संख्याः एल.एल.आर.-डी.(6)-33/2024-लेज.--हिमाचल प्रदेश के राज्यपाल ने भारत के संविधान के अनुच्छेद 200 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए हिमाचल प्रदेश मूल्य परिवर्धित कर (संशोधन) 256-राजपत्र/2025-01-03-2025 (13621) 13622 राजपत्र, हिमाचल प्रदेश, 01 मार्च, 2025/10 फाल्गुन, 1946 विधेयक, 2024 (2024 का विधेयक संख्यांक 38) को दिनांक 19-02-2025 को अनुमोदित कर दिया है तथा अनुच्छेद 348 के खण्ड (3) के अधीन, विधेयक के अंग्रेजी पाठ को राजपत्र, हिमाचल प्रदेश में प्रकाशित करने के लिए प्राधि—त कर दिया है। अतः उपरोक्त विधयेक को वर्ष 2025 के अधिनियम संख्यांक 30 के रूप में अंगे्रजी प्राधि—त पाठ सहित राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशित किया जाता है।

(माननीय राज्यपाल महोदय द्वारा तारीख 19 फरवरी, 2025 को यथाअनुमोदित)

हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 (2005 का अधिनियम संख्यांक 12) का और संशोधन करने के लिए अधिनियम।

भारत गणराज्य के पचहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित होः-

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश मूल्य परिवर्धित कर (संशोधन) अधिनियम, 2024 है।

2. धारा 21 का संशोधन.--हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 (जिसे इसमें इसके पश्चात्‌ ''मूल अधिनियम'' कहा गया है) की धारा 21 की उप-धारा (8) के परंतुक के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

"परन्तु निर्धारण प्राधिकारी, सम्बद्ध जोन के संयुक्त राज्य कर एवं आबकारी आयुक्त (करदाता सेवा, प्रवर्तन और सहबद्ध कर) के पूर्व अनुमोदन से, ऐसे संदाय की तारीख को बढ़ा सकेगा किन्तु नब्बे दिन से अधिक नहीं, या पर्याप्त प्रतिभूति या बैंक गारन्टी के विरुद्ध तीन से अनधिक मासिक किश्तों द्वारा संदाय अनुज्ञात कर सकेगा ।"।13623 राजपत्र, हिमाचल प्रदेश, 01 मार्च, 2025/10 फाल्गुन, 1946 3. धारा 34 का संशोधन.--मूल अधिनियम की धारा 34 की उप-धारा (6) के परन्तुक के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

"परन्तु जहां किसी माल को निरूद्ध किया जाता है, वहां माल निरुद्ध करने वाले अधिकारी द्वारा, सम्बद्ध जोन के संयुक्त राज्य कर एवं आबकारी आयुक्त (करदाता सेवा, प्रवर्तन और सहबद्ध कर) को तुरन्त और किसी भी दशा में माल निरुद्ध करने के चौबीस घण्टे के भीतर, रिपोर्ट की जाएगी, जब कभी माल को चौबीस घण्टे से अधिक की किसी अवधि के लिए निरूद्ध करना अपेक्षित हो तो इसके पश्चात्‌कथित की अनुज्ञा मांगी जाएगी और यदि पश्चात्‌कथित से कोई प्रतिकूल सूचना प्राप्त नहीं होती है, तो पहला यह धारणा कर सकेगा कि उसके प्रस्ताव को स्वीकार कर लिया गया है ।"। 4. धारा 45 का संशोधन.--मूल अधिनियम की धारा 45 में;-

(i) उप-धारा (1) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''(1) इस अधिनियम या तद्‌धीन बनाए गए नियमों के अधीन पारित प्रत्येक मूल आदेश से, अपील निम्नलिखित को होगीः-

(क) यदि आदेश किसी निर्धारण अधिकारी द्वारा या चैक पोस्ट या बैरिअर के भारसाधक अधिकारी द्वारा अथवा किसी अन्य अधिकारी द्वारा, जो राज्य कर एवं आबकारी अधिकारी की पंक्ति से नीचे का न हो, द्वारा किया जाता है, तो सम्बद्ध जोन के संयुक्त राज्य कर एवं आबकारी आयुक्त (करदाता सेवा, प्रवर्तन और सहबद्ध कर) को;

(ख) यदि आदेश संयुक्त राज्य कर एवं आबकारी आयुक्त (करदाता सेवा, प्रवर्तन और सहबद्ध कर) द्वारा किया जाता है, तो आयुक्त या राज्य मुख्यालय में तैनात अतिरिक्त राज्य कर एवं आबकारी आयुक्त को;

(ग) यदि आदेश आयुक्त या आयुक्त की शक्तियों का प्रयोग करने वाले राज्य मुख्यालय में तैनात अतिरिक्त राज्य कर एवं आबकारी आयुक्त द्वारा किया जाता है तो अधिकरण को।''; और

(ii) उप-धारा (2) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''(2) राज्य मुख्यालय में तैनात संयुक्त राज्य कर एवं आबकारी आयुक्त (करदाता सेवा, प्रवर्तन और सहबद्ध कर) या राज्य मुख्यालय में तैनात अतिरिक्त राज्य कर एवं आबकारी आयुक्त या आयुक्त द्वारा या किसी अधिकारी, जिस पर आयुक्त की शक्तियां प्रदत्त की गई हैं, द्वारा अपील में पारित आदेश, आगे अधिकरण को अपीलीय होगा।"।

5. धारा 51 का संशोधन.-मूल अधिनियम की धारा 51 की उप-धारा (1) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

''(1) आयुक्त या सम्बद्ध वृत्त का कोई अन्य अधिकारी, जो सहायक आयुक्त (माल और सेवा कर और सहबद्ध कर) से नीचे की पंक्ति का न हो, धारा 50 या इस अधिनियम के अधीन बनाए गए किसी नियम के अधीन दण्डनीय किसी अपराध के लिए कार्यवाहियां संस्थित करने से या तो पूर्व या पश्चात्‌, ऐसे अपराध के अभियुक्त किसी व्यक्ति से, अपराध के शमन स्वरूप कर की रकम के दो गुणा के बराबर धन राशि स्वीकार कर सकेगा, जो विक्रयों या क्रयों के आवर्त पर, जिससे कि अपराध सम्बन्धित हो, संदेय होती, जो भी अधिकतर हो।"।

6. धारा 56 का संशोधन.-मूल अधिनियम की धारा 56 की उप-धारा (3) के खण्ड (ञ) के पश्चात्‌ परन्तुक के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- 13624 राजपत्र, हिमाचल प्रदेश, 01 मार्च, 2025/10 फाल्गुन, 1946 "परन्तु खण्ड (क), (च) और (छ) में उल्लिखित सूचना सम्बद्ध जोन के संयुक्त राज्य कर एवं आबकारी आयुक्त (करदाता सेवा, प्रवर्तन और सहबद्ध कर) द्वारा तभी प्रकट किए जाने के लिए अनुज्ञात की जा सकेगी, जब इस निमित्त किए गए आवेदन की छानबीन के पश्चात्‌, जैसी वह आवश्यक समझे, उसका समाधान हो जाता है कि प्रकटीकरण इस उप-धारा के अधीन अनुज्ञेय है।"।

THE HIMACHAL PRADESH VALUE ADDED TAX (AMENDMENT) ACT, 2024

(AS ASSENTED TO BY THE GOVERNOR ON 19TH FEBRUARY, 2025)

ACT

further to amend the Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12 of 2005).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy-fifth Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Himachal Pradesh Value Added Tax (Amendment) Act, 2024.

2. Amendment of section 21.—In the Himachal Pradesh Value Added Tax Act, 2005 (hereinafter referred to as the "principal Act"), in section 21, in sub-section 8, for the proviso, the following shall be substituted, namely:—

"Provided that the Assessing Authority may, with the prior approval of the Joint Commissioner, State Taxes and Excise (Taxpayer Services, Enforcement and Allied Taxes) of the concerned Zone, extend the date of such payment, but not for more than ninety days, or allow payment by monthly installments not exceeding three, against an adequate security or a bank guarantee.''.

3. Amendment of section 34.—In section 34 of the principal Act, in sub-section (6), for the proviso, the following shall be substituted, namely:—

"Provided that where any goods are detained a report shall be made immediately and in any case within twenty four hours of the detention of the goods by the officer detaining the goods to the Joint Commissioner, State Taxes and Excise (Taxpayer Services, Enforcement and Allied Taxes) of the concerned Zone, seeking the later's permission for the detention of the goods for a period exceeding twenty-four hours, as and when so required and if no intimation to the contrary is received from the later, the former may assume that his proposal has been accepted.".

4. Amendment of section 45.—In section 45 of the principal Act,—

(i) for sub-section (1), the following shall be substituted, namely:—

"(1) An appeal from every original order passed under this Act or rules made thereunder shall lie—

(a) if the order is made by an Assessing Authority or by an Officer–in–Charge of the check post or barrier or any other officer not below the rank of the State Taxes and Excise Officer, to the Joint Commissioner, State Taxes and Excise (Taxpayer Services, Enforcement and Allied Taxes) of the concerned zone;

(b) if the order is made by the Joint Commissioner, State Taxes and Excise (Taxpayer Services, Enforcement and Allied Taxes), to the Commissioner or the Additional Commissioner, State Taxes and Excise, posted at the State Headquarters;

(c) if the order is made by the Commissioner or the Additional Commissioner, State Taxes and Excise posted at State Headquarter, exercising the powers of the Commissioner, to the Tribunal."; and

(ii) for sub-section (2), the following shall be substituted, namely:—

"(2) An order passed in appeal by a Joint Commissioner, State Taxes and Excise (Taxpayer Services, Enforcement and Allied Taxes) or by the Additional Commissioner, State Taxes and Excise posted at the State Headquarters or by the Commissioner or any officer, on whom the powers of the Commissioner are conferred, shall be further appealable to the Tribunal.".

5. Amendment of section 51.—In section 51 of the principal Act, for sub-section (1), the following shall be substituted, namely:—

"(1) The Commissioner or any other officer not below the rank of Assistant Commissioner (GST and Allied Taxes) of the concerned circle may, either before or after the institution of proceedings for any offence punishable under section 50 or under any rule made under this Act, accept from any person accused of such offence by way of composition of offence a sum of money equal to double the amount of tax which would have been payable on the turnover of sales or purchases to which the said offence relates, whichever is greater.".

6. Amendment of section 56.—In section 56 of the principal Act, in sub-section (3), for the proviso after clause (j), the following shall be substituted, namely:—

"Provided that the information mentioned in clauses (a), (f) and (g) may be permitted to be disclosed by the Joint Commissioner, State Taxes and Excise (Taxpayer Services, Enforcement and Allied Taxes) of the concerned Zone only when he is satisfied, after scrutiny of the request made in this behalf and after such enquiries as he considers necessary, that the disclosure is admissible under this sub-section.".

No. Home(A)A(6)-1/2025.—The Governor, Himachal Pradesh is pleased to order to categorize all Police Stations in Police Department on the basis of Population, Area, Crime rate with a view to ensure better service delivery and maintenance of uniformity with regard to creation/deployment of staff. The Police Stations shall be categorized in six (06) categories on the basis of following criteria/norms:—

1. Population 20 Marks Registration of crime over 250 per annum OR existing sanctioned strength above 70 police personnel.

2. Area 10 Marks 76-100 Marks A

The marks shall be assessed/awarded to the each Police Station on the basis of criteria as per annexure "A".

2. Further, the minimum staff strength in r/o of Police Stations of each category after following the above norms shall be as under: —

The number of IOs may vary depending on number of FIRs, registered in particular Police Station without any variation in total strength. However, any enhancement/reduction in already sanctioned strength of a particular Police Station shall be subject to the prior approval of the State Government. Further, the above categorization shall not be applicable to Special Police Stations e.g. Women Police Station etc.

3. The Director General of Police, Himachal Pradesh shall take necessary action to evaluate each Police Stations on the basis of above norms and categorize all the police stations accordingly on regular intervals.
