No: 234.—In exercise of the powers conferred under Section 113 read with section 202 of the Himachal Pradesh Municipal Act, 1994, I, Hitesh Kumar, Executive Officer, Municipal Council 247-राजपत्र/2025-10-02-2026 (11231)11232 राजपत्र, हिमाचल प्रदेश, 10 फरवरी, 2026/21 माघ, 1947 Nerchowk, Himachal Pradesh hereby notifies the following Bye-laws: "The Nerchowk Municipal Council (Registration and Control of Pet Dogs) Bye-laws, 2025."

1. Short title and Commencement.—(i) These Bye-laws may be called "The Nerchowk Municipal Council (Registration and Control of Pet Dogs) Bye-laws, 2025." (ii) These shall come into force from the date of their publication in the official gazette of Himachal Pradesh.

2. Definitions.—ln the se bye-laws, unless the context otherwise requires:—

(i) "Act" means the Himachal Pradesh Municipal Council A C T , 1994, (Act No. 12 of 1994).

(ii) "Section" means the section of the Act.

(iii) "Family" means the owner, his/her parents, spouse, sons, daughters, brothers and sisters living in one premises.

(iv) "Owner" means the person who owns a registered/unregistered dog an dincludes a person in whose custody, charge or possession a dog is found.

(v) "Pet Dog" means a male or female dog kept by a person within the area of Municipal Council Nerchowk and other than stray dogs.

(vi) "Registration Authority" means any officer so appointed by the Executive Officer, Municipal Council, Nerchowk.

(vii) The words and expressions not defined in these bye-laws shall have the same meaning as assigned to them in the HP Municipal Council Act, 1994.

3. Procedure for Registration of Dogs:—

On and from the date of publication of these bye-laws, registration of Pet Dog(s) (hereinafter mentioned as dog) above the age of three months, kept within the jurisdiction of Municipal Council, Nerchowk shall be compulsory. The owner of Dog, on or before the first day of April of every year or within seven days of its arrival, register such dog in a Form as prescribed by the Council, Municipal Council, Nerchowk (Annexure–A) accompanied by a fee of Rs. 500 per dog as one time registration fees along with two recent photographs of the dog and a copy of vaccination certificate from a Government Veterinary Practitioner or Veterinary Practitioner duly registered with Indian Veterinary Council (IVC) or State Veterinary Council (SVC). Further, an amount of Rs. 500 per dog shall be charged as license fees annually. However, a blind person keeping dog and using solely for his/her guidance shall be exempted from the payment of registration fee. On registration, the Registration Authority shall issue a metal token to be attached with the collar to be worn by the dog and in case of loss or destruction of the token; a duplicate token shall be issued to the owner on submission of an application along with a fee of Rs. 500 per token. The registration once made shall remain valid for full life span of the dog. In case of death of the dog, the owner of the dog shall immediately inform the Registration Authority. A family may keep maximum of two dogs.

5. Any un-registered pet shall be deemed as stray and treated accordingly.

6. Duties and responsibilities of the owners.—

(i) The owner of the pet dog shall be responsible for the controlled breeding, immunization, neutering and licensing in accordance with the provisions of these Bye-Laws.

(ii) Any dog not wearing metal ticket or registration in accordance with clause 3 of these Bye-laws may, if found in any public place be removed and will be liable to be dealt under the orders of the Veterinary Public Health Officer, Municipal Council, Nerchowk, if not claimed within 7 days by the owner.

(iii) For the purpose of these bye-laws any person in possession or in charge of the dog, during the absence of the real owner within the limits of M. C. Nerchowk, shall be deemed to be the owner of the dog.

(iv) It shall be mandatory for each owner to carry disposable bags during the time when the dog is put on Municipal streets.

(v) The owner of the dog shall not allow the dog to defecate in public places such as residential areas, green belts, parks, streets, roads, road beams and other common places etc. In case the dog defecates at the above specified places, the owner shall arrange to get the excreta of the dog removed from the said place at his own level. No owner shall allow the dog to defecate near the residences of other persons, his/her neighbors to his/her/their annoyance.

7. The owner of the registered dog shall keep the dog under his/her control at all times so that it does not intimidate, annoy, hurt or bite any person. The Municipal Council shall not be held responsible for any loss, damage or injury caused by a registered dog to any person or to his/her property and sole liability to compensate the victim will remain with the owner of the registered dog.

8. Guideline for Breeders.—

(i) A breeder must be registered with Municipal Council, Nerchowk. Breeder must maintain full record of the number of pups born/died from individual bitches. He shall also maintain proper record of pedigree and vaccination.

(ii) Breeder must maintain record of the person buying the pups. He should ensure that the buyer has required knowledge for the upkeep of pups

Breeder must pay Rs. 5000/-as one time registration charges in the treasury of the Municipal Council besides Rs. 1500/- per dog as annual fees every year. This fee to be paid by the breeding shall be over and above the registration fee / annual license fee provided in 3 above.

9. Guideline for Dog Care Centre.—

(i) A dog care center must be registered with Municipal Council, Nerchowk. Owner of dog care center must maintain full record of the number of dogs. He shall also maintain proper record of pedigree and vaccination.

(iii) Owner of dog care center must pay Rs. 5000/- as one time registration charges in the treasury of the Municipal Council besides Rs. 5000/- license fee every year.

(iv) Owner of dog care center must obtain no objection certificate from the concerned ward councilor.

(v) Permission to operate dog care center shall be subject to approval of Municipal Council Nerchowk.

10. The owner of the registered dog shall ensure proper space, accommodation, food and medical treatment to the dog.

11. The Registration Authority or an officer/official authorized by him shall keep the details of all the seized dogs duly entered in a register with a brief description of the dog, date of seizure, reasons of seizure and the manner in which it is disposed of.

12. The dog after its death shall not be thrown in the open or in the garbage bins of Municipal Council. Dead dog shall be buried at notified/earmarked places up to a depth of at least 3 ft. in a hygienic manner. The Municipal Council, Nerchowk may provide a van for the disposal/burial of dead dogs in the earmarked dog burial ground son the request so received by it. The owner shall pay charges for availing the services of the van at the rates prescribed by the Executive Officer, Municipal Council and so revised from time to time.

13. The Registration Authority or a Veterinarian, Health Supervisor, Chief Sanitary Inspector, Sanitary Inspector or any other officer of the Municipal Council, Nerchowk authorized by the Registration Authority, may inspect the premises of the owner of any dog and such owner shall allow that person to enter and inspect his/her premises at all reasonable times. Such officer/official shall also be authorized to search the places where dogs are kept without registration and to seize them.

14. Penalty.—

(i) Any contravention of these Bye-Laws including the failure to register the dog, failure to follow guidelines for breeders, guidelines for dog care center as per clause 3, 7, 8 above, shall be punishable with fine which may extend to Rs. 5,000/- and in case of continuous breach additional fine which may extend to Rs. 200/- per month till such contravention or breach continues shall be imposed.

15. Repeal and saving.—

(i) The bye-laws published vide H.P. Govt. Notification No. LSG-B (3)15/82, dated 19-9-1984 are hereby repealed. Notwith standing such repeal anything done or any action taken in exercise of the powers conferred by or under the bye-laws so repealed shall be deemed to have been done or taken in exercise of the powers conferred by or under these bye-laws which were enforced on the day on which such thing was done or was taken.

ANNEXURE-B Undertaking from the owner of the Dog for registration

1. I do not have more than two dogs.

2. I shall keep the dog protected by getting it vaccinated against rabies from a Govt. Veterinary Practitioner or Veterinary Practitioner duly registered with Indian Veterinary Council (IVC) or State Veterinary Council (SVC).

3. I will furnish the vaccination certificate on demand during Inspection by Registration Authority or any officer/official of the Municipal Council duly authorized by the Registration Authority or within a period of 10 days from such Inspection, failing which registration of the dog may be cancelled.

4. I will keep the dog chained/leashed while taking it outside. All ferocious dogs shall be duly muzzled and a stick shall be carried by the Escort accompanying the dog while taking it out.

5. I will ensure that the dog will wear a collar affixed with the metal token issued by the Registration Authority at all the times.

6. I will compensate the person if a dog bites or causes/harm to any person or to the property of any person.

7. I shall keep the dog under my control all the times, so that it does not intimidate, annoy, hurt or bite any person. I shall not make Municipal Council responsible for any loss, damage or Injury caused by a registered dog to any person or to his/her property and sole liability to compensate the victim will remain with me.

8. I shall not indulge in breeding of dogs for commercial purposes and trading of dogs within the area of Municipal Council. In case it is found that dog is being kept for breeding or trading/commercial purposes by me, the Registration Authority shall impound my dogs besides imposing a fine as fixed by the Executive Officer, Municipal Council, Nerchowk upon me.

9. I shall not allow the dog to defecate in public places such as residential areas, green belts, parks, streets, roads, road berms and other common places etc. In case the dog defecates at the above specified places, I shall arrange to get the excreta of the dog removed from the said place at my own level. I shall not allow the dog to defecate near the residences of other persons, neighbors to their annoyance.

10. I shall ensure proper space, accommodation, food and medical treatment to the dog.

11. of

SRINIVASA RAMANUJAN STUDENTS DIGITAL YOJANA

History and Evolution of the Scheme: The "Srinivasa Ramanujan Students Digital Yojana" has evolved over more than a decade as one of11239 राजपत्र, हिमाचल प्रदेश, 10 फरवरी, 2026/21 माघ, 1947 the most significant merit-based educational support initiatives of the Government of Himachal Pradesh. Launched in 2011-12 under the name "Rajiv Gandhi Student Digital Yojana", the Scheme was introduced with the objective of supporting meritorious Class 10th students through the provision of digital devices. In 2012-13, it was expanded to include Class 12th meritorious students. In 2019, the Scheme was renamed "Srinivasa Ramanujan Students Digital Yojana" and further expanded to include 900 meritorious final-year undergraduate students of Government Colleges in the State, affiliated to Himachal Pradesh University (HPU).

2. Short Title, Extent and Commencement. — (1) This Scheme shall be known as the "Srinivasa Ramanujan Students Digital Yojana".

(2) It shall extend to the whole of the State of Himachal Pradesh and shall come into force from the date of its notification in the Official Gazette (e-Gazette).

4. Objective.—The primary objective of the Scheme is to promote academic excellence through digital empowerment among meritorious students by providing them with personal digital devices essential for modern learning. It aims to strengthen technology-enabled education, reduce the digital divide, and enhance access to online learning resources and competitive examination platforms.

5. Definitions.—For the purpose of these Scheme Guidelines, unless the context otherwise requires, the following expressions shall have the meanings respectively assigned to them below:—

5.1 "Scheme" means the Srinivasa Ramanujan Students Digital Yojana notified by the Government of Himachal Pradesh from time to time.

5.2 "Government" means the Government of Himachal Pradesh

5.3 "Department" means the Department of Education, Government of Himachal Pradesh.

5.4 "Directorate" means the Directorate of School Education, Himachal Pradesh 5.5 "Director" means the Director of School Education, Himachal Pradesh 5.6 "Executing Agency" means the Government agency, public sector undertaking, corporation, or other entity authorized by the Directorate with the prior approval of the Government to undertake operational implementation of the Scheme through the online portal.

5.7 "Eligible Student" means a meritorious bonafide student of the State of Himachal Pradesh, enrolled in a Government educational institution, who fulfills the eligibility conditions prescribed under the Scheme.

5.8 "Meritorious Student" means a student whose name appears in the official merit list issued by the Himachal Pradesh Board of School Education (HPBOSE), Central Board of Secondary Education (CBSE), Himachal Pradesh University (HPU) and Sardar Patel University (SPU), as applicable, and who has secured such merit in the first attempt in the qualifying examination.

5.9 "Bonafide Student of the State" means a student who is a permanent resident of Himachal Pradesh or otherwise fulfills the residency conditions as may be prescribed by the Government from time to time.

5.10 "Government Educational Institution" means a school or college wholly owned, managed, and funded by the Government of Himachal Pradesh and recognized by the competent authority.

5.11 "Beneficiary" means an eligible student whose name appears in the final approved list of beneficiaries published by the Directorate under the Scheme.

5.12 "Digital Device" means a laptop, tablet, notebook, smart phone or any other digital learning device or gadget approved by the Government for distribution under the Scheme.

5.13 "e-RUPI Card / Digital Voucher" means a purpose-specific, beneficiary- specific digital payment instrument generated electronically through the banking system, to be redeemed only for the procurement of approved digital devices under the Scheme.

5.14 "Online Portal" means the dedicated digital platform developed or designated by the Directorate or Executing Agency for online application, verification, voucher generation, redemption, monitoring, and grievance redressal under the Scheme.

5.15 "Empanelled Vendor" means a vendor selected and empanelled by the Executing Agency through a transparent and competitive process, in accordance with Government procurement rules, for the supply of approved digital devices under the Scheme.

5.16 "Partner Bank" means the bank or financial institution authorized to generate and manage e-RUPI cards or digital vouchers under the Scheme.

5.17 "Authentication" means the process of verifying the identity of a beneficiary through mobile-based OTP or Aadhaar-based authentication or through Deputy Directors concerned, as may be prescribed by the Government from time to time.

5.18 "Verification" means the process of scrutiny and confirmation of eligibility, merit, category, and other particulars of a student by the concerned authority under the Scheme.

5.19 "Grievance" means any complaint or representation submitted by a beneficiary or applicant relating to application processing, verification, voucher generation, redemption, delivery of digital devices, or quality of devices.

5.20 "Financial Year" means the period commencing from 1st April and ending on 31st March of the following year.

5.21 "Academic Session" means the academic year notified by the concerned Board or University for Class 10, Class 12, or undergraduate courses, as applicable.

5.22 "Dashboard" means the digital monitoring interface maintained by the Directorate for real-time tracking of applications, approvals, voucher generation, redemption, delivery, and grievance redressal under the Scheme.

5.23 "Prescribed" means guidelines and SOPs issued by the Directorate or the Government through issued from time to time under the provisions of these guidelines/ scheme.

6. Coverage and Beneficiaries.—(1) The Scheme shall cover meritorious students of 10th and 12th Classes of HPBOSE and CBSE enrolled in Government schools and meritorious final year undergraduate students of Government Degree Colleges affiliated to HPU and SPU.

(2) For each financial year, the Government may determine and approve the total number of beneficiaries to be covered under the Scheme and communicate to the Directorate for its implementation. Notwithstanding such approval, the Government may also revise, re-determine, or modify, from time to time, the overall coverage, category-wise allocation, and number of beneficiaries, if required.

7. Nature of Assistance and Eligibility Criteria.—(1) Eligible meritorious students shall be provided with personal digital learning devices, such as laptops, tablets, notebooks, smart phones or other digital devices or gadgets, as may be approved by the Government on the recommendations of a Committee headed by the Director of School Education. The type of device and its technical specifications shall be determined annually, keeping in view the educational requirements, prevailing technical standards, and financial feasibility. The rate and monetary ceiling of assistance for such devices shall be decided by the Directorate with the prior approval of the Government, from time to time or annually, as the case may be.

(2) In order to avail the benefit under the Scheme, a student must be enrolled in a Government educational institution. Selection of beneficiaries shall be made strictly on the basis of merit, as determined from the official merit lists issued by the HPBOSE, CBSE, HPU and SPU, as applicable. Further, number of the beneficiaries shall be finalized on the basis of total number of students appeared in board and final years graduation classes in the respective Boards and Universities and benefits shall be provided proportionately.

(3) Separate merit lists shall be prepared for beneficiaries belonging to the Scheduled Caste and Scheduled Tribe categories in proportion to their population in the State, and applicable reservation norms shall be followed accordingly.

(4) A student shall not be eligible for assistance under the Scheme if he or she has already availed similar benefits under any Government scheme during the same academic session or has previously availed benefits under this Scheme, as per the provisions applicable from time to time. The provisions of this para shall be implemented from next Academic Session i.e 2026-27 or as may be decided by the Government, from time to time.

(5) A student who has availed benefit under the Scheme during the preceding three years shall not be eligible to receive assistance under the Scheme again.

8. Processing of authenticated / verified data at Directorate Level.—(1) On receiving the authenticated/verified data/information of beneficiary students and requisite documents, if any, from respective Deputy Director of School Education (Secondary) and Directorate of Higher Education, shall publish district wise final list of beneficiary students and host all such list on the departmental website, for wide publicity and to ensure transparently in selection process.

(2) After publication of list, if no objections and grievance are received within seven (7) days of its publication though official website or any other means, a consolidated final list of meritorious beneficiary students, shall be supplied to the Executing Agency.

(3) The Executing Agency, as approved by the Directorate with the prior approval of the Government from time to time, shall undertake all further processes through the online portal so as to ensure transparency, efficiency, accountability, and real-time monitoring of the implementation of the Scheme.

9. Online System and Mode of Implementation.—(1) After completion of the process of selection of beneficiaries and approval of the final merit list by the competent authority, the verified beneficiary data shall be hosted on the Scheme's online portal. The approved data shall thereafter be transmitted electronically to the Executing Agency, approved by the Directorate with the prior approval of the Government from time to time, for undertaking further processes under the Scheme.

(2) On receipt of the approved beneficiary data, the Executing Agency, in coordination with the designated partner bank and payment service provider, shall initiate the process for generation of e-RUPI cards or digital vouchers in respect of each eligible beneficiary. The e-RUPI card or digital voucher shall be generated strictly as per the sanctioned entitlement under the Scheme and shall be beneficiary-specific as well as purpose-specific.

(3) The e-RUPI card or digital voucher shall be securely mapped to the registered mobile number of the beneficiary as available on the Scheme portal. Upon successful generation, the beneficiary shall be informed through automated SMS and/or email regarding issuance of the e- RUPI card or digital voucher, alongwith details of its validity period and instructions for redemption.

(4) For the purpose of redemption, the beneficiary shall access the designated online redemption platform using the registered credentials. Authentication of the beneficiary shall ordinarily be carried out through One Time Password sent to the registered mobile number.

(5) The Government may, at any stage, further refine, upgrade, or modify the authentication mechanism and may introduce Aadhar-based authentication, either in lieu of or in addition to mobile-based OTP authentication, in accordance with applicable law and guidelines issued by the Government of India and the State Government from time to time.

(6) Upon successful authentication, the beneficiary shall be able to view the sanctioned voucher value and the list of approved digital devices available under the Scheme. The online portal shall display only such vendors as have been empanelled by the Executing Agency through a transparent and approved procurement process, alongwith approved makes, models, technical specifications, and prices of devices.

(7) The beneficiary shall select a digital device strictly within the sanctioned voucher value and from among the options made available on the portal and shall confirm the selected device details and delivery particulars.

(8) Upon confirmation, the e-RUPI card or digital voucher shall be redeemed electronically. The redemption shall be cashless, non-transferable, and non-encashable, and the voucher amount shall be settled directly with the selected vendor through the banking system. Once redeemed, the e-RUPI card or digital voucher shall stand exhausted.

(9) The Executing Agency shall maintain a complete electronic trail of beneficiary approval, voucher generation, authentication, redemption, and vendor settlement for the purposes of monitoring, audit, and verification.

10. Implementing Agency and Execution Framework.—(1) The Scheme shall be implemented by the Department of School Education, Government of Himachal Pradesh, through the Directorate of School Education, which shall exercise overall administrative control, supervision and monitoring of the Scheme.

(2) The Directorate, with the prior approval of the Government, shall designate or engage an Executing Agency from time to time for operational implementation of the Scheme. The Executing Agency shall function under the directions and supervision of the Directorate.

(3) The Executing Agency shall be responsible for management of the online portal, coordination with partner banks and payment service providers, empanelment of vendors, generation and redemption of e-RUPI cards or digital vouchers, monitoring of transactions, and facilitation of delivery of digital devices.

(4) Vendors for supply of digital devices shall be empanelled through a transparent and competitive process in accordance with Government procurement rules and guidelines, prescribing technical standards, warranty obligations, and service-level requirements.

(5) The Directorate, with the prior approval of the Government, may issue detailed guidelines, standard operating procedures, and instructions for verification and authentication of beneficiaries, vendor empanelment, delivery mechanisms, and monitoring arrangements.

(6) The Executing Agency shall maintain proper records and digital logs of all activities under the Scheme and shall submit periodic reports to the Directorate in such form and manner as may be prescribed.

11. Delivery of Digital Devices.— (1) Upon successful redemption of the e-RUPI card or digital voucher, the selected vendor shall receive an automated order through the online portal and shall ensure dispatch and delivery of the digital device within the timelines prescribed by the Directorate.

(2) The status of dispatch and delivery shall be updated on the online portal on a real-time basis and shall be accessible to the beneficiary, the Executing Agency, and the Directorate.

(3) Delivery of the digital device shall ordinarily be made at the address furnished by the beneficiary. Where home delivery is not feasible due to geographical or logistical reasons, the device may be made available for collection from a designated distribution centre as notified.

(4) Delivery shall be treated as complete only upon system-generated confirmation of delivery and, wherever required, beneficiary acknowledgement. Liability for loss or damage prior to confirmed delivery shall rest with the vendor or Executing Agency, as applicable.

(5) All digital devices supplied under the Scheme shall be covered by warranty and after- sales service as prescribed. Defective devices shall be replaced or repaired within the prescribed timeframe without cost to the beneficiary.

(6) Grievances relating to delay, non-delivery, damage, or defects shall be addressed through the online grievance redressal mechanism and monitored until resolution.

12. Monitoring and Evaluation.—(1) The Directorate shall operate a district-wise digital dashboard capturing key performance indicators, including number of applications received, beneficiaries approved, vouchers generated, vouchers redeemed, devices delivered, delivery timelines, and grievance resolution status.

(2) The Executing Agency shall submit periodic reports to the Directorate, and the Directorate may conduct inspections, audits, or reviews of records and processes at any stage.

14. Maintenance of Accounts and Records.—(1) The overall responsibility for the proper maintenance, custody, and management of all accounts and records relating to this Scheme shall rest with office of Directorate of School Education and concerned Deputy Director of School Education (Secondary).

(2) The Directorate of School Education and Deputy Director of School Education (Secondary) concerned shall maintain complete and up-to-date records relating to the implementation of the Scheme, including, inter alia, receipt and scrutiny and verification of information data/ documents, disbursement of benefits, maintenance of individual beneficiary-wise accounts, and documentation of physical and financial progress including UCs.

(3) Data Protection and Record Maintenance.—All personal and academic data of beneficiaries collected under the Scheme shall be stored, processed, and protected in accordance with applicable data protection laws and Government policies. Access to the system shall be role- based, and all actions shall be digitally logged for audit purposes.

15. Audit.— All expenditure incurred under the Scheme shall be subject to audit by the Office of the Accountant General (Audit), Himachal Pradesh, or any other authority authorized in this regard, in accordance with the applicable rules and procedures.

16. Grievance Redressal.—(1) An online grievance redressal mechanism shall be provided on the Scheme portal for addressing complaints relating to application processing, voucher generation, redemption, delivery, or device quality.

(2) All grievances shall be acknowledged within a prescribed timeframe and resolved within the period notified by the Directorate. Unresolved grievances shall be escalated automatically to higher authorities through the portal.

17. Power to issue Guidelines/ Clarifications.—For the purpose of ensuring smooth operation, effective implementation, progress reporting, maintenance and digitization of records and for addressing matters incidental or ancillary thereto, the Director shall be the competent authority to issue necessary instructions, guidelines, and clarifications from time to time.

18. Miscellaneous.—The Government may review, amend, or discontinue the scheme based on policy considerations, financial provisions, and emerging educational needs.
