Shimla, the 8th January, 2026.

No. HPERC-ED(T)/D(TE)/2026.—WHEREAS, the Himachal Pradesh Electricity Regulatory Commission has notified the HPERC (Consumer Grievances Redressal Forum and 223-राजपत्र/2025-13-01-2026 (10059)10060 राजपत्र, हिमाचल प्रदेश, 13 जनवरी, 2026/23 पौष, 1947 Ombudsman) Regulations, 2013 vide Notification No. HPERC-(H)(1)-1/2012 dated 23rd January 2013 and the same were published in the Rajpatra on 28th January 2013 (hereinafter referred to as "the said Regulations");

AND WHEREAS, the Commission has invited applications to fill up the vacant posts of Independent Members in some of the Forums as per provisions of sub-regulation (1) of Regulation 7 of the said Regulations;

AND WHEREAS, it is observed that sufficient number of applications are not being received due to required long service experience of minimum twenty years under the existing eligibility criteria specified under Regulation 7 (1)(ii)(a) of the said Regulations;

AND WHEREAS, in order to nominate Independent Members to the CGRF Shimla and Additional CGRFs in the State and to made these forums functional, it is considered necessary in the interest of the Electricity Consumers of the State to reduce the existing eligibility condition of "20 years service experience" to "10 years service experience" in sub-clause (a) of clause (ii) of sub-regulation (1) of Regulation 7 by making necessary amendment in the said Regulations;

NOW, THEREFORE, the Himachal Pradesh Electricity Regulatory Commission in exercise of the powers conferred under clauses (r) and (s) of sub-section (2) of section 181 read with sub- sections (5) to (8) of section 42 of the Electricity Act, 2003 (36 of 2003) read with section 21 of the General Clauses Act, 1897 (Act No. 10 of 1897) and rule 15 of the Electricity (Rights of Consumers) Rules, 2020 and all other powers enabling it in this behalf, proposes further to amend the Himachal Pradesh Electricity Regulatory Commission (Consumer Grievances Redressal Forum and Ombudsman) Regulations, 2013, and as required by Rule 3 of the Electricity (Procedure for Previous Publication) Rules, 2005, the draft amendment Regulations are hereby published for the information of all the persons likely to be affected thereby; and notice is hereby given that the said draft amendment Regulations will be taken into consideration after the expiry of thirty (30) days from the date of publication of this Notification in the Rajpatra, Himachal Pradesh together with objections or suggestions, if any, received within the above stipulated period.

DRAFT REGULATIONS

1. Short title and commencement.—(1) These Regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Consumer Grievances Redressal Forum and Ombudsman) (Fourth Amendment) Regulations, 2026. (2) These Regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Regulation 7.—In Regulation 7 of the Himachal Pradesh Electricity Regulatory Commission (Consumer Grievances Redressal Forum and Ombudsman) Regulations, 2013, in sub-regulation (1), in clause (ii), for sub-clause (a), the following sub-clause shall be substituted, namely:—

"(a) who are retired officers of the Central or State Government or its Undertakings having minimum service experience of ten years as such and are familiar with the consumer affairs, power sector or regulatory affairs; or".

POLICY FOR PREMATURE RELEASE OF THE PRISONERS UNDERGOING

SENTENCE OF LIFE IMPRISONMENT-ELIGIBILITY CRITERIA FOR,

CONSTITUTION OF HIMACHAL PRADESH STATE SENTENCE

REVIEW BOARD AND PROCEDURE TO BE FOLLOWED

1. STATE SENTENCE REVIEW BOARD:

The State Sentence Review Board shall review the sentence awarded to the prisoners and recommend the pre-mature release in appropriate cases. The Review Board shall be a permanent body having following constitution:—

The recommendation of the Sentence Review Board shall not be invalid merely by reason of any vacancy in the Board or the inability of any Member to attend the Board meeting. The meeting of the Board shall not however, be, held if the Coram is less than 4 Members including the chairman.

2. ELIGIBILTY FOR PREMATURE RELEASE:

(i) Every convicted prisoner whether male or female undergoing sentence of life imprisonment and covered by the provisions of Section 475 BNSS shall be eligible to be considered for premature release from the prison immediately after serving out the sentence of 14 years of actual imprisonment i.e. without the remissions. It is, however, clarified that completion of 14 years in prison by itself would not entitle a convict to automatic release from the prison and the Sentence Review Board shall have the discretion to release a convict, at an appropriate time in all cases considering the circumstances in which the crime was committed and other relevant factors like:—

(a) Whether the convict has lost his potential for committing crime considering his overall conduct in Jail during the 14 year's incarceration;

(b) The possibility of reclaiming the convict as a useful member of the society;

and

(c) Socio-economic condition of the convict's family.

The life convict covered under Section 475 BNSS are required to undergo 14 years of actual imprisonment before release. The total period of incarceration including remissions in such cases should ordinarily not exceed 20 years. The magnitude, brutality and gravity of offence for which the convict was sentenced to life imprisonment will be kept in view. Certain categories of convicted prisoners undergoing life sentence would be entitled to be considered for premature release only after undergoing imprisonment for 20 years including remission. The period of incarceration including remission even in such cases should not exceed 25 years. Following categories are mentioned in this connection by way of illustration and are not to be taken as an exhaustive list of such categories:

(a) Convicts who have been imprisoned for life for murder in heinous cases such as murder with rape, murder with dacoity, murder involving an offence under the protection of Civil Rights Act, 1955, murder committed after conviction while inside the Jail, murder during parole, murder in terrorist incident, murder in smuggling operation, murder of a public servant on duty.

(b) Gangsters, contract killers, smugglers, drug traffickers, racketeers awarded life imprisonment for committing murders as also the perpetrators of murder committed with pre-meditation and with exceptional violence or perversity.

(c) Convicts whose death sentence has been commuted to life imprisonment.

(ii) All other convicted male prisoners not covered by Section 475 BNSS the sentence of life imprisonment would be entitled to be considered for premature release after they have served at least 14 years of imprisonment inclusive of remission but only after completion of 10years actual imprisonment i.e. without remissions.

(iii) The female prisoners not covered by Section 475 BNSS undergoing the sentence of life imprisonment would be entitled to be considered for premature release after they have served at least 10 years of imprisonment inclusive of remissions but only after completion of 7 years actual imprisonment i.e. without remissions.

(iv) Cases of premature release of persons undergoing life imprisonment before completion of 14 years of actual imprisonment on grounds of terminal illness or old age etc. can be dealt with under the provisions of Article, 161 of the constitution.

3. PREMATURE RELEASE PROCESS OF ELIGIBLE CONVICTS :

STAGE 1- IDENTIFICATION OF ELIGIBLE CONVICTS

A. Recording of data of life convicts & other convicts

(i) The Superintendent Jail of all the prisons in the State shall prepare the list of all life convicts and other convicts, who would be entitled to be considered for premature release in the next four months. (ii) The following details shall be included in the list prepared by the Superintendent Jail:-- (1) Name of the Convict

(2) Father's name

(3) Gender10074 राजपत्र, हिमाचल प्रदेश, 13 जनवरी, 2026/23 पौष, 1947 (4) Age as on the date of eligibility (5) Particulars of offence(s) for which the convict is serving the sentence

(6) Police Station in whose jurisdiction the crime was committed

(7) Name of the trial court which passed the sentence

(8) Duration and nature of the sentence

(9) Duration of sentence served as on date of eligibility

(10) Total remission earned as on date of eligibility

(11) Remarks by the Prison Superintendent

(iii) The Superintendent Jail shall prepare the list of eligible life convicts and other convicts with a gap of four months, in January, May and September. This list should be preferably prepared within the first ten days of these months.

(iv) The Superintendent Jail shall prepare this list in soft/digital form (in Microsoft Word or Excel or any other similar platform).

(v) Based on the list of prisoners so created, the Superintendent Jail shall prepare individual case files for each prisoner eligible for premature release, as per prescribed formats by the State Government. Where no format is available, a format may be prepared by the state prison department.

(vi) The Superintendent Jail may also depute paralegals appointed by the District Legal Services Authority (DLSA) in the Prison Legal Aid Clinic (PLAC) to assist in the process of preparation of the individual case files of eligible convicts.

(vii) The access to the details of life convicts included in this list and individual case files shall be strictly limited only to the Superintendent Jail, concerned DLSA and paralegals involved in the process of premature release.

B. Sharing the list of eligible convicts with the DLSA

(i) The Superintendent Jail shall send a copy of the list of eligible convicts to the DLSA as soon as the list is prepared, and within the 10th day of the respective months (January, May and September) in which the list is to be prepared.

(ii) DLSA shall appoint jail visiting lawyers and paralegals assigned to the PLAC to assist the convict prisoners in preparation of their applications. The concerned DLSA shall issue a roster as soon as possible after receiving the list of eligible convicts in the following format:

Title.—Case wise roster of assigned jail visiting lawyers and paralegals assigned for assisting the eligible convicts in preparation of their premature release application and individual case files.

(iii) The DLSA shall send the issued roster to the Superintendent Jail within 4 days from the date of receiving the list of eligible prisoners from the Superintendent Jail.

(iv) The Superintendent Jail shall intimate the prisoners individually about the assigned person for assisting them in the preparation of their premature release application.

STAGE 2-PROCEDURE/PREPRATION AND SUB MISSION OF THE APPLICATIONS/

CASES FOR CONSIDERATION OF THE REVIEW BOARD

A. Collection of documents

(i) The Superintendent Jail shall collect all the documents required for considering an application of premature release.

(ii) The Superintendent Jail shall send letters to the concerned authorities for seeking required documents which are not available with the prison administration by 1st February (for the list prepared in January), 1st June (for the list prepared in May) and 1st October (for the list prepared in September).

(iii) The Superintendent Jail shall make reference to the District Magistrate/Superintendent of Police of the District where the convict prisoner was ordinarily residing at the time of the commission of the offence for which he was convicted and sentenced or where he is likely to resettle after his release from the Jail. However, in case the place where the convict prisoner was ordinarily residing at the time of the commission of the offence is different from place where he committed the offence, a reference shall also be made to the District Magistrate/ Superintendent of Police of the District in which the offence was committed. In either case, he shall forward a copy of the note prepared by him to enable the District Magistrate and Superintendent of Police to express their views in regard to the desirability of the premature release of the convict.

(iv) On receipt of the reference, the concerned District Magistrate/ Superintendent of Police shall cause an inquiry to be made in the matter through Senior Police Officer of appropriate rank and based on their own assessment shall make their recommendations. While making the recommendation the District Magistrate/ Superintendent of Police shall not act mechanically and oppose the premature release of the convict prisoner on untenable and hypothetical grounds/ apprehensions. In case the District Magistrate/ Superintendent of Police are not in favour of the premature release of the prisoner, they shall justify the same with cogent reasons and material. They shall return the reference to the Superintendent of the concerned Jail not later than 30 days from the receipt of the reference.

(v) The Superintendent of Jail also makes a reference to the Chief Probation Officer of the State and shall forward to him a copy of his note. On receipt of the reference, the Chief Probation Officer shall either hold or cause to be held an inquiry through a Probation Officer in regard to the desirability of premature release of the prisoner having regard to his family members and the society prospects of the prisoner for rehabilitation and leading a meaningful life as a good citizen. He will not act mechanically and recommend each and every case for premature release; in either case he should justify his recommendation by reason material. The Chief Probation Officer shall furnish his report/recommendations to the Superintendent of Jail not later than 30 days from the receipt of the reference.

(vi) As per the mandate Section 473(2) of BNSS The Superintendent of Jail shall also make a reference to the Presiding Judge of the convicting Court to obtain his opinion on the desirability of the premature release of the prisoner, together with his reasons for such opinion, a certified copy of the record of the trial or of such record thereof as exists.

(vii) The process of compiling documents/information for the individual case files and preparation of the premature release applications shall be completed in maximum 2 months i.e., by 31st March (for the list prepared in January), by 31st July (for the list prepared in May) and by 31st November (for the list prepared in September).

B. Sending premature release files to the Director General/ Additional Director

General of Prisons.

(i) The Superintendent Jail shall send the list of eligible prisoners and individual case files with all the documents/information complied as on the following dates alongwith the convict's application by 1st April (for the list prepared in January), by 1st August (for the list prepared in May) and by 1st December (for the list prepared in September) to the Director General/ Additional Director General of Prisons. Even in cases where the collection of documents/information is incomplete, the files shall be sent to the Director General/ Additional Director General of Prisons with the documents collected so far without any delay.

(ii) The Nodal Officer so deputed at the head office of the prison department shall collect the remaining documents/information in cases where it is incomplete and shall forward the complete file to the Sentence Review Board within one month.

(iii) The Nodal Officer may take the assistance of the concerned DLSAs or SLSA for collecting the remaining documents/information in cases where the prison superintendents could not collect all the documents as required under the State's premature release policy.

(iv) No file of premature release of convicts/prisoners shall be returned or held back for the reasons of incomplete documents/information at the Prison Headquarter/ Superintendent Jail level.

(v) The Director General/ Additional Director General of Prisons shall examine the case bearing in mind the report/recommendations of the Superintendent of Jail, District Magistrate/ Superintendent of Police/ Chief Probation Officer and the opinion of the Presiding Judge of the convicting Court and shall make his own recommendations with regard to the premature release of the prisoner or otherwise keeping in view the general and special guidelines laid down for Sentence Review Board. Regard shall also be had10077 राजपत्र, हिमाचल प्रदेश, 13 जनवरी, 2026/23 पौष, 1947 to various norms laid down and guidelines given by the Apex Court and various High Court in the matter of premature release of prisoners.

STAGE 3- RECOMMENDATION BY THE REVIEW BOARD

A. Meeting

(i) The Sentence Review Board shall meet once in every four months, preferably in the months of April, August and December with full quorum as per the policy. However, it shall be open to the Chairman of the Board to convene a meeting of the Board more frequently as may be deemed necessary.

(ii) The Director General/ Additional Director General of Prisons shall convene a meeting of the Sentence Review Board on a date and time at the State Headquarter, an advance notice of which shall be given to the Chairman and members of the Board atleast ten days in advance of the scheduled meeting and it shall accompany the complete agenda paper i.e. the note of the Superintendent of Jail, recommendation of District Magistrate/ Superintendent of Police, Chief Probation Officer, The opinion of the Presiding Judge of the convicting court alongwith the copies of documents, if any.

B. Making recommendations

(i) A meeting shall ordinarily be chaired by the Chairman and if some reasons he is unable to be present in the meeting it shall be chaired by the Secretary (Law)-cum- Legal Remembrancer. The Member Secretary (D.G./A.D.G. of Prisons) shall present the case of each prisoner under consideration before the Sentence Review Board. The Board shall consider the case and take a view, as far as practicable; the Sentence Review Board shall endeavor to make unanimous recommendation. However, in cases of a dissent, the majority view shall prevail and will be deemed to be decision of the Board.

(ii) The Sentence Review Board shall ask for the documents/information in cases where it is incomplete.

(iii) Incomplete documents or lack of information on any criteria shall not be considered as an adverse circumstance. No premature release application should be recommended against or put in abeyance only on the ground of incomplete documents or information.

(iv) While considering the case of premature release of a particular convict, the Board shall keep in view the general principals of amnesty/remission of the sentences as laid down by the State Government or by Courts as also the earlier precedents in the matter. The paramount consideration before the State Sentence Review Board shall be the Welfare of the prisoner and the society at large. The Board shall not ordinarily decline a premature release of prisoner merely on grounds that the police has not recommended his release on certain farfetched and hypothetical premises. The following considerations shall also be taken into account and to determined on a case-to-case basis in making recommendation –

A. Whether the offence was an individual act of crime without affecting the society at large;

B. Whether there was any chance of future recurrence of committing a crime; C. Whether the convict had lost his potentiality in committing the crime;

D. Whether there was any fruitful purpose of confining the convict anymore; and E. The socio-economic condition of the convict's family and other similar circumstances.

(v) Rejection of the case of a prisoner for premature release on one or more occasions by the Sentence Review Board will not be a bar for reconsideration of his case. However, the reconsiderations of the case of a convict already rejected shall be done only after the expiry of a period of one year from the date of last consideration of his case.

(vi) The Sentence Review Board shall forward its recommendation to the appropriate government/ State Government in all cases within 10 days from the day on which the meeting is conducted.

STAGE 4.— ORDERS BY THE STATE GOVERNMENT/APPROPRIATE

GOVERMENT

A. Deciding on the recommendation of the review board

(i) The appropriate Government/State Government shall make its decision on all cases recommended by the Sentence Review Board within one month of receiving the recommendation.

(ii) The appropriate government shall immediately send a copy of the order to the Prison Headquarters and the concerned SLSA and in case the appropriate government has ordered to grant remission and order his premature release, the prisoner shall be released forthwith with conditions as specified below.—

CONDITIONS

Whenever a convict is prematurely released, the following conditions may be imposed:

(1) Before the release, the petitioner shall furnish to the satisfaction of the District Magistrate concerned, a bond for keeping peace and good behavior, and shall undertake not to threaten or cause any harm to the complainant or witnesses. For this purpose, two bonds shall be executed, one by the prisoner himself in the sum of Rs. 10,000/- (Rupees Ten thousand only) and other by the two sureties in like amount:

Provided that, if the prisoner is unable to submit surety bond on account of financial weakness and requests exemption from Surety, the District Magistrate shall assess and verify the financial status of the convict. If the convict is found to be financially weak, he may be released on executing a Personal bond either after the expiry of a period of one month from the date of receipt of the release order at the Jail premises or from the date of recommendation by the District Magistrate that the convict is indeed financially weak, whichever is earlier.

(2) If during the above mentioned unexpired period of the sentence, the prisoner is found to have committed any non-bailable criminal offence, the remission granted to him shall be liable to be cancelled and he shall serve the unexpired portion of his/her sentence in Jail.

Provided that such cancellation shall be effected only after the prisoner is convicted by a competent court in such a case,10079 राजपत्र, हिमाचल प्रदेश, 13 जनवरी, 2026/23 पौष, 1947 Provided further that, if the prisoner is involved in offences such as rioting, waging war against the Government, or any action that endangers the sovereignty, unity, and integrity of the country or poses a serious threat to public tranquility, and law and order, the remission granted to him may be cancelled by the appropriate Government on the basis of a report submitted by the District Administration, subject to the due compliance with the provisions of Section 432(3) of the CrPC and Section 473(3) BNSS.

(3) The sum of each of the bonds shall stand forfeited to the Government in case of breach of any condition of the bond.

(4) After being released from jail the prisoner shall mark his presence in the nearest police station on a regular basis, as directed by the District Magistrate or the Superintendent of Police, for a period of 1 year.

(5) At the time of his release, the prisoner shall submit to the District Magistrate concerned, full particulars of the place where he intends to reside and shall keep the said District Magistrate informed about any subsequent changes of his residence during the said period.

(6) The amount of fine, if any, shall be paid by the prisoner before his release.

(7) The prisoner shall not possess or carry any fireman, ammunition, explosive substance, or any weapon, licensed or otherwise, during the period of remission.

(8) The prisoner shall not leave the territorial jurisdiction of the District in which he is permitted to reside without prior written permission of the District Magistrate.

(9) The prisoner shall not directly or indirectly contact, approach, or communicate with the complainant or prosecution witnesses of the case in which he was convicted, except through legal channel or with prior permission of the District Magistrate.

Additionally, in the event the appropriate Government proposes to cancel or withdraw remission under Section 432(3) of the CrPC or Section 473(3) of the BNSS, such cancellation shall follow due process of law, including issuance of a show cause notice, affording the prisoner an opportunity of being heard, and passing a reasoned order, as mandated by the Hon'ble Supreme Court in Criminal Appeal No. 4307 of 2024, titled as Mafabhai Motibhai Sagar Vs State of Gujarat & Ors.

(iii) The Prison Headquarters shall ensure that all orders granting premature release or rejection thereof, along with the reasons behind its order, are uploaded on the official website of the prison department as soon as possible.

B. Communicating the orders to the convicts

(i) The Prisons Department shall forward the orders of the appropriate Government to the concerned Superintendents Jail, with a copy marked to the DLSA Secretaries, respectively as soon as the orders are received by them from the appropriate government.

(ii) The Superintendents Jail shall communicate the decision of the appropriate Government on the premature release application to the concerned convicts as soon as the orders are received by them.

MERCY PETITIONS

Procedure for Consideration of Mercy Petition under Article 161 by the State

Sentence Review Board

Constitutional Provision:

The procedure is framed in accordance with Article 161 of the Constitution of India, which empowers the Governor of a State to grant pardons, reprieves, respites or remissions of punishment, or to suspend, remit or commute the sentence of any person convicted of any offence against any law relating to a matter to which the executive power of the State extends.

(A) State Sentence Review Board

The State Sentence Review Board is constituted by the State Government to scrutinize and recommend eligible cases for the consideration of the Governor under Article 161.

(B) Eligibility Criteria for Mercy Petition

(A) convict may submit a mercy petition under Article 161 if—

(a) All legal remedies including appeals, revisions, and Special Leave Petition have been exhausted.

(b) A reasonable time has passed since the conviction and sentencing.

(c) There are genuine grounds such as—

(i) Serious illness (physical or mental)

(ii) Old age

(iii) Family hardship, and

( iv) Any other humanitarian grounds.

(C) Submission of the Petition-

(a) The mercy petition may be submitted by the convict, a family member or a legal representative, either—

(i) Directly to the Governor, or

(ii) To the Superintendent of Jail.

(D) Procedure for Processing Mercy Petition

(a)sIf submitted to the Governor—

The Home Department will verify the completeness of the petition and obtain necessary reports from the Jail Authorities/ Superintendent, District Magistrate, Police Authorities, and other relevant departments.

(b) If submitted to the Superintendent of Jail –

The Superintendent of Jail shall forward the application along with all relevant records to the Government through the Director General of Prisons.

(c) Once all reports and documents are complete, the case is placed before the State Sentence Review Board, which assesses—

(i) The conduct of convict in prison.

(ii) Circumstances of the offence.

(iii) Grounds raised in the petition.

(iv) Socio-economic background and family situation.

(E) Recommendation of the State Sentence Review Board

The State Sentence Review Board shall record its detailed recommendation and submit it to the Home Department for submission to the Governor.

(F) Final Consideration by the Governor

(a) Based on the recommendation of the State Sentence Review Board and other material available, the Governor shall take a final decision under Article 161.

(b) The decision of the Governor shall be communicated to the petitioner through the concerned Superintendent of Jail.

(c) As far as possible, all correspondence should be conducted by email, unless confidentiality and sensitivity is involved.

सं0ः पी0डब्ल्यू0डी0-बी-एफ0(5)/49/2025-296697.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामतः गांव नागल सकेती (141), तहसील नाहन, जिला सिरमौर, हिमाचल प्रदेश में खजुरना-नागल-सकेती-काला अम्ब सड़क के निर्माण हेतुु भूमि अर्जित करनी अपेक्षित है, अतएव एतद्‌ द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-11 के उपबन्धों के अन्तर्गत जारी की जाती है।
