हिमाचल प्रदेश सरकार

संख्याःस्वास्थ्य-ए-बी(15)-20/2025.--व्यक्तियों की पहचान स्थापित करने के लिए आधार संख्या का उपयोग, उनको सुविधाजनक और निर्बाध तरीके से सहायिकी, प्रसुविधा और सेवाएं प्राप्त करने में सक्षम 265-राजपत्र/2025-05-03-2026 (12439)12440 राजपत्र, हिमाचल प्रदेश, 05 मार्च, 2026/14 फाल्गुन, 1947 बनाता है, पहचान स्थापित करने के लिए दस्तावेजों की बहुलता की आवश्यकता को समाप्त करता है, प्रक्रियाओं को सरल बनाता है और आधार (वित्तीय और अन्य सहायिकी, प्रसुविधाओं और सेवाओं का लक्षित परिदान) अधिनियम, 2016 के अधीन पारदर्शिता और दक्षता को बढ़ावा देता है;

और, हिमाचल प्रदेश सरकार (जिसे इसमें इसके पश्चात्‌ "सरकार" कहा गया है) में स्वास्थ्य एवं परिवार कल्याण विभाग (जिसे इसमें इसके पश्चात्‌ "विभाग" कहा गया है) मुख्यमंत्री क्षय रोग निवारण योजना (जिसे इसमें इसके पश्चात्‌ "स्कीम" कहा गया है) प्रशासित कर रहा है;

और, स्कीम के अधीन, सहायिकी, प्रसुविधा और सेवाएं प्राप्त करने के लिए आधार संख्या का प्रमाण आवश्यक बनाया जाना प्रस्तावित है (जिसे इसमें इसके पश्चात्‌ प्रसुविधा कहा गया है) स्कीम और उसके संबंध में जारी किए गए अनुदेशों और मार्गदर्शक सिद्धान्तों के अधीन टी बी/डी आर-टी बी रोगियों और आशा कार्यकर्ताओं (जिसे इसमें इसके पश्चात्‌ "लाभार्थी" कहा गया है) को प्रदान की जाती है;

और व्यय राज्य की संचित निधि से उपगत किया जाता है;

और विभाग की वांछा है कि सरकार प्रसुविधा की प्राप्ति के लिए एक शर्त के रूप में प्रसुविधा प्राप्तकर्ता की पहचान स्थापित करने के उद्देश्य से, यह अपेक्षा करती है कि प्रसुविधा प्राप्तकर्ता को प्रमाणीकरण से गुजरना होगा, या आधार संख्या होने का प्रमाण प्रस्तुत करना होगा या किसी ऐसे व्यक्ति के मामले में जिसे कोई आधार संख्या समुदेशित नहीं है, उसे नामांकन के लिए आवेदन करना होगा;

अतः हिमाचल प्रदेश के राज्यपाल, आधार (वित्तीय और अन्य सहायिकी, प्रसुविधाओं और सेवाओं का लक्षित परिदान) अधिनियम, 2016 (जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है) की धारा 7 के उपबंधों के अनुसरण में, निम्नलिखित को अधिसूचित करते हैं, अर्थातः-

1. (1) योजना के अधीन सुविधा प्राप्त करने की वांछा रखने वाले व्यक्ति को प्रमाणीकरण कराना होगा या आधार संख्या होने का प्रमाण प्रस्तुत करना होगा।

(2) यदि किसी व्याक्ति को आधार संख्या नहीं दी गई है, तो उस मामले में आधार नामांकन के लिए आवेदन करना होगाः

परन्तु बालक के मामले मे ऐसा आवेदन केवल उसके माता-पिता या विधिक संरक्षक की सहमति से ही किया जाएगा।

(3) आधार (नामांकन और अद्यतन) विनियम 2016 के विनियम 12 के उपबंधों के अनुसार, विभाग सुनिश्चित करेगा कि ऐसे प्रसुविधा प्राप्तकर्ता का नामांकन किया जाए जोे अभी तक नामांकित नहीं हैं या उनके आधार विवरण को उचित उपायों के माध्यम से अद्यतन किया जाए, जिसमें रजिस्ट्रार के साथ समन्वय और सुविधाजनक स्थानों पर नामांकन केन्द्रों की स्थापना या स्वयं रजिस्ट्रार बनकर नामांकन सुविधाएं प्रदान करना शामिल हैः

परन्तु जब तक ऐसे प्रसुविधा प्राप्तकर्ताओं को आधार नंबर आबंटित नहीं किया जाता है, वह निम्नलिखित दस्तावेज प्रस्तुत कर अपनी पहचान स्थापित कर सकता है जिनके लिए वह हकदार है और जो प्रस्तुति के समय विधिमान्य है, या, ऐसे मामले में जहां ऐसे पहचान के लिए विभाग द्वारा सॉफ्टवेयर प्रदान या अनुमोदित किया गया है, जो इसके तैयार कर्ता या रख-रखाव करने वाले प्राधिकरण के डेटाबेस से ऐसे दस्तावेजों की सत्यापन सूचना, ऐसा करने की सहमति देकर, इलेक्ट्रोनिक रूप से हासिल करने की सुविधा देता है, अर्थातः- अठारह वर्ष से कम आयु के बालक के लिए, जिसे आधार संख्या समुदेशित नहीं की गई हैः12441 राजपत्र, हिमाचल प्रदेश, 05 मार्च, 2026/14 फाल्गुन, 1947 (क) लाभार्थी द्वारा नामांकन प्रक्रिया पूरी कर लेने की पावती, जो नामांकन केन्द्र पर ऑपरेटर द्वारा प्रदान की जाती है, जिसमें नामांकन आई डी (ई आई डी) होती है; और

(ख) निम्नलिखित दस्तावेजों में से कोई एक दस्तावेज यह प्रमाणित करने के लिए कि लाभार्थी अठारह वर्ष से कम आयु का बालक है, अर्थातः-

(i) जन्म और मृत्यु रजिस्ट्रीकरण अधिनियम, 1969 के अधीन जारी किया गया जन्म प्रमाण पत्र;

(ii) भारतीय पासपोर्ट;

(iii) किसी मान्यता प्राप्त स्कूल शिक्षा बोर्ड द्वारा जारी मैट्रिक या दसवीं कक्षा या उच्चतर माध्यमिक या बारहवीं कक्षा का प्रमाण-पत्र या अंकों का विवरण;

(iv) देखभाल और संरक्षण की आवश्यकता वाले किसी बालक या विधि का उल्लंघन करने वाले बालक के संबंध में, जिसे किशोर न्याय (बालकों की देखभाल और संरक्षण) अधिनियम, 2015 के अधीन राज्य सरकार द्वारा बनाए गए नियमों के अधीन संबंधित राज्य सरकार के पास रजिस्ट्रीकृत बाल देखभाल संस्था में रखा जाता है, ऐसी संस्था के प्रभारी, अधीक्षक, बाल कल्याण अधिकारी या परिवीक्षा अधिकारी द्वारा जारी किया गया उसकी जन्मतिथि विनिर्दिष्ट करने वाला प्रमाण-पत्र; या

(v) किसी प्रवासी वैदेशिक नागरिक के संबंध में -

(i) यदि वह भारतीय कार्ड धारक नागरिक है, तो विदेशी भारतीय नागरिक कार्ड ;

(ii) यदि वह तिब्बती शरणार्थी है, तो विदेशी क्षेत्रीय रजिस्ट्रीकरण कार्यालय द्वारा जारी रजिस्ट्रीकरण प्रमाण-पत्र; या

(iii) यदि वह नेपाल या भूटान का नागरिक है, तो नेपाल या भूटान का पासपोर्ट; या (iv) यदि वह विदेशी कार्डधारक भारतीय नागरिक, तिब्बती शरणार्थी या नेपाल या भूटान का नागरिक नहीं है तो उसके पास या तो विदेशी पासपोर्ट के साथ भारतीय वीजा या वर्तमान वैध या समाप्त विदेशी पासपोर्ट के साथ भारत के लिए लंबी अवधि का वीजा; या

(ग) निम्नलिखित दस्तावेजों मेें से कोई एक दस्तावेज, जिसमें लाभार्थी की फोटो हो, जो उसके माता-पिता या विधिक अभिभावक के साथ उसके संबंध को प्रमाणित करे, अर्थातः-

(i) राशन कार्ड;

(ii) जाति प्रमाण-पत्र या अधिवास प्रमाण-पत्र, जो किसी राजपत्रित अधिकारी जो कार्यकारी मजिस्ट्रेट या राज्य सरकार के राजस्व अधिकारी जो तहसीलदार की पंक्ति से नीचे का न हो; द्वारा जारी किया गया हो;

(iii) किसी सरकारी संस्था या सार्वजनिक क्षेत्र के उद्यम द्वारा सेवानिवृत या कार्यरत लोक सेवक या उसके परिवार के सदस्य को जारी किया गया चिकित्सा या बीमा पहचान-पत्र;

(iv) भारतीय पासपोर्ट;

(v) किसी मान्यता प्राप्त स्कूल शिक्षा बोर्ड द्वारा जारी मैट्रिक या दसवीं कक्षा या उच्चतर माध्यमिक या बारहवीं कक्षा का प्रमाण-पत्र या अंकों का विवरण;

(vi) देखभाल और संरक्षण की आवश्यकता वाले किसी बालक या विधि का उल्लंघन करने वाले बालक के संबंध में, जिसे किशोर न्याय(बालकों की देखभाल और संरक्षण) अधिनियम, 2015 के अधीन राज्य सरकार द्वारा बनाए गए नियमों के अधीन संबंधित राज्य सरकार के पास रजिस्ट्रीकृत बाल देखभाल संस्था में रखा जाता है, ऐसी संस्था के प्रभारी व्यक्ति, अधीक्षक, बाल कल्याण अधिकारी या परिवीक्षा अधिकारी द्वारा जारी किया गया उसकी जन्मतिथि विनिर्दिष्ट करने वाला प्रमाण-पत्र; या

(vii) किसी विदेशी नागरिक के संबंध में,-

(i) यदि वह भारतीय नागरिक कार्डधारक है, तो विदेशी भारतीय नागरिक कार्ड;

(ii) यदि वह तिब्बती शरणार्थी है, तो क्षेत्रीय विदेशी रजिस्ट्रीकरण कार्यालय द्वारा जारी रजिस्ट्रीकरण प्रमाण-पत्र;

(iii) यदि वह नेपाल या भूटान का नागरिक है; तो नेपाल या भूटान का पासपोर्ट;

(iv) यदि वह विदेशी भारतीय नागरिक कार्डधारक, तिब्बती शरणार्थी या नेपाल या भूटान का नागरिक नहीं है, तो उसके पास या तो विदेशी पासपोर्ट के साथ भारतीय वीजा होना चाहिए या वर्तमान में वैध या समाप्त हो चुके विदेशी पासपोर्ट के साथ भारत का दीर्घकालिक वीजा होना चाहिए; या

(v) ऐसे लाभार्थी के बाबत जिसके पास विधिक अभिभावक, दत्तक ग्रहण आदेश या विधिक अभिभावकता के साक्ष्य के लिए अन्य दस्तावेज है, जो संरक्षक और प्रतिपाल्य अधिनियम, 1890, किशोर न्याय (बालकों की देखभाल और संरक्षण) अधिनियम, 2015, राष्ट्रीय स्वपरायणता, प्रमस्तिक घात, मानसिक मंदता और बहु निःशक्तताग्रस्त व्यक्ति कल्याण न्याय अधिनियम, 1999 या दिव्यांगजन अधिकार अधिनियम, 2016 और उक्त अधिनियम के अधीन बनाए गए लागू नियमों और विनियमों के अधीन किसी न्यायालय या सक्षम प्राधिकारी द्वारा जारी किया गया हो; या

(vi) कोई अन्य दस्तावेज जो यथा विभाग विनिर्दिष्ट करे।

अठारह वर्ष या उससे अधिक आयु के लाभार्थी के लिए जिन्हें आधार संख्या समनुदेशित नहीं की गई हैः--

(क) लाभार्थी द्वारा नामांकन प्रक्रिया पूरी कर लेने की पावती, जो नामांकन केंद्र पर आपरेटर द्वारा प्रदान की गई हो, जिसमें ई आई डी शमिल है; और

(ख) निम्नलिखित दस्तावेजों में से कोई एक दस्तावेज, जिसमें लाभार्थी का फोटो हो, अर्थात्‌ः- (i) भारत निर्वाचन आयोग द्वारा जारी मतदाता फोटो पहचान पत्र;

(ii) राशन कार्ड;

(iii) जाति प्रमाण-पत्र या अधिवास प्रमाण-पत्र, जो किसी राजपत्रित अधिकारी जो कार्यकारी मजिस्ट्रेट या राज्य सरकार का राजस्व अधिकारी जो तहसीलदार की पंक्ति से नीचे का न हो; द्वारा जारी किया गया हो;

राजपत्र, हिमाचल प्रदेश, 05 मार्च, 2026/14 फाल्गुन, 1947 (iv) किसी सरकारी संस्था या सार्वजनिक क्षेत्र के उद्यम द्वारा किसी सेवानिवृत या सेवारत लोक सेवक या उसके परिवार के सदस्य को जारी किया गया चिकित्सा या बीमा पहचान पत्र;

(v) भारतीय पासपोर्ट;

(vi) किसी मान्यता प्राप्त स्कूल शिक्षा बोर्ड द्वारा जारी मैट्रिक या दसवीं कक्षा या उच्चतर माध्यमिक या बारहवीं कक्षा का प्रमाण-पत्र या अंकों का विवरण;

(vii) किसी सरकारी संस्था या सार्वजनिक क्षेत्र के उद्यम द्वारा सेवारत या सेवानिवृत लोक सेवक को जारी किया गया पहचान पत्र या अन्य पहचान दस्तावेज;

(viii) दिव्यांजन अधिकार नियम, 2017 के अधीन अधिसूचित चिकित्सा प्राधिकारी द्वारा जारी दिव्यांगता प्रमाण-पत्र या दिव्यांगजन सशक्तिकरण विभाग, भारत सरकार द्वारा जारी विशिष्ट दिव्यांगता पहचान (यूडीआईडी) कार्ड;

(ix) भारत में जारी किये गए ड्राइविंग लाइसेंस;

(x) देखभाल और संरक्षण की आवश्यकता वाला बालक या विधि का उल्लंघन करने वाला बालक, जिसे किशोर न्याय (बालकों की देखभाल और संरक्षण) अधिनियम, 2015 के अधीन राज्य सरकार द्वारा बनाए गए नियमों के अधीन संबंधित राज्य सरकार के पास रजिस्ट्रीकृत बालक देख-रेख संस्था में रखा जाता है, ऐसी संस्था के प्रभारी, अधीक्षक, बाल कल्याण अधिकारी या परिवीक्षा अधिकारी द्वारा जारी किया गया उसकी जन्मतिथि विनिर्दिष्ट करने वाला प्रमाण-पत्र; या

(xi) किसी विदेशी नागरिक के संबंध में,-

(I) यदि वह भारतीय नागरिक कार्डधारक है, तो विदेशी भारतीय नागरिक कार्ड;

(II) यदि वह तिब्बती शरणार्थी है, तो क्षेत्रीय विदेशी रजिस्ट्रीकरण कार्यालय द्वारा जारी रजिस्ट्रीकरण प्रमाण-पत्र;

(III) यदि वह नेपाल या भूटान का नागरिक है तो नेपाल या भूटान का पासपोर्ट;

(IV) यदि वह विदेशी भारतीय नागरिक कार्डधारक, तिब्बती शरणार्थी या नेपाल या भूटान का नागरिक नहीं है, तो उसके पास या तो विदेशी पासपोर्ट के साथ भारतीय वीजा होना चाहिए या वर्तमान में वैध या समाप्त हो चुके विदेशी पासपोर्ट के साथ भारत का दीर्घकालिक वीजा होना चाहिए; या

(V) ऐसे लाभार्थी के संबंध में जिसके नाम विधिक अभिभावक, दत्तक ग्रहण आदेश या विधिक अभिभावकता के साक्ष्य के लिए अन्य दस्तावेज है, जो संरक्षक और प्रतिपान्य अधिनियम, 1890 (1890 का 8), किशोर न्याय (बालकों की देखभाल और सरंक्षण) अधिनियम, 2015 (2016 का 2) राष्ट्रीय स्वपरायत, प्रमस्तिष्क घात, मानसिक मंदता और बहु-निःशतता ग्रस्त व्यक्ति कल्याण राष्ट्रीय इस्ट अधिनियम, 1999 (1999 का 44) का न्याम दिव्यांगजन अधिकार अधिनियम 2016 (2016 का 49) और उक्त अधिनियमों के अधीन बनाए गए लागू नियमों और विनियमों के अधीन किसी न्यायालय या सक्षम प्राधिकारी द्वारा जारी किया गया है; या

(VI) कोई अन्य दस्तावेज जो विभाग विनिर्दिष्ट करे। 12444 राजपत्र, हिमाचल प्रदेश, 05 मार्च, 2026/14 फाल्गुन, 1947 (4) उक्त मंत्रालय द्वारा इस संबंध में नामित अधिकारी धारा (3) के अधीन प्रस्तुत दस्तावेजों या उनकी विषय-वस्तु को प्रमाणित करने वाली सूचना के संबंध में जांच करेगा,-

(क) माईआधार पोर्टल (https:@@myaadhaar. Uidai.gov. in @portal) पर ईआईडी जमा करके नामांकन अनुरोध की स्थिति की पुष्टि करे ताकि यह पुष्टि हो सके कि ईआईडी वैध है और नामांकन अनुरोध अस्वीकृत नहीं हुआ है; और

(ख) अन्य दस्तावेजों के संबंध में तथा इस प्रयोजन के लिए किसी सरकारी संस्था या प्राधिकरण की सहायता ले सकेगा तथा प्रस्तुत जानकारी को उसके साथ सांझा कर सकेगा जो ऐसे दस्तावेजों में निहित जानकारी की तैयारी या रख-रखाव से संबंधित है।

1. लाभार्थियों को लाभ आसानी से प्राप्त करने में सक्षम बनाने के लिए मंत्रालय स्कीम के अधीन आधार संख्या की आवश्यकता के बारे में लाभार्थियों को जागरूक करने के लिए मीडिया के माध्यम से व्यापक प्रचार सुनिश्चित करने के लिए सभी आवश्यक कदम उठाएगा।

2. जब आधार नंबर का प्रमाणीकरण किसी भी बायोमिट्रिक आधारित प्रमाणीकरण विधि (अर्थात्‌ चेहरे का प्रतिविव उंगलियों के निशान या आईरिस स्कैन आधारित प्रमाणीकरण) के माध्यम से किया जाता है, वह किसी भी कारण में असफल हो जाता है, जैसे कि बायोमिट्रिक सूचना की खराब गुणवत्ता, तो निम्नलिखित उपचारात्मक तंत्र अपनाए जाएंगे अर्थात्‌ः-

(क) यदि प्रमाणीकरण का कोई विशेष बायोमिट्रिक-आधारित तरीका सफल नहीं होता है, तो बायोमिट्रिक आधारित प्रमाणीकरण या वन-टाइम पिन (ओटीपी) आधारित प्रमाणीकरण का कोई अन्य तरीका, जहां भी व्यवहार्य और स्वीकार्य हो, से किया जाएगा,

(ख) ऐसे मामलों में जहां प्रमाणीकरण के बायोमिट्रिक-आधारित या ओटीपी- आधारित तरीके संभव नहीं हैं, वहां उक्त स्कीम के अधीन लाभ, यथा स्थिति, आधार सुरक्षित त्वरित प्रतिक्रिया (क्यूआर) कोड या आधार पेपरलेस ऑफलाइन ई-केवाईसी दस्तावेज पर यूआईडीएआई के डिजिटल हस्ताक्षर प्रमाण-पत्र के ऑफलाइन सत्यापन के द्वारा आधार संख्या की वास्तविकता स्थापित करने के पश्चात्‌ निम्नलिखित में से किसी दस्तावेज के आधार पर दिया जा सकता हैः (i) आधार सुरक्षित त्वरित प्रतिक्रिया (क्यूआर) कोड जिसमें आधार कार्ड, आधार पत्र (अर्थात्‌ आधार संख्या धारक को उसके आधार संख्या के सृजन पर जारी किया गया पत्र) या ई-आधार (अर्थात्‌ यूआईडीएआई की वेबसाइट से डाउनलोड करने योग्य आधार-पत्र की पासवर्ड में सुरक्षित इलेक्ट्रॉनिक प्रति या जिसे एमआधार ऐप का उपयोग करके प्राप्त किया जा सकता हो) सम्मिलित है, आधार क्यूआर स्कैनर या एमआधार ऐप का उपयोग करके क्यूआर कोड को स्कैन करके ऑफलाइन सत्यापन के माध्यम से इसकी वास्तविकता स्थापित होने के पश्चात्‌।

(ii) आधार पेपरलेस ऑफलाइन ई-केवाईसी दस्तावेज (यूआईडीएआई की वेबसाइट से डाउनलोड किया जा सकता है या इसके एमआधार ऐप का उपयोग करके प्राप्त किया जा सकता है), यूआईडीएआई की वेबसाइट पर इस संबंध में दिए गए विवरण के अनुसार, इस प्रयोजन के लिए संबंधित मंत्रालय या विभाग या स्कीम कार्यान्वयन एजेंसी द्वारा विकसित एप्लिकेशन के माध्यम से दस्तावेज पर आईडीएआई के डिजिटल हस्ताक्षर प्रमाण-पत्र के ऑफलाइन सत्यापन के माध्यम से इसकी वास्तविकता स्थापित होने के पश्चात्‌। 3. ऊपर दी गई किसी बात के होते हुए भी,-

(क) उक्त स्कीम के अधीन किसी बालक को लाभ देने से इनकार नहीं किया जाएगा-12445 राजपत्र, हिमाचल प्रदेश, 05 मार्च, 2026/14 फाल्गुन, 1947 (i) चल रहे प्रमाणन द्वारा पहचान स्थापित करने और आधार संख्या रखने का प्रमाण प्रस्तुत करने में असफल रहने की स्थिति में; या

(ii) नामांकन के लिए आवेदन प्रस्तुत करने की स्थिति में, जहां उसे आधार संख्या नहीं दी गई है; और

(ख) स्कीम के अधीन लाभ, ऐसे बालक को उसकी पहचान सत्यापित करके और पैरा 1 के खंड (3) के परंतुक में विनिर्दिष्ट रीति से उसके माता-पिता या विधिक अभिभावक के साथ उसके संबंध को स्थापित करके दिया जाएगा; और

(ग) जहां खंड (ख) के अधीन लाभ दिया जाता है, वहां उसके संबंध में एक रिकार्ड रखा जाएगा, जिसकी विभाग द्वारा समय-समय पर समीक्षा और लेखा-परीक्षा की जाएगी।

4. यह सुनिश्चित करने के लिए कि अठारह वर्ष या उससे अधिक आयु के वास्तविक लाभार्थी स्कीम के अधीन मिलने वाले लाभ से वंचित न रहें, विभाग प्रत्यक्ष लाभ अंतरण मिशन, कैबिनेट सचिवालय, भारत सरकार के तारीख 19 दिसम्बर, 2017 के कार्यालय ज्ञापन संख्या डी- 26011/04/2017- डी बी टी (https://dbtbharat.gov.in पर उपलब्ध) में विनिर्दिष्ट अपवाद हैंडलिंग तंत्र का पालन करेगा।

5. यह अधिसूचना राजपत्र (ई-गजट) हिमाचल प्रदेश में इसके प्रकाशन की तारीख से प्रवृत्त होगी। आदेश द्वारा, एम सुधा देवी, सचिव (स्वास्थ्य)।

No. SEC-HP-F002(01)/1/2021-6636.—Whereas the State Election Commission vide Notification No. SEC:13-90/2016-V-1755-1919, dated 24th May, 2025 had issued the programme for delimitation of wards in respect of 73 Municipal Bodies in the State;

And whereas the State Election Commission had finally published delimitation of wards in respect of 73 Municipalities in the Official Gazette vide Notification dated 4th and 14th July, 2025.

And whereas creation/upgradation/inclusion of areas in following Municipalities were challenged before the Hon'ble High Court in various CWPs. The Hon'ble Court quashed the notifications of the Government with the directions to consider the objections of the petitioner(s) in accordance with law by passing a reasoned and speaking order after affording an opportunity of personal hearing in respect of following Municipalities:—

And whereas in pursuance to the directions of the Hon'ble High Court the Department of Urban Development heard the objections and final notifications for creation/upgradation/ reorganization of the above mentioned Municipalities has already been issued by the Government without any changes in the geographical areas as mentioned earlier;

Since there is no change in the geographical area of the abovementioned Municipalities and population remains as such as determined in Census, 2011 and the said census is still in force as required under Section 2(38) of the HP Municipal Corporation Act, 1994 and H.P Municipal Act, 1994;

Therefore, the State Election Commission in exercise of the powers vested in it under Article 243ZA of the Constitution of India, Section 9 of the HP Municipal Corporation Act, 1994 and Section 281 of the Himachal Pradesh Municipal Act, 1994 read with Rule 9 of the H.P. Municipal Corporation Election Rules, 2012 and HP Municipal Election Rules, 2015 is of the considered view that there is no need to undertake fresh delimitation of wards within territorial jurisdiction of abovementioned Municipalities;

Accordingly, delimitation of Wards in respect of abovementioned Municipalitiesas finally notified vide Notification No. SEC-HP-F002(01)/2021-2578, dated 4th July, 2025 and 14th July, 2025 is hereby re-notified and finally published for ensuing General Elections to abovementioned Municipalities.

And whereas Section 14 of the Himachal Pradesh Municipal Act, 1994 provides that first election to a Municipality may be held within a period of two years of its being notified as a Municipality;

Therefore, The State Election Commission in exercise of the powers vested in it under Article 243ZA of the Constitution of India, Section 10 and 281 of the H.P. Municipal Act, 1994 read with Rule 9 of the H.P. Municipal Election Rules, 2015 hereby issues the following program for delimitation of wards in respect of the abovementioned Urban Local Bodies of the State:—

If no objection is received or no appeal is filed within stipulated period, the concerned Deputy Commissioner may issue final de-limitation orders and start process for reservation of wards. After finalization of de-limitation and reservation of wards, order to this effect should immediately be sent to the Government by the Deputy Commissioner concerned as required under Sub-Rule 11 of the Rule 10, so that the Government may provide a copy of the final reservation order to the Commission in accordance with Rule 11 of the Rules ibid.

Dated, the 21st November, 2025

No. 889.—The following Bye – laws made by Nagar Panchayat Chowari, for regulating Outdoor Advertisement and hoardings in exercise of the Power conferred under section 113 and section 202(o) of the Himachal Pradesh Municipal Act, 1994 I, Aditya Chauhan, Secretary, Nagar Panchayat Chowari, Himachal Pradesh hereby notify the following Bye-laws:

Advertisement Bye–Laws–Nagar Panchayat Chowari

1. Title & Contents.—(i) These Bye-laws may be called the Nagar Panchayat Chowari Outdoor Advertisement Bye-laws 2025.

(ii) These Bye-laws shall come in to force with immediate effect within the limits of Chowari Nagar Panchayat after the notification by the Government of Himachal Pradesh in the official gazette.

2. Definitions: In these bye-laws unless the context otherwise requires:

(i) "Act" means Himachal Pradesh Municipal Act, 1994

(ii) "Panchayat" means Nagar Panchayat Chowari (PNP henceforth)

(iii) "Advertisement" shall mean any work, letter, model, sign, device, digital display, electronic display, name boards, direction boards, laser show, kiosk, LED, LCD, Backlit Board, Neon display, or representation supported on or attached to any post, pole, standard framework or other support wholly or in part upon or over any Private/ Public/State Govt./Central Govt./ public Sector undertaking/ Govt. Companies/ Govt. Authorities etc., land/Spaces, building or structure which or any part of which shall be visible against the sky from some point in any street/Road includes all and every part of any such post, pole, parapet, standard framework or other support. It shall also include any balloon parachute or other similar employed wholly or in part for the purpose of any advertisement announcement or direction upon or over any land/spaces, building or upon or over any street. However, any display in the form of graffiti and civic messages published by Nagar Panchayat or any Government authorities (Having no commercial explanation) for the benefit of the citizen shall not be considered as an advertisement.

(iv) Advertisement on vehicle (movable) means single, double or multiple advertisement board affixed by means of sticker/boards on vehicle, side panel or behind a vehicle in a manner that advertisement draw visibility while the vehicle is driven on the road. However, care must be taken to ensure that this does not impede traffic as well as pedestrians.

(v) Advertisement on vehicle (Parked) means single, double or multiple advertisement board affixed by means of sticker/boards on vehicle, side panel or12457 राजपत्र, हिमाचल प्रदेश, 05 मार्च, 2026/14 फाल्गुन, 1947 behind a vehicle in a manner that advertisement draw visibility when vehicle is parked at strategic location. However, care must be taken to ensure that this does not impede traffic as well as pedestrians.

(vi) "Advertisement Regulation Committee" means Committee consisting of a)Secretary Nagar Panchayat Chowari (b) Junior Engineer Nagar Panchayat, Chowari (c) SanitarySupervisor, Nagar Panchayat, Chowari (d) Assistant Engineer, Chowari.

(vii) "Advertisement Zoning Plan" means the numbered plan signed by the Secretary and kept in this office defining the areas of special control and restrictions regarding the advertisement applicable to such areas.

(viii) "Area of Special control" means as area so defined in the advertisement zoning plan.

(ix) "Enclosed Land" shall mean the land which is wholly or for the most part enclosed within the hedge fence, wall or similar screen or structure and shall not include any railway station together with the yards and for Court thereof, whether enclosed or not, any public park, public garden or other land held for the use or enjoyment of the public.

(x) "Illuminated advertisement" shall mean any advertisement with self-luminous by an outside source of light, but not include an illuminated display of goods if such display:—

(a) Is of goods merely bearing labels showing the name of article of its manufacturer or of other; and

(b) Is made by lighting which is not, in the opinion of the Secretary more than which is necessary to make the goods labels visible at night.

(xi) "Name Plate" shall mean an advertisement announcing the name of owner and or name of occupier of a building and/or name of a building upon which such advertisement is fixed, exhibited painted, pasted retained or displayed, provided that the size of the letters constituting such advertisement does not exceed 2" in height and the total area does not exceed 4 square feet.

(xii) "Structure" shall include a post, pole, tree, bridge, embank and road surface and also a tram car, omnibus and any other vehicle any movable, board used primarily as an advertisement or advertising medium.

(xiii) "Schedule" means the schedule indicating the rate/fees for advertisements 3. (A) Regulation and control of advertisement:

No advertisement shall be erected, exhibited, fixed or retained upon or over any land, building, wall, boarding, frame, post or structure or place within the City without the written permission of the Secretary granted in accordance with bye-laws made under this Act. Provided that no permission shall be required for any advertisement, which:—

(a) Appears in newspapers, relates to public meeting, or to an election to Parliament12458 राजपत्र, हिमाचल प्रदेश, 05 मार्च, 2026/14 फाल्गुन, 1947 or Legislative Assembly or the Council or to candidature in respect of such election; or

(b) is exhibited within the window of and building if the advertisement relates to the trade, profession or business carried on in that building; or

(c) relates to the trade profession or business carried on within the land or building upon or over which such advertisement is exhibited or to any sale or letting of such land or building or any effects therein or to any sale entertainment or meeting to be held on or upon or in the same; or

(d) relates to the name of the land or building upon or over which the advertisement is exhibited, or the name of the owner or occupier of such land or building; or (e) Relates to any activity of the Government or Union of India or the Nagar Panchayat.

3. (B) Prohibition of Sticking, fixing hanging or painting bills, posters, advertisement, notices etc.— (i) Hoardings, advertisement/ banners will not be allowed in the acquired width of the National/ State high way and other scheduled road and footpath as they cause traffic hazard and are against the instructions of the Govt. of India and Hon'ble Court.

(ii). No Hoarding, advertisements should be put at the place which effects or endangers the growth of flora and fauna.

(iii). No hoarding, advertisement should be located in thickly wooded area and no any kind of hoarding should be placed on trees.

(iv). No hoarding, advertisement should exceed dimension size of 30 sq. Meters (v). No hoarding, advertisement, banners should be put up in contravention of any law & rules against the guidelines notified by any department.

(vi).No hoarding, advertisement should locate near a water source

(vii). No hoarding, advertisement should be in the form of writing, engraving, nailing and carving on any Natural or in animate object.

(viii). No hoarding, advertisement, banner will be allowed on the roofs of buildings, except with the permission of Secretary, N.P Chowari.

(ix). Only sign board of premises are allowed upto 4 Sq. m. between slab and lintel of the building to the occupier/ owner.

(x). Directional sign to Govt. offices, religious places will be allowed by the Council, The type, size and location of these shall be also approved by the Council. The PNP has to keep in view requisite site clearness, so that there is no traffic hazard due to installation of such board.

(xi). The Council shall provide notice board for the purpose of sticking, fixing or hanging posters, notice and advertisement, which shall be available for use on an application to be made to the Secretary on payment of fee provided for in these bye-laws.

(xiii). The beauty of nature for matters such as hills, rivers, trees and rock should not be destroyed by indiscriminate installation of commercial advertisement.

(xiv). No writing/ defacing of retaining walls and parapets could be allowed

4. Outdoor advertisement and road safety criteria:

An advertisement device may be considered a traffic hazard:—

(a) If it interferes with road safety or traffic efficiency;

(b) If it interferes with the effectiveness of a traffic control device (e.g. traffic light, stop or give way sign);

(c) Distracts a driver at a critical time (e.g. making a decision at an intersection);

(d) Obscures a driver's view of a road hazard (e.g. at corners or bends on the road);

(e) Gives instructions to traffic to "Stop", "halt" or other (e.g. give way or merge); (f) Imitates a traffic control device;

(g) Is a dangerous obstruction to road or other infrastructure, traffic, pedestrians, cyclists or other road users;

(h) Is in an area where there are several devices and the cumulative effect of those devices may be potentially hazardous; and

(i) If situated at locations where the demands on driver's concentration due to road conditions are high such as at major intersections or merging and diverging lanes;

(j) Name of advertisement agencies should be mentioned on every hoarding board 5. Control of the physical characteristics of advertising devices shall be as follows:

(a) Advertising shall not contain flashing red, blue or amber point light sources which when viewed from the road, could give the appearance of an emergency service or other special purpose vehicle warning lights.

(b) All lighting associated with the Advertising Device shall be directed solely on the Advertising Device and its immediate surroundings.

(c) External illumination sources shall be shielded to ensure that external 'spot' light sources are not directed at approaching motorists.

(d) Illumination of advertising device is to be concealed or be integral part of it (e) Upward pointing light of the device shall not be allowed, any external lighting is to be downward pointing and focused directly on the sign so that glare does not extend beyond the Advertising Device.

(f) The average-maintained luminance shall be reduced to 0.5 candelas or all together shut from 11pm till sunrise by automatic timing devices.

(h) Moving, rotating or variable message Advertising Devices are not permitted within the municipal boundaries as these cause a statistically significant distractive influence on motorist's response times to external stimuli.

However, this permission criterion is not intended to apply to variable message displays used by road authorities for traffic management or for displaying other Council's information. Variable message displays located at bus stops or similar places where messages are directed at- and intended for pedestrians (not motorists) are excluded.

6. Outdoor hoarding and their content criteria:

The Municipal authority may take action to modify or remove any Advertising Device that contravenes the following negative advertisements or that otherwise cause a traffic hazard.

List of negative advertisements:—

• Nudity

• Racial advertisements or advertisements propagating caste, community or ethnic differences.

• Advertisement promoting drugs, alcohol, cigarette or tobacco items

• Advertisements propagating exploitation of women or child

• Advertisement having sexual overtone

• Advertisement depicting cruelty to animals

• Advertisement depicting any nation or institution in poor light

• Advertisement casting aspersion of any brand or person

• Advertisement banned by any law enacted by the Government of India • Advertisement glorifying violence

• Advertisement that exploits the national emblem or any part of Constitution of India, or the person or personality of a national leader or a state dignitary.

• Destructive devices and explosives depicting items

• Any psychedelic, laser or moving displays

• Advertisement of Weapons and related items (such as firearms, firearm parts and magazines, ammunition etc.).

• Advertisements which may be defamatory, trade libelous, unlawfully threatening or unlawfully harassing.

• Advertisements which may be obscene or contain pornography or contain an "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986.

• Advertisement linked directly or indirectly to or include description of items, goods or services that are prohibited under any applicable law for the time being in force, including but not limited to the Drugs and Cosmetics Act, 1940, the Drugs and Magic Remedies (Objectionable Advertisements) Act,1954, the Indian Penal Code, 1860; or

• Any other items considered inappropriate by the municipal bodies.

For all categories of devices (except Category of devices which are directed at pedestrians), text elements on an Advertising Device, face should be easily discernible to travelling motorists. This will minimize driver's distraction. Additionally, a sign shall be quickly and easily interpreted so as to convey the required advertising message to the viewer and reduce the period of distraction. The content or graphic layout exhibited on advertising device panel shall avoid hard-to-read and overlay intricate typefaces and have letter styles that are appropriate. Under no circumstances should device contain information in text sizes which would necessitate the driver or passenger in a moving vehicle to stop, read and/or note down, which detrimental to the smooth flow of traffic and distracting for the driver. All signs shall be so designed as to maintain a proportion where, as a general rule letters should not appear to occupy more than 2% of the sign area unless otherwise permitted by the municipal bodies.

7. Prohibited areas and areas of special control and restrictions thereon:

The Secretary may:—

(a) by order prohibit the erection, exhibition, fixation, retention or display of any or any class of advertisements in any street road or public park or park there of or in any place or public resort;

(b) Regulate the erection, exhibition, fixation, retention or display any advertisements, in any manner in the prohibited areas and areas of special control, in accordance with the regulations indicated in the Advertisement Zoning Plans of the said areas.

Explanation.— The restrictions indicated in the advertisement zoning plans shall be in addition to those mentioned in the other clauses of the bye-laws.

8. Classification of advertisement devices:

The categories of the advertisement devices:—

Category 1: Large-format advertisement, mainly fixed on bill boards / uni-poles and bridge.

Category 2: Advertisement mounted on public amenities, like public toilets, garbage collection points, Single Poles etc.

Category 3: Fleets, fliers and transport related infrastructure

Category 4: Advertisement devices for self-advertising in commercial areas12462 राजपत्र, हिमाचल प्रदेश, 05 मार्च, 2026/14 फाल्गुन, 1947 9. Outdoor advertising and structure criteria: • Advertising Device structures including the foundations, for categories 1 and 2 devices, shall be designed and checked for extreme wind conditions, earthquakes, soil bearing capacity etc. and shall comply with relevant Indian structural design standards, codes of practice and Byelaws guidelines. The designs shall be certified by an experienced and practicing structural engineer.

• The supporting structure shall have a non-reflective finish to prevent glare. The device structure shall be well maintained at all times. It shall be painted in colours that are consistent with, and enhance the surrounding area and will be compliant with the criteria or colours laid out earlier in the Bye-laws.

• Official road furniture such as official signs and delineator guide-posts shall not be used as the supporting structure of an advertising device.

• The name of the Advertising Device license holder should be placed in a conspicuous position on the device.

10. Outdoor advertising devices and electrical connection:

The electrical connections and components in all Advertising Devices shall be in accordance with relevant Indian Standards and designed to ensure there is no safety or traffic risk. No generator running on diesel / petrol / kerosene or any bio fuel, causing noise, air or water pollution would be allowed for providing power for illumination of any outdoor advertising device.

Electricity from renewable energy sources:

To promote conservation of electricity, if the illumination at outdoor advertising devices draws power from alternate renewable resources like solar power, such advertisement devices the license fee/charges will be half of the actual fee.

11. Permissibility of different category of advertising devices:

As per schedule-I

12. Specific conditions:

(a) No advertisement /hoarding should be placed in such a way that obstructs the mountain and valley view of Town. If such case is found, the Secretary can impose a penalty as he deems fit not exceeding a sum of twenty thousand rupees and remove the said advertisement.

(b) All advertisements outside the business area or the building which houses the business can be erected only after permission from the Council.

13. Limitation for Disposal of Applications:

Every application received as per provision of these Bye-laws shall be acknowledged and the decision on it shall be taken within 30 working days from the date of receipt. If the decision is not taken within the prescribed period, it will be presumed that the required permission is granted subject to payment of due advertisement tax and license fee of the land use charges, wherever applicable and compliance of other clauses of Bye-laws.

All advertisements, over the size of 100 sq. feet, (9.3 sq. m.) permitted over the Municipal land/building shall be through tenders. The tenders can be of single or more hoardings. The tender shall be invited by a committee to be headed by Secretary or by his representative or in the exceptional circumstances by private experts. The committee shall fix the following minimum things before the tender;

(a) Reserve price

(b) Location of the site/sites

(c) Size of advertisement

(d) Past revenue collection

(e) Number of sites

(f) Period of tender

The advertisement right shall be given for a period of 3 years or as may be decided by the Chowari Nagar Panchayat. It shall be terminable at one month notice without assigning any reason. In the event of default of any terms, the same shall be terminable forthwith without any notice. The tender bid will include the advertisement tax and rent for use of Nagar Panchayat Land/Property. However, payment of service tax or any other State/Central tax will be borne by the tendering agency/individual.

15. Procedure for obtaining permission - For grant of permission in respect of

advertisement of private property:

The application for permission from the Secretary shall be accompanied with the following documents:—

1. Written no objection certificate from the landowner of the person, legally authorized to accord such NOC.

2. Three copies of plan showing the location, norms and size of the advertisement/hoarding etc. and a copy of the advertisement to be displayed.

3. The design and the structure shall be certified by a experienced and practicing Structural Engineer who shall certify the safety aspect from the point of view of its foundations which can bear extreme wind conditions, earthquakes, soil bearing capacity and shall comply with relevant India structural design standards policy and guidelines framed from time to time.

4. NOC will not be issued to those who violate these bye-laws

16. Fees on Advertisements:

1. The advertisement fee shall be payable in advance annually / quarterly / monthly basis as the case may be fixed by the Municipality from time to time provided that if the rate of fee is chargeable on annually, quarterly or monthly basis, the fractions thereof shall be construed accordingly.

3. Full monthly fee shall be chargeable if the advertisement duration is for more than 10 days. A month for this purpose shall be the calendar month-provided that where advertisement are to be displayed for part of a year and the fees fixed in the schedule are for one year, the fees payable part of the year shall be calculated on quarterly basis.

4. The fees shall be paid by the advertiser to the Chowari Nagar Panchayat before the erection of the advertisement.

Calculation of fees:

The advertisement fees should be calculated on the basis of the following factors:—

(a) Category of the advertisement- Equal for all 1 factor (b) Size of the advertisement- as per sq. m. House approval 100 and 300 per sq.m. (c) Location of the advertisement- Equal for all 1 factor.

The value of the factor shall be decided by the general house of the Chowari Nagar Panchayat for the first time and future amendments can be done by the Advertisement Regulations committee.

17. Functions of the Advertisement Regulation Committee:

(I) The advertisement Regulation Committee shall identify the area of special control and prepare advertisement/zoning plans indicating the categories of advertisement devices permissible in different areas of Special Control.

(II) In case any practical difficulty arises with respect to implementation of these bye- laws of the zoning plans, the matter shall be referred to advertisement regulation committee who shall on reference consider and make suitable recommendations to the Secretary for the decision.

18. Penalties:

Whoever contravenes any of these bye-laws shall be punishable with fine of Rupees 500/- for everyday, which may extend upto Ten thousand Rupees, when the contravention is continuing gone.

19. Arbitration:

If any dispute regarding advertisement holdings arises between Municipal authorities and any other person concerned with such advertisement holdings, such dispute may be referred by both parties to the Deputy Commissioner Chamba, who shall be sole arbitrator.

20. Jurisdiction:

All disputes shall be subject to the jurisdiction of the Civil Courts at Chamba only

21. Indemnity:

A licensee/sign owner/applicant (licensee) shall be required to indemnify the Municipal Authority for the designated Advertising Device and activities against all actions, proceedings,12465 राजपत्र, हिमाचल प्रदेश, 05 मार्च, 2026/14 फाल्गुन, 1947 claims, demands, costs, losses, damages and expenses which may be brought against, or made upon the Municipal Authority which arise as a result of the installation or existence of an Advertising Device. Such licensee/sign owners/applicant (licensee) shall always be responsible for any injury or damage caused or suffered by any person or property arising out of or relating to the display of device / advertisement and the consequential claim shall be borne by the advertiser who will also indemnify and safe guard the Municipal Authority in respect of any such claim or claims.

22. Removal of Illegal holdings:

In case any holdings are found illegal, the Secretary may order its immediate removal subject to giving seven days prior notice. Removal shell be done by the Council, whose cost shall be borne by the defaulter himself. However, in case any holdings pose danger to the safety of general public requirement of serving seven days prior notice shall be dispensed with.

23. Insurance:

• The Licensee in case of Category 1 and 2 Advertising Devices shall provide a public liability insurance policy for their respective rights, interests and liabilities to third parties in respect of accidental death or bodily injury to person(s) or damage to property.

The public liability Policy of Insurance shall be for an amount as specified by Municipal Authority for any single event (or such higher amount as may be notified in writing by the Municipal Authority from time to time) and on the terms as specified by the Municipal Authority.

24. Appeals:

(a) Appeal against any decision of the Secretary relating to display of advertisement or any matter related thereto shall lie before, Director Urban Development Department.

(b) Before lodging an appeal, the affected person shall seek a review of the decision 25. If there is any contradiction between these bye-laws and any judgment passed by Hon'ble Apex court or High Court of Himachal Pradesh, then decision of Hon'ble court shall prevail over these bye-laws.

26. When a person desires to remove the advertisement, he will put the space as it was before.

Schedule-I Permissibility of different category of advertising devices 9.1 Category1-

Devices

No. 891.—In exercise of the powers conferred under Section 113 read with Section 202 of the Himachal Pradesh Municipal Act, 1994, I, Aditya Chauhan, Secretary, Nagar Panchayat Chowari, Himachal Pradesh hereby notify the following Bye-laws:

"The Chowari Nagar Panchayat (Registration and Control of Pet Dogs) Bye-laws, 2025."

1. Short title and Commencement.—(i) These Bye-laws may be called "The Chowari Nagar Panchayat (Registration and Control of Pet Dogs) Bye-laws, 2025."

(ii) These shall come into force from the date of their publication in the official gazette of Himachal Pradesh.

2. Definitions.—ln these bye-laws, unless the context otherwise requires:

(i)"Act" means the Himachal Pradesh Municipal Council Act, 1994, (Act No. 12 of 1994).

(ii)"Section" means the section of the Act

(iii)"Family" means the owner, his/her parents, spouse, sons, daughters, brothers and sisters living in one premises.

(iv)"Owner" means the person who owns a registered/unregistered dog and includes a12467 राजपत्र, हिमाचल प्रदेश, 05 मार्च, 2026/14 फाल्गुन, 1947 person in whose custody, charge or possession a dog is found. (v)"Pet Dog" means a male or female dog kept by a person within the area of Nagar Panchayat Chowari and other than stray dogs.

(vi)"Registration Authority" means any officer so appointed by the Secretary Nagar Panchayat Chowari.

(vii)The words and expressions not defined in these bye-laws shall have the same meaning as assigned to them in the HP Municipal Council Act, 1994.

3. Procedure for Registration of Dogs:

On and from the date of publication of these bye-laws, registration of Pet Dog(s) (hereinafter mentioned as dog) above the age of three months, kept within the jurisdiction of Nagar Panchayat Chowari shall be compulsory. The owner of Dog, on or before the first day of April of every year or within seven days of its arrival, register such dog in a Form as prescribed by the Council, Nagar Panchayat Chowari (Annexure – A) accompanied by a fee of Rs. 50 per dog as one time registration fees along with two recent photographs of the dog and a copy of vaccination certificate from a Government Veterinary Practitioner or Veterinary Practitioner duly registered with Indian Veterinary Council (IVC) or State Veterinary Council (SVC). Further, an amount of Rs. 50 per dog shall be charged as license fees annually. However, a blind person keeping dog and using solely for his/her guidance shall be exempted from the payment of registration fee. On registration, the Registration Authority shall issue a metal token to be attached with the collar to be worn by the dog and in case of loss or destruction of the token; a duplicate token shall be issued to the owner on submission of an application along with a fee of Rs. 50 per token. The registration once made shall remain valid for full life span of the dog. In case of death of the dog, the owner of the dog shall immediately inform the Registration Authority. A family may keep maximum of two dogs.

4. Any registered dog found straying at large shall be liable to be seized and keptat a place set for this purpose.

5. Duties and responsibilities of the owners. —

(i) The owner of the pet dog shall be responsible for the controlled breeding, immunization, neutering and licensing in accordance with the provisions of these Bye-Laws.

(ii) Any dog not wearing metal ticket or registration in accordance with clause 3 of these Bye-laws may, if found in any public place be removed and will be liable to be dealt under the orders of the Veterinary Public Health Officer, Nagar Panchayat Chowari, if not claimed within 7 days by the owner.

(iii) For the purpose of these bye-laws any person in possession or in charge of the dog, during the absence of the real owner within the limits of N.P. Chowari, shall be deemed to be the owner of the dog.

(iv) It shall be mandatory for each owner to carry disposable bags during the time when the dog is put on Municipal streets.

(v) The owner of the dog shall not allow the dog to defecate in public places such as12468 राजपत्र, हिमाचल प्रदेश, 05 मार्च, 2026/14 फाल्गुन, 1947 residential areas, green belts, parks, streets, roads, road beams and other common places etc. In case the dog defecates at the above specified places, the owner shall arrange to get the excreta of the dog removed from the said place at his own level. No owner shall allow the dog to defecate near the residences of other persons, his/her neighbors to his/her/their annoyance

6. The owner of the registered dog shall keep the dog under his/her control at all times so that it does not intimidate, annoy, hurt or bite any person. The Municipal Council shall not be held responsible for any loss, damage or injury caused by a registered dog to any person or to his/her property and sole liability to compensate the victim will remain with the owner of the registered dog.

7. Guideline for breeders. —

(i) A breeder must be registered with Nagar Panchayat Chowari. Breeder must maintain full record of the number of pups born/died from individual bitches. He shall also maintain proper record of pedigree and vaccination.

(ii) Breeder must maintain record of the person buying the pups. He should ensure that the buyer has required knowledge for the upkeep of pups.

(iii) Breeder must pay Rs. 5000/-as one time registration charges in the treasury of the Municipal Council besides Rs. 1500/- per dog as annual fees every year. This fee to be paid by the breeder shall be over and above the registration fee / annual license fee provided in 3 above.

8. Guideline for Dog Care Centre:—

(i)A dog care centre must be registered with Nagar Panchayat Chowari. Owner of dog care centre must maintain full record of the number of dogs. He shall also maintain proper record of pedigree and vaccination.

(ii)No dog care centre is allowed inside residential houses and flats.

(iii)Owner of dog care centre must pay Rs.5000/- as one time registration charges in the treasury of the Municipal Corporation besides Rs. 10,000/- license fee every year.

(iv)Owner of dog care centre must obtain no objection certificate from the concerned ward councilor.

(v)Permission to operate dog care centre shall be subject to approval of Nagar Panchayat Chowari.

9. The owner of the registered dog shall ensure proper space, accommodation, food and medical treatment to the dog.

10. The Registration Authority or an officer/official authorized by him shall keep the details of all the seized dogs duly entered in a register with a brief description of the dog, date of seizure, reasons of seizure and the manner in which it is disposed of.

Municipal Council. Dead dog shall be buried at notified/earmarked places up to a depth of atleast 3 ft. in a hygienic manner. The Nagar Panchayat Chowari may provide a van for the disposal/burial of dead dogs in the earmarked dog burial grounds on the request so received by it. The owner shall pay charges for availing the services of the van at the rates prescribed by the Commissioner, Municipal Council and so revised from time to time.

12. The Registration Authority or a Veterinarian, Health Supervisor, Sanitary Inspector or any other officer of the Nagar Panchayat Chowari authorized by the Registration Authority, may inspect the premises of the owner of any dog and such owner shall allow that person to enter and inspect his/her premises at all reasonable times. Such officer/official shall also be authorized to search the places where dogs are kept without registration and to seize them.

13. Penalty. —

(i) Any contravention of these Bye-Laws including the failure to register the dog, failure to follow guidelines for breeders, guidelines for dog care centre as per clause 3, 7, 8 above, shall be punishable with fine which may extend to Rs.10,000/- and in case of continuous breach additional fine which may extend to Rs. 100/- per day till such contravention or breach continues shall be imposed. Repeal and saving. —

14. Repeal and saving. —

(i) The bye-laws published vide H.P. Govt. Notification No. LSG-B(3)15/82, dated 19-9-1984 are hereby repealed. Not with standing such repeal anything done or any action taken in exercise of the powers conferred by or under the bye-laws so repealed shall be deemed to have been done or taken in exercise of the powers conferred by or under these bye-laws which were enforced on the day on which such thing was done or was taken.

Undertaking from the owner of the Dog for registration

1. I do not have more than two dogs

2. I shall keep the dog protected by getting it vaccinated against rabies from a Govt. Veterinary Practitioner or Veterinary Practitioner duly registered with Indian Veterinary Council (IVC) or State Veterinary Council (SVC).

3. I will furnish the vaccination certificate on demand during Inspection by Registration Authority or any officer/official of the Municipal Corporation duly authorized by the Registration Authority or within a period of 10 days from such Inspection, failing which registration of the dog may be cancelled.

4. I will keep the dog chained/leashed while taking it outside. All ferocious dogs shall be duly muzzled and a stick shall be carried by the Escort accompanying the dog while taking it out.

5. I will ensure that the dog will wear a collar affixed with the metal token issued by the Registration Authority at all the times.

6. I will compensate the person if a dog bites or causes harm to any person or to the property of any person.

7. I shall keep the dog under my control all the times, so that it does not intimidate, annoy, hurt or bite any person. I shall not make Municipal Corporation responsible for any loss, damage or Injury caused by a registered dog to any person or to his/her property and sole liability to compensate the victim will remain with me.

8. I shall not indulge in breeding of dogs for commercial purposes and trading of dogs within the area of Municipal Corporation. In case it is found that dog is being kept for breeding or trading/commercial purposes by me, the Registration Authority shall impound my dog/s besides imposing a fine as fixed by the Commissioner, Municipal Corporation, Chowari upon me.

9. I shall not allow the dog to defecate in public places such as residential areas, green belts, parks, streets, roads, road beams and other common places etc. In case the dog defecates at the above specified places, I shall arrange to get the excreta of the dog removed from the said place at my own level. I shall not allow the dog to defecate near the residences of other persons, neighbors to their annoyance.

भारत गणराज्य के छिहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश नगर निगम (द्वितीय संशोधन) अधिनियम, 2025 है।

(2) यह 1 नवम्बर, 2025 को प्रवृत्त हुआ समझा जाएगा।

2. धारा 36 का संशोधन.--हिमाचल प्रदेश नगर निगम अधिनियम, 1994 की धारा 36 में,- (क) उप-धारा (1) में ''और तत्पश्चात्‌ प्रत्येक अढ़ाई वर्ष के अवसान पर'' शब्दों का लोप किया जाएगा; और

(ख) उप-धारा (2) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

''(2) निगम के महापौर और उप महापौर की पदावधि उसके निर्वाचन की तारीख से पांच वर्ष की होगी, जब तक कि इस बीच महापौर या उप महापौर के रूप में वह अपने पद से12476 राजपत्र, हिमाचल प्रदेश, 05 मार्च, 2026/14 फाल्गुन, 1947 त्यागपत्र नहीं दे देता या जब तक उप महापौर के मामले में वह महापौर के रूप में निर्वाचित नहीं कर दिया जाता और वह अपनी पदावधि के अवसान पर अपने पद पर नहीं रहेगाः

परन्तु यदि महापौर या उप महापौर का पद रिक्त हो जाता है या इस कार्यकाल के दौरान मृत्यु, त्यागपत्र या अविश्वास प्रस्ताव के कारण रिक्त हो जाता है तो रिक्ति होने के एक मास की अवधि के भीतर उसी वर्ग से शेष अवधि के लिए नया निर्वाचन करवाया जाएगा।''।

3. निरसन और व्यावृत्तियां.--(1) हिमाचल प्रदेश नगर निगम (संशोधन) अध्यादेश, 2025 (2025 का 4) का एतद्‌द्वारा निरसन किया जाता है।

(2) ऐसे निरसन के होते हुए भी इस प्रकार निरसित अध्यादेश के अधीन की गई कोई बात या कार्रवाई इस अधिनियम के तत्स्थानी उपबन्धों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

further to amend the Himachal Pradesh Municipal Corporation Act, 1994 (Act No.12 of

1994).

BE it enacted by the Legislative Assembly of Himachal Pradesh in Seventy-sixth Year of the Republic of India as follows:—

1. Short title and commencement.—(1) This Act may be called the Himachal Pradesh Municipal Corporation (2nd Amendment) Act, 2025.

(2) It shall be deemed to have come into force on the 1st day of November, 2025.

2. Amendment of section 36.—In section 36 of the Himachal Pradesh Municipal Corporation Act, 1994,—

(a) in sub-section (1), the words "and thereafter at the expiration of every two and half years", shall be omitted; and

(b) for sub-section (2), the following shall be substituted, namely:—

"(2) The term of office of the Mayor and Deputy Mayor of the Corporation shall be five years from the date of election, as such, unless in the mean time he resigns his office as Mayor or Deputy Mayor or unless in the case of Deputy Mayor is elected as the Mayor and he shall cease to hold his office on the expiry of his term of office:

Provided that if the office of the Mayor or Deputy Mayor is vacated or falls vacant during the tenure on account of death, resignation or no-confidence motion, a fresh election within a period of one month of the vacancy shall be held from the same category, for the remainder period. ".

3. Repeal and saving.—(1) The Himachal Pradesh Municipal Corporation (Amendment) Ordinance, 2025 (4 of 2025) is hereby repealed.

(2) Notwithstanding such repeal, any action taken or anything done under the Ordinance so repealed, shall be deemed to have been done or taken under the corresponding provisions of this Act.

उपरोक्त मुकद्दमा विवाह पंजीकरण व अदालत सहायक समाहर्ता प्रथम श्रेणी एवम्‌ तहसीलदार इन्दौरा की अदालत में विचारधीन है। जिसमें सायल श्री गगन सिंह पुत्र प्रेम सिंह, निवासी गांव पलाख, तहसील इन्दौरा, जिला कांगड़ा (हि0प्र0) ने प्रार्थना-पत्र दायर किया है कि दिनांक 21-04-2024 को मैंने सुमन कुमारी पुत्री धर्म सिंह, निवासी गांव पलाख, तहसील इन्दौरा, जिला कांगड़ा (हि0प्र0) से हिन्दू रिति-रिवाजों के अनुसार समस्त परिवार सदस्यों व रिश्तेदारोेेेेेेेेेेेें की उपस्थिति में शादी की है लेकिन अनभिज्ञता के कारण ग्राम पंचायत पलाख के विवाह पंजीकरण रजिस्टर में पंजीकरण नहीं करवाया है, अतः अब अदालत के आदेशानुसार दर्ज करवाना चाहता है।

अतः सर्वसाधारण को इस मुश्त्री मुनादी के माध्यम से सूचित किया जाता है कि इस विवाह पंजीकरण के बारे में यदि किसी को उजर/एतराज हो तो वह उक्त तिथि 13-03-2026 को असालतन/वकालतन अदालत हजा में पेश होकर अपना पक्ष रखे अन्यथा एकतरफा कार्यवाही अमल में लाई जाकर उपरोक्त मुकद्दमा का फैसला कर दिया जाएगा।

. . प्रतिवादीगण। प्रार्थना-पत्र हि0प्र0 मुजारियत एवं भूमि सुधार अधिनियम, 1972 की धारा 104 (3) के तहत मालकाना हक बारे।

यह आवेदन-पत्र वादीगण गिरधारी लाल आदि ने हि0प्र0 मुजारियत एवं भूमि सुधार अधिनियम, 1972 की धारा 104 (3) के तहत अराजी खेवट/खतौनी नं0 148/167, खसरा नं0 479/155, रकबा तदादी 30-2 बीघा महाल बडोटा, तहसील घुमारवीं, जिला बिलासपुर में मालकाना हक प्रदान करने बारा न्यायालय में पेश किया। प्रार्थी ने समस्त कागजात संशोधित प्रार्थना-पत्र, हल्फी ब्यान व समस्त नकल जमाबन्दियां संलग्न करते हुए निवेदन किया है कि उनका उपरोक्त खाता/खतौनी में खाना काश्त में गैर मौरूसी का इन्द्राज चला आ रहा है। तथा वे ही उपरोक्त भूमि काश्त करते चले आ रहे है। उपरोक्त भूमि पर प्रतिवादी का कोई मौका कब्जा नहीं है। तथा इसलिए वादीगण ने उपरोक्त आरजी में मालकाना हक बारे दरख्वास्त की है। तथा प्रार्थना की है कि मुताबिक मौका व कब्जा काश्त के अनुसार कागजात माल मे प्रार्थीगण को गैर मौरूसी के बजाये मालिक बनाया जाकर खाना मलकीयत में बतौर मालिक दर्ज किया जावें।

अतः अब उपरोक्त प्रतिवादीगण को राजपत्र हि0प्र0 के माध्यम से सूचित किया जाता है कि यदि उपरोक्त प्रतिवादीगण को प्रार्थीगण के द्वारा दायर वाद के सम्बन्ध में कोई उजर व एतराज हो तो वह अपना उजर व एतराज मिति 30-03-2026 को प्रातः 11.00 बजे कार्यालय नायब तहसीलदार भू-व्यवस्था वृत्त घुमारवीं में अधोहस्ताक्षरी के समक्ष पेश कर सकते हैं। किसी से उजर व एतराज न आने की सूरत में वादीगण को खाना काश्त में काश्त व कब्जा स्वयं मुताबिक करने बारा आदेश प्रदान किये जायेंगे। किसी से उजर व एतराज न आने की सूरत में वादीगण को खाना काश्त में काश्त व कब्जा स्वयं मुताबिक करने बारा आदेश प्रदान किये जायेंगे।
