संख्याः टी.पी.टी.-एफ(3)-7/2019-II-लूज.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश मोटरयान कराधान अधिनियम, 1972 की धारा 17 की उप-धारा (4) के साथ पठित धारा 3 (क) की उप-धारा (1) द्वारा 82—राजपत्र/2024-19-07-2024 (2333)2334 राजपत्र, हिमाचल प्रदेश, 19 जुलाई, 2024/28 आषाढ़, 1946 प्रदत्त शक्तियों का प्रयोग करते हुए राजपत्र (ई-गजट), में तारीख 07 नवंबर, 2023 को यथा प्रकाशित इस विभाग की अधिसूचना संख्याः टी.पी.टी.-एफ(3)-7/2019-II-लूज, तारीख 01-11-2023 में आंशिक उपांतरण करते हुए अधिसूचना की शर्त संख्या 2 को प्रतिस्थापित करते हैं, अर्थात्‌ः--

"2. यदि कोई मोटरयान अन्य राज्य में रजिस्ट्रीकृत है और हिमाचल प्रदेश मेें देय कर का संदाय किए बिना या जिस प्रयोजन के लिए उसे अनुज्ञापत्र प्रदान किया गया है, उससे भिन्न प्रयोजन के लिए चलता हुआ पाया जाता है, तो हिमाचल प्रदेश मोटरयान कराधान अधिनियम, 1972 की धारा 17 (4) के उपबन्धों के अधीन प्रथम अपराध के लिए हलके मोटरयानों के मामले में रु0 20,000/- और अन्य मोटरयानों के मामले में रु0 50,000/- की शास्ति अधिरोपित की जाएगी और पश्चात्‌वर्ती अपराध के लिए हल्के मोटरयानों के मामले में रु0 40,000/- और अन्य मोटरयानों के मामले में रु0 1,00,000/-शास्ति अधिरोपित की जाएगी।" अधिसूचना संख्याः टी.पी.टी.-एफ(3)-7/2019-II-लूज, तारीख 01-11-2023 की अन्य शर्तें अपरिवर्तित रहेंगी। उपरोक्त अधिसूचना तत्काल प्रभाव से प्रवर्तित होगी।

Shimla-2, the 27th June, 2024

No. TPT-A(3)-7/2019-II-Loose.—In partial modification of this Department Notification No. TPT-A(3)-7/2019-II, dated 01-11-2023, as published in the Rajpatra (e-Gazette), dated 7th November, 2023, in exercise of the powers conferred by sub-section (1) of Section 3-A read with sub-section (4) of Section 17 of the Himachal Pradesh Motor Vehicles Taxation Act, 1972, the Governor, Himachal Pradesh is pleased to substitute condition No. 2 of the notification, namely :—

"2. In case, a vehicle registered in other State and is found plying in Himachal Pradesh

without paying the due tax or for a different purpose than the purpose for which it is granted a

permit, penalty of Rs. 20,000/- shall be charged in the case of a light motor vehicle and

Rs. 50,000/- in the case of other motor vehicles for the first offence and Rs. 40,000/- in the case of

light motor vehicles and Rs.1,00,000/- in case of other motor vehicles for the second offence, under

the provisions of Section 17(4) of the Himachal Pradesh Motor Vehicles Taxation Act, 1972."

The other conditions of Notification No. TPT-A(3)-7/2019-II, dated 01-11-2023 shall remain unchanged. The above notification shall come into force with immediate effect.

हीरा लाल पुत्र स्व0 श्री सोनम दावा, गांव दालंग, डाकघर गौन्धला, तहसील लाहौल, जिला लाहौल एवं स्पिति (हि0 प्र0) ने एक आवेदन शपथ पत्र सहित (बराये जन्म तिथि इन्द्राज) इस अदालत में जिला पंजीयन (जन्म व मृत्यु) एवं मुख्य चिकित्सा अधिकारी जिला लाहौल स्पिति स्थान केलंग के पत्र संख्या HFW-LSP/ST (B&D) 2024/-1456-57, Dated May 2024 के माध्यम से मिसल इस कार्यालय को दिनांक 03-06-2024 में प्राप्त हुआ है। मिसल में संलग्न शपथ-पत्र में प्रार्थी हीरा लाल ने उल्लेख किया है कि मेरा जन्म गांव दालंग, डाकघर गौन्धला, तहसील लाहौल में दिनांक 15-06-1973 को हुआ है और यही मेरी असली जन्म तिथि है। मेरे पास मेरे जन्म से जुड़ा कोई भी दस्तावेज नहीं है।

श्री देविन्दर सिंह पुत्र बलबीर सिंह, गांव खंगसर, डाकघर गोन्धला, तहसील लाहौल, जिला लाहौल स्पिति (हि0 प्र0) ने एक प्रार्थना-पत्र (बराए नाम दुरुस्ती) मय शपथ-पत्र मय अन्य वांछित दस्तावेजों सहित 2368 राजपत्र, हिमाचल प्रदेश, 19 जुलाई, 2024/28 आषाढ़, 1946 इस अदालत में प्रस्तुत कर निवेदन किया है कि मेरे दादा का नाम राजस्व अभिलेख पटवार वृत्त गोन्धला, मोहाल खंगसर में करमा दर्ज है। पर मेरे दादा जी का नाम मेरे पिता व चाचा सुन्दर लाल ठाकुर के आधार कार्ड, शैक्षणिक प्रमाण-पत्र व पेन कार्ड में दादा जी का नाम कर्म चन्द दर्ज है। प्रार्थी ने ब्यान किया है कि करमा व कर्म चन्द दोनों नाम एक ही व्यक्ति विशेष यानी मेरे दादा जी के हैं। प्रार्थी ने निवेदन किया है कि राजस्व अभिलेख पटवार वृत्त गोन्धला के मोहाल खंगसर में मेरे दादा जी का नाम करमा के स्थान पर करमा उर्फ कर्म चन्द दुरुस्त करने के आदेश किए जाये।

अवलोकन मिसल पाया कि क्षेत्रिय अभिकरण की छानबीन रिपोर्ट अनुसार करमा व कर्म चन्द दोनो नाम एक ही व्यक्ति विशष के नाम है। अतः प्रार्थी देविन्दर के दादा का नाम करमा उर्फ कर्म चन्द राजस्व कागजात माल पटवार गोन्धला में कियाजाना उचित होगा।
