सं0ः पी0बी0डब्ल्यू0 (बी0) एफ (5) 38/2019.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामतः गांव खुन्नी पनोली, 89—राजपत्र/2024-27-07-2024 (2555)2556 राजपत्र, हिमाचल प्रदेश, 27 जुलाई, 2024/05 श्रावण, 1946 तहसील ननखड़ी, जिला शिमला, हिमाचल प्रदेश में राई-बाहली-खुन्नी पनोली-खड़ाहण सड़क के निर्माण हेतुु भूमि अर्जित करनी अपेक्षित है। अतएव एतद्‌द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-11 के उपबन्धों के अन्तर्गत जारी की जाती है।

3. पूर्वोक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल, हिमाचल प्रदेश इस समय इस उपक्रम में कार्यरत सभी अधिकारियों, उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उप-धारा द्वारा अपेक्षित अथवा अनुमतः अन्य सभी कार्याें को करने के लिए सहर्ष प्राधिकार देते हैं।

4. कोई भी हितबद्ध व्यक्ति जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आपत्ति हो तो वह इस अधिसूचना के प्रकाशित होने के 60 दिन की अवधि के भीतर लिखित रूप में भू-अर्जन समाहर्ता (शिमला क्षेत्र), लोक निर्माण विभाग, जिला शिमला (हि0प्र0) के समक्ष अपनी आपत्ति दायर कर सकता है।

सं0ः पी0बी0डब्ल्यू0 (बी0) एफ (5) 13/2024.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामतः गांव पुरानी मण्डी/366/10 व पड्‌डल/366/9, तहसील सदर, जिला मण्डी, हिमाचल प्रदेश में पड्‌डल से पुरानी मण्डी के लिए पैदल पार-पथ पुल के निर्माण हेतुु भूमि अर्जित करनी अपेक्षित है। अतएव एतद्‌द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-11 के उपबन्धों के अन्तर्गत जारी की जाती है।

4. कोई भी हितबद्ध व्यक्ति जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आपत्ति हो तो वह इस अधिसूचना के प्रकाशित होने के 60 दिन की अवधि के भीतर लिखित रूप में भू-अर्जन समाहर्ता (मण्डी क्षेत्र), लोक निर्माण विभाग, जिला मण्डी (हि0प्र0) के समक्ष अपनी आपत्ति दायर कर सकता है।

संख्या एल0एल0आर0-ई(9)-12/2021-लेज.--श्री मनोज कुमार, अधिवक्ता को इस विभाग की अधिसूचना संख्या0 एल0 एल0 आर0-ई ( 9)-6/2011-लेज, दिनांक 09-07-2015 द्वारा नोटरी के रूप में नियुक्त किया गया था और उनको उप-मण्डल नाहन, जिला सिरमौर की क्षेत्रीय सीमाओं के भीतर व्यवसाय करने के लिए प्राधिकृत किया गया था और उनका नाम नोटरी के रजिस्टर में क्रम संख्या 443 पर दर्ज किया गया था ;

और श्री मनोज कुमार, अधिवक्ता का व्यवसाय प्रमाण-पत्र दिनांक 31-07-2020 तक विधिमान्य था और लगभग चार वर्ष व्यतीत होने के उपरांत भी उन्होंने व्यवसाय प्रमाण-पत्र नवीनीकरण के लिए आवेदन नहीं किया है। नोटरी नियम 1952 (केन्द्रीय अधिनियम संख्यांक 53 का 1952) की धारा 5 कीे उप-धारा (2) के अंतर्गत पठित नोटरी नियम 1956 के नियम, 8बी के प्रावधानों के तहत व्यवसाय प्रमाण-पत्र को उसकी वैधता अवधि की समाप्ति से छह महीने पहले नवीनीकरण के लिए आवेदन करना आवश्यक था। अतः उन्हें2559 राजपत्र, हिमाचल प्रदेश, 27 जुलाई, 2024/05 श्रावण, 1946 इस विभाग के पत्र संख्या एल0 एल0 आर0-ई(9)-12/2021-लेज, दिनांक 20-04-2024 द्वारा व्यवसाय प्रमाण-पत्र नवीनीकरण न करने हेतु कारण बताओ नोटिस जारी किया था। परन्तु तीन महीने व्यतीत होने के उपरांत भी इस संदर्भ में उनका कोई जवाब नहीं आया।

अतः हिमाचल प्रदेश के राज्यपाल, नोटरी नियम, 1956 के नियम 13 (13) और नोटरी अधिनियम, 1952 की धारा 10(च) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए श्री मनोज कुमार, नोटरी, उप-मण्डल नाहन, जिला सिरमौर का नाम नोटरी के रजिस्टर से तुरन्त प्रभाव से हटाए जाने का आदेश करते हैं।

No. LLR-E(9)-12/2021-Leg.—WHEREAS, Shri Manoj Kumar, Advocate was appointed as Public Notary vide Notification No. LLR-E(9)-6/2011-Leg] dated 09-07-2015 and authorized to practice as such within the territorial limits of Sub-Division Nahan of District Sirmaur and his name was entered at serial No. 443 in the Register of Notaries;

WHEREAS, the certificate of practice of Shri Manoj Kumar has expired on 31-07-2020 and he has not applied for renewal of certificate of practice and since then almost 4 years have lapsed. As per the provisions under sub-section (2) of Section 5 of the Notaries Act, 1952 (Central Act. No. 53 of 1952) read with rule 8B of the Notaries Rules, 1956, an application for renewal of Certificate of Practice was required to be submitted six months before the date of expiry of its period of validity. Therefore, a show cause notice was issued to him vide letter No. LLR-E(9)-12/2021-Leg. dated 20th April, 2024 for non-renewal of licence before removal of his name from the register of notary. But nothing has been heard from him till today in this behalf and since then more than three months have lapsed.

NOW, therefore, the Governor, Himachal Pradesh in exercise of the powers conferred by section 10(f) of the Notaries Act, 1952 read with rule 13(13) of the Notaries Rules, 1956 hereby orders removal of the name of Shri Manoj Kumar, Notary Public of Sub-Division Nahan of District Sirmaur from the Register of Notaries with immediate effect.
