संख्याः रैव-डी(जी)7-10/2023.--हिमाचल प्रदेश सरकार को यह प्रतीत होता है कि ग्राम कुटंग, महाल जंगी, तहसील मूरंग, जिला किन्नौर, हिमाचल प्रदेश में अवस्थित 0-05-65 हैक्टेयर कुल भूमि हिन्दुस्तान तिब्बत सड़क के पास 394.800 (राष्ट्रीय उच्च मार्ग-05) में दीवार सन्निर्माण के लिए अपेक्षित है। उपायुक्त किन्नौर के सहायक उपायुक्त, को प्रभावित परिवारों के पुनर्वास एवं पुनव्र्यवस्थापन के प्रयोजन के लिए 'प्रशासक' नियुक्त किया गया है। अतः यह अधिसूचित किया जाता है कि तहसील मूरंग, जिला किन्नौर के ग्राम कुटंग, महाल जंगी, तहसील मूरंग, जिला किन्नौर, हिमाचल प्रदेश में उक्त प्रयोजन के लिए 0-05-65 हैक्टेयर भूमि का एक टुकड़ा, जिसका विवरण निम्नलिखित है, को अर्जित किया जाना अपेक्षित हैः-

भूमि की अनुसूची

यह अधिसूचना, उन सभी जिनसे यह सम्बन्धित है हेतु भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा 11 के उपबन्धों के अधीन की गई है।

भू-विवरण एवं योजना का भू-अर्जन अधिकारी एवं अतिरिक्त जिला दण्डाधिकारी, पूह, जिला किन्नौर के कार्यालय में किसी भी कार्य दिवस को कार्यालय समय के दौरान निरीक्षण किया जा सकेगा।

सरकार, उपायुक्त किन्नौर और उसके कर्मचारिवृन्द को भूमि में प्रवेश करने और सर्वेक्षण करने, किसी भी भूमि को समतल करने, खुदाई करने और अवमृदा का भेदन करने और समस्त अन्य कार्यों, जो उक्त अधिनियम की धारा-12 के अधीन यथाउपबन्धित कार्य के समुचित निष्पादन के लिए अपेक्षित हो, करने हेतु अधिकृत करती है।2667 राजपत्र, हिमाचल प्रदेश, 01 अगस्त, 2024/10 श्रावण, 1946 अधिनियम की धारा-11(4) के अधीन कोई भी व्यक्ति इस अधिसूचना के प्रकाशन की तारीख से जिला कलेक्टर, किन्नौर के पूर्वानुमोदन के बिना कोई भी लेन-देन संव्यवहार नहीं करेगा या भूमि का कोई भी संव्यवहार अर्थात्‌ क्रय/विक्रय आदि नहीं करवाएगा या भूमि पर कोई विल्लंगम सृजित नहीं करेगा। अधिनियम की धारा-15 के अधीन यथाउपबन्धित हितबद्ध व्यक्तियों द्वारा, भू-अर्जन के आक्षेप, यदि कोई हो, को इस अधिसूचना के प्रकाशन की तारीख से 60 दिन की अवधि के भीतर भू-अर्जन कलक्टर एवं अतिरिक्त जिला दण्डाधिकारी, पूह, जिला किन्नौर के समक्ष दायर किए जा सकेंगे।

चूंकि अधिनियम की धारा 40(2) के दायरे में आने वाली परियोजना के लिए भूमि की तत्काल आवश्यकता है, इसलिए विनिश्चय किया गया है कि सामाजिक समाघात मूल्यांकन अध्ययन न किया जाए। उपरोक्त भू-अर्जन के कारण संभाव्य विस्थापित होने वाले परिवारों के ब्यौरे ऐसे विस्थापन की आवश्यकता के कारणों को विनिर्दिष्ट करते हुए सम्यक्‌ अनुक्रम में उपलब्ध करवाए जाएंगे।

No. Rev-D (G)7-10/2023.—WHEREAS, it appear to the Government of Himachal Pradesh that a total private land measuring 0-05-65 hectares situated in Village Kutang, Muhal Jangi, Tehsil Moorang, District Kinnaur, H.P is required for the construction of retaining wall at 394.800 (NH-5) on HT Road.

The Assistant Commissioner to Deputy Commissioner, Kinnaur is appointed as 'Administrator' for the purpose of rehabilitation and resettlement of the affected families. Therefore, it is notified that for the above said project in the village Kutang, Muhal Jangi, Tehsil Moorang, District Kinnaur, H.P. a piece of land measuring 0-05-65 hectares, whose detailed description is as below, is under acquisition:—

Schedule of land

2668 राजपत्र, हिमाचल प्रदेश, 01 अगस्त, 2024/10 श्रावण, 1946 This notification is made under the provision of Section 11 of the Right to Fair Compensation and Transparency in land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) to all whom it may concern.

The Land statement and plan may be inspected in the office of the Land Acquisition Officer-cum-Additional District Magistrate, Pooh, District Kinnaur on any working day during the working hours.

The Government authorizes the Deputy Commissioner, Kinnaur and his staff to enter upon and survey land, take levels of any land, dig and bore into the sub-soil and do all other acts as may be required for the proper execution of the work as provided under section 12 of the said Act. Under Section 11(4) of the Act, no person shall make any transaction or cause any transaction of land i.e. sale/purchase etc. or create any encumbrances or such land from the date of publication of this notification without prior approval of the District Collector, Kinnaur.

Objections of the acquisition, if any, may be filed by the person interested within a period of 60 days from the date of publication of this notification as provided under section 15 of the Act before the Land Acquisition Collector-cum-Additional District Magistrate, Pooh, District Kinnaur, H.P.

Since the land is urgently required for the project falling within the purview of Section 40(2) of the Act, it has been decided not to carry out the Social Impact Assessment Study. Detail of families likely to be displaced due to aforesaid land acquisition will be provided in due course of time specifying reasons necessitating such displacement.

"The rule provides for the constitution of a Co-operative Education Fund' which shall be administered by the Himachal Pradesh State Co-operative Development Federation or by any other agency in the absence of the former as well as by Co-operative Societies at their own level. The contribution to the fund shall be made by every registered society at the rate of Rs. 300/- or 3% of the net profits derived from the working in a given year subject to a maximum of Rs. 15 lakhs to be distributed between these institutions as per rule 69(1). The rule read with Section No. 54 of the Act, imposes a statutory obligation on every society for making contribution to this Fund. No. Coop-A(3)-2/2020.—In the Himachal Pradesh Co-operative Societies (Amendment) Rules, 2024, notified vide Notification No. Coop-A(3)-2/2020, dated 14-03-2024 published in the Rajpatra (e-Gazette) on 15-03-2024, in rule 3, clause (b), the following words shall stand omitted:—

No. I/449026/2026.—Whereas, the Government of Himachal Pradesh, vide Notification No. FDS-A(3)-7/2016-I, dated 9th May, 2023, has invoked the Himachal Pradesh Hoarding and Profiteering Prevention Order, 1977. Therefore, in supersession of all previous notifications issued in this behalf and in exercise of the powers vested in me under Sub-Clause(d) of Clause 3(1) of the Himachal Pradesh Hoarding and Profiteering Prevention Order, 1977, I, Abid Hussain Sadiq, I.A.S, District Magistrate, Bilaspur District Bilaspur, do hereby fix the maximum margin of profit on the commodities listed in Schedule-I appended to the order ibid, which dealers in Bilaspur District can charge on wholesale and retail sale transactions, as under:—

Terms and Conditions:

1. The element of expenditure, incurred/actually paid by a dealer to be taken into account for computing the landed cost of the commodities listed above i.e. (i) Purchase Price, (ii) Freight, (iii) Central/Local Taxes/GST, (iv) Loading, un-loading, Carriage, (v) Market Fee, (vi) Interest on capital@ 1% for Wholesaler and Retailer on item No.1 to 5 above, (vii) Other incidental charges @1% for Wholesaler and Retailer on item no. 1 to 5 above, (viii) 1% shortage may be allowed over and above the margin of profit calculated as per instructions. No shortage will however be allowed in the case of H.V.Oil sold in packs upto 5kgs. In the case of Gur, Shakkar and Khandsari shortage upto 2% may be allowed

Note.—This condition will not be applicable on fruits and vegetables, as all incidental charges have already been included in their retail margin of profit.

2. The dealer engaged in Wholesale as well as in retail sale business shall charge only one margin of profit on the transaction i.e. wholesale margin on wholesale transaction and retail sale margin on retail sale transaction. The wholesale margin shall be allowed at one stage only at one particular station.

(1) Foodgrains, Gur, Shakkar, Khandsari, Sugar, Pulses, Salt = One Quintal (2) Bread = Ten Number (3) Paper = One Ream (4) Eggs = One Hundred (5) Fruits and Vegetables = 20 Kgs. (6) Meat, Chicken, Fish, Curd and Cottae Cheese = 10 Kgs. (7) Bottled Beverages = 24 Nos.

4. The below terms and conditions will be applicable for vegetables & fruits:—

(4.1) No Wholesaler or retailer shall charge more than the margin of profit as fixed above.

(4.2) Every Commission Agent/Wholesaler in Vegetable Market shall issue Form R to every farmer/grower at the time of purchase of fruits and vegetable from them and retain its one copy with him/her.

(4.3) Every Commission Agent/Wholesaler in Vegetable Market shall issue Form Q to every retailers showing rates of each fruit and vegetable sold to the retailers. On this Form /Cash memo, he or she shall display rate of the fruits/vegetables as per Form R and Charge his/her margin of profit/ commission as shown at column 3 above, which shall be shown separately on Form Q and he/she shall retains its one copy with him/her.

(4.4) The Dealer engaged in wholesale as well as in retail sale business shall charge only one margin of profit on the transaction i.e. wholesale margin on wholesale transaction and retail sale margin on retail sale transaction. The wholesale margin shall be allowed at one stage only at one particular station.

(4.5) Every Retailers shall display price list of the fruits and vegetables available with him/her in business premises in such a way that it may easily be seen by every customer.

(4.6) Wholesale transaction would mean a single transaction of not less than the following:—

Fruits and Vegetables = 20 Kg.

(4.7) All Sub-Divisional Magistrates, all Deputy Superintendent of Police and all Inspectors Food Civil Supplies and Consumers Affairs, in Distt. Bilaspur shall ensure compliance of this notification in letter and spirit.

(4.8) The Secretary, APMC Bilaspur shall ensure issuance of Form-R and Form-Q by the Commission Agent in Vegetable markets in the district.

This notification shall come into force from the date of its publication in official Gazette.

संख्या ः फिन (सी)ए (3)-3/2024.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश राज्य को लागू सेंट्रल सिविल सर्विसिज (लीव) रूल्ज, 1972 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-- 1. संक्षिप्त और प्रारम्भ नाम (1) इन नियमों का संक्षिप्त नाम सेंट्रल सिविल सर्विसिज (लीव)

हिमाचल प्रदेश अमेंडमेंट रूल्ज, 2024 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख

से प्रवृत्त होंगे।

2. रूल 43-सी का

अन्तःस्थापन।

हिमाचल प्रदेश राज्य को लागू सेंट्रल सिविल सर्विसिज (लीव) रूल्ज, 1972 में रूल 43-बी के पश्चात्‌ निम्नलिखित अन्तःस्थापन किया जाएगा, अर्थात्‌ :--

"43-C. Child Care Leave

(1) Subject to the provisions of this rule, a female Government servant may be granted child care leave by an authority competent to grant leave for a maximum period of seven hundred and thirty days during her entire service for taking care of her child with a minimum disability of forty percent as specified in the Government of India Ministry of Social Justice and Empowerment's Notification No. 16-18/97-N 1.1, dated the 1st June, 2001 upto two surviving children.

(2) Grant of child care leave to a female Government servant under sub-rule (1) shall be subject to the following conditions, namely:—

(i) it shall not be granted for more than three spells

in a calendar year;

(ii) in case of a single female Government servant, the grant of leave in three spells in a calendar year shall be extended to six spells in a calendar year;

(iii) it shall not ordinarily be granted during the

probation period except in case of certain

extreme situations where the leave sanctioning

authority is satisfied about the need of child

care leave to the probationer, provided that the

period for which such leave is sanctioned is

minimal; and

(iv) Child care leave may not be granted for a

period less than five days at a time.

(3) During the period of child care leave, a female Government servant shall be paid one hundred percent of the salary for the first three hundred and sixty-five days, and at eighty percent of the salary for the next three hundred and sixty-five days.

(4) Child care leave may be combined with leave of any

other kind.

(5) Child care leave shall not be debited against the

leave account.''.

FINANCE (REGULATIONS) DEPARTMENT

NOTIFICATION

Shimla-2, the 31st July, 2024

No. Fin(C)A(3)-3/2024.—In exercise of powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Himachal Pradesh is pleased to make the following rules further to amend the Central Civil Services (Leave) Rules, 1972, in their application to the State of Himachal Pradesh, namely :—

(1) These rules may be called the Central Civil Services 1. Short title and commencement

(Leave) Himachal Pradesh Amendment Rules, 2024.

(2) They shall come into force from the date of their

publication in Rajpatra (e-Gazette), Himachal Pradesh.

2. Insertion of rule 43-C. In the Central Civil Services (Leave) Rules, 1972, in their application to State of Himachal Pradesh, after rule 43-B the

following shall be inserted, namely:—

"43-C. Child Care Leave

(1) Subject to the provisions of this rule, a female

Government servant may be granted child care leave

by an authority competent to grant leave for a

Registration of Marriage Act, 1996 alongwith relevant records and affidavits stating therein that they have solemnized their marriage on 02-07-2017 at their place of residences with prevailing rites and customs but due to some unavoidable circumstances it could not be entered in the records of Municiple Council Chamba, Tehsil & Distt. Kullu (H.P.) well in time.

And whereas, they have also stated that they were not aware of the laws for the registration of marriage with the registrar of marriages and now, therefore, necessary order for registration of theire marriage be passed, so that their marriage could be registered by the concerned authority.
