Dhanotu, Tehsil Shahpur, District Kangra (H.P.) has filed an application dated 04-09-2025 before the Secretary (Labour Employment & O.P.) to the Government of Himachal Pradesh, in terms of Section-17(2) of the Working Journalists and Other Newspaper Employees (Conditions of10312 राजपत्र, हिमाचल प्रदेश, 19 जनवरी, 2026/29 पौष, 1947 Service) and Miscellaneous Provisions Act, 1955, in lieu of the reference notification No. LO/DSL/IV LL/WJA/19/2019-782-787, dated 11/23-11-2019 made by Labour Officer-cum- Conciliation Officer, Kangra at Dharamshala And;

Whereas, Shri Jitender Kumar s/o Late Shri Roshan Lal, r/o V.P.O. Dhanotu, Tehsil Shahpur, District Kangra, H.P. has earlier filed his claim dated 04-09-2019 before the Labour Officer-cum-Conciliation Officer, Kangra at Dharamshala in terms of Section-17 of the Working Journalists and Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955 against the CMD Divya Himachal Prakashan Pvt. Ltd., Kangra Pathankot Marg, Old Matour, Tehsil and District Kangra, H.P. for non-payment of arrear of wages, as difference of wages as per recommendation of Majithia Wage Board. The Labour Officer-cum-Conciliation Officer, Kangra at Dharamshala, District Kangra tried to settle the claim application amicably, but the same could not be settled and he made the reference to the Ld. Labour Court-cum-Industrial Tribunal, Kangra at Dharamshala for legal adjudication vide Notification No. LO/DSL/IV LL/WJA/19/2019-782-787, dated 11/23-11-2019 and the same is registered as Reference No. 150 of 2019 before the Ld. Labour Court-cum-Industrial Tribunal and same is pending for adjudication And; Whereas, in similar matter the Ld. Labour Court-cum-Industrial Tribunal, Shimla vide award dated 18-10-2024 in reference No. 74/2017 titled as Ravinder Sharma versus M/s Dainik Prakashan Ltd., which has been referred by the Labour Officer-cum-Conciliation Officer, Shimla for legal adjudication has already been rejected the reference Notification, the operative part of award dated 18-10-2024 is as under:—

"42. Thus, it is amply clear from the above judgments that powers under Section 17(2) of the Act cannot be delegated to the Labour-cum-Conciliation Officer, Shimla to make a reference under Section 17(2) of the Act nor any such notification has been produced or brought to the notice of this Court that the Labour-cum-Conciliation Officer, Shimla was authorized to make a reference to this Court even under Section 17(2) of the Act. 43. In view of the discussion made hereinabove, and in view of the ratio of judgment of Hon'ble High Court of Bombay at Nagpur bench, followed by the Hon'ble High Court of Bombay at Aurangabad Bench (supra), that the Government cannot delegate its powers under Section 17(2) of the Act to any Labour Officer to file a reference in this regard before this Court. The reference, thus, which has been made to this Court is without any jurisdiction and the same is not maintainable. In view of above discussion issues no. 1 and 2 are decided against the petitioner whereas issue no. 3 is decided in favour of the respondents.

RELIEF

44. In view of my findings on issues no. 1 to 3, above, the claim filed by the petitioner fails and hereby dismissed. The reference is answered in the aforesaid terms. Let a copy of this award be communicated to the Appropriate Government as well as to the Labour Officer, Shimla zone for further action. The file after due completion be tagged with the main file." And;

Whereas, in another similar matter the Ld. Labour Court-cum-Industrial Tribunal, Kangra at Dharamshala vide award dated 04-08-2025 in reference No. 06/2020 titled as Sunil Kumar versus M/s Divya Himachal Prakashan Pvt. Ltd., which has been referred by the Labour Officer-cum- Conciliation Officer, Kangra at Dharamshala for legal adjudication, has held that the reference which has been made to the Ld. Labour Court by the authority is without jurisdiction as State Government does not have any power to delegate its authorities under Section 17 Clause 2 of the10313 राजपत्र, हिमाचल प्रदेश, 19 जनवरी, 2026/29 पौष, 1947 Governing Act and reference made to the Ld. Labour Court is defective and also held that the State Government shall be at liberty to remove defect in process of making the reference And;

Whereas, application dated 04-09-2025 filed before Secretary (Labour Employment & O.P.) to the Government of Himachal Pradesh and claim application dated 04-09-2019 filed before Labour Officer-cum-Conciliation Officer, Kangra at Dharamshala by Shri Jitender Kumar have been considered and examined alongwith latest awards passed by Ld. Labour Courts and orders by the Hon'ble High Court of H.P. by the undersigned while exercising the powers conferred under sub-section (2) of Section-17 of the Working Journalists and other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955, decided that claim application dated 04-09-2019 is required to be legally adjudicated by the Ld. Labour Court-cum-Industrial Tribunal, Kangra at Dharamshala. Therefore, the earlier reference to the Ld. Labour Court-cum- Industrial Tribunal, Kangra at Dharamshala for legal adjudication vide Notification No. LO/DSL/IV LL/WJA/19/2019-782-787, dated 11/23-11-2019 has been withdrawn.

Therefore, the Governor of Himachal Pradesh is pleased to refer this claim application dated 04-09-2019 to the Ld. Labour Court-cum-Industrial Tribunal, Kangra at Dharamshala, with the following term of reference for adjudication:—

"Whether Shri Jitender Kumar s/o Late Shri Roshan Lal, r/o V.P.O. Dhanotu, Tehsil Shahpur, District Kangra, H.P. is entitled for wages and other benefits as per claim application dated 04-09-2019 (copy enclosed) filed in terms of Section 17(2) of the Working Journalists and Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955 from The CMD Divya Himachal Prakashan Pvt. Ltd., Kangra Pathankot Marg, Old Matour, Tehsil and District Kangra (H.P.)?"

The Labour Officer-cum-Conciliation Officer, Shimla tried to settle the claim application amicably, but the same could not be settled and he made the reference to the Ld. Labour Court-cum-Industrial Tribunal Shimla for legal adjudication vide Notification No. LO/SML/ID/Majithia/30/2020-1026, dated 09-09-2021 and the same is registered as Reference No. 18 of 2022 before the Ld. Labour Court-cum-Industrial Tribunal and same is pending for adjudication And;

Whereas, in similar matter of Ravinder Sharma versus M/s Dainik Prakashan Ltd. referred by the Labour Officer-cum-Conciliation Officer, Shimla to Ld. Labour Court-cum-Industrial Tribunal Shimla for legal adjudication has already been rejected by the Ld. Labour Court vide award dated 18-10-2024 and the operative part of award dated 18-10-2024 is as under:—

"42. LEP-A003/7/2025-LEP.—Whereas, Shri Rajiv Goswami s/o Late Shri Desraj Goswami, r/o Nalsuha, Tehsil Dehra, District Kangra (H.P.) has filed an application dated 06-09-2025 before the Secretary (Labour Employment & O.P.) to the Government of Himachal Pradesh, in terms of Section-17(2) of the Working Journalists and Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955, in lieu of the reference notification No. LO/DSL/IV LL/WJA/24/2019-973, dated 06-01-2020 made by Labour Officer-cum-Conciliation Officer, Kangra at Dharamshala And;

Whereas, Shri Rajiv Goswami s/o Late Shri Desraj Goswami, r/o Village Suked, P.O. Nalsuha, Tehsil Dehra, District Kangra (H.P.) has earlier filed his claim dated 28-09-2019 (received on 01-10-2019) before the Labour Officer-cum-Conciliation Officer, Kangra at Dharamshala in terms of Section-17 of the Working Journalists and Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955 against (1) The M/S Jagran Prakashan Ltd., Registered Office at Jagran Building 2, Sarvodaya Nagar, Kanpur (U.P.) (2) The Chief General Manager, M/S Jagran Prakashan Ltd., Vill. Banoi, P.O. Rajol, Tehsil Shahpur, District Kangra (H.P.). (3) The General Manager, M/S Jagran Prakashan Ltd., Vill. Banoi, P.O. Rajol, Tehsil Shahpur, District Kangra (H.P.) for non-payment of arrear of wages, as difference of wages as per recommendation of Majithia Wage Board. The Labour Officer-cum-Conciliation Officer, Kangra at Dharamshala, District Kangra tried to settle the claim application amicably, but the same could not be settled and he made the reference to the Ld. Labour Court-cum-Industrial Tribunal, Kangra at Dharamshala for legal adjudication vide Notification No. LO/DSL/IV LL/WJA/24/2019-973, dated 06-01-2020 and the same is registered as Reference No. 07 of 2020 before the Ld. Labour Court-cum-Industrial Tribunal and same is pending for adjudication And;

Whereas, in similar matter the Ld. Labour Court-cum-Industrial Tribunal, Shimla vide award dated 18-10-2024 in reference No. 74/2017 titled as Ravinder Sharma versus M/s Dainik Prakashan Ltd., which has been referred by the Labour Officer-cum-Conciliation Officer, Shimla for legal adjudication has already been rejected the reference Notification, the operative part of award dated 18-10-2024 is as under:—

"42. Thus, it is amply clear from the above judgments that powers under Section 17(2) of the Act cannot be delegated to the Labour-cum-Conciliation Officer, Shimla to make a reference under Section 17(2) of the Act nor any such notification has been produced or brought to the notice of this Court that the Labour-cum-Conciliation Officer, Shimla was authorized to make a reference to this Court even under Section 17(2) of the Act. 43. In view of the discussion made hereinabove, and in view of the ratio of judgment of Hon'ble High Court of Bombay at Nagpur bench, followed by the Hon'ble High Court of Bombay at Aurangabad Bench (supra), that the Government cannot delegate its powers under Section 17(2) of the Act to any Labour Officer to file a reference in this regard before this Court. The reference, thus, which has been made to this Court is without any jurisdiction and the same is not maintainable. In view of above discussion issues no. 1 and 2 are decided against the petitioner whereas issue no. 3 is decided in favour of the respondents.

RELIEF

44. In view of my findings on issues no. 1 to 3, above, the claim filed by the petitioner fails and hereby dismissed. The reference is answered in the aforesaid terms. Let a copy of this award be communicated to the Appropriate Government as well as to the Labour Officer, Shimla zone for further action. The file after due completion be tagged with the main file." And;

Whereas, in another similar matter the Ld. Labour Court-cum-Industrial Tribunal, Kangra at Dharamshala vide award dated 04-08-2025 in reference No. 06/2020 titled as Sunil Kumar versus M/s Divya Himachal Prakashan Pvt. Ltd., which has been referred by the Labour Officer-cum- Conciliation Officer, Kangra at Dharamshala for legal adjudication, has held that the reference which has been made to the Ld. Labour Court by the authority is without jurisdiction as State Government does not have any power to delegate its authorities under Section 17 Clause 2 of the Governing Act and reference made to the Ld. Labour Court is defective and also held that the State Government shall be at liberty to remove defect in process of making the reference And;

Whereas, application dated 06-09-2025 filed before Secretary (Labour Employment & O.P.) to the Government of Himachal Pradesh and claim application dated 28-09-2019 filed before Labour Officer-cum-Conciliation Officer, Kangra at Dharamshala by Shri Rajiv Goswami have been considered and examined alongwith latest awards passed by Ld. Labour Courts and orders by the Hon'ble High Court of H.P. by the undersigned while exercising the powers conferred under sub-section (2) of Section-17 of the Working Journalists and other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955, decided that claim application 28-09-2019 is required to be legally adjudicated by the Ld. Labour Court-cum-Industrial Tribunal, Kangra at Dharamshala. Hence, the earlier reference to the Ld. Labour Court-cum-Industrial Tribunal, Kangra at Dharamshala for legal adjudication vide Notification No. LO/DSL/IV LL/WJA/24/2019-973, dated 06-01-2020 has been withdrawn.

Therefore, the Governor of Himachal Pradesh is pleased to refer this claim application dated 28.09.2019 to the Ld. Labour Court-cum-Industrial Tribunal, Kangra at Dharamshala, with the following term of reference for adjudication:—

The Labour Officer-cum- Conciliation Officer, Kangra at Dharamshala, District Kangra tried to settle the claim application amicably, but the same could not be settled and he made the reference to the Ld. Whereas, Shri Desh Raj Mohan has raised industrial dispute vide demand notice dated 05-05-2015 before the Labour Inspector, Kangra at Dharamshala. The Labour Inspector-cum- Conciliation Officer, Dharamshala has tried to settle the dispute but could not succeed and submit report to the Appropriate Government and the dispute has been referred to the Ld. Labour Court- cum-Industrial Tribunal, Kangra at Dharamshala vide reference notification dated 16-08-2016 for adjudication as per reference on following terms,"Whether the action of the Management of Jagran Prakashan Limited, Village Banoi, P.O. Rajol, Tehsil Shahpur, Near Kangra Airport, Pathankot- Mandi Highway, District Kangra, H.P. to pressurize Shri Deshraj Mohan s/o Shri Om Prakash, r/o Kamla Cottage, Ward No.6, Ram Nagar, P.O. & Tehsil Dharamshala, District Kangra, H.P. to resign from services w.e.f. 01-08-2014 is legal and justified? If not, what amount of back wages, due arrears of the recommendations of the Majithia Wage Board, seniority, past service benefits and compensation the above worker is entitled to from the above employer/management?" and before the Ld. Labour Court-cum-Industrial Tribunal, Kangra at Dharamshala the said reference was registered as Reference No. 603/2016 titled as Desh Raj Mohan vs. Employer/Management, Jagran Prakashan Ltd. And;

Whereas, it is also pertinent to mention here that during the pendency of Reference No. 603/2016 tilted as Desh Raj Mohan vs. Employer/Management, Jagran Prakashan Ltd. before the Ld. Labour Court-cum-Industrial Tribunal, Kangra at Dharamshala, the applicant Shri Desh Raj Mohan has approached to the Hon'ble High Court of Himachal Pradesh by filing CWP No. 8672 of 2025 with the prayer to ensure the expeditious summery enquiry by the designated Authority under Section 17 of the Working Journalists and Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955 on the application of petitioner in time bound manner, and the same has been withdrawn by the petitioner/applicant vide order dated 26-05-2025, granting him liberty to approach the Hon'ble Supreme Court for appropriate relief. Subsequently, the applicant has filed SLP(C) No. 019705/2025 titled as Desh Raj Mohan versus State of H.P. & Ors. before the Hon'ble Supreme Court of India and same is pending for hearing before the Hon'ble Apex Court.

Whereas, the Labour Officer-cum-Conciliation Officer, Kangra at Dharamshala tried to amicably settle the claim application dated 30-11-2023 filed by the applicant Shri Desh Raj Mohan filed under Section 17 of the Working Journalists and other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955, but the same could not be settled and he submit10325 राजपत्र, हिमाचल प्रदेश, 19 जनवरी, 2026/29 पौष, 1947 detailed report regarding enquiry of claim application. The report sent by the Labour Officer-cum- Conciliation Officer, Kangra at Dharamshala, claim application dated 30-11-2023 alongwith rejoinder dated 23-07-2024 filed by Shri Desh Raj Mohan and reply dated 26-06-2024 filed by the Employer/Management have been examined by the undersigned and it is found that Reference No. 603/2016 filed by the applicant was pending for adjudication before the Ld. Labour Court-cum- Industrial Tribunal, Kangra at Dharamshala on the similar issue and was listed for hearing on dated 24-09-2025 when the Ld. Labour Court was pleased to dispose of the same. The operative part of the award dated 24-09-2025 passed by the Ld. Labour Court is reproduced as below:-

ISSUE NO. 5

20. The petitioner had claimed to determine the amount in terms of Section 17 Clause 2 of Working Journalists and Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955. The reference was in respect of back wages, due arrears as per recommendations of MWB, seniority, past service benefits and compensation if in any case the resignation was proved to be illegal. The findings to the contrary are deduced from the evidence on record. This was not reference under Section 17 Clause 2 of the Working Journalists and Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955 hence this issue shall remained redundant.

RELIEF

21. In view of my findings on the issues no.1 to 6 above considering the evidence produced before this court by the petitioner cannot be granted any relief as the petitioner had voluntarily resigned from service and the claim of the petitioner is dismissed. It would be pertinent to mention here that this order shall not cover any right of the petitioner with regard to his wages, salary due pertaining to his period of service with the respondents prior to his resignation. Parties are left to bear their costs.

22. The reference is answered in aforesaid terms. A copy of this Award be sent to the appropriate Government for publication in the official gazette. File after due completion be consigned to the Record Room.

No.LEP-F005/2/2025.—In continuation to this Department Notification no. LEP- B002/2/2023, dated 1st January, 2024 the Governor Himachal Pradesh is pleased to provide the 30% subsidy for 18 seater buses under "Rajiv Gandhi Swarozgaar Start-Up Yojna stage III" in the following manner:—

1. Short Title, Commencement and Duration:

1.1 This Scheme shall be called the "Subsidy Scheme for Purchase and Operation of 18 Seater Buses for Stage Carriage Services in Himachal Pradesh".

1.2 It shall come into force from the date of it's publication in the Official Gazette.

1.3 The Scheme shall remain in force for one year, unless extended or modified by the State Government.

2. Background and Rationale:With a view to strengthening rural mobility, promoting livelihood opportunities for unemployed youth of Himachal Pradesh, and ensuring optimal utilization of unserved and underserved routes, the Government of Himachal Pradesh, in the Budget 2025–26, announced the issuance of new stage carriage permits along with financial assistance of up to 30% in the form of subsidy/VGF. This scheme operationalizes the announcement through a transparent and accountable implementation mechanism.

3. Definitions:

3.1 "Applicant" means a person applying for subsidy under this Scheme.

3.2 "Beneficiary" means an eligible applicant who has been allotted a route permit by the Transport Department and sanctioned subsidy under this Scheme.

3.3 "Bonafide Himachali" means a person certified as such by the competent authority of Himachal Pradesh.

3.4 "Local Resident" means a resident of the Revenue Sub-Division from where the allotted route originates or terminates.

3.6 "Department for allotment of route permit" means the Transport Department, Government of Himachal Pradesh.

3.7 "Department for releasing subsidy" means the Labour, Employment & Overseas Placement Department, Government of Himachal Pradesh.

3.8 "Government" means the Government of Himachal Pradesh.

3.9 "Permit" means a stage carriage permit issued under The Motor Vehicles Act, 1988.

3.10 "Bus" means an 18 seater bus for stage carriage operation.

3.11 "Financial Institution" means

(a) Public Sector Banks. (b) H.P. State Cooperative Bank. (c) or any other bank as notified by the State Government .

3.12 "Subsidy" means financial assistance approved by the State Government as per the percentage and conditions prescribed in this scheme under "Rajiv Gandhi Swarozgaar Start-Up Yojna".

3.13"Scheme" means this Subsidy Scheme.

4. Objectives of the Scheme:

The objectives of the Scheme are:—

(a) To enhance rural and regional connectivity;

(b) To generate self-employment for unemployed bonafide Himachali youth;

(c) To ensure efficient utilization of notified routes;

(d) To improve public transport accessibility .

5. Coverage and Route Identification

5.1 The Scheme shall cover routes notified by the Government of Himachal Pradesh.

5.2 Vehicles sanctioned under this Scheme shall operate only on the allotted routes.

6. Eligibility Criteria

An applicant shall be eligible if:—

(a) He/she is a bonafide Himachali;

(b) He/she is unemployed at the time of application;

Transport Undertakings;

(d) He/she has no outstanding dues with the Department of Transport;

(e) Notwithstanding anything contained elsewhere, the benefit under this Scheme shall be admissible to only one member of a family, and no other member of the same family shall be eligible to receive or claim benefits under the Scheme.

7. Application and Selection Process:

7.1 Applications shall be invited by the Transport Department for notified routes on the designated portal of the Transport Department.

7.2 The applicant can submit applications for Bus having a seating capacity of 18 seater.

7.3 Applications shall be scrutinized by the respective Regional Transport Officers of the Transport Authorities.

7.4 The allocation of routes will be as per the manner and priority mentioned in the Scheme.

7.5 Where applications exceed the number of routes, selection shall be made through draw of lots.

7.6 Final stage carriage permits shall be issued by the concerned RTOs.

7.7 The general conditions of H.P. Transport Policy will also be applicable.

8. Allotment of Routes:

8.1 The notified routes shall be allotted through the respective RTA's as per standard procedure and priority mentioned in the Scheme.

8.2 Priority shall be given to beneficiaries opting to ply higher seating capacity buses on allotted routes.

8.3 The beneficiary list so prepared by the Transport Department, H.P. shall be recommended to the Labour, Employment & Overseas Placement Department, H.P. for release of subsidy under "Rajiv Gandhi Swarojgaar Start-Up Yojna".

9. Permit and Operational Conditions:

9.1 Permit is route-specific and non-transferable, except in case of death of beneficiary, subject to RTA approval.

9.2 The beneficiary shall operate the vehicle regularly on the allotted route.

9.3 Violation of conditions shall entail cancellation of permit by the respective RTAs and recovery of subsidy by the Labour, Employment & Overseas Placement Department, H.P.

10.1 Subsidy/VGF shall be up to 30% of the on-road cost of 18 seater buses.

10.2 Subsidy shall be released only after issuance of route permit and purchase of vehicle.

11. Financial Implication for Subsidy:

11.1 Subsidy/VGF @30% will be admissible on cost of 18 seater bus.

11.2 390 Buses (Euro-VI).

12. Priority for Release of Subsidy:

12.1 First priority shall be given to Local Residents of the Sub-Division from where the route originates/terminates.

12.2 Second priority shall be given to District Residents where the route originates/terminates.

12.3 Third priority shall be open to all eligible applicants.

13. Release of Subsidy:

13.1 Subsidy shall be released by the Labour, Employment & Overseas Placement Department, and H.P. under "Rajiv Gandhi Swarozgaar Start- UpYojna" through the concerned bank.

14. Monitoring and Penalty:

14.1 The Transport Department and Labour, Employment & Overseas Placement Department, H.P. shall monitor implementation of the Scheme.

14.2 Non-operation or misuse shall result in cancellation of route permit and recovery of subsidy.

15. Transparency and Grievance Redressal:

15.1 Details of beneficiaries and routes shall be placed in public domain.

15.2 Grievances shall be redressed by the competent authority.

16. Power to Relax and Interpretation:

16.1 The Government may relax any provision of this Scheme in public interest.

16.2 Any question relating to interpretation of this Scheme shall be decided by the Government, and such decision shall be final.

17. Repeal and Savings.—Any earlier orders or guidelines inconsistent with this Scheme stand modified to the extent of inconsistency. Actions already taken, if any, shall be deemed valid under the corresponding provisions of this Scheme.

File No. PCH/19/2025-IT Cell-(E-254990) -I/764142/2026.—Whereas, the SAMARTH Panchayat Portal (https://samarthpanchayat.gov.in/), has been developed by the Ministry of Panchayati Raj, Government of India for enabling digitization of tax and non-tax revenues, online generation of demand, digital collection of payments, maintenance of Panchayat-owned assets, and realtime monitoring of revenue performance.

And whereas, by ensuring transparency, standardization, and efficiency in rural financial governance, the portal aims to strengthen the financial self-reliance of Gram Panchayats, in line with the vision of Atam Nirbhar Panchayats.

Now, therefore, the Government of Himachal Pradesh hereby notifies that with effect from 01-04-2026, the SAMARTH Panchayat Portal shall be mandatorily used by all Gram Panchayats in the State, for management of "Own Source Revenue". All activities relating to "Own Source Revenue", including the configuration of tax and non-tax revenues, registration of taxpayers, online generation of demand, management of Panchayat assets for revenue purposes, and collection of payments from citizens, shall be carried out exclusively through the SAMARTH Panchayat Portal and the offline processing of these activities shall be discontinued completely.

संख्याः इण्ड-बी-एफ(6)-14/2024-IV.— हिमाचल प्रदेश के राज्यपाल, खान और खनिज (विकास और विनियमन) अधिनियम, 1957 की धारा 23ग के साथ पठित धारा 15 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्या इण्ड-बी-(एफ) 6-14/2014, तारीख 13 मार्च, 2015 द्वारा अधिसूचित और राजपत्र (ई-गजट), हिमाचल प्रदेश में तारीख 21 मार्च, 2015 को प्रकाशित हिमाचल प्रदेश गौण खनिज (रियायत) और खनिज (अवैध खनन, उसके परिवहन और भण्डारण का निवारण) नियम, 2015 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌.--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश गौण खनिज (रियायत) और खनिज (अवैध खनन, उसके परिवहन और भण्डारण का निवारण) नौवां संशोधन नियम, 2026 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृा होंगे। 2. नियम 16 का संशोधन.--हिमाचल प्रदेश गौण खनिज (रियायत) और खनिज (अवैध खनन्‌, उसके परिवहन और भण्डारण का निवारण) नियम, 2015 (जिन्हें इसमें इसके पश्चात्‌ 'उक्त नियम' कहा गया है) के नियम 16 के उप-नियम (3) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌.--

''(3) खनन पट्टे के नवीकरण हेतु आवेदन उप-नियम (2) में विनिर्दिष्ट अवधि के भीतर, संबंंद्ध विभाग के सक्षम प्राधिकारी द्वारा जारी माल और सेवा कर (जीएसटी) से संबंधित अनापत्ति प्रमाण-पत्र तथा सभी आवश्यक दस्तावेजों सहित, समस्त प्रक्रियात्मक औपचारिकताओं को पूर्ण करने के पश्चात्‌ किया जाता है और प्राधिकारी द्वारा पट्टे की अवधि के अवसान से पूर्व उसका निपटान न किया गया हो, तो निदेशक, लिखित में कारणों को अभिलिखित करते हुए, ऐसे खनन्‌ पट्टे के नवीकरण तक आदेश द्वारा खान में काम-काज को अनुज्ञात कर सकेगा।''

3. नियम 79 का संशोधन.--उक्त नियमों के नियम 79 के उप-नियम (4) में दूसरे परन्तुक के स्थान पर निम्नलिखित रखा जाएगा, अर्थातः-

"परन्तु यह और कि हिमाचल प्रदेश लोक निर्माण विभाग, जल शक्ति विभाग तथा हिमाचल प्रदेश आवास एवं शहरी विकास प्राधिकरण से संबंधित ऐसी सरकारी अनुमोदित सनिर्माण संकर्म के मामलों में, जहाँ अनुमानित परियोजना खर्चे 50,00,000/-(पचास लाख) रुपए तक हों, तथा अन्य सरकारी विभागों से संबंधित ऐसी सरकारी अनुमोदित सनिर्माण संकर्म के मामलों में, जहाँ अनुमानित परियोजना10340 राजपत्र, हिमाचल प्रदेश, 19 जनवरी, 2026/29 पौष, 1947 खर्च 25,00,000-/(पच्चीस लाख) रुपए तक हो, वहां सम्बद्ध विभाग जनित खनिज के परिमाणीकरण के पश्चात्‌ द्वितीय अनुसूची में यथाविनिर्दिष्ट रॉयल्टी तथा तृतीय अनुसूची में यथाविनिर्दिष्ट प्रसंस्करण प्रभारों के साथ अन्य लागू करों/प्रभारों की कटौती करने के पश्चात्‌ जनित गौण खनिजों के स्व स्थल पर उपयोग की अनुज्ञा देगा।"।

No. Ind-II (F) 6-14/2014-IV.— In exercise of the powers conferred by Section 15 read with Section 23C of the Mines and Minerals (Development and Regulation) Act, 1957, the Governor, Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Minor Minerals (Concession) and Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2015 notified vide this department's notification No. Ind-II(F)6-14/2014, dated 13-03-2015 and published in the Rajpatra, (e-Gazette) Himachal Pradesh on 21-03-2015, namely.—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Minor Minerals (Concession) and Minerals (Prevention of Illegal Mining, Transportation and Storage) Ninth Amendment Rules, 2026.

(2) These rules shall come into force from the date of their publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of rule 16.—In sub-rule (3) of rule 16 of the Himachal Pradesh Minor Minerals (Concession) and Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2015 (hereinafter referred to as 'said rules'), the following shall be substituted, namely.—

"(3) If an application for the renewal of the mining lease is made within the time specified in sub-rule (2) alongwith no dues certificate w.r.t. GST issued by the authority of the concerned department and all requisite documents after completion of codal formalities and not disposed of by the Authority before the expiry of lease period, the Director by recording the reasons in writing may allow the working in the mine by an order till the renewal of such mining lease."

3. Amendment of rule 79.—In rule 79 of the 'said rules', in sub-rule (4) for the second proviso, the following shall be substituted, namely.—

"Provided further that in case of Government approved construction works pertaining to Department(s) of Himachal Pradesh Public Works Department (HPPWD), Jal Shakti10341 राजपत्र, हिमाचल प्रदेश, 19 जनवरी, 2026/29 पौष, 1947 Vibhag (JSV), Himachal Pradesh Housing and Urban Development Authority (HIMUDA) where estimated project costs is upto Rs. 50,00,000/- (Rs. Fifty Lakhs) and in case of Government approved construction works pertaining to other Government Departments where estimated project costs is upto Rs. 25,00,000/- (Rs. Twenty-five Lakhs), the concerned Department after quantifying the mineral shall permit the use of minor mineral generated in-situ after deducting the royalty as specified in SECOND SCHEDULE and processing charges as specified in THIRD SCHEDULE along with other applicable taxes/charges in advance."

अतः प्रार्थना-पत्र के आधार पर उक्त प्रतिवादीगण को इस इश्तहार के माध्यम से सूचित किया जाता है कि यदि उनका कोई लेनदेन वादी व वादी के पूर्वजों से लेना बकाया है तो वह इस न्यायालय में 20-01-2026 से पूर्व व उक्त तारीख को अपना पक्ष रख सकते हैं। हाजिर न आने की सूरत में एकतरफा कार्यवाही अमल में लाई जाकर वादी के पक्ष में फक-उल-रहन का राजस्व कागजात माल में अमल कर दिया जावेगा।
