संख्या ः टी0सी0पी0-ए03/1/2023.--हिमाचल प्रदेश नगर एवं ग्राम योजना नियम, 2014 में संशोधन कार्यान्वयन करने हेतु प्रारूप अधिसूचना को इस विभाग की समसंख्यांक अधिसूचना तारीख 24-01-2024 द्वारा अधिसूचित किया गया था और उक्त अधिसूचना के राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर उसके द्वारा सम्भाव्य प्रभावित होने वाले व्यक्तियों से आक्षेप(पों) और सुझाव (वों) को आमन्त्रित करने के लिए राजपत्र (ई-गजट) हिमाचल प्रदेश में तारीख 30-01-2024 को प्रकाशित किया गया था;

और इस निमित नियत अवधि के भीतर कोई भी आक्षेप और सुझाव प्राप्त नहीं हुए हैं;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर एवं ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 87 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्याः टी0सी0पी-ए(3)-1/2014-I, तारीख 1 दिसम्बर, 2014 द्वारा अधिसूचित और राजपत्र (ई-गजट) हिमाचल प्रदेश में तारीख 1 दिसम्बर, 2014 को प्रकाशित, हिमाचल प्रदेश नगर एवं ग्राम योजना नियम, 2014 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश नगर और ग्राम योजना (ग्यारहवां संशोधन) नियम, 2024 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृत्त होंगे। 2. नियम 21 का संशोधन.--हिमाचल प्रदेश नगर और ग्राम योजना नियम 2014 (जिसे इसमें इसके पश्चात्‌ ''उक्त नियम'' कहा गया है) के नियम 21 के उप-नियम (2) के पश्चात्‌ निम्नलिखित नए उप-नियम (3) और (4) जोड़े जाएंगे अर्थात्‌ :--2834 राजपत्र, हिमाचल प्रदेश, 08 अगस्त, 2024/17 श्रावण, 1946 "(3) सरकार द्वारा अधिसूचित जोखिम आधारित वर्गीकरण के अनुसार समस्त उच्च जोखिम वाले भवनों के लिए संरचनात्मक डिजाइन रिपोर्ट और संरचनात्मक स्थिरता प्रमाण पत्र के साथ भू-वैज्ञानिक अन्वेषण रिपोर्ट आवश्यक होगी।

(4) निदेशक किसी रजिस्ट्री—त संरचनात्मक इंजीनियर के रजिस्ट्रीकरण को निलंबित या रद्द कर सकेगा, यदि संबद्ध संरचनात्मक इंजीनियर द्वारा प्रस्तुत और अनुमोदित संरचनात्मक डिजाइन में कोई संरचनात्मक अस्थिरता पाई जाती है या भवन निर्माण के पूर्ण होने पर संरचनात्मक इंजीनियर द्वारा संरचनात्मक स्थिरता प्रमाण पत्र जारी कर दिया जाता है और भवन संरचनात्मक रूप से स्थिर नहीं पाया जाता है।''

3. परिशिष्ट-1 का संशोधन.--उक्त नियमों' से संलग्न परिशिष्ट-1 में, सामान्य विनियम की क्रम संख्या III में :--

(क) विनियम 16 के स्थान पर निम्नलिखित विनियम रखा जाएगा, अर्थात्‌ :-

''16. नाले और खड्‌ड से क्रमशः 5.00 मीटर और 7.00 मीटर की दूरी पर सन्निर्माण अनुज्ञात किया जाएगा।'', और

(ख) विनियम 31 के पश्चात्‌ निम्नलिखित विनियम जोड़ा जाएगा, अर्थात्‌ :-

"31. वेली व्यू- हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 के कानूनी उपबन्धाें के अधीन अधिसूचित किसी योजना या विशेष क्षेत्र के संबंध में यथा लागू किसी विकास योजना/अंतरिम विकास योजना के तत्समय प्रवृत्त किसी सामान्य विनियमों के अधीन किसी बात के होते हुए भी, सम्पूर्ण हिमाचल प्रदेश राज्य में फोर लेन/राष्ट्रीय राजमार्गों/राज्य राजमार्गों के चिन्हित खण्डों में घाटी की तरफ निर्मित होने वाले भवन सड़क के स्तर से 1.00 मीटर नीचे रहेंगे। तथापि अत्यधिक सुविधाजनक/–श्य-स्थलों और पर्यटन संभावनाओं वाले किन्ही सड़क खण्डों पर वेली व्यू लागू करने से पूर्व राज्य सरकार द्वारा, वेली व्यू को पुर्वतः संरक्षित और सुरक्षित रखने के उद्देश्य से इनकी पहचान (चिन्हित) की जाएगी।''

टिप्पण.--पूर्वोक्त अधिनियम की अधिकारिता से परे, फोर लेन/राष्ट्रीय राजमार्गों/राज्य राजमार्गों पर अत्यधिक सुविधाजनक/–श्य-स्थलों और पर्यटन संभावनाओं वाले सड़क खण्डों को राज्य सरकार द्वारा चिन्हित किया जाएगा और इसका कार्यान्वयन और अनुश्रवण हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 की धारा 11 में अन्तर्विष्ट उपबंधों के अनुसार ग्रामीण विकास और पंचायती राज विभाग द्वारा सुनिश्चित किया जाएगा।''

NOTIFICATION

Shimla-2, the 5th August, 2024

No. TCP-A03/1/2023-—WHEREAS, the draft notification to carry out amendments in the Himachal Pradesh Town and Country Planning Rules, 2014, was notified vide this Department2835 राजपत्र, हिमाचल प्रदेश, 08 अगस्त, 2024/17 श्रावण, 1946 notification of even number dated 21st January, 2024 and published in the Rajpatra (e-Gazette), Himachal Pradesh dated 30th January, 2024 for inviting objection(s) and suggestion(s) from the person(s) likely to be affected thereby within a period of thirty days from the date of publication of the said notification in the Rajpatra (e-gazette) Himachal Pradesh;

AND WHEREAS, no objection(s)/suggestion(s) received in this behalf within the stipulated period by the Government;

NOW] THEREFORE, in exercise of the powers conferred by section 87 of the Act, 1977 (Act No. 12 of 1977), the Governor, Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Town and Country Planning Rules, 2014 notified vide this Department Notification No. TCP-A (3)-1/2014-I, dated 1st December, 2014 and published in the Rajpatra (e-Gazette), Himachal Pradesh on 01st December, 2014, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Town and Country Planning (Eleventh Amendment) Rules, 2024.

(2) These rules shall come into force from the date of its publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of rule 21.—In rule 21 of the Himachal Pradesh Town and Country Planning Rules, 2014 (hereinafter referred to as the 'said rules'), after sub-rule (2), the following new sub-rules (3) & (4) shall be added, namely:—

"(3) For all High Risk Buildings as per Risk Based Classification notified by the Government, Geological Investigation Report along with Structural Design Report and Structural Stability Certificate shall be mandatory.

(4) The Director may suspend or cancel the registration of any registered structural engineer in case any structure infirmity is found in the structural design submitted and approved by the concerned Structural Engineer or in case the structural stability certificate is issued by a Structural Engineer upon completion of the building and the building is not found structurally stable."

3. Amendment of Appendix-1.—In Appendix-1 of the 'said rules', in serial number-III of General Regulations.–

(a) for regulation 16, the following regulation shall be substituted, namely:—

"16. The construction shall be allowed at distance of 5.00 Metre and 7.00 Metre from Nallah and Khud respectively."; and

(b) after regulation 31, the following Regulation shall be added, namely:—

"32. Valley View—Notwithstanding anything contained under the general regulations of any Development Plan/ Interim Development Plan for the time being in force, as applicable in respect of any planning or special area notified under the statutory provisions of the Himachal Pradesh Town and Country Planning Act, 1977, any building to be constructed on the valley side of the identified stretches of the Four Lanes/National Highway/State Highway in whole of the State of Himachal Pradesh shall remain 1.00 M below the road level. However, before imposition of Valley View on any road stretches having great2836 राजपत्र, हिमाचल प्रदेश, 08 अगस्त, 2024/17 श्रावण, 1946 vantage/view points and tourism potentials, same shall be identified by the State Government in order to fully preserve and protect the valley view.

Note.—For imposition of Valley View regulations on Four Lanes/National Highway/State Highway falling beyond the jurisdiction of the act ibid, the road stretches having great vantage/view points and tourism potentials shall be identified by the State Government and the implementation and monitoring of same shall be ensured by the Rural Development and Panchayati Raj Departments as per the provisions contained in section 11 of the Himachal Pradesh Panchayati Raj Act, 1994."

NOTIFICATION

Shimla, the 5th August, 2024

No. HPERC/419.—The Himachal Pradesh Electricity Regulatory Commission, in exercise of the powers conferred by Section 46 read with section 181, of the Electricity Act, 2003 (36 of 2003), and all other powers enabling it in this behalf, after previous publication, hereby makes the following further amendments in the Himachal Pradesh Electricity Regulatory Commission (Recovery of Expenditure for Supply of Electricity) Regulations, 2012, namely:—

REGULATIONS

1. Short Title and Commencement.—(1) These Regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Recovery of Expenditure for Supply of Electricity) (Sixth Amendment) Regulations, 2024.

(2) These Regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Substitution of Regulation 13.—For Regulation 13 of the Himachal Pradesh Electricity Regulatory Commission (Recovery of Expenditure for Supply of Electricity) Regulations, 2012 (hereinafter referred to as "the said Regulations"), the following Regulation shall be substituted, namely:—

"13. Standard cost data.—(1) The distribution licensee shall, on annual basis prepare the cost data (including the departmental charges) and shall, after inviting public objections, finalize the standard cost data book by 1st March of each year after considering the public observations, if any received, and after approval of the Board of Directors/Competent Authority.

(2) The Distribution Licensee shall, latest by 15th March of each year, upload the standard cost data, on its website and also make available the printed copies of the same to any2837 राजपत्र, हिमाचल प्रदेश, 08 अगस्त, 2024/17 श्रावण, 1946 interested person on demand at a reasonable charges. Sufficient number of copies of the cost data book shall be kept available in its field offices.

(3) The cost data printed book which shall be made effective from the 1st day of start of the next financial year, shall form the basis for approving the average or normative rates as per these Regulations and also for making the initial estimates for erection of electric lines and/or electrical plants and/or any other works to be executed in order to provide supply to the applicants in cases where the cost is to be recovered on actual basis.

(4) In case the Distribution Licensee does not upload the cost data book before the start of the succeeding financial year, the cost data for the relevant current year shall continue to be followed till the same is uploaded on the website."

3. Amendment of Regulation 21.—In Regulation 21 of the said Regulations, for the words, brackets, signs and figures "Himachal Pradesh Electricity Regulatory Commission (Licensee's Duty for supply of Electricity on Request) Regulations, 2004", the words, signs and figures "the Himachal Pradesh Electricity Supply Code, 2009, as amended from time to time:" shall be substituted.

No. I/453992/2024.—In supersession of all previous Notifications and in exercise of the powers conferred upon me under Clause 3(I) (e) of the H.P. Hoarding and Profiteering Prevention Order, 1977, I, Abid Hussain Sadiq, IAS, District Magistrate, Bilaspur, District Bilaspur do hereby fix the maximum retail prices inclusive of all taxes and other incidental charges in respect of the following essential commodities that may be charged by the dealers or retailers in district Bilaspur with immediate effect.—

Note.— 1. One plate of meat/chicken curry should have 200 grams net meat pieces i.e. atleast minimum 5 pieces and 100 grams of gravy.

3. In the packed commodities i.e. bread / milk etc., the price, date of packing should be as W & M Commodities Package Act, 1976.

4. Every dealer/ shopkeeper shall display the price list of these commodities at the entrance of the business premises, which should be duly singed by the owner/manager.

5. On the demand of the customer, every shopkeeper shall issue cash memo/bill to the customer.

This notification shall be valid for a period of one month from the date of publication in the

Official Gazette.
