3)1/94-19181-362, तारीख 25 नवम्बर, 1997 द्वारा अधिसूचित और राजपत्र (असाधारण) हिमाचल प्रदेश में तारीख 25 नवम्बर, 1997 को प्रकाशित हिमाचल प्रदेश पंचायती राज (सामान्य) नियम, 1997 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थातः--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पंचायती राज (सामान्य) संशोधन नियम, 2024 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे। 2. नियम 21 का संशोधन.--हिमाचल प्रदेश पंचायती राज (सामान्य) नियम, 1997 (जिन्हें इसमें इसके पश्चात "उक्त नियम" कहा गया है) के नियम 21 के उप-नियम (1) में,

(क) "परिवार रजिस्टर" शब्दों के स्थान पर "ऑनलाइन परिवार रजिस्टर" शब्द रखे जाएंगे;

(ख) उप-नियम (2) के स्थान पर निम्नलिखित रखा जाएगा, अर्थातः--

"(2) उप-नियम (1) के अधीन तैयार किए जाने हेतु अपेक्षित ऑनलाइन परिवार रजिस्टर की प्रविष्टियां पुनरीक्षित की जाएंगी और जन्म, मृत्यु, विवाह और अन्य पंचायत/क्षेत्र से अंतरण से सम्बन्धित समस्त प्रविष्टियां रजिस्टर में की जाएंगी। कोई अन्य परिवर्धन या परिवर्तन किसी अधिप्रमाणित साक्ष्य के बिना नहीं किया जा सकेगा। परिवार में विभाजन की दशा में, कुटुंब के पृथकीकरण की प्रविष्टियां केवल ऑनलाइन परिवार रजिस्टर में, सम्बद्ध कुटुंब के मुखिया द्वारा किए गए आवेदन पर और सम्बद्ध वार्ड मेंबर की सिफारिश पर ग्राम सभा द्वारा इसकी साधारण या विशेष बैठक में बहुमत द्वारा पारित संकल्प में लिए गए निर्णय के आधार पर ही की जाएंगी। तथापि, ग्राम सभा कुटुंब के विभाजन के बारे में मामले का विनिश्चय करते समय, अधिनियम की धारा 2 के खण्ड (13-क) के अधीन यथा परिभाषित कुटुंब की परिभाषा को ध्यान में रखेगी। विभाजन के कारण पृथक कुटुंब से प्रविष्टियां, ग्राम सभा के संकल्प की संख्या और तारीख उल्लिखित करते हुए ग्राम सभा के अनुमोदन के तत्काल पश्चात्‌ की जाएंगी। पंचायत निरीक्षक का यह कर्तव्य होगा कि वह पंचायत सचिव द्वारा अभिलिखित किए गए कारणों के बारे में अपना समाधान करने के पश्चात्‌ इन प्रविष्टियों को सत्यापित करें। वह पंचायत सचिव द्वारा प्ररूप-19 क में तैयार किए गोशवारा पर भी डिजिटल हस्ताक्षर करेगाः

परन्तु कुटुंब के पृथककरण की बाबत ऑनलाइन परिवार रजिस्टर में तब तक कोई प्रविष्टि नहीं की जाएगी जब तक कि इस प्रकार विभाजित पृथक कुटुंब की शौचालय में पहुंच/आना जाना नहीं है/हो।

(ग) उप-नियम (3) और (4) का लोप किया जाएगा तथा उप-नियम (5) और (6) को क्रमशः (3) और (4) के रूप में पुनः संख्यांकित किया जाएगा।"

No. PCH-HA(1)19/2008-III-20020-178.—Whereas the draft Himachal Pradesh Panchayati Raj (General) Amendment Rules, 2024 were notified vide this department notification of even number dated 19-02-2024 and published in Rajpatra of Himachal Pradesh on dated 28-02-2024 for inviting objections and suggestions from general public under the provision of section 186 of Himachal Pradesh Panchayati Raj Act, 1994, (Act No. 4 of 1994).

And whereas, no objection /suggestion has been received in this behalf during the stipulated period;

Now, therefore, in exercise of the powers conferred by Section 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994), the Governor of Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Panchayati Raj (General) Rules, 1997, notified vide Notification No-PCH-HA(3)-1/94-19181-362 dated 25-11- 1997 and published in Rajpatra, Himachal Pradesh (Extra-ordinary) on dated 25-11-1997, namely:—

1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh Panchayati Raj (General) Amendment Rules, 2024.

(2) These rules shall come into force from the date of publication in Rajpatra (e-gazette) Himachal Pradesh.

2. Amendment of rule 21.— In rule 21 of the Himachal Pradesh Panchayati Raj (General) Rules, 1997,(herein after referred to as the said rules),—

(a) in sub-rule (1), for the words "a Pariwar Register", the words "Online Pariwar Register" shall be substituted;

(b) For sub-rule (2), the following shall be substituted, namely :—

"(2) The entries in the Online Pariwar Register, required to be prepared under sub- rule(1) shall be revised and all entries pertaining to births, deaths, marriages and transfer from other Panchayat/area shall be made in the register. No other addition or alternation may be made without any authenticated evidence. In the event of division of the family, separation of family may only been entered in the online Pariwar Register on the decision of the Gram Sabha by passing a resolution by majority in its general or special meeting on an application made by the head of family concerned and recommendation of the concerned ward member. However, the Gram Sabha shall take into consideration the definition of the family as defined under clause(13-A) of section 2 of the Act while deciding the matter regarding division of family. The entries pertaining to a separate family on account of a division will be made immediately after the approval of Gram Sabha by mentioning the Resolution No. and Date of the1090 राजपत्र, हिमाचल प्रदेश, 06 मई, 2024/16 वैशाख, 1946 resolution of the Gram Sabha. It shall be the duty of the Panchayat Inspector to verify these entries after satisfying himself about the reasons recorded by the Panchayat Secretary. He shall also put his digital signature on the goshwara prepared by Panchayat Secretary on Form19-A:

Provided that no entry with regard to separation of family shall be made in the online Pariwar Register unless the family so separated having access to the toilet, and (c) sub rules (3) and (4) shall be deleted/omitted and sub rules 5 and 6 shall be re- numbered as sub rules (3) and (4), respectively.

NOTIFICATION

Shimla-2, the 1st December, 2023

No. TPT-A(3)-3/2015-II.—In exercise of the powers conferred vide para 15 of the Special Policy for One time waiving of penalty/interest due on Special Road Tax in lieu of PGT upto 31-12-2021 as notified by the Department of Transport, Government of Himachal Pradesh vide Notification No. TPT-A(3)-3/2015-II, dated 09-10-2023 (Annexure-A), the Governor, Himachal Pradesh, is pleased to notify the procedure for carrying out the provisions of the Policy as follows:—

1. The Special Policy shall apply to following categories of vehicles:—

Vehicles Taxation Act, 1972/Rules shall be applicable upto 31-12-2021.

2. The last date of availing this exemption under Special Policy shall remain valid upto 31st December, 2023 or as per time line notified by the Government from time to time.

3. In order to avail the benefits of the Policy a declarant/applicant/owner of the vehicle shall be required to file a declaration in affidavit as specified in clause 2(l) of the Special Policy on prescribed proforma attached at Annexure-B. The self-declaration form shall be submitted for each vehicle separately.

4. The Taxation Authority shall be all Regional Transport Officer(s) and Registering & Licensing Authorities [SDO(Civil)] for assessment of tax under Special Policy.

5. The Taxation authority shall asses the tax due for all those vehicles registered in their jurisdiction as on 31-12-2021 as per rates notified by the Government vide its notification No. TPT-A(3)-2015 dated 06-12-2021 (Annexure-C).

6. In the case of contract carriage vehicles and contract carriage attached with educational institution the tax shall be assessed by the taxation authority as per notification issued by the government vide its Notification No. TPT-A(3)-7/2019-II, dated 01-11-2023 (Annexure-D) wherein per seat per annum tax has been notified.

7. The Taxation Authority shall assess the tax for each missing receipts of Monthly/Quarterly/Half Yearly/Yearly from the date of registration of the vehicle. The Inspection book issued by the Excise Department shall also be taken into account for due tax.

8. Declarant/applicant/owner of vehicle shall produce all receipt of Passenger and Goods Tax Payment from the date of registration of vehicle.

9. Lump-sum penalty of 10% on due tax (SRT) will be charged by the Taxation authority 10. The vehicle owner shall submit the self-assessment sheet to the taxation authority which shall be verified by the authority for further payment as per procedure defined in the SOP. The sample of self-assessment sheets for each category of vehicles are enclosed in annexure (s).

11. The taxation authority shall prepare tax assessment sheet for calculation of due tax and penalty as per special policy and same shall be provided to the vehicle owner for payment of assessed tax. The proforma of assessment sheet will be as per Annexure-E.

12. If the declarant/applicant/owner of vehicle has not filed tax returns from the date of registration of vehicle and due tax has not been paid with respect to a financial year or any return period, one time waiving of penalty/interest shall be calculated @10% (lump-sum amount) on due Special Road Tax (in lieu of PGT upto 31-12-2021) applicable as per the provisions of HP Motor Vehicles Taxation Act, 1972/Rules made thereunder.

13. If the declarant/applicant/owner of vehicle failed to produce the requisite NOC from the State Excise Department depicting tax paid upto date, the Taxation Authority shall assess the tax due as per clause 3 above from the date depicted in the NOC.

14. The Taxation Authority shall generate application for payment in VAHAN through BALANCE-FEE-TAX-OTHER-COLLECTION depicting clearly the assessed tax and penalty for online payment through Cyber Treasury or in VAHAN portal.

15. The Taxation Authority (RTO/R&LA) shall clear pendency in VAHAN after realising payment of due tax from the vehicle owner for period mentioned.

16. The Taxation Authority shall maintain proper record of the receipts, tax assessment sheet and declaration given by the declarant/applicant/owner of vehicle for audit purpose in future.

17. The Audit of the receipts and documents submitted by the declarant/ applicant/owner of vehicle shall be responsibility of the Taxation authority.

18. The head of account for depositing Tax shall be as under:—

a. 0041-00-102-05 SPECIAL ROAD TAX

b. 0041-00-102-06 PENALITY ON SPECIAL ROAD TAX
