संख्याः एल.एल.आर.-डी.(6)-11/2025-लेज.--हिमाचल प्रदेश के राज्यपाल ने भारत के संविधान के अनुच्छेद 200 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और 152-राजपत्र/2025-15-10-2025 (6575)6576 राजपत्र, हिमाचल प्रदेश, 15 अक्तूबर, 2025/23 आश्विन, 1947 पेंशन) संशोधन विधेयक, 2025 (2025 का विधेयक संख्यांक 9) को अनुमोदित कर दिया है तथा अनुच्छेद 348 के खण्ड (3) के अधीन, विधेयक के अंग्रेजी पाठ को राजपत्र, हिमाचल प्रदेश में प्रकाशित करने के लिए प्राधि—त कर दिया है। अतः उपरोक्त विधेयक को वर्ष 2025 के अधिनियम संख्यांक 38 के रूप में अंगे्रजी प्राधि—त पाठ सहित राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशित किया जाता है।

हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) संशोधन अधिनियम, 2025 (माननीय राज्यपाल महोदय द्वारा यथाअनुमोदित)

हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) अधिनियम, 1971 (1971 का अधिनियम संख्यांक 8) का और संशोधन करने के लिए अधिनियम।

भारत गणराज्य के छिहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित होः-

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) संशोधन अधिनियम, 2025 है।6577 राजपत्र, हिमाचल प्रदेश, 15 अक्तूबर, 2025/23 आश्विन, 1947 2. धारा 3 का संशोधन.--हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) अधिनियम, 1971 (जिसे इसमें इसके पश्चात्‌ ''मूल अधिनियम'' कहा गया है) की धारा 3 में,

(क) हाशिए के शीर्षक में ''वेतन और प्रतिकरात्मक भत्ता'' शब्दों के स्थान पर ''सदस्य के वेतन'' शब्द रखे जाएंगे;

(ख) उप-धारा (1) में,-

(i) ''पचपन हजार'' शब्दों के स्थान पर ''पचासी हजार'' शब्द रखे जाएंगे; और (ii) ''और पांच हजार रुपए की दर से प्रतिकरात्मक भत्ता'' शब्दों का लोप किया जाएगा;

(ग) उप-धारा (1-क) के पश्चात्‌ निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''(2) सदस्य का वेतन आयकर अधिनियम, 1961 (1961 का 43) की धारा 48 के स्पष्टीकरण के खण्ड (v) के अधीन उपबंधित लागत मुद्रास्फीति सूचकांक के आधार पर प्रथम अप्रैल, 2030 से प्रारम्भ हुए प्रत्येक पांच वर्षों के पश्चात्‌ बढ़ाया जाएगा।''। 3. धारा 4 का संशोधन.--मूल अधिनियम की धारा 4 की उपधारा (1) के खंड (ii) में ''एक हज़ार आठ सौ'' शब्दों के स्थान पर ''दो हज़ार पांच सौ'' शब्द रखे जाएंगे।

4. धारा 4-ख का प्रतिस्थापन.--मूल अधिनियम की धारा 4-ख के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''4-ख. निर्वाचन क्षेत्र और कार्यालय भत्ता,-(1) प्रत्येक सदस्य को एक लाख बीस हजार रुपए की दर से निर्वाचन क्षेत्र भाा भी संदा किया जाएगा।

(2) प्रत्येक सदस्य को नब्बे हजार रुपए प्रतिमास की दर से कार्यालय भाा संदा किया जाएगा।"।

5. धारा 5 का प्रतिस्थापन.--मूल अधिनियम की धारा 5 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''5. सुख सुविधाएं.-सदस्य सभा की बैठक के स्थान पर रियायती दरों पर ऐसे निवास स्थान का हकदार होगा जो धारा 7 के अधीन नियमों द्वारा विहित किया जाए।''।

6. धारा 5-क का लोप.--मूल अधिनियम की धारा 5-क का लोप किया जाएगा।

7. धारा 6 का संशोधन.--मूल अधिनियम की धारा 6 में,-

(क) उपधारा (1) में,-

(i) ''चार लाख रुपए'' शब्दों के स्थान पर ''छह लाख रुपए'' शब्द रखे जाएंगे। (ii) द्वितीय परंतुक के स्थान पर निम्नलिखित रखा जाएगा, अर्थातः-

''परंतु टैक्सी द्वारा यात्रा का व्यय वास्तविक आधार पर होगा किन्तु प्रति किलोमीटर प्रभार पच्चीस रुपए से अनधिक तथा छह लाख रुपए की अधिकतम सीमा के भीतर होगाः''; और

(ख) उप-धारा (2) में ''प्रत्येक सदस्य'' के पश्चात्‌ ''आधिकारिक दौरे के दौरान'' शब्द अन्तःस्थापित किए जाएंगे और ''पच्चीस हजार'' शब्दों के स्थान पर ''पचास हजार'' शब्द रखे जाएंगे।6578 राजपत्र, हिमाचल प्रदेश, 15 अक्तूबर, 2025/23 आश्विन, 1947 8. धारा 6-क का संशोधन.--मूल अधिनियम की धारा 6-क में,- (क) ''दो लाख रुपए'' शब्दों के स्थान पर ''तीन लाख रुपये'' शब्द रखे जाएंगे।

(ख) प्रथम परंतुक के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''परंतु टैक्सी द्वारा यात्रा का व्यय वास्तिविक आधार पर होगा किन्तु प्रति किलोमीटर प्रभार 'पच्चीस रूपए' से अनधिक तथा 'तीन लाख रुपए' की अधिकतम सीमा के भीतर होगाः"; और

(ग) द्वितीय परंतुक में ''दो लाख रुपए,'' शब्दों के स्थान पर ''तीन लाख रुपए''' शब्द रखे जाएंगे।

9. धारा 6-ख का संशोधन.--मूल अधिनियम की धारा 6-ख में,-

(क) उपधारा (1) में ''छत्तीस हजार रुपए'' शब्दों के स्थान पर ''पचास हजार रुपए'' शब्द रखे जाएंगे।

(ख) उपधारा (1) के पश्चात्‌ निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात्‌-

''(1-क) सदस्य का वेतन आयकर अधिनियम, 1961 (1961 का 43) की धारा 48 के स्पष्टीकरण के खण्ड (v) के अधीन उपबंधित लागत मुद्रास्फीति सूचकांक के आधार पर प्रथम अप्रैल, 2030 से प्रारम्भ हुए प्रत्येक पांच वर्षों के पश्चात्‌ बढ़ाया जाएगा।''। 10. धारा 6-ग ग का लोप.--धारा 6-ग ग का लोप किया जाएगा।

PENSION OF MEMBERS) AMENDMENT ACT, 2025

(AS ASSSENDED TO BY THE GOVERNOR)

ACT

further to amend the Himachal Pradesh Legislative Assembly (Allowances and Pension of

Members) Act, 1971 (Act No. 8 of 1971).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy-sixth Year of the Republic of India as follows:—

1. Short title.—This Act may be called The Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Amendment Act, 2025.

2. Amendment of section 3.—In section 3 of the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971 (hereinafter referred to as the "principal Act"),—

(a) in marginal heading for the words "Salary and compensatory allowance", the words "Salary to a Member" shall be substituted;

(b) in sub-section (1),—

(i) for the words "fifty five thousand", the words "eighty five thousand" shall be substituted; and

(ii) the words "and compensatory allowance at the rate of five thousand rupees" shall be omitted;

"(2) The salary of a member shall be increased after every five years commencing from 1st April, 2030 on the basis of Cost Inflation Index provided under clause (v) of Explanation to section 48 of the Income Tax Act, 1961(43 of 1961).".

3. Amendment of section 4.—In section 4 of the principal Act, in sub-section (1), in clause (ii), for the words "one thousand eight hundred", the words "two thousand five hundred" shall be substituted.

4. Substitution of section 4-B.—For section 4-B of the principal Act, the following shall be substituted, namely:—

"4-B. Constituency and Office Allowance.—(1) There shall be paid to each member a constituency allowance at the rate of one lakh twenty thousand rupees per mensem.

(2) There shall be paid to each member an office allowance at the rate of ninety thousand rupees per mensem. ".

5. Substitution of section 5.—For section 5 of the principal Act, the following shall be substituted, namely:-

"5. Amenities.—A member shall be entitled to such residential accommodation on concessional rates at the place of sitting of the Assembly as may be prescribed by rules under section 7. ".

6. Omission of section 5-A.—Section 5-A of the principal Act shall be omitted.

7. Amendment of section 6.—In section 6 of the principal Act,—

(a) in sub-section (1),—

(i) for the words "four lac rupees", the words "six lakh rupees" shall be substituted;

(ii) for the second proviso, the following shall be substituted, namely:—

"Provided that the expenses of journey by taxi shall be on actual basis but per kilometer charges shall not exceed twenty five rupees and shall be within the maximum limit of six lakh rupees:"; and

(b) in sub-section (2), after the words "Each member", the words "during official tour" shall be inserted and for the words "twenty five thousand", the words "fifty thousand" shall be substituted.

8. Amendment of section 6-A.—In section 6-A of the principal Act,—

(a) for the words "two lac rupees", the words "three lakh rupees" shall be substituted;

(b) for the first proviso, the following shall be substituted, namely:

"Provided that the expenses of journey by taxi shall be on actual basis but per kilometer charges shall not exceed twenty five rupees and shall be within the maximum limit of three lakh rupees:"; and

9. Amendment of section 6-B.—In section 6-B of the principal Act,—

(a) in sub-section (1), for the words and figures "Rs. 36,000", the words "fifty thousand rupees" shall be substituted; and

(b) after sub-section (1), the following shall be inserted, namely:—

"(1-A) The pension of a member for the first term shall be increased after every five years commencing from 1st April, 2030 on the basis of Cost Inflation Index provided under clause (v) of Explanation to section 48 of the Income Tax Act, 1961(43 of 1961).".

10. Omission of section 6-CC.—Section 6-CC shall be omitted.

''(1-अ) उपाध्यक्ष का वेतन, आयकर अधिनियम, 1961(1961 का 43) की धारा 48 के स्पष्टीकरण के खण्ड (5) के अधीन उपबंधित लागत मुद्रास्फीति सूचकांक के आधार पर प्रथम अप्रैल, 2030 से प्रारम्भ होते हुए प्रत्येक पांच वर्षों के पश्चात्‌ बढ़ाया जाएगा।''; और

Speaker's Salaries Act, 1971 (Act No. 4 of 1971).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy-sixth Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Himachal Pradesh Legislative Assembly Speaker's and Deputy Speaker's Salaries (Amendment) Act, 2025.

2. Amendment of section 3.—In Section 3 of the Himachal Pradesh Legislative Assembly Speaker's and Deputy Speaker's Salaries Act, 1971 (hereinafter referred to as the "principal Act"),—

(a) in sub-section (1), for the words "eighty thousand", the words "ninety five thousand" shall be substituted;

(b) for sub-section (1-A), the following shall be substituted, namely:—

"(1-A) The salary of the Speaker shall be increased after every five years commencing from 1st April, 2030 on the basis of Cost Inflation Index provided under clause (v) of Explanation to section 48 of the Income Tax Act, 1961 (43 of 1961)."; and6584 राजपत्र, हिमाचल प्रदेश, 15 अक्तूबर, 2025/23 आश्विन, 1947 (c) in sub-section (1-B), for the words "ninety five thousand", the words "one lakh fifty thousand" shall be substituted.

"(1-A) The salary of the Deputy Speaker shall be increased after every five years commencing from 1st April, 2030 on the basis of cost inflation index provided under clause (v) of Explanation to section 48 of the Income Tax Act, 1961(43 of 1961)."; and (c) in sub-section (1-B), for the words "ninety five thousand", the words "one lakh fifty thousand" shall be substituted.

4. Omission of section 8.—Section 8 of the principal Act shall be omitted.

5. Amendment of section 10-A.—In section 10-A of the principal Act,—

(a) in sub-section (1),—

(i) for the words "four lac rupees", the words "six lakh rupees" shall be substituted;

(ii) for the first proviso, the following shall be substituted, namely:—

मंत्रियों के वेतन और भत्ता (हिमाचल प्रदेश) अधिनियम, 2000 (2000 का अधिनियम संख्यांक 11) का और संशोधन करने के लिए अधिनियम।

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम मंत्रियों के वेतन और भत्ता (हिमाचल प्रदेश) संशोधन अधिनियम, 2025 है।

2. धारा 3 का संशोधन.--मंत्रियों के वेतन और भत्ता (हिमाचल प्रदेश) अधिनियम, 2000 (जिसे इसमें इसके पश्चात्‌ ''मूल अधिनियम'' कहा गया है) की धारा 3 में,-

(क) उप-धारा (1) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-6586 राजपत्र, हिमाचल प्रदेश, 15 अक्तूबर, 2025/23 आश्विन, 1947 ''(1) प्रत्येक मन्त्री निम्नलिखित दरों पर वेतन लेने का हकदार होगा, अर्थात्‌ः- (क) मुख्य मन्त्री एक लाख पंद्रह हजार रुपए प्रतिमास;

(ख) केबिनेट मन्त्री पचानवे हजार रुपए प्रतिमास;

(ग) राज्य मन्त्री तिरानवे हजार रुपए प्रतिमास; और

(घ) उप मन्त्री अस्सी हजार रुपए प्रतिमास।''; और

(ख) उप-धारा (2) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''(2) मंत्रियों का वेतन आयकर अधिनियम, 1961 की धारा 48 के स्पष्टीकरण के खण्ड (v) के अधीन उपबंधित लागत मुद्रास्फीति सूचकांक के आधार पर प्रथम अप्रैल, 2030 से प्रारम्भ हुए प्रत्येक पांच वर्षों के पश्चात्‌ बढ़ाया जाएगा।''।

3. धारा 4 का प्रतिस्थापन.--मूल अधिनियम की धारा 4 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''4. सत्कार भत्ता.-प्रत्येक मन्त्री एक लाख पचास हजार रुपए प्रतिमास की दर से सत्कार भत्ता प्राप्त करने का हकदार होगा।''।

4. धारा 7 का संशोधन.--मूल अधिनियम की धारा 7 में,--

(क) उपधारा (1) में,--

(i) ''चार लाख रुपए'' शब्दों के स्थान पर ''छह लाख रुपए'' शब्द रखे जाएंगे। (ii) प्रथम परंतुक के स्थान पर निम्नलिखित परन्तुक रखा जाएगा, अर्थात्‌ः-

''परंतु टैक्सी द्वारा की गई यात्रा का व्यय वास्तविक आधार पर संदेय होगा किन्तु प्रति किलोमीटर प्रभार पच्चीस रुपए से अनधिक तथा छह लाख रुपए की अधिकतम सीमा के भीतर होगा।''; और

(iii) द्वितीय परंतुक में ''चार लाख रुपए'' शब्दों के स्थान पर ''छह लाख रुपए'' शब्द रखे जाएंगे; और

(ख) उपधारा (2) में ''पच्चीस हजार'' शब्दों के स्थान पर ''पचास हजार'' शब्द रखे जाएंगे। 5. धारा 10 का लोप.--मूल अधिनियम की धारा 10 का लोप किया जाएगा।

6. धारा 14-क और 14-ख का अंतःस्थापन.--धारा 14 के पश्चात्‌ निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात्‌ः-

''14-क. पूर्व मुख्य मन्त्री को आवास.-पूर्व मुख्य मन्त्री टाइप-VI या उससे ऊपर के प्रवर्ग के आवास का हकदार होगा।6587 राजपत्र, हिमाचल प्रदेश, 15 अक्तूबर, 2025/23 आश्विन, 1947 14-ख. नेता प्रतिपक्ष को वेतन और भत्ते.-नेता प्रतिपक्ष, उसी दर पर वेतन, भत्ते और प्रसुविधाएं प्राप्त करने का हकदार होगा जो इस अधिनियम के अधीन सरकार के केबिनेट मन्त्री को अनुज्ञेय है।

स्पष्टीकरण.-इस धारा के प्रयोजन के लिए ''नेता प्रतिपक्ष'' से, विधान सभा का सदस्य जो तत्समय सरकार के प्रतिपक्ष में सर्वाधिक संख्याबल रखने वाले विपक्षी दल का नेता है और जिसे विधानसभा अध्यक्ष द्वारा ऐसे नेता के रूप में मान्यता प्रदान की गई है, अभिप्रेत है।

(2) इस अधिनियम के अधीन केबिनेट मन्त्री को विशिष्टतया उपबंधित के सिवाय, नेता प्रतिपक्ष हिमाचल प्रदेश की विधान सभा के सदस्य के रूप में वेतन, भत्ते और प्रसुविधाओं के रूप में किसी राशि को प्राप्त करने का हकदार नहीं होगा।''।

further to amend the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000

(Act No. 11 of 2000).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy-sixth Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Salaries and Allowances of Ministers (Himachal Pradesh) Amendment Act, 2025.

2. Amendment of section 3.—In section 3 of the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000 (hereinafter referred to as the "principal Act"), —

(a) for sub-section (1), the following shall be substituted, namely:—

"(1) Each Minister shall be entitled to receive a salary at the following rates, namely:—

(a) Chief Minister One lakh fifteen thousand rupees per mensem;

(b) Cabinet Minister Ninety five thousand rupees per mensem;

(d) Deputy Minister Eighty thousand rupees per mensem."; and

(b) for sub-section (2), the following shall be substituted, namely:—

"(2) The salary of a Minister shall be increased after every five years commencing from 1st April, 2030 on the basis of Cost Inflation Index provided under clause (v) of Explanation to section 48 of the Income Tax Act, 1961.".

3. Substitution of section 4.—For section 4 of the principal Act, the following shall be substituted, namely:—

"4. Sumptuary Allowance.—Each Ministers shall be entitled to receive sumptuary allowance at the rate of rupees one lakh fifty thousand per mensem.".

4. Amendment of section 7.—In section 7 of the principal Act,—

(a) in sub-section (1),—

(i) for the words "four lac rupees", the words "six lakh rupees" shall be substituted;

(ii) for the first proviso, the following proviso shall be substituted, namely:—

"Provided that the expenses of journey by taxi shall be on actual basis but per kilometer charges shall not exceed twenty five rupees and shall be within the maximum limit of six lakh rupees:"; and

(iii) in the second proviso, for the words "four lac rupees", the words "six lakh rupees" shall be substituted; and

(b) in sub-section (2), for the words "twenty five thousand", the words "fifty thousand" shall be substituted.

5. Omission of section 10.—Section 10 of the principal Act shall be omitted.

6. Insertion of sections 14-A and 14-B.—After section 14 of the principal Act, the following shall be inserted, namely:—

"14-A. Residence to Ex-Chief Minister.—The Ex-Chief Minister shall be entitled for an accommodation of Type-VI category or above.

14-B. Salary and allowances to Leader of Opposition.—(1) The Leader of Opposition shall be entitled to receive salary, allowances and benefits as admissible to a Cabinet Minister of the Government under this Act.

Explanation.—For the purpose of this section, "Leader of Opposition" means a Member of the Legislative Assembly, who is, for the time being, the Leader of the party in opposition to the Government having the greatest numerical strength and recognised as such by the Speaker of the Legislative Assembly.

(2) The Leader of Opposition shall not be entitled to receive any sum by way of salary, allowances and benefits, as a Member of the Legislative Assembly of Himachal Pradesh except what is specifically provided to a Cabinet Minister under this Act.".
