संख्याः एग्र0-बी0-ए0(3)-2/2025.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश —षि, औद्यानिकी और वानिकी विश्वविद्यालय अधिनियम, 1986 की धारा 55क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, चौधरी 234-राजपत्र/2025-24-01-2026 (10691) 10692 राजपत्र, हिमाचल प्रदेश, 24 जनवरी, 2026/04 माघ, 1947 सरवन कुमार हिमाचल प्रदेश —षि विश्वविद्यालय, पालमपुर तथा डॉ. यशवंत सिंह परमार औद्यानिकी एवं वानिकी विश्वविद्यालय, सोलन में कुलपति की नियुक्ति हेतु निम्नलिखित नियम बनाते हैंं, अर्थात्‌ः- 1. संक्षिप्त नाम और प्रारम्भ.-(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश —षि, औद्यानिकी और वानिकी विश्वविद्यालय नियम, 2026 है।

(2) ये नियम राजपत्र (ई-गजट) हिमाचल प्रदेश में इनके प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे।

2. कुलपति की नियुक्ति.-कुलपति की नियुक्ति, राज्य सरकार की सहायता एवं परामर्श पर, कुलाधिपति द्वारा की जाएगी। राज्य सरकार एक खोज-एवं-चयन समिति का गठन करेगी, जो तीन व्यक्तियों का एक पैनल राज्य सरकार को अग्रेषित करेगी। राज्य सरकार उक्त पैनल में से एक अभ्यर्थी का चयन करेगी तथा कुलपति के पद पर नियुक्ति हेतु उसे कुलाधिपति को अग्रेषित करेगी।

3. खोजबीन-एवं-चयन समिति.-समिति में निम्नलिखित सदस्य होंगेः

(i) मुख्य सचिव, हिमाचल प्रदेश सरकार अध्यक्ष के रूप में;

(ii) भारतीय —षि अनुसंधान परिषद (आईसीएआर) के महानिदेशक अथवा उनके द्वारा नामनिर्देशिती कोई व्यक्ति, जो कुलपति से नीचे की पंक्ति का न हो या समकक्ष;

(iii) कुलाधिपति का एक नामनिर्देशिती सदस्य, जो प्रधान सचिव/कुलपति/प्राध्यापक से नीचे की पंक्ति का न हो तथा जिसे 15 वर्षों का अनुभव हो;

(iv) राज्य सरकार का एक नामित सदस्य, जिसे राज्य सरकार द्वारा नियुक्त किया जाएगा, जो प्रधान सचिव/कुलपति/प्राध्यापक से नीचे की पंक्ति का न हो तथा 15 वर्षों का अनुभव हो; तथा (v) —षि/औद्यानिकी/पशु चिकित्सा एवं पशु विज्ञान का एक विशेषज्ञ, जो प्राध्यापक से नीचे की पंक्ति का न हो तथा जिसे आचार्य के रूप में 15 वर्षों का अनुभव हो, जिसे सरकार द्वारा नामनिर्दिष्ट किया जाएगा।

4. समिति की प्रक्रिया.-(क) समिति संबंधित विश्वविद्यालय के कुलसचिव के माध्यम से आवेदन एवं नामांकन आमंत्रित करेगी तथा पात्रता शर्तों का विनिर्दिष्ट उल्लेख करेगी;

(ख) समिति तीन व्यक्तियों का एक पैनल राज्य सरकार को प्रस्तुत करेगी;

(ग) राज्य सरकार पैनल में से एक नाम का चयन करेगी और नियुक्ति हेतु कुलाधिपति को उसकी सिफारिश करेगी;

(घ) कुलाधिपति राज्य सरकार द्वारा संस्तुत व्यक्ति की नियुक्ति एक सप्ताह की अवधि के भीतर करेंगे। ऐसा न होने पर कृषि/औद्यानिकी विभाग के प्रशासनिक सचिव नियुक्ति की अधिसूचना जारी करेंगे।

(ङ) समिति अपनी विचार-विमर्श की कार्यवाही की गोपनीयता बनाए रखेगी।

(च) हिमाचल प्रदेश सरकार के —षि/औद्यानिकी विभाग के प्रशासनिक सचिव संबद्ध विश्वविद्यालय के लिए चयन प्रक्रिया में आचार्य के रूप में कार्य करेंगे।10693 राजपत्र, हिमाचल प्रदेश, 24 जनवरी, 2026/04 माघ, 1947 5. पात्रता मानदण्ड.-किसी व्यक्ति को कुलपति के पद पर नियुक्ति हेतु पात्र माना जाएगा, यदि वह निम्नलिखित शर्तों को पूरा करता/करती हो-

(क) वह विश्वविद्यालय या अनुसंधान संस्थान में आचार्य के रूप में अथवा उसके समकक्ष पद पर न्यूनतम 10 वर्ष का अनुभव रखने वाला/वाली एक प्रतिष्ठित शिक्षाविद्‌ हो;

(ख) उसके पास उच्च शैक्षणिक मानक, सत्यनिष्ठा तथा प्रशासनिक अनुभव हो, अधिमानतः —षि, औद्यानिकी, वानिकी अथवा संबद्ध विज्ञानों के क्षेत्र में, जिसमें —षि अनुसंधान सेवाओं में 20 वर्ष की सेवा सम्मिलित हो;

(ग) वह राज्य सरकार द्वारा समय-समय पर अधिसूचित अन्य अर्हताओं को भी पूर्ण करता/करती हो।

6. पदावधि.-(ंक) कुलपति की पदावधि तीन वर्ष की होगी।

(ख) वह एक बार पुनर्नियुक्ति के लिए पात्र होगा/होगी, जिसकी अवधि पुनः तीन वर्ष होगी, परंतु किसी भी स्थिति में उसकी आयु 65 वर्ष से अधिक नहीं होगी।

(ग) कुलपति के वेतन, भत्ते तथा सेवा की अन्य शर्तें ऐसी होंगी, जैसा कि विनिर्दिष्ट किया जाए, और उसकी नियुक्ति के पश्चात्‌ उन्हें उसके प्रतिकूल परिवर्तित नहीं किया जाएगा।

(घ) सेवानिवृत्ति की आयु/अधिकतम आयु-सीमा राज्य सरकार द्वारा विनिर्दिष्ट की जा सकती है। त्यागपत्र, पद से हटाए जाने, कार्यकाल की समाप्ति अथवा किसी अन्य कारण से रिक्ति उत्पन्न होने की स्थिति में, राज्य सरकार द्वारा आवश्यक कार्रवाई की जाएगी।

7. अंतरिम विन्यास.-त्यागपत्र, पद से हटाए जाने, कार्यकाल की समाप्ति अथवा किसी अन्य कारण से पद रिक्त होने के मामले में, राज्य सरकार की सहायता एवं परामर्श पर कुलाधिपति, वरिष्ठ संकाय सदस्यों में से किसी उपयुक्त व्यक्ति या प्रधान सचिव के पद से नीचे की पंक्ति का न हो या किसी प्रशासक, या विश्वविद्यालय के किसी अन्य उपयुक्त अधिकारी को, कार्यवाहक कुलपति के रूप में नियुक्त कर सकते हैं। ऐसी नियुक्ति की अवधि छह माह से अधिक नहीं होगी अथवा नियमित कुलपति की नियुक्ति होने तक, जो भी पूर्व हो।

8. कुलपति को हटाया जाना.-राज्य सरकार की सहायता एवं परामर्श पर चांसलर निम्नलिखित आधारों पर कुलपति को पद से हटा सकता/सकती है-

(क) अधिनियम या परिनियमों का जानबूझकर उल्लंघन;

(ख) पद का दुरुपयोग;

(ग) र्काव्यों के निर्वहन में अक्षमता :

परंतु यह कि कुलपति को पद से हटाए जाने से पूर्व उसे अपना पक्ष प्रस्तुत करने का युक्तिसंगत अवसर प्रदान किया जाएगा।

9. शक्तियां एवं र्काव्य.-कुलपति अधिनियम, परिनियमों तथा समय-समय पर राज्य सरकार द्वारा जारी निर्देशों के अनुसार यथाविहित शक्तियों का प्रयोग तथा र्काव्यों का पालन करेगा।

NOTIFICATION

Shimla-2, the 06th January, 2026

No. AGR-B-A(3)-2/2025.—In exercise of the powers conferred by the Section 55-A of the Himachal Pradesh Universities of Agriculture, Horticulture and Forestry Act, 1986, the Governor, Himachal Pradesh, is pleased to make the following rules for appointment of the Vice-Chancellor in the Chaudhary Sarwan Kumar Himachal Pradesh Krishi Vishvavidyalaya at Palampur and Dr. Yashwant Singh Parmar University of Horticulture and Forestry at Solan, namely:—

1. Short Title and Commencement.—1. These rules may be called the Himachal Pradesh Universities of Agriculture, Horticulture and Forestry Rules, 2026.

2. They shall come into force on the date of their publication in the Rajpatra (e-Gazette) of Himachal Pradesh.

2. Appointment of the Vice-Chancellor.—The Vice-Chancellor shall be appointed by the Chancellor on the aid and advice of the Government. The Government will constitute Search- cum-Selection committee, which shall forward a panel of three persons to the Government. The State Government will select a candidate from the panel and forward the same to the Chancellor for appointment to the post of Vice-Chancellor.

3. Search-cum-Selection Committee.—The Committee shall consist of the following members:—

(i) The Chief Secretary to the Government of Himachal Pradesh as Chairperson;

(ii) Director General, Indian Council of Agricultural Research or his nominee not below the rank of Vice Chancellor or equivalent;

(iii) One nominee of the Chancellor not below the rank of Pr. Secretary/Vice-chancellor/ professor having 15 years' experience;

(iv) The nominee of the State Government to be appointed by the State Government not below the rank of Pr. Secretary/Vice-Chancellor/Professor having 15 years' experience; and

(v) An expert of Agriculture/ Horticulture/ Veterinary and Animal Sciences not below the rank of Professor with 15 years' experience as professor nominated by the Government.

4. Procedure of the Committee:

(a) The Committee shall invite applications and nominations through Registrar of the concerned University, specifying eligibility conditions;

(c) The State Government shall select one name from the panel and recommend to the Chancellor for appointment;

(d) The Chancellor shall make appointment of the person recommended by the State Government within a period of one week, failing which the Administrative Secretary of Agriculture/Horticulture Department shall issue the notification of appointment;

(e) The Committee shall maintain confidentiality of deliberations; and

(f) The Administrative Secretary (Agriculture/Horticulture) to the Government shall act as Convener for concerned University for the selection process.

5. Eligibility Criteria:

A person shall be eligible for appointment as Vice-Chancellor if he or she—

(a) Is a distinguished academician with minimum 10 years of experience as Professor, or equivalent in University or Research Institutes;

(b) Has high academic standards, integrity, and administrative experience, preferably in agricultural, horticultural, forestry, or allied sciences; including 20 years' service in Agriculture research services; and

(c) Meets other qualifications notified by the State Government from time to time.

6. Term of Office:—

(a) The Vice-Chancellor shall hold office for a term of three years;

(b) He shall be eligible for one re-appointment for another three years but not beyond the age of 65;

(c) The emoluments and other conditions of service of the Vice-Chancellor shall be such as may be prescribed and shall not be varied to his disadvantage after his appointment.

(d) The age of superannuation/upper age limit may be specified by the State in case of vacancy due to resignation, removal, expiry of term, or any other reason.

7. Interim Arrangement.—In case of vacancy due to resignation, removal, expiry of term, or any other reason the Chancellor on aid and advice of the State Government may appoint from amongst the senior faculty members deemed fit or administrator not less the rank of Principal Secretary, or any suitable officer of the University, as an acting Vice-Chancellor for a period not exceeding six months, or until a regular Vice-Chancellor is appointed, whichever is earlier.

8. Removal of the Vice-Chancellor.—The Chancellor on the aid and advice of the State Government may remove the Vice-Chancellor on the following grounds:

(a) Willful violation of the Act or Statutes;

(c) Abuse of office.

Provided that the Vice-Chancellor shall be given a reasonable opportunity of being heard before removal.

9. Powers and Duties.—The Vice-Chancellor shall exercise such powers and perform such duties as prescribed in the Act, Statutes, and directions issued by the State Government from time to time.
