संख्या यू0डी0-ए 0(1)-5/2024.--इस विभाग की अधिसूचना संख्या यू0डी0-ए 0(1)-5/2024-लूज, तारीख 14-12-2024 द्वारा नगरपालिका परिषद नदौन, जिला हमीरपुर में कुछ क्षेत्रों 209-राजपत्र/2024-31-12-2024 (11039) 11040 राजपत्र, हिमाचल प्रदेश, 31 दिसम्बर, 2024/10 पौष, 1946 को सम्मिलित किए जाने के लिए प्रस्ताव हिमाचल प्रदेश नगरपालिका अधिनियम, 1994 (1994 का अधिनियम संख्यांक 13) की धारा 5 की उप-धारा (1) के उपबंधों के अनुसार तद्‌द्वारा प्रभावित होने वाले संभाव्य निवासी(निवासियाें)/व्यक्ति(व्यक्तियों) से आक्षेप/आक्षेपों को आमंत्रित करने के लिए अधिसूचित किया गया और जिसे राजपत्र(ई-गजट), हिमाचल प्रदेश में तारीख 14-12-2024 को प्रकाशित किया गया था;

और इस बाबत नियत अवधि के भीतर प्राप्त हुए आक्षेपों पर राज्य सरकार द्वारा विचार किया गया और तदनुसार उन पर आवश्यक विनिश्चय किया गया;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगरपालिका अधिनियम, 1994(1994 का अधिनियम संख्यांक 13) की धारा 5 की उप-धारा (3) के अधीन उनमें निहित शक्तियों का प्रयोग करते हुए , इस अधिसूचना के साथ सलंग्न अनुसूची में विनिर्दिष्ट क्षेत्रों को इस अधिसूचना के राजपत्र(ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से नगरपालिका परिषद्‌ नदौन, जिला हमीरपुर, हिमाचल प्रदेश में सम्मिलित करने के आदेश देते हैं।

हिमाचल प्रदेश के राज्यपाल , इसके अतिरिक्त पूर्वोक्त अधिनियम की धारा 80 की उप-धारा (1) के साथ पठित धारा 5 की उप-धारा (4) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अनुसूची में विनिर्दिष्ट क्षेत्रों में भूमि और भवनों पर संपति कर के संदाय से भी इस अधिसूचना के राजपत्र(ई-गजट) हिमाचल प्रदेश में प्रकाशन की तारीख से तीन वर्ष की अवधि के लिए छूट प्रदान करते हैं। इन क्षेत्रों के निवासियों को अधिकार-अभिलेख के वाजीब-उल-अर्ज में यथा उपबंधित उनके रूढ़िजन्य अधिकार मिलते रहेंगे।

NOTIFICATION

Shimla-2, the 30th December, 2024

No. UD-A(1)-5/2024.—WHEREAS, a proposal for inclusion of some areas in Municipal Council, Nadaun, District Hamirpur was notified in accordance with the provisions of sub-section (1) of Section 5 of Himachal Pradesh Municipal Act. 1994 (Act. No. 13 of 1994) for11042 राजपत्र, हिमाचल प्रदेश, 31 दिसम्बर, 2024/10 पौष, 1946 inviting objections from the inhabitant(s)/person(s) likely to be affected thereby vide this Department Notification No. UD-A(1)-5/2024-loose dated 14-12-2024 and published in Rajpatra (e- Gazette), Himachal Pradesh on 14-12-2024;

AND WHEREAS, the objections received in this regard, within the stipulated period were considered by the State Government and necessary decision was taken thereon, accordingly;

NOW THEREFORE, the Governor, Himachal Pradesh, in exercise of the powers vested in him under sub-section (3) of Section 5 of the Himachal Pradesh Municipal Act, 1994 (Act No. 13 of 1994), is pleased to include the areas specified in the SCHEDULE attached with this notification, in the Municipal Council Nadaun, District Hamirpur, Himachal Pradesh from the date of publication of this notification in Rajpatra (e-Gazette), Himachal Pradesh.

The Governor, Himachal Pradesh in exercise of the powers conferred by sub-section (4) of Section 5 read with sub-section (1) of Section 80 of Act ibid is further pleased to exempt the land and buildings in the areas specified in the SCHEDULE from payment of property tax for a period of three years from the date of publication of this notification in the Rajpatra (e-Gazette), Himachal Pradesh. The residents of these areas shall continue to retain their customary rights as provided in Wazib-Ul-Urj of the record of rights.

और विहित समय-सीमा के भीतर नगर पंचायत शिलाई, जिला सिरमौर में सम्मिलित किए जाने बारे प्रस्तावित स्थानीय क्षेत्रों के निवासियों से प्राप्त हुए आक्षेप/आक्षेपों पर राज्य सरकार द्वारा विचार किया गया और तदनुसार उन पर आवश्यक विनिश्चय किया गया;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगरपालिका अधिनियम, 1994(1994 का अधिनियम संख्यांक 13) की धारा 3 की उप-धारा (2) और धारा 4 की उप-धारा (6) द्वारा प्रदत्त शक्तियों का प्रयोग 11044 राजपत्र, हिमाचल प्रदेश, 31 दिसम्बर, 2024/10 पौष, 1946 करते हुए, इस अधिसूचना के साथ सलंग्न अनुसूची में विनिर्दिष्ट क्षेत्रों के अनुसार नगर पंचायत शिलाई, जिला सिरमौर का गठन करते हैं और यह राजपत्र(ई-गजट), हिमाचल प्रदेश में इसके प्रकाशन की तारीख से अस्तित्व में आएगी।

हिमाचल प्रदेश के राज्यपाल, इसके अतिरिक्त पूर्वोक्त अधिनियम की धारा 80 की उपधारा (1) के साथ पठित धारा 4 की उप-धारा (7) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त नगर पंचायत की भूमि और भवनों पर इस अधिसूचना के प्रारम्भ से तीन वर्ष की अवधि के लिए संपति कर के संदाय से भी छूट प्रदान करते हैं। इन क्षेत्रों के निवासियों को अधिकार अभिलेख के वाजीब-उल-अर्ज में यथा उपबंधित उनके रूढ़िजन्य अधिकार मिलते रहेंगे।

NOTIFICATION

Shimla-2, the 30th December, 2024

No. UD-A(1)-21/2024.—WHEREAS, a proposal for declaration of the Nagar Panchayat Shillai, District Sirmour as notified vide this Department Notification No. UD-A(1)-21/2024 dated 09-12-2024 was published in the Rajpatra (e-Gazette), Himachal Pradesh on 10-12-2024 for inviting objections from the affected persons through the Deputy Commissioner, Sirmour within a period of two weeks;

AND WHEREAS, the objections received from the inhabitants of the local areas proposed to be included in Nagar Panchayat Shillai, District Sirmour within the prescribed time limit were considered by the State Government and necessary decision was taken thereon, accordingly;

NOW THEREFORE, in exercise of the powers conferred by sub-section (2) of section 3 and sub-section (6) of Section 4 of the Himachal Pradesh Municipal Act, 1994 (Act No. 13 of 1994), the Governor, Himachal Pradesh is pleased to constitute Nagar Panchayat Shillai, District Sirmour, Himachal Pradesh as per the area specified in the SCHEDULE attached with this Notification and it shall come into existence from the date of its publication in the Rajpatra (e-Gazette), Himachal Pradesh.

The Governor, Himachal Pradesh, further in exercise of the powers conferred by sub-section (7) of Section 4 read with sub-section (1) of Section 80 of the Act ibid., is pleased to exempt the land and buildings of the said Nagar Panchayat from the payment of property tax for a period of 03 years from the commencement of this notification. The residents of said areas shall continue to retain their customary rights as provided in Wazib-Ul-Urj of the records of rights.

No. 13 of 1994) and also to amend Schedule-I of the Act ibid and to declare Nagar Panchayat Baijnath- Paprola as Municipal Council Baijnath-Paprola as per second proviso to Section 3(2) of the Act ibid, was notified vide this Department Notification No. UD-A(1)-23/2024 dated 09-12-2024, which was published in Rajpatra (e- Gazette), Himachal Pradesh on 10-12-2024 for inviting objections from the inhabitant(s)/person(s) likely to be affected thereby;

AND WHEREAS, the objections received in this regard, within the stipulated period were considered by the State Government and necessary decision was taken thereon, accordingly;

NOW THEREFORE, the Governor, Himachal Pradesh, in exercise of the powers vested in him under sub-section (6) of section 4 of the Himachal Pradesh Municipal Act, 1994 ( Act No. 13 of 1994), is pleased to declare the existing areas of the Nagar Panchayat, Baijnath-Paprola, District11066 राजपत्र, हिमाचल प्रदेश, 31 दिसम्बर, 2024/10 पौष, 1946 Kangra, Himachal Pradesh as municipal areas from the date of publication of this Notification in Rajpatra (e-Gazette), Himachal Pradesh. Further, in exercise of the powers conferred by second proviso to section 3(2) of the Act ibid, the Governor Himachal Pradesh is pleased to up-grade Nagar Panchayat, Baijnath-Paprola to that of the Municipal Council Baijnath Paprola and also to amend the Schedule-1 of the said Act by deleting entry of Nagar Panchayat from part-II of the Schedule and to insert it in part-1 of the schedule namely as the Municipal Council , Baijnath- Paprola.

No. EXN-D(6)-3/2024.—In exercise of the powers conferred by sub-sections (3) and (4) of Section 13 of the Central Sales Tax Act, 1956 (Act No. 74 of 1956), the Governor of Himachal Pradesh is pleased to make the following rules further to amend the Central Sales Tax (Himachal Pradesh) Rules, 1970, namely:—

1. Short title and commencement.—(1) These Rules may be called the Central Sales Tax (Himachal Pradesh) Amendment Rules, 2024.

(2) They shall come into force from the date of their publication in Rajpatra (e-gazette), Himachal Pradesh.

2. `Amendment in Rule 6B.—In sub-rule (2) of rule 6B of the Central Sales Tax (Himachal Pradesh) Rules, 1970, for the words "Zonal Collector" the words "concerned Joint Commissioner, ST&E (Tax Payer Services, Enforcement & Allied Taxes)" shall be substituted.
