No. EDN-B-A(1)-3/2025.—The Governor, Himachal Pradesh, is pleased to approve the "Scheme for the Engagement of Teachers in Government School Affiliated to Central Board of 17-राजपत्र/2026-24-04-2026 (1211)1212 राजपत्र, हिमाचल प्रदेश, 24 अप्रैल, 2026/04 वैशाख, 1948 Secondary Education (CBSE) on Fixed Honorarium/Consolidated Amount" (Annexure-1) for implementation in Government Schools in the State, affiliated with the Central Board of Secondary Education (CBSE) in the public interest.

The Scheme shall come into force with immediate effect.

SCHEME FOR THE ENGAGEMENT OF TEACHERS IN GOVERNMENT SCHOOLS

AFFILIATED TO CENTRAL BOARD OF SECONDARY EDUCATION (CBSE) ON

"FIXED HONORARIUM/CONSOLIDATED AMOUNT"

1. INTRODUCTION:—

(a) The State Government, in discharge of its constitutional obligation to provide equitable, inclusive and quality education, and in alignment with the vision and guiding principles of the National Education Policy, 2020, has undertaken a series of systemic reforms in the school education sector. These reforms emphasize competency-based learning, foundational literacy and numeracy, activity-based and competency-based learning approaches and continuous professional development of teachers. In furtherance of these objectives, the Government has taken a policy decision to shift the affiliation of selected Government schools from the Himachal Pradesh Board of School Education (in short 'HPBOSE') to the Central Board of Secondary Education (in short 'CBSE'), with a view to ensuring national-level standards, wider academic exposure, national/international mobility and enhanced opportunities for students, particularly those in rural and tribal areas.

(b) Consequent upon such transition, an immediate and critical requirement has arisen for the availability of suitably qualified, professionally competent and CBSE-oriented teachers in these schools. The existing system is constrained by a shortage of qualified teachers capable of effectively delivering CBSE curriculum in a competency-driven and outcome-oriented manner. Further, the conventional methods of recruitment against sanctioned posts of teachers, though necessary in the long term, involve procedural timelines which are likely to delay timely deployment of teachers in CBSE affiliated Government Schools. Such delay may likely to adversely affect the academic interests of students and the quality of education during this crucial transition phase in newly affiliated CBSE schools.

(c) In order to address this emergent requirement, while ensuring adherence to the principles of equality, transparency and merit in public employment as envisaged under Articles 14 and 16 of the Constitution of India, the Government has decided to introduce a structured, merit-based selection/engagement through competitive examination in time bound manner, to be engaged temporarily on fixed honorarium or consolidated monthly amount. This approach enables timely availability of teaching resources while maintaining fiscal prudence as well.

(d) The Government is further of the considered view that improving educational outcomes in CBSE affiliated Government schools requires engagement of highly qualified and professionally competent teachers with academic standards aligned with the objectives of National Educational Policy, (in short NEP, 2020). This initiative is intended to promote professionalism, accountability, flexibility in deployment and performance- oriented teaching practices. Accordingly, after due consideration, the State Government hereby introduces a comprehensive scheme namely "Scheme for Engagements of teachers in Government school affiliated to the Central Board of Secondary Education (CBSE) on fixed Honorarium or Consolidated Amount", with the objective to ensure timely availability of quality teachers, strengthening institutional capacity and improving learning outcomes for all students from Foundational Stage to Senior Secondary Stage.

2. AIMS AND OBJECT OF THE SCHEME:—

(a) To ensure immediate and timely availability of suitably qualified, professionally competent teachers in Government schools, affiliated to CBSE, so that academic continuity is maintained and the interests of students are safeguarded during the transition phase.

(b) To improve the overall quality of school education by promoting competency- based learning, foundational literacy and numeracy, activity-based and learner- centric teaching approaches, and integration of skills essential for holistic development of students, in alignment with the objectives of the National Education Policy, 2020.

(c) To establish a fair, transparent and merit-based system of selection through a competitive examination and structured counseling process, ensuring adherence to the constitutional principles of equality, equal opportunity and non-arbitrariness in public employment.

(d) To engage teachers possessing higher academic qualifications, subject expertise and professional competence so as to effectively meet the academic, pedagogical and assessment requirements of CBSE curriculum.

(e) To promote professionalism, accountability and performance-oriented teaching practices by clearly defining roles, responsibilities and expected learning outcomes, thereby ensuring measurable improvement in student achievement levels.

(f) To enable flexibility in deployment and optimum utilization of teaching resources, including multi-subject teaching and rational distribution of teachers across schools/classes clusters or regions, in the larger interest of students and the education system.

(g) To provide a time efficient and administratively feasible alternative to conventional recruitment processes, which are inherently time-consuming, so as to address urgent requirements without compromising transparency and merit.

(h) To ensure financial sustainability and prudent management of public resources by adopting a model of engagement on fixed honorarium or consolidated amount basis, without creation of additional permanent posts, while maintaining the desired quality of human resources.

(i) To strengthen institutional capacity of Government schools by infusing qualified human resources capable of adopting innovative teaching practices, use of technology in education, and continuous academic improvement.

(j) To enhance access to quality education for students, especially those belonging to rural, remote and tribal areas, by providing exposure to CBSE curriculum, national-level standards and improved academic opportunities.

(k) To support effective implementation of the State Government's policy initiatives, including transition from HPBOSE to CBSE and alignment with NEP 2020, ensuring that systemic reforms translate into tangible improvements in classroom practices and student outcomes.

(l) To provide adequate teaching resource to fill the gap between the required and actual competence level of students.

3. DEFINITIONS:—

(a) "Agency/Recruiting Agency" means an authority or agency authorized by the Government to conduct selection process for engagement under this Scheme and to recommend suitable candidates to the requisitioning Department.

(b) "Competent Authority" means the authority competent to approve and make engagement under this Scheme, as may be notified by the Government from time to time.

(c) "Engagement" means selection of eligible and meritorious candidates for deployment as teachers of different categories in Government schools, on fixed honorarium/amount temporarily for a specified period, without creation of any sanctioned post under this Scheme through a competitive process followed by counseling.

(d) "Teacher" means a person engaged for imparting subject-specific instruction to ensure acquisition of desired knowledge, competencies and skills by students in accordance with the prescribed curriculum and grade level. Such teachers shall possess academic and professional standards in tune with the NEP-2020. The teacher shall be deployed from Foundational Stage to Senior Secondary Stage (Balvatika I to Class XII) and may also teach additional subject(s) based on his/her academic qualifications, as directed by the Head of the Institution in the interest of students.

(e) "CBSE" means the Central Board of Secondary Education, a national level Board of School Education to which the concerned Government schools are affiliated.

(f) "HPBOSE" means the Himachal Pradesh Board of School Education, Dharamshala.

(g) "Scheme" means the "Scheme for Engagement of Teachers in Government Schools affiliated to CBSE on fixed Honorarium/Consolidated Amount", as notified by the Government.

(h) "Honorarium/Consolidated Amount" means the fixed monthly remuneration payable to a teacher engaged for specified period/months during any given academic years under this Scheme, as determined by the Government, which shall not be treated as pay or salary under any service rules.

(i) "Competitive Examination" means the selection test conducted by the Recruiting Agency for assessing merit and suitability of candidates for engagement under this Scheme.

(j) "Counseling" means the process of allocation of schools/posts to selected candidates based on merit, preference and availability, as per procedure prescribed by the Government.

(k) "Foundational Stage" means the stage of education comprising Balvatika and Classes I and II, as defined under NEP 2020.

(l) "Preparatory Stage", "Middle Stage" and "Secondary Stage" shall have the same meaning as assigned under the National Education Policy, 2020.

(m) "Head of the Institution" means the Principal or any other officer designated as the administrative head of the concerned Government school.

(n) "Requisitioning Department" means the Department of School Education or any authority under it which places requirement of teachers for engagement under this Scheme.

(o) "Merit" means the relative ranking of candidates based on marks obtained in the competitive examination and such other criteria as may be prescribed by the Government.

(p) "Academic Year" means the period as notified by the Government for conduct of teaching and learning activities in schools.

(q) "Deployment" means engaging teacher to a particular school, cluster or location as per requirement of the Department.

4. APPLICABILITY OF THE SCHEME:—This Scheme is applicable for engagement of different categories of teachers required to teach students from Foundational Level to Senior Secondary Level in the educational institutions of the State Government Affiliated to CBSE as per the requirement/need under the Directorate of School Education. The teachers engaged under this Scheme shall not to be engaged against any sanctioned post of TGT/PGT/PRT but are specifically engaged temporarily under this scheme on fixed monthly honorarium/consolidated amount only and shall be entitled for such benefits as prescribed under this Scheme or as may be prescribed from time to time by Government, as the case may be.

5. EDUCATIONAL QUALIFICATION FOR DIFFERENT CATEGORIES OF

TEACHER:-—

(i) Minimum Educational and professional qualification for various teachers to be engaged under the scheme shall be as follows:—

(ii) RELAXATION: Relaxation upto 5% will be allowed in minimum educational qualifications to the candidates belonging to SC/ST/OBC/PWD categories of H.P. (iii) AGE: Between 18-45 years.

6. FIXED HONORARIUM.— The teachers engaged under this Scheme shall be entitled for fixed honorarium of `30,000 (INR) per month payable for 10 months in an academic year.

7. MODE OF ENGAGEMENT/SELECTION.— Eligible candidates shall be selected through open competitive examination and shall be temporarily engaged in any CBSE affiliated Government schools through merit-based counseling system, for which guidelines may be prescribed by the Government, if required.

8. TERMS AND CONDITIONS OF APPOINTMENT.—

(i) All the teachers temporarily engaged under this scheme shall be given monthly consolidated fixed honorarium for 10 months only in an academic year.

(ii) The Teachers temporarily engaged under this Scheme shall not be deemed to be Government employee in any manner and shall be governed by the terms and condition of this scheme only. Any benefit available to Government employees on regular basis shall not be extended to a candidate engaged under this Scheme.

(iii) These teachers shall be engaged temporarily for period of 5 years and are liable to be posted in any CBSE affiliated Government Schools, as per the requirement of the requisitioning department. Government/Department may deploy any teachers engaged under this Scheme in Government schools affiliated to HPBOSE on need basis, if required.

(iv) The teacher engaged under this scheme shall be paid Honorarium/consolidated fixed amount only which shall not be treated as salary.

(vi) Engagements shall be made through competitive process followed by counseling by the H.P. Rajya Chayan Aayog, Hamirpur or any other recruiting agency, as may be authorized by the Government from time to time.

(vii) If, at any stage, it is found that the person engaged under this scheme does not fulfill the criteria for the post or is otherwise ineligible, the person shall be removed from engagement, after issuing prior notice.

(viii) In the event of dereliction of duty, misbehavior, embezzlement of funds, any criminal offence, moral turpitude, involvement in sexual harassment at work place etc. or any other misconduct, the teachers engaged under this Scheme shall be disengaged by following the principles of Natural Justice by competent authority. The criminal proceedings can also be initiated against the teacher under in accordance with law.

(ix) Teachers engaged under this Scheme will be entitled for TA/DA, for tours in connection with his/her official duties, as assigned by the Head of the Institute, at the rate as prescribed by the State Government from time to time.

(x) Teachers engaged under this sub scheme shall have to perform such duties as directed by their Controlling Officers (Principal) or higher authorities; any violation shall amount to termination of engagement after giving reasonable opportunity of hearing.

(xi) The general terms and conditions of the engagement of the teachers, in addition to conditions specified in this scheme, may be prescribed by the Government, if required, and same shall also be mentioned in the advertisement and engagement order of the person to whom the engagement is offered.

(xii) The teachers engaged under this Scheme shall be eligible for Medical benefit schemes under HIMCARE/Ayushman Bharat, if fulfills the eligibility under these schemes. The engagement under this scheme as teacher shall not render him ineligible for the aforesaid schemes. The Government medical rules for reimbursement claims shall not be applicable to such teachers.

(xiii) The teachers engaged under this Scheme shall be selected through a prescribed competitive examination followed by counseling. In the event the Government, at any stage, decides to undertake regular recruitment against vacant sanctioned posts, the teachers engaged under this scheme shall be required to participate in and qualify the prescribed selection process or examination applicable to such posts. Engagement under this Scheme shall not confer any right, claim or preference whatsoever for appointment against any regular sanctioned post.

(xiv) Teachers engaged under this Scheme shall arrange for extra/remedial classes for students, if required. They may be assigned any other subject for teaching as may be directed by the Head of the Institutions.

(xv) The teachers engaged under this scheme shall be entitled for 10 days Casual Leaves and 5 days Medical Leave in a year.

(xvi) The service Rule (including CCS/CCA/Leave Rules/Pension Rule or any other rules as applicable to Government servants) shall not be applicable to the persons engaged under this scheme. The period of engagement under this scheme shall not be considered and counted for any purpose/service benefits and teachers shall be entitled only for the benefits as mentioned in this Scheme. Further, the engagement under this scheme shall not confer any right or entitlement to claim equivalence with any temporary appointments made by the Government in the past, by whatever name called.

(xvii) Teachers engaged under this Scheme shall have no right to claim regularization or appointment against any vacant sanctioned post. Engagement under this Scheme shall not confer any right, title or interest for absorption in Government service, and no such claim shall be entertained at any stage.

(xviii) Teachers engaged under this Scheme shall also function as substitute teachers during the leave period of any teacher or against any vacant post as and when required. The Head of the Institution shall assign teaching duties in respect of any teacher who proceeds on leave, deputation, or is otherwise unavailable. Such teachers may also be deputed to primary schools or to any school within the cluster, or, where required, to nearby Government schools outside the cluster for short durations, in order to support improvement in the learning levels of students.

No. NP/KANDAGHAT/TRADE/Bye-Laws-800-802.—WHEREAS, the "Nagar panchayat Kandaghat drafted TRADE BYE-LAWS-2025" on the house meeting 27/06/25 vide resolution 498 were published in notice board and leading newspapers for inviting public objection and suggestions /Claims under section-217 of Himachal Pradesh Municipal Act, 1994:

AND WHEREAS, no objections were received from any quarter within the specified period of 30 days from the date of publication of these draft Bye-law.

NOW, THEREFORE, in exercise of the powers conferred under Section 125, 126, 127, 128 read with section 202 and 214 of the Himachal Pradesh Municipal Act, 1994, I Abhinav Sharma, Secretary, Nagar Panchayat Kandaghat, Himachal Pradesh hereby notify and publish the Rajpatra, Himachal Pradesh (extra-ordinary) for the information of the general public as follows, namely:—

NAGAR PANCHAYAT KANDAGHAT "TRADE BYE-LAWS-2025"

1. Short title, Extent and Commencement :

(i) These Bye-laws may be called the Himachal Pradesh Municipality, (Grant of Trade License for Trade Activities, Use of Premises, and Storage of Articles in a Premises) Bye-laws 2024.

(iii) These Bye-laws shall apply to all shops/premises falling within the municipal limits which may not be used without a license for the purposes specified in Section 125, 126, 127, 128 read with section 202 and 214 of the Himachal Pradesh Municipal Act, 1994 as per Annexure-I and for storage of any article, and performing any trade within municipal limits as per the Trade Types specified in these Bye-laws at Annexure-I.

2. Definitions.—In these Bye-laws, unless the context otherwise requires:—

(a) "Act" means the Himachal Pradesh Municipal Act, 1994 (Act No 12 of 1994) (b) "Authorized Officer" means Secretary, or any other officer specifically authorized by the Secretary.

(c) Urban Local Body (ULB) : An Urban Local Body (ULB) is an administrative unit in urban areas, responsible for governance, management, and development. ULBs for this Bye-law are categorized into Nagar Panchayat (NP).

(d) "Inspector" means Sanitary Inspector or any other official of the Nagar Panchayat duly authorized by the Secretary.

(e) "License" means a written permission granted by the Secretary or any other official/officer duly authorized by the Secretary in favor of the person, owner & occupier for the sale/storage of articles and Trade Types specified in Annexure-I, and zones as per Annexure-II of these Bye-laws.

(f) "Licensing Officer" means Secretary, or any other officer duly authorized by the Secretary to grant/renew licenses under the provisions of these Bye-laws.

(g) "Premises" means any shop/store/place where the articles specified in Annexure-I are kept for sale/storage in the godown/premises and/or where the trade activities as specified under Annexure-I are performed.

(h) Temporary Trade License : This license is issued for a brief period ranging from 1 to 30 days. It is applicable exclusively to trade activities conducted from temporary or makeshift shops or stalls at approved fairs, events, etc. It is mandatory for the fair organizer/temporary shop or stall owner to get the individual temporary trade license as per the terms defined in this Bye-law.

(i) Zone : The entire area of Nagar Panchayat has been classified into only one zone only.

(j) Superstore : typically refers to a larger retail establishment that sells a wide variety of goods.

(k) E-commerce: Electronic commerce refers to the buying and selling of goods and services over the internet. It encompasses a wide range of online business activities for products and services.

(l) Cloud Kitchen : A cloud kitchen, also known as a virtual kitchen, is a type of commercial kitchen space dedicated solely to preparing food for delivery and takeout.

(m) Municipal Services : include but not limited to Garbage Collection, Property Tax, Electricity supply, Water supply, and Sewerage connection, provided under the jurisdiction of the Nagar Panchayat which can be regulated by separate authorities.

(n) "Shopkeeper" means any person running and managing the affairs of the shop/ premises/place including its owner/occupier.

(o) The words and expressions not defined under these Bye-laws shall have the same meaning or sense as are defined in Himachal Pradesh Municipal Act, 1994.

3. Procedure for Obtaining License :

(a) Any person who wants to operate/run any business/trade as specified in Annexure-I and/or store any article as specified in Annexure-I within the areas of the Nagar Panchayat and as per zone definitions in Annexure-II shall apply for a license on the prescribed format to the Secretary of the concerned Nagar Panchayat.

(b) Period of License : The license shall be issued for a period of 1 year and the license shall automatically come to an end after the completion of such period.

4. Renewal of License :

(i) The license will be automatically renewed upon expiration once the applicant deposits the required fee. It can be renewed without any late fee or additional documentation within one month after expiration. If renewed within the following month (2nd Month of Expiry), a 50% penalty will apply. Beyond this period, the license cannot be renewed, and a new trade license must be applied.

(ii) No document is required to be submitted for the renewal of the License. However, a No-dues Certificate from every branch of NP Kandaghat will be a mandatory condition for the renewal of the License.

5. Transfer of License :

(i) The license issued under the Bye-laws shall not be transferred in the name of any person except in case of the death of the original licensee wherein it shall be made/transferred in the name of the legal heirs only for the validity period of the license on production of supporting documents and shall be decided by the Secretary keeping in view the circumstances of the case.

(ii) Transfer of Trade License fees 50 will be charged as per prescribed fees decided by the ULB.

6. Closure of License.—The license issued under the bye-laws can be requested for closure in case of winding up of the business. The licensee shall provide information as per prescribed guidelines to the Secretary for winding up of his business. Closure of Trade License fees 50 will be charged as per prescribed fees decided by the ULB.

7. Modification of License.—The license issued under the Bye-laws can be requested for modification in the following heads only :

(i) In case of Change of Mobile Number (Trade Owner)

(ii) In case of Change and/or Addition in Sub-category or Trade under the pre- selected sector as per Annexure-I. (Note: Sector cannot be modified, multiple licenses will have to be applied for, multiple sectors).

(iii) In case of Change of Business/Trade Address (Modification of trade address is only allowed in case the address is being changed within the same ward of the ULB.)

Modification of Trade License fees will be charged as per prescribed fees decided by the ULB.

8. Temporary Trade Licenses :

(i) Temporary Trade Licenses are applicable for mobile vendors who will be selling products on carts, vans, bikes, on foot, or in makeshift camps or stalls located along the road during events within the ULB, for a period of 1 day to 30 days only.

(ii) These licenses are specifically issued for temporary or makeshift shops or stalls at fairs and similar events.

9. Conditions for Grant of License :

(i) Trade registration with the Labour & Employment Department, Government of Himachal Pradesh, is a mandatory pre-requisite for applying for a Trade License from Urban Local Bodies (ULBs).

(ii) The license shall not be valid for any other purpose, except for the items/articles for which it is granted under these Bye-laws.

(iii) The permission shall, unless specified otherwise in the license, be valid in the entire NP limits, subject to such conditions as may be imposed by the Secretary.

(iv) The owner/occupier of the premises shall have to produce the license before the Inspector or the licensing officer at any point of time as may be ordered by them.

(v) The Secretary shall have the right to impose or alter any of the conditions in the license as may be deemed fit by him/her under the provisions of Section 214 of the Himachal Pradesh Municipal Act, 1994.

(vi) Additional Permissions for any article/trade mentioned in Annexure-I may be added by the Secretary as and when deemed necessary.

(vii) The applicant shall submit a self-declaration regarding information submitted by him/her about the premises to be used for business/trade viz. type of business, area, approval of map, and nature of property i.e. commercial and domestic, etc. to be true to the best of his knowledge and belief.

(viii) The licensee shall maintain proper records of the articles kept for sale or storage and trade activities being performed in the premises as may be required by the Licensing Officer. Further, the licensee shall comply with all the directions and instructions issued to him by the Secretary or the Licensing Officer from time to time.

(ix) The licensee will ensure timely payment of Municipal dues

(x) Time period for the issue of License : The license shall be issued as per the timelines notified/specified for this service under the Public Service Guarantee Act, 2011.

(xi) Subject to these Bye-laws, a license to any person, who applies online to the Secretary or Licensing Officer in this behalf and tenders the prescribed fee shall be granted by that officer, unless for reasons to be recorded in writing by him.

(xii) The licensee shall be liable to pay transfer, modification, closure charges as prescribed by ULB per license at the time of effecting transfer of license, modification of license, closure of license.

(xiii) The licensee shall abide by the terms and conditions of the license and the license shall be displayed at the convenient/conspicuous place/reception of the premises.

(xiv) The Inspector or inspecting staff concerned shall have the right to enter and inspect the premises and the licensee shall provide necessary assistance to the inspecting staff at the time of inspection of licensed premises.

(xv) The licensee shall not make any encroachment/overhanging projection on public streets and NP drains in any manner.

10. Denials of License.—(1) The license shall not be granted :

(i) to a person suffering from any loathsome infections or contagious diseases;

(ii) to a person convicted for unlawful sale or storage of any articles mentioned in Section 125, 126, 127, 128 read with section 202 and 214 of the Himachal Pradesh Municipal Act, 1994;

(iii) to a person who has been found to have habitually committed the breach of these Bye-laws or the terms of the license.

(iv) to a person not below the age of 18 years.

(i) In addition to the penalty as provided under Himachal Pradesh Municipal Act, 1994 any person in possession of the premises found violating any of the provisions of these Bye-laws shall in the first instance be liable for a penalty of Rs. 1000/- only and suspension of license for a period of one month and for repetition of the same violation within three months be liable for a penalty of Rs. 10000/- only and permanent Cancellation/withdrawal of license.

(ii) If the information submitted by the applicant under self-declaration is found to be false, he/she shall be liable for the penalty of ten times the license fee and his/her license will be canceled.

(iii) In case of repeated violations, the concerned person, owner, or occupier, as the case shall be liable for the cancellation/withdrawal of License which can only be restored on receiving written undertaking accompanied by surety from the person violating these Bye-laws, subject to the satisfaction of the Secretary.

12. Penalization for Default on Municipal Services.—In the interest of maintaining compliance and to ensure the seamless provision of municipal services, Nagar Panchayat hereby enacts the following :—

(1) Interlinked Service Compliance.—All Municipal Services, including but not limited to Garbage Collection, Property Tax, Electricity, Water, and Sewerage, provided under the jurisdiction of the Nagar Panchayat and regulated by separate authorities, shall be interlinked for compliance purposes and the lined departments will be duty-bound to withdraw the services if requested by the Secretary, Nagar Panchayat Kandaghat.

(2) Cross-Service Penalization.—Any resident or entity found to be in violation of the regulations pertaining to any one of the municipal services shall be subject to cross- municipal service penalization. This includes but is not limited to :

(i) Suspension or limitation of other municipal services

(ii) Imposition of additional fines and penalties across all utilities

(iii) Notification and reporting of violations across regulatory authorities for coordinated enforcement.

(3) Repercussions for Trade License service.—Municipal Service Defaulters will not be allowed to apply/renew/modify/close trade licenses until the violation is resolved.

(4) Notification and Appeal.—Prior to the enforcement of cross-municipal penalties, the affected party shall receive a written notice detailing the nature of the violation, the affected services, and the penalties to be imposed.

The affected party shall have the right to appeal against the penalization within a stipulated period as prescribed by the Nagar Panchayat.

(5) Inter-Authority Coordination.—Regulatory authorities governing each municipal service shall establish a coordination mechanism to ensure the efficient and timely exchange of information regarding violations and enforcement actions.

Regular meetings shall be held between regulatory authorities to review compliance status and address issues related to cross- municipal service penalization.

These Bye-laws shall come in to effect immediately upon its inclusion in the Nagar Panchayat Bye-laws. The Municipality shall periodically review and update the cross-municipal penalization framework to address emerging challenges and ensure fair and effective enforcement.

संख्याः जीएडी-बी(एफ) 2-1/2025-I.--हिमाचल प्रदेश के राज्यपाल, जनगणना नियम, 1990 के उप-नियम 8(ii) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए तथा भारत के महारजिस्ट्रार एवं जनगणना आयुक्त के कार्यालय द्वारा जारी अनुदेशों अनुसरण में, वर्ष 2027 में आयोजित की जाने वाली जनगणना के संचालन के संबंध में सामान्य जनमानस की जानकारी हेतु निम्नलिखित सूचना अधिसूचित की जाती है, जिसको डिजिटल माध्यम से दो चरणों में संचालित किया जाना है। प्रथम चरण तारीख 16 जून, 2026 से 15 जुलाई, 2026 तक आयोजित किया जाएगा, जिसके साथ स्व-गणना का विकल्प भी उपलब्ध रहेगा, जो कि हाऊस-लिस्टिंग एवं आवास जनगणना के प्रारंभ से पूर्व 15 दिनों की अवधि में संपन्न किया जाएगा। द्वितीय 1244 राजपत्र, हिमाचल प्रदेश, 24 अप्रैल, 2026/04 वैशाख, 1948 चरण, अर्थात्‌ जनसंख्या गणना फरवरी, 2027 के दौरान आयोजित की जाएगी (अपवादस्वरूप हिमाचल प्रदेश के हिमच्छादित क्षेत्रों में यह कार्य सितंबर, 2026 के दौरान संपन्न किया जाएगा) राज्य के समस्त निवासियों से यह अपील की जाती है कि वे आगामी जनगणना कार्यों के सफल संचालन हेतु जनगणना अधिकारियों/ कर्मचारियों को पूर्ण सहयोग प्रदान करें। जनगणना आंकड़ों की उपयोगिता से संबंधित विवरण तथा जनगणना अधिनियम, 1948 के प्रासंगिक अंश, राज्य के सामान्य जन की सूचना हेतु, एतद्‌वारा प्रकाशित किए जाते हैं, जो निम्नानुसार हैंः-

(i) जनगणना आंकड़ों की उपयोगिता.--जनगणना आंकड़ों का प्राथमिक स्रोत है जो मकान की स्थिति, सुविधाओं और संपत्तियों, जनसांख्यिकी, साक्षरता, धर्म, आर्थिक गतिविधि, प्रवासन, प्रजनन क्षमता आदि निम्नतम प्रशासनिक इकाइयों तक अर्थात्‌ ग्रामीण क्षेत्रों में गाँवों और शहरी क्षेत्रों में नगरं/वार्डों तक उपलब्ध होता है।

इसका व्यापक उपयोग केंद्र/राज्य/संघ राज्य क्षेत्रों की सरकारों द्वारा योजना निर्माण, नीति निर्धारण और प्रभावी सार्वजनिक प्रशासन के लिए किया जाता है। इसके अतिरिक्त, जनगणना आंकड़ों का उपयोग संसदीय, विधानसभा, पंचायतों और अन्य स्थानीय निकायों के निर्वाचन क्षेत्रों के परिसीमन और आरक्षण के लिए किया जाता है। अतः जनता से अपेक्षा की जाती है कि वे जनगणना कार्य में सहयोग करें और सही जानकारी प्रदान करें। जनगणना अधिनियम, 1948 के कुछ महत्वपूर्ण उपबंध जनता की जानकारी के लिए नीचे पुनः प्रस्तुत किए गए हैंः-

(ii) धारा 8 ः-प्रश्नों का पूछा जाना और उत्तर देने की बाध्यता.--(1) जनगणना अधिकारी उस स्थानीय क्षेत्र की सीमा में, जिसके लिए नियुक्ति की गई ह,ै सभी व्यक्तियों सेें ऐसे सभी प्रश्न पूछ सकेगा, जिन्हें पूछने के लिए, उसे केन्द्रीय सरकार द्वारा इस निमित्त जारी और राजपत्र में प्रकाशित किए गए अनुदेशों द्वारा, निदिष्ट किया जाए।

(2) ऐसा प्रत्येक व्यक्ति, जिससे उपधारा (1) के अधीन कोई प्रश्न पूछा जाता है, अपनी सर्वोत्तम जानकारी या विश्वास के अनुसार उस प्रश्न का उत्तर देने के लिए वैध रूप में आबद्ध होगा।

परंतु कोई भी व्यक्ति अपने परिवार के किसी स्त्री सदस्य का नाम बताने के लिए आबद्ध नहीं होगा और कोई भी स्त्री अपने पति या मृत पति का अथवा ऐसे किसी अन्य व्यक्ति का नाम बताने के लिए आबद्ध नहीं होगी, जिसका नाम बताने के लिए वह रूढ़ि द्वारा निषिद्ध की गई हो।

(iii) धारा 9 ः-अधिभोगी प्रवेश करने और संख्यांक लगाने देना.--किसी गृह, अहाते, जलयान या अन्य स्थान का अधिभोग करने वाला प्रत्येक व्यक्ति, जनगणना अधिकारियों को उसमें ऐसा प्रवेश करने देने की अनुज्ञा देगा जिसकी वे जनगणना के प्रयोजनों के लिए अपेक्षा करें तथा जो देश की रुढ़़ियों को ध्यान में रखते हुए युक्तियुक्त हों, और वह उनको ऐसे अक्षरों, चिन्हों या संख्यांकों से जो जनगणना के प्रयोजनों के लिए आवश्यक हों, उस स्थान को अंकित करने की, या उनको उस स्थान पर लगाने देने की अनुज्ञा देगा। (iv) धारा 10 ः-अधिभोगी या प्रबन्धक द्वारा अनुसूची का भरा जाना.--(1) ऐसे आदेशों के अधीन रहते हुए, जैसे जनगणना आयुक्त इस निमित्त जारी करें, जनगणना अधिकारी, ऐसे स्थानीय क्षेत्र में जिसके लिए उसकी नियुक्ति की गई है, किसी निवासगृह में या किसी वाणिज्यिक अथवा औद्योगिक स्थापन के प्रबंधक या किसी अधिकारी के पास एक अनुसूची, जनगणना करने के समय, यथास्थिति, ऐसे गृह या उसके किसी भाग में सहवासियों, या ऐसे प्रबंधक या अधिकारी के अधीन नियोजित व्यक्तियों के बारे में, ऐसे गृह या उनके किसी विनिर्दिष्ट भाग के अधिभोगी द्वारा या ऐसे प्रबंधक या अधिकारी द्वारा उसमें ऐसी विशिष्टियां, जैसी जनगणना आयुक्त निर्दिष्ट करें, भरने के प्रयोजन के लिए रख सकेगा या रखवा सकेगा।

(2) जब ऐसी अनुसूची इस प्रकार रख दी जाए तब, यथास्थिति, उक्त अधिभोगी, प्रबंधक या अधिकारी, पूर्वोक्त समय पर, यथास्थिति, ऐसे गृह या उसके किसी भाग के सहवासियों या उसके अधीन नियोजित व्यक्तियों के संबंध में, उसे अपनी सर्वोत्तम जानकारी या विश्वास के अनुसार भरेगा या भरवाएगा और उस पर अपने हस्ताक्षर करेगा, और जब उससे ऐसी अपेक्षा की जाए तब वह इस प्रकार भरी गई और हस्ताक्षरित अनुसूची, जनगणना अधिकारी को या ऐसे व्यक्ति को जिसे जनगणना अधिकारी निर्दिष्ट करें, परिदत्त करेगा।1245 राजपत्र, हिमाचल प्रदेश, 24 अप्रैल, 2026/04 वैशाख, 1948 (v) धारा 11 ः- शास्तियां.--(1)-(क) कोई ऐसा जनगणना अधिकारी या जनगणना करने में सहायता देने के लिए विधिपूर्वक अपेक्षित कोई ऐसा व्यक्ति, जो इस अधिनियम या इसके अधीन बनाए गए किसी नियम द्वारा उस पर अधिरोपित किसी कर्त्तव्य का पालन करने में इंकार करेगा या कोई ऐसा व्यक्ति जो किसी ऐसे कर्त्तव्य का पालन में अन्य व्यक्ति को प्रतिबंधित या बाधित करेगा, या

(कक) कोई ऐसा जनगणना अधिकारी या जनगणना करने में सहायता देने के लिए विधिपूर्वक अपेक्षित कोई ऐसा व्यक्ति, जो इस अधिनियम या इसके अधीन बनाए गए किसी नियम के अनुसार उस पर अधिरोपित किमी कर्त्तव्य का पालन करने में या उसको दिए गए किसी आदेश के पालन करने में युक्तियुक्त तत्परता बरतने में अपेक्षा करेगा, या कोई ऐसा व्यक्ति जो किसी ऐसे कर्त्तव्य का पालन करने में या किसी ऐसे आदेश का पालन करने में अन्य व्यक्ति को प्रतिबंधित या बाधित करेगा, या

(घ) कोई ऐसा व्यक्ति, जो जनगणना अधिकारी द्वारा उससे पूछे गए किसी ऐसे प्रश्न का, जिसका उत्तर देने के लिए वह धारा 8 द्वारा वैध रूप से आबद्ध है, साशय मिथ्या उत्तर देगा, या अपनी सर्वोत्तम जानकारी या विश्वास के अनुसार उत्तर देने से इंकार करेगा, या (ङ) किसी गृह, अहाते, जलयान या अन्य स्थान का अधिभोग करने वाला कोई ऐसा व्यक्ति, जो जनगणना अधिकारी को उसमें ऐसा युक्तियुक्त प्रवेश करने देने से इंकार करेगा जैसा कि वह धारा 9 द्वारा अनुज्ञा देने के लिए अपेक्षित है, या

(च) कोई ऐसा व्यक्ति, जो किन्हीं ऐसे अक्षराें, चिन्हों, या संख्यांकों को, जिन्हें जनगणना के प्रयोजनों के लिए अंकित किया या लगाया गया है, हटाएगा, मिटाएगा, परिवर्तित करेगा, या उन्हें नुकसान पहुंचाएगा, या

(छ) कोई ऐसा व्यक्ति, जिससे धारा 10 के अधीन अनुसूची भरने की अपेक्षा की गई हो, जानते हुए और बिना पर्याप्त हेतुक के उस धारा के उपबंधों का अनुपालन करने में असफल रहेगा, उसके अधीन कोई मिथ्या बिबरणी देगा, या

(ज) कोई ऐसा व्यक्ति, जो जनगणना कार्यालय में अतिचार करेगा, या जुर्माने से, जो एक हजार रुपये तक का हो सकेगा, दंडनीय होगा और भाग (क) के अधीन किसी दोषसिद्धि की दशा में कारावास से भी, जो तीन वर्ष का हो सकेगा, दडनीय होगा।

(2) जो कोई उपधारा (1) के अधीन किसी अपराध का दुष्प्रेरण करेगा, वह जुर्माने से, जो एक हजार रुपए तक का हो सकेगा, दंडणीय होगा।

(vi) धारा 15 :-जनगणना के अभिलेखों का निरीक्षण नहीं किया जा सकेगा और न वे साक्ष्य में ग्राह्य होंगे.--किसी भी व्यक्ति को, जनगणना अधिकारी द्वारा उस हैसियत में अपने कर्त्तव्य के निर्वहन में तैयार की गई किसी पुस्तक, रजिस्टर या अभिलेख का, अथवा धारा-10 के अधीन परिदत्त किसी अनुसूची का, निरीक्षण करने का अधिकार नहीं होगा, और भारतीय साक्ष्य अधिनियम, 2023 (2023 का 47) में किसी प्रतिकूल बात के होते हुए भी, किसी ऐसी पुस्तक, रजिस्टर, अभिलेख या अनुसूची में की कोई भी प्रविष्टि किसी ऐसे कार्य या लोप के लिए, जो इस अधिनियम के अधीन अपराध बनता है इस अधिनियम या किसी अन्य विधि के अधीन किए गए अभियोजन में भिन्न किसी भी प्रकार की किसी सिविल कार्यवाही में अथवा किसी दांडिक कार्यवाही में साक्ष्य के रूप में ग्राह नहीं होगी।

No. GAD-B(F)2-1/2025-I.—In exercise of the powers conferred under the rule 8 (ii) of the Census Rules, 1990 and in pursuance of the instructions issued by the Office of the Registrar General & Census Commissioner of India, the Governor, Himachal Pradesh hereby notifies the following information for the awareness of the general public in connection with the conduct of Census 2027, which is scheduled to be digitally conducted in two phases. The 1st phase is scheduled w.e.f. 16th June 2026 to 15th July, 2026 alongwith option for self enumeration which shall be conducted in 15 days time period just before the start of Houselisting and Housing Census. The 2nd phase i.e. Population Enumeration would be conducted during February, 2027 (except snow bound areas where it would be conducted during September, 2026). The residents of the State are appealed to extend full cooperation to Census officers/officials during forthcoming operations. The contents covering utility of Census data and relevant extracts of the Census Act, 1948 are hereby published for the notice of general public of the state, which are as follows:—

(i) Utility of Census Data.—The Census is the primary source of data upto the lowest administrative units, i.e. villages in rural areas and town/wards in urban areas on Housing Condition; Amenities & Assets, Demography, Literacy, Religion, Economic Activity, Migration, Fertility etc..

It is widely used for planning and formulation of policies and effective Public Administration by the Central/State/UT Governments. Apart from this, Census data are used for delimitation and reservation of Constituencies for Parliamentary, Assembly, Panchayats and other Local Bodies. Thus, the public are to cooperate in Census taking and provide the correct information. Some of the important provisions in the Census Act, 1948 are reproduced below for information of the public.

(ii) Section 8 :–Asking of questions and obligation to answer.—(1) A Census-officer may ask all such questions of all persons within the limits of the local area for which he is appointed, as by instructions issued in this behalf by the Central Government and published in the Official Gazette, he may be directed to ask.

(2) Every person of whom any question is asked under sub-section (1) shall be legally bound to answer such question to the best of his knowledge or belief :

Provided that no person shall be bound to state the name of any female member of his household, and no woman shall be bound to state the name of her husband or deceased husband or of any other person whose name she is forbidden by custom to mention.

(iii) Section 9 :–Occupier to permit access and affixing of number.—Every person occupying any house, enclosure, vessel or other place shall allow census-officers such access thereto as they may require for the purposes of the census and as, having regard to the customs of the country, may be reasonable, and shall allow them to paint on, or affix to, the place such letters, marks or numbers as may be necessary for the purposes of the census.

(iv) Section 10 :–Occupier or manager to fill up schedule.—(1) Subject to such orders as the Deputy Commissioner-cum-Principal Census Officer may issue in this behalf, a census officer may, within the local area for which he is appointed, leave or cause to be left a schedule at any dwelling-house or with the manager or any officer of any commercial or industrial establishment, for the purpose of its being filled up by the occupiers of such house or of any specified part thereof or by such manager or officer with such particulars as the Deputy Commissioner-cum-Principal Census Officers may direct regarding the inmates of such house or part thereof, or the persons employed under such manager or officer, as the case may be, at the time of the taking of the census.

(2) When such schedule has been so left, the said occupier, manager or officer, as the case may be, shall fill it up or cause it to be filled upto the best of his knowledge or belief so far as regards the inmates of such house or part thereof or the persons employed under him, as the case may be, at the time aforesaid, and shall sign his name thereto and, when so required, shall deliver the schedule so filled up and signed to the census-officer or to such person as the census-officer may direct.

(v) Section 11 :–Penalties.—(1) (a) Any census-officer or any person lawfully required to give assistance towards the taking of census who refuses to perform any duty imposed upon him by this Act or any rule made thereunder, or any person who hinders or obstructs another person in performing any such duty, or

(aa) any census-officer or any person lawfully required to give assistance towards the taking of a census who neglects to use reasonable diligence in performing any duty imposed upon him or in obeying any order issued to him in accordance with this Act or any rule made thereunder or any person who hinders or obstructs another person in performing any such duty or obeying any such order, or;

(d) any person who intentionally gives a false answer to, or refuses to answer to the best of his knowledge or belief, any question asked of him by a census-officer which he is legally bound by section 8 to answer, or

(e) any person occupying any house, enclosure, vessel or other place who refuses to allow a census-officer such reasonable access thereto as he is required by section 9 to allow, or

(f) any person who, removes, obliterates, alters, or damages any letters, marks or numbers which have been painted or affixed for the purposes of the census, or (g) any person who, having been required under section 10 to fill up a schedule, knowingly and without sufficient cause fails to comply with the provisions of that section, or makes any false return there under, or

(h) any person who trespasses into a census office, shall be punishable with fine which may extend to one thousand rupees and in case of a conviction under part (a) shall also be punishable with imprisonment which may extend to three years.

2. Whoever abets any offence under sub-section (1) shall be punishable with fine which may extend to one thousand rupees.

(vi) 15 :–Records of census not open to inspection nor admissible in evidence.—No person shall have a right to inspect any book, register or record made by a census-officer in the1248 राजपत्र, हिमाचल प्रदेश, 24 अप्रैल, 2026/04 वैशाख, 1948 discharge of his duty as such, or any schedule delivered under section 10, and notwithstanding anything to the contrary in the Bharatiya Sakshya Adhiniyam, 2023 (47 of 2023), no entry in any such book, register, record or schedule shall be admissible as evidence in any civil proceeding whatsoever or in any criminal proceeding other than a prosecution under this Act or any other law for any act or omission which constitutes an offence under this Act.

The enquiry of the application filed by the applicant was conducted through filed revenue agencies and after receving report from the field revenue agencies, it has been observed that the applicant's father correct name is Lakshman Dass s/o Palo but the name of the applicant is father is recorded in revenue record as Lachhman s/o Palo.

Now, therefore, in pursuance of section 38 of H.P. Land Revenue Act, 1954 proclamation is hereby issued to all general public concerned that objections in this regard for correction of the name of Lakshman Dass s/o Palo shall be heard by the undersigned on 16-05-2026 in his court at Raja Ka Talab.
