ेड लाइस(cid:336)स)/2026-(2).—कहमाचल (cid:366)दे नगर कनगम (cid:354)मांि: एम0ॉिप(cid:330)0/ ब(cid:542)ी/ बाई लॉ (ट(cid:332) अकधकनयम, 1994 ीि धारा 395 ेि साथ पकठत अ(cid:559)ाय XVIII ेि अंतग(cid:330)त (cid:366)द(cid:517) (cid:304)(cid:389)यं ाि (cid:366)र्योग रिते (cid:352)ए, 269-राजपत्र/2025-10-03-2026 (12743)12744 राजपत्र, हिमाचल प्रदेश, 10 मार्च, 2026/19 फाल्गुन, 1947 नगर कनगम ब(cid:542)ी (cid:554)ारा कनकम(cid:330)त कन(cid:635)कल(cid:304)खत (cid:366)ा(cid:349)प उप-कवकधयँ (Draft By-Laws) सामा(cid:586) जन ीि जानािरी तथा उनसे सुझाव एवं आपक(cid:517)यँ आमंक(cid:361)त रिने ेि उ(cid:542)े(cid:692) से (cid:366)ािकत ीि जाती ह(cid:339)।

यकद इन (cid:366)ा(cid:349)प उप-कवकधयं ेि संबंध म(cid:336) कसिी (cid:681)(cid:304)(cid:389) र्ोि र्ोिई सुझाव अथवा आपक(cid:517) र्हो, र्तो वह इस अकधसूचना ेि राजप(cid:361) (Official Gazette) म(cid:336) (cid:366)ािन ीि कतकथ से 30 (तीस) कदनं ेि भीतर नगर कनगम ब(cid:542)ी ेि ािया(cid:330)लय म(cid:336) कल(cid:304)खत (cid:349)प म(cid:336) (cid:366)(cid:721)ुत ीि जा सतिी है।

1. संक(cid:407)(cid:593) ीष(cid:330)ि, (cid:407)े(cid:361)ाकधािर एवं (cid:366)वत(cid:330)न :–

(i) इन (cid:366)ा(cid:349)प उप-कवकधयं र्ोि "नगर कनगम ब(cid:542)ी–प(cid:303)रसर ेि उपर्योग एवं प(cid:303)रसर म(cid:336) व(cid:721)ुओं ेि भंडारण हेतु (cid:681)ापार अनु(cid:466)ा (cid:366)दान रिने संबंधी उप-कवकधयँ, 2026" हिा जाएगा। (ii) र्ोिई भी (cid:681)(cid:304)(cid:389) अथवा (cid:681)वसाय संचालि, Himachal Pradesh Municipal Corporation Act, 1994 ेि अ(cid:559)ाय XVIII ीि धारा 324 एवं (cid:366)थम अनुसूची ेि (cid:366)ावधानं तथा उनेि अंतग(cid:330)त कनकम(cid:330)त उप-कवकधयं ेि अनुसार जारी लाइस(cid:336)स (cid:366)ा(cid:593) कएि कबना र्ोिई भी (cid:681)ापा(cid:303)रि गकतकवकध (cid:366)ारं भ या संचाकलत नहीं रिे गा।

(iii) ये उप-कवकधयँ इस कनगम ीि नगरपाकलाि सीमा ेि अंतग(cid:330)त आने वाली सभी दुािनं/प(cid:303)रसरं पर लागू हंगी, कज(cid:590)(cid:336) अ(cid:559)ाय XVIII ीि धारा 324 तथा Himachal Pradesh Municipal Corporation Act, 1994 ीि (cid:366)थम अनुसूची ेि भाग-I एवं भाग-II म(cid:336) कनकद(cid:330) (cid:700) (cid:366)र्योजनं ेि कलए, प(cid:303)रसर ेि उपर्योग एवं/अथवा कसिी भी व(cid:721)ु ेि भंडारण हेतु, लाइस(cid:336)स ेि कबना उपर्योग नहीं कयिा जा सेि गा। (भाग-I एवं भाग-II उप-कवकधयं ेि अंत म(cid:336) संल(cid:432) ह(cid:339)।)

2. प(cid:303)रभाषाएँ .— इन उप-कवकधयं म(cid:336), जब ति संदभ(cid:330) से अ(cid:586)था अकभ(cid:366)ेत न र्हो :–

()ि "अकधकनयम" से अकभ(cid:366)ाय Himachal Pradesh Municipal Corporation Act, 1994 (अकधकनयम सं(cid:421)ा 12, 1994) से है।

(ख) "(cid:366)ाकधृि त अकधािरी" से अकभ(cid:366)ाय आयु(cid:389) या नगर कनगम, ब(cid:542)ी ेि आयु(cid:389) (cid:554)ारा कवेष (cid:349)प से अकधृि त कसिी अ(cid:586) अकधािरी से है।

(ग) "कनरी(cid:407)ि" से अकभ(cid:366)ाय (cid:738)(cid:453)ता कनरी(cid:407)ि अथवा आयु(cid:389) (cid:554)ारा कवकधवत अकधृि त नगर कनगम ेि कसिी अ(cid:586) अकधािरी/मि(cid:330)चारी से है।

(घ) "लाइस(cid:336)स" से अकभ(cid:366)ाय आयु(cid:389) या आयु(cid:389) (cid:554)ारा कवकधवत अकधृि त कसिी अ(cid:586) अकधािरी (cid:554)ारा, इन उप-कवकधयं ेि अंत म(cid:336) संल(cid:432) भाग-I एवं भाग-II म(cid:336) कनकद(cid:330) (cid:700) व(cid:721)ुओं ेि कव(cid:354)य/भंडारण हेतु, कसिी (cid:681)(cid:304)(cid:389), (cid:738)ामी एवं प(cid:303)रसर ेि अकधर्भोगी ेि प(cid:407) म(cid:336) (cid:366)दान ीि गई कल(cid:304)खत अनुमकत से है।

(ङ) "लाइस(cid:336)कसंग अकधािरी" से अकभ(cid:366)ाय आयु(cid:389) या आयु(cid:389) (cid:554)ारा इन उप-कवकधयं ेि (cid:366)ावधानं ेि अंतग(cid:330)त लाइस(cid:336)स (cid:366)दान/नवीनीरिण हेतु कवकधवत अकधृि त कसिी अ(cid:586) अकधािरी से है।

(च) "प(cid:303)रसर" से अकभ(cid:366)ाय कसिी भी दुािन/भंडार/(cid:830)थान से है, जहँ भाग-I एवं भाग-II म(cid:336) कनकद(cid:330) (cid:700) व(cid:721)ुएँ कव(cid:354)य/भंडारण हेतु रखी जाती ह(cid:339)।12745 राजपत्र, हिमाचल प्रदेश, 10 मार्च, 2026/19 फाल्गुन, 1947 (छ) "लघु (cid:373)ेणी (cid:681)वसाय/(cid:681)ापार" से अकभ(cid:366)ाय अकधतिम 25 वग(cid:330) फु ट (cid:407)े(cid:361)फल वाले प(cid:303)रसर से है; "म(cid:559)म (cid:373)ेणी (cid:681)वसाय/(cid:681)ापार" से अकभ(cid:366)ाय 25 वग(cid:330) फु ट से 100 वग(cid:330) फु ट ति ेि (cid:407)े(cid:361)फल वाले प(cid:303)रसर से है; तथा "बे (cid:373)ेणी (cid:681)वसाय/ (cid:681)ापार" से अकभ(cid:366)ाय 100 वग(cid:330) फु ट से अकधि (cid:407)े(cid:361)फल वाले प(cid:303)रसर से है।

(ज) "दुािनदार" से अकभ(cid:366)ाय कसिी भी ऐसे (cid:681)(cid:304)(cid:389) से है र्जो दुािन/प(cid:303)रसर/(cid:830)थान ाि संचालन एवं (cid:366)बंधन रिता र्हो, कजसम(cid:336) उसाि (cid:738)ामी/अकधर्भोगी भी स(cid:304)(cid:643)कलत है, परं तु अकत(cid:354)मणतिा(cid:330) इसम(cid:336) स(cid:304)(cid:643)कलत नहीं र्होगा।

(झ) इन उप-कवकधयं म(cid:336) (cid:366)यु(cid:389) वे (cid:616) एवं अकभ(cid:681)(cid:304)(cid:389)यँ, र्जो यहँ प(cid:303)रभाकषत नहीं ह(cid:339), उनाि वही अथ(cid:330) या आय र्होगा र्जो Himachal Pradesh Municipal Corporation Act, 1994 म(cid:336) कनकद(cid:330)(cid:700) है।

3. लाइस(cid:336)स (cid:366)ा(cid:593) रिने ीि (cid:366)क(cid:354)या.—र्ोिई भी (cid:681)(cid:304)(cid:389) र्जो भाग-I म(cid:336) कनकद(cid:330) (cid:700) कसिी (cid:681)वसाय/(cid:681)ापार र्ोि संचाकलत रिना चाहता है तथा/अथवा भाग-II म(cid:336) कनकद(cid:330) (cid:700) कसिी व(cid:721)ु ाि भंडारण रिना चाहता है, वह नगर कनगम ब(cid:542)ी ेि (cid:407)े(cid:361)ाकधािर म(cid:336) (cid:681)वसाय (cid:366)ारं भ रिने से पूव(cid:330) लाइस(cid:336)स हेतु ऑनलाइन र्पोट(cid:330)ल https://citizenseva.hp.gov.in/hp-udd/ ेि मा(cid:559)म से आवेदन रिे गा। इस (cid:366)ावधान ाि उ(cid:671)ंघन कएि जाने ीि (cid:304)(cid:830)थकत म(cid:336), इन उप-कवकधयं म(cid:336) कनधा(cid:330)(cid:303)रत दं ड आर्रोकपत कयिा जाएगा।

4. लाइस(cid:336)स ीि अवकध.—लाइस(cid:336)स एि वष(cid:330) अथवा एि बार म(cid:336) पांच वष(cid:330) ीि अवकध ेि कलए जारी कयिा जाएगा तथा उ(cid:389) अवकध ीि समा(cid:304)(cid:593) पर लाइस(cid:336)स (cid:738)तः समा(cid:593) र्हो जाएगा।

5. लाइस(cid:336)स ाि नवीनीरिण.—लाइस(cid:336)सधारी र्ोि लाइस(cid:336)स ीि वैधता अवकध समा(cid:593) र्होने ेि प(cid:686)ात उसाि नवीनीरिण रिाना अकनवाय(cid:330) र्होगा। यकद नवीनीरिण हेतु आवेदन लाइस(cid:336)स ीि समा(cid:304)(cid:593) ीि कतकथ से एि माह ेि भीतर (cid:366)(cid:721)ुत कयिा जाता है, र्तो कसिी (cid:366)ािर ाि कवलंब ु(cid:651) दे य नहीं र्होगा।

6. लाइस(cid:336)स ाि ह(cid:721)ांतरण.—इन उप-कवकधयं ेि अंतग(cid:330)त जारी कयिा गया लाइस(cid:336)स कसिी अ(cid:586) (cid:681)(cid:304)(cid:389) ेि नाम ह(cid:721)ांत(cid:303)रत नहीं कयिा जाएगा, कसवाय मूल लाइस(cid:336)सधारी ीि मृ(cid:529)ु ीि (cid:304)(cid:830)थकत म(cid:336)। ऐसी दा म(cid:336), वैधता अवकध ीि ेष अवकध ेि कलए, आव(cid:692)ि द(cid:721)ावेज (cid:366)(cid:721)ुत कएि जाने पर, लाइस(cid:336)स ेि वल कवकधि उ(cid:517)राकधाि(cid:303)रयं ेि नाम पर ह(cid:721)ांत(cid:303)रत कयिा जाएगा। इस संबंध म(cid:336) कनण(cid:330)य आयु(cid:389) (cid:554)ारा (cid:366)रिण ीि प(cid:303)र(cid:304)(cid:830)थकतयं र्ोि (cid:559)ान म(cid:336) रखते (cid:352)ए कलया जाएगा।

7. लाइस(cid:336)स ु(cid:651) :–

(ि) लाइस(cid:336)स (cid:366)दान कएि जाने हेतु दे य ु(cid:651) ाि कनधा(cid:330)रण आयु(cid:389) (cid:554)ारा समय-समय पर कयिा जाएगा। तथाकप, ु(cid:651) ीि गणना वाकष(cid:330)ि लाइस(cid:336)स ु(cid:651) दर ेि आधार पर ीि जाएगी, कजसे आवेदि (cid:554)ारा मँगी गई लाइस(cid:336)स ीि अवकध (वष(cid:344) ीि सं(cid:421)ा) से गुणा कयिा जाएगा। ु(cid:651) कन(cid:635)कल(cid:304)खत (cid:366)ािर से अकधर्रोकपत/वसूल कयिा जाएगा :–

नगर कनगम ेि अकधािर (cid:407)े(cid:361) ेि अंतग(cid:330)त (cid:529)ौहारं/मेलं अथवा कसिी अ(cid:586) अवसर पर (cid:830)थाकपत लघु/म(cid:559)म/बे दुािनं/(cid:720)ॉलं से वसूल ीि जाने वाली ु(cid:651) राक ाि कनधा(cid:330)रण आयु(cid:389), नगर कनगम ब(cid:542)ी (cid:554)ारा समय-समय पर कयिा जाएगा।

((cid:729)(cid:700)ीरिणाथ(cid:330).—लघु दुािन/(cid:720)ॉल से अकभ(cid:366)ाय अकधतिम 25 वग(cid:330) फु ट (cid:407)े(cid:361)फल वाले प(cid:303)रसर से है; म(cid:559)म दुािन/(cid:720)ॉल से अकभ(cid:366)ाय 25 वग(cid:330) फु ट से 100 वग(cid:330) फु ट ति ेि (cid:407)े(cid:361)फल वाले प(cid:303)रसर से है; तथा बे दुािन/(cid:720)ॉल से अकभ(cid:366)ाय 100 वग(cid:330) फु ट से अकधि (cid:407)े(cid:361)फल वाले प(cid:303)रसर से है।)

(ख) नगर कनगम (cid:407)े(cid:361) म(cid:336) कफ(cid:669)/चलकच(cid:361)/वृ(cid:517)कच(cid:361)/टीवी धारावाकहि/संगीत ए(cid:667)म/कव(cid:466)ापन आकद ीि ूकटंग हेतु अनुमकत ेि कलए ु(cid:651) संरचना:—

8. लाइस(cid:336)स (cid:366)दान रिने ीि त(cid:338) :—

(i) लाइस(cid:336)स ेि वल उ(cid:590)ीं व(cid:721)ुओं/सामक(cid:356)यं ेि कलए मा(cid:586) र्होगा, कजनेि कलए इन उप-कवकधयं ेि अंतग(cid:330)त इसे (cid:366)दान कयिा गया है। कसिी अ(cid:586) (cid:366)र्योजन हेतु यह मा(cid:586) नहीं र्होगा। (ii) जब ति लाइस(cid:336)स म(cid:336) अ(cid:586)था उ(cid:671)े(cid:304)खत न र्हो, यह अनुमकत आयु(cid:389) (cid:554)ारा कनधा(cid:330)(cid:303)रत त(cid:344) ेि अधीन, नगर कनगम ीि संपूण(cid:330) सीमा म(cid:336) वैध र्होगी।

(iii) प(cid:303)रसर ाि (cid:738)ामी/अकधर्भोगी, कनरी(cid:407)ि अथवा लाइस(cid:336)कसंग अकधािरी (cid:554)ारा मँगे जाने पर कसिी भी समय लाइस(cid:336)स (cid:366)(cid:721)ुत रिने ेि कलए बा(cid:559) र्होगा।

(iv) आयु(cid:389) र्ोि Himachal Pradesh Municipal Corporation Act, 1994 ेि अ(cid:559)ाय XVIII ेि (cid:366)ावधानं ेि अंतग(cid:330)त, लाइस(cid:336)स म(cid:336) उपयु(cid:389) समझी जाने वाली कसिी भी त(cid:330) र्ोि लगाने या र्संोकधत रिने ाि अकधािर र्होगा।

(v) आवेदि र्ोि प(cid:303)रसर ेि संबंध म(cid:336) (cid:366)(cid:721)ुत ीि गई जानािरी, जैसे—(cid:681)वसाय/(cid:681)ापार ाि (cid:366)ािर, (cid:407)े(cid:361)फल, मानकच(cid:361) ीि (cid:738)ीृि कत तथा संपक(cid:517) ाि (cid:738)(cid:349)प (वाकण(cid:304)(cid:475)ि अथवा आवासीय आकद) — ेि स(cid:529) र्होने संबंधी एि (cid:738)-र्घोषणा (Self-Declaration) (cid:366)(cid:721)ुत रिनी र्होगी, र्जो उसेि (cid:466)ान एवं कव(cid:695)ास ेि अनुसार स(cid:529) र्होगी।

(vi) लाइस(cid:336)सधारी र्ोि प(cid:303)रसर म(cid:336) कव(cid:354)य अथवा भंडारण हेतु रखी गई व(cid:721)ुओं ाि समुकचत अकभलेख, लाइस(cid:336)कसंग अकधािरी ीि अपे(cid:407)ा अनुसार संधा(cid:303)रत रिना र्होगा। साथ ही, लाइस(cid:336)सधारी आयु(cid:389) या लाइस(cid:336)कसंग अकधािरी (cid:554)ारा समय-समय पर जारी कनद(cid:337) ं एवं आदे ं ाि पालन रिे गा।

(vii) लाइस(cid:336)सधारी नगर कनगम ेि सभी दे यंि ाि समय पर भुगतान सुकनक(cid:686)त रिे गा।12747 राजपत्र, हिमाचल प्रदेश, 10 मार्च, 2026/19 फाल्गुन, 1947 (viii) लाइस(cid:336)स जारी रिने ीि समय-सीमा.—लाइस(cid:336)स ाि कनग(cid:330)मन Himachal Pradesh Public Service Guarantee Act, 2011 ेि अंतग(cid:330)त इस सेवा ेि कलए अकधसूकचत/कनधा(cid:330)(cid:303)रत समय-सीमा ेि अनुसार कयिा जाएगा।

9. कवलंब ु(cid:651) :–

यकद र्ोिई (cid:681)(cid:304)(cid:389) कनधा(cid:330)(cid:303)रत अवकध ेि भीतर लाइस(cid:336)स ाि नवीनीरिण रिाने म(cid:336) असफल रहता है, र्तो उसे कवलंकबत अवकध ेि कलए कन(cid:635)ानुसार कवलंब ु(cid:651) जमा रिना र्होगा :–

(i) (cid:366)थम माह ेि कलए – लाइस(cid:336)स ु(cid:651) ाि 50%

(ii) क(cid:554)तीय माह ेि कलए – लाइस(cid:336)स ु(cid:651) ाि 75%

(iii) एि वष(cid:330) ति – लाइस(cid:336)स ु(cid:651) ाि 100%

(iv) र्दो वष(cid:330) ति – लाइस(cid:336)स ु(cid:651) ाि 125%

(v) ेष अवकध ेि कलए – लाइस(cid:336)स ु(cid:651) ाि 150%

10. लाइस(cid:336)स अ(cid:738)ीृि कत :–

(1) कन(cid:635)कल(cid:304)खत प(cid:303)र(cid:304)(cid:830)थकतयं म(cid:336) लाइस(cid:336)स (cid:366)दान नहीं कयिा जाएगा:– (ि) कसिी सं(cid:354)ामि र्रोग से पीकत (cid:681)(cid:304)(cid:389) र्ोि

(ख) ऐसे (cid:681)(cid:304)(cid:389) र्ोि र्जो Himachal Pradesh Municipal Corporation Act, 1994 ेि अ(cid:559)ाय XVIII म(cid:336) उ(cid:304)(cid:671)(cid:304)खत कसिी व(cid:721)ु ेि अवैध कव(cid:354)य या भंडारण ेि अपराध म(cid:336) र्दोषकसद्ध (Convicted) र्हो चुाि र्हो।

(ग) ऐसे (cid:681)(cid:304)(cid:389) र्ोि, र्जो इन उप-कवकधयं अथवा लाइस(cid:336)स ीि त(cid:344) ाि बार-बार उ(cid:671)ंघन रिता पाया गया र्हो।

(घ) 18 वष(cid:330) से मि आयु ेि (cid:681)(cid:304)(cid:389) र्ोि।

(2) (ि) उप-कवकध 10(1) ेि अधीन, र्जो र्ोिई (cid:681)(cid:304)(cid:389) इस संबंध म(cid:336) आयु(cid:389) या लाइस(cid:336)कसंग अकधािरी ेि सम(cid:407) आवेदन (cid:366)(cid:721)ुत रिता है तथा कनधा(cid:330)(cid:303)रत ु(cid:651) जमा रिता है, उसे लाइस(cid:336)स (cid:366)दान कयिा जाएगा, जब ति कि कल(cid:304)खत (cid:349)प म(cid:336) ािरण दज(cid:330) रिते (cid:352)ए उसे अ(cid:738)ीृि त न कयिा जाए।

(ख) लाइस(cid:336)स ेि ह(cid:721)ांतरण ेि समय, लाइस(cid:336)सधारी र्ोि (cid:366)कत लाइस(cid:336)स ` ____/- ीि दर से ह(cid:721)ांतरण ु(cid:651) दे य र्होगा।

(ग) लाइस(cid:336)सधारी लाइस(cid:336)स ीि त(cid:344) एवं कनयमं ाि पालन रिे गा तथा लाइस(cid:336)स र्ोि प(cid:303)रसर ेि कसिी सुकवधाजनि/(cid:729)(cid:700) (cid:349)प से कदखाई देने वाले (cid:830)थान या (cid:738)ागत (िcid:407) (Reception) म(cid:336) (cid:366)दक(cid:330)त रिे गा।

(घ) कनरी(cid:407)ि या संबंकधत कनरी(cid:407)ण मि(cid:330)चारी र्ोि प(cid:303)रसर म(cid:336) (cid:366)वे रि कनरी(cid:407)ण रिने ाि अकधािर र्होगा तथा लाइस(cid:336)सधारी ऐसे कनरी(cid:407)ण ेि दौरान आव(cid:692)ि सहर्योग (cid:366)दान रिे गा।12748 राजपत्र, हिमाचल प्रदेश, 10 मार्च, 2026/19 फाल्गुन, 1947 (ङ) लाइस(cid:336)सधारी कसिी भी (cid:366)ािर से साव(cid:330)जकनि माग(cid:344) या नगरपाकलाि नाकलयं पर अकत(cid:354)मण अथवा बाहर ीि ओर कनलिा (cid:352)आ (cid:366)(cid:407)ेपण (Overhanging Projection) नहीं रिे गा।

11. अपराध एवं दंड :–

(1) अपराध.—कन(cid:635)कल(cid:304)खत ृि (cid:529)/(cid:361)ुकटयँ इन उप-कवकधयं ेि अंतग(cid:330)त अपराध मानी जाएंंगी :– (ि) नगर कनगम ब(cid:542)ी से वैध (cid:681)ापार लाइस(cid:336)स (cid:366)ा(cid:593) कएि कबना भाग-I म(cid:336) सूचीब(cid:544) कसिी (cid:681)वसाय/(cid:681)ापार/गकतकवकध र्ोि (cid:366)ारं भ रिना, संचाकलत रिना या चलाना अथवा भाग-II म(cid:336) सूचीब(cid:544) कसिी व(cid:721)ु ाि भंडारण रिना।

(ख) लाइस(cid:336)स ीि अवकध समा(cid:593) र्होने, कनलंकबत र्होने या कनर(cid:721) कएि जाने ेि प(cid:686)ात भी (cid:681)वसाय/(cid:681)ापार ाि संचालन जारी रखना।

(ग) लाइस(cid:336)स ेि अनुदान/नवीनीरिण/ह(cid:721)ांतरण ेि कलए आवेदन रिते समय (cid:407)े(cid:361)फल, गकतकवकध ीि (cid:366)ृि कत या प(cid:303)रसर ीि (cid:373)ेणी ेि संबंध म(cid:336) कम(cid:538)ा (cid:366)कतपादन सकहत र्ोिई भी गलत, (cid:369)ामि, अपूण(cid:330) या अस(cid:529) जानािरी (cid:366)दान रिना।

NOTIFICATION

Dated, the 25th February, 2026

No. M.Corp./Baddi/Bye-Laws (Trade License)/2026-(2).—In exercise of the powers conferred under Chapter XVIII read with section 395 of the Himachal Pradesh Municipal Corporation Act, 1994, the following Draft By-Laws framed by the Municipal Corporation Baddi are hereby published for information and inviting suggestions and objections of the general public.

Suggestions and objections if any may be submitted in the Office of Municipal Corporation, Baddi within 30 (thirty) days from the date of publication of this notification in the Rajpatra (Official Gazette).

1. Short title, extent and commencement:–

(i) These Draft Bye-Laws may be called "Municipal Corporation Baddi- Grant of Trade License for Use of Premises and Storage of Articles in Premises Bye-Laws- 2026."

(ii) No person or business operator shall commence or carry on any business activity without a license issued as per the provisions under Section 324 of chapter XVIII & 1st schedule of the Himachal Pradesh Municipal Corporation Act, 1994 and the Bye-Laws made thereunder.

(iii) These Bye Laws shall apply to all shops/premises falling within the Municipal limits of this Corporation which may not be used without license for the purpose specified in Section 324 of chapter XVIII and Part-I and Part-II of 1st schedule of the HimachaI Pradesh Municipal Corporation Act, 1994 for use of premises and/or storage of any Article within the municipal limits. (Part-I and Part-II appended at the end of the Bye-Laws)

2. Definitions.—in these Bye-Laws, unless the context otherwise requires:—

(a) "Act" means the Himachal Pradesh Municipal Corporation Act. I994, (Act No. 12 of 1994).

(b) "Authorized Officer "means Commissioner or any other Officer specifically authorized by the Commissioner Municipal Corporation, Baddi.

राजपत्र, हिमाचल प्रदेश, 10 मार्च, 2026/19 फाल्गुन, 1947 (c) "Inspector" means Sanitary Inspector or any other Official of the Municipal Corporation duly authorized by the Commissioner.

(d) "License" means a written permission granted by the Commissioner, or any other official/Officer duly authorized by the Commissioner, in favour of the person, owner & occupier of premises for sale/storage of articles specified in Part-I and II appended at the end of these Bye-Laws.

(e) "Licensing Officer" means Commissioner or any other officer duly authorized by the Commissioner to grant/renew License under the provisions of these Bye-Laws.

(f) "Premises" means any shop/store/place where the articles specified in Part-I & II are kept for sale/storage.

(g) "Small Scale Business/Trade" means premises covering maximum area of 25 sq.ft., "Medium ScaleBusiness/Trade" means premises covering area of 25Sq.ft. to 100 sq.ft, and "large Scale Business/Trade" means premises covering area more than 100 sq.ft.

(h) "Shopkeeper" means any person running and managing the affairs of the shop/premises/place including its owner/occupier, but shall not include a trespasser.

(i) The words and expression defined under these Bye-Laws shall have the same meaning or sense as are defined in Himachal Pradesh Municipal Corporation Act 1994.

3. Procedure for obtaining License.—Any person who wants to operate/run any business/trade as specified in Part-I and/or store any article as specified in Part-II within the areas of the Municipal Corporation Baddi shall apply for license through the online portal https://citizenseva.hp.gov.in/hp-udd/. In case of violation of this provision, penalty as prescribed under these Bye-Laws shall be imposed.

4. Period of License.—The License shall be issued either for 1 year or for a period of five years at a time and the License shall automatically come to an end after completion of such period.

5. Renewal of License.—The License will have to be renewed by the license holder after the expiry of the validity period of license. The license shall be renewed without any late fee if the application of renewal is applied within 1 month after expiry of the license.

6. Transfer of License.—The license issued under the Bye-Laws shall not be transferred in the name of any person except in case of the death of original licensee wherein it shall be made/ transferred in the name of the legal heirs only for the validity period of license on production of supporting documents and shall be decided by the Commissioner keeping in view the circumstances of the case.

7. License Fee:

(a) The license fee for grant of license shall be decided by the Commissioner from time to time. However, the fee will be calculated on annual license fee12756 राजपत्र, हिमाचल प्रदेश, 10 मार्च, 2026/19 फाल्गुन, 1947 rate multiplied by number of years the license is requested by the applicant. The fee shall be charged in the following manner:—

The fees charged from small/medium/large Shops/Stalls put up during festivals/fairs or any other occasion within Municipal Corporation jurisdiction shall be decided by the commissioner, Municipal Corporation Baddi from time to time.

(for reference Small Shop/Stall means premises covering maximum area of

25 sq. ft., Medium Shop/Stall means premises covering area of 25 Sq. ft to

100 sq. ft. and large Shop/Stall means premises covering area of more than

100 Sq. ft.)

(b) Fee structure for permission for Shooting of the Films/Movies/ Documentaries/TV Serials/Musical Albums/Advertisements in MC area:—

8. Conditions for grant of license:—

(i) The License shall not be valid for any other purpose, except for the items/articles for which it is granted under these Bye Laws.

(ii) The permission shall, unless specified otherwise in the license, be valid in the entire Municipal Corporation limits, subject to such conditions as may be imposed by the Commissioner.

(iii) The owner/occupier of the premises shall have to produce the license before the inspector or the licensing officer at any point of time as may be demanded/ ordered by them.

(iv) The Commissioner shall have a right to impose or alter any of conditions in the license as may be deemed fit by him/her under the provisions of Chapter XVIII of the Himachal Pradesh Municipal Corporation Act, 1994.

(v) The applicant shall submit a self-declaration regarding information submitted by him/her about the premises to be used for business/trade viz. type of business, area, approval of map and nature of property i.e. commercial or domestic etc. to be true to the best of his knowledge and belief.

राजपत्र, हिमाचल प्रदेश, 10 मार्च, 2026/19 फाल्गुन, 1947 (vi) The licensee shall maintain proper records of the articles kept for sale or storage in the premises, as may be required by the Licensing Officer. Further, the licensee shall comply with all directions and instructions issued to him by the Commissioner or the Licensing Officer from time to time.

(vii) The licensee will ensure timely payment of all municipal dues

(viii) Time period for issue of License:—The license shall be issued as per the timelines notified/specified for this service under the Public Service Guarantee Act, 2011.

9. Late Fees.—In case the person fails to renew the license within the stipulated period, he/she shall have to deposit late fees for the delayed period as under:—

(i) @ 50% of the license amount for the first month, (ii) @ 75% for the second month, (iii) @ 100% upto one year, (iv) @ 125% upto two years, and (v) @ 150% for the remaining period.

10. Denial of License:

(1) The license shall not be granted:—

(a) to a person suffering from any contagious disease,

(b) to a person convicted for unlawful sale or storage of any articles mentioned in Chapter XVIII of the Himachal Pradesh Municipal Corporation Act, 1994, (c) to a person who has been found to have habitually committed breach of these Bye-Laws or the terms of the license,

(d) to a person below the age of 18 years.

(2) (a) Subject to Bye-Law 10(1), license to any person who applies to the Commissioner or Licensing Officer in this behalf and tenders the prescribed fee shall be granted by that officer, unless refused for reasons to be recorded in writing.

(b) The licensee shall be liable to pay transfer charges @_ /- per license at the time of transfer of license.

(c) The licensee shall abide by the terms and conditions of the license and the license shall be displayed at a convenient/conspicuous place or at the reception of the premises.

(d) The Inspector or inspecting staff concerned shall have the right to enter and inspect the premises, and the licensee shall provide necessary assistance during such inspection.

(e) The licensee shall not make any encroachment or overhanging projection on public streets or municipal drains in any manner.

(1) Offences.—The following acts/omissions shall constitute offences under these Bye-Laws:—

(a) Commencing, carrying on, or operating any business/trade/activity listed in Part-I or storing any article listed in Part-II without obtaining a valid Trade License from the Municipal Corporation, Baddi.

(b) Continuing to operate a business/trade after expiry, suspension, or cancellation of the license.

(c) Providing false, incorrect, misleading, or incomplete information at the time of applying for grant/renewal/transfer of license, including misrepresentation regarding the area, nature of activity, or category of premises.

(d) Violating any of the conditions specified in the license or any directions issued by the Commissioner or the Licensing Officer from time to time.

(e) Obstructing or refusing entry to the Inspector or any authorized officer during inspection, or failing to provide required records, documents, or assistance.

(f) Unauthorized transfer, lending, or misuse of the license by any person other than the licensee or his/her legal heir(s) as permitted under these Bye-Laws.

(g) Encroaching upon municipal land, public street, footpath, or municipal drain or causing obstruction by projecting goods, boards, articles, or any temporary/permanent structure.

(h) Storage/selling of prohibited articles or storage of articles in excess of the permitted quantity, or storage of hazardous materials not in compliance with safety norms prescribed by the Municipal Corporation or any other statutory authority.

(i) Tampering with, altering, or attempting to alter any license, official record, or document issued by the Municipal Corporation.

(j) Failure to display the license at a conspicuous place in the premises as required under these Bye-Laws.

(k) Failure to comply to the norms issued by the Government from time to time (l) Use of Child labor.

(2) Penalties.—Any person committing an offence under these Bye-Laws shall be liable to the following penalties:—

(a) Penalty for operating without a license.—A fine up to `5,000/- for Small Scale, `10,000/- for Medium Scale, and `25,000/- for Large Scale Business/Trade, in addition to immediate closure/sealing of the premises until a valid license is obtained.

(b) Penalty for operating after expiry of license.—A fine equivalent to 100% of the annual license fee, besides the late fee payable under Bye-Law 9.

(c) Penalty for violation of license conditions.—A fine upto `10,000/-, and in case of repeated violations, suspension or cancellation of the license.

(d) Penalty for providing false information or misrepresentation.—A fine up to `20,000/-, and cancellation of license with disqualification from applying for 1 year.

(e) Penalty for obstruction of inspection.—A fine upto `5,000/- and additional action as deemed appropriate by the Commissioner.

(f) Penalty for unauthorized encroachment.—A fine up to `10,000/- and removal of encroachment at the cost of the licensee. For repeated violations, sealing of premises may be ordered.

(g) Penalty for unauthorized transfer or misuse of license.—A fine upto `15,000/- and cancellation of the license.

(h) Penalty for unsafe or unauthorized storage of articles.—A fine upto `25,000/- and confiscation of hazardous/prohibited materials. The premises may be sealed in the interest of public safety.

12. Interpretation.—In case of any ambiguity in interpretation, orders of the competent authority (Commissioner, in this case will be final).

13. Amendments and Abolishment.—Any amendments to these laws additions or deletions if any will be decided by a committee to be headed by the Commissioner including stakeholders as he/she may deem fit for the purpose.

2. The dealer engaged in Wholesale as well as in retail sale business shall charge only one margin of profit on the transaction i.e. wholesale margin on wholesale transaction and retail sale margin on retail sale transaction. The wholesale margin shall be allowed at one stage only at one particular station.

3. Wholesale transaction would mean a single transaction of not less than the following:

(1) Foodgrains, Gur, Shakkar, Khandsari,

Sugar, Pulses, Salt. = One Quintal (2) Bread = Ten Number (3) Paper = One Ream (4) Eggs = One Hundred (5) Fruits and Vegetables = 20 Kgs (6) Meat, Chicken, Fish, Curd and Cottaeg Cheese =10 Kgs (7) Bottled Beverages = 24 Nos.

4. The below terms and conditions will be applicable for vegetables & fruits:—

(4.1) No Wholesaler or retailer shall charge more than the margin of profit as fixed above.

(4.2) Every Commission Agent/Wholesaler in Vegetable Market shall issue Form R to every farmer/grower at the time of purchase of fruits and vegetable form them and retain its one copy with him/her.

(4.3) Every Commission Agent/Wholesaler in Vegetable Market shall issue Form Q to every retailers showing rates of each fruit and vegetable sold to the retailers. On this Form/Cash memo, he or she shall display rate of the fruits/vegetables as per Form R and Charge his/her margin of profit/ commission as shown at column 3 above, which shall be shown separately on Form Q and he/she shall retains its one copy with him/her.

(4.4) The Dealer engaged in wholesale as well as in retail sale business shall charge only one margin of profit on the transaction i.e. wholesale margin on wholesale transaction and retail sale margin on retail sale transaction. The wholesale margin shall be allowed at one stage only at one particular station.

(4.5) Every Retailers shall display price list of the fruits and vegetables available with him/her in business premises in such a way that it may easily be seen by every customer.

(4.6) Wholesale transaction would mean a single transaction of not less than the following:

Fruits and Vegetables = 20 Kg.

(4.7) All sub Divisional Magistrates, all Deputy Superintendent of Police and all Inspectors Food Civil Supplies and Consumers Affairs, in Distt, Bilaspur shall ensure compliance of this notification in letter and spirit.

(4.8) The Secretary, APMC Bilaspur shall ensure issuance of Form-R and Form-Q by the Commission Agent in Vegetable markets in the district. This notification shall come into force from the date of its publication in official Gazette.

No. 2418.—The following Bye–Laws made by Nagar Panchayat Bhunter, for regulating Outdoor Advertisement and hoardings in exercise of the Power conferred under section 113 and section 202(o) of the Himachal Pradesh Municipal Act, 1994, Secretary, Nagar Panchayat Bhunter, Distt. Kullu, Himachal Pradesh hereby notifies the following Bye-Laws:—

ADVERTISEMENT BYE–LAWS–NAGAR PANCHAYAT BHUNTER

1. Title & Contents.—(i) These Bye-laws may be called the Nagar Panchayat Bhunter Outdoor Advertisement Bye-laws 2025.

(ii) These Bye-laws shall come in to force with immediate effect with in the limits of Nagar Panchayat Bhunter after the notification by the Government of Himachal Pradesh in the official gazette.

2. Definitions.—In these bye laws unless the contex to therwise requires:—

(i). "Act" means Himachal Pradesh Municipal Act, 1994

(ii). "Panchayat" means Nagar Panchayat Bhunter, Distt Kullu, H.P.

(iii). "Advertisement" shall mean any work, letter, model, sign, device, digital display, electronic display, name boards, direction boards, laser show, kiosk, LED, LCD, Backlit Board, Neon display, or representation supported on or attached to any post, pole, standard framework or other support wholly or in part upon or over any Private/ Public/State Govt./Central Govt./public Sector undertaking/Govt. Companies/Govt. Authorities etc., land/Spaces, building or structure which or any part of which shall be visible against the sky from some point in any street/Road includes all and every part of any such post, pole, parapet, standard framework or other support. It shall also include any balloon parachute or other similar employed wholly or in part for the purpose of any advertisement announcement or direction upon or over any land/spaces, building or upon or over any street. However, any display in the form of graffiti and civic messages published by Nagar Panchayat or any Government authorities (Having no commercial explanation) for the benefit of the citizen shall not be considered as an advertisement.

(iv) Advertisement on vehicle (movable) means single, double or multiple advertisement board affixed by means of sticker/boards on vehicle, side panel or12769 राजपत्र, हिमाचल प्रदेश, 10 मार्च, 2026/19 फाल्गुन, 1947 behind a vehicle in a manner that advertisement draw visibility while the vehicle is driven on the road. However, care must be taken to ensure that this does not impede traffic as well as pedestrians.

(v) Advertisement on vehicle (Parked) means single, double or multiple advertisement board affixed by means of sticker/boards on vehicle, side panel or behind a vehicle in a manner that advertisement draw visibility when vehicle is parked at strategic location. However, care must be taken to ensure that this does not impede traffic as well as pedestrians.

(vi) "Advertisement Regulation Committee" means Committee consisting of a) Secretary Nagar Panchayat Bhunter (b) Junior Engineer Nagar Panchayat, Bhunter (c) Sanitary Supervisor, Nagar Panchayat, Bhunter or other official of Nagar Panchayat Bhunter assigned by Secretary Nagar Panchayat Bhunter.

(vii) "Advertisement Zoning Plan" means the numbered plan signed by the Secretary and kept in this office defining the areas of special control and restrictions regarding the advertisement applicable to such areas.

(viii) "AreaofSpecial control" means as area so defined in the advertisement zoning plan.

(ix) "Enclosed Land" shall mean the land which is wholly or for the most part enclosed within the hedge fence, wall or similar screen or structure and shall not include Bus Stand together with the yards and for Court thereof, whether enclosed or not, any public park, public garden or other land held for the use or enjoyment of the public.

(x) "Illuminated advertisement" shall mean any advertisement with self-luminous by an outside source of light, but not include an illuminated display of goods if such display:—

(a). Is of goods merely bearing labels showing the name of article of its manufacturer or of other.

(b). Is made by lighting which is not, in the opinion of the Secretary more than which is necessary to make the goods labels visible at night.

(xi) "Name Plate" shall mean an advertisement announcing the name of owner and or name of occupier of a building and/or name of a building upon which such advertisement is fixed, exhibited painted, pasted retained or displayed, provided that the size of the letters constituting such advertisement does not exceed 2" in height and the total area does not exceed 4 square feet.

(xii) "Structure" shall include a post, pole, tree, bridge, embank and road surface and also a tram car, omnibus and any other vehicle any movable, board used primarily as an advertisement or advertising medium.

(xiii) "Schedule" means the schedule indicating the rate/fees for advertisements.

3. (A) Regulation and control of advertisement:—

No advertisement shall be erected, exhibited, fixed or retained upon or over any land, building, wall, boarding, frame, post or structure or place within the City without the written 12770 राजपत्र, हिमाचल प्रदेश, 10 मार्च, 2026/19 फाल्गुन, 1947 permission of the Secretary granted in accordance with Bye-laws made under this Act. Provided that no permission shal lbe required for any advertisement, which:—

(a) Appears in news papers, relates to public meeting, or to an election to Parliament or Legislative Assembly or the Nagar Panchayat Bhunter or to candidature in respect of such election; or

(b) is exhibited within the window of and building if the advertisement relates to the trade, profession or business carried on in that building; or

(c) relates to the trade profession or business carried on within the land or building upon or over which such advertisement is exhibited or to any sale or letting of such land or building or any effects therein or to any sale entertainment or meeting to be held on or up on or in the same; or

(d) relates to the name of the land or building upon or over which the advertisement is exhibited, or the name of the owner or occupier of such land or building; or (e) Relates to any activity of the Government or Union of India or the Nagar Panchayat Bhunter.

3. (B) Prohibition of Sticking, fixing hanging or painting bills, posters, advertisement, notices etc.—(i). Hoardings, advertisement/banners will not be allowed in the acquired width of the National/ State high way and other scheduled road and footpath as they cause traffic hazard and are against the instructions of the Govt. of India and Hon'ble Court.

(ii) No Hoarding, advertisements should be put at the place which effects or endangers the growth of flora and fauna.

(iii) No hoarding, advertisement should be located in thickly wooded area and no any kind of hoarding should be placed on trees.

(iv) No hoarding, advertisement should exceed dimension size of 30 Sq.Meters

(v) No hoarding, advertisement, banners should be put up in contravention of any law & rules against the guide lines notified by any department.

(vi) No hoarding ,advertisement should locate near a water source

(vii) No hoarding, advertisement should be in the form of writing, engraving, nailing and carving on any Natural or in animate object.

(viii) No hoarding, advertisement, banner will be allowed on the roofs of buildings, except with the permission of Secretary, Nagar Panchayat Bhunter.

(ix) Only sign board of premises are allowed up to 4 Sq m. between slab and lintel of the building to the occupier/ owner.

(x) Directional sign to Govt. offices, religious places will be allowed by the Nagar Panchayat Bhunter, The type,size and location of these shall be also approved by the Nagar Panchayat Bhunter. The PNP has to keep in view requisite site clearness, so that there is not traffic hazard due to in stallation of such board.

(xi) The Nagar Panchayat Bhunter shall provide notice board for the purpose of sticking, fixing or hanging posters, notice and advertisement, which shall be available for use on an application to be made to the Secretary on payment of fee provided for in these bye-laws.

(xii) No hoarding, advertisement should be located/ positioned on a sharp turn, "U" turns and blind turns.

(xiii) The beauty of nature for matters such as hills, rivers, trees and rock should not be destroyed by indiscriminate installation of commercial advertisement.

(xiv) No writing/ defacing of retaining walls and parapets could be allowed

4. Outdoor advertisement and road safety criteria:—

An advertisement device may be considered a traffic hazard:—

(a) If it interferes with road safety or traffic efficiency;

(b) If it interferes with the effectiveness of a traffic control device (e.g. traffic light,stop or give way sign);

(c) Distracts a driver at a critical time (e.g. making a decision at an intersection);

(d) Obscures a driver's view of a road hazard (e.g. at corners or bends on the road);

(e) Gives instructions to traffic to "Stop", "halt" or other (e.g. give way or merge);

(f) Imitates a traffic control device;

(g) Is a dangerous obstruction to road or other infrastructure, traffic, pedestrians, cyclists or other road users;

(h) Is in an area where there are several devices and the cumulative effect of those devices may be potentially hazardous; and

(i) If situated at locations where the demands on driver's concentration due to road conditions are high such as at major intersections or merging and diverging lanes;

(j) Name of advertisement agencies should be mentioned on every hoarding board.

5. Control of the physical characteristics of advertising devices shall be as

follows: —

(a) Advertising shall not contain flashing red, blue or amber point light sources which when viewed from the road, could give the appearance of an emergency service or other special purpose vehicle warning lights.

(b) All lighting associated with the Advertising Device shall be directed solely on the Advertising Device and its immediate surroundings.

(c) External illumination sources shall be shielded to ensure that external 'spot' light sources are not directed at approaching motorists.

(e) Upward pointing light of the device shall not be allowed, any external lighting is to be down ward pointing and focused directly on the sign so that glare does not extend beyond the Advertising Device.

(f) The average-maintained luminance shall be reduced to 0.5 candelas or all together shut from 11: pm till sunrise by automatic timing devices.

(g) Non-static illuminated Advertising Devices (flashing lights) are not permitted within the boundaries of municipal roads.

(h) Moving, rotating or variable message Advertising Devices are not permitted within the municipal boundaries as these cause a statistically significant distractive in fluence on motorist's response times to external stimuli.

However, this permission criterion is not intended to apply to variable message displays used by road authorities for traffic management or for displaying other Nagar Panchayat Bhunter's information. Variable message displays located at bus stops or similar places where messages are directed at- and intended for pedestrians (not motorists) are excluded.

6. Outdoor hoarding and their content criteria:—

The Municipal authority may take action to modify or remove any Advertising Device that contravenes the following negative advertisements or that otherwise cause a traffic hazard.

List of negative advertisements: —

• Nudity

• Racial advertisements or advertisements propagating caste, community or ethnic differences.

• Advertisement promoting drugs, alcohol, cigarette or tobacco items

• Advertisements propagating exploitation of women or child

• Advertisement having sexual overtone

• Advertisement depicting cruelty to animals

• Advertisement depicting any nation or institution in poor light

• Advertisement casting aspersion of any brand or person

• Advertisement banned by any law enacted by the Government of India • Advertisement glorifying violence

• Advertisement that exploits the national emblem or any part of Constitution of India, or the person or personality of a national leader or a state dignitary.

• Advertisements which may be defamatory, trade libelous, unlawfully threatening or unlawfully harassing .

• Advertisements which may be obscene or contain pornography or contain an "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986.

• Advertisement linked directly or indirectly to or include description of items, goods or services thatare prohibited under any applicable law for the time being in force, including but not limited to the Drugs and Cosmetics Act, 1940, the Drugs and Magic Remedies (Objectionable Advertisements) Act,1954, the Indian Penal Code, 1860; or

• Any other items consid eredinappropriate by the municipal bodies

For all categories of devices (except Category of devices which are directed at pedestrians), textelements on an Advertising Device, face should be easily discernible to travelling motorists. This willminimize driver's distraction. Additionally, a sign shall be quickly and easily interpreted so as toconvey the required advertising message to the viewer and reduce the period of distraction. The content or graphic layout exhibited on advertising device panel shall avoid hard-to-read and over layintricate typefaces and have letter styles that are appropriate. Under no circumstances should devicecontain information in text sizes which would necessitate the driver or passenger in a moving vehicle to stop, read and/or note down, which detrimental to the smooth flow of traffic and distracting for the driver. All signs shall be so designed as to maintain a proportion were, as a general rule letter should not appear to occupy more than 2% of the sign area unless otherwise permitted by the municipal bodies.

7. Prohibited areas and areas of special control and restrictions there-on:—

The Secretary may:—

(a) by order prohibit the erection, exhibition, fixation, retention or display of any or any class of advertisements in any street road or public park or park there of or in any placeor public resort;

(b) Regulate the erection, exhibition, fixation, retention or display any advertisements, in any manner in the prohibited areas and areas of special control, in accordance with the regulations indicated in the Advertisement Zoning Plans of the said areas.

Explanation.—The restrictions indicated in the advertisement zoning plans shall be in addition to those mentioned in the other clauses of the Bye-laws.

8. Classification of advertisement devices:—

The categories of the advertisement devices:—

Category 1: Large-format advertisement, mainly fixed on bill boards /uni-poles and bridge.

Category 3: Fleets, fliers and transport related infrastructure

Category4: Advertisement devices for self-advertising in commercial areas

9. Outdoor advertising and structure criteria:—

• Advertising Device structures including the foundations, for categories 1 and 2 devices, shall be designed and checked for extreme wind conditions, earthquakes, soil bearing capacity etc.and shall comply with relevant Indian structural design standards, codes of practice and Bye-laws guidelines. The designs shall be certified by an experienced and practicing structural engineer.

• The supporting structure shall have an on-reflective finish to prevent glare. The device structure shall be well maintained at all times. It shall be painted in colors that are consistent with, and enhance the surrounding area and will be compliant with the criteria or colors laid out earlier in the Bye-laws.

• Officia lroad furniture such as official signs and delineator guide-posts shall not be used as the supporting structure of an advertising device.

• The name of the Advertising Device license holder should be placed in a conspicuous position on the device.

10. Outdoor advertising devices and electrical connection:—

The electrical connections and components in all Advertising Devices shall be in accordance with relevant Indian Standards and designed to ensure there is no safety or traffic risk. No generator running on diesel/petrol/kerosene or any bio fuel, causing noise, air or water pollution would be allowed for providing power for illumination of any outdoor advertising device.

Electricity from renewable energy sources.

To promote conservation of electricity, if the illumination at outdoor advertising devices draws power from alternate renewable resources like solar power, such advertisement devices the license fee/charges will be half of the actual fee.

11. Permissibility of different category of advertising devices:—

As per schedule-I

12. Specific conditions:—

(a) No advertisement /hoarding should be placed in such a way that obstructs the mountain and valley view of Town. If such case is found, the Secretary can impose a penalty as he deems fit not exceeding a sum of twenty thousand rupees and remove thesaid advertisement.

(b) All advertisements outside the business area or the building which houses the business can be erected only after permission fromthe Nagar Panchayat Bhunter.

Every application received as per provision of these bye-laws shall be acknowledged and the decisionon it shall be taken within 30 working days from the date of receipt. If the decision is not taken within the prescribed period, it will be presumed that the required permission is granted subject to payment of due advertisement tax and license fee of the land use charges, wherever applicable and compliance of other clauses of Bye-laws.

14. Proceduretograntpermission:—

All advertisements, over the size of 100 sq. feet, (9.3 sq.m.) permitted over the Municipal land / building shall be through tenders. The tenders can be of single or more hoardings. The tender shall be invited by acommittee to be headed by Secretary or by his representative or in the exceptional circumstances by private experts. The committee shall fix the following minimum things before the tender;

(a) Reserveprice

(b) Location of the site/sites

(c) Size of advertisement

(d) Past revenue collection

(e) Number of sites

(f) Period of tender

The advertisement right shall be given for a period of 1 years or as may be decided by the Secretary Nagar Panchayat Bhunter. It shall be terminable at one month notice without assigning any reason. In the event of default of any terms, the same shall be terminable forth with without any notice. The tender bid will include the advertisement tax and rent for use of Nagar Panchayat Land/Property. However, payment of service tax or any other State/Central tax will be borne by the tendering agency/individual.

15. Procedure for obtaining permission-For grant of permission in respect of

advertisement of private property:—

The application for permission from the Secretary shall be accompanied with the following documents:—

1. Written no objection certificate from the landowner of the person, legally authorized to accord such NOC.

2. Three copies of plan showing the location, normsandsize of the advertisement/ hoardingetc. and a copy of the advertisement to be displayed.

3. The design and the structure shall be certified by an experienced and practicing Structural Engineer who shall certify the safety aspect from the point of view of its foundations which can bear extreme wind conditions, earth quakes, soil bearing capacity and shall comply with relevant India structural design standards policy and guidelines framed from time to time.

16. Fees on Advertisements:—

1. The advertisement fee shall be payable in advance annually/quarterly/monthly and daily basis as the case may be fixed by the Municipality from time to time provided that if the rate of fee is chargeable on annually, quarterly, daily or monthly basis, the fractions there of shall be construed accordingly.

2. New Advertisement shall not be exhibited unless the advertisement fee in advance as per the condition of sanctionis deposited.

3. Full monthly fee shall be chargeable if the advertisement duration is for more than 10 days. Amonth for this purpose shall be the calendar month-provided that where advertisement is to be displayed for part of a year and the fees fixed in the schedule are for one year, the fees payable part of the year shall be calculated on quarterly basis.

4. The fees shall be paid by the advertiser to the Nagar Panchayat Bhunter before the erection of the advertisement.

Calculation of fees

The advertisement fees should be calculated on the basis of the following factors:

(a) Categoryoftheadvertisement- Equal for all 1 factor

(b) Sizeoftheadvertisement- Rupees per sqm =

(i) Rs. 30 per sq.metre for One day.

(ii) Rs. 150 per sq. metre for One Month.

(iii) Rs. 1500 per sq. metre. for One Year.

(c) Location of the advertisement- Equal for all 1 factor

The value of the factors shall be decided by the general house of the Nagar Panchayat Bhunter for the first time and future amendments can be done by the Advertisement Regulations committee.

17. Functions of the Advertisement Regulation Committee:—

(I). The advertisement Regulation Committee shall identify the area of special control and prepare advertisement/zoning plans indicating the categories of advertisement devices permissible in different areas of Special Control.

(II). In case any practical difficulty arises with respect to implementation of these bye- laws of the zoning plans, the matter shall be referred to advertisement regulation committee who shall on reference consider and make suitable recommendations to the Secretary for the decision.

18. Penalties:—

Whoever contravenes any of these bye-laws shall be punishable with fine of Rupees 500/- for everyday, which may extend upto Ten thousand Rupees, when the contravention is continuing one.

If any dispute regarding advertisement holdings arises between Municipal authorities and any other person concerned with such advertisement holdings, such dispute may be referred by both parties to the Deputy Commissioner Kullu, who shall be sole arbitrator.

20. Jurisdiction:—

All disputes shall be subject to the jurisdiction of the Civil Courts at Kullu only

21. Indemnity:—

A licensee/sign owner/applicant (licensee) shall be required to indemnify the Municipal Authority forthe designated Advertising Device and activities against all actions, proceedings, claims, demands,costs, losses, damages and expenses which may be brought against, or made upon the Municipal Authority which arise as a result of the installation or existence of an Advertising Device. Such licensee/sign owners/applicant (licensee) shall always be responsible for any injury or damage caused or suffered by any person or property arising out of or relating to the display of device / advertisement and the consequential claim shall be borne by the advertiser who will also indemnify and safe guard the Municipal Authority in respect of any such claim or claims.

22. Removal of Illegal holdings:—

In case any holdings are found illegal, the Secretary may order its immediate removal subject togiving seven days prior notice. Removal shell be done by the Nagar Panchayat Bhunter, whose cost shall be borneby the defaulter himself. However, in case any holdings pose danger to the safety of general public requirement of serving seven days prior notice shall be dispensed with.

23. Insurance:—

• The Licensee in case of Category 1 and 2 Advertising Devices shall provide a public liability insurance policy for their respective rights, interests and liabilities to third parties in respect of accidental death or bodily injury to person(s) or damage to property.

The public liability Policy of Insurance shall be for an amount as specified by Municipal Authority for any single event (or such higher amount as may be notified in writing by the Municipal Authority from time to time) and on the terms as specified by the Municipal Authority.

24. Appeals:—

(a). Appeal against any decision of the Secretary relating to display of advertisement or any matter related thereto shall lie before, Director Urban Development Department.

(b). Before lodging an appeal, the affected person shall seek a review of the decision.

25. If there is any contradiction between these bye-laws and any judgment passed by Hon'ble Apex courtor High Court of Himachal Pradesh, then decision of Hon'ble court shall prevail over these bye-laws.

26. When a person desires to remove the advertisement, he will put the space as it was before.

No. MCT/2026-1951.—Whereas, the Municipal Council THEOG drafted the "MUNICIPAL COUNCIL THEOG Parivar Registar Bye-laws, 2026. "were published in the Hindi Punjab Kesari and Hindi Divya Himachal All Edition, under Section 217 read with Section 202 of the Himachal Pradesh Municipal Act, 1994.

And whereas, no objections were received from any quarter within the specified period of 15 days from the date of publication of these draft bye-laws.

In exercise of the powers conferred under section 202 read with section 48(1)19 of the Himachal Pradesh Municipal Act 1994 (Act. 12 of 1994), the Governor, Himachal Pradesh is pleased to notify the following rules, namely:—

1. Short title, extent and commencement.—(1) These rules may be called the Himachal Pradesh Municipal Council/Nagar Panchayat maintenance of Pariwar Register Rules, 2026.

(2) These rules shall come into force from the date of publication in the Rajpatra (e- Gazette) Himachal Pradesh.

2. Definitions.—(1) In these rules, unless the context otherwise requires:—

(a) "Act" means the Himachal Pradesh Municipal Act, 1994;

(b) "Bonafide" means a person who has a permanent home in Himachal Pradesh or includes a person who has been residing in Himachal Pradesh for a period of not less than 20 years or a person who has permanent home in Himachal Pradesh but on account of his occupation he is living outside Himachal Pradesh.

(c) "EO" means Executive Officer of Municipal Council;

(d) "Form" means a Form appended to these rules;

(e) "Secretary" means the Secretary;

(f) "Secretary of Ward Sabha" means the official appointed or nominated as such for the purpose of Section 51-B(2) of the Act;

(g) "Section" means a section of the Act;

(h) "Migration" means shifting from one Urban Local Bodies to other and PRI

to Urban Local Bodies or vice–versa, and;

(2) Words and expressions used but not defined in the rules, shall have the same meaning as assigned to them under the Act or under the Himachal Pradesh Municipal Act, 1994 or any other Act.

3. Making of Pariwar Register Record and its Revision:—

(1) (a) After Ward Sabha has come into existence in accordance with section 51-A of the Act, a Pariwar Register shall be prepared Ward wise for every Municipal Council in Form-1 appended to these rules. It shall contain the names and particulars of all persons, family-wise, who are the bonafide residents of the Municipal Council which forms part of the Ward Sabha area. The register shall be prepared by the Secretary of the Ward Committee and shall be verified by the Executive Officer/ Secretary of Municipal Council as the case may be.

(b) The Secretary of Ward committee shall cause to conduct door to door survey for enumeration of families of bonafide residents of the ward.

(c) The Executive Officer/Secretary of MC/NP shall notify and widely publicize the dates and area of starting of such door to door survey in atleast two local newspapers and pasted the notice at conspicuous places in the ward and office of ULB. The modalities of conducting such surveys shall be decided by the Director, UD.

(d) The information gathered by door to door survey shall be verified by Secretary, Ward Committee and countersigned by Executive Officer of MC.

After due approval of the House, the draft Parivar Register of MC made after compilation of ward Parivar Register shall be published in the Rajpatra of H.P. and also kept in office of ULBs for inspection by general public.

(f) The written objections received in office of ULB within fifteen Days of publication of Draft Parivar Register shall caused to be reverified by Secretary of Ward Committee within 07 days of closing of date of receiving objections by conducting summary inquiry, the amendments, if any, shall be incorporated in draft Parivar Register and the same shall be signed by Secretary, Ward Committee and countersigned by EO of MC.

(g) The final Parivar Register so prepared after compilation of verified ward Parivar Register shall be placed in House of MC and after application published in e- Rajpatra.

(2) At the close of each calendar year, the entries in the Pariwar Register, required to be prepared under sub-rule (1) shall be revised and all entries pertaining to births, deaths and marriages shall be updated in the Pariwar Register which had taken place during the preceding year i.e. upto 31st day of December. This revision shall be carried out strictly in accordance with the entries recorded in the "Birth & Death Register" and "Marriage Registration Register" maintained by the Municipal Council as per the provisions of Registration of birth & death Act, 1969 and HP Registration of Marriage Act, 1996 respectively. No other addition or alternation may be made without any authenticated evidence or certificate of the Member of concerned Ward of the Municipal Council. In the event of division of the family, separation of family may only be entered in the Pariwar Register on the decision of the concerned Ward Committee by passing a resolution by majority in its meeting on an application made by the head of family concerned. However, the Ward Committee shall take into consideration the definition of the family as defined under clause (19-a) of section 2 of the Act while deciding the matter regarding division of family. It shall be the duty of the Verifying Officer Senior in rank to the Secretary of Ward Sabha specially designated as such for this purpose by the Executive Officer/Secretary of Municipal Council to verify these entries after satisfying himself about the reasons recorded by the Secretary of concerned Ward Committee. He shall also put his initials on the Summary Sheet prepared by Secretary of Ward Committee on Form 1-A. In case of migration from one Urban Local Bodies to other and PRI to Urban Local Bodies or vice–versa, the applicant should obtain report on the prescribed format from the concerned officer/Official Incharge, for making necessary entries in the Parivar Register at the level of ULB.

Provided that no entry with regard to separation of family shall be made in the Pariwar Register unless having a separate kitchen and access to the toilet to the family so separated.

(3) The register shall be revised and brought up-to-date under sub-rule (2) by 31st January of each year and public notice will be issued to the effect that–

(a) the register has been revised and brought up-to-date under sub-rule (2); (b) the register, as revised, is available for public inspection for a period of fifteen days (excepting the public holidays) between 10 AM to 5 PM in the office of the concerned Ward Committee and other conspicuous places in a Municipal Council area;

राजपत्र, हिमाचल प्रदेश, 10 मार्च, 2026/19 फाल्गुन, 1947 (c) if any person has to make any objections with regard to any entry or any omission in the register, he may make the objection to that effect to the Secretary of the concerned Ward Committee within the said period of Seven days. The notice shall be pasted in the office of the Ward Committee /conspicuous places within the territorial jurisdiction of the said Ward of Municipal Council area.

(4) The revised entries made in the register under sub-rule (2) and the objections received under sub-rule (3), shall be taken into consideration and disposed of and verified by the Executive Officer of Municipal Council or any official/officer designated by the Executive Officer of Municipal Council after having given an opportunity of being heard to the person(s) concerned.

4. Pariwar Register Record open to inspection.—(1) Any person may apply for the copies of the entries of the Pariwar Register.

(2) Every application for obtaining the copy of the Records of the Pariwar Register shall be made to the official/officer designated as such for the purpose of supply of certified copies of the record by the Executive Officer of Municipal Council, stating therein the purpose for which the copy is required and shall be accompanied with a fee of Rs.50/-. The requisite record shall be provided to applicant either by post/hand or through online within 07 days positively.

(3) Copying fee shall be charged at the rate of rupee three for every page or fraction thereof which shall be recovered in advance before making the copy applied for:

Provided that no fee shall be charged for the copy of the record from Public Authorities, in case they require the record for official use.

(4) Any person may apply for inspection of the record of the Pariwar Register to the Secretary of the Ward Committee concerned. The inspection fee shall be rupees twenty for an hour. The inspection shall be made during the office hour in the office of the Municipal Council. The use of pen and ink during inspection is prohibited. The inspection of the record shall be made in the presence of officer /official of the Municipal Council.

(5) The fee chargeable under this rule shall be paid in cash or otherwise with the application to the official/officer designated as such for the purpose of supply of the certified copy of the record by the Executive Officer of Municipal Council, who shall further get it deposited in the Municipal Fund and forthwith and give a receipt under his signature.

(6) The Director may from time to time revise the rates of copying and inspection fee by notification.

5. Power to issue instructions.—The Director may from time to time issue instructions /clarifications for the smooth implementation of these Rules.
