सं0ःपीसीएच-एचए(1)19/2008-III-1073-1229-लूज.--इस विभाग की समसंख्यक अधिसूचना तारीख 17 दिसम्बर, 2024 के अन्तर्गत, हिमाचल प्रदेश पंचायती राज (सामान्य) संशोधन नियम, 2024 का प्रारूप, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक 4) की धारा 186 के उपबन्धों के अधीन यथा अपेक्षित जनसाधारण से आक्षेप(पों) और सुझाव(वों) आमन्त्रित करने के लिए राजपत्र हिमाचल प्रदेश में तारीख 21 दिसम्बर, 2024 को प्रकाशित किए गए थे;

और नियत अवधि के दौरान इस निमित्त कोई भी आक्षेप/सुझाव प्राप्त नहीं हुआ है;

अतः राज्यपाल हिमाचल प्रदेश, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक 4) की धारा 186 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, अधिसूचना संख्या पीसीएच-एचए (3)1/94-19181-362, तारीख 25 नवम्बर, 1997 द्वारा अधिसूचित और राजपत्र (असाधारण) हिमाचल प्रदेश में तारीख 25 नवम्बर, 1997 को प्रकाशित हिमाचल प्रदेश पंचायती राज (सामान्य) नियम, 1997 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः-

1. प्रारूप नियम संक्षिप्त नाम और प्रारम्भ.-(1) इन नियमों का संक्षिप्त नाम, हिमाचल प्रदेश पंचायती राज (सामान्य) संशोधन नियम, 2024 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। परन्तु नियम 3 के प्रावधान उस तारीख से लागू होंगे जिसे राज्य सरकार द्वारा अधिसूचित किया जाएगा। 2. नियम 2 का संशोधन.--हिमाचल प्रदेश पंचायती राज (सामान्य) नियम, 1997 (जिन्हें इसमें इसके पश्चात्‌ उक्त नियम कहा गया है) के नियम 2 के उप-नियम (1) के खण्ड (खख) के स्थान पर निम्नलिखित रखा जाएगा, अर्थातः-

''(खख) वास्तविक निवासी से ऐसा व्यक्ति अभिप्रेत है, जिसको सक्षम राजस्व अधिकारी द्वारा वास्तविक हिमाचली प्रमाण-पत्र जारी किया गया है।

3. नियम 9 का संशोधन.-उक्त नियमों के नियम 9 में,-

(क) उप-नियम (1) में, ''पन्द्रह दिन'' शब्दों के स्थान पर ''सात दिन'' शब्द रखे जाएंगे, और (ख) उप-नियम (2) में, ''तीस दिन'' शब्दों के स्थान पर ''तीन दिन'' शब्द रखे जाएंगे, और 4. नियम 10 का संशोधन.-उक्त नियमों के नियम 10 के उप-नियम (1) के पश्चात्‌ निम्नलिखित उप-नियम (1-क) जोड़ा जाएगा, अर्थातः-

''(1-क) बैठक की कार्यवाहियों को पंचायती राज विभाग द्वारा उपलब्ध कराए गए रूपविधान और सॉफ्टवेयर में ऑनलाइन भी अभिलिखित की जा सकेंगी।''

5. नियम 21 का संशोधन.-उक्त नियमों के नियम 21 के उप-नियम (1) में ''जो उस गांव के वास्तविक निवासी हैं जो उस सभा क्षेत्र का भाग है,'' शब्दों के स्थान पर ''जो हिमाचल प्रदेश के वास्तविक निवासी हैं और उस गांव के भीतर निवास करते हैं जो सभा क्षेत्र का भाग है,'' शब्द रखे जाएंगे।12543 राजपत्र, हिमाचल प्रदेश, 28 जनवरी, 2025/08 माघ, 1946 6. नियम 25 का संशोधन.-उक्त-नियमों के नियम 25 में, ''सात दिन'' शब्दों के स्थान पर ''तीन दिन'' शब्द रखे जाएंगे।

7. नियम 27 का संशोधन.-उक्त नियमों के नियम 27 के उप-नियम (1) के पश्चात्‌ निम्नलिखित उप-नियम (1-क) जोड़ा जाएगा, अर्थातः-

''(1.क) बैठक की कार्यवाहियों को पंचायती राज विभाग द्वारा उपलब्ध कराए गए रूपविधान और सॉफ्टवेयर में ऑनलाइन भी अभिलिखित की जा सकेंगी।''

8. नियम 32 का संशोधन.-उक्त-नियमों के नियम 32 में, ''पंचायत समिति'' शब्दों के स्थान पर ''उप मण्डल अधिकारी (नागरिक)'' शब्द रखे जाएंगे।

9. नियम 97 का संशोधन.-उक्त नियमों के नियम 97 के उप-नियम (3) के पश्चात्‌ निम्नलिखित उप-नियम (3-क) जोड़ा जाएगा, अर्थातः-

''(3-क) बैठक की कार्यवाहियों को पंचायतीराज विभाग द्वारा उपलब्ध कराए गए रूप विधान और सॉफ्टवेयर में ऑनलाइन भी अभिलिखित की जा सकेंगी।''

10. नियम 105 का संशोधन.-उक्त नियमों के नियम 105 के उप-नियम (3) के पश्चात्‌ निम्नलिखित उप-नियम (3-क) जोड़ा जाएगा, अर्थातः-

NOTIFICATION

Shimla-171 009, the 23rd January, 2025

No. PCH-HA(1)19/2008-III-1073-1229.—Whereas the draft Himachal Pradesh Panchayati Raj (General) Amendment Rules, 2024 were notified vide this department notification of even number dated 17-12-2024 and published in Rajpatra of Himachal Pradesh on dated 21-12-2024 for inviting objections and suggestions from general public under the provision of Section 186 of Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994).

And whereas, no objection /suggestion has been received in this behalf during the stipulated period;

Now, therefore, in exercise of the powers conferred by Section 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994), the Governor of Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Panchayati Raj (General) Rules, 1997, notified vide Notification No.PCH-HA(3)-1/94-19181-362 dated 25-11-1997 and published in Rajpatra, Himachal Pradesh (Extra-ordinary) on dated 25-11-1997, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Panchayati Raj (General) Amendment Rules, 2024.

(2) They shall come into force from the date of publication in Rajpatra (e-Gazette) Himachal Pradesh but the provision of Rule 3 will come in force from such date as may be notified by the State Government.

2. Amendment of Rule 2.—In rule 2 of the Himachal Pradesh Panchayati Raj (General) Rules (hereinafter referred to as "said rules"), for clause (bb) of sub- rule (1), the following shall be substituted, namely:—"(BB) bonafide resident shall mean a person who has been issued a bonafide Himachali Certificate by a Competent Revenue Officer".

3. Amendment of Rule 9.—In Rule 9 of the said rules,—

(a) in sub-rule (1), for the words "fifteen days" the words "seven days" shall be substituted; and

(b) in sub-rule (2) for the words "thirty days" the words "three days" shall be substituted.

4. Amendment of Rule 10.—In rule 10 of the said rules, after, after sub-rule (1) the following sub-rule (1-A) shall be added, namely :—

"(1-A) The proceedings of the meeting may also be recorded online in the format and software, as may be made available by the Panchayati Raj Department".

5. Amendment of Rule 21.—In rule 21 of the said rules, in sub-rule (1) for the words "of the village which forms part of the Sabha area" the words "of Himachal Pradesh and reside within the village which forms part of the sabha area" shall be substituted.

6. Amendment of Rule 25.—In Rule 25 of the said rules, for the words "seven days" the words "three days" shall be substituted.

7. Amendment of Rule 27.—In rule 27 of the said rules, after sub-rule (1) the following sub-rule (1-A) shall be added, namely:—

"(1-A) The proceedings of the meeting may also be recorded online in the format and software, as may be made available by the Panchayati Raj Department".

8. Amendment of Rule 32.—In Rule 32 of the said rules, for the words "Panchayat Samiti" the words "Sub-Divisional Officer (Civil)"shall be substituted.

9. Amendment of Rule 97.—In rule 97 of the said rules, after sub-rule (3) the following sub-rule (3-A) shall be added namely:—

"(3-A) The proceedings of the meeting may also be recorded online in the format and software, as may be made available by the Panchayati Raj Department".

10. Amendment of Rule 105.—In rule 105 of the said rules, after sub-rule (3), the following sub-rule (3-A) shall be added, namely:—

"(3-A) The proceedings of the meeting may also be recorded online in the format and software, as may be made available by the Panchayati Raj Department".

11. Substitution of Form 19.—Form-19 appended to the said rules, shall be substituted, namely:—
