Shimla-2, the 20th August, 2024

No. TCP-F05/5/2023.—In exercise of the powers conferred by sub-section (3) of Section 1 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), 140—राजपत्र/2024-30-09-2024 (6607)6608 राजपत्र, हिमाचल प्रदेश, 30 सितम्बर, 2024/08 आश्विन, 1946 the Governor of Himachal Pradesh is pleased to appoint 20th day of August month of 2024 as the date on which the provisions of the aforesaid Act shall come into force in the following revenue Mohal/Villages of Tehsil Paonta Sahib and Nahan, Distt. Sirmaur, namely:—

Consequent upon the enforcement of the provisions of the Act ibid in above revenue Mohals/Villages, the provisions of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), shall apply to the re-defined limits of Dhaulakuan-Majra Planning Area and total Mohals over which provisions of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977) are enforced shall, now be as follows:—

No. TCP-F05/5/2023.—In exercise of powers conferred by clause (a) of sub-section 2 of Section-13 of the Himachal Pradesh Town & Country Planning Act, 1977 ( Act No. 12 of 1977),6609 राजपत्र, हिमाचल प्रदेश, 30 सितम्बर, 2024/08 आश्विन, 1946 the Governor of Himachal Pradesh is pleased to include the following Revenue Mohals in the Dhaulakuan-Majra Planning Area, already notified vide the Notification No. TCP-F(5)-1/2015, dated 14-05-2015, namely:—

Consequent upon the enforcement of the provisions of the Act ibid on above referred Revenue Mohals the Governor of Himachal Pradesh in exercise of the powers conferred by sub- section (2) of Section 13 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), is pleased to re-constitute and re-defined the limits of Dhaulakuan-Majra Planning Area as under:—

SPECIFICATIONS

Note.—Total area of earlier notified Planning Area was 2161 hectares; Area proposed to be extended is 107 hectare; Total area of Planning area is 2268 hectares.

DHAULAKUAN- MAJRA PLANNING AREA BOUNDARY

NORTH.—Area bounded upto 150 mtr. on left hand side of NH-07 including complete revenue Villages namely Kolar, Sukhchainpur, Dhaulakuan, Jagatpur, Majra & Misarwala.

EAST.—Area bounded by outer boundary of Paonta Sahib Special Area.

SOUTH.—Area bounded upto 150 mtr. on right hand side of NH-07 including complete revenue Villages namely Kollar, Sukhchainpur, Dhaulakuan, Jagatpur, Majra & Misarwala.

WEST.—Area bounded by outer boundary of Nahan Planning Area.

NOTIFICATION

Shimla-2, the 20th August, 2024

No. TCP-F05/5/2023.—Whereas some areas have been included in the Dhaulakuan- Majra Planning Area and its limits have been re-defined under sub-section (2) (a) of Section 13 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977) notified vide the Notification of TCP-F05/5/2023 number, dated 20-08-2024.

And whereas, the existing land use of the newly included areas of the said Planning Area has not yet been published under sub-section (1) of Section-15 of the Act ibid;

And whereas, the Governor of Himachal Pradesh is satisfied that in the aforesaid newly included areas of the Planning Area, the change of land use or any building operation therein is likely to cause injurious disturbance of the surface or any land or soil, or is considered detrimental to the preservation of the soil, prevention of land slips or protection against erosion and is likely to make it difficult to plan and develop the areas in question in accordance with the provisions of the aforesaid Act.

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 15-A of the Act ibid, the Governor of Himachal Pradesh is pleased to freeze the existing land use of the newly included areas of the Dhaulakuan-Majra Planning Area from the date of publication of this Notification in the Official Gazette for a period of five years.
