No.NPK/2026-2388.—Whereas the Nagar Panchayat Kotkhai drafted the "Nagar Panchayat Kotkhai (Registration and Control of Pet Dogs) Bye-Laws 2025" were published in 249-राजपत्र/2025-12-02-2026 (11343)11344 राजपत्र, हिमाचल प्रदेश, 12 फरवरी, 2026/23 माघ, 1947 the Hindi Newspaper, Amar Ujala and Divya Himachal, under section 217 read with section 202 of the Himachal Pradesh Municipal Act, 1994

And whereas, no objections were received from any quarter within the specific period of fifteen days from the date of publication of these draft bye-laws .

In exercise of the powers conferred by Section 202(t) under chapter XI of the Himachal Pradesh Municipal Act, 1994, the following Byelaws are hereby made by the Nagar Panchayat Kotkhai for regulating /framing of " The Kotkhai Nagar Panchayat (Registration and Control of Pet Dogs) Bye-Laws 2025",

1. Short title and Commencement.—

(i) These Bye-laws may be called "The Nagar Panchayat Kotkhai (Registration and Control of Pet Dogs) Bye-laws, 2025."

(ii) These shall come into force from the date of their publication in the official gazette of Himachal Pradesh.

2. Definitions.— ln these bye-laws, unless the context otherwise requires:

i. "Act" means the Himachal Pradesh Municipal Council Act, 1994,(section 202(t) ii. "Section" means these action of the Act

iii. "Family" means the owner, his/her parents, spouse, sons, daughters, brothers and sisters living in one premises.

iv. "Owner" means the person who owns a registered/ unregistered dog and includes a person in whose custody, charge or possession a dog is found.

v. "Pet Dog" means a male or female dog kept by a person within the area of Nagar Panchayat Kotkhai and other than stray dogs.

vi. "Registration Authority" means any officers appointed by the Secretary, Nagar Panchayat Kotkhai.

vii. The words and expressions not defined in these byelaws shall have the same meaning as assigned to them in the HP Municipal Council Act, 1994.

3. Procedure for Registration of Dogs:

On and from the date of publication of these bye-laws, registration of Pet Dog(s) (hereinafter mentioned as dog) above the age of three months, kept within the jurisdiction of Nagar Panchayat, Kotkhai shall be compulsory. The owner of Dog, on or before the first day of April of every year or within seven days of its arrival, register such dog in a Form as prescribed by the Nagar Panchayat Kotkhai (Annexure – A) accompanied by a fee of Rs. 200 per dog as one time registration fees alongwith two recent photographs of the dog and a copy of vaccination certificate from a Government Veterinary Practitioner or Veterinary Practitioner duly registered with Indian Veterinary Council (IVC)or State Veterinary Council (SVC). Further, an amount of Rs 200 per dog shall be charged as license fees annually. However, a blind person keeping dog and using solely for his/her guidance shall be exempted from the payment of registration fee. On registration, the Registration Authority shall issue a metal token to be attached with the collar to be worn by the dog11345 राजपत्र, हिमाचल प्रदेश, 12 फरवरी, 2026/23 माघ, 1947 and in case of loss or destruction of the token; a duplicate token shall be issued to the owner on submission of an application alongwith a fee of Rs. 300 per token. The registration once made shall remain valid for full lifespan of the dog. In case of death of the dog, the owner of the dog shall immediately inform the Registration Authority. A family may keep maximum of two dogs.

1. Any registered dog found straying at large shall be liable to be seized and kept at

a place set for this purpose.

2. Duties and responsibilities of the owners:

(i) The owner of the pet dog shall be responsible for the controlled breeding, immunization, neutering and licensing in accordance with the provisions of these Bye-Laws.

(ii) Any dog not wearing metal ticket or registration in accordance with clause 3 of these Bye-laws may, if found in any public place be removed and will be liable to be dealt under the orders of the Veterinary Public Health Officer, Nagar Panchayat Kotkhai, if not claimed within 7 days by the owner.

(iii) For the purpose of these bye-laws any person in possession or in charge of the dog, during the absence of the real owner within the limits of Nagar Panchayat Kotkhai, shall be deemed to be the owner of the dog.

(iv) It shall be mandatory for each owner to carry disposable bags during the time when the dog is put on NP streets.

(v) The owner of the dog shall not allow the dog to defecate in public places such as residential areas, green belts, parks, streets, roads, road beams and other common places etc. In case the dog defecates at the above specified places, the owner shall arrange to get the excreta of the dog removed from the said place at his own level. No owner shall allow the dog to defecate near the residences of other persons, his/her neighbors to his/her/their annoyance.

3. The owner of the registered dog shall keep the dog under his/her control at all times so that it does not intimidate, annoy, hurt or bite any person. The Nagar Panchayat Kotkhai shall not be held responsible for any loss, damage or injury caused by a registered dog to any person or to his/her property and sole liability to compensate the victim will remain with the owner of the registered dog.

4. Guideline for breeders:

(i) A breeder must be registered with Nagar Panchayat Kotkhai. Breeder must maintain full record of the number of pups born/ died from individual bitches. He shall also maintain proper record of pedigree and vaccination.

(ii) Breeder must maintain record of the person buying the pups. He should ensure that the buyer has required knowledge for the upkeep of pups.

(iii) Breeder must pay Rs. 1000/-as one time registration charges in the treasury of the Nagar Panchayat Kotkhai besides Rs. 250/- per dog as annual fees every year. This fee to be paid by the breeding shall be over and above the registration fee / annual license fee provided in 3 above..

(i) A dog care centre must be registered with Nagar Panchayat Kotkhai. Owner of dog care centre must maintain full record of the number of dogs. He shall also maintain proper record of pedigree and vaccination.

(ii) No dog care centre is allowed insiders identical houses and flats

(iii) Owner of dog care centre must pay Rs. 1000/-as one time registration charges in the treasury of the Nagar Panchayat Kotkhai besides Rs. 250/- license fee every year.

(iv) Owner of dog care centre must obtain no objection certificate from the concerned ward councilor.

(v) Permission to operate dog care centre shall be subject to approval of Nagar Panchayat Kotkhai .

6. The owner of the registered dog shall ensure proper space, accommodation, food and medical treatment to the dog.

7. The Registration Authority or an officer/official authorize by him shall keep the details of all the seized dogs duly entered in a register with a brief description of the dog, date of seizure, reasons of seizure and the manner in which it is disposed of.

8. The dog after its death shall not be thrown in the open or in the garbage bins of Nagar Panchayat Kotkhai. Dead dog shall be buried at notified/earmarked places upto a depth of at least 3 ft. in a hygienic manner. The Nagar Panchayat Kotkhai may provide a van for the disposal/burial of dead dogs in the earmarked dog burial grounds on the request so received by it. The owner shall pay charges for availing the services of the van at the rates prescribed by the Secretary, Nagar Panchayat Kotkhai and so revised from time to time.

9. The Registration Authority or a Veterinarian, Health Supervisor, Chief Sanitary Inspector, Sanitary Inspector/Supervisor or any other officer of the Nagar Panchayat Kotkhai authorized by the Registration Authority, may inspect the premises of the owner of any dog and such owner shall allow that person to enter and inspect his/her premises at all reasonable times. Such officer/official shall also be authorized to search the places where dogs are kept without registration and to seize them.

10. Penalty:

(i) Any contravention of these Bye-Laws including the failure to register the dog, failure to follow guidelines for breeders, guidelines for dog care centre as per clause 3, 7, 8 above, shall be punishable with fine which may extend to Rs. 5,000/- and in case of continuous breach additional fine which may extend to Rs. 100/- per day till such contravention or breach continues shall be imposed.

Note.—Citizens cannot adopt and breeders or suppliers cannot sell any breed of dogs which is banned by Govt. of India and State Government.

In case of banned breeds, penalty of Rs. 5000/- and any injury or damage done by such pet animals will be the liability of pet owner.

ANNEXURE-B Undertaking from the owner of the Dog for registration

1. I do not have more than two dogs

2. I shall keep the dog protected by getting it vaccinated against rabies from a Govt. Veterinary Practitioner or Veterinary Practitioner duly registered with Indian Veterinary Council (IVC) or State Veterinary Council (SVC).

3. I will furnish the vaccination certificate on demand during Inspection by Registration Authority or any officer/official of the Nagar Panchayat Kotkhai duly authorized by the Registration Authority or within a period of 10 days from such Inspection, failing which registration of the dog may be cancelled.

4. I will keep the dog chained/leashed while taking it outside. All ferocious dogs shall be duly muzzled and a stick shall be carried by the Escort accompanying the dog while taking it out.

5. I will ensure that the dog will wear a collar affixed with the metal token issued by the Registration Authority at all the times.

6. I will compensate the person if a dog bites or causes/harm to any person or to the property of any person.

7. I shall keep the dog under my control all the times, so that it does not intimidate, annoy, hurt or bite any person. I shall not make Nagar Panchayat Kotkhai responsible for any loss, damage or Injury caused by a registered dog to any person or to his/her property and sole liability to compensate the victim will remain with me.

8. I shall not indulge in breeding of dogs for commercial purposes and trading of dogs within the area of Nagar Panchayat Kotkhai. In case it is found that dog is being kept for breeding or trading/commercial purposes by me, the Registration Authority shall impound my dog/s besides imposing a fine as fixed by the Secretary Nagar Panchayat Kotkhai upon me.

9. I shall not allow the dog to defecate in public places such as residential areas, green belts, parks, streets, roads, road beams and other common places etc. In case the dog defecates at the above specified places, I shall arrange to get the excreta of the dog removed from the said place at my own level. I shall not allow the dog to defecate near the residences of other persons, neighbors to their annoyance.

10. I shall ensure proper space, accommodation, food and medical treatment to the dog 11. सं0 टी0एस0एम0-एफ(5)11/2022.--हिमाचल प्रदेश के राज्यपाल का समाधान हो गया है कि गांव सेरी, तहसील नादौन, जिला हमीरपुर में खातानंबर 3, खतौनी नंबर 7, खसरा नंबर 2016 और 2017 से समाविष्ट 97-66 वर्गमीटर (प्राईवेट भूमि) लोक परियोजनार्थ नामतः पर्यटन परिसर के सन्न्र्मिाण हेतु अर्जित की जानी है ।

अतः हिमाचल प्रदेश के राज्यपाल, भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा 19 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए घोषणा करते हैं कि गांव सेरी, तहसील नादौन, जिला हमीरपुर में 97-66 वर्गमीटर भूमि उपरोक्त प्रयोजन हेतु अर्जन के अधीन है। अर्जित की जानी वाली भूमि पर वृक्षों और निर्मितियों का ब्यौरा निम्नानुसार हैः-

यह घोषणा इसलिए की जा रही है क्योंकि भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा 15 के अधीन हितबद्ध व्यक्तियों के आक्षेप आमन्त्रित करने हेतु और अधिसूचना का व्यापक प्रचार करने के बाबजूद साठ दिनों की नियत अवधि के भीतर प्रस्तावित भूमि अर्जन के विरुद्ध किसी भी हितबद्ध व्यक्ति से कोई लिखित आक्षेप प्राप्त नहीं हुए। चूंकि इस भूमि अर्जन के कारण किसी भी प्रभावित कुटुंब के विस्थापन और परिणामतः पुनव्र्यवस्थापन की कोई संभावना नहीं है इसलिए किसी भी पुनव्र्यवस्थापन क्षेत्र की पहचान किया जाना अपेक्षित नहीं है। तथापि, प्रभावित कुटुंब को अधिनियम के उपबन्धों के अनुसार देय पुनर्वासन और पुनव्र्यवस्थापन प्रसुविधाएं प्रदान की जाएंगी।

पुनर्वासन और पुनव्र्यवस्थापन योजना का संक्षिप्त विवरणः-

(भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित मुआवज़े और पारदर्शिता का अधिकार अधिनियम, 2013) के प्रावधानों के अनुसार पुनर्वासन और पुनव्र्यवस्थापन योजना के उद्‌देश्य के लिए अधिनियम को दूसरी अनुसूची में निर्धारित मैट्रिक्स के नियमानुसार लागू होगा :

1. प्रभावित परिवारों की स्थिति.--इस परियोजना के शुरू होने से प्रभावित परिवार के घर अधिग्रहण के लिए प्रस्तावित भूमि के भीतर स्थित नहीं है और कोई भी परिवार भूमिहीन नहीं होगा या उसे पुनस्र्थापन की आवश्यकता नहीं होगी।

2. आवास लाभ.--अधिनियम के प्रावधानों के तहत जिन परिवारों के घरों की आवश्यकता है वे इसके हकदार होंगे।

• ग्रामीण क्षेत्रों में 1,50,000/- • शहरी क्षेत्रों में 1,85,000/-

एक नया घर बनाने के लिए यह लाभ सक्षम प्राधिकारी द्वारा किये गए प्रधान मंत्री आवास योजना के तहत प्रदान किए जाएंगे। यद्यपि कोई भी घर अधिग्रहित नहीं किया जा रहा है।

3. भूमि के बदले भूमि.--इस परियोजना के तहत भूमि के बदले भूमि का प्रावधान लागू नहीं है। 4. भूमि विकास.--इस परियोजना के तहत भूमि विकास का प्रावधान लागू नहीं है।11357 राजपत्र, हिमाचल प्रदेश, 12 फरवरी, 2026/23 माघ, 1947 5. वार्षिकी/रोजगार अनुदान.--

• वार्षिकी/रोजगार के बदले रु0 5,00,000/- का एक मुश्त भुगतान का विकल्प प्रदान किया जाएगा।

• यह राशि प्रभावित भूमि के सह साझेदारों के बीच जैसा लागू हो वितरित की जाएगी। • इस परियोजना के तहत प्रभावित परिवारों को रोजगार देने का कोई प्रावधान नहीं है। 6. निर्वाह अनुदान :-

• विस्थापित परिवारों के लिए एक वर्ष के लिए प्रतिमाह रु0 3,000/- का निर्वाह अनुदान एक वर्ष (36,000/-) तक प्रदान किया जाएगा।

• यह लाभ केवल उन परिवारों को दिया जाएगा जिनके घरों का अधिग्रहण किया गया है और जिन्हें प्रभावित क्षेत्र के बाहर एक नया घर बनाने की आवश्यकता है।

• इस मामले में यह लागू नहीं है।

7. परिवहन सहायता.--

• प्रत्येक पुनस्र्थापित परिवार को भवन निमार्ण सामग्री, घरेलू सामान और मवेशियों के परिवहन की लागत के लिए रु0 50,000/- की एक मुश्त राशि प्रदान की जाएगी। यह इस मामले में लागू नहीं है क्योंकि कोई विस्थापन नहीं है।

8. मवेशी शेड/छोटी दुकान/कारीगरों/छोटे व्यापारियों के लिए सहायता.--प्रत्येक प्रभावित परिवार को मवेशी शेड के पुनर्निमाण, छोटी दुकान या कारीगराें, छोटे व्यापारियों की सहायता के लिए रु0 25,000/-दिए जाएंगे। यह इस मामले में लागू नहीं है।

9. मछली पकड़ने का अधिकार.--मछली पकड़ने के अधिकारों से सम्बन्धित प्रावधान इस प्रोजैक्ट के तहत लागू नहीं है।

10. एक मुश्त पुनर्वासन अनुदान.--प्रत्येक प्रभावित परिवार को रु0 50,000/- का एक मुश्त अनुदान का हकदार होगा।

11. सार्वजनिक उपयोगिताएं.--इस प्रोजैक्ट के लागू होने से सार्वजनिक उपयोगिताओं पर कोई प्रतिकूल प्रभाव नहीं पड़ेगा।

12. कार्यान्वयन और सत्यापन.--

• उप-मण्डलाधिकारी (ना)-एवं-भूमि अधिग्रहण अधिकारी (पर्यटन) लाभों के वितरण से पहले लाभार्थियों की पात्रता सुनिश्चित करेंगे।

Shimla-2, the 10th February, 2026

No. TSM-F(5)11/2022.—Whereas, the Governor of Himachal Pradesh is satisfied that a total of 97-66 Sq. Mtrs. (Private land) comprising in Khata No. 3, Khatauni No. 7, Khasra No. 2016 and 2017 is required in Village Seri, Tehsil Nadaun, Distt. Hamirpur for the public purpose namely construction of Tourist Complex.

Therefore, the Governor of Himachal Pradesh in exercise of the powers conferred by Section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) declares that land measuring 97-66 Sq. Mtr. is under acquisition for the above said project in Village Seri, Tehsil Nadaun, Distt. Hamirpur, H.P. The detail of trees and structures on land being acquired are as under:—

This declaration is being made since no written objections from any interested person against the proposed land acquisition has been received within stipulated period of 60 days despite wide publicity of notification u/s 15 of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) for inviting objections.

Since there is no likelihood of displacement and resultant resettlement of any affected family due to this land acquisition, therefore, no resettlement area is required to be identified. However, the affected family shall be provided with entitled Rehabilitation & Resettlement benefits as per the provisions of the Act.

SUMMARY OF REHABILITATION AND RESETTLEMENT (R&R) SCHEME:

(As per provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013) For the purpose of the Rehabilitation and Resettlement Scheme, the matrix laid down in the Second Schedule of the Act shall apply as under:—

1. Status of Affected Families.—By Commissioning of this project, the house of the affected family is not situated within the proposed land for acquisition, and no family will become landless or require resettlement.

2. Housing Benefits.—Under the Provisions of the Act, such families whose houses are being required shall be entitled to:—

• Rs. 1,50,000/- in rural areas; and • Rs. 1,85,000/- in urban areas.

for the construction of a new house. These benefits are to be provided under the Pradhan Mantri Awas Yojana, as decided by the competent authority. However, no house is being acquired.

3. Land for Land.—The provision of Land for Land is not applicable under this project.

4. Land Development.—The provision of Land Development is not applicable under this project .

5. Annuity / Employment Grant :

• An option of a one- time payment of Rs. 5,00,000/- will be provided in lieu of annuity of employment .

• This amount will be distributed among the co- sharers of the affected land, as applicable.

• There is not provision for employment to the affected families under this project.

5. Subsistence Grant :

• For displaced families, a subsistence grant of Rs. 3,000/- per month for one year (total Rs. 36,000/-) will be provided.

• This benefits shall be extended only to those families whose houses have been acquired and who are required to construct a new house outside the affected area.

• This is not applicable in present case.

7. Transportation Assistance:

• Each resettled family will be provided a lump sum of Rs. 50,000/- towards the cost of transporting building material, household belongings and cattle. This is not applicable in present case as there is no displacement.

8. Assistance for Cattle Shed / Petty Shop/ Artisans / Small Traders :

• Each affected family shall be provided Rs. 25,000/- for reconstruction of a cattle shed, petty shop or for assistance to artisans / small traders. This is not applicable in present case.

9. Fishing Rights:

• The provision regarding fishing rights is not applicable under this project.

• Each affected family shall be entitled to a one-time resettlement grant of Rs. 50,000/-.

11. Public Utilities:

• The implementation of this project will not cause any adverse impact on public utilities.

12. Implementation and Verification:

• The SDO (C)-cum-Land Acquisition Officer (Tourism), Nadaun shall ensure the eligibility of beneficiaries before the disbursement of R & R benefits.

• The benefits shall not be extended to any ineligible or underserving family under any circumstances.

प्रार्थी श्री मोहन सिंह पुत्र स्व0 श्री नरपत, निवासी गांव तून बडयार ने इस न्यायालय मे प्रार्थना-पत्र प्रस्तुत किया है कि शंकरू पुत्री नडा, निवासी गांव तून बडयार जोकि अरसा तकरीबन 50 वर्षों से लापता है। शंकरू पुत्री नडा घर छोड़ कर गई उस समय अविवाहित थी। अरसा लगभग 50 वर्षाें से उसके जीवित या मृत होने बारे प्रमाण नहीं है तथा इन्तकाल वरास्त उसके भाई के वारसान के नाम तसदीक किया जाये। क्षेत्रीय अभिकरण से इसकी छानबीन करवाई गई। क्षेत्रीय अभिकरण की रिपोर्ट व वाशिन्दगान दह केे ब्यान अनुसार शंकरू पुत्री नडडा अविवाहित थी। पटवार वृा कन्सवाला के महाल तून मे इन्तकाल नम्बर 56 व उप-महाल बडयार मे इन्तकाल नम्बर 51 दर्ज है। आम जनता को सूचित किया जाता है कि बरास्त मे आदेश उसके वारसान पारित किये जाने बारे आपाि हो तो वह असालतन या वकालतन अपनी आपाि अधोहस्ताक्षरी के न्यायालय मे इस इश्तहार के प्रकाशन के एक महीने के अन्दर प्रस्तुत कर सकता है। उसके पश्चात इन्तकाल में आदेश नियमानुसार पारित कर दिये जाएंगे।
