हिमाचल प्रदेश पुलिस (संशोधन) अधिनियम, 2024

(माननीय राष्ट्रपति महोदया, द्वारा तारीख 23 मई, 2025 को यथाअनुमोदित)

हिमाचल प्रदेश पुलिस अधिनियम, 2007 (2007 का अधिनियम संख्यांक 17) का और संशोधन करने के लिए अधिनियम।

भारत गणराज्य के पचहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश पुलिस (संशोधन) अधिनियम, 2024 है।3567 राजपत्र, हिमाचल प्रदेश, 07 जुलाई, 2025/16 आषाढ़, 1947 2. धारा 4 का संशोधन.--हिमाचल प्रदेश पुलिस अधिनियम, 2007 (जिसे इसमें इसके पश्चात्‌ "मूल अधिनियम" कहा गया है) की धारा 4 की उप-धारा (3) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- "(3) ग्रेड-II के अराजपत्रित पुलिस अधिकारियों की राज्य संवर्ग (काडर) में भर्ती पुलिस भर्ती बोर्ड के माध्यम से, राज्य सरकार द्वारा बनाए गए भर्ती और प्रोन्नति नियमों के अनुसार की जाएगी।"।

3. धारा 25 का संशोधन.--मूल अधिनियम की धारा 25 की उप-धारा (1) में, "जिला संवर्ग के सदस्य के लिए जिला नामावली से और राज्य संवर्ग (काडर) के सदस्य के लिए राज्य नामावली (रोल) से" शब्दों और कोष्ठकों का लोप किया जाएगा।

4. धारा 65 का संशोधन.--मूल अधिनियम की धारा 65 की उप-धारा (3) के पश्चात्‌ निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात्‌ः-

"(4) कोई भी पुलिस अधिकारी सरकार की पूर्व मंजूरी के सिवाय, लोक सेवक को उसके द्वारा लोक सेवक के रूप में कार्य करते समय किए गए कार्य के लिए गिरफ्तार नहीं करेगा।"। 5. धारा 95 का संशोधन.--मूल अधिनियम की धारा 95 की उप-धारा (1) के अन्त "।"चिन्ह के स्थान पर "ः" चिन्ह रखा जाएगा और इसके पश्चात्‌ निम्नलिखित परंतुक अन्तःस्थापित किया जाएगा, अर्थात्‌ः- "परन्तु यदि उपरोक्त वर्णित पंक्ति के सेवानिवृत्त अधिकारी उपलब्ध नहीं हैं तो राज्य सरकार, स्थिति और उपलब्धता के आधार पर कारणों को अभिलिखित करके, किसी भी कनिष्ठ सेवानिवृत्त अधिकारी को उपरोक्त चर्चित रीति में नामनिर्दिष्ट कर सकेगी।"।

THE HIMACHAL PRADESH POLICE (AMENDMENT) ACT, 2024

(AS ASSENTED TO BY THE PRESIDENT ON 23rd MAY, 2025)

ACT

further to amend the Himachal Pradesh Police Act, 2007(Act No. 17 of 2007).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy-fifth Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Himachal Pradesh Police (Amendment) Act, 2024.

2. Amendment of section 4.—In the Himachal Pradesh Police Act, 2007 (hereinafter referred to as the "principal Act"), in section 4, for the sub-section (3), the following shall be substituted, namely:—

" (3) Recruitment of the Non-Gazetted Police Officers Grade-II to the State Cadre shall be made through Police Recruitment Board, in accordance with the Recruitment and Promotion Rules framed by the State Government.".

3. Amendment of section 25.—In section 25 of the principal Act, in the sub-section (1), the words "from a District Roll for a member of the District Cadre and from a State Roll for a member of the State Cadre" shall be omitted.

4. Amendment of section 65.—In section 65 of the principal Act, after the sub-section (3), the following shall be inserted, namely:—

" (4) No Police Officer shall arrest a public servant for any act done while discharging his duties as public servant except with the prior sanction of the Government.". 5. Amendment of section 95.—In section 95 of the principal Act, at the end of sub- section (1), for the sign ".", the sign ":" shall be substituted and thereafter a proviso shall be inserted, namely:—

"Provided that in case the retired officers of the ranks mentioned above are not available, the State Government may nominate junior retired officer in the manner discussed above depending upon the situation and availability for the reasons to be recorded.".
