संख्याः रैव 1-3(स्टाम्प) 2/88.--हिमाचल प्रदेश भू-राजस्व अधिनियम, 1954 (1954 का अधिनियम संख्यांक 6) यथापेक्षित के अनुसार प्रारूप ऑनलाइन प्रतिलिपि एजेंसी नियम, 2024 जन साधारण से आक्ष्ेाप 211-राजपत्र/2025-02-01-2025 (11139) 11140 राजपत्र, हिमाचल प्रदेश, 02 जनवरी, 2025/12 पौष, 1946 और सुझाव आमन्त्रित करने के लिए अधिसूचना संख्या रैव 1-3 स्टाम्प 2/88 तारीख 12/08/2024 द्वारा अधिसूचित और राजपत्र (ई-गजट) हिमाचल प्रदेश में 04/09/2024 को प्रकाशित किए गए थे। और नियत अवधि के दौरान इस निमित्त कोई भी आक्षेप/सुझाव प्राप्त नहीं हुए है/ हैंंंं।

अतः हिमाचल प्रदेश सरकार के वित्तायुक्त (राजस्व) हिमाचल प्रदेश भू-राजस्व अधिनियम 1954 (1954 का अधिनियम संख्यांक 6) की धारा 168 की उप-धारा 1 के खण्ड (घ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उपरोक्त अधिनियम के प्रयोजनो को कार्यान्वित करने के लिए अपने और वित्तायुक्त (अपील) हिमाचल प्रदेश सरकार मण्डलायुक्तों, उपायुक्ताें, उपमण्डल कलक्टरों और सहायक कलक्टर प्रथम और द्वितीय श्रेणी के नियन्त्रण के अधीन अभिलेखों की प्रतिलिपियाें के प्रदाय को विनियमित करने के लिए निम्नलिखित नियम बनाते है, अर्थातः-

प्रारूप नियम

1. संक्षिप्त नाम, प्रारम्भ और लागू होना.--(1) इन नियमों का संक्षिप्त नाम ऑनलाइन प्रतिलिपि एजेंसी नियम, 2024 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे। (3) ये नियम हिमाचल प्रदेश, राजस्व विभाग के समस्त अभिलेख कक्षों को लागू होेंगे।

2. परिभाषाएं.--(1) इन नियमों में, जब तक कि कोई बात विषय या संदर्भ में विरूद्ध न हो,- (क) ''उपाबन्ध'' से इन नियमों से संलग्न उपाबन्ध अभिप्रेत है,

(ख) ''प्रतिलिपियों'' से, मूल दस्तावेजों,नस्तियों या अभिलेखों का प्रत्युत्पादन करना अभिप्रेत है, जो विधिक, प्रशासनिक, भू-अभिलेखों या न्यायालय कार्यवाहियों का भाग हैं। ये डिजिटल या भौतिक प्रतिलिपियॉंं हो सकती हैं और ये विधि के अनुसार उनके हकदार पक्षकारों से अधिकारिक अनुरोध के अनुसार की जाती हैं;

(ग) ''परेषित'' से, अभिलेख कक्ष में किसी नस्ति या दस्तावेज का सुरक्षित अभिरक्षा की स्थिति अभिप्रेत है;

(घ) ''परेषित नस्तियां'' से राजस्व न्यायालय की नस्तियों जो अभिलेख कक्ष में रख दी गई हैं;

(ङ) ''प्रतिलिपि एजेंसी'' से, ऐसी एजेंसी अभिप्रेत है जो वित्तायुक्त, हिमाचल प्रदेश (राजस्व एवं अपील)े कार्यालय प्रतिलिपि एजेंसी नियम, 1993 और हिमाचल प्रदेश उपायुक्त कार्यालय प्रतिलिपि एजेंसी नियम, 1994 में परिभाषित हैं;

(च) ''प्रतिलिपि लिपिक'' से, ऐसा व्यक्ति अभिप्रेत है जो ऑनलाइन प्रतिलिपि एजेंसी मेें डिजिटल अभिलेख को आदेशिक या प्रदाय करेगा;

(छ) ''प्रतिलिपि पर्यवेक्षक'' से, सम्बद्ध कार्यालय के वरिष्ठ पदधारी अभिप्रेत है जो ऑनलाइन प्रतिलिपि एजेंसी में प्रचालन का पर्यवेक्षण करेगा;

(ज) ''न्यायालय'' से, हिमाचल प्रदेश में प्रकार्य समस्त राजस्व न्यायालय अभिप्रेत है;

(झ) ''डिजिटल अभिलेख'' से, ऐसा अभिलेख जिसे डिजिटलीकृत किया गया है;

(ञ) ''डिजिटाइज'' से भौतिक या एनालॉग जानकारी, जैसे दस्तावेजों, अभिलेख या प्रतिबिम्ब को डिजिटल प्रारूप में परिवर्तित करने की प्रक्रिया करना अभिप्रेत है, जिसे इलेक्ट्रॉनिक रूप से संसाधित, संगृहीत और प्रसारित किया जा सकता है;

(ट) ''ऑनलाइन सिस्टम'' से, सरकार द्वारा बनाया गया कम्प्यूटर एप्लिकेशन अभिप्रत है, जो इंटरनेट पर खुले तौर पर उपलब्ध है;

(ठ) ''ऑनलाइन अभिलेख कक्ष'' से, ऐसा अभिलेख कक्ष अभिप्रेत है जिसके अभिलेख को डिजिटल अभिलेख में संपरिवर्तित किया गया है;

(ड) ''ऑनलाइन प्रतिलिपि एजेंसी'' से, डिजिटल अभिलेख कक्ष की बाबत प्रतिलिपि एजेंसी अभिप्रेत है;

(ढ) ''पेमेंट गेटवे'' से, इंटरनेट पर विभिन्न सेवाओं के लिए एक प्रणाली अभिप्रेत है; जो क्रेडिट कार्ड/डेबिट कार्ड और यूनिफाइड पेमेंट इंटरफेस (यू.पी.आई.) सहित अन्य इलेक्ट्रानिक संदत्त प्रणालियों का उपयोग करके किए गए लेन-देन के प्राधिकरण और निपटान की सुविधा प्रदान करता है;

(ण) ''पी.डी.एफ. दस्तावेज'' से, एडोब सिस्टम द्वारा रचित (बनाया गया) एक प्रारूप/फाइल अभिप्रेत है, जो पोर्टेबल दस्तावेज प्रारूप (पी.डी.एफ.) के रूप से ज्ञात है, जिसका उपयोग एप्लिकेशन सॉफ्टवेयर, हार्डवेयर या ऑपरेटिंग सिस्टम से स्वतन्त्र रीति से दस्तावेज प्रस्तुत करने के लिए किया जाता है और इसमें टेक्स्ट, प्रतिबिंब अंतर्विष्ट हो सकते हैं और अन्य तत्व तथा बहुधा आधिकारिक प्रपत्रों और रिकार्ड के लिए उपयोग किए जाते हैं;

(त) ''पीठासीन अधिकारी'' से, राजस्व न्यायालय का प्रभावी राजस्व अधिकारी अभिप्रेत है जिसके पर्यवेक्षण में ऑनलाइन प्रतिलिपि एजेंसी कृत्य करती है;

(थ) ''क्यूआर कोर्ड'' से, त्वरित प्रतिक्रिया कोड, एक प्रकार का मैट्रिक्स बारकोड (या दो-आयामी बारकोड) जिसमें मशीन पढ़नीय प्रारूप में सूचना अन्तर्विष्ट होती है और एन्कोडेड डेटा तक त्वरित पहुंच के लिए स्मार्टफोन या अन्य क्यूआर कोड रीडर का उपयोग करके स्कैन किया जा सकता है जैसे यू.आर.एल., संपर्क सूचना या अन्य पाठ अभिप्रेत है;

(द) ''रीडर'' से, न्यायालय में तैनात किया गया कोई अधिकारी अभिप्रेत है, जो न्यायालय के पीठासीन अधिकारी के सीधे पर्यवेक्षण के अधीन कार्य, तथा न्यायालय से संबंधित विभिन्न कार्यों में सहायता और न्यायालय कार्यवाही के सुचारू कृत्य को सुनिश्चित करता है;

(ध) ''रिकार्ड कक्ष'' से, राजस्व विभाग के कार्यालय की शाखा अभिप्रेत है, जहां राजस्व न्यायालय के मामले की फाइलों के साथ-साथ राजस्व रिकार्ड परेषण के पश्चात्‌ रखे जाते हैं;

(न) ''चालन नस्तियां'' से, राजस्व/न्यायालय नस्तियां अभिप्रेत हैं जिन्हें अभिलेख कक्ष में परेषित नहीं किया गया है;

(प) ''एस.एम.एस.'' से, लघु संदेश सेवा अभिप्रेत है, जो अधिकांश टेलीफोन, इंटरनेट और मोबाइल डिवाइस सिस्टम का टेक्स्ट मैसेजिंग सेवा घटक है जो उपकरणों के बीच लघु संदेश भेजने की अनुमति देता है;

11142 राजपत्र, हिमाचल प्रदेश, 02 जनवरी, 2025/12 पौष, 1946 (फ) ''यूनिफाइड पेमेंट्‌स इंटरफेस (यू.पी.आई.)'' से, भारतीय राष्ट्रीय भुगतान निगम (एन.पी.सी.

आई.) द्वारा विकसित वास्तविक समय में संदत्त प्रणाली, मोबाइल प्लेटफॉर्म के माध्यम से बैंक खातों के बीच तत्काल धन हस्तांतरण की सुविधा प्रदान करती है, अभिप्रेत है;

(ब) यू.आर.एल.'' से, इंटरनेट पर संसाधनों तक पहुंचने के लिए उपयोग किए गए एक संदर्भ या पता, यूनिफॉर्म रिसोर्स लोकेटर अभिप्रेत हैं;

(2) उन समस्त शब्दों और पदो ंके जो इन नियमों में प्रयुक्त है किन्तु परिभाषित नहीं है वे ही अर्थ होंगे जो हिमाचल प्रदेश भू-राजस्व अधिनियम, 1954(1954 का अधिनियम संख्यांक 6) और हिमाचल प्रदेश वित्तायुक्त (राजस्व और अपील) कार्यालय के लिए प्रतिलिपि एजेंसी नियम, 1993 और हिमाचल प्रदेश उपायुक्त कार्यालय प्रतिलिपि एजेंसी नियम, 1994 में उनके है अन्य शब्दों का अपना सामान्य रूप से स्वीकृत शब्दकोश अर्थ होगा।

(3) पुरूष लिंग के समस्त संदर्भों को सभी लिंंगों के संदर्भ के रूप में माना जा सकता है। 3. ऑनलाइन प्रतिलिपि एजेंसियां और उनके कर्मचारिवृंद.--(1) ऑनलाइन प्रतिलिपि एजेंसियां समस्त न्यायालयों में जहां प्रतिलिपि एजेंसियां विद्यमान हैं।

(2) पीठासीन अधिकारी निम्नलिखित कृत्यों के लिए अपने न्यायालय या कार्यालय से कर्मचारिवृंद को तैनात कर सकेगा।

(क) प्रतिलिपि लिपिक, जो आवेदनों के प्रक्रमण और आवेदक को प्रतियां उपलब्ध कराने के लिए उत्तरदायी होगा।

(ख) प्रतिलिपि पर्यवेक्षक, प्रतिलिपि लिपिक से वरिष्ठ कर्मचारी होगा, जो अपने कार्य का पर्यवेक्षण करेगा।

(ग) प्रभारी अधिकारी, जो ऑनलाइन प्रतिलिपि करने वाली एजेंसी का समग्र प्रभारी होगा। (3) प्रभारी अधिकारी जनता को प्रतिलिपि उपलब्ध कराने के लिए उत्तरदायी होगा। वह उपगृहीत की गई फीस के औचित्य और कार्य के व्यवस्थित संचालन के लिए भी उत्तरदायी होगा।

4. अभिलेखों की प्रतिलिपियां प्राप्त करने के हकदार व्यक्ति.--(1) समस्त व्यक्ति जो प्रतिलिपि एजेंसियाें के लिए सुसंगत नियमों के अनुसार प्रतिलिपि प्राप्त करने के हकदार हैं, वे ऑनलाइन प्रतिलिपि ऐजेंसी से भी प्रतिलिपि प्राप्त करने के पात्र होंगे।

(2) किसी व्यक्ति के आवेदन करने के अधिकार के संबंध में किसी विवाद के मामले में, प्रतिलिपि पर्यवेक्षक मामले का निर्णय करेगा।

(3) डिजिटल अभिलेख की प्रतिलिपि आवेदक को उसी भाषा और प्रारूप में उपलब्ध कराई जाएगी जिसमें वह उपलब्ध है।

5. आवेदन प्रक्रिया.--(1) आवेदक द्वारा इन नियमों से संलग्न उपाबंध-I में आवेदन प्रस्तुत किया जाएगा।

(2) जहां आवेदक ने कागज पर आवेदन प्रस्तुत किया है, वहां प्रतिलिपि लिपिक उसका विवरण ऑनलाइन प्रणाली पर दर्ज करेगा।11143 राजपत्र, हिमाचल प्रदेश, 02 जनवरी, 2025/12 पौष, 1946 (3) जहां सरकार ने आवेदक द्वारा सीधे ऑनलाइन आवेदन करने का उपबंध किया है, वहां आवेदक सीधे ऐसी प्रणाली पर आवेदन कर सकेगा।

(4) यदि किसी व्यक्ति को किसी अभिलेख की तत्काल आवश्यकता है, तो वह आवेदन प्रारूप में ऐसी तात्कालिकता की सूचना दे सकेगा।

6. आवेदनों का प्रक्रमण.--(1) प्रतिलिपि लिपिक, कागज पर आवेदन में दी गई आवश्यकता के अनुसार दस्तावेजों की खोज और समानुक्रमित करेगा।

(2) समाकलन करने पर प्रतिलिपि लिपिक ऑनलाइन प्रणाली पर ली जाने वाली फीस की गणना करेगा, तथा एस.एम.एस. चालान(बीजक) के माध्यम से आवेदक को इसकी सूचना देगा।

(3) जहां आवेदक सीधे ऑनलाइन प्रणाली पर आवेदन करता है, वहां आवेदक स्वयं अपने लिए दस्तावेजों की खोज और समानुक्रमित करेगा, तथा उन्हें जारी करने के लिए प्रस्तुत करेगा तथा उसके द्वारा प्रस्तुत दस्तावेजों के आधार पर, फीस की गणना एस.एम.एस. बीजक के माध्यम से उसे स्वचालित रूप से सूचित की जाएगी।

(4) यदि आवेदक को दस्तावेजों की तत्काल आवश्यकता होगी तो अतिरिक्त तात्कालिकता फीस भी ली जाएगी।

7. प्रतिलिपि फीस का संदाय.--(1) प्रतिलिपि फीस में आवेदन पर कार्रवाई की लागत, तात्कालिकता फीस और प्रतियां उपलब्ध कराने की लागत पृथक से सम्मिलित होगी और इसे पृथक से प्रभारित किया जा सकेगा।

(2) इन नियमों के अधीन प्रतिलिपि फीस वही होगी जो सरकार द्वारा समय-समय पर अधिसूचित की जाएगी। आवेदन में यह ब्यौरा अन्तर्विष्ट होगा कि फीस से प्राप्त रकम राज्य और अन्य संस्थाओं के मध्य किस प्रकार वितरित की जाएगी।

(3) एस.एम.एस. बीजक तैयार होने पर, आवेदक को यू.पी.आई. के माध्यम से प्रतिलिपि एजेंसी को उचित रकम का संदाय करना होगाः

(i) यू.पी.आई. के माध्यम से सफल भूगतान के पश्चात्‌, आवेदक को इसका प्रमाण प्रतिलिपि लिपिक को अपने मोबाइल फोन पर दिखाना होगा।

(ii) इस बात से समाधान होने पर कि सुसंगत रकम का सफलतापूर्वक भूगतान (संदाय) कर दिया गया है, प्रतिलिपि लिपिक ऑनलाइन प्रणाली पर यू.पी.आई. लेन-देन आइर्. डी. दर्ज करेगा ताकि किए गए संदाय का अभिलेख किया जा सके।

(4) यदि आवेदक ने सीधे ऑनलाइन प्रणाली पर आवेदन किया है, तो फीस का संदाय ऑनलाइन प्रणाली पर दिए गए संदाय गेटवे के माध्यम से किया जाएगा।

(i) सफल संदाय होने पर, एक एस.एम.एस. स्वचालित रूप से तैयार रसीद आवेदक को भेज दी जाएगी।

(ii) संदाय गेटवे के माध्यम से किया गया संदाय ऑनलाइन प्रणाली पर तुरन्त सत्यापित हो जाएगा।

8. जहां आवेदन कागज पर किया गया हो वहां दस्तावेजों का प्रदाय.--(1) सुसंगत फीस के सफल संदाय पर, प्रतिलिपि लिपिक संकलित दस्तावेजों को मुद्रित करेगा। 11144 राजपत्र, हिमाचल प्रदेश, 02 जनवरी, 2025/12 पौष, 1946 (2) प्रतिलिपि लिपिक मुद्रित अभिलेख (प्रिंट आऊट) के प्रत्येक पृष्ठ के पीछे निम्नलिखित चिपकाएगा और लिखेगा।

(3) प्रतिलिपि लिपिक सभी दस्तावेजाें को समानुक्रमित करेगा और उन्हें टैग या स्टैपल के माध्यम से एक साथ सिल देगा, और आवेदक को प्रदाय करेगा।

(4) आवेदक द्वारा दस्तावेजों की सफलतापूर्वक प्राप्ति पर, प्रतिलिपि लिपिक उसे ऑनलाइन प्रणाली पर अभिलिखित करेगा, जिससे प्रतियां सफलतापूर्वक प्रदाय होने का एक एस.एम.एस. संदेश आवेदक को भेजा जाएगा।

9. जहां ऑनलाइन प्रणाली पर आवेदन करने पर दस्तावेजों का प्रदाय.--(1) सुसंगत फीस के सफल संदाय पर, ऑनलाइन प्रणाली आवेदक द्वारा किए गए चयन के अनुसार स्वचालित रूप से पी.डी.एफ. दस्तावेज तैयार कर देगी।

(2) पी.डी.एफ. दस्तावेज डाउनलोड करने के पश्चात्‌ आवेदक इसे अपने स्तर पर प्रिंट कर सकेगा। (3) पी.डी.एफ. दस्तावेज के प्रत्येक पृष्ठ के नीचे एक अद्वितीय क्यूआर कोड होगा, जिसमें निम्नलिखित सूचना होगी :

(i) आवेदक का नाम (ii) आवेदन की तारीख (iii) आवेदन का प्रयोजन (iv) संदाय की गई फीस की रकम (v) फीस संदाय की तारीख (vi) उत्पन्न पी. डी. एफ. दस्तावेज का यू. आर. एल.

(4) क्यू आर कोड को मोबाइल फोन पर किसी भी क्यू आर कोड स्कैनर एप्लीकेशन से स्कैन किया जा सकेगा।

(5) क्यू आर कोड किसी भी व्यक्ति को तैयार किए गए दस्तावेज के विवरण को सत्यापित करने, दस्तावेज को डाऊनलोड करने और उसकी विषय वस्तु को प्रमाणित करने में सक्षम करेगा।

(6) क्यू आर कोड किसी भी व्यक्ति को सुसंगत अभिलेख के लिए आवेदक द्वारा संदाय किए गए प्रतिलिपि फीस को सत्यापित करने में सक्षम करेगा।

10. अभिलेखों को नष्ट करना.--(1) जहां किसी निश्चित अभिलेख कमरे के अभिलेखों को डिजिटल कर दिया गया है। ऐसे अभिलेखों को नष्ट किया जा सकेगा।

(2) सरकार ऐसे अभिलेखों को नष्ट करने के लिए प्रक्रिया बनाएगी।

(3) ऐसे नष्ट करने की प्रक्रिया में डिजिटलीकरण के पश्चात्‌ विभिन्न प्रकार के अभिलेखों को रखने की अवधि का ब्यौरा सम्मिलित होगा।

(4) सरकार ऑनलाइन अभिलेख के बैकअप (पूर्तिकर) के लिए प्रक्रिया बनाएगी।

11. कठिनाइयों को दूर करने की शक्ति.--यदि इन नियमों के उपबंधों को प्रभावी करने में कोई कठिनाई उत्पन्न होती है, तो राज्य सरकार ऐसे आदेश द्वारा, जो राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशित हो, कठिनाई को दूर करने के लिए आवश्यक प्रतीत होने वाले उपबंध कर सकेगी। इसमें तेजी से बदलते तकनीकी परिदृष्य के संदर्भ में स्पष्टीकरण भी सम्मिलित होगा।11145 राजपत्र, हिमाचल प्रदेश, 02 जनवरी, 2025/12 पौष, 1946 12. निरसन और व्यावृति.--(1) कुछ जिलों में अभिलेख का डिजिटलीकरण पूर्ण हो चुका है, जबकि राज्य के शेष जिलों में डिजिटलीकरण की प्रक्रिया जारी है। हिमाचल प्रदेश वित्तायुक्त (राजस्व एवं अपील) कार्यालय प्रतिलिपि नियम, 1993 अधिसूचना संख्या रैव 1-3(स्टाम्प)2/88 तारीख 21.01.1993 द्वारा अधिसूचित तथा हिमाचल प्रदेश उपायुक्त कार्यालय प्रतिलिपि एजेंसी नियम, 1994 अधिसूचना संख्या रैव-1-3(स्टाम्प)2/88 तारीख 13.11.1997 द्वारा अधिसूचित, तब तक लागू रहेंगे जब तक अभिलेख का डिजिटलीकरण सभी प्रकार से पूर्ण नहीं हो जाता। पूरे राज्य में डिजिटलीकरण पूर्ण हो जाने पर राज्य सरकार द्वारा विद्यमान नियमों का निरसन करने की तारीख अधिसूचित की जाएगी।

No. Rev. 1-3 (Stamp) 2/88.—WHEREAS ,the draft Online Copying Agency Rules ,2024 were published in the Rajpatra (e-Gazette), Himachal Pradesh on 04-09-2023 for inviting11146 राजपत्र, हिमाचल प्रदेश, 02 जनवरी, 2025/12 पौष, 1946 objection(s) and suggestion(s) from the general public vide this department notification of even number dated 12-08-2024 as required under section 169 of the Himachal Pradesh land revenue act, 1954 (Act No.6 of 1954).

AND WHEREAS, no objection(s) or suggestion(s) has been received in this behalf, within the stipulated period;

NOW, THEREFORE ,in exercise of the powers conferred upon him, under clause (d) of the sub section (1) of Section 168 of the Himachal Pradesh Land Revenue Act 1954 (Act No.6 of 1954), the Financial Commissioner (Revenue) to the Government of Himachal Pradesh, makes the following rules to regulate the supply of copies of records under his control and under the control of Financial Commissioner (Appeals) to the Government of Himachal Pradesh ,Divisional Commissioner, Deputy commissioner, Deputy Commissioners' ,Sub divisional collectors and assistant collectors Ist and IInd grade for carrying the purposes of the aforesaid act namely-;

1. Short title, commencement and applicability.—(1) These rules may be called the Online Copying Agency Rules, 2024.

(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

(3) These rules shall be applicable in all the Record Rooms of the Department of Revenue, Himachal Pradesh.

2. Definitions.—(1) In these rules, unless there is anything repugnant in the subject or context:

(a) "Annexure" means annexure annexed to these rules ;

(b) "Copies" mean reproductions of original documents, files, or records that are part of legal, administrative, land records or court proceedings. These can be digital or physical copies and are produced as per official request from parties entitled to them under the law.

(c) "Consigned" means to the state of safe custody of any file or document in the record room;

(d) "Consigned files" means the Revenue court files which have been consigned in the record room;

(e) "Copying agency" means an agency as defined in the "Copying Agency Rules for the offices of the Financial Commissioner (Revenue and Appeals), 1993", and the "Copying Agency Rules for the offices of the Deputy Commissioners in Himachal Pradesh, 1994";

(f) "Copying clerk" means the person who shall process and supply digital records in the online copying agency;

(g) "Copying supervisor" means a senior official of the concerned office who shall supervise the operations in the online copying agency;

(h) "Court" means all the Revenue courts functioning in Himachal Pradesh;

(j) "Digitise" means the process of converting physical or analog information, such as documents, records, or images, into a digital format, which can be processed, stored, and transmitted electronically.

(k) "Online system" means a computer application made by the government which is openly accessible on the internet;

(l) "Online record room" means a record room whose records have been converted to digital records;

(m) "Online copying agency" means an copying agency related to a digital record room;

(n) "Payment Gateway" means a system for the payment of various services on the internet that facilitates the authorization and settlement of transactions made using credit cards, debit cards, and other electronic payment methods, including Unified Payments Interface (UPI);

(o) "PDF document" means a file format created by Adobe Systems known as Portable Document Format (PDF), which is used to present documents in a manner independent of application software, hardware, or operating systems and can contain text, images, and other elements, and are often used for official forms and records;

(p) "Presiding officer" means the revenue officer in charge of a Revenue Court, under whose supervision an online copying agency functions;

(q) "QR code" means Quick Response Code, a type of matrix barcode (or two-dimensional barcode) that contains information in a machine-readable format and can be scanned using a Smartphone or other QR code reader to quickly access the encoded data, such as URLs, contact information, or other text;

(r) "Reader" means an official posted in the court who works under the direct supervision of the presiding officer of the court, assisting in various tasks related to court and ensuring the smooth functioning of court proceedings;

(s) "Record room" means the branch in an office of the Revenue Department, where the revenue court case files as well as Revenue records are kept after consignment;

(t) "Running files" means the revenue/court files which have not been consigned in the record room;

(u) "SMS" means Short Message Service, a text messaging service component of most telephone, internet, and mobile device systems that allows the sending of short text messages between devices;

(v) "Unified Payments Interface (UPI)" means a real-time payment system developed by the National Payments Corporation of India (NPCI), facilitating instant money transfer between bank accounts through a mobile platform;

(w) "URL" means Uniform Resource Locator, a reference or address used to access resources on the internet.

(2) All other words and expressions used herein but not defined in these rules shall have the same meanings as have been assigned to them in the Himachal Pradesh Land Revenue Act, 1954 (6 of 1954), and the Copying Agency Rules for the offices of Financial Commissioner (Revenue and Appeals), 1993 and Copying Agency (for the offices of the Deputy Commissioners in Himachal Pradesh) Rules, 1994. Other words shall have their generally accepted dictionary meanings.

(3) All references to the male gender may be construed to be references to all genders.

3. Online copying agencies and their staff.—(1) Online copying agencies shall be established in all courts where copying agencies exist.

(2) The presiding officer may deploy staff from his court or office for the following functions:—

(a) Copying clerk, who shall be responsible for processing of the applications and providing copies to the applicant.

(b) Copying supervisor, an employee senior to the copying clerk, who shall supervise his work.

(c) Officer-in-charge, who shall be the overall in charge of the online copying agency.

(3) The Officer-in-charge shall be responsible for the supply of copies to the public. He shall also be responsible for the correctness of fees levied and the orderly conduct of business.

4. Persons entitled to obtain copies of records.—(1) All persons who are entitled to receive copies as per the relevant rules for the copying agencies shall also be eligible to receive copies from online copying agencies.

(2) In case of any dispute regarding the entitlement of a person to apply, the copying supervisor shall decide the matter.

(3) Copy of digital record shall be supplied to the applicant in the language and form in which it exists.

5. Application process.—(1) Applications shall be submitted by an applicant in Annexure-I appended to these rules.

(2) Where an applicant has submitted an application on paper, the copying clerk shall enter the details of the same on the online system.

(3) Where the government has made provision for online application directly by the applicant on the online system, the applicant may directly apply on such system.

(4) In case any record is required by a person urgently, he may intimate such urgency in the application form.

6. Processing of applications.—(1) The copying clerk shall search for and collate documents as per the requirement given in the paper application.

(2) Upon collation, the copying clerk shall calculate the fees to be charged on the online system, and intimate the same to the applicant through an SMS invoice.

(3) Where the applicant directly applies on the online system, the applicant himself shall search for and collate documents required by him, and submit the same for issue and based on the documents compiled by him, calculation of fees shall be automatically intimated to him through an SMS invoice.

(4) In case documents are required by the applicant urgently, an additional urgency fee shall also be charged.

7. Payment of copying fees.—(1) Copying fees shall separately include the cost for processing an application, urgency fees and the cost for supply of copies, and may be charged separately.

(2) Copying fees under these rules shall be such as are notified by the government from time to time. The notification may contain the details of how the receipts from the fees shall be distributed between the state and other entities.

(3) Upon the generation of an SMS invoice, the applicant shall pay relevant amount at the copying agency through UPI (Unified Payment Interface).

(a) Upon successful payment through UPI, the applicant shall show the proof thereof to the copying clerk on his mobile phone.

(b) Upon satisfaction that the relevant amount has been successfully paid, the copying clerk shall enter the UPI transaction ID on the online system so as to record the payment made.

(4) In case the applicant has directly applied on the online system, payment of fees shall be done through the payment gateway given on the online system.

(a) Upon successful payment, an SMS receipt is automatically generated and sent to the applicant.

(b) Payment through payment gateway is instantly verifiable on the online system.

8. Supply of documents where application is made on paper.—(1) Upon successful payment of the relevant fees, the copying clerk shall print the collated documents.

(2) The copying clerk shall affix and write the following on the back of each page of printout:

(3) The copying clerk shall collate all the documents and stitch them together either through tag or staple, and supply the same to the applicant.

(4) Upon successful receipt of the documents by the applicant, the copying clerk shall record the same on the online system, which will trigger an SMS message of successful supply of copies and sent to the applicant.

9. Supply of documents where application is made on online system.—(1) Upon successful payment of the relevant fees, the online system will automatically generate the PDF document as per the selection made by the applicant.

(2) After downloading the PDF document, the applicant may print it at his level.

(3) Each page of the PDF document shall contain a unique QR code at the bottom of the page, which shall contain the following information:

(i) Name of applicant (ii) Date of application (iii) Purpose of application (iv) Amount of fees paid (v) Date on which fees paid (vi) URL of the PDF document generated

(4) The QR code can be scanned with any QR code scanner application on a mobile phone.

(5) The QR code will enable any person to verify the details of the document generated, download the document, and to certify the contents.

(6) The QR code will enable any person to verify the copying fees paid by the applicant for the relevant records.

10. Destruction of records.—(1) Where records have been digitized for a certain record room, such records may be destroyed.

(2) The government shall make procedure for such destruction of records.

(3) The procedure for such destruction shall contain details of the period of retention of various kinds of records after digitization.

(4) Government shall make procedures for the backup of online records.

11. Power to remove difficulties.—In case any difficulty or uncertainty arises in giving effect to the provisions of these rules, the State Government may, by order published in Rajpatra, Himachal Pradesh, make provisions as may appear to be necessary for removing the difficulty. This shall also include clarification in context of the swiftly changing technological scenario.

12. Repeal and saving.—The digitization of the record has been completed in some of the Records Rooms, whereas process of digitization of the all the Record Rooms present all over the state is going on. The Copying Agency Rules for the office of the Financial Commissioner (Revenue and Appeals), Himachal Pradesh, 1993 notified vide notification number Rev 1-3 (Stamp) 2/88 dated 21-01-1993 and the Copying Agency (for the offices of Deputy Commissioners in the Himachal Pradesh) Rules 1994 notified vide notification number Rev 1-3 (Stamp) 2/88 dated 13-11-1997 shall also remain in force until digitization of record is completed in all respects. The date of repealing the existing rules shall be notified by the State Government as and when the digitization is completed in whole of the State.
