No. H (1)-1/2012.—The Himachal Pradesh Electricity Regulatory Commission, in exercise of the powers conferred under clauses (r) and (s) of sub-section (2) of Section 181 and sub-sections 255-राजपत्र/2025-20-02-2026 (11675)11676 राजपत्र, हिमाचल प्रदेश, 20 फरवरी, 2026/01 फाल्गुन, 1947 (5) to (8) of Section 42 of the Electricity Act, 2003 (36 of 2003), read with Section 21 of the general clauses Act, 1897 (Act No.10 of 1897), and all other powers enabling it in this behalf and after previous publication, hereby makes the following Regulations further to amend the Himachal Pradesh Electricity Regulatory Commission (Consumer Grievances Redressal Forum and Ombudsman) Regulations, 2013, namely:—

1. Short title and commencement.— (1) These Regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Consumer Grievances Redressal Forum and Ombudsman) (Fourth Amendment) Regulations, 2026.

(2) These Regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Regulation 7.— In Regulation 7 of the Himachal Pradesh Electricity Regulatory Commission (Consumer Grievances Redressal Forum and Ombudsman) Regulations, 2013, in sub-regulation (1), in clause (ii), for sub-clause (a), the following sub-clause shall be substituted, namely:—

"(a) who are retired officers of the Central or State Government or its Undertakings having minimum service experience of ten years as such and are familiar with the consumer affairs, power sector or regulatory affairs; or".

No.NP/JBL-2025-1652.—Whereas the Nagar Panchayat Jubbal drafted the "Nagar Panchayat Jubbal (Registration and Control of Pet Dogs) Bye-Laws 2025" were published in the Hindi Divya Himachal and Himachal Dastak, under Section 217 read with Section 202 of the Himachal Pradesh Municipal Act, 1994.

And whereas, no objections were received from any quarter within the specific period of fifteen days from the date of publication of these draft bye-laws .

In exercise of the powers conferred by Section 202(t) under Chapter XI of the Himachal Pradesh Municipal Act, 1994, the following Bye-laws are hereby made by the Nagar Panchayat Jubbal for regulating /framing of " The Jubbal Nagar Panchayat (Registration and Control of Pet Dogs) Bye-Laws 2025".

1. Short title and Commencement.—

(i) These Bye-laws may be called "The Nagar Panchayat Jubbal (Registration and Control of Pet Dogs) Bye-laws, 2025."11677 राजपत्र, हिमाचल प्रदेश, 20 फरवरी, 2026/01 फाल्गुन, 1947 (ii) These shall come into force from the date of their publication in the official gazette of Himachal Pradesh.

2. Definitions- ln these bye-laws, unless the context otherwise requires.—

i. "Act" means the Himachal Pradesh Municipal Council A c t , 1994, [section 202(t)].

ii. "Section" means the section of the Act

iii. "Family" means the owner, his/her parents, spouse, sons, daughters, brothers and sisters living in one premises.

iv. "Owner" means the person who owns a registered/ unregistered dog and includes a person in whose custody, charge or possession a dog is found.

v. "Pet Dog" means a male or female dog kept by a person within the area of Nagar Panchayat Jubbal and other than stray dogs.

vi. "Registration Authority" means any officers appointed by the Secretary, Nagar Panchayat Jubbal.

vii. The words and expressions not defined in these bye-laws shall have the same meaning as assigned to them in the HP Municipal Council Act, 1994.

3. Procedure for Registration of Dogs.—

On and from the date of publication of these bye-laws, registration of Pet Dog(s) (hereinafter mentioned as dog) above the age of three months, kept within the jurisdiction of Nagar Panchayat, Jubbal shall be compulsory. The owner of Dog, on or before the first day of April of every year or within seven days of its arrival, register such dog in a Form as prescribed by the Nagar Panchayat Jubbal (Annexure – A) accompanied by a fee of Rs. 250 per dog as one time registration fees alongwith two recent photographs of the dog and a copy of vaccination certificate from a Government Veterinary Practitioner or Veterinary Practitioner duly registered with Indian Veterinary Council (IVC)or State Veterinary Council (SVC). Further, an amount of Rs. 500 per dog shall be charged as license fees annually. However, a blind person keeping dog and using solely for his/her guidance shall be exempted from the payment of registration fee. On registration, the Registration Authority shall issue a metal token to be attached with the collar to be worn by the dog and in case of loss or destruction of the token; a duplicate token shall be issued to the owner on submission of an application alongwith a fee of Rs. 500 per token. The registration once made shall remain valid for full lifespan of the dog. In case of death of the dog, the owner of the dog shall immediately inform the Registration Authority. A family may keep maximum of two dogs.

1. Any registered dog found straying at large shall be liable to be seized and kept at

a place set for this purpose.

2. Duties and responsibilities of the owners.—

(i) The owner of the pet dog shall be responsible for the controlled breeding, immunization, neutering and licensing in accordance with the provisions of these Bye-Laws.

(ii) Any dog not wearing metal ticket or registration in accordance with clause 3 of these Bye-laws may, if found in any public place be removed and will be liable to be dealt under the orders of the Veterinary Public Health Officer, Nagar Panchayat Jubbal, if not claimed within 7 days by the owner.

(iii) For the purpose of these bye-laws any person in possession or in charge of the dog, during the absence of the real owner within the limits of Nagar Panchayat Jubbal, shall be deemed to be the owner of the dog.

(iv) It shall be mandatory for each owner to carry disposable bags during the time when the dog is put on NP streets.

(v) The owner of the dog shall not allow the dog to defecate in public places such as residential areas, green belts, parks, streets, roads, road beams and other common places etc. In case the dog defecates at the above specified places, the owner shall arrange to get the excreta of the dog removed from the said place at his own level. No owner shall allow the dog to defecate near the residences of other persons, his/her neighbors to his/her/their annoyance

3. The owner of the registered dog shall keep the dog under his/her control at all times so that it does not intimidate, annoy, hurt or bite any person. The Nagar Panchayat Jubbal shall not be held responsible for any loss, damage or injury caused by a registered dog to any person or to his/her property and sole liability to compensate the victim will remain with the owner of the registered dog.

4. Guideline for breeders.—

(i) A breeder must be registered with Nagar Panchayat Jubbal. Breeder must maintain full record of the number of pups born/ died from individual bitches. He shall also maintain proper record of pedigree and vaccination.

(ii) Breeder must maintain record of the person buying the pups. He should ensure that the buyer has required knowledge for the upkeep of pups.

(iii) Breeder must pay Rs. 1000/-as one time registration charges in the treasury of the Nagar Panchayat Jubbal besides Rs. 250/- per dog as annual fees every year. This fee to be paid by the breeding shall be over and above the registration fee / annual license fee provided in 3 above.

5. Guideline for Dog Care Centre.—

(i) A dog care centre must be registered with Nagar Panchayat Jubbal. Owner of dog care centre must maintain full record of the number of dogs. He shall also maintain proper record of pedigree and vaccination.

(ii) No dog care centre is allowed insiders identical houses and flats

(iii) Owner of dog care centre must pay Rs.1000/-as one time registration charges in the treasury of the Nagar Panchayat Jubbal besides Rs. 250/- license fee every year.

(iv) Owner of dog care centre must obtain no objection certificate from the concerned ward councilor.

(v) Permission to operate dog care centre shall be subject to approval of Nagar Panchayat Jubbal .

6. The owner of the registered dog shall ensure proper space, accommodation, food and medical treatment to the dog.

7. The Registration Authority or an officer/official authorize by him shall keep the details of all the seized dogs duly entered in a register with a brief description of the dog, date of seizure, reasons of seizure and the manner in which it is disposed of.

8. The dog after its death shall not be thrown in the open or in the garbage bins of Nagar Panchayat Jubbal. Dead dog shall be buried at notified/earmarked places up to a depth of at least 3 ft. in a hygienic manner. The Nagar Panchayat Jubbal may provide a van for the disposal/burial of dead dogs in the earmarked dog burial grounds on the request so received by it. The owner shall pay charges for availing the services of the van at the rates prescribed by the Commissioner, Municipal Council and so revised from time to time.

9. The Registration Authority or a Veterinarian, Health Supervisor, Chief Sanitary Inspector, Sanitary Inspector or any other officer of the Nagar Panchayat Jubbal authorized by the Registration Authority, may inspect the premises of the owner of any dog and such owner shall allow that person to enter and inspect his/her premises at all reasonable times. Such officer/official shall also be authorized to search the places where dogs are kept without registration and to seize them.

10. Penalty.—

(i) Any contravention of these Bye-Laws including the failure to register the dog, failure to follow guidelines for breeders, guidelines for dog care centre as per clause 3, 7, 8 above, shall be punishable with fine which may extend to Rs. 5,000/- and in case of continuous breach additional fine which may extend to Rs. 100/- per day till such contravention or breach continues shall be imposed.

Note:- Citizens cannot adopt and breeders or suppliers cannot sell any breed of dogs which is

banned by Govt. of India and State Government.

In case of banned breeds, penalty of Rs. 5000/- and any injury or damage done by such pet

animals will be the liability of pet owner.

Annexure-B

Undertaking from the owner of the Dog for registration

1. I do not have more than two dogs

2. I shall keep the dog protected by getting it vaccinated against rabies from a Govt. Veterinary Practitioner or Veterinary Practitioner duly registered with Indian Veterinary Council (IVC) or State Veterinary Council (SVC).

3. I will furnish the vaccination certificate on demand during Inspection by Registration11681 राजपत्र, हिमाचल प्रदेश, 20 फरवरी, 2026/01 फाल्गुन, 1947 Authority or any officer/official of the Nagar Panchayat Jubbal duly authorized by the Registration Authority or within a period of 10 days from such Inspection, failing which registration of the dog may be cancelled.

4. I will keep the dog chained/leashed while taking it outside. All ferocious dogs shall be duly muzzled and a stick shall be carried by the Escort accompanying the dog while taking it out.

5. I will ensure that the dog will wear a collar affixed with the metal token issued by the Registration Authority at all the times.

6. I will compensate the person if a dog bites or causes/harm to any person or to the property of any person.

7. I shall keep the dog under my control all the times, so that it does not intimidate, annoy, hurt or bite any person. I shall not make Nagar Panchayat Jubbal responsible for any loss, damage or Injury caused by a registered dog to any person or to his/her property and sole liability to compensate the victim will remain with me.

8. I shall not indulge in breeding of dogs for commercial purposes and trading of dogs within the area of Nagar Panchayat Jubbal. In case it is found that dog is being kept for breeding or trading/commercial purposes by me, the Registration Authority shall impound my dog/s besides imposing a fine as fixed by the Secretary Nagar Panchayat Jubbal upon me.

9. I shall not allow the dog to defecate in public places such as residential areas, green belts, parks, streets, roads, road beams and other common places etc. In case the dog defecates at the above specified places, I shall arrange to get the excreta of the dog removed from the said place at my own level. I shall not allow the dog to defecate near the residences of other persons, neighbors to their annoyance.

In exercise of the powers conferred under Section 125,126,127, 128 read with Section 202 and 214 of the Himachal Pradesh Municipal Act, 1994, the following Bye-laws are hereby made by the Nagar Panchayat Jubbal for regulating /framing of "The Jubbal Nagar Panchayat (Grant of Trade License for Trade Activities, Use of Premises and Storage of Articles in Premises) Bye-laws 2025.

1. Short title, Extent and Commencement:

i. These Bye-laws may be called the Nagar Panchayat Jubbal, (Grant of Trade License for Trade Activities, Use of Premises and Storage of Articles in Premises) Bye-laws 2025.

ii. These Bye-Laws shall come into force from the date of their publication in the Official Gazette.

iii. These Byelaws shall apply to all shops/premises falling within the NP limits which may not be used without license for the purpose specified in Section 125,126,127, 128 read with section 202 and 214 of the Himachal Pradesh Municipal Act, 1994 as per Annexure I and for storage of any Article, and performing of any trade within NP limits as per the Trade Types specified in these bye-laws at Annexure I.

2. Definitions:

In these Bye-laws, unless the context otherwise requires:—

a. "Act" means the Himachal Pradesh Municipal Act, 1994, (Act No 12 of 1994) b. "Authorized Officer" means Secretary or any other Officer specifically authorized by the Secretary.

c. Urban Local Body (ULB): An Urban Local Body (ULB) is an administrative unit in urban areas, responsible for governance, management, and development which in this case is Nagar Panchayat Jubbal (NPJ henceforth).

d. "Inspector" means Sanitary Inspector, or any other Official of the Nagar Panchayat Jubbal duly authorized by the Secretary.

e. "License" means a written permission granted by the Secretary or any other official /Officer duly authorized by the Secretary in favor of the person, owner & occupier for sale/storage of articles and Trade Types specified in Annexure I, and zones as per Annexure II of these Bye-laws.

f. "Licensing Officer" means Secretary, or any other officer duly authorized by the Secretary to grant/ renew License under the provisions of these Bye-laws.

g. "premises", means any shop/store/place where the articles specified in Annexure I are kept for sale/storage in the godown/ premises and or where the trade activities as specified under Annexure I are performed.

h. "Small Scale Business/Trade" means premises covering a maximum area of 150 sq.ft. "Medium Scale Business/Trade" means premises covering area of 151 Sq.ft. to 500 sq. ft. and "large Scale Business/Trade" means premises covering area of more than 500 Sq.ft.

i. "Small Shop" A shop covering an area upto 64 square ft. shall be deemed to be a small shop.

j. "Medium Shop" A shop covering an area more than 65 sq ft. and upto 250 square ft. shall be deemed to be a medium shop.

k. "Large Shop" A shop covering an area more than 250 square ft. shall be deemed to be a large shop.

l. "Temporary Trade License" This license is issued for a brief period ranging from 1 to 30 days. It is applicable exclusively to trade activities conducted from temporary or makeshift shops or stalls at approved fairs, events, etc. It is mandatory for the fair organizer/ temporary shop or stall owner to get the individual temporary trade license as per the terms defined in this bye-law.

m. "Zone" Functional boundary of the ULB, area designated for specific types of trade activities.

n. "Superstore" typically refers to a large retail establishment that sells a wide variety of goods.

o. "E-commerce: Electronic commerce refers to the buying and selling of goods and services over the internet. It encompasses a wide range of online business activities for products and services.

p. "Cloud Kitchen" A cloud kitchen, also known as a virtual kitchen, is a type of commercial kitchen space dedicated solely to preparing food for delivery and takeout.

q. "NP Services" include but not limited to Garbage Collection, Property Tax, Electricity supply, Water supply, and Sewerage connection, provided under the jurisdiction of the Nagar Panchayat which can be regulated by separate authorities.

r. "Shopkeeper" means any person running and managing the affairs of the shop/premises/place including its owner/occupier.

s. The words and expression not defined under these Bye-laws shall have the same meaning or sense as are defined in Himachal Pradesh Municipal Act, 1994.

3. Procedure for Obtaining License:

a. Any person who wants to operate/run any business/trade as specified in Annexure I and/ or store any article as specified in Annexure I within the areas of the Nagar Panchayat and as per zone definitions in Annexure II shall apply for license on prescribed Format to Secretary of the concerned Nagar Panchayat.

b. Period of License: The License shall be issued for a period of 1 year, 5 Years, 10 years & maximum up to 15 years at a time and the License shall automatically come to an end after completion of such period.

4. Renewal of License:

i. The license will be automatically renewed upon expiration once the applicant deposits the required fee. It can be renewed without any late fee or additional11686 राजपत्र, हिमाचल प्रदेश, 20 फरवरी, 2026/01 फाल्गुन, 1947 documentation within one month after expiration. If renewed within the following month (2nd Month of Expiry), a 25% penalty will apply. Beyond this period, the license cannot be renewed, and a new trade license must be applied.

ii. No document is required to be submitted for renewal of License

5. Transfer of License:

i. The license issued under the Bye-laws shall not be transferred in the name of any person except in case of the death of original licensee wherein it shall be made/ transferred in the name of the legal heirs only for the validity period of license on production of supporting documents and shall be decided by Secretary keeping in view the circumstances of the case.

ii. Transfer of Trade License fees will be charged as per prescribed fees decided by the ULB.

6. Closure of License:

The license issued under the Bye-laws can be requested for closure in case of winding up of the business. The licensee shall provide information as per prescribed guidelines to the Secretary for winding up of his business. Closure of Trade License fees will be charged as per prescribed fees, decided by the ULB.

7. Modification of License:

The license issued under the Bye-laws can be requested for modification in the following heads only.

i. In-case of Change of Mobile Number (Trade Owner)

ii. In-case of Change and or Addition in Subcategory or Trade under the preselected sector as per Annexure I. (Note: Sector cannot be Modified, Multiple licenses will have to be applied for, multiple sectors).

iii. In-case of Change of Business/ Trade Address (Modification of trade address is only allowed in case the address is being changed within the same ward of the ULB.) Modification of Trade License fees will be charged as per prescribed fees, decided by the ULB.

8. License Fees:

The license fee for grant of license shall be decided by the Nagar Panchayat from time to time. The fee shall be charged in the following manner:—

9. Temporary Trade Licenses:

i. Temporary Trade Licenses are applicable only in case of fairs, festivals, and other such events within the ULB, for a period of 1 day to 30 days only.

ii. These licenses are specifically issued for temporary or makeshift shops or stalls at fairs and similar events.

11. Conditions for Grant of License:

i. Trade registration with the Labour & Employment Department, Government of Himachal Pradesh, is a mandatory prerequisite for applying for a Trade License from Urban Local Bodies (ULBs).

for which it is granted under these Bye-Laws.

iii. The permission shall, unless specified otherwise in the license, be valid in the entire NP limits, subject to such conditions as may be imposed by the Secretary.

iv. The owner /occupier of the premises shall have to produce the license before the Inspector or the licensing officer at any point of time as may be ordered by them.

v. The Secretary shall have a right to impose or alter any of conditions in the license as may be deemed fit by him/her under the provisions of Section 214 of the Himachal Pradesh Municipal Act, 1994.

vi. Additional Permissions for any article/ trade mentioned in annexure I may be

added by the Secretary as and when deemed necessary.

vii. The applicant shall submit a self-declaration regarding information submitted by him / her about the premises to be used for business/ trade viz. type of business, area, approval of map and nature of property i.e. commercial and domestic etc. to be true to the best of his knowledge and belief.

viii. The licensee shall maintain proper record of the articles kept for sale or storage and trade activities being performed in the premises as may be required by the Licensing Officer. Further the licensee shall comply with all the directions and instructions issued to him by the Secretary or the Licensing Officer from time to time.

ix. The licensee will ensure timely payment of NP dues

x. Time period for issue of License: The license shall be issued as per the timelines notified/specified for this service under Public Service Guarantee Act, 2011.

xi. Subject to these Bye-laws, license to any person, who applies online to the Secretary or Licensing Officer in this behalf and tenders the prescribed fee shall be granted by that officer, unless for reasons to be recorded in writing by him.

xii. The Licensee shall be liable to pay transfer, modification, closure charges as

prescribed by ULB per license at the time of effecting transfer of License,

modification of license, closure of license.

xiii. The licensee shall abide by the terms and conditions of the license and the license shall be displayed at the convenient/ conspicuous place /reception of the premises.

xiv. The Inspector or inspecting staff concerned shall have a right to enter and inspect the premises and the licensee shall provide necessary assistance to the inspecting staff at the time of inspection of licensed premises.

xv. The licensee shall not make any encroachment/ overhanging projection on public streets and NP drains in any manner.

12. Denials of License:

1. The license shall not be granted:—

i. to a person suffering from any loathsome infections or contagious diseases ii. to a person convicted for unlawful sale or storage of any articles mentioned in Section 125,126,127, 128 read with section 202 and 214 of the Himachal Pradesh Municipal Act, 199411689 राजपत्र, हिमाचल प्रदेश, 20 फरवरी, 2026/01 फाल्गुन, 1947 iii. to a person who has been found to have habitually committed the breach of these Bye- Laws or the terms of the license.

iv. to a person not below the age of 18 years

v. To a person involved in any unlawful activity as decided by the Municipality 13. Offenses and Penalties:

i. In addition to the penalty as provided under Himachal Pradesh Municipal

Act, 1994 any person in possession of the premises found violating any of the

provisions of these Bye-laws shall in the first instance be liable for a penalty

of Rs. 1000/- only and suspension of license for a period of one month and for

repetition of the same violation within three months be liable for penalty of

Rs. 5000/- only and permanent Cancellation/withdrawal of license.

ii. If the information submitted by the applicant under self-declaration is found to be false, he/she shall be liable for the penalty of ten times of the license fee and his/ her license will be cancelled.

iii. In case of repeated violations, the concerned person, owner, or occupier, as the case shall be liable for cancellation/withdrawal of License which can only be restored on receiving written undertaking accompanied by surety from the person violating these Bye-laws subject to the satisfaction of the Secretary.

14. Penalization for Default on NP Services:

In the interest of maintaining compliance and to ensure the seamless provision of NP services, the Nagar Panchayat hereby enacts the following:—

1. Interlinked Service Compliance:

All NP Services, including but not limited to Garbage Collection, Property Tax, Electricity, Water, and Sewerage, provided under the jurisdiction of the Nagar Panchayat and regulated by separate authorities, shall be interlinked for compliance purposes.

2. Cross- Service Penalization:

Any resident or entity found to be in violation of the regulations pertaining to any one of the NP services shall be subject to cross-NP service penalization. This includes but is not limited to:—

i. Suspension or limitation of other NP services

ii. Imposition of additional fines and penalties across all utilities

iii. Notification and reporting of violations across regulatory authorities for coordinated enforcement.

3. Repercussions for Trade License service:

NP Service Defaulters will not be allowed to apply/ renew/ modify/ close trade licenses till the violation is resolved.

Prior to the enforcement of cross-NP penalties, the affected party shall receive a written notice detailing the nature of the violation, the affected services, and the penalties to be imposed.

The affected party shall have the right to appeal against the penalization within a stipulated period as prescribed by the Nagar Panchayat.

5. Inter-Authority Coordination:

Regulatory authorities governing each NP service shall establish a coordination mechanism to ensure the efficient and timely exchange of information regarding violations and enforcement actions.

Regular meetings shall be held between regulatory authorities to review compliance status and address issues related to cross-NP service penalization.

6. Zone Categorization:

Nagar Panchayat should consider categorizing trade license fees within their jurisdiction based on the zone in which the trading unit is located.

These Byelaws shall come into effect immediately upon its inclusion in the Nagar Panchayat

Byelaws. The Municipality shall periodically review and update the cross-NP penalization

framework to address emerging challenges and ensure fair and effective enforcement.

No.NP/JBL-2025-1653.—Whereas the Nagar Panchayat Jubbal drafted the Nagar Panchayat Jubbal Outdoor Advertisement Bye-laws 2025 were published in the Hindi Divya Himachal and Himachal Dastak, under section 217 read with Section 202 of the Himachal Pradesh Municipal Act, 1994.

And whereas, no objections were received from any quarter within the specific period of fifteen days from the date of publication of these draft bye-laws.

In exercise of the powers conferred by Section 202(o) under chapter XI of the Himachal Pradesh Municipal Act, 1994, the following Byelaws are hereby made by the Nagar Panchayat Jubbal for regulating /framing of "Nagar Panchayat Jubbal Outdoor Advertisement Bye-laws 2025.

Advertisement Bye–Laws – Nagar Panchayat Jubbal

1. Title & Contents.—(i) These Bye-laws may be called the Nagar Panchayat Jubbal Outdoor Advertisement Bye-laws 2025.

(ii) These Bye-laws shall come into force with immediate effect within the limits of Nagar Panchayat Jubbal after the notification by the Government of Himachal Pradesh in the official gazette.

2. Definitions: In these byelaws unless the context otherwise requires:—

i. "Act" means Himachal Pradesh Municipal Act, 1994

ii. "panchayat" means Nagar Panchayat Jubbal (Jubbal henceforth)

iii. "Advertisement" shall mean any work, letter, model, sign, device, digital display, electronic display, name boards, direction boards, laser show, kiosk, LED, LCD, Backlit Board, Neon display, or representation supported on or attached to any post, pole, standard framework or other support wholly or in part upon or over any Private/ Public/State Govt./Central Govt./ public Sector undertaking/ Govt. Companies/ Govt. Authorities etc., land/Spaces, building or structure which or any part of which shall be visible against the sky from some point in any street/Road includes all and every part of any such post, pole, parapet, standard framework or other support. It shall also include any balloon parachute or other similar employed wholly or in part for the purpose of any advertisement announcement or direction upon or over any land/spaces, building or upon or over any street. However, any display in the form of graffiti and civic messages published by urban local body or any Government authorities (Having no commercial explanation) for the benefit of the citizen shall not be considered as an advertisement.

iv. Advertisement on vehicle (movable) means single, double or multiple advertisement board affixed by means of sticker/boards on vehicle, side panel or behind a vehicle in a manner that advertisement draw visibility while the vehicle is driven on the road. However, care must be taken to ensure that this does not impede traffic as well as pedestrians.

v. Advertisement on vehicle (Parked) means single, double or multiple advertisement board affixed by means of sticker/boards on vehicle, side panel or behind a vehicle in a manner that advertisement draw visibility when vehicle is parked at strategic location. However, care must be taken to ensure that this does not impede traffic as well as pedestrians.

vi. "Advertisement Regulation Committee" means Committee consisting of (a) Secretary Nagar Panchayat Jubbal (b) One Municipal councillors nominated by the General House of NP Jubbal (c) Municipal Engineer(AE or JE) Nagar Panchayat Jubbal (d) Sanitary supervisor, Nagar Panchayat Jubbal (e) Assistant Engineer PWD Jubbal (f) Branch in charge Advertisement, Nagar Panchayat Jubbal(g) Representative of concerned Highway Authority.

vii. "Advertisement Zoning Plan" means the numbered plan signed by the Secretary and kept in this office defining the areas of special control and restrictions regarding the advertisement applicable to such areas.

ix. "Enclosed Land" shall mean the land which is wholly or for the most part enclosed within the hedge fence, wall or similar screen or structure and shall not include any railway station together with the yards and for Court thereof, whether enclosed or not, any public park, public garden or other land held for the use or enjoyment of the public.

x. "Illuminated advertisement" shall mean any advertisement with self-luminous by an outside source of light, but not include an illuminated display of goods if such display:—

a. Is of goods merely bearing labels showing the name of article of its manufacturer or of other; and

b. Is made by lighting which is not, in the opinion of the Secretary more than which is necessary to make the goods labels visible at night.

xi. "Name Plate" shall mean an advertisement announcing the name of owner and or name of occupier of a building and/or name of a building upon which such advertisement is fixed, exhibited painted, pasted retained or displayed, provided that the size of the letters constituting such advertisement does not exceed 2" in height and the total area does not exceed 4 square feet.

xii. "Structure" shall include a post, pole, tree, bridge, embank and road surface and also a tram car, omnibus and any other vehicle any movable, board used primarily as an advertisement or advertising medium.

xiii. "Schedule" means the schedule indicating the rate/fees for advertisements 3. (A) Regulation and control of advertisement.—No advertisement shall be erected, exhibited, fixed or retained upon or over any land, building, wall, boarding, frame, post or structure or place within the City without the written permission of the Secretary granted in accordance with bye-laws made under this Act. Provided that no permission shall be required for any advertisement, which.—

a. Appears in newspapers, relates to public meeting, or to an election to Parliament or Legislative Assembly or the Council or to candidature in respect of such election; or

b. is exhibited within the window of and building if the advertisement relates to the trade, profession or business carried on in that building; or

c. relates to the trade profession or business carried on within the land or building upon or over which such advertisement is exhibited or to any sale or letting of11696 राजपत्र, हिमाचल प्रदेश, 20 फरवरी, 2026/01 फाल्गुन, 1947 such land or building or any effects therein or to any sale entertainment or meeting to be held on or upon or in the same; or

d. relates to the name of the land or building upon or over which the advertisement is exhibited, or the name of the owner or occupier of such land or building; or e. Relates to any activity of the Government or Union of India or the Municipal Council.

3 (B) Prohibition of Sticking, fixing hanging or painting bills, posters, advertisement, notices etc.—(i). Hoardings, advertisement/ banners will not be allowed in the National/ State highway and other scheduled road and footpath as they cause traffic hazard and are against the instructions of the Govt. of India and Hon'ble Court.

ii. No Hoarding, advertisements should be put at the place which effects or endangers the growth of flora and fauna.

iii. No hoarding, advertisement should be located in thickly wooded area and no any kind of hoarding should be placed on trees.

iv. No hoarding, advertisement should exceed dimension size of 16 Sq. Meters v. No hoarding, advertisement, banners should be put up in contravention of any law & rules against the guidelines notified by any department.

vi. No hoarding, advertisement should locate near a water source

vii. No hoarding, advertisement should be in the form of writing, engraving, nailing and carving on any Natural or in animate object.

viii. No hoarding, advertisement, banner will be allowed on the roofs of buildings, except with the permission of Secretary NP Jubbal.

ix. Only sign board of premises are allowed up to 3 Sq. m. between slab and lintel of the building to the occupier/ owner.

x. Directional sign to Govt. offices, religious places will be allowed by the Nagar Panchayat, The type, size and location of these shall be also approved by the Nagar Panchayat, The Nagar Panchayat Jubbal has to keep in view requisite site clearness, so that there is no traffic hazard due to installation of such board.

xi. The Nagar Panchayat shall provide notice board for the purpose of sticking, fixing or hanging posters, notice and advertisement, which shall be available for use on11697 राजपत्र, हिमाचल प्रदेश, 20 फरवरी, 2026/01 फाल्गुन, 1947 an application to be made to the Secretary on payment of fee provided for in these bye-laws.

xii. No hoarding, advertisement should be located/ positioned on a sharp turn, "U" turn and blind turns.

xiii. The beauty of nature for matters such as hills, rivers, trees and rock should not be destroyed by indiscriminate installation of commercial advertisement.

xiv. No writing/ defacing of retaining wall sand parapets could be allowed

4. Outdoor advertisement and road safety criteria

An advertisement device may be considered a traffic hazard:—

a. If it interferes with road safety or traffic efficiency;

b. If it interferes with the effectiveness of a traffic control device (e.g. traffic light, stop or give way sign);

c. Distracts a driver at a critical time (e.g. making a decision at an intersection);

d. Obscures a driver's view of a road hazard (e.g. at corners or bends on the road);

e. Gives instructions to traffic to "Stop", "halt" or other (e.g. give way or merge);

f. Imitates a traffic control device;

g. Is a dangerous obstruction to road or other infrastructure, traffic, pedestrians, cyclists or other road users;

h. Is in an area where there are several devices and the cumulative effect of those devices may be potentially hazardous;

i. If situated at locations where the demands on driver's concentration due to road conditions are high such as at major intersections or merging and diverging lanes; and

j. Name of advertisement agencies should be mentioned on every hoarding board 5. Control of the physical characteristics of advertising devices shall be as follows:—

a. Advertising shall not contain flashing red, blue or amber point light sources which when viewed from the road, could give the appearance of an emergency service or other special purpose vehicle warning lights.

Advertising Device and its immediate surroundings.

c. External illumination sources shall be shielded to ensure that external 'spot' light sources are not directed at approaching motorists.

d. Illumination of advertising device is to be concealed or be integral part of it e. Upward pointing light of the device shall not be allowed, any external lighting is to be downward pointing and focused directly on the sign so that glare does not extend beyond the Advertising Device.

f. The average-maintained luminance shall be reduced to 0.5 candelas or all together shut from 11PM till sunrise by automatic timing devices.

g. Non-static illuminated Advertising Devices (flashing lights) are not permitted within the boundaries of municipal roads.

h. Moving, rotating or variable message Advertising Devices are not permitted within the municipal boundaries as these cause a statistically significant distractive influence on motorist's response times to external stimuli.

However, this permission criterion is not intended to apply to variable message displays used by road authorities for traffic management or for displaying other Council's information. Variable message displays located at bus stops or similar places where messages are directed at- and intended for pedestrians (not motorists) are excluded.

6. Outdoor hoarding and their content criteria:—

The Nagar Panchayat authority may take action to modify or remove any Advertising Device that contravenes the following negative advertisements or that otherwise cause a traffic hazard.

List of negative advertisements:—

• Nudity

• Racial advertisements or advertisements propagating caste, community or ethnic differences.

• Advertisement promoting drugs, alcohol, cigarette or tobacco items

• Advertisements propagating exploitation of women or child

• Advertisement having sexual overtone11699 राजपत्र, हिमाचल प्रदेश, 20 फरवरी, 2026/01 फाल्गुन, 1947 • Advertisement depicting cruelty to animals • Advertisement depicting any nation or institution in poor light

• Advertisement casting aspersion of any brand or person

• Advertisement banned by any law enacted by the Government of India • Advertisement glorifying violence

• Advertisement that exploits the national emblem or any part of Constitution of India, or the person or personality of a national leader or a state dignitary.

• Destructive devices and explosives depicting items

• Any psychedelic, laser or moving displays

• Advertisement of Weapons and related items (such as firearms, firearm parts and magazines, ammunition etc.).

• Advertisements which may be defamatory, trade libelous, unlawfully threatening or unlawfully harassing • Advertisements which may be obscene or contain pornography or contain an "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986.

• Advertisement linked directly or indirectly to or include description of items, goods or services that are prohibited under any applicable law for the time being in force, including but not limited to the Drugs and Cosmetics Act, 1940, the Drugs and Magic Remedies (Objectionable Advertisements) Act,1954, the Indian Penal Code, 1860; or

• Any other items considered inappropriate by the municipal bodies.

For all categories of devices (except Category of devices which are directed at pedestrians), text elements on an Advertising Device, face should be easily discernible to travelling motorists. This will minimize driver's distraction. Additionally, a sign shall be quickly and easily interpreted so as to convey the required advertising message to the viewer and reduce the period of distraction. The content or graphic layout exhibited on advertising device panel shall avoid hard-to-read and over lay intricate typefaces and have letter styles that are appropriate. Under no circumstances should device contain information in text sizes which would necessitate the driver or passenger in a moving vehicle to stop, read and/or note down, which detrimental to the smooth flow of traffic and distracting for the driver. All signs shall be so designed as to maintain a proportion where, as a general rule letters should not appear to occupy more than 2% of the sign area unless otherwise permitted by the municipal bodies.

7. Prohibited areas and areas of special control and restrictions thereon:

The Secretary may:—

a. by order prohibit the erection, exhibition, fixation, retention or display of any or any class of advertisements in any street road or public park or park thereof or in any place or public resort;

b. Regulate the erection, exhibition, fixation, retention or display any advertisements, in any manner in the prohibited areas and areas of special control, in accordance with the regulations indicated in the Advertisement Zoning Plans of the said areas.

Explanation:— The restrictions indicated in the advertisement zoning plans shall be in addition to those mentioned in the other clauses of the bye-laws.

8. Classification of advertisement devices:

The categories of the advertisement devices:—

Category 1: Large-format advertisement, mainly fixed on bill boards / uni-poles and bridge.

Category 2: Advertisement mounted on public amenities, like public toilets, NP parking, garbage collection points, Single Poles etc.

Category 3: Fleets, fliers and transport related infrastructure

Category 4: Advertisement devices for self-advertising in commercial areas 9. Outdoor advertising and structure criteria:

• Advertising Device structures including the foundations, for categories 1 and 2 devices, shall be designed and checked for extreme wind conditions, earthquakes, soil bearing capacity etc. and shall comply with relevant Indian structural design standards, codes of practice and Byelaws guidelines. The designs shall be certified by an experienced and practicing structural engineer.

• The supporting structure shall have an on-reflective finish to prevent glare.

The device structure shall be well maintained at all times. It shall be painted in colors that are consistent with, and enhance the surrounding area and will be compliant with the criteria or colors laid out earlier in the Bye-laws.

• Official road furniture such as official signs and delineator guide-posts shall not be used as the supporting structure of an advertising device.

• The name of the Advertising Device license holder should be placed in a conspicuous position on the device.

10. Outdoor advertising devices and electrical connection:

The electrical connections and components in all Advertising Devices shall be in accordance with relevant Indian Standards and designed to ensure there is no safety or traffic risk.

No generator running on diesel / petrol / kerosene or any bio fuel, causing noise, air or water pollution would be allowed for providing power for illumination of any outdoor advertising device.

1. Electricity from renewable energy sources:

To promote conservation of electricity, if the illumination at outdoor advertising devices draws power from alternate renewable resources like solar power, such advertisement devices the license fee/charges will be half of the actual fee.

11. Permissibility of different category of advertising devices:

As per schedule-I

12. Specific conditions:

a. No advertisement /hoarding should be placed in such a way that obstructs the mountain and valley view of Town. If such case is found, the Secretary can impose a penalty as he deems fit not exceeding a sum of twenty thousand rupees and remove the said advertisement.

b. All advertisements outside the business area or the building which houses the business can be erected only after permission from the Council.

13. Limitation for Disposal of Applications:

Every application received as per provision of these byelaws shall be acknowledged and the decision on it shall be taken within 30 working days from the date of receipt. If the decision is not taken within the prescribed period, it will be presumed that the required permission is granted subject to payment of due advertisement tax and license fee of the land use charges, wherever applicable and compliance of other clauses of Bye-laws.

14. Procedure to grant permission:

All advertisements, over the size of 120 sq.feet/11square mtr, permitted over the Nagar panchayat land / building shall be through tenders. The tenders can be of single or more hoardings. The tender shall be invited by a committee to be headed by Secretary or by his representative or in the exceptional circumstances by private experts. The committee shall fix the following minimum things before the tender;

a. Reserve price

b. Location of the site/sites

c. Size of advertisement

d. Past revenue collection11702 राजपत्र, हिमाचल प्रदेश, 20 फरवरी, 2026/01 फाल्गुन, 1947 e. Number of sites f. Period of tender.

The advertisement right shall be given for a period of maximum 1 years or as may be decided by the Nagar Panchayat Jubbal. It shall be terminable at one month notice without assigning any reason. In the event of default of any terms, the same shall be terminable forthwith without any notice. The tender bid will include the advertisement tax and rent for use of Nagar Panchayat Land/Property. However, payment of service tax or any other State/Central tax will be borne by the individual/Second party.

15. Procedure for obtaining permission - For grant of permission in respect of

advertisement of private property:

The application for permission from the Secretary shall be accompanied with the following documents:—

1. Written no objection certificate from the landowner of the person, legally authorized to accord such NOC.

2. Three copies of plan showing the location, norms and size of the advertisement/hoarding etc. and a copy of the advertisement to be displayed.

3. The design and the structure shall be certified by a experienced and practicing Structural Engineer who shall certify the safety aspect from the point of view of its foundations which can bear extreme wind conditions, earthquakes, soil bearing capacity and shall comply with relevant India structural design standards policy and guidelines framed from time to time.

4. NOC. Will not be issued to those who violate these bye-laws

16. Fees on Advertisements:

1. The advertisement fee shall be payable in advance annually / quarterly / monthly basis as the case may be fixed by the Municipality from time to time provided that if the rate of fee is chargeable on annually, quarterly or monthly basis, the fractions thereof shall be construed accordingly.

2. New Advertisement shall not be exhibited unless the advertisement fee in advance as per the condition of sanction is deposited.

3. Full monthly fee shall be chargeable if the advertisement duration is for more than 10 days. A month for this purpose shall be the calendar month-provided that where advertisement are to be displayed for part of a year and the fees fixed in the schedule are for one year, the fees payable part of the year shall be calculated on quarterly basis.

1. Calculation of fees:

The advertisement fees should be calculated on the basis of the following factors:—

a. Category of the advertisement

b. Size of the advertisement

c. Location of the advertisement

The value of the factors shall be decided by the general house of the Nagar Panchayat Jubbal for the first time and future amendments can be done by the Advertisement Regulations committee.

Note:— The Advisement fees upto the size of 120 Sq.ft/ 11 Sqm shall be Rs 300 per sqm for

six months Only.

17. Functions of the Advertisement Regulation Committee:

I. The advertisement Regulation Committee shall identify the area of special control and prepare advertisement/zoning plans indicating the categories of advertisement devices permissible in different areas of Special Control.

II. In case any practical difficulty arises with respect to implementation of these byelaws of the zoning plans, the matter shall be referred to advertisement regulation committee who shall on reference consider and make suitable recommendations to the Secretary for the decision.

18. Penalties:

Whoever contravenes any of these bye-laws shall be punishable with fine of Rupees 500/- for everyday, which may extend upto Ten thousand Rupees, when the contravention is continuing one.

19. Arbitration

If any dispute regarding advertisement holdings arises between Municipal authorities and any other person concerned with such advertisement holdings, such dispute may be referred by both parties to the SDO (c) Jubbal , who shall be sole arbitrator.

20. Jurisdiction:

All disputes shall be subject to the jurisdiction of the Civil Courts at Jubbal only.

A licensee/sign owner/applicant (licensee) shall be required to indemnify the Municipal Authority for the designated Advertising Device and activities against all actions, proceedings, claims, demands, costs, losses, damages and expenses which may be brought against, or made upon the Municipal Authority which arise as a result of the installation or existence of an Advertising Device. Such licensee/sign owners/applicant (licensee) shall always be responsible for any injury or damage caused or suffered by any person or property arising out of or relating to the display of device / advertisement and the consequential claim shall be borne by the advertiser who will also indemnify and safeguard the Municipal Authority in respect of any such claim or claims.

22. Removal of Illegal hoardings:

In case any hoarding are found illegal, the Secretary may order its immediate removal subject to giving seven days prior notice. Removal shall be done by the Council, whose cost shall be borne by the defaulter himself. However, in case any holdings pose danger to the safety of general public requirement of serving seven days prior notice shall be dispensed with.

23. Insurance:

• The Licensee in case of Category 1 and 2 Advertising Devices shall provide a public liability insurance policy for their respective rights, interests and liabilities to third parties in respect of accidental death or bodily injury to person(s) or damage to property.

The public liability Policy of Insurance shall be for an amount as specified by Municipal Authority for any single event (or such higher amount as may be notified in writing by the Municipal Authority from time to time) and on the terms as specified by the Municipal Authority.

24. Appeals:

a. Appeal against any decision of the Secretary relating to display of advertisement or any matter related thereto shall lie before, Director Urban Development Department.

b. Before lodging an appeal, the affected person shall seek a review of the decision 24. If there is any contradiction between these bye-laws and any judgment passed by Hon'ble Apex court or High Court of Himachal Pradesh, then decision of Hon'ble court shall prevail over these bye-laws.

26. When a person desires to remove the advertisement, he will put the space as it was before.

सर्वसाधारण को सूचित किया जाता है कि वादिया कुमारी सहज पुत्री श्री बलदेव, निवासी गांव दलान, डाकघर दलान, उप-तहसील कोटगढ़, जिला शिमला, हिमाचल प्रदेश द्वारा इस राजस्व कार्यालय में दिनांक 04-12-2025 को हिमाचल प्रदेश भू-राजस्व अधिनियम, 1954 की धारा 37 के अन्तर्गत एक प्रार्थना-पत्र प्रस्तुत कर आग्रह किया है कि आवेदिका का नाम भूमि खाता नं0 52, 53 स्थित मोहाल केपू, हदबस्त नं0 24, जमाबन्दी साल 2019-2020 व खाता नं0 47, स्थित मोहाल दलान, हदबस्त नं0 28, जमाबन्दी साल 2023-2024, पटवार वृत्त दलान, उप-तहसील कोटगढ़, जिला शिमला, हिमाचल प्रदेश में कुमारी सैंज पुत्री स्व0 श्रीमती सरोज दर्ज है, जो गलत दर्ज है। जबकि उसका सही नाम कुमारी सहज है, जिसकी पुष्टि के लिए वादिया द्वारा सहायक दस्तावेज परिवार नकल, आधार कार्ड, शपथ-पत्र, बैंक पासबुक, स्कूल प्रमाण-पत्र (दसवीं), पैन कार्ड व नकल जमाबंदी हाल संलग्न प्रार्थना-पत्र कर रखे हैं। इसलिए आवेदिका अब अपने नाम को उक्त राजस्व अभिलेख में सैंज के स्थान पर सहज दुरुस्त करवाना चाहती है।

अतः समस्त जनता को इस इश्तहार के माध्यम से सूचित किया जाता है कि यदि आवेदिका का नाम उक्त राजस्व अभिलेख में दुरुस्त करने बारा किसी को किसी भी प्रकार का उजर या एतराज हो तो वह अधोहस्ताक्षरी के कार्यालय में दिनांक 25-02-2026 को कार्यालय समय प्रातः 10.00 बजे से सायं 5.00 बजे तक असालतन या वकालतन पेश कर सकता है। निर्धारित समय में यदि किसी का कोई उजर या एतराज प्राप्त नहीं होता है तो इस वाद में नियमानुसार वांछित दुरुस्ती आदेश पारित कर दिए जाएंगे।
