संख्या जी0ए0डी0-एफ-एफ(4) 8/99-खण्ड-II.—हिमाचल प्रदेश के राज्यपाल, एसएलपी (सी) संख्याः 2016 का 31435, हिमाचल प्रदेश राज्य और अन्य बनाम नीलम कुमारी में तारीख 28-02-2024 को 222-राजपत्र/2025-12-01-2026 (10029) 10030 राजपत्र, हिमाचल प्रदेश, 12 जनवरी, 2026/22 पौष, 1947 सर्वोच्च न्यायालय द्‌वारा पारित निर्णय के अनुसरण में और पूर्व विन्यास अधिनियम, 1890 (1890 का 6) की धारा-5 की उप-धारा (1) द्वारा प्रदत्त शक्तियाें का प्रयोग करते हुए अधिसूचना संख्याः जी0ए0डी0(एफ)1(ए0)4-2/90-खण्ड-1, तारीख 08 जून, 1994 को अधिसूचित "हिमाचल प्रदेश स्वतन्त्रता सेनानी कल्याण निधि के उपयोग के लिए योजना" का उस विस्तार तक संशोधन करते हैं कि पैरा-1 के खण्ड (ख) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

(ख) "आश्रितो से पत्नी और हिताधिकारी से सीधे तौर पर जुडे़ वंशज, विवाहित पुत्री/पौत्रियों और स्वतन्त्रता सेनानियाें की पुत्री की तरफ से विवाहित/अविवाहित पौत्रों/पौत्रियों और ऐसा अन्य व्यक्ति, जो हिमाचल प्रदेश स्वतन्त्रता सेनानी कल्याण बोर्ड (जिसे इसमें इसके पश्चात्‌ राज्य बोर्ड कहा गया है) की राय में पूर्णतः या भागतः हिताधिकारी पर आश्रित है, अभिप्रेत है।"

यह संशोधन स्वतन्त्रता सेनानी के प्रतिपाल्य (वार्ड) के आरक्षण को स्वतन्त्रता सेनानियों के पुत्रों के बच्चों के अतिरिक्त, पुत्रियों कें बच्चों को सम्मिलित करने हेतु विस्तारित करता है।

No. GAD-F-F(4)8/99-Part-II .—In pursuance of judgment dated 28-02-2024 passed by the Apex Court in SLP (c) No. 31435 of 2016, State of H.P. & ors. vs Neelam Kumari, the Governor, Himachal Pradesh, in exercise of the powers conferred by sub–section (1) of Section 5 of the Charitable Endowment Act, 1890 (Act VI) of 1890), to amend the "Scheme for the utilization of the Himachal Pradesh Freedom Fighters Welfare Fund" notified vide notification No. GAD(F)I(A)4-2/90-I dated 8th June, 1994, to the extent that for clause (b) of para-1, the following is substituted, namely:—

"Dependents" shall mean the wife, direct descendants of the beneficiary, married daughter/granddaughters and married/unmarried grandsons/grand-daughter from the side of daughters of Freedom Fighters and any other person, who in the opinion of Himachal Pradesh Freedom Fighters Welfare Board hereinafter referred to as the State Board is or was wholly or partly dependent on the beneficiary.

This amendment expands the WFF (Ward of Freedom Fighters) reservation to include children of daughters of freedom fighters, in addition to children of sons.

संख्याः ईडीएन (टीई) ए(3)-8/2024.-- हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियोंं का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, हिमाचल प्रदेश तकनीकी शिक्षा, व्यवसायिक एवं औद्योगिक प्रशिक्षण विभाग में प्रधानाचार्य (बहुतकनीकी), ग्रुप-ए के पद के लिए इस अधिसूचना से संलग्न उपाबन्ध-क के अनुसार भर्ती और प्रोन्नति नियम बनाते हैं, अर्थात्‌ः--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमाें का संक्षिप्त नाम हिमाचल प्रदेश तकनीकी शिक्षा, व्यवसायिक एवं औद्योगिक प्रशिक्षण विभाग, प्रधानाचार्य (बहुतकनीकी), ग्रुप-ए भर्ती और प्रोन्नति नियम, 2025 है।

(2) ये नियम राजपत्र, (ई-गजट) हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होेंगे। 2. निरसन और व्यावृतियां.--(1) इस विभाग की अधिसूचना संख्याः एस0टी0वी0(टी0ई0)ए0(3) 9/87-I, तारीख 02-12-1993 द्वारा अधिसूचित और असाधारण राजपत्र, हिमाचल प्रदेश में तारीख 25 दिसम्बर, 1993 को प्रकाशित हिमाचल प्रदेश तकनीकी शिक्षा, व्यवसायिक एवं औद्योगिक प्रशिक्षण विभाग प्रधानाचार्य बहुतकनीकी (वर्ग-I राजपत्रित) पद भर्ती और प्रोन्नति नियम, 1993 का एतद्‌द्वारा निरसन किया जाता है।

(2) ऐसे निरसन के होते हुए भी उपरोक्त उप नियम 2(1) के अधीन इस प्रकार निरसित नियमों के अधीन की गई कोई नियुक्ति या बात या कार्रवाई इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

परन्तु प्रोन्नति के प्रयोजन के लिए प्रत्येक कर्मचारी को, जनजातीय/कठिन/दुर्गम/अगम्य क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्राें में पद (पदों) की ऐसे क्षेत्रों में पर्याप्त संख्या की उपलब्धता के अध्यधीन, कम से कम एक कार्यकाल तक सेवा करनी होगीः

परन्तु यह और कि उपर्युक्त परन्तुक (1) उन कर्मचारियों के मामले में लागू नहीं होगा, जिनकी अधिवर्षिता के लिए पांच वर्ष की या उससे कम की सेवा शेष रही हो। तथापि ऐसे पदधारियों को, उनकी प्रोन्नति पर, दूरस्थ/ग्रामीण क्षेत्रों में तैनात/स्थानान्तरित किया जा सकेगाः

परन्तु यह और भी कि उन अधिकारी/कर्मचारी को, जिन्होंने जनजातीय/कठिन/दुर्गम/अगम्य क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्राें में कम से कम एक कार्यकाल तक सेवा नहीं की है, उसके अपने संवर्ग (काडर) में सर्वथा वरिष्ठता के अनुसार स्थानान्तरण किया जाएगा।

स्पष्टीकरण I.--उपरोक्त परन्तुक (I) के लिए जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्राें में "कार्यकाल" से प्रशासनिक अत्यावश्यकताओं/सुविधा को ध्यान में रखते हुए, साधारणतया तीन वर्ष की अवधि या ऐसे क्षेत्रों में तैनाती की इससे कम अवधि अभिप्रेत होगी।

स्पष्टीकरण II.--उपरोक्त परन्तुक (I) के प्रयोजन के लिए जनजातीय/कठिन क्षेत्र निम्न प्रकार से होंगेः-

(i) राज्य में समस्त जनजाती क्षेत्र (ii) चम्बा जिला का चुराह एवं मेहला खण्ड (ब्लॉक) (iii) रामपुर उपमण्डल का 15/20, 18/20, 12/20 क्षेत्रों के अन्तर्गत कुकी, दरकली, मुनीष, काशापाट पंचायत, जिला शिमला।

(iv) जिला शिमला के उप-मण्डल का डोडरा क्वार क्षेत्र (v) जिला शिमला के रोहडू उप-मण्डल के छोहारा खण्ड (ब्लॉक) की जावल, खाबल पेरवा तांगनू, जांगलिक, दिउड़ी, मायला, सिंदासली, धगोली, रोहल, रानोल, खरशाली, गॅावशारी, डिसवानी, ढाकगांव पंचायतें। (vi) जिला शिमला की कूपवी उप-तहसील। (vii) कांगड़ा जिला का छोटा भंगाल और बड़ा भंगाल क्षेत्र (viii) सिरमौर जिला की शिलाई और संगड़ाह तहसीलें10035 राजपत्र, हिमाचल प्रदेश, 12 जनवरी, 2026/22 पौष, 1947 (ix) जिला सिरमौर में तहसील नौहराधार के चरना पटवार वृत्त और ददाहू तहसील के खाला क्यार, भाटगढ़, कोटिधिमान और जराग के पटवार वृत्त।

(x) जिला मण्डी का चौहार घाटी

स्पष्टीकरण-III.—उपरोक्त परन्तुक (1) के प्रयोजन कि लिए दूरस्थ/ग्रामीण क्षेत्र निम्न प्रकार से होंगेः- (i) उप- मण्डल/तहसील मुख्यालय से 20 किलोमीटर की परिधि से परे के समस्त स्थान।

(ii) राज्य मुख्यालय और जिला मुख्यालय से 15 किलोमीटर की परिधि से परे के समस्त स्थान जहा के लिए बस सेवा उपलब्ध नहीें है और 3 किलोमीटर से अधिक की पैदल यात्रा करनी पड़ती है।

(iii) कर्मचारी का, उसके प्रवर्ग को ध्यान में लाए बिना अपने गृहनगर या गृहनगर क्षेत्र के साथ लगता 20 किलोमीटर की परिधि के भीतर का क्षेत्र।

(I) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व, सम्भरक(पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अध्यधीन प्रोन्नति के लिए गणना में ली जाएगी, कि सम्भरक(पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थीः परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक(पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पद की गई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहा उससे वरिष्ठ सभी व्यक्ति अपने-अपने प्रवर्ग/पद/काडर में विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएगेः

परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः

परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहा उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे।

स्पष्टीकरण.--अंतिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जिसने आपातकाल की अवधि के दौरान सशस्त्र बलों में कार्य ग्रहण किया था और जिसे डिमोबिलाइज्ड आर्मड फोर्सिज परसोनल (रिजवेशन ऑफ वैकन्सीज इन दी हिमाचल स्टेट नॉन-टैक्नीकल सर्विसीज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों या जिसे एक्स-सर्विसमैन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसिज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और तद्‌धीन वरीयता लाभ दिए गए हों।

(II) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थीः

TECHNICAL EDUCATION, VOCATIONAL & DEPARTMENT OF INDUSTRIAL TRAINING

NOTIFICATION

No. EDN(TE)A(3)-8/2024.—In exercise, of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the Recruitment and Promotion Rules for the post of Principal (Polytechnic), Group-A in the Department of Technical Education, Vocational & Industrial Training, Himachal Pradesh, as per Annexure-A attached to this Notification, namely:—

1. Short title and

Commencement:

These Rules may be called the Himachal Pradesh, Technical Education, Vocational and Industrial Training Department, Principal (Polytechnic) Group-A Recruitment and Promotion Rules, 2025.

These rules shall come into force from the date of publication in the Rajparta (e-Gazette), Himachal Pradesh.

2. Repeal & Savings: The Himachal Pradesh, Technical Education, Vocational and Industrial Training Department, Principal (Polytechnic) (Class-I Gazetted), Recruitment and Promotion Rules, 1993 notified vide this Department Notification No. STV(TE)A(3)-9/87-I, dated 02-12-1993 and published in Rajpatra on 25-12-1993 are hereby repealed.

Notwithstanding such repeal, any appointment made or anything done or any action taken under these rules so repealed under sub-rule 2(I) supra shall be deemed to have been validly made, done or taken under these rules.

Taragarh, तहसील बैजनाथ, जिला कांगड़ा (हि0प्र0) ने इस न्यायालय में प्रार्थना-पत्र पेश किया है कि प्रार्थी का जन्म दिनांक 23-05-1989 को गांव लदोह, डा0 पंचरूखी, तहसील पंचरूखी, जिला कांगड़ा (हि0प्र0) में घर पर हुआ था। उस समय इनका परिवार किराये के मकान में रहता था परन्तु उस समय अज्ञानतावश इनके परिवार वालों ने ग्राम पंचायत लदोह के अभिलेख में जन्म तिथि पंजीकृत नहीं करवाई थी। अब इनको किसी कारणवश अपने जन्म प्रमाण पत्र की आवश्यकता है। अतः सम्बन्धित ग्राम पंचायत को जन्म पंजीकरण के आदेश पारित किए जाएं।

अतः इस इश्तहार द्वारा सर्वसाधारण को सूचित किया जाता है कि यदि इस बारे किसी व्यक्ति को कोई उजर या एतराज हो तो वह दिनांक 23-01-2026 को अधोहस्ताक्षरी की अदालत में सुबह 11.00 बजे असालतन या वकालतन हाजिर होकर अपना पक्ष पेश कर सकते हैं। बाद गुजरने मियाद कोई भी उजर या एतराज काबिले समायत न होगा तथा प्रार्थी की जन्म तिथि पंजीकरण दिनांक 23-05-1989 के आदेश ग्राम पंचायत लदोह, तहसील पंचरूखी, जिला कांगड़ा (हि0प्र0) को जारी कर दिए जाएंगे।

प्रार्थी श्री प्रदीप कुमार पुत्र श्री ईटली राम, निवासी गांव वार खुर्द, डाकघर वारी कलां, तहसील खुण्डियां, जिला कांगड़ा, हिमाचल प्रदेश ने स्वयं उपस्थित होकर प्रार्थना-पत्र प्रस्तुत किया है कि उसका जन्म दिनांक 16-04-1975 को गांव वार खुर्द में हुआ है परन्तु अज्ञानतावश ग्राम पंचायत वारी कलां के अभिलेख में जन्म तिथि दर्ज नहीं हुआ है जिसे ग्राम पंचायत वारी कलां के अभिलेख में दर्ज किया जाना अनिवार्य है।10045 राजपत्र, हिमाचल प्रदेश, 12 जनवरी, 2026/22 पौष, 1947 अतः सर्वसाधारण को सुनवाई हेतु बजरिये इश्तहार व मुस्त्री मुनादी द्वारा सूचित किया जाता है कि इस सम्बन्ध में किसी प्रकार का उजर/एतराज हो तो वह दिनांक 16-02-2026 को असालतन व वकालतन पेश होकर अपना एतराज दर्ज करवा सकता है। उसके उपरान्त कोई भी उजर/एतराज जेरे समायत न होगा तथा प्रार्थी श्री प्रदीप कुमार पुत्र श्री ईटली राम, निवासी गांव वार खुर्द, डाकघर वारी कलां की जन्म तिथि दिनांक 16-04-1975 जेरे धारा 13(3) जन्म एवं मृत्यु पंजीकरण अधिनियम, 1969 के तहत ग्राम पंचायत वारी कलां के अभिलेख में दर्ज करने के आदेश पारित कर दिये जायेंगे।

Whereas, Smt. Sulkshana Devi w/o Late Sh. Kesar Singh, r/o Village Kadana, P.O. Rehan, Sub-Tehsil Raja ka Talab, District Kangra, H.P. has filled an application before the undersigned in which she has stated that her correct name according to Gram Panchayat record, Aadhar Card, Bank record, Mark List etc. is Smt. Sulkshana Devi w/o Late Sh. Kesar Singh but due to clerical mistake her name has been wrongly entered in Revenue record of Mohal Kadana Patwar Circle Rehan bearing Khata No. 33, Khatoni No. 58 in Mohal Kadna.

The enquiry of the application filed by the applicant was conducted through field revenue agencies and after receiving report from the field revenue agencies, it has been observed that the applicant's correct name is Smt. Sulkshana Devi w/o Late Sh. Kesar Singh but the name of the applicant is recorded in revenue record Smt. Sudershana Devi w/o Late Sh. Kesar Singh.

Now, therefore, in pursuance of section 38 of H.P. Land Revenue Act, 1954, proclamation is hereby issued to all General public concerned that objection in this regard fort correction of the name of Smt. Sudershana Devi w/o Late Sh. Kesar Singh shall be heard by the undersigned on 27-01-2026 in this court at Raja Ka Talab. Any person having any objection to make in the matter may due so on the said date and place in person or through legal practitioner or through recognised agent. प्रार्थी श्री देवांग रिंगजिन सुपुत्र स्व0 श्री डण्डूप पलदन, निवासी गांव व डा0 सुन्नम, तहसील पूह, जिला किन्नौर (हि0प्र0) ने जिला पंजीयक जन्म एवं मृत्यु एवं मुख्य चिकित्सा अधिकारी, जिला किन्नौर के माध्यम से अपने पिता स्व0 श्री डण्डूप पलदन की मृत्यु दिनांक 27-11-1994 का इन्द्राज सचिव ग्राम पंचायत सुन्नम, जिला किन्नौर के कार्यालय अभिलेख (मृत्यु इद्राज रजिस्टर) में करवाने बारे आवेदन पत्र दायर किया है। प्रार्थी का दावा है कि उसके पिता स्व0 डण्डूप पलदन का देहान्त दिनांक 27-11-1994 को हुआ है परन्तु अज्ञानतावश उनकी मृत्यु का इन्द्राज सचिव ग्राम पंचायत सुन्नम, तहसील पूह, जिला किन्नौर के कार्यालय अभिलेख में न करवाया जा सका है। 10048 राजपत्र, हिमाचल प्रदेश, 12 जनवरी, 2026/22 पौष, 1947 अतः आम जनता, स्व0 श्री डण्डूप पलदन के कानूनी वारसान व सगे सम्बन्धियों को इस अदालती इश्तहार के माध्यम से सूचित किया जाता है कि यदि किसी को भी उक्त व्यक्ति स्व0 डण्डूप पलदन, निवासी गांव व डा0 सुन्नम, तहसील पूह, जिला किन्नौर हि0प्र0 की मृत्यु दिनांक 27-11-1994 के इन्द्राज करने बारे कोई आपत्ति हो तो वह अपना एतराज भीतर एक माह किसी भी कार्यदिवस को असालतन या वकालतन अधोहस्ताक्षरी के कार्यालय में आकर दायर कर सकता है। आम जनता व मृतक के परिजनों की तरफ से कोई भी एतराज प्राप्त न होने की सूरत में आवेदन पत्र पर आगामी कार्यवाही अमल में लाई जाएगी व उसके पश्चात प्राप्त होने वाला कोई भी एतराज मान्य न समझ जाएगा।

इस अदालत हजा में श्रीमती संजुशा पत्नी श्री चंदर सिंह, निवासी गांव थाना, डाकघर मांदल, उप-तहसील सरस्वतीनगर सावडा, जिला शिमला (हि0 प्र0) ने इस कार्यालय में एक आवेदन प्रस्तुत किया है जिसमें यह कथन प्रस्तुत किया गया है कि उनकी पुत्री कुमारी सहज की दसवीं कक्षा की अंकतालिका में अंकित जन्म तिथि एवम्‌ पिता का नाम त्रुटिपूर्ण है। आवेदिका के अनुसार दसवीं कक्षा की अंकतालिका में उनकी पुत्री कुमारी सेहज की जन्म तिथि 28-03-2010 अंकित है तथा पिता का नाम चंदर जिन्टा दर्शाया गया है जबकि वास्तविक विवरण (जन्म प्रमाण-पत्र व परिवार रजिस्टर की नकल) के अनुसार सही जन्म तिथि 08-04-2009 है तथा पिता का सही नाम चंदर सिंह है। आवेदिका द्वारा इस कार्यालय में प्रमाण के तौर पर कुमारी सहज का जन्म प्रमाण-पत्र तथा परिवार रजिस्टर की प्रमाणित नकल प्रस्तुत की गई है। प्रस्तुत अभिलेखों के अवलोकन से यह प्रमाणित होता है कि जन्म प्रमाण-पत्र एवं परिवार रजिस्टर में कुमारी सहज की जन्म तिथि 08-04-2009 है तथा पिता का नाम चंदर सिंह अंकित है। अतः इस इश्तहार के माध्यम से आम जनता को सूचित किया जाता है कि यदि किसी व्यक्ति को कुमारी सहज की दसवीं कक्षा की अंकतालिका में जन्म तिथि एवं पिता के नाम संशोधन के संबंध में कोई आपत्ति हो, तो वह अपनी आपत्ति असालतन व वकालतन दिनांक 31 जनवरी, 2026 को दोपहर 2 बजे अदालत हजा में हाजिर होकर अपना एतराज पेश कर सकता है। निर्धारित अवधि के पश्चात्‌ किसी भी आपत्ति पर कोई विचार नहीं किया जाएगा।
