No. TCP-F05/6/2023.—Whereas, the Notice on draft Development Plan for Joginder Nagar Planning Area was issued by the Director, Town and Country Planning Department, 246-राजपत्र/2025-09-2-2026 (11203)11204 राजपत्र, हिमाचल प्रदेश, 09 फरवरी, 2026/20 माघ, 1947 Himachal Pradesh, Shimla under the powers conferred by sub-Section (1) of section 19 of the Town and Country Planning Act, 1977 (Act No. 12 of 1977) vide No. HIM/TP/PJT/DP- Jogindernagar/ 2023/Vol-I/1722-45, dated 06-06-2025 and the same was published in the Rajpatra (e-Gazette), Himachal Pradesh on 13-06-2025 for inviting objection(s) and suggestion(s) from the person(s) likely to be affected thereby within 30 days from the date of publication in Rajpatra (e- Gazette), Himachal Pradesh;

And whereas, objection(s) and suggestion(s) have been received within the stipulated period have been considered;

Now, therefore, in exercise of the powers vested under sub-section (1) of Section 20 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No.12 of 1977), the Governor, Himachal Pradesh is pleased to approve the Development Plan for Joginder Nagar Planning Area. It has been hosted at the official website of Department of Town and Country Planning, Himachal Pradesh hptcp.hp.gov.in with URL: https://hptcp.hp.gov.in/filestore/v1/files/ download file?fileStoreId=693a6747-a0b4-4ef5-a01 8-abea57d7c6bd. The same may be deemed to have been published in the Official Gazette of Himachal Pradesh with fore-referred URL linkage as required under sub-section (4) of section 20 of the Act ibid. A Notice is hereby given that a copy of the said Development Plan is available for inspection during office hours in the following offices:—

1. The Director, Town and Country Planning Department, Nagar Yojana Bhawan, Block No. 32-A, Vikas Nagar, Kasumpti, Shimla, Himachal Pradesh-171 009.

2. The Town and Country Planner, Divisional Town Planning Office, Mandi, District Mandi, Himachal Pradesh.

3. Executive Officer, Municipal Council, Joginder Nagar, Distt. Mandi, Himachal Pradesh.

The said Development Plan shall come into operation from the date of publication of this Notification in Rajpatra (e-Gazette), Himachal Pradesh.

संख्याः वाई0एस0एस-एफ (5)-3/2019.--भूमि अर्जन, पुनर्वासन और पुनस्र्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013 की धारा 19(1) के अंतर्गत।11205 राजपत्र, हिमाचल प्रदेश, 09 फरवरी, 2026/20 माघ, 1947 जबकि भूमि अर्जन, पुनर्वासन और पुनस्र्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013 (जिसे आगे "अधिनियम" कहा गया है) की धारा 11(1) के अंतर्गत एक प्रारंभिक अधिसूचना, ग्राम डोली घराना, मौजा कोहला, तहसील नादौन, जिला हमीरपुर, हिमाचल प्रदेश में स्थित कुल 7561.06 वर्ग मीटर निजी भूमि के अधिग्रहण हेतु, सार्वजनिक प्रयोजन अर्थात्‌ युवा सेवाएं एवं खेल विभाग, हिमाचल प्रदेश सरकार द्वारा खरीडी मैदान, नादौन में इंडोर मल्टीस्पोर्ट्‌स कॉम्प्लेक्स के निर्माण के लिए, जारी की गई थी, जिसका विवरण निम्नानुसार हैः-

और जबकि अधिसूचित सामाजिक प्रभाव आंकलन (SIA) इकाई द्वारा सामाजिक प्रभाव आंकलन अध्ययन किया गया तथा सामाजिक प्रभाव आंकलन प्रतिवेदन एवं सामाजिक प्रभाव प्रबंधन योजना की जांच अधिनियम की धारा 7 के अंतर्गत गठित बहु-विषयक विशेषज्ञ समूह द्वारा की गई, जिसने उपर्युक्त सार्वजनिक प्रयोजन हेतु उक्त भूमि के अधिग्रहण की संस्तुति की।

और जबकि अधिनियम की धारा 15(1) के अंतर्गत संबंधित व्यक्तियों से आपत्तियां एवं सुझाव आमंत्रित किए गए तथा ग्राम डोली घराना के प्रभावित भूमिधारकों से लिखित आपत्तियां प्राप्त हुईं।

और जबकि उपरोक्त आपत्तियों पर उप-मंडल अधिकारी (नागरिक), नादौन द्वारा दिनांक 08-01-2026 को व्यक्तिगत सुनवाई की गई तथा लिखित आपत्तियों एवं सुनवाई के दौरान दिए गए कथनों पर विचारोपरांत उन्होंने अपनी रिपोर्ट प्रस्तुत की, जिसमें उन्होंने निम्नलिखित निष्कर्ष निकाला:—

"विस्तृत सुनवाई एवं जांच के आधार पर यह निष्कर्ष निकाला जाता है कि भूमि अर्जन, पुनर्वासन और पुनस्र्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013 की प्रमुख प्रक्रियात्मक आवश्यकताओं का पर्याप्त रूप से अनुपालन किया गया है। सार्वजनिक प्रयोजन एवं परियोजना की आवश्यकता से संबंधित आपत्तियों की पुष्टि सक्षम सरकार द्वारा पहले ही की जा चुकी है। अतः उठाई गई आपत्तियां स्वीकार योग्य नहीं हैं और निरस्त किए जाने योग्य हैं। तदनुसार यह अनुशंसा की जाती है कि सरकार आगे आवश्यक कार्रवाई कर सकती है, क्योंकि धारा 19 के अंतर्गत अधिसूचना जारी करने की प्रक्रिया अब पूर्णतः स्वी—त है।"

और जबकि अधिनियम की धारा 15(2) के अंतर्गत प्रस्तुत अपनी रिपोर्ट के उपर्युक्त निष्कर्षात्मक अनुच्छेद में उप-मंडल अधिकारी (नागरिक), नादौन ने स्पष्ट रूप से यह संस्तुति की है कि आपत्तियां स्वीकार योग्य नहीं हैं तथा अधिनियम की धारा 19 के अंतर्गत घोषणा जारी करने की प्रक्रिया पूर्ण हो चुकी है और सरकार आगे आवश्यक कार्रवाई कर सकती है।

और जबकि मंडलीय आयुक्त द्वारा दिनांक 06-01-2026 के पत्र के माध्यम से समुचित विचारोपरांत बहुउद्देशीय खेल परिसर के निर्माण हेतु पुनर्वासन एवं पुनस्र्थापन योजना को निम्नानुसार अनुमोदन प्रदान किया गया हैः-11206 राजपत्र, हिमाचल प्रदेश, 09 फरवरी, 2026/20 माघ, 1947 (क) अधिनियम की धारा 11 के अंतर्गत जारी प्रारंभिक अधिसूचना, (ख) सामाजिक प्रभाव आंकलन पर विशेषज्ञ समूह की संस्तुतियां,

(ग) अधिनियम की धारा 15(2) के अंतर्गत उप-मंडल अधिकारी (नागरिक), नादौन की सुस्पष्ट रिपोर्ट एवं अंतिम संस्तुति, तथा

(घ) मंडलीय आयुक्त द्वारा पुनर्वासन एवं पुनस्र्थापन योजना को प्रदान की गई स्वी—ति, के आधार पर तथा भूमि अर्जन, पुनर्वासन और पुनस्र्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013 की धारा 19(1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषित किया जाता है कि अनुसूची में वर्णित भूमि उपर्युक्त सार्वजनिक प्रयोजन हेतु आवश्यक है और उसे अधिनियम के प्रावधानों के अंतर्गत अधिग्रहित किया जाएगा।

अतः यह अधिसूचना उपर्युक्त वैधानिक जांचों एवं संस्तुतियों के आधार पर जारी की जाती है और यह इस बात का अंतिम एवं निर्णायक प्रमाण होगी कि उक्त भूमि सार्वजनिक प्रयोजन के लिए आवश्यक है।

AUTHORITATIVE ENGLISH TEST

No. YSS-F(5)-3/2019.—Under Section 19(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

Whereas, a Preliminary Notification under Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (hereinafter referred to as "the Act") was issued for acquisition of total private land measuring 7561.06 square metres situated in Village Doli Gharana, Mauza Kohla, Tehsil Nadaun, District Hamirpur, Himachal Pradesh, for the public purpose of construction of Indoor Multisports Complex at Kharidi Ground, Nadaun by the Department of Youth Services & Sports, Government of Himachal Pradesh; whose detailed description is :—

And whereas, the Social Impact Assessment study was conducted by the notified SIA Unit and the Social Impact Assessment Report along with the Social Impact Management Plan was examined by the Multi-Disciplinary Expert Group constituted under Section 7 of the Act, which recommended the acquisition of the said land for the aforesaid public purpose.

And whereas, in pursuance of Section 15(1) of the Act, objections and suggestions were invited from the interested persons and written objections were received from the affected landowners of Village Doli Gharana;

And whereas, the personal hearing of the objections was conducted by the Sub-Divisional Officer(Civil), Nadaun on 08-01-2026 and after considering the written objections and the statements made during the hearing, he has submitted his report, wherein he has concluded as under: —

"Based on the detailed hearing and inquiry, it is concluded that the key procedural requirements of the RFCTLARR Act, 2013 have been substantially complied with. The objections related to public purpose and project necessity have already been affirmed by the Appropriate Government. Therefore, the objections raised are not tenable and are liable to be rejected. It is accordingly recommended that the Government may proceed for future necessary action, as the process for the issuance of the Notification under Section 19 is now cleared."

And whereas, in the above concluding paragraph of his report under Section 15(2) of the Act, the Sub-Divisional Officer (Civil), Nadaun has specifically recommended that the objections are not tenable and that the process for issuance of declaration under Section 19 of the Act stands cleared and the Government may proceed for further necessary action accordingly;

And whereas, the Divisional Commissioner, vide letter dated 06-01-2026 – after due consideration has granted approval for Rehabilitation and Resettlement scheme for construction of multipurpose sports complex.

Now, therefore, on the basis of :—

(a) the Preliminary Notification issued under Section 11 of the Act,

(b) the recommendations of the Expert Group on the Social Impact Assessment, (c) the speaking report and final recommendation of the Sub-Divisional Officer (Civil), Nadaun under Section 15(2) of the Act, and

(d) the approval of Rehabilitation and Resettlement scheme by the Divisional Commissioner,11208 राजपत्र, हिमाचल प्रदेश, 09 फरवरी, 2026/20 माघ, 1947 and in exercise of the powers conferred by Section 19(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, it is hereby declared that the land specified in the Schedule appended hereto is required for the aforesaid public purpose and that the same shall be acquired under the provisions of the Act. Now, therefore, this notification is issued on the basis of the statutory inquiries and recommendations referred to above and shall be conclusive evidence that the land is needed for a public purpose.

Notices have been served to all concerned and General Public to this effect that if anybody has got any objection regarding the registration of marriage duly solemnized between the above parties i.e. Mr. Amit Anand and Mrs. Babita Anand they may file their written objections and appear personally or through their authorized agents before me within a period of thirty days from the date of issuance of this notice. After expiry of the said period, the marriage certificate would be issued to the applicants by this court post which no objection will be heard or accepted.

इस उद्धघोषणा के माध्यम से सर्वसाधारण को सूचित किया जाता है कि प्रार्थिया श्रीमती फुला देई पुत्री श्री नथू राम, निवासी ग्राम धर्मपुर-बठोल, तहसील कसौली, जिला सोलन, हि0प्र0 द्वारा राजस्व अभिलेख में मकबूल-उल-खबरी का इन्तकाल दर्ज एवं तस्दीक किए जाने के सम्बन्ध में एक प्रार्थना-पत्र इस न्यायालय/कार्यालय में प्रस्तुत किया है। जिसमें उस द्वारा यह अंकित किया कि उसका भाई श्री ख्याली राम पुत्र श्री नथू राम, निवासी ग्राम धर्मपुर-बठोल, तहसील कसौली, जिला सोलन लगभग 50 वर्ष पूर्व अचानक अपने घर से कहीं चला गया। घर छोड़ने के उपरान्त उसका आज तक कोई भी पता-ठिकाना नहीं चल पाया है तथा न ही वह कभी वापिस आया है। परिजनों एवं सम्बन्धियों द्वारा उसकी काफी खोजबीन की गई किन्तु उसका कोई सुराग प्राप्त नहीं हो सका।

अतः उद्धघोषणा के माध्यम से सर्वसाधारण को सूचित किया जाता है कि यदि किसी भी व्यक्ति को उपरोक्त वर्णित मकबूल-उल-खबरी के इन्तकाल को राजस्व अभिलेख में दर्ज एवं तस्दीक किए जाने के सम्बन्ध में कोई भी उजर व एतराज हो तो वह दिनांक 10-02-2026 को प्रातः 11.00 बजे सुनवाई के समय अधोहस्ताक्षरी की अदालत में स्वयं उपस्थित होकर अथवा उरोक्त वर्णित तिथि तक अपना उजर/एतराज लिखित रूप में प्रस्तुत कर सकता है।
