संख्याः टी0सी0पी0-एफ05/5/2023.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा (1) की उप-धारा (3) द्वारा प्रदत्त शक्तियों 103—राजपत्र/2024-14-08-2024 (2947) 2948 राजपत्र, हिमाचल प्रदेश, 14 अगस्त, 2024/23 श्रावण, 1946 का प्रयोग करते हुए, 2024 के 03 माह के 02 दिवस को ऐसा दिन नियत करते हैं, जिसको पूर्वोक्त अधिनियम के उपबंध ''बंजार योजना क्षेत्र'' में सम्मिलित तहसील बंजार, जिला कुल्लू के निम्नलिखित राजस्व महालों/गांवों में लागू (प्रवृत्त) होंगेः-

उपरोक्त राजस्व महालों/गांवों में, उक्त अधिनियम के उपबंधोंं के लागू होने के परिणामस्वरूप, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) के उपबंध ''बंजार योजना क्षेत्र'' की पुनः परिनिश्चित सीमाओं पर लागू होंगे। कुल राजस्व महाल/गांव जिन पर हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) के उपबंध लागू हैं, अब इस प्रकार होंगेः-2949 राजपत्र, हिमाचल प्रदेश, 14 अगस्त, 2024/23 श्रावण, 1946 विनिर्देश

NOTIFICATION

Shimla-2, the 2nd March, 2024

No. TCP-F05/5/2023.—In exercise of the powers conferred by sub-section (3) of Section 1 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor of Himachal Pradesh is pleased to appoint 2nd day of March month of 2024 as the day on which the provisions of the aforesaid Act shall come into force in the following revenue Mohals/Villages of Tehsil Banjar, District Kullu included in the Banjar Planning Area:—

SPECIFICATIONS

Consequent upon the enforcement of the provisions of the act ibid in above revenue Mohals/villages, the provisions of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), shall apply to the re-defined limits of Banjar Planning Area. The total revenue Mohals/Villages over which provisions of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977) are enforced shall, now be as follows:—

NOTICE OF PUBLICATION OF AMENDMENTS IN DEVELOPMENT PLAN FOR

CHAMBA PLANNING AREA

No. HIM/TP/PJT/AZR-Chamba/2024/Vol-I/3405-28.—In exercise of the powers vested under sub-section (1) of Section 19 of the Himachal Pradesh Town and Country Planning Act, 19772952 राजपत्र, हिमाचल प्रदेश, 14 अगस्त, 2024/23 श्रावण, 1946 (Act No. 12 of 1977), the amendment proposed to be carried out in Development Plan for Chamba Planning Area notified vide Notification No. TCP-F (5)-4/2005, dated 09-10-2007 as per Annexure-A, is hereby published and Notice is given that a copy of the said proposed amendment is available for inspection during the office hours in the following offices:—

1. The Director, Town and Country Planning Department, Himachal Pradesh, Block No. 32-A, SDA Complex, Kasumpati, Shimla-171 009.

2. The Deputy Commissioner, Chamba, Himachal Pradesh.

3. The Assistant Town Planner, Sub-Divisional Town Planning Office, Chamba, Himachal Pradesh.

4. The Executive Officer, Municipal Council, Chamba, Himachal Pradesh.

If any person(s), likely to be affected by the provisions of the aforesaid proposed amendment has any objection(s) or suggestion(s) with respect to the aforesaid proposed amendment, he/she may send the same in writing to the Director, Town and Country Planning Department, Himachal Pradesh, Block No. 32-A, SDA Complex, Kasumpati, Shimla-171009 or the Deputy Commissioner, Chamba, Himachal Pradesh or the Assistant Town Planner, Sub-Divisional Town Planning Office, Chamba, Himachal Pradesh, or the Executive Officer, Municipal Council, Chamba, Himachal Pradesh, within a period of 30 days from the date of publication of this Notice in the Rajpatra (e-Gazette), Himachal Pradesh.

Objection(s) or suggestion(s), if any, received within the period as specified above, shall be taken into consideration before finalizing the provisions of the aforesaid proposed amendments.

और पूर्वोक्त अधिनियम की धारा 15 की उप-धारा (1) के अधीन अभी तक उक्त योजना क्षेत्र में नए सम्मिलित किए गए क्षेत्रों के विद्यमान भू-उपयोग को प्रकाशित नहीं किया गया है;

और हिमाचल प्रदेश के राज्यपाल का समाधान हो गया है कि बन्जार योजना क्षेत्र के पूर्वोक्त नए सम्मिलित किए गए क्षेत्रों में भू-उपयोग में परिवर्तन या उस पर किसी निर्माण संक्रिया से सतह या किसी भूमि 2954 राजपत्र, हिमाचल प्रदेश, 14 अगस्त, 2024/23 श्रावण, 1946 या मिट्‌टी पर हानिकारक अवरोध होने की सम्भावना है या मिट्‌टी के परिरक्षण, भूमि खिसकने की रोकथाम करने या भूमि-कटाव से संरक्षण हेतु हानिकारक समझा गया है और पूर्वोक्त अधिनियम के उपबन्धों के अनुसार प्रश्नगत क्षेत्रों की योजना बनाना और उनका विकास करना कठिन होने की सम्भावना है;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977, का अधिनियम संख्यांक 12) की धारा 15-क की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, ''बन्जार योजना क्षेत्र'' में नए सम्मिलित किए गए क्षेत्रों के विद्यमान भू-उपयोग को, इस अधिसूचना के राजपत्र, हिमाचल प्रदेश में प्रकाशित किये जाने की तारीख से पांच वर्ष की अवधि के लिए रोक लगाते हैं।

NOTIFICATION

Shimla-2,the 2nd, March, 2024

No. TCP-F05/5/2023.—Whereas some areas have been included in the Banjar Planning Area and its limits have been re-defined under clause (a) of sub-section (2) of Section-13 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977) vide Notification No. TCP-F05/5/2023, dated 02 -03-2024.

And whereas existing landuse of the Banjar Planning Area has not yet been published under sub-section (1) of Section-15 of the act ibid.

And whereas the Governor of Himachal Pradesh is satisfied that in the Banjar Planning Area, the change of landuse or any building operation therein is likely to cause injurious disturbance of the surface or any land or soil, or is considered detrimental to the preservation of the soil, prevention of land slips or protection against erosion and is likely to make it difficult to plan and develop the areas in question in accordance with the provisions of the aforesaid Act. Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 15-A of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor of Himachal Pradesh is pleased to freeze the existing landuse of the areas of all mohals as covered under the Banjar Planning Area from the date of the publication of this notification in the Rajpatra (e-Gazette), Himachal Pradesh for a period of five years.

उतरः जिला कुल्लू तहसील बन्जार की पश्चिमी सीमा से आरम्भ करके पूर्व की ओर महाल रतवाह (हदबस्त संख्या 6/21 तरगाली) हदबस्त संख्या 6/20, पलाच हदबस्त संख्या 4/13 में राष्ट्रीय राजमार्ग की अधिग्रहित चौड़ाई से पहाडी की तरफ 100 मीटर की दूरी तक और फिर राजस्व गांव पलाच हदबस्त संख्या 4/13ए कलवारी हदबस्त संख्या 4/12, पेखरी हदबस्त संख्या 13/36 में शर्ची सड़क की2960 राजपत्र, हिमाचल प्रदेश, 14 अगस्त, 2024/23 श्रावण, 1946 अधिग्रहित चौड़ार्ई से 100 मीटर की दूरी तक और फिर तिर्थन सड़क की ओर बढ़ते हुए राजस्व गांव पेखडी तथा तिन्दर हदबस्त संख्या 13/37 में तिर्थन सड़क की अधिग्रहित चौड़ाई से सड़क के दोनाें तरफ 100 मीटर की दूरी तक और फिर उतरी सीमा की ओर बढ़ते हुए राजस्व गांव तिन्दरए चिपनी हदबस्त संख्या 14/38 में शर्ची सड़क की अधिग्रहित चौड़ाई से 100 मीटरए तथा मशियार हदबस्त संख्या 14/39 में फलाचन नदी और चलौरू नाला के संगम बिन्दु से 100 मीटर की दूरी तक।

पूर्वः जिला कुल्लू तहसील बन्जार की उतरी सीमा के अंत से आरम्भ करके फलाचन नदी और चलौरू नाला के संगम बिन्दु से 100 मीटर की दूरी तक तथा राजस्व गांव मशियार हदबस्त संख्या 14/39 और शिल्ही हदबस्त संख्या 12/35 में शर्ची सड़क के दोनों तरफ 100 मीटर की दूरी तक का क्षेत्र सम्मिलित।

दक्षिणः जिला कुल्लू तहसील बन्जार की पूर्वी सीमा से आरम्भ करके पश्चिम की ओर बढ़ते हुए राजस्व गांव शिल्ही हदबस्त संख्या 12/35, शर्ची हदबस्त संख्या 12/34 में शर्ची सड़क की अधिग्रहित चौड़ाई से 100 मीटर की दूरी तक और फिर बन्जार नगर पंचायत में राजस्व गांव बिहार हदबस्त संख्या 11/33 की सीमा का अनुसरण करते हुए तथा राजस्व गांव बीणी हदबस्त संख्या 11/32, रशाला हदबस्त संख्या 10/30, सजवाड हदबस्त संख्या 10/29, करशाईगाड-II हदबस्त संख्या 23/72 में आनी-बन्जार-औट राष्ट्रीय राजमार्ग-305 की अधिग्रहित चौड़ाई से 100 मीटर की दूरी तक । पश्चिमः जिला कुल्लू तहसील बन्जार के राजस्व गांव करशाईगाड-II की दक्षिणी सीमा के अंत से आरम्भ राजस्व गांव करशाईगाड-II हदबस्त संख्या 23/72, सराज हदबस्त संख्या 8/26, तान्दी हदबस्त संख्या 9/28 में आन्नी-बन्जार-औट राष्ट्रीय राजमार्ग-305 की अधिग्रहित चौड़ाई से 100 मीटर की दूरी तक और फिर राजस्व गांव तान्दी हदबस्त संख्या 9/28, बाहू हदबस्त संख्या 9/27, बलागाड हदबस्त संख्या 7/23 में By-Pass सड़क की अधिग्रहित चौड़ाई से 100 मीटर की दूरी तक और फिर राजस्व गांव बलागाड हदबस्त संख्या 7/23, चैथर हदबस्त संख्या 7/22, रतवाह हदबस्त संख्या 6/21, हदबस्त संख्या 23/72 में आन्नी-बन्जार-औट राष्ट्रीय राजमार्ग-305 की अधिग्रहित चौड़ाई से 100 मीटर की दूरी तथा उतरी सीमा के प्रारंभिक बिंदु के संगम तक।

BANJAR PLANNING AREA BOUNDARY

North:—Starting from the western side towards eastern side upto 100m distance from the acquired width of NH-305 towards hillside in mohal Ratwah (Hadbast No. 6/21), Targali (Hadbast No. 6/20), Palach (Hadbast No. 4/13), and then 100 m. distance from acquired width of Sharchi road in mohal Palach (Hadbast No. 4/13), Kalwari (Hadbast No. 4/12), Pekhari (Hadbast No. 13/36), & then following Tirthan Valley road both side at a distance of 100 m from acquired width of Tirthan Valley road in mohal Pekhri (Hadbast No. 13/36) and Tinder (Hadbast No. 13/37), and then following the northern boundaries upto 100 m distance from acquired width of Sharchi Road in Mohal Tinder (Hadbast No. 13/37), Chipani (Hadbast No. 14/38) & upto 100 meters from meeting point of river Falachan and Chalouru Nallah in Mohal Mashiyar (Hadbast No. 14/39), Tehsil Banjar, Distt. Kullu, H.P. East:—Starting from the end of northern boundary at a distance of 100 m from meeting point of River Falachan and Chalouru Nallah and covering 100 m on both sides of Sharchi Road in Mohal Mashiyar (Hadbast No. 14/39), and Shilhi (Hadbast No. 12/35), Tehsil Banjar, Distt. और हिमाचल प्रदेश के राज्यपाल का समाधान हो गया है कि योजना क्षेत्र के पूर्वोक्त नए सम्मिलित किए गए क्षेत्रों में भू-उपयोग में परिवर्तन या उस पर किसी निर्माण संक्रिया से सतह या किसी भूमि या मिट्‌टी पर हानिकारक अवरोध होने की सम्भावना है या मिट्‌टी के परिरक्षण, भूमि खिसकने की रोकथाम करने या भूमि-कटाव से संरक्षण हेतु हानिकारक समझा गया है और पूर्वोक्त अधिनियम के उपबन्धों के अनुसार प्रश्नगत क्षेत्रों की योजना बनाना और उनका विकास करना कठिन होने की सम्भावना है;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम 1977 (1977 का अधिनियम संख्यांक 12) की धारा 15-क की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, ''कुफरी विशेष क्षेत्र'' में नए सम्मिलित किए गए क्षेत्रों के विद्यमान भू-उपयोग पर, इस अधिसूचना के राजपत्र, हिमाचल प्रदेश में प्रकाशित किये जाने की तारीख से पांच वर्ष की अवधि के लिए रोक लगाते हैं।

Shimla-2, the 2nd March, 2024 No. TCP-F05/5/2023—Whereas some areas have been included in the Kufri Special Area and its limits have been re-defined under clause (a) of sub-section (3) of Section-66 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977) vide Notification No. TCP-F05/5/2023 dated 02-03-2024,

And whereas existing landuse of the newly included areas of the said Special Area has not yet been published under sub-section (1) of Section-15 of the Act ibid.

And whereas the Governor of Himachal Pradesh is satisfied that in the aforesaid newly included areas of the Planning Area, the change of landuse or any building operation therein is2964 राजपत्र, हिमाचल प्रदेश, 14 अगस्त, 2024/23 श्रावण, 1946 likely to cause injurious disturbance of the surface or any land or soil, or is considered detrimental to the preservation of the soil, prevention of land slips or protection against erosion and is likely to make it difficult to plan and develop the areas in question in accordance with the provisions of the aforesaid Act.

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 15-A of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor of Himachal Pradesh is pleased to freeze the existing landuse of the newly included areas of the Kufri Special Area from the date of the publication of this notification in the Official Gazette of Himachal Pradesh for a period of five years.
