No. HPERC-B(3)-I/2020-705-Vol-VIII.— The Himachal Pradesh Electricity Regulatory Commission (Terms and Conditions of Service of Staff) Regulations, 2013, issued vide Notification 154-राजपत्र/2025-17-10-2025 (6669)6670 राजपत्र, हिमाचल प्रदेश, 17 अक्तूबर, 2025/25 आश्विन, 1947 No. HPERC/Secy/RPB/705/CV/KD/2011, dated 18th April, 2013 and published in the Rajpatra Himachal Pradesh on 22nd April, 2013, provides for appointment, Promotion and other terms and conditions of service of officers and employees of the Commission;

The Commission, in exercise of the powers conferred by sub-sections (2) and (3) of Section 91 read with clause (zk) of sub-section (2) of Section 181 of the Electricity Act, 2003 (36 of 2003) and Section 20 of the Himachal Pradesh General Clauses Act, 1968 (16 of 1969), and all other powers enabling it in this behalf, proposes further to amend "the Himachal Pradesh Electricity Regulatory Commission (Terms and Conditions of Service of Staff) Regulations, 2013" published in the Rajpatra, Himachal Pradesh on 22nd April, 2013 and as required under sub-section (3) of Section 181 of the Electricity Act, 2003 and rule 3 of the Electricity (Procedure for Previous Publication) Rules, 2005. The draft amendment regulations are hereby published for the information of all the persons likely to be affected thereby; and notice is hereby given that the said draft amendment regulations shall be taken into consideration after expiry of thirty days (30) from the date of publication of this notification, together with objections or suggestions, if any, received within the aforesaid stipulated period.

The objections or suggestions, if any, should be addressed to the Secretary, Himachal Pradesh Electricity Regulatory Commission, Vidyut Aayog Bhawan, Block 37, SDA Complex, Kasumpti, Shimla -171 009.

DRAFT REGULATIONS

1. Short title and commencement.—(1) These Regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Terms and Conditions of Service of Staff) (Fifth Amendment) Regulations, 2025.

(2) These Regulations shall come into force from the date of its publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Schedule-II.—In Schedule-II of the Himachal Pradesh Electricity Regulatory Commission (Terms and Conditions of Service of Staff) Regulations, 2013, in Part-III, in clause 2, for sub-clause (iii), the following sub-clause shall be substituted, namely:—

"(iii) Applications of the persons serving in the Commission on secondment basis may

be considered for absorption only where such person has rendered at least minimum

three years of service on secondment basis in the Commission and has left balance

service of at least fifteen years to attain the age of superannuation on the date of

making of such application; Provided that the Commission may, only in the case of

Electrical Engineers, by order for the reasons to be recorded in writing, relax the

condition of fifteen years of balance service by three years."

Terms and Conditions:

1. The element of expenditure, incurred/actually paid by a dealer to be taken into account for computing the landed cost of the commodities listed above. i.e. (i) Purchase Price, (ii) Freight, (iii) Central/Local Taxes/GST, (iv) Loading, un-loading, Carriage, (v) Market Fee, (vi) interest on capital @ 1% for Wholesaler and Retailer on item no.1 to 5 above, (vii) Other incidental charges @ 1% for Wholesaler and Retailer on item no. 1 to 5 above, (viii) 1% shortage may be allowed over and above the margin of profit calculated as per instructions. No shortage will however be allowed in the case of H.V. Oil sold in packs upto 5 kgs. In the case of Gur, Shakkar, and Khandsari shortage upto 2% may be allowed.

Note.—This condition will not be applicable on fruits and vegetables, as all incidental charges have already been included in their retail margin of profit.

2. The dealer engaged in Wholesale as well as in retail sale business shall charge only one margin of profit on the transaction i.e. wholesale margin on wholesale transaction and retail sale margin on retail sale transaction. The wholesale margin shall be allowed at one stage only at one particular station.

3. Wholesale transaction would mean a single transaction of not less than the following:-

(1) Foodgrains, Gur, Shakkar, Khandsari, Sugar, Pulses, Salt = One Quintal = Ten Number (2) Bread = One Ream (3) Paper (4) Eggs = One Hundred (5) Fruits and Vegetables = 20 Kgs (6) Meat, Chicken, Fish, Curd and Cottage Cheese =10 Kgs (7) Bottled Beverages = 24 Nos.

4. The below terms and conditions will be applicable for vegetables & fruits:—

(4.1) No Wholesaler or retailer shall charge more than the margin of profit as fixed above.

(4.2) Every Commission Agent/Wholesaler in Vegetable Market shall issue Form R to every farmer/grower at the time of purchase of fruits and vegetable from them and retain its one copy with him/her.

(4.3) Every Commission Agent/Wholesaler in Vegetable Market shall issue Form Q to every retailers showing rates of each fruit and vegetable sold to the retailers. On this Form/Cash memo, he or she shall display rate of the fruits/vegetables as per Form R and Charge his/her margin of profit/ commission as shown at column 3 above, which shall be shown separately on Form Q and he/she shall retains its one copy with him/her.

(4.4) The Dealer engaged in wholesale as well as in retail sale business shall charge only one margin of profit on the transaction i.e. wholesale margin on wholesale transaction and retail sale margin on retail sale transaction. The wholesale margin shall be allowed at one stage only at one particular station.

(4.5) Every Retailers shall display price list of the fruits and vegetables available with him/her in business premises in such a way that it may easily be seen by every customer.

(4.6) Wholesale transaction would mean a single transaction of not less than the following:

Fruits and Vegetables = 20 Kg.

(4.7) All Sub-Divisional Magistrates, all Deputy Superintendent of Police and all Inspectors of Food, Civil Supplies and Consumers Affairs, in Distt. Bilaspur shall ensure compliance of this notification in letter and spirit.

(4.8) The Secretary, APMC Bilaspur shall ensure issuance of Form-R and Form-Q by the Commission Agent in Vegetable markets in the district.

This notification shall come into force from the date of its publication in official Gazette.

No. TSM-C(9)-1/2025.—The Governor of Himachal Pradesh in order to provide employment to the youth of the State and strengthen the rural economy as well as the hospitality sector, is pleased to notify "Interest Subvention Scheme for Home stays under Chief Minister Tourism Startup Scheme in Hospitality Industry" as per Annexure-"A'' appended to this notification for information of all concerned with immediate effect.

Interest Subvention Scheme for the Home Stays under Chief Minister Tourism

Startup Scheme in Hospitality Industry.

1. Introduction.—The emergence of tourism as a major industry is one of the most remarkable changes that have taken place in the economic activity in the recent past. For the State of Himachal Pradesh, Tourism and Hospitality sector has been recognized as a very vital factor for economic growth as well as for employment generation and to establish it as a tourist destination on the global map. Tourism is only valuable if it is considered from a holistic perspective, meaning that both tourists and hosts benefit from tourism.

Himalayas are the Unique Selling product and a strong spinal support for the State of Himachal Pradesh in Northern India. They have also given the area an enormous geographical spectrum and unique and unparalleled treasure. The State is endowed with the entire basic requirement necessary for thriving tourism activities, geographical and cultural diversity, clean, peaceful and beautiful environment, forest, lakes, Himalayas, rivers and streams, sacred shrines, historic monuments, and the most important of all a friendly and hospitable people.

The State Govt. is aiming at promoting sustainable tourism, encouraging private sector to develop tourism related infrastructure in the State without disturbing the existing ecology and environment. The main thrust is on employment generation and promoting new concepts of tourism in the State. The contribution of Tourism sector of the State in State Gross Domestic Product (SGDP) is 7.78 % (approx., as per economic survey 2024-25).

In order to exploit the tourism potential of the State, the Government of Himachal Pradesh, has commenced a new scheme namely'Interest Subvention Scheme for the Home Stays under Chief Minister Tourism Startup Scheme in Hospitality Industry'.The focus of the Govt. is to harness the tourism potential of not only urban areas but also of culturally rich rural areas and to generate self-employment opportunities to the local people.

During the budget speech of financial year 2025-26, the Hon'ble Chief Minister, H.P. said that-Home Stay units have played a significant role in attracting tourists to Himachal Pradesh. These units are not only an alternative accommodation option for stay as compared to expensive hotels but also encourage tourists to stay longer in rural areas. To strengthen the rural economy, the Hon'ble Chief Minister, H.P has announced to launch a new scheme, "Chief Minister Tourism Start-up Scheme" to provide employment to the youth of the State and strengthen the rural economy as well as the hospitality sector.

2. Objective:

➢ To promote entrepreneurship spirit. ➢ To promote self employment opportunities to Himachal is in the tourism and hospitality sector in the State by providing financial relief on loans taken for establishing New Tourism Units i.e. Home Stays and expanding/ upgrading/operatingt he old/existing ones.

3. Commencement and duration of the Scheme.—This Scheme shall come into effect, from the date of notification in official e-Gazette/Rajpatra of Himachal Pradesh and shall remain in6676 राजपत्र, हिमाचल प्रदेश, 17 अक्तूबर, 2025/25 आश्विन, 1947 force up to 1st December, 2027 or any other date as the State Government prescribes by a notification in the official Gazette.

4. Definitions:

(i) "Bonafide Himachali" means a person who has permanent home in Himachal Pradesh and includes a person who has been residing in Himachal Pradesh for a period not less than 20 years or a person who has permanent home in Himachal Pradesh but on account of his occupation he is living outside Himachal Pradesh.

(ii) "Department" means Department of Tourism & Civil Aviation, Government of Himachal Pradesh.

(iii) "Director" means Director of Tourism, Government of Himachal Pradesh and will also include Commissioner of Tourism, Government of Himachal Pradesh, as the case may be.

(iv) "Government" means the Government of Himachal Pradesh.

(v) "Financial Institution" means—

(a) Public Sector Banks

(b) All Regional Rural Banks

(c) Co-operative Banks

(d) Private Sector Scheduled Commercial Banks

(e) Small Industries Development Bank of India (SIDBI)

It will also include Corporation(s)/institution(s) set up by the State/Central Government specifically to assist and extend loan assistance to specific categories of entrepreneurs such as Women, SCs/STs, Ex-servicemen, Physically Handicapped, Backward Classes etc as defined in the "Rules Regarding Grant of Incentives, Concessions and Facilities to industrial units in Himachal Pradesh, 2004" as amended from time to time by the Government.

(vi) "Tourism Unit" means Home Stays only.

(vii) "Interest Subvention" means subsidy or rebate in the rate of interest.

(viii)"DTDO/ATDO" means District Tourism Development Officer/Assistant Tourism Development Officer.

(ix) "Tribal Area"as per 'The Scheduled Areas (Himachal Pradesh) Order 1975, the following areas are declared to be the Scheduled Area within the State:—

(1) Lahaul & Spiti District

(2) Kinnaur District6677 राजपत्र, हिमाचल प्रदेश, 17 अक्तूबर, 2025/25 आश्विन, 1947 (3) Pangi Tehsil and Bharmour Sub-Tehsil in Chamba District. (x) "Urban Area" means areas falling within Municipal Corporations/Municipal Councils/Nagar Parishad/Nagar Panchayats as may be notified by the State Government of H.P. from time to time and areas falling within 50 meters from the edge of the controlled width of National Highways/Four Lane Highways in the State of Himachal Pradesh and area under Special Area Development Authority constituted under section 67 of the Himachal Pradesh Town and Country Planning Act, 1977.

(xi) "Rural Area" means are as other than areas defined in para (x) above.

(xii) "Diamond, Gold and Silver Category" as explained/defined in H.P. Homestay Rules, 2025 dated 25-06-2025.

(xiii) "Nodal Bank"—A Bank to be notified by Director, Tourism & Civil Aviation.

5. Key features:

(i) Applicability of the Scheme.—The Scheme is applicable to the Bonafide Himachal is who are of the age of 18 years or more at the time of filling the common application form on the Departmental website or offline as the case may be, for operating/starting tourism unit within the State. The upper age limit will be determined by loan applicability guidelines of RBI.

(ii) Interest Subvention details:—

(iii) Interest Subvention.—The above interest subsidy will be eligible on term loans taken for establishment or expansion or up-gradation of tourism units.

(iv) Tenure of Subvention.—This subvention will be available for a maximum of three years from the date of loan disbursement including moratorium period:

Provided that if a Home Stay which has availed the benefit of Interest subvention under Diamond or Gold category requests to downgrade its category to silver then the benefit of Interest Subvention shall be limited to the principal amount of Rs.

1.00 Crore or less from the date the downgradation becomes effective. The6678 राजपत्र, हिमाचल प्रदेश, 17 अक्तूबर, 2025/25 आश्विन, 1947 concerned Bank shall be informed about the change of category which in turn shall update its record of loan and interest subvention accordingly.

(v) Loan Amount Covered.—Loan amount up to ` 2.00 Crores as principal will be covered under this scheme for diamond and Gold category homestays only. For silver category Home Stays, this limit shall be `1.00 Crore or less.

(iv) Loan Criteria (Financial).—Tourism units with a total investment of Rs. 5.00 Crores or less only will be eligible.

(vii) Eligibility.—New and existing bonafide Himachali entrepreneurs/startups with proposals to establish/ running a tourism unit within the boundaries of the State.

(viii)Applicant receiving similar aid under any other State/central scheme will be ineligible for the relief.

(ix) Moratorium period.—Interest subvention shall be eligible for 3 years including the moratorium period.

(x) Loan disbursement procedure.—Bank will follow the standard protocol for the disbursement of loan. After disbursement of loan to the beneficiary, the concerned branch of the bank will send details of disbursed loan cases to DTDO/ATDO alongwith details of interest subsidy amount accrued on quarterly basis as per Annexure-C.

(xi) Legal action against defaulters.—If there is a default of 3 months or more in payment of loan installments by the borrower, the subvention amount shall be kept on stand by and if the default is for 6 months, then benefit under this scheme shall be stopped forthwith and no subvention shall be given by the Govt. for said cases. Legal action against the defaulter will be initiated by the Bank as per their given procedures.

(xii) Timeline.—A new tourism unit will have to be completed within two years from the disbursement of term loan. If he fails to complete the work within stipulated time interest subvention shall be withheld/stopped.

(xiii)Roles/responsibility of applicant/beneficiary:

(a) Applicant/Beneficiary shall mandatorily maintain computerized record of occupants/booking register.

(b) He/she shall open a GST account and communicate its details (GSTIN No.) to the Department within 3 weeks of availing benefit under this scheme or operationalization of his unit whichever is pertinent.

(c) They shall be charged with commercial rates of power and water supply. A copy of the approval shall be supplied by the Department to the concerned office of HPSEB & JSV for further action accordingly.

The unit shall be run for atleast five years from the commencement of the commercial production of the unit failing which the interest subvention amount will be recovered. An affidavit to that effect shall be submitted by the applicant as per Annexure-B.

6. Application Process:

1. Application Portal.—Through the dedicated tourism department portal/offline process (Annexure-A) to be notified separately.

2. Required Documents:

o Homestay provisional/final registration certificate from concerned Competent Authority of Tourism Department.

o Name of 03 preferred Banks for loan/loanee Bank

o Bonafide Himachali Certificate

o Affidavit of non receiving any other similar subsidy and running the unit for at least 5 years as per para (xii) of Key Features (on Annexure-B).

o GSTIN

3. Verification.—The entrepreneur shall apply for the loan Interest subvention to the concerned DTDO/ATDO (on Annexure-A). The concerned DTDO/ATDO will sponsor the case to the bank for cases of sanction of new loan after due evaluation on the basis of feasibility of the Tourism Unit. Before sanctioning of new term loan the DTDO/ATDO will provisionally register the unit and send the recommendation to the concerned Bank for term loan within 10 days after receiving the application. The bank will sanction the loan and complete full documentation and codal formalities as per their guidelines.

4. Disbursement.—The interest subvention subsidy will be parked in the nodal bank and released to the beneficiaries account on quarterly basis as per the claim raised by the bank. Interest subvention amount will be credited to the loan account of the beneficiary on quarterly basis by the nodal Bank.

5. Designated agency for disbursement of interest subsidy.— The Director Tourism & Civil Aviation shall be the designated agency for disbursement of incentive as defined under this scheme.

6. Expected Outcomes:

• Boost to urban, rural and offbeat tourism

• Formalization of the homestay economy

• Increased employment in tourism sectors through startup

• Enhanced quality standards in hospitality ventures

She further stated that despite extensive efforts by her and her husband to locate her missing mother-in-law, Smt. Batu, they were unsuccessful. We could not find even after a lot of searching and there is no any trace of my missing mother-in-law, Smt. Batu, been found until. I have no information till date whether she is alive or not.

Whereas, Smt Bimla Devi also stated that my above mentioned missing mother-in-law had only one son, Sh. Dhyan Singh, the only legitimate heir, who was my husband, who has now passed away on 23-05-2024, whose three legitimate heirs are now myself, my son Sh. Deepak and my daughter Pooja. She further stated that Smt. Batu has her own property in Mauza Mangoti, Tehsil Kasauli, District Solan H.P., now she want to transfer her, above mentioned land registered in the revenue records to legitimate heir of Smt. Batu Devi w/o Sh. Shobha Ram as per rule. Whereas, scrutiny has been made by the undersigned through his concerned official, it has been found that, Smt. Batu Devi w/o Sh. Shobha Ram, suddenly left home about 35 to 38 years ago and has not returned home since living home till date. In such a case, the property of the above mentioned Smt. Batu, will be transferred to their legal heirs, as per the Hindu Succession Act. Therefore, by this proclamation, the general public is hereby informed that any person having any objection for the transfer of property of Smt. Batu Devi w/o Sh. Shobha Ram in favour of their legal heirs may submit their objections in writing in this court on or before 30-10-2025 at 10.00 A.M., failing which no objection will be entertained after expiry of date.
