संख्याः टी.एस.एम-एफ(6) 1/2015-IV-एल.--कांगड़ा हवाई अड्‌डे के विस्तार लिए इस विभाग ने भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 की 75—राजपत्र/2024-09-07-2024 (2201)2202 राजपत्र, हिमाचल प्रदेश, 09 जुलाई, 2024/18 आषाढ़, 1946 धारा 11 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए प्रारंभिक अधिसूचना संख्या टी.एस.एम-एफ (6)-1/2015-II-एल, तारीख 07-07-2023 जारी की है और राजपत्र (ई-गजट), हिमाचल प्रदेश में 10-07-2023 को प्रकाशित की गई। अब, पूर्वोक्त अधिनियम की धारा 19 की उपधारा (2) के उपबंधों की अपेक्षा के अनुसार, सरकार को पूर्वोक्त अधिनियम की धारा 11 के अधीन जारी प्रारंभिक अधिसूचना के प्रकाशन की तारीख से बारह मास की अवधि के भीतर पुनर्वास और पुनव्र्यवस्थापन की घोषणा और सारांश प्रकाशित करना अपेक्षित है, परंतु कुछ अपरिहार्य परिस्थितियों के कारण ऐसा संभव नहीं हो सका।

और, पूर्वोक्त अधिनियम की धारा 11 के अधीन जारी प्रारंभिक अधिसूचना राजपत्र (ई-गजट), हिमाचल प्रदेश में 10-07-2023 को प्रकाशित की गई थी और इस प्रकार पूर्वोक्त अधिनियम की धारा 19 की उप-धारा (2) के उपबंधों के अनुसार, घोषण को 10-07-2024 को या उससे पूर्व प्रकाशित किया जाना अपेक्षित है, जब अपेक्षित बारह मास की अवधि समाप्त होने जा रही है। विहित समय-सीमा के भीतर घोषणा जारी नहीं की जा सकी क्योंकि भूमि अधिग्रहण विभाग द्वारा 9 जनवरी, 2024 से 22 जनवरी, 2024 (13 दिन) तक माननीय उच्च न्यायालय द्वारा सी डब्ल्यू पी संख्या 7846/2023 में स्थगन आदेश पारित किए जाने के कारण भूमि अधिग्रहण रोक दिया गया था। इसके अतिरिक्त, लोकसभा चुनाव के मद्‌देनजर आदर्श आचार संहिता लागू होने के कारण यह अधिग्रहण पुनः 16-03-2024 से 06-06-2024 (83 दिन) तक रोक दिया गया था। अधिग्रहण कार्य रुके रहने की कुल अवधि 96 दिन है।

अतः, उपरोक्त तथ्यों और परिस्थितियों के दृष्टिगत तथा पूर्वोक्त अधिनियम की धारा 19 की उप-धारा (7) में विहित उपबंधों को ध्यान में रखते हुए, हिमाचल प्रदेश के राज्यपाल लोकहित में अधिनियम की धारा 19 की उप-धारा (2) के अधीन विहित उपबंधों में अंतर्विष्ट अपेक्षा के अनुसार पुनर्वास और पुनव्र्यवस्थापन की घोषणा और सारांश के प्रकाशन की अवधि को 10-07-2024 से 13-10-2024 तक, 96 दिन तक विस्तारित करते हैं।

NOTIFICATION

Shimla-02, 9th July, 2024

No.TSM-F(6)-1/2015-IV-L.—Whereas, for the expansion of Kangra airport this department has issued Preliminary Notification No. TSM-F(6)-1/2015-II-L dated 07-07-2023 in exercise of the powers conferred under section 11 of the Right to Fair Compensation in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and published in the Rajpatra (e-Gazette), Himachal Pradesh on 10-07-2023. Now as per the requirement of the provisions of sub-section (2) of section 19 of the Act ibid, the Government is required to publish Declaration and Summary of Rehabilitation and Resettlement within a period of twelve months from the date of the publication of Preliminary Notification issued under section 11 of the Act ibid but the same could not appear to be possible due to some unavoidable circumstances.

And, whereas, the Preliminary Notification issued under section 11 of the Act ibid was published in the Rajpatra (e-Gazette), Himachal Pradesh on 10-07-2023 and thus, as per the provisions of sub-section (2) of section 19 of the Act ibid, the Declaration is supposed to be published on or before 10-07-2024, when the period of requisite twelve months is going to expire. The Declaration could not be issued within the prescribed time limit as the acquisition of the land was held up by the Department w.e.f. 9th January, 2024 to 22nd January, 2024 (13 days) on account of stay order passed by the Hon'ble High Court in the instant matter vide CWP No. 7846/2023. Further, due to imposition of Model Code of Conduct in view of Lok Sabha Election, this acquisition was again held up w.e.f. 16-03-2024 to 06-06-2024 (83 days). The total period when the acquisition work remained held up comes to 96 days.

Now, therefore in the light of above facts and circumstances and also keeping in view the provisions contained in the sub-section (7) of the section 19 of the Act ibid, the Governor, Himachal Pradesh is pleased to extend the period for the publication of the Declaration and summary of Rehabilitation & Resettlement as per the requirement of the provisions contained under sub-section(2) of section 19 of the Act ibid by 96 days w.e.f. 10-07-2024 to 13-10-2024 in public interest.

प्रार्थी श्री पुष्प ठाकुर पुत्र श्री हेत राम, निवासी ग्राम व डा0 सैन्ज, मौजा मंझली जायण, उप-तहसील धामी, जिला शिमला (हि0 प्र0) के नाम दुरुस्ती प्रार्थना-पत्र प्रार्थी के नाबालिग होने के मध्यनजर उनकी नैसर्गिक अभिभावक उनकी माता श्रीमती हेमलता पत्नी स्व0 श्री हेत राम द्वारा नाम दुरुस्ती प्रकरण की पूर्ण जिम्मेवारी लेते हुए दिनांक 06-03-2024 को इस आशय के साथ इस अदालत में प्रस्तुत किया है कि भू-राजस्व अभिलेख मौजा मंझली जायण में प्रार्थी का नाम शिशु पुत्र श्री हेत राम दर्ज राजस्व कागजात है जोकि गलत है। प्रार्थी के प्रार्थना-पत्र को छानबीन हेतु पटवारी हल्का चनावग को भेजा गया। पटवारी चनावग से प्राप्त रिपोर्ट के मुताबिक मौजा मंझली जायण में प्रार्थी का नाम शिशु पुत्र श्री हेत राम दर्ज है जबकि प्रार्थी द्वारा प्रस्तुत किये गए दस्तावेजों आधार कार्ड, ग्राम पंचायत चनावग की परिवार नकल, शपथ-पत्र तथा ब्यानात वाशिन्दगान के अनुसार प्रार्थी का नाम पुष्प ठाकुर पुत्र श्री हेत राम है जो सही है। उपरोक्त तथ्याें के आधार पर मौजा मंझली जायण, पटवार वृत्त चनावग में प्रार्थी का नाम शिशु उर्फ पुष्प ठाकुर पुत्र हेत राम दर्ज किया जाना वाजिब है।

अतः इश्तहार द्वारा सूचित किया जाता है कि यदि किसी को भी उपरोक्त मुकद्दमा नाम दुरुस्ती बारे कोई भी उजर व एतराज हो तो स्वयं या लिखित तौर पर दिनांक 12-07-2024 को अपराह्न 2.00 बजे तक इस अदालत में अपना उजर/एतराज पेश करे अन्यथा यह समझा जायेगा कि किसी भी व्यक्ति को इस मुकद्दमा नाम दुरुस्ती बारे कोई उजर व एतराज न है तथा आवेदन-पत्र को अन्तिम रूप दिया जायेगा व एकतरफा कार्यवाही अमल में लाई जाएगी।
