Ghumarwin, the 22nd September, 2025

No. MCG/Hoarding/2025.—In exercise of the powers conferred under Section 125, 126, 127, 128 read with Sections 202 and 21 4 of the Himachal Pradesh Municipal Act, 1994, 254-राजपत्र/2025-19-02-2026 (11601)11602 राजपत्र, हिमाचल प्रदेश, 19 फरवरी, 2026/30 माघ, 1947 I, Khem Chand Verma, Executive Officer, Municipal Council Ghumarwin, District Bilaspur, Himachal Pradesh hereby notify the following Advertisement and Hoarding Bye-Laws:—

MUNICIPAL COUNCIL GHUMARWIN, ERECTION, EXHIBITION, AFIXATION OF

ADVERTISEMENT AND HOARDING BYE-LAWS 2025

1. Short title, commencement and application.—These Bye-laws may be called, "MUNICIPAL COUNCIL GHUMARWIN, ERECTION, EXHIBITION, AFFIXATION OF ADVERTISEMENT AND HOARDING BYE-LAWS 2025".

(ii) These Bye-laws shall come into force from the date of their final publication in the Official Gazette (Rajpatra).

(iii) These Bye-laws shall be applicable within the jurisdiction of Municipal Council Ghumarwin as defined from time to time.

2. Definitions:

(i) In these Bye-laws, unless the context otherwise requires:—

(a) "Act" means the Himachal Pradesh Municipal Act, 1994 (Act No. 13 of 1994) as amended from time to time.

(b) "Applicant" means any person applying for permission for erection, exhibition, affixation of advertisement and hoarding upon the land and buildings falling within the jurisdiction of Municipal Council Ghumarwin which include the Government/Semi Government and Private buildings.

(c) "Authorized Officer" means any Officer/Official duly authorized by the Municipality or its Sr. Executive Officer/Executive Officer/Secretary under these Bye-laws.

(d) "Hoarding" means any advertisement to be placed by way of erection, exhibition and affixation or to retain upon or over any land, building, wall, boarding, frame, poster structure or upon in any vehicle including, any advertisement exhibited by means of cinematography.

(e) "Place" means authorized sites/locations specified by the Municipal Council Ghumarwin erection, exhibition and affixation of advertisement hoarding, with the limits of council/corporation.

(f) "Permission"means sanction/approval granted by the Sr. Executive Officer/ Executive Officer/Secretary or the Officers authorized by him in this behalf for erection, exhibition and affixation of advertisement hoardings.

(g) "Special Judicial Magistrate 1st Class" means the Judicial Magistrate having jurisdictionover the area of Municipal Council Ghumarwin under the Act.

(h) words and expressions used in these Bye-law but not defined herein shall have the meaning respectfully assigned to them under the Act.

3. Prohibition of advertisement without written permission of the Sr. Executive

Officer/Executive Officer/Secretary:—

(i) No advertisement shall be erected, exhibited, affixed or retained upon or over any land building, wall boarding, frame, post or structure or upon in any vehicle or shall be displayed in any manner, whatsoever in any place within the Municipal area including private land and buildings without the written permission of the Sr. Executive Officer/Executive Officer/Secretary granted in accordance with these bye-laws except the advertisementhoardings of the Central, State Government highlighting the achievements of the Government swithin the area of Municipal area.

(ii) All such advertisement hoarding erected/installed by any other individual, authority or agency including the public sector undertakings duly owned and controlled by the Governmentshall be liable to seek prior permission for erection and installation of such hoardings within the territorial jurisdiction of the Municipal area on such fees and other terms and condition as may be fixed in this behalf by the concerned officer under these bye-laws. However, no permission shall be permissible for the hoardings to be installed by Central, State Government highlighting the achievements of the Governments within the Municipal area.

(iii) Any person authority or agent found erecting, exhibiting and affixing the advertisement hoardings illegally, unauthorized and without any permission shall be liable for penalty under these Bye-laws and such hoardings along with frame structure/ vehicle displaying the same shall be impounded.

4. Procedure for application and grant of permission:—

(i) The applicant or the person concerned, intending to erect, exhibit or affix advertisement hoardings within the Municipality's area, shall submit in writing the details of the location/site and size of the hoarding to be occupied for such installation, or through the online Citizen Seva Portal, to the Sr. Executive Officer/Executive Officer/ Secretary or the Officer authorized in this behalf.

(ii) The application submitted by the applicant, through offline or online channels, shall be verified by the concerned branch dealing with hoarding permissions. This branch shall, after spot inspection, process the application for the authority's approval for the grant of necessary permission in favour of the applicant, after assessing the hoarding charges for the erection, affixation and exhibition of such hoarding, and convey the same to the applicant before granting permission.

(iii) Applicant or the person concerned, intending to erect, exhibit and affix the advertisement hoardings within the area of the Municipality shall in writing submit the detail of the location/site, size of hoarding to beoccupied for such installation or through online Citizen Seva Portal to the Sr. Executive Officer/Executive Officer/Secretary or the Officer authorized in this behalf.

(iv) The application submitted by the applicant shall be verified by the concerned branch dealing with hoarding permission who shall after spot inspection process the same for the approval of the authority for grant of necessary permission in favour of the applicant after assessing the hoarding charges for erection, affixation11604 राजपत्र, हिमाचल प्रदेश, 19 फरवरी, 2026/30 माघ, 1947 and exhibition of such hoarding and convey the same to the applicant before granting permission.

(v) The permission for erection, affixation and exhibition of advertisement hoarding shall be accorded only after obtaining receipt of the amount to be deposited by the applicant in the Municipality on this account.

(vi) The place for erection, affixation and exhibition of advertisement hoarding shall be communicated to the applicant by the concerned branch of the Municipality in writing and the name of the place/site of erection, affixation and exhibition of advertisement hoarding by the applicant shall also be mentioned on the hoardings to be affixed/erected and installed alongwith the date and period of sanction on such hoarding. Further, intimation of the same shall also be given to Municipality or to the concerned agency or the contractor hired or engaged by the Municipality for managing the sites for erection, affixation and exhibition of advertisement hoardings.

(vii) In the case of advertisement affixed, erected and installed upon vehicle, a person shall have to carry the original permission, a copy of which shall be affixed on the 'windscreen of thevehicle and the same shall have to be shown to the authorized officer of the Municipality at the time of inspection. Further, all other persons, authority or agency shall also be liable to show the sanction to the inspecting staff of the Municipality at any time.

(viii)The permission granted by the Municipality for erection, exhibition and affixation of advertisement hoarding shall be time specific and after expiry of period of permission, the concerned person, authority and agency shall be liable to remove the same forthwith failing which the same shall be removed by the Municipality at the risk cost and responsibility of the person concerned.

In addition, the Authorised Officer shall impose penalty at the rate of Rs.1000/- (One Thousand) per day and amount shall be recovered from the concerned as per the provision scontained in Section 87 of the H.P. Municipal Act, 1994.

(ix) In case the advertisement hoarding is affixed on the private land or building including shops and the person concerned have failed to release the amount of fees to be paid to the Municipality on account of such sanction, the Authorised Officer in addition to the aforesaid penalty shall take steps to withdraw civic amenities granted in favour of the person concerned and also to make request to concerned authority for withdrawal of sanction/ recognition granted by them in favour of the person concerned.

(x) The size of the hoarding shall not be more than the size as fixed by the Municipality andall the advertisement hoarding shall be installed in the specified area and no hoarding shall be installed in heritage area or in valley side above the road level and on the roofs of the buildings. All the hoardings must be installed, erected in a way so as to preserve the aesthetics, scenic beauty and the view of the hills.

(xi) No advertisement hoarding shall be erected on sharp and blind curves and should not be located in oblique to the road on any natural water source, tree, water line,11605 राजपत्र, हिमाचल प्रदेश, 19 फरवरी, 2026/30 माघ, 1947 Municipal drain, fire hydrant and on garbage containers and at a place where it effects the growth of flora etc.

(xii) No advertisement hoarding shall be permitted within the area started from ………………….. to …………………………….or restricted area except the advertisement hoardings to be installed by the specific order of the State Government for a particular occasion.

(xiii)The Authorised officer in the exceptional circumstances or in the larger public interest may permit any person, authority or agency to erect, exhibit or affix the advertisement hoardings pertaining to social or State and National interest matter only for a period of 7 days in any area including Core/Heritage area.

(xiv) No advertisement hoarding in contravention of any law, rules norms, notification or direction issued by the State Government or by the Municipality shall be erected, affixed and installed within the limits of Municipal area. Further the directive issued by any Court of law in this regard shall be binding upon all the concerned.

5. Rates for affixation, erection and installation of advertisement hoarding.—The rate shall benotified/fixed by the Municipality for affixation, erection and installation of advertisement hoarding from time to time and the same shall be notified to the concerned seeking such permission.

6. Duties and responsibilities of the applicant:—

(i) It shall be the duty and responsibility of the applicant to make available all the sanctions/permissions granted by the competent authority to the said person, authority or agency to whom such permission has been granted by the Municipality and to follow the instructions/guidelines issued by the Municipality or by the Central /State Government in this regard from time to time.

(ii) Whosoever is found affixing, erecting and exhibiting the advertisement hoarding at a place other than the places so approved for such purpose and in contravention of conditions specified by the Municipality, in such sanction the person, authority and agency shall be liable jointly for penalty under these Bye-laws in addition to the penalties already provided under the H.P.Municipal Act, 1994.

7. Compounding of offences.—All the offences punishable under these Bye-laws may, before, be compounded by such officer as may be authorized by the payment of such sum as may be the institution of prosecution, Municipality or its Authorised Officer in this behalf, on specified by such officer under these Bye-laws.

8. Offences to be tried summarily.—The offences which are not compounded shall be tried in a summary manner by the Special Judicial Magistrate 1st having jurisdiction of the Municipal area as per provision contained under law.

9. Penalty:—

(i) Whosoever, is found guilty of affixing, erecting and exhibiting the advertisement hoarding at a place other than the place(s) specified/ notified by the Municipality the rate of penalty stall be Rs.100/ (One Hundred) per square feet per day to be11606 राजपत्र, हिमाचल प्रदेश, 19 फरवरी, 2026/30 माघ, 1947 calculated from the date oferection/affixation of such unauthorized hoarding and till its removal by the concerned or by the Municipality.

(ii) In case of repeated violation and the person concerned failed to release the due amount including penalty to the Municipality within a period of 15 days, as the case may be, he/she shall also be liable for disconnection of water, electricity and others civic amenities and the Municipality may request the competent authority for withdrawal of recognition and registration, if any, granted in his/her favour including withdrawal of building sanction granted in favour of the owner concerned if such unauthorized hoarding is found erected upon the building concerned.

10. Repeal and Savings.—The scheme regulation, bye laws if any, relating to affixation, erection and exhibition of advertisement hoardings is hereby repealed. Anything done or any action taken under the said scheme, bye-laws and Regulations the same shall be deemed to have beendone or taken under the provisions of these bye-laws.

Ghumarwin, the 22nd September, 2025

No. MCG/PETS/2025.—Whereas, the Municipal Council Ghumarwin has created new bye-laws, called the (Registration & Control of Dogs) Pet Bye-Laws-2025, to manage the pet dog population and address related public issues within the municipal area.

In exercise of the powers conferred under Section 125, 126, 127, 128 read with Sections 202 and 214 of the Himachal Pradesh Municipal Act, 1994, I, Khem Chand Verma, Executive Officer, Municipal Council Ghumarwin, District Bilaspur, Himachal Pradesh, hereby officially notify and implement the following (Registration & Control of Dogs), Pet Bye-Laws 2025: —

MUNICIPAL COUNCIL GHUMARWIN,

(Registration & Control of Dogs), Pet Bye-Laws 2025

These bye-laws apply to all dog owners within the official municipal limits.

1. Short title and commencement:—

(i) These new "bye-laws" will be known as the Municipal Council Ghumarwin, (Registration & Control of Dogs), Pet Bye-Laws of 2025, specifically covering the registration and control of dogs.

the Official Gazette (Rajpatra).

(iii) These bye-laws apply to everyone who owns a dog within the official municipal limits.

2. Definitions.—In these Bye-Laws, unless the context otherwise requires,—

(i) Dog: Refers only to Pet Dogs, not stray dogs

(ii) Owner: The person who owns the dog, or any other person who has the dog in their possession or custody whether with or without the consent of the owner.

(iii) Authorized Officer: The Sr. Executive Officer/Executive Officer/ Secretary or any others officer specially authorized by the Sr. Executive Officer/Executive Officer/ Secretary as the case may be.

(iv) License: Written permission granted by the Executive Officer/Secretary or Authorized officer.

(v) Act: The Himachal Pradesh Municipal Council Act, 1994

(vi) Section: A section of the Act

(vii) Dog Pound: the place

3. Procedure for Registration of Dogs:

All pet dog owners within MC Ghumarwin limits must follow these steps:

4. Breeding and Dog Limit:

(i) Dog Limit: A maximum of two dogs can be kept and registered per household.

Registration for more than two dogs is prohibited.

(ii) Breeding: Owners must not breed any dog species that have been banned by the State or Central Government or the District Administration.

(iii) Death or Relocation: The owner must inform the Authorized Officer in writing about the dog's death or change of location. Failure to do so will result in the dog being presumed alive and action being taken accordingly.

5. Owner Duties and Public Nuisance Control:

Dog owners must ensure their pet does not become a nuisance to the public in any way.

6. Guideline for breeders:—

All dog breeders must be registered with the Municipal Council Ghumarwin:

• Registration Fee for Breeders: `500 (One-time) plus `50 (Annual renewal fee) per dog. Note: This is an additional fee to the regular pet registration fee in Section 2.

• Record Keeping: Breeders must maintain full records of:—

o The number of pups born and died from each mother dog o Proper pedigree and vaccination records o The details of the person buying the pups11609 राजपत्र, हिमाचल प्रदेश, 19 फरवरी, 2026/30 माघ, 1947 • Buyer Knowledge: Breeders must ensure the buyer has the necessary knowledge to properly care for the pups.

7. Penalties for Violations:—

Any person who violates these bye-laws, including failing to register a dog, will be punished with a fine:

• Minimum Fine: `500 (Five Hundred Rupees). • Maximum Fine: Up to `1,000 (One Thousand Rupees). • Continuous Violation: If the violation continues, an additional fine of up to `50 per day will be charged until the bye-law is followed.

8. Liability and Action in Case of Dog Bite:—

Notwithstanding the general duties in Clause 5, if any registered or unregistered dog bites a person within the Municipal Council limits, the Owner shall be held liable as follows:

A. For Dogs Having a Valid Pet Registration Certificate

If the dog possesses a current and valid registration certificate and metal tag/badge issued by the Municipal Council Ghumarwin:

B. For Dogs Having No Valid Pet Registration Certificate

If the dog does not possess a current and valid registration certificate issued by the Municipal Council Ghumarwin, or if the registration has expired:

NOTIFICATION

Ghumarwin, the 12th December, 2025

No. MCG/Tobacco License/2025.—In exercise of the powers conferred under Section 125, 126, 127, 128 read with Sections 202 and 214 of the Himachal Pradesh Municipal Act, 1994, I, Khem Chand Verma, Executive Officer, Municipal Council Ghumarwin, District Bilaspur, Himachal Pradesh hereby notify the"Municipal Council Ghumarwin Tobacco Control and Regulation Bye-Laws, 2025". These Bye-Laws were approved in the General House meeting held on 8th December, 2025.

The Municipal Council (MC) of Ghumarwin formally adopts and shall strictly enforce these Bye-Laws in accordance with "The Himachal Pradesh Prohibition of Sale of Loose Cigarettes and Beedies and Regulation of Retail Business of Cigarettes and Other Tobacco Products Act, 2016," and is strictly implementing these Bye-Laws to regulate the retail business of tobacco products within the Municipal limits of Ghumarwin.

1. Short Title, Commencement and Application:—

1.1. Short Title: These Bye-laws may be called the "Municipal Council Ghumarwin Tobacco Control and Regulation Bye-Laws, 2025".

1.2. Commencement: These Bye-laws shall come into force from the date of their final publication in the Official Gazette (Rajpatra).

1.3. Application: These Bye-Laws shall extend to the whole Municipal Area of Ghumarwin.

2. Adoption of State Act and Definitions:—

2.1. Principle: The provisions of "The Himachal Pradesh Prohibition of Sale of

Loose Cigarettes and Beedies and Regulation of Retail Business of Cigarettes

and Other Tobacco Products Act, 2016" (Act No. 17 of 2016), including all definitions, prohibitions, and penalties, are hereby adopted and shall be enforced with the same rigor within the jurisdiction of the Municipal Council Ghumarwin.

2.2 Definition of Permanent Shop/Retail Outlet:

"Permanent Shop/Retail Outlet" shall mean a premises or structure used for the sale of tobacco products that is fixed to the ground with permanent foundations or a permanent floor structure, constructed of materials (such as brick, mortar, concrete or equivalent engineered materials), and duly registered for property tax by the Municipal Council.

Exclusion: This definition specifically excludes all forms of temporary, mobile or movable vending units, including, but not limited to, rehadis, vending carts, temporary stalls, or any other non-permanent structures, irrespective of their size.

3. Prohibition of Sale of Loose Tobacco Products:—

3.1. Complete Ban:No person shall sell, offer for sale, or permit the sale of loose cigarettes or loose beedies (single sticks or less than the statutory minimum pack quantity) at any retail outlet, shop, temporary stall, or mobile vending unit within the Municipal limits of Ghumarwin.

3.2. Mandatory Packaging: All sales of cigarettes, beedies and other notified tobacco products must strictly adhere to the mandatory packaging requirements as prescribed under the Central and State laws, including pictorial health warnings.

4. Regulation of Retail Business (Registration and Location):—

The registration process is mandatory for all persons who are carrying on or intend to carry on the retail business of Cigarettes, Beedies and other Tobacco Products within the Municipal Council (MC) limits of Ghumarwin.

4.1 Designated Registering Authority

The Registering Authority for granting the certificate is an authority designated by the State Government, which, in the case of Municipal areas, is the Executive Officer (EO)/Senior Executive Officer (SEO)/Secretary or a designated officer of the Municipal Council Ghumarwin.

4.2 Application Submission

• Application Form: The applicant must obtain and fill out the prescribed Form-1 (Annexure-"A") as per the Himachal Pradesh Prohibition of Sale of Loose Cigarettes and Beedies and Regulation of Retail Business of Cigarettes and Other Tobacco Products Rules, 2018. This form is available at the Municipal Council office.

• Fees: The application must be submitted alongwith the requisite registration fee.

o New Registration Fee: `500 (Rupees Five Hundred only).

The applicant must typically submit the following documents along with Form-1:

• Proof of Business Premises: Rent agreement, property tax receipt, or ownership documents for the shop.

• Identity and Address Proof: Aadhaar Card, Voter ID, or other prescribed documents of the applicant.

• Mandatory Business Registration: A certified copy of the Trade License issued by the Municipal Council Ghumarwin is mandatory for submission with both the new registration and renewal application forms.

"Failure to submit a valid Municipal Trade License will result in the

application being summarily rejected by the Registering Authority."

• Declaration: A formal undertaking/declaration to strictly comply with the provisions of the State Act (2016) and all local Bye-laws, including the ban on loose sale and sales near educational institutions.

• Photographs: Passport-sized photographs of the applicant.

4.4 Verification and Site Inspection

• Scrutiny: The Registering Authority (MC Ghumarwin office) will scrutinize the application and submitted documents.

• Site Inspection: An officer authorized by the Secretary/EO/SEO (e.g., Sanitary Inspector or Junior Engineer or Enforcement Officer) will conduct a physical inspection of the proposed premises to ensure compliance with the mandatory requirements.

A written report from the Sanitary Inspector or Junior Engineer or Enforcement Officer, or any authorized officer, confirming compliance with all location restrictions, is mandatory before approval.

• Mandatory Location Restriction:The shop must NOT be located within 100 yards (91.44 meters) radially of the outer limit of the boundary wall of any educational institution (including Schools, Colleges, Universities, Anganwadicenters, Coaching centres, Tuition Centres, Computer Centres, or any institution where educational activities are conducted).

4.5 Grant of Registration Certificate

• Issuance: If the application is complete and the premises pass the inspection, the Registering Authority will grant the Registration Certificate in Form-3 (Annexure-"C").

• Validity: The Registration Certificate is granted for a period of three years.

• Deemed Registration: If the Registering Authority fails to grant the certificate within six months of the receipt of the application, the applicant will be deemed to be registered.

4.6 Renewal Process

• Application: Before the expiry of the three-year period, the vendor must apply for the renewal of the certificate.

• Renewal Fee: The current prescribed renewal fee is `300 (Rupees Three Hundred only).

• Validity: Renewal is granted for a further period of three years.

• Penalties: If the applicant fails to apply for renewal before the expiry of three years, a late fee of `200 (Rupees Two Hundred only) per month shall be charged in addition to the renewal fee.

• Duplicate: If the original registration certificate is lost, a duplicate registration certificate shall be issued on payment of `100 (Rupees One Hundred only).

4.7 Prohibition on Non-Permanent Structures:

• The Tobacco Vendor Registration Certificate/License shall be issued ONLY to applicants operating from a "Permanent Shop/Retail Outlet" as defined in Section 2.2.

• The Certificate shall NOT be issued or renewed for any form of temporary, mobile, or movable vending units (rehadis, vending carts, temporary stalls, or any other non-permanent structures).

4.8. Prohibition of Banned Products and Non-Eligibility for License

• Non-Eligible Products: The Registration Certificate/License shall not be issued or renewed to any vendor, and any existing certificate shall be subject to immediate cancellation, if the vendor is found to be engaged in the sale, storage, distribution, or handling of:

o Banned Smokeless Tobacco Products: Gutkha, Khaini, Zarda, Pan Masala containing tobacco, or any other flavored, scented, or processed tobacco products that are currently banned under the Food Safety and Standards Act, 2006 (FSSA) and its Regulations in the State of Himachal Pradesh.

o Banned Smoking Devices: Electronic Cigarettes (e-Cigarettes), Heated Tobacco Products, Hookah (except in licensed Hookah Bars as per State Rules, which are not permitted under this retail license), and any similar devices prohibited by law.

constitute a violation of these Bye-laws and:

o For banned smokeless tobacco, prosecution shall be initiated against the vendor concurrently under the relevant provisions of the FSSAI Act, 2006.

o For electronic cigarettes and similar devices, prosecution shall be initiated under the Prohibition of Electronic Cigarettes Act (PECA), 2019, and the seized items shall be immediately confiscated.

• Permanent Disqualification: Any vendor whose license is cancelled under this clause shall be permanently disqualified from obtaining a Municipal Council Ghumarwin Tobacco Control and Regulation License.

4.9. Mandatory Operational and Display Conditions for Tobacco Vendors:—

The issuance or renewal of the Registration Certificate/License is strictly conditional upon the vendor's continuous compliance with the following points, failing which the application shall be rejected or the license is cancelled:

• Ancillary Products Ban: The tobacco vendor shall not provide or make available a matchbox, lighter or ashtray facility to clients inside the shop premises. Licenses shall not be issued to vendors violating this.

• Mandatory Warning Signage [Section 6(a), COTPA]: The license cannot be issued unless the mandatory warning signboard (prohibiting sale to minors) is prominently displayed. Selling without this display is a violation of Section 6(a) of COTPA, punishable with a fine up to `200.

• • Sale and Display to Minors:

o No tobacco product shall be handled or sold by a person below

the age of 18 (eighteen) years.

o Tobacco products shall not be displayed in a manner that enables easy access or direct visibility to persons below the age of eighteen years.

• Advertisement Prohibition (Section 5, COTPA): The Advertisement of Tobacco products at the shop is strictly not allowed. This includes placing advertisement posters, dangles, backlit displays, or sunboards at the shop, which constitutes a violation of Section 5 of COTPA.

• Permitted Display Rules for Vendors: Vendors may display only one plain information board (optional), subject to the following limits:

o Maximum Size: 60 cm × 45 cm. o Health Warning: Must include a health warning—"Tobacco causes cancer" or "Tobacco kills"—in an Indian language, measuring 20 cm × 15 cm.

o Formatting: Warning must be clear, legible, and in black text on

a white background.

o Content Limit: The board may display only the types of tobacco products available. No brand names, pictures,11615 राजपत्र, हिमाचल प्रदेश, 19 फरवरी, 2026/30 माघ, 1947 promotional messages, lighting, or backlit displays are allowed.

o

• Pictorial Health Warnings (PHW) Compliance (Section 7, COTPA):

o Tobacco vendors can sell only those tobacco products which

carry the specified Pictorial Health Warnings.

o If a tobacco pack does not display the specified PHW, or if a vendor is found selling smuggled, imported, or illegal tobacco products without the specified PHW, it constitutes a violation of Section 7 of COTPA.

o In cases of PHW violation, the license shall not be issued or renewed, and the vendor will be subject to prosecution under the law.

5. Enforcement and Penalties (Local Fines):—

5.1. Enforcement Authority: The Senior Executive Officer (SEO)/Executive Officer (EO)/ Secretary of the Municipal Council, alongwith any officer authorized by them (not below the rank of Sanitary Inspector/ Sanitary Supervisor/ Junior Engineer (JE)/ Enforcement Officer), shall be the designated Enforcement Authority under these Bye-Laws, in addition to the officers authorized under the State Act.

5.2. Local Penalties for Loose Sale (Compounding of Offences)

 Any person found selling loose cigarettes or beedies in contravention of these Bye-Laws shall be liable to a spot fine/compounding fee by the Enforcement Authority, as follows:

o First Offence: `1,000 (Rupees One Thousand only) o Second Offence: `2,000 (Rupees Two Thousand only) o Subsequent Offences: `5,000 (Rupees Five Thousand only) and recommendation for the cancellation/suspension of the business license/registration by the competent authority.

5.3. Penalties for Operating without Registration.—Any person carrying on retail business of tobacco products without the mandatory registration shall be liable to a fine as prescribed in the State Act.

6. Public Awareness and Display:

6.1. Display of Prohibition: Every vendor licensed/registered to sell tobacco products shall prominently display a board/notice stating the following:

• "SALE OF LOOSE CIGARETTES AND BEEDIES IS STRICTLY

PROHIBITED (अके ली सिगरे ट/बीड़ी बेचना स(cid:834)त मना है)"

• "SALE OF TOBACCO PRODUCTS TO PERSONS UNDER 18

YEARS OF AGE IS A PUNISHABLE OFFENCE (तंबाकू उ(cid:523)ादों  की  बि(cid:354)ी

18 वष(cid:330) से कम उ(cid:370) के  (cid:681)(cid:304)(cid:389)यों को दंडनीय अपराध है)"

The enquiry of the application filed by the applicant was conducted through field revenue agencies and after receiving report from the field revenue agencies, it has been observed that the applicant's correct name is Saran Dass s/o Bhima but the name of the applicant is recorded in revenue reocord is Ram Saran s/o Bhima.

Now, therefore, in pursuance of section 38 of H.P. Land Revenue Act, 1954, proclamation is hereby issued to all General public concerned that objection in this regard for the correction of the name of Ram Saran s/o Bhima shall be heard by the undersigned on 16-03-2026 in this court at Raja Ka Talab. Any person having any objection to make in the matter may due so on the said date and place in person or through legal practitioner or through recognised agent. धर्म पाल पुत्र श्रीमती चानू देवी, निवासी गांव व डाकघर बनास, डाकघर धार, तहसील रामपुर, जिला शिमला (हि0प्र0) ने इस कार्यालय में अनुसूचित जाति प्रमाण-पत्र जारी करने बारे दरख्वास्त इस कार्यालय में प्रस्तुत कर निवेदन किया है कि वादी की माता श्रीमती चानू देवी पुत्री जलसु बचपन से ही गूंगी व बहरी है व दिमागी तौर पर विकलांग है और उससे प्रार्थी धर्म पाल को जन्म दिया है। वादी ने अपनी माता की जाति के आधार पर जन्म जाति प्रमाण-पत्र जारी करने बारे आवेदन इस कार्यालय में प्रस्तुत किया है।

विषय उपरोक्त में आवेदन मौका छानबीन हेतु क्षेत्रीय कानूनगो झाखड़ी को भेजी गई। मुताबिक मौका रिपोर्ट क्षेत्रीय कानूनगो के पाया कि प्रार्थी धर्म पाल की माता श्रीमती चानू देवी पुत्री जलसु ने कोई शादी नहीं की है क्योंकि वह बचपन से ही गूंगी तथा बहरी है और प्रार्थी धर्म पाल को जन्म दिया है, लेकिन यह पता नहीं है कि उसका पिता कौन है तथा किस जाति से सम्बंध रखता था। वादी की माता स्वयं कोली जाति से सम्बंध रखती है जो उप-मोहाल सरपारा के माल कागजात खजरा नसल में दर्ज है।

मुताबिक नस्ब क्यान वाशिन्दगान देह तथा उप-प्रधान ग्राम पंचायत सरपारा के ब्यानानुसार पाया कि श्रीमती चानू देवी पुत्री जलसू, गांव बनास कंधार की रहने वाली है जिसने ताहाल कोई शादी नहीं की है। 11656 राजपत्र, हिमाचल प्रदेश, 19 फरवरी, 2026/30 माघ, 1947 श्रीमती चानू देवी ने लगभग 40-42 वर्ष पहले प्रार्थी धर्म पाल को जन्म दिया है जिसके पिता का कोई पता नहीं है कि कौन था और किस जाति से सम्बंध रखता था क्योंकि वास्तव में चानू देवी बचपन से गूंगी तथा बहरी है। श्रीमती चानू देवी पुत्री जलसू का नाम नकल परिवार रजिस्टर में धर्म पाल पुत्र चानू देवी के साथ दर्ज है और प्रार्थी की जाति दुरुस्त करने बारे सिफारिश की गई है और ग्राम पंचायत सरपारा के नकल प्रस्ताव संख्या 8 दिनांक 10-07-2025 की प्रस्ताव मूल प्रति भी संलग्न है जिसमें ग्राम पंचायत सरपारा ने प्रार्थी को अनुसूचित जाति का प्रमाण-पत्र जारी करने बारे किसी को कोई भी एतराज नहीं है।

इस संदर्भ में इस कार्यालय के पत्र संख्या रामपुर/तहसीलदार/2024-575, दिनांक 18-03-2025 को जाति बारे प्रमाण रिपोर्ट उपमण्डलाधिकारी (ना0) रामपुर को भेजी गई जिसके एवज में उपमण्डलाधिकारी (ना0) रामपुर के कार्यालय पत्र संख्या आर.एम.पी./रीडर (विविध) 2025-741, दिनांक 20-03-2025 को निर्देश जारी करते हुए यह स्पष्ट किया है कि भारत सरकार के सामाजिक न्याय एवं अधिकारिता मंत्रालय द्वारा जारी परिपत्र दिनांक 3 अक्तूबर, 2019 के अनुसार जिसमें अलग रहने वाली, तकालशुदा या अकेली माताओं से पैदा हुए बच्चों की जाति की स्थिति के बारे में बताया गया है। यह परिपत्र स्पष्ट करता है कि ऐसे मामले में जहां पिता की पहचान अज्ञात है या बच्चे का पालन-पोषण केवल अनुसूचित जाति से संबंधित मां द्वारा किया जाता है, वहां बच्चे को मां की जाति से संबंधित माना जा सकता है। परिपत्र में रमेश भाई नायका बनाम गुजरात राज्य और अन्य [(2012) 3 एस.सी.सी. 400)] में सुप्रीम कोर्ट के फैसले का संदर्भ दिया गया है। परिपत्र में निर्धारित दिशा-निर्देशों के अनुसार अगर पिता अज्ञात है और मां अनुसूचित जाति से संबंधित है तो बच्चा अनुसूचित जाति का दर्जा प्राप्त करने का दावा कर सकता है।

अतः इश्तहार द्वारा सर्वसाधारण व सम्बन्धित रिश्तेदारों को सूचित किया जाता है कि किसी को यदि धर्म पाल पुत्र श्रीमती चानू देवी, निवासी गांव व डाकघर बनास, डाकघर धार, तहसील रामपुर, जिला शिमला (हि0प्र0) के परिवारजनों को अनुसूचित जाति प्रमाण-पत्र जारी करने बारे कोई उजर/एतराज हो तो वह आगमी तारीख पेशी दिनांक 20-02-2026 को असालतन/वकालतन हाजिर होकर अपना उजर/एतराज प्रस्तुत कर सकता है। इसके उपरान्त कोई भी उजर/एतराज काबिले समायत न होगा तथा नियमानुसार जाति प्रमाण-पत्र जारी करने बारे आदेश पारित किए जाएंगे।

In supersession of this department's advertisement No. 01/2026 dated 12-01-2026 to fill up the posts of State Chief Information Commissioner and State Information Commissioner in Himachal Pradesh State Information Commission, fresh applications are invited from citizen of India for selection/appointment to the posts of State Chief Information Commissioner and State Information Commissioner in Himachal Pradesh State Information Commission, under the provisions contained in Section 15 (5) & (6) of the Right to Information Act, 2005, due to policy decision of shifting the office of Himachal Pradesh State Information Commission from Shimla to Kangra at Dharamshala.
