हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) अधिनियम, 1971 (1971 का अधिनियम संख्यांक 8) का और संशोधन करने के लिए विधेयक।

भारत गणराज्य के पचहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित होः-

1. संक्षिप्त नाम.-- इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) संशोधन अधिनियम, 2024 है।

2. धारा 6-ख का संशोधन.--मूल अधिनियम की धारा 6-ख की उपधारा (2) के पश्चात्‌ निम्नलिखित उपधारा अन्तःस्थापित की जाएगी, अर्थात :-

''(2अ) इस धारा में अन्र्तविष्ट किसी बात के प्रतिकूल होते हुए भी, कोई व्यक्ति अधिनियम के अधीन पेंशन का हकदार नहीं होगा, यदि उसे संविधान की दसवीं अनुसूची के अधीन किसी भी समय अयोग्य घोषित किया गया हैः

परंतु यदि कोई व्यक्ति इस उपधारा के अधीन पेंशन के अधिकार से वंचित हो जाता है, तो उसके द्वारा पहले से ली गई पेंशन की रकम ऐसी रीति में वसूल की जाएगी, जैसी विहित की जाए।''।5539 राजपत्र, हिमाचल प्रदेश, 05 सितम्बर, 2024/14 भाद्रपद, 1946

उद्देश्यों और कारणों का कथन

हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) अधिनियम, 1971 विधान सभा के सदस्यों के भत्ते और पेंशन प्रदान करने के दृष्टिगत अधिनियमित किया गया था। वर्तमानतः भारत के संविधान की दसवीं अनुसूची के अधीन विधायी सदस्यों के दलबदल को हतोत्साहित करने के लिए अधिनियम में कोई उपबंध नहीं है। इसलिए, सांविधानिक उद्देश्य की पूर्ति के लिए; राज्य के लोगों द्वारा दिए गए जनादेश की रक्षा के लिए, लोकतांत्रिक मूल्यों के संरक्षण के लिए; और इस सांविधानिक पाप (सिन) के निवारण के लिए हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) अधिनियम, 1971 में संशोधन करना आवश्यक हो गया है। यह विधेयक उपर्युक्त उद्देश्यों की पूर्ति के लिए है।

further to amend the Himachal Pradesh Legislative Assembly (Allowances and Pension of

Members) Act, 1971 (Act No. 8 of 1971).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy-fifth Year of the Republic of India as follow:—

1. Short title.—This Act may be called the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 2024.

2. Amendment of section 6-B.—In section 6-B of the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971, after sub-section (2), the following sub-section shall be inserted, namely:—

"(2A) Notwithstanding anything to the contrary contained in this section, a person shall not be entitled for pension under the Act, if he has been disqualified at any time under the Tenth Schedule of the Constitution:

Provided that if a person is disentitled for pension under this sub-section, the amount of pension already drawn by him shall be recovered in the manner as may be prescribed.".

The Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971 was enacted with a view to provide for allowances and pension to the Members of the Legislative Assembly of Himachal Pradesh. Presently, there is no provision in the Act to discourage the defection of the legislative members under the Tenth Schedule of the Constitution of India. Thus, to achieve this Constitutional objective; to protect the mandate given by the people of the State, to preserve the democratic values; and to have deterrence towards this Constitutional sin, it has been necessitated to carry out amendments in the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971.

This Bill seeks to achieve the aforesaid objectives.

संख्या श्रम (ए) 3-4/2022.--हिमाचल प्रदेश कारखाना (संशोधन) नियम, 2024 के प्रारूप को कारखाना अधिनियम, 1948 (1948 का अधिनियम संख्यांक 63) की धारा 115 के साथ पठित धारा 112 के उपबन्धों के अधीन यथा अपेक्षित एतद्‌द्वारा संभाव्य प्रभावित होने वाले व्यक्ति (व्यक्तियों) से आक्षेप(पों)/सुझाव(वों) को आमन्त्रित करने के लिए राजपत्र (ई-गजट), हिमाचल प्रदेश में इसके प्रकाशन की तारीख से 45 दिनों के भीतर तारीख 29 फरवरी, 2024 को प्रकाशित किया गया था,

और उपरोक्त नियत अवधि के भीतर इस निमित्त कोई भी आक्षेप/सुझाव प्राप्त नहीं हुए हैं;

अतः हिमाचल प्रदेश के राज्यपाल, कारखाना अधिनियम, 1948 (1948 का अधिनियम संख्यांक 63) की धारा 115 के साथ पठित धारा 112 द्वारा प्रदा शक्तियों का प्रयोग करते हुए उद्योग विभाग की अधिसूचना संख्याः डी 80-12/48-III, तारीख 6-5-1952 को अधिसूचित हिमाचल प्रदेश कारखाना नियम, 1950 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारंभ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश कारखाना (संशोधन) नियम, 2024 है।5543 राजपत्र, हिमाचल प्रदेश, 05 सितम्बर, 2024/14 भाद्रपद, 1946 (2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृा होंगे।

2. नियम 5 का संशोधन.--हिमाचल प्रदेश कारखाना नियम, 1950 (जिन्हें इसमें इसके पश्चात्‌ 'उक्त नियम' कहा गया है) के नियम 5 के उप-नियम (2) में विहित अनुसूची के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

कारखाने के लिए एक वर्ष के लिए अनुज्ञप्ति प्रदान करने हेतु शुल्क

3. नियम 6 का संशोधन.-उक्त नियमों के नियम 6 के उप-नियम (4) में ''एक सौ'' शब्दों के स्थान पर ''पांच सौ'' शब्द रखे जाएंगे।

4. नियम 8 का संशोधन.-उक्त नियमों के नियम 8 के उप-नियम (3) में, ''एक सौ'' शब्दों के स्थान पर ''पांच सौ'' शब्द रखे जाऐंगे।

5. नियम 10 का संशोधन.-उक्त नियमों के नियम 10 में, ''एक सौ'' शब्दों के स्थान पर ''पांच सौ'' शब्द रखे जाऐंगे।

6. नियम 12 क का अन्तःस्थापन.-उक्त नियमों के नियम 12 के पश्चात्‌ निम्नलिखित नियम अन्तःस्थापित किया जाएगा, अर्थात.-

''12 क.- (1) मुख्य निरीक्षक किसी व्यक्ति को ऐसे क्षेत्र में और ऐसी अवधि, जैसी ऐसे भवनों, खतरनाक मशीनरी, उाोलक और लिफ्ट, लिफ्टिंग मशीन और लिफ्टिंग टैकल, प्रैशर प्लांट, सिमित स्थान, वातानुकूलन प्रणाली और कारखाना में अवस्थित ऐसी अन्य प्रक्रिया या संयत्र और उपस्कर (उपकरण) जैसे अधिनियम और तद्‌धीन बनाए गए नियमों में विहित है, हेतु परीक्षण, परीक्षा (जांच), निरीक्षण और प्रमाणन कार्यान्वित करने के प्रयोजन हेतु विनिर्दिष्ट की जाए, 'सक्षम व्यक्ति' के रूप में मान्यता दे सकेगा, यदि ऐसा कोई व्यक्ति इस नियम से संलग्न अनुसूची में यथा निर्धारित अर्हताएं, अनुभव और अन्य अपेक्षाएं रखता होः

परन्तु मुख्य निरीक्षक 'सक्षम व्यक्ति' के संबंध में अर्हताओं की अपेक्षाओं में छूट दे सकेगा, किंतु राज्य सरकार की सहमति ली जाएगी और ऐसे व्यक्ति के पास इस प्रकार मान्यता प्राप्त होने के पश्चात्‌, निरीक्षक की शक्तियां नहीं होगी;

परंतु यह और कि इस उपबंध के अधीन मान्यता प्राप्त 'सक्षम व्यक्ति' की आयु 62 वर्ष से अधिक नहीं होगी और वह परीक्षण, परीक्षा और निरीक्षण कार्यान्वित करने के प्रयोजन हेतु शारीरिक रूप से स्वस्थ होगा।

राजपत्र, हिमाचल प्रदेश, 05 सितम्बर, 2024/14 भाद्रपद, 1946 (3) मुख्य निरीक्षक, इस अधिनियम और तद्‌धीन बनाए गए नियमों के प्रयोजन के लिए 'सक्षम व्यक्ति' के रुप में मान्यता प्राप्त करने के लिए आशयित किसी व्यक्ति या किसी संस्था से इस नियम के अधीन विहित प्ररूप में आवेदन प्राप्त होने पर ऐसे आवेदन को रजिस्ट्रीकृत करेगा और आवेदन प्राप्त होने की तारीख से साठ दिन की अवधि के भीतर या तो आवेदक की क्षमता और उपलब्ध प्रसुविधाओं के संबंध में स्वंय का समाधान होने के पश्चात्‌ आवेदक को एक 'सक्षम व्यक्ति' के रुप में मान्यता देगा और इस नियम के अधीन विहित प्ररूप में 'सक्षमता प्रमाण-पत्र' जारी करेगा या कारणों को विनिर्दिष्ट करते हुए आवेदन को अस्वीकार करेगा।

(4) मुख्य निरीक्षक, सक्षम व्यक्ति को सुनवाई का अवसर प्रदान करने के पश्चात्‌, सक्षमता का प्रमाण-मत्र प्रतिसंहृत कर सकेगा,-

(i) यदि उसके विश्वास का यह कारण है कि सक्षम व्यक्ति ने,-

(क) 'सक्षमता प्रमाण-पत्र' में विहित किसी भी शर्त का उल्लंघन किया है; या

(ख) इस अधिनियम या तद्‌धीन बनाए गए नियमों के प्रयोजन के लिए कोई परीक्षण, परीक्षा और निरीक्षण कार्यान्वित किया है या ऐसे आशय से असंगत किसी रीति से कार्य किया है अथवा इस अधिनियम और तद्‌धीन बनाए गए नियमों के अधीन यथा अपेक्षित किसी कार्य का लोप किया है; या (ii) लिखित में अभिलिखित किए जाने के किसी अन्य कारण के लिए।

स्पष्टीकरण.-इस नियम के प्रयोजन के लिए, संस्था के अन्तर्गत संगठन भी है। (5) मुख्य निरीक्षक, कारणों को लिखित में अभिलिखित करके, यथास्थिति, लिफ्टिंग मशीनों, लिफ्टिंग टैकल, प्रैशर प्लांट या वातानुकुलन प्रणाली के पुनः प्रमाणीकरण, जिसे राज्य के बाहर किसी सक्षम व्यक्ति द्वारा प्रमाणित किया गया है की अपेक्षा कर सकेगा।

(6) सक्षमता प्रमाण-पत्र प्रदान करने हेतु आवेदन, रु0 25000/- (पच्चीस हजार रुपये) की अप्रतिदेय फीस और रु0 100,000/- (एक लाख रुपये) की ब्याज रहित प्रतिदेय प्रतिभूति रकम के साथ किया जाएगा, जिसे हिमकोष के माध्यम से मुख्य शीर्ष 0230-00-104-01 में जमा किया जाएगा।

(7) सक्षमता प्रमाण-पत्र के नवीनीकरण के लिए आवेदन रु0 25000/- (पच्चीस हजार रुपये) की अप्रतिदेय फीस के साथ किया जाएगा, जिसे हिमकोष के माध्यम से मुख्य शीर्ष 0230-00-104-01 में जमा किया जाएगा।

नियम 12 (क) के उप-नियम (1) के अधीन किसी व्यक्ति को सक्षमता प्रमाण-पत्र प्रदान करने के लिए आवेदन पत्र का प्ररुप

3. सक्षम व्यक्ति सभी आवश्यक उपकरणों/ सुविधाओं को उपाप्त करेगा और इसको सही हालत में (सुव्यवस्थित कार्य चालन) अनुरक्षित करेगा और निरीक्षक अर्थात्‌ उप निदेशक कारखाना/ सहायक निदेशक कारखाना, जिसकी अधिकारिता में कारखाना अवस्थित है, को परीक्षण कार्य में उपयोग किए गए उपकरणों के बारे में सूचित करेगा ।

4. जहाँ अधिकतम अनुज्ञात कार्यचालन दबाव क्षीण हो गया है या परीक्षा से दर्शित होता है कि दबाव पात्र या सयंत्र या इसका कोई भाग, जब तक कतिपय मरम्मत नहीं की जाती अथवा जब तक कोई अन्य सुरक्षा उपाय अपेक्षित नहीं किए जाते, तब तक उसका उपयोग सुरक्षित रूप से जारी नहीं रख सकते। इसकी रिपोर्ट सम्बद्व निरीक्षक अर्थात्‌ उप-निदेशक कारखाना/ सहायक निदेशक कारखाना को भेजी जाएगी और इसकी एक प्रति परीक्षा पूर्ण होने के सात दिन के भीतर अधोहस्ताक्षरी को भी भेजी जाएगी।

5. सक्षम व्यक्ति के रूप में मान्यता प्राप्त संस्था, संगठन छोड़ने वाले सक्षम व्यक्ति के नाम के बारे में अधोहस्ताक्षरी को सूचित करेगी। यदि उपर्नामित समस्त व्यक्ति संगठत कोे छोड़ देते हैं तो जारी किया गया सक्षमता प्रमाण-पत्र रद्द हुआ समझा जाएगा।

6. हर महीने की 10 तारीख तक कारखानों के नामों, परीक्षण किए गए उपकरणों/ पात्रों की सूची, परीक्षण की तारीख, जारी किए गए प्रमाण-पत्र की संख्या और तारीख, कार्यचालन दबाव या अनुज्ञात सुरक्षित भार और विशेष टिप्पणियां, यदि कोई हो, को सम्मिलित करते हुए मासिक विवरणी प्रस्तुत की जाएगी।

7. मुख्य कारखाना निरीक्षक के पास इस आदेश को इसकी वैधता के दौरान किसी भी समय प्रतिसंहृत करने या संशोधन करने के अधिकार सुरक्षित होंगे।

8. परीक्षणों, परीक्षाओं और निरीक्षणों के दौरान सक्षम व्यक्ति फोटोग्राफ लेगा और रिकार्डिंग करेगा और मुख्य कारखाना निरीक्षक द्वारा जब मांगा जाए तो इसको सहजता से उपलब्ध करवाएगा। सक्षमता प्रमाण-पत्र के नवीकरण के लिए आवेदन इस प्रमाण-पत्र के अवसान से कम से कम एक मास पूर्व किया जाएगा।

No. Shram(A)3-4/2022.—Whereas, the draft Himachal Pradesh Factories (Amendment) Rules 2024 were published in the Rajpatra, Himachal Pradesh on 29th February, 2024 for inviting objection(s)/suggestion(s) from person(s) likely to be affected thereby as required under the provisions of Section 112 read with Section 115 of the Factories Act, 1948 (Act No. 63 of 1948) within a period of 45 days from the date of its publication.

And whereas, no objection(s)/suggestion(s) have been received in this behalf within the above stipulated period;

Now, therefore, in exercise of the powers conferred by Section 112 read with Section 115 of the Factories Act, 1948 (Act No. 63 of 1948), the Governor, Himachal Pradesh is pleased to make the following rules, further to amend the Himachal Pradesh Factories Rules, 1950 notified vide Industries Department Notification No. D. 80-12/48-III, dated 6-05-1952, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Factories (Amendment) Rules, 2024.

(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of rule 5.—In the Himachal Pradesh Factories Rules, 1950 (hereinafter referred to as the 'said rules'), for the Schedule prescribed in sub-rule (2) of rule 5, the following shall be substituted, namely:—

Fee for grant of licence for a factory for one year

3. Amendment of rule 6.— In sub-rule (4) of rule 6 of the said rules, for the words "Rupees One hundred" the words "Rupees Five Hundred" shall be substituted.

4. Amendment of rule 8.—In rule 8 of said rules, in sub-rule (3), for the words "one hundred" the words "five hundred" shall be substituted.

5. Amendment of rule 10.—In rule 10 of said rules, for the words "one hundred" the words "five hundred" shall be substituted.

6. Insertion of rule 12-A.—After rule 12 of the said rules, the following rule shall be inserted, namely:—

"12-A (1) The Chief Inspector may recognize any person as a 'competent person' within such area and for such period as may be specified for the purposes of carrying out tests, examinations, inspections and certification for such buildings, dangerous machinery, hoists and lifts, lifting machines and lifting tackles, pressure plant, confined space, ventilation system and such other process or plant and equipment as stipulated in the Act and the rules made thereunder, located in a factory, if such a person possesses the qualifications, experience and other requirements as set out in the SCHEDULE annexed to this rule:

Provided that the Chief Inspector may relax the requirements of qualifications in respect of a competent person but concurrence of the State Government shall be taken and such a person after being so recognized, shall not have powers of an 'Inspector':

Provided further that the competent person recognized under this provision shall not be above the age of 62 years and shall be physically fit for the purpose of carrying out the tests, examination and inspection.

(2) The Chief Inspector may recognize an institution of repute, having persons possessing qualifications and experience as set out in the SCHEDULE annexed to this rule for the purpose of carrying out tests, examinations, inspections and certification for buildings, dangerous machinery, hoists and lifts, lifting machines and lifting tackles, pressure plant, confined space, ventilation system and such other process or plant and equipment as stipulated in the Act and the rules made thereunder as a competent person within such area and for such period as may be specified.

(3) The Chief Inspector on receipt of an application in the Form prescribed under the rule from a person or an institution intending to be recognized as a competent person for the purposes of this Act and the rules made thereunder, shall register such application and within a period of sixty days of the date of receipt of application, either after having satisfied himself as regards competence and facilities available at the disposal of the applicant recognize the applicant as a competent person and issue a certificate of competency in the Form prescribed under this rule or reject the application specifying the reasons thereof.

(4) The Chief Inspector may, after giving an opportunity to the competent person of being heard, revoke the certificate of competency,—

(i) If he has reason to believe that a competent person,—

(a) has violated any condition stipulated in the certificate of competency; or

(b) has carried out a test, examination and inspection or has acted in a manner inconsistent with the intent or the purpose of this Act or the rules made thereunder; or has omitted to act as required under the Act and the rules made thereunder; or

(ii) for any other reason to be recorded in writing.

Explanation. For the purpose of this rule, an institution includes an organization.

(5) The Chief Inspector may, for reasons to be recorded in writing, require re-certification of lifting machines, lifting tackles, pressure plant or ventilation system, as the case may be, which has been certified by a competent person outside the State.

(6) Application for grant of certificate of competency shall be accompanied by a non- refundable fee of ` 25,000 (Rupees Twenty Five Thousand) and a security amount (without interest) of ` 1,00,000/- (Rupees One Lakh) which shall be deposited in Major Head 0230- 00-104-01 through HIMKOSH.

(7) Application for renewal of Certificate of Competency shall be accompanied by a non- refundable fee of ` 25,000/- (Rupees Twenty Five Thousand) which shall be deposited in the Major Head 0230-00-104-01 through HIMKOSH.

This certificate is valid upto ………….. or the date, the Occupational Safety, Health and Working Conditions Code, 2020 and rules made thereunder, shall come into force, whichever is earlier.

This certificate is issued subject to the conditions stipulated hereunder.—

1. Tests, examinations and inspections shall be carried out in accordance with the

provisions of the Act and the rules made thereunder, and record of tests shall be maintained in a

register.

2. Tests, examination and inspection shall be carried out under direct supervision of the

competent person and the date of test examination be informed to the Inspector i.e. Deputy

Director Factories/ Assistant Director Factories under whose jurisdiction factory is located well in

advance. Any testing without prior intimation as stated above shall not be accepted.

3. The competent person shall procure all necessary equipments/facilities and maintain the

same in good working order and inform to the Inspector i.e. Deputy Director Factories/ Assistant

Director Factories under whose jurisdiction factory is located about the equipment used in testing

work.

4. Where maximum permissible working pressure is reduced or the examination shows that

the pressure vessels or plant or any part thereof, cannot continue to be used safely unless certain

repairs are carried out or unless any other safety measures are required to be taken the report

shall be sent to concerned Inspector i.e. Deputy Director Factories/ Assistant Director Factories

and copy of the same shall also be sent to the undersigned within 7 days of completion of the

examination.

5. The Institution recognized as competent person shall keep the undersigned informed

about the name of the competent person who leave the organization. The certificate of competency

issued shall stand cancelled if all of above named person(s) leave the organization.

6. Monthly return shall be submitted covering names of Factories, list of equipments/vessels

tested, date of test, number and date of certificate issued, working pressure or safe load allowed

and special remarks if any by the 10th of every month.

7. The Chief Inspector of Factories reserves the rights to revoke or amend this order at any

time during its validity.

8. The competent person shall take photographs and make recordings during the course of

Tests, examinations and inspections and make it readily available as and when demanded by Chief

Inspector of Factories.

Application for renewal of competency certificate may be made at least one month before the

expiry of this certificate

No. PBW(B)F(5)10/2024.—In exercise of powers conferred by rule 3 read with rule 4 of the Himachal Pradesh Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules, 2015, the Governor of Himachal Pradesh is pleased to empower the Social Impact Assessment Unit as specified in the concluding para of this notification to carry out Social Impact Assessment for the purpose of proposed Land Acquisition for widening/improvement of various narrow/bottleneck points of MDR 66-Cart Road from Tutikandi to Sanjauli via Chotta Shimla and MDR 67-Victory5566 राजपत्र, हिमाचल प्रदेश, 05 सितम्बर, 2024/14 भाद्रपद, 1946 Tunnel to Dhalli Chowk via Lakkar Bazar Road and for construction of pedestrian path near Tibetan School, Chotta Shimla-Khas.

The detail of proposed land to be acquired is as under:

Thus, it is made clear that any attempt of coercion or threat during Social Impact Assessment will render this exercise as null and void and the Social Impact Assessment will be carried out within a period of six months from its commencement. The Social Impact Assessment Unit shall hold consultations, survey and public hearings. The Social Impact Assessment Unit shall also ensure that adequate representation be given to the representatives of Panchayats and Gram Sabha, at the stage of carrying out the Social Impact Assessment.

While undertaking a Social Impact Assessment Study the Social Impact Assessment Unit shall amongst other things, take into consideration the impact that the project likely to have on various components such as livelihood of affected families, public and community properties, assets and infrastructure particularly roads, public transport, drainage, sanitation, sources of drinking water, sources of water for cattle, community ponds, grazing land, plantations, public utilities such as post offices, fair price shops, food storage godowns, electric supply, health care facilities, school and educational or training facilities, aganwadis, children parks, places of worship, land for traditional tribal institutions and burial and cremation grounds. The Social Impact Assessment unit shall amongst other matters consider all the aspects under Section 4(4) of the5568 राजपत्र, हिमाचल प्रदेश, 05 सितम्बर, 2024/14 भाद्रपद, 1946 Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and rules framed thereunder.

The Social Impact Assessment Unit after completion of consultation, survey and public hearing shall prepare a Social Impact Assessment Study report in Form-II under sub-rule (3) of rule 3 of the rules and a Social Impact Management Plan, listing the ameliorative measures required to be undertaken for addressing the impact of the project under sub-section (6) of section 4 of the Act ibid shall be submitted in Form-III under sub-rule (4) of rule 3 alongwith the Social Impact Assessment report.

The land is being proposed to be acquired for public purpose by the Public Works Department under Section 2(1) (b) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and therefore, consent provision as laid down under sub-section 2 of the Act, ibid shall not apply on this department.

The Himachal Pradesh Revenue Department vide Notification No. Rev-B.A(3)3/2014-II dated 27-11-2015 has already constituted the State Social Impact Assessment Unit , hence, for the information of the general public, the contact information of unit is as under:—

No. Fin-2-C(12)2/2024.—Government of Himachal Pradesh hereby notifies the sale of Himachal Pradesh Government Stock (Securities) of 15-year tenure for an aggregate amount of Rs. 700 crore (Nominal). The sale will be subject to the terms and conditions spelt out in this5569 राजपत्र, हिमाचल प्रदेश, 05 सितम्बर, 2024/14 भाद्रपद, 1946 notification (called specific Notification) as also the terms and conditions specified in the General Notification No. Fin-2-C(12)-11/2003 dated July 20, 2007 of Government of Himachal Pradesh.

Object of the Loan :

1. (i) The Proceeds of the State Government Securities will be utilized for the development programme of the State of Himachal Pradesh.

(ii) Consent of Central Government has been obtained to the floatation of this loan as required by Article 293(3) of the Constitution of India.

Method of Issue :

2. Government Stock will be sold through the Reserve Bank of India, Mumbai Office (PDO) Fort, Mumbai- 400 001 by auction in the manner as prescribed in paragraph 6.1 of the General Notification No. Fin-2-C(12)-11/2003 dated July 20, 2007 at a coupon rate to be determined by the Reserve Bank of India at the yield based auction under multiple price formats.

Allotment to Non-competitive Bidders :

The Government Stock upto 10 % of the notified amount of the sale will be allotted to eligible individuals and institutions subject to a maximum limit of 1 % of the notified amount for a single bid as per the Revised Scheme for Non-competitive Bidding Facility in the Auctions of State Government Securities of the General Notification (Annexure-II).

The above applicants have filed an application under section 16 of Special Marriage Act, 1954 alongwith affidavits and supporting documents in this court of undersigned in which they have stated that they have solemnized their marriage on 09-08-2024 at Shiv Mahadev Mandir, Putriyala, Distt. Kangra (H.P.) and they are living as husband and wife since then. Hence their marriage may be registered.

Therefore, the general public is hereby informed through this notice that if any person who has the objections regarding this marriage can file the objections personally or in writing before this office on or before 03-10-2024 at 11.00 A.M. The objection(s) after 03-10-2024 at 11.00 A.M. will not be entertained by this office and then the marriage will be registered accordingly as per law prescribed.

श्रीमती विमला देवी पुत्री आतू हाल पत्नी बाला राम, निवासी हाऊस नं0 207, वार्ड नं0 3 ब्राधा, डाकघर न्यूली, तहसील व जिला कुल्लू (हि0प्र0) ने इस न्यायालय में आवेदन-पत्र मय शपथ-पत्र गुजारा है कि उसका जन्म 30-01-1980 को हुआ है। परन्तु ग्राम पंचायत वुरुआ के जन्म व मृत्यु पंजीकरण अभिलेख में दर्ज नहीं है, जिसे अब वह दर्ज करवाना चाहती है। इस बाबत क्षेत्रीय अभिकरणों से छानबीन करवाई गई तथा पाया गया कि श्रीमती विमला देवी पुत्री आतू हाल पत्नी बाला राम की जन्म तिथि 30-01-1980 है तथा जन्म तिथि दर्ज करने बारे सिफारिश की गई है।

अतः सर्वसाधारण को इस इश्तहार द्वारा सूचित किया जाता है कि यदि किसी व्यक्ति विशेष को श्रीमती विमला देवी पुत्री आतू हाल पत्नी बाला राम की जन्म तिथि दर्ज करने बारे आपत्ति हो तो वह दिनांक 12-09-2024 को या इससे पूर्व अदालत हजा में अपनी आपत्ति दर्ज करवा सकता है। इसके उपरान्त कोई भी उजर/एतराज मान्य नहीं होगा तथा नियमानुसार ग्राम पंचायत वुरूआ के जन्म तथा मृत्यु पंजीकरण अभिलेख में जन्म तिथि दर्ज करवाने के आदेश पारित कर दिये जाएंगे।

श्री लोबसंग गोंपो पुत्र श्री पलदेन वांगचुक, निवासी वार्ड नं0 7 गोम्पा रोड मनाली, डाकघर व तहसील मनाली, जिला कुल्लू (हि0प्र0) ने इस न्यायालय में आवेदन-पत्र मय शपथ-पत्र गुजारा है कि उसका जन्म 28-06-1975 को हुआ है। परन्तु नगर परिषद मनाली के जन्म व मृत्यु पंजीकरण अभिलेख में दर्ज नहीं है, जिसे अब वह दर्ज करवाना चाहता है। इस बाबत क्षेत्रीय अभिकरणों से छानबीन करवाई गई तथा पाया गया कि श्री लोबसंग गोंपो पुत्र श्री पलदेन वांगचुक की जन्म तिथि 28-06-1975 है तथा जन्म तिथि दर्ज करने बारे सिफारिश की गई है।
