संख्याः ईडीएन-सी-ए(3)-2/2020-पार्ट-I.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के 249-राजपत्र/2025-20-02-2025 (13345) 13346 राजपत्र, हिमाचल प्रदेश, 20 फरवरी, 2025/01 फाल्गुन, 1946 परामर्श से, इस विभाग की अधिसूचना संख्याः ईडीएन-सी-ए(3)-2/2020 तारीख 06 जून 2024 द्वारा अधिसूचित हिमाचल प्रदेश प्रारम्भिक शिक्षा विभाग मे प्रशिक्षित स्नातक अध्यापक (कला/नॉन- मेडिकल/मेडिकल), ग्रुप-सी, के पद के लिए भर्ती और प्रोन्नति नियम, 2024 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ।	(1)	इन नियमो ं का संक्षिप्त नाम हिमाचल प्रदेश प्रारम्भिक शिक्षा विभाग, प्रशिक्षित स्नातक अध्यापक(कला/नॉन- मेडिकल/ मेडिकल), ग्रुप-सी भर्ती और प्रोन्नति(संशोधन) नियम, 2025 है।
	(2)	ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे।
2. उपाबन्ध-क का संशोधन।		हिमाचल प्रदेश प्रारम्भिक शिक्षा विभाग, प्रशिक्षित स्नातक अध्यापक, (कला/नॉन-मेडिकल/मेडिकल), ग्रुप-सी, भर्ती और प्रोन्नति नियम, 2024 के उपबन्ध-क में,
	(क)	स्तम्भ संख्याः 7 के सामने विद्यमान उपाबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :- ( 1) अनिवार्य अर्हता(अर्हताएं)ः- 1. प्रशिक्षित स्नातक अध्यापक (कला)ः- (i) किसी मान्यता प्राप्त विश्वविद्यालय से या तो स्नातक में या तो स्नातकोत्तर में कम से कम पचास प्रतिशत अकों के साथ बी0ए0/ बी0कॉम/स्नातकोत्तर (किसी भी संकाय मेे े ं निष्णांत उपाधि, परन्तु अभ्यर्थियों ने स्नातक की उपाधि बी0ए0/बी0कॉम में उत्तीर्ण की हो) और एक वर्ष का शिक्षा स्नातक(बी0एड0)/दो वर्षीय शिक्षा स्नातक (बी0एड0)/राष्ट्रीय अध्यापक शिक्षा परिषद्‌ (एन0सी0टी0ई0) से मान्यता प्राप्त संस्थान से शिक्षा स्नातक (बी0एड0)। या न्यूनतम पचपन प्रतिशत अंकों के साथ स्नातकोत्तर (किसी भी संकाय म े े ं निष्णांत उपाधि, परन्तु अभ्यर्थियों ने स्नातक की उपाधि बी0ए0/बी0कॉम में उत्तीर्ण की हो) और राष्ट्रीय अध्यापक शिक्षा परिषद्‌ (एन0सी0टी0ई0) से मान्यता प्राप्त संस्थान से तीन वर्षीय एकीकृत शिक्षा स्नातक-शिक्षा निष्णांत (इंटिग्रेटिड बी0एड0-एम0एड0) या कम से कम पचास प्रतिशत अंकों के साथ सीनियर सेकेंडरी/दस जमा दो और प्रारम्भिक शिक्षा में चार वर्ष का स्नातक (बी0एल0एड0)।
		या कम से कम पचास प्रतिशत अंकों के साथ सीनियर सेकेंडरी/दस जमा दो और चार वर्षीय कला शिक्षा स्नातक (बी0ए0एजुकेशन)/बी0ए0 बी0एड0) या कम से कम पचास प्रतिशत अंकों के साथ बी0ए0/बी0कॉम और एक वर्ष की शिक्षा स्नातक बी0एड0 (विशेष शिक्षा)। और (ii) हिमाचल प्रदेश स्कूल शिक्षा बोर्ड धर्मशाला, जिला कांगड़ा या सरकार द्वारा प्राधिकृत किसी अन्य अभिकरण द्वारा सम्यक्‌ रूप से संचालित शिक्षक पात्रता परीक्षा (टी0ई0टी0) में उत्तीर्ण हो। 2 . प्रशिक्षित स्नातक अध्यापक (नॉन मेडिकल)ः (i) किसी मान्यता प्राप्त विश्वविद्यालय से या तो विज्ञान स्नातक (नॉन मेडिकल) में या तो स्नातकोत्तर मे ं कम से कम पचास प्रतिशत अकों के साथ बी0एससी0 (नॉन मेडिकल)/स्नातकोत्तर (विज्ञान स ंकाय के किसी भी विषय मेेें विज्ञान निष्णांत, परन्तु अभ्यर्थियों ने स्नातक की उपाधि बी0एससी0 (नॉन मेडिकल) में उत्तीर्ण की हो) और एक वर्ष का शिक्षा स्नातक (बी0एड0)/दो वर्षीय शिक्षा स्नातक (बी0एड0)/राष्ट्रीय अध्यापक शिक्षा परिषद्‌ (एन0सी0टी0ई0) से मान्यता प्राप्त संस्थान से शिक्षा स्नातक (बी0एड0)। या न्यूनतम पचपन प्रतिशत अंकों के साथ स्नातकोत्तर (विज्ञान संकाय के किसी भी विषय मेेें विज्ञान निष्णांत, परन्तु अभ्यर्थियों ने स्नातक की उपाधि बी0एससी0 (नॉन मेडिकल) में उतीर्ण की हो) और राष्ट्रीय आध्यपक शिक्षा परिषद (एन0सी0टी0ई0) से मान्यता प्राप्त संस्थान से तीन वर्षीय एकीकृत शिक्षा स्नातक-शिक्षा निष्णांत (बी0एड0-एम0एड0) । या कम से कम पचास प्रतिशत अंकों के साथ सीनियर सेकेंडरी/दस जमा दो विज्ञान(नॉन
		मेडिकल) और चार वर्ष का प्रारंभिक शिक्षा में स्नातक (बी0एल0एड0)। या कम से कम पचास प्रतिशत अंकों के साथ विज्ञान (नॉन मेडिकल) में सीनियर सेकेंडरी/दस जमा दो और चार वर्षीय बी0एस0सी0 (नॉन मेडिकल) शिक्षा(एड0)/बी0एस0सी0 (नॉन मेडिकल) बी0एड0। या क म से कम पचास प्रतिशत अंकों के साथ विज्ञान स्नातक(नॉन मेडिकल) और एक वर्षीय शिक्षा स्नातक (बी0एड0) (विशेष शिक्षा)। और (ii) हिमाचल प्रदेश स्कूल शिक्षा बोर्ड धर्मशाला, जिला कांगड़ा या सरकार द्वारा प्राधिकृत किसी अन्य अभिकरण द्वारा सम्यक्‌ रूप से संचालित शिक्षक पात्रता परीक्षा (टी0ई0टी0) में उत्तीर्ण हो। 3. प्रशिक्षित स्नातक अध्यापक (मेडिकल)ः किसी मान्यता प्राप्त विश्वविद्यालय से या तो (i) स्नातक(मेडिकल) में या तो स्नातकोत्तर में कम से कम पचास प्रतिशत अंकों सहित बी0एस0सी0 (मेडिकल)/स्नातकोत्तर (विज्ञान संकाय के किसी भी विषय मेंेे विज्ञान निष्णांत, परन्तु अभ्यर्थियों ने स्नातक की उपाधि बी0एस0सी0 (मेडिकल) में उत्तीर्ण की हो) और एक वर्षीय शिक्षा स्नातक (बी0एड0)/दो वर्षीय शिक्षा स्नातक (बी0एड0)/ राष्ट्रीय अध्यापक शिक्षा परिषद्‌ (एन0सी0टी0ई0) से मान्यता प्राप्त संस्थान से शिक्षा स्नातक (बी0एड0)। या न्यूनतम पचपन प्रतिशत अंकों के साथ स्नातकोत्तर (विज्ञान संकाय के किसी भी विषय मेें विज्ञान निष्णांत, परन्तु अभ्यर्थियों ने स्नातक की उपाधि बी0एस0सी0 (मेडिकल) में उत्तीर्ण की हो) और राष्ट्रीय अध्यापक शिक्षा परिषद्‌ (एन0सी0टी0ई0) से मान्यता प्राप्त संस्थान से तीन वर्षीय एकीकृत शिक्षा स्नातक-शिक्षा निष्णांत (बी0एड0-एम0एड0) । या
		कम से कम पचास प्रतिशत अंकों के साथ में सीनियर सेकेंडरी/दस जमा दो (विज्ञान- मेडिकल) और चार वर्षीय प्रारंभिक शिक्षा में स्नातक (बी0एल0एड0)। या कम से कम पचास प्रतिशत अंकों के साथ मे ं सीनियर सेकेंडरी/दस जमा दो विज्ञान (मेडिकल) और चार वर्षीय बी0एस0सी0 (मेडिकल) शिक्षा (एड0)/बी0एस0सी0 (मेडिकल) बी0एड0। या कम से कम पचास प्रतिशत अंकों के साथ विज्ञान(मेडिकल) स्नातक और एक वर्षीय शिक्षा स्नातक (बी0एड0) (विशेष शिक्षा)। और (ii) हिमाचल प्रदेश स्कूल शिक्षा बोर्ड धर्मशाला, जिला कांगड़ा या सरकार द्वारा प्राधिकृत किसी अन्य अभिकरण द्वारा सम्यक्‌ रूप से संचालित शिक्षक पात्रता परीक्षा (टी0ई0टी0) में उत्तीर्ण होः प रन्तु अभ्यर्थी ने दसवीं और बारहवीं की परीक्षा हिमाचल प्रदेश में स्थित किसी स्कूल/संस्थान से अवश्य उत्र्तीण की होः प रन्तु यह और कि यह शर्त हिमाचल प्रदेश के वास्तविक निवासियों को लागू नहीं होगी। (2) वाँछनीय अर्हता (अर्हताएं)ः हिमाचल प्रदेश की रूढ़ियों, रीतियों और बोलियों का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता। ि टप्पण (1).--परन्तु स्नातक में अंकों का न्यूनतम प्रतिशत उन पदधारियों पर लागू नहीं होगा जिन्होंने 29 जुलाई, 2011 से पहले ही शिक्षा स्नातक (बी0एड0) या प्रारम्भिक शिक्षा स्नातक में प्रवेश ले लिया था। ि टप्पण (2).--हिमाचल प्रदेश के एस0सी0/एस0टी0/ ओ0बी0सी0/पी0डब्ल्यू0डी0 प्रवर्गों से सम्बन्धित अभ्यर्थियों को न्यूनतम शैक्षिक अर्हताओं और टी0ई0टी0 के लिए न्यूनतम अर्हित अंकों में 5 प्रतिशत तक की छूट दी जाएगी।
		टिप्पण (3).--उन अभ्यर्थियों के मामले में जिन्होंने बी0एड0 पाठ्‌यक्रम मेें प्रवेश एम0ए0/एम0एस0सी0 में न्यूनतम 50 प्रतिशत अंक के आधार पर लिया है पर ही प्रशिक्षित स्नातक अध्यापक के पद के लिए विचार किया जाएगा। ि टप्पण (4).--विज्ञापन के प्रकाशन की तारीख को राष्ट्रीय अध्यापक शिक्षा परिषद्‌ (एन0सी0टी0ई0) द्वारा यथाविहित न्यूनतम अर्हता को इन भर्ती और प्रोन्नति नियमों के अनिवार्य अंग के रूप में समझा जाएगा और सरकार (प्रारंभिक शिक्षा विभाग, हि0प्र0) विज्ञापन के प्रकाशन की तारीख तक भर्ती अभिकरण को न्यूनतम अनिवार्य अर्हता में ऐसे परिवर्तन उपलब्ध करवाएगी।
	(ख)	स्तम्भ संख्याः 10 के सामने विद्यमान उपाबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :- मे ं ं (i) यथास्थिति, पचहत्तर प्रतिशत निम्नलिखित रीतियो सीधी भर्ती द्वारा, नियमित आधार पर या संविदा के आधार पर भर्ती द्वाराः- (क) 37.5 प्रतिशत यथास्थिति, नियमित आधार पर या संविदा के आधार पर हिमाचल प्रदेश राज्य चयन आयोग के माध्यम से । ( ख) 32.5 प्रतिशत बैच वाईच आधार पर । ( ग) समय-समय पर संशोधित स्कूल प्रबंधन समिति (एस0एम0सी0) पॉलिसी तारीख 17-07-2012 के अधीन सेवारत एस0एम0सी0 अध्यापकों (जिनकी कम से कम 5 वर्ष की सेवा हो) में से जो स्तंभ स ं ख्या-7 में यथाविहित वांछित शेैक्षिक अर्हता/ अर्हताएं रखते हों यथास्थिति हि0प्र0 राज्य चयन आयोग हमीरपुर/अन्य भर्ती अभिकरण/प्राधिकरण क े माध्यम से यथास्थिति नियमित आधार पर या स ंविदा के आधार पर सीमित सीधी भर्ती (एल0डी0आर0) के माध्यम से 05 प्रतिशतः परन्तु सीधी भर्ती किए जाने वाले अभ्यर्थियों के लिए निर्धारित ऊपरी आयु सीमा सरकार में पहले से सेवारत एस0एम0सी0 अध्यापकों को लागू नहीं होगी। (ii) 25 प्रतिशत प्रोन्नति द्वारा। ि टप्पण.--प्रारंभिक शिक्षा विभाग में समय-समय पर संशोधित स्कूल प्रबंधन सीमिति (एस0एम0सी0) पॉलिसी तारीख

	17-07-2012 के अधीन कार्यरत समस्त एस0एम0सी0 अध्यापकों के आमेलन के पश्चात्‌ पांच प्रतिशत सीमित सीधी भर्ती कोटा स्वतः ही समाप्त हो जाएगा और तत्पश्चात सीमित सीधी भर्ती हेतु घोषित पांच प्रतिशत कोटा बैचवाईज़ आधार पर सीधी भर्ती के लिए कोटे का अनिवार्य भाग समझा जाएगा।
(ग)	स्तम्भ संख्याः 11 के सामने विद्यमान के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :- (i) पन्द्रह प्रतिशत सेवारत जे0बी0टी0 में से प्रोन्नति द्वारा जो उपरोक्त स्तम्भ सख्या 7 में विहित शैक्षिक अर्हता रखते हो और जिनका कम से कम पांच वर्ष का ं नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके पांच वर्ष का नियमित सेवाकाल हो; ( ii) दस प्रतिशत सेवारत शास्त्रीय और भाषा अध्यापक (सी0 एण्ड वी0) में से प्रोन्नति द्वारा जो उपरोक्त स्तम्भ संख्या 7 में विहित अनिवार्य शैक्षिक अर्हता रखते हो और जिनका कम से कम पांच वर्ष का ं नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके पांच वर्ष का नियमित सेवाकाल हो । पदो को भरने के लिए निम्नलिखित रोस्टर का अनुसरण किया जाएगाः-

		1.	जे0बी0टी0		पहला, ग्यारहवां, बीसवां, इक्कीसवां, इकतीसवां, और चालीसवां
		2.	शास्त्रीय और भाषा (सी0 एण्ड वी0)		छठवां, सोलहवां, छब्बीसवां, और छत्तीसवां
		3.	सीधी भर्ती	हिमाचल प्रदेश राज्य चयन आयोग या कोई अन्य भर्ती अभिकरण के माध्यम से	द ू सरा, चौथा, सातवां, नौवां, बारहवां, चौदहवां, सतरहवां, उन्नीसवां, चौबीसवां, सत्ताईसवां, उनतीसवां, बत्तीसवां, चौतीसवां, सैतीसवां, और उनतालीसवां
	ि टप्पण-1.--रोस्टर प्रत्येक चालीसवें पद के पश्चात तब तक चक्रानुचक्रित किया जाता रहेगा जब तक कि समस्त प्रवर्गों को दी गई प्रतिशतता तक प्रतिनिधित्व प्राप्त नहीं हो जाता और तत्पश्चात्‌ रिक्ति को उसी प्रवर्ग से भरा जाएगा जिससे पद रिक्त हुआ हो । शिक्षा विभाग में समय-समय पर ि टप्पण-2.--प्रारंभिक संशोधित स्कूल प्रबंधन समिति (एस0एम0सी0) पॉलिसी तारीख 17-07-2012 के अधीन लगे हुए समस्त सेवारत एस0एम0सी0 अध्यापकों के आमेलन के पश्चात्‌ पांच प्रतिशत सीमित सीधी भर्ती कोटा स्वतः ही समाप्त हो जाएगा और तत्पश्चात सीमित सीधी भर्ती हेतु निर्धारित रोस्टर बिन्दु संख्या 35 व 38 को बैचवाईज़ आधार पर सीधी भर्ती के लिए कोटे का अनिवार्य भाग समझा जाएगा। (I) परन्तु प्रोन्नति के प्रयोजन के लिए प्रत्येक कर्मचारी को, जनजातीय/दुर्गम/अगम्य क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में पद (पदों) की ऐसे क्षेत्रों में पर्याप्त संख्या की उपलब्धता के अध्यधीन, कम से कम एक कार्यकाल तक सेवा करनी होगीः परन्तु यह और कि उपर्युक्त परन्तुक (I) उन कर्मचारियों क े मामले में लागू नहीं होगा, जिनकी अधिवर्षिता के लिए पांच वर्ष की या उससे कम की सेवा शेष रही हो। तथापि ऐसे पदधारियों को, उनकी प्रोन्नति पर, द ूरस्थ/ग्रामीण क्षेत्रों में तैनात/स्थानान्तरित किया जा सकेगाः परन्तु यह और भी कि उन अधिकारियों/कर्मचारियों को, जिसने जनजातीय/कठिन/दुर्गम क्षेत्रों और द ूरस्थ/ग्रामीण क्षेत्रों में कम से कम एक कार्यकाल तक सेवा नहीं की है, ऐसे क्षेत्र में उसके अपने संवर्ग (काडर) में सर्वथा उसकी वरिष्ठता के अनुसार स्थानान्तरण किया जाएगा। स्पष्टीकरण I.--उपर्युक्त परन्तुक (I) के प्रयोजन के लिए जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में "कार्यकाल" से, प्रशासनिक अत्यावश्यकताओं/सुविधा को ध्यान			बैच वाईच आधार पर	तीसरा, पांचवां, आठवां, दसवां, तेरहवां, पन्द्र्रहवां, अठारहवां, बाईसवां, तेईसवां, पच्चीसवां, अठाईसवां, तीसवां और तैंतीसवां
				सीमित सीधी भर्ती द्वारा	पैतीसवां अड़तीसवां

		में रखते हुए, साधारणतया तीन वर्ष की अवधि या ऐसे क्षेत्रों में तैनाती की इससे कम अवधि अभिप्रेत होगी। स्पष्टीकरण II.-- उपर्युक्त परन्तुक (I) के प्रयोजन के लिए जनजातीय/कठिन क्षेत्र निम्न प्रकार से होंगेः- 1. जिला लाहौल एवं स्पिति 2. चम्बा जिला का पांगी और भरमौर उप-मण्डल 3. रोहड़ उपमण्डल का डोडरा क्वार क्षेत्र ू 4. जिला शिमला की रामपुर तहसील का पन्द्रह बीस परगना, मुनीश, दरकाली और ग्राम पंचायत काशापाट 5. जिला कुल्लू का पन्द्रह बीस परगना 6. कांगड़ा जिला के बैजनाथ उप-मण्डल का बड़ा भंगाल क्षेत्र। 7. जिला किन्नौर ं, उप तहसील कमरउ के काठवाड़ 8. सिरमौर जिला मे और कोरगा पटवार वृत्त, र ेणुकाजी तहसील के भलाड़-भलौना और सांगना पटवार वृत्त और शिलाई तहसील का कोटा पाब पटवार वृत्त। 9. मण्डी जिला में, करसोग तहसील का खनयोल-बगड़ा पटवार वृत्त, बाली चौकी उपतहसील के गाड़ा गुशैणी, मठियानी, घनयाड़, थाची, बागी, सोमगाड और खोलानाल, पटवार वृत्त, पद्धर तहसील के झारवाड़, क ुटगढ़, ग्रामण, देवग ट्राईला, रोपा, कथोग, सिलह भड़वानी, हस्तपुर, घमरेहर और भटेड़ पटवार वृत्त, थुनाग तहसील म ें चिउणी, कालीपर, मानगढ़, थाच-बागड़ा, उत्तरी मगरू और दक्षिणी मगरू पटवार वृत्त और मण्डी जिला की सुन्दरनगर तहसील का बटवाड़ा पटवार वृत्त । स्पष्टीकरण-III.-- उपर्युक्त परन्तुक (I) के प्रयोजन के लिए और दूरस्थ़/ग्रामीण क्षेत्र निम्न प्रकार से होंगेः- (i) उप-मण्डल/तहसील मुख्यालय से 20 किलोमीटर की परिधि से परे के समस्त स्थान । (ii) राज्य मुख्यालय और जिला मुख्यालय से 15 किलोमीटर की परिधि से परे के समस्त स्थान जहा के लिए बस सेवा उपलब्ध नहीं है और 3 (तीन) किलोमीटर से अधिक की पैदल यात्रा करनी पड़ती है। (iii) कर्मचारी का, उसके प्रवर्ग को ध्यान में लाए बिना अपने गृह नगर या गृह नगर क्षेत्र के साथ लगती 20 किलोमीटर की परिधि के भीतर का क्षेत्र। ( II) प्रोन्नति के सभी मामलों मे पद पर नियमित नियुक्ति से ं पूर्व सम्भरक (पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, इन नियमों मे ं यथाविहित सेवाकाल के लिए, इस शर्त के अध्यधीन प्रोन्नति के लिए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति, भर्ती और प्रोन्नति नियमों के उपबन्धों
		के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थीः (i) परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां उससे वरिष्ठ सभी व्यक्ति अपने-अपने प्रवर्ग/पद/काडर में विचार किए जाने के पात्र समझे जाएंगे ओैर विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएगेः परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे। स् पष्टीकरण.--अन्तिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जिन्होंने आपातकाल के दौरान आर्मड फोर्सस मे उपस्थिति दी है और जिसे डिमोबिलाइज्ड आर्मड ं फोर्सिज परसोनल (रिजर्वेशन आफ वैकेन्सीज इन हिमाचल स्टेट नॉन-टैक्नीकल सर्विसिज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत्‌ भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों या जिसे एक्स-सर्विसमैन (रिजर्वेशन आफ वैकेन्सीज इन दी हिमाचल प्रदेष टैक्नीकल सर्विसिज) रूल्ज, 1985(समय-समय पर संशोधित) के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और तद्‌धीन वरीयता लाभ दिए गए हों। (ii) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति, उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबंधों के अनुसार की गई थी :
		परन्तु की गई तदर्थ सेवा को गणना में लेने के पश्चात्‌ जो स्थाईकरण होगा उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।

NOTIFICATION

Shimla-02, the 17th February, 2025

No. EDN-C-A(3)-2/2020-Part-I.—In exercise of the powers conferred by proviso to article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following Rules further to amend the Himachal Pradesh Elementary Department Trained Graduate Teacher (Arts/Non- Medical/Medical), Group-C, (Non Gazetted) Recruitment and Promotion Rules, 2024 notified vide this Department notification No. EDN-C-A(3)-2/2020, dated 06-06-2024; namely :—

1. Short title and Commencement.	(1) These rules may be called the "Himachal Pradesh Elementary Education Department, Trained Graduate Teacher (Arts/Non- Medical/Medical), Group-C, Recruitment and Promotion(Amendment) Rules, 2025".
	( 2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.
2. Amendment of Annexure-A.	In Annexure-A to the Himachal Pradesh Elementary Education Department Trained Graduate Teacher (Arts/Non- Medical/Medical), Group-C, Recruitment and Promotion Rules, 2024.
	(a) For the existing provisions against Col. No. 7 the following shall be substituted, namely:—
	(1) ESSENTIAL QUALIFICATION:—
	1. TRAINED GRADUATE TEACHER (ARTS):— (i) BA/B.Com./Post Graduation [Master Degree in any
	discipline provided that candidates should have passed their Graduation Degree in B.A./B.Com] from a recognized University with at least 50% marks either in Graduation or in Post Graduation and 1 year's Bachelor of Education (B.Ed.)/2 Year's Bachelor of Education (B.Ed.)/Bachelor of Education(B.Ed.) from National Council for Teacher Education (NCTE) recognized institution. OR Post Graduation [Master Degree in any discipline provided that candidates should have passed their Graduation Degree in B.A./B.Com] with a minimum 55% marks and three-year integrated B.Ed.-M.Ed. from National Council for Teacher Education (NCTE) recognized institution. OR Senior Secondary/10+2 with at least 50% marks and 4 year's Bachelor in Elementary Education (B.El.Ed.). OR Senior Secondary/10+2 with at least 50% marks and 4 year's B.A. Education (Ed.)/B.A.B.Ed. OR B.A./B.Com. with at least 50% marks and 1 year's Bachelor in Education (B.Ed.) (Special Education). AND (ii) Pass in Teacher Eligibility Test (TET) duly conducted by H.P. Board of School Education Dharamshala, Distt. Kangra or any other Agency authorized by the Government. 2. TRAINED GRADUATE TEACHER (NON- MEDICAL):— (i) B.Sc. (Non Medical)/Post Graduation [M.Sc. in any science discipline provided that candidates should have passed their Graduation Degree in B.Sc. (NM)] from a recognized University with at least 50% marks either in B.Sc. (Non Medical) or in Post Graduation and 1 year's Bachelor of Education (B.Ed.)/2 Year's Bachelor of
	Education (B.Ed.)/ Bachelor of Education (B.Ed.) from National Council for Teacher Education (NCTE) recognized institution. OR Post Graduation [M.Sc. in any science discipline provided that candidates should have passed their Graduation Degree in B.Sc. (NM)] with a minimum of 55% marks and three-year integrated B.Ed.-M.Ed. from a National Council for Teacher Education (NCTE) recognized institution. OR Senior Secondary/10+2 in Science(Non-Medical) with at least 50% marks and 4 year's Bachelor in Elementary Education (B.El.Ed.) OR Senior Secondary/10+2 in Science(Non-Medical) with at least 50% marks and 4 year's B.Sc. (Non Medical) Ed/B.Sc. (Non Medical) B.Ed. OR B.Sc. (Non Medical) with at least 50% marks and 1 year's Bachelor in Education (B.Ed.) (Special Education). AND (ii) Pass in Teacher Eligibility Test (TET) duly conducted by H.P. Board of School Education Dharamshala, Distt. Kangra or any other Agency authorized by the Government. 3 . TRAINED GRADUATE TEACHER (MEDICAL):— (i) B.Sc. (Medical)/ Post Graduation [M.Sc. in any science discipline provided that candidates should have passed their Graduation Degree in B.Sc. (Medical)] from a recognized University with at least 50% marks in B.Sc. (Medical) or Post Graduation and 1 year's Bachelor of Education (B.Ed.)/ 2 Year's Bachelor of Education (B.Ed.)/Bachelor of Education (B.Ed.) from National Council for Teacher Education (NCTE) recognized institution.
	OR Post Graduation [M.Sc. in any science discipline provided that candidates should have passed their Graduation Degree in B.Sc. (Medical)] with a minimum of 55% marks and three-year integrated B.Ed.-M.Ed. from a National Council for Teacher Education (NCTE) recognized institution. OR Senior Secondary/10+2 in Science (Medical) with at least 50% marks and 4 year's Bachelor in Elementary Education (B.El.Ed.). OR Senior Secondary/10+2 in Science (Medical) with at least 50% marks and 4 year's B.Sc. (Medical) Ed./B.Sc. (Medical) B.Ed. OR B.Sc. (Medical) with at least 50% marks and 1 year's Bachelor in Education (B.Ed.) (Special Education) AND (ii) Pass in Teacher Eligibility Test (TET) duly conducted by H.P. Board of School Education Dharamshala, Distt. Kangra or any other Agency authorized by the Government : Provided that a candidate must have passed Matriculation and 10+2 from any School/Institution situated within Himachal Pradesh : Provided this condition shall not apply to Bonafide Himachalis. ( b) DESIRABLE QUALIFICATION(s): Knowledge of customs, manner and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh. N ote (1).—Provided that minimum percentage of marks in graduation shall not be applicable to those incumbents who had already taken admission to the Bachelor of Education or Bachelor of Elementary Education prior to the 29th July, 2011.
	Note (2).—Relaxation upto 5% will be allowed in minimum educational qualifications and also in minimum qualifying marks for TET to the candidates belonging to SC/ST/OBC/PWD categories of H.P. N ote (3).—In case of candidates who have taken admission in B.Ed. course on the basis of M.A./M.Sc. with at least 50% marks shall only be considered for the post of TGT. N ote (4).—The minimum qualification as prescribed by NCTE on the date of publication of the Advertisement shall also be considered as part and parcel of these R&P Rules and the Government (in the Department of Elementary Education, H.P.) shall provide such changes in the minimum essential qualification to the recruiting agency till the date of publication of advertisement.
	(b) For the existing provision against Col. No. 10, the following shall be substituted, namely:— (i) 75% by direct recruitment on regular basis or recruitment on contract basis as the case may be in the following manners:- (a) 37.5% through Himachal Pradesh Rajya Chayan Aayog, Hamirpur/other recruiting agency/ authority as the case may be. (b) 32.5% on batch -wise basis. ( c) 5% through Limited Direct Recruitment (LDR) Himachal Pradesh Rajya Chayan through Aayog/other agency/authority, as the case may be, on regular basis or on contract basis, from amongst in service SMC Teachers [with at least five (05) years of service] engaged under SMC Policy dated 17-07-2012, amended from time to time, possessing the requisite Educational qualification as prescribed in the Col No. 7: Provided that the upper age limit for direct recruits will not be applicable to the SMC Teachers already in service of Government. (ii) 25% by Promotion. N ote.—The 5% Limited Direct Recruitment Quota will cease automatically after the absorption of all SMC teachers engaged under SMC Policy dated 17-07-2012, amended from time to time, in the Elementary Education Department and thereafter, the 5% quota meant for LDR recruitment shall be considered as part and parcel of quota for direct recruitment through batch-wise.

(c) For the existing provision against Col. No. 11 , the following shall be substituted, namely:— (i) 15% by Promotion from amongst the in-service JBTs possessing the educational qualification as prescribed in Col. No. 7 above, with at least five years regular service or regular combined with continuous adhoc service rendered, if any, in the grade. ( ii) 10% by promotion from amongst the in-service Classical & Vernacular Teachers (C&Vs) possessing the essential educational qualification as prescribed in Col. No. 7 above, with at least five years regular service or regular combined with continuous adhoc service rendered, if any, in the grade. For filling up the posts the following roster shall be followed:— N ote:-1.—This roster will be rotated after every 40th post till the representation to all the categories is achieved by the given percentage and thereafter the vacancy is to be filled up from the category which vacates the post. N ote-2.—The 5% Limited Direct Recruitment quota will cease automatically after the absorption of all in service SMC teachers engaged under SMC Policy dated 17-07-2012, amended from time to time, in the Elementary Education Department and thereafter, roster point 35 & 38 allotted to LDR Recruitment shall be considered as roster points for direct recruitment through batch- wise. (I) Provided that for the purpose of promotion every employee shall have to serve at least one term in the Tribal/Difficult/ Hard areas and remote/rural areas subject to adequate numbers of post(s) available in such areas:

	Provided further that the proviso (I) supra shall not be applicable in the case of those employees who have five years or less service, left for superannuation. However, such incumbents may posted/transferred to remote/rural areas on their promotion: Provided further that Officers/Officials who have not served atleast one tenure in Tribal/Difficult/Hard areas/ remote/rural areas shall be transferred to such area strictly in accordance with his/her seniority in the respective cadre. E xplanation I.—For the purpose of proviso (I) supra the "term" in Tribal/Difficult/Hard areas/remote/rural areas shall mean normally three years or less period of posting in such areas keeping in view the administrative exigencies/convenience. E xplanation II.—For the purpose of proviso (1) supra the Tribal/Difficult Areas shall be as under:— 1. District Lahaul & Spiti 2. Pangi and Bharmour Sub Division of Chamba District. 3. Dodra Kawar Area of Rohru Sub Division 4. Pandrah Bis Pargana, Munish Darkali and Gram Panchayat Kashapat, Gram Panchayats of Rampur Tehsil of District Shimla. Pandrah Bis Pargana of Kullu District 5. Bara Bhangal Areas of Baijnath Sub Division of 6. Kangra District. District Kinnaur 7. 8. Kathwar and Korga Patwar Circlse of Kamrau Sub Division, Bhaladh Bhalona and Sangna Patwar Circles of Renukaji Tehsil and Kota Pab Patwar Circle of Shillai Tehsil in Sirmaur District. 9. Khanyol-Bagra Patwar Circle of Karsog Tehsil, Gada Gussaini, Mathyani, Ghanyar, Thachi, Baggi, Somgad and Kholanal of Bali-Chowki Sub Tehsil, Jharwar, Kutgarh, Graman, Devgarh, Trailla, Ropa, Kathog, Silh-Badhwani, Hastpur, Ghamrehar and Bhatehar Patwar Circle of Padhar Tehsil, Chiuni, Kalipar, Mangarh,Thach-Bagra, North Magru and South Magru Patwar Circles of Thunag Tehsil and Bhatwara Patwar Circle of Sunder Nagar Tehsil in Mandi District. Explanation III.—For the purpose of proviso (I) supra the Remote/Rural Areas shall be as under: (i) All stations beyond the radius of 20 Kms. from sub Division/Tehsil headquarter.
	(ii) All stations beyond the radius of 15 Kms. from State Headquarter and District headquarters where bus service is not available and on foot journey is more than 3 (three) Kms. (iii) Home town or area adjoining to area of home town within the radius of 20 Kms. of the employee regardless of its category. (II) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rules for promotion subject to the condition that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R & P Rules: (i) Provided that in all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including service rendered on adhoc basis, followed by regular service/appointment) in the feeder post in view of the provisions referred to respective above, all persons senior to him in the category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration: Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the Recruitment & Promotion Rules for the post, whichever is less: Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him shall also be deemed to be ineligible for consideration for such promotion. E xplanation.—The last proviso shall not render the junior incumbent(s) ineligible for consideration for promotion if the senior ineligible person(s) happened to be Ex- Servicemen who have joined Armed Forces during the period of emergency and recruited under the provision of Rule-3 of Demobilized Armed Forces Personnel (Reservation of vacancies in Himachal State Non-Technical Services) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisions of Rule-3 of Ex-Servicemen (Reservation of Vacancies in the H.P. Technical Services) Rules, 1985(as amended from time to time) and having been given the benefit of seniority thereunder. (ii) Similarly, in all cases of confirmation, continuous
	adhoc service rendered on the feeder post, if any, prior to the regular appointment/promotion against such post taken into account towards the length of shall be service; if the adhoc appointment/promotion had been made after proper selection and in accordance with the provisions of the Recruitment and Promotion Rules: inter-se-seniority as a result of Provided that confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged.
