क्रमांकः एम0कॉर्प0/बद्दी/बाई लॉज (ट्रेड लाइसेंस)/2026-(2).—हिमाचल प्रदेश नगर निगम अधिनियम, 1994 के अध्याय XVIII के साथ पठित धारा 395 के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए, नगर निगम बद्दी द्वारा निम्नलिखित उप-विधियां बनाने का प्रस्ताव किया गया, जिन्हें "नगर निगम बद्दी— परिसरों के उपयोग एवं परिसरों में वस्तुओं के भंडारण हेतु व्यापार लाइसेंस प्रदान करने संबंधी उप-विधियां, 2026" कहा जाएगा। 1308 राजपत्र, हिमाचल प्रदेश, 25 अप्रैल, 2026/05 वैशाख, 1948 उक्त उप-विधियों के प्रारूप को राजपत्र संख्या 269/GAZETTE/2026, दिनांक 10-03-2026 के माध्यम से राजपत्र (Official Gazette) में प्रकाशित किया गया था, ताकि इसके संबंध में आम जनता से प्रकाशन की तिथि से तीस (30) दिनों की अवधि के भीतर आपत्तियां एवं सुझाव आमंत्रित किए जा सकें;

और जबकि, निर्धारित अवधि के भीतर कोई भी सुझाव अथवा आपत्ति प्राप्त नहीं हुई है;

अतएव, अब हिमाचल प्रदेश नगर निगम अधिनियम, 1994 के अध्याय XVIII के साथ पठित धारा 395 के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए, नगर निगम बद्दी द्वारा "परिसरों के उपयोग एवं परिसरों में वस्तुओं के भंडारण हेतु व्यापार लाइसेंस प्रदान करने संबंधी उप-विधियां, 2026" को अंतिम रूप से प्रकाशित एवं अधिसूचित किया जाता है।

ये उप-विधियां राजपत्र में इनके प्रकाशन की तिथि से प्रभावी होंगी।

1. संक्षिप्त शीर्षक, क्षेत्राधिकार एवं प्रवर्तन.—(i) इन उप-विधियों को "नगर निगम बद्दी – परिसर के उपयोग एवं परिसर में वस्तुओं के भंडारण हेतु व्यापार अनुज्ञा प्रदान करने संबंधी उप-विधियां, 2026" कहा जाएगा।

(ii) कोई भी व्यक्ति अथवा व्यवसाय संचालक, Himachal Pradesh Municipal Corporation Act, 1994 के अध्याय XVIII की धारा 324 एवं प्रथम अनुसूची के प्रावधानों तथा उनके अंतर्गत निर्मित उप-विधियों के अनुसार जारी लाइसेंस प्राप्त किए बिना कोई भी व्यापारिक गतिविधि प्रारंभ या संचालित नहीं करेगा।

(iii) ये उप-विधियां इस निगम की नगरपालिका सीमा के अंतर्गत आने वाली सभी दुकानों/परिसरों पर लागू होंगी, जिन्हें अध्याय XVIII की धारा 324 तथा Himachal Pradesh Municipal Corporation Act, 1994 की प्रथम अनुसूची के भाग-I एवं भाग-II में निर्दिष्ट प्रयोजनों के लिए, परिसर के उपयोग एवं/अथवा किसी भी वस्तु के भंडारण हेतु, लाइसेंस के बिना उपयोग नहीं किया जा सकेगा। (भाग- I एवं भाग- II उप-विधियों के अंत में संलग्न हैं।)

2. परिभाषाएं .—इन उप-विधियों में, जब तक संदर्भ से अन्यथा अभिप्रेत न हो,–

(क) "अधिनियम" से अभिप्राय Himachal Pradesh Municipal Corporation Act, 1994 (अधिनियम संख्या 12, 1994) से है;

(ख) "प्राधि—त अधिकारी" से अभिप्राय आयुक्त या नगर निगम, बद्दी के आयुक्त द्वारा विशेष रूप से अधि—त किसी अन्य अधिकारी से है;

(ग) "निरीक्षक" से अभिप्राय स्वच्छता निरीक्षक अथवा आयुक्त द्वारा विधिवत अधि—त नगर निगम के किसी अन्य अधिकारी/कर्मचारी से है;

(घ) "लाइसेंस" से अभिप्राय आयुक्त या आयुक्त द्वारा विधिवत अधि—त किसी अन्य अधिकारी द्वारा, इन उप-विधियों के अंत में संलग्न भाग- I एवं भाग- II में निर्दिष्ट वस्तुओं के विक्रय/भंडारण हेतु, किसी व्यक्ति, स्वामी एवं परिसर के अधिभोगी के पक्ष में प्रदान की गई लिखित अनुमति से है;

(ङ) "लाइसेंसिंग अधिकारी" से अभिप्राय आयुक्त या आयुक्त द्वारा इन उप-विधियों के प्रावधानों के अंतर्गत लाइसेंस प्रदान/नवीनीकरण हेतु विधिवत अधि—त किसी अन्य अधिकारी से है;

(च) "परिसर" से अभिप्राय किसी भी दुकान/भंडार/स्थान से है, जहां भाग- I एवं भाग- II में निर्दिष्ट वस्तुएं विक्रय/भंडारण हेतु रखी जाती हैं;

(छ) "लघु श्रेणी व्यवसाय/व्यापार" से अभिप्राय अधिकतम 25 वर्ग फुट क्षेत्रफल वाले परिसर से है;

"मध्यम श्रेणी व्यवसाय/व्यापार" से अभिप्राय 25 वर्ग फुट से 100 वर्ग फुट तक के क्षेत्रफल वाले परिसर से है; तथा "बड़े श्रेणी व्यवसाय/व्यापार" से अभिप्राय 100 वर्ग फुट से अधिक क्षेत्रफल वाले परिसर से है।

(ज) "दुकानदार" से अभिप्राय किसी भी ऐसे व्यक्ति से है जो दुकान/परिसर/स्थान का संचालन एवं प्रबंधन करता हो, जिसमें उसका स्वामी/अधिभोगी भी सम्मिलित है, परंतु अतिक्रमणकर्ता इसमें सम्मिलित नहीं होगा।

(झ) इन उप-विधियों में प्रयुक्त वे शब्द एवं अभिव्यक्तियां, जो यहां परिभाषित नहीं हैं, उनका वही अर्थ या आशय होगा जो Himachal Pradesh Municipal Corporation Act, 1994 में निर्दिष्ट है।

3. लाइसेंस प्राप्त करने की प्रक्रिया :–कोई भी व्यक्ति जो भाग-I में निर्दिष्ट किसी व्यवसाय/व्यापार को संचालित करना चाहता है तथा/अथवा भाग-II में निर्दिष्ट किसी वस्तु का भंडारण करना चाहता है, वह नगर निगम बद्दी के क्षेत्राधिकार में व्यवसाय प्रारंभ करने से पूर्व लाइसेंस हेतु ऑनलाइन पोर्टल https://citizenseva-hp-gov-in/hp&udd/ के माध्यम से आवेदन करेगा। इस प्रावधान का उल्लंघन किए जाने की स्थिति में, इन उप-विधियों में निर्धारित दंड आरोपित किया जाएगा।

4. लाइसेंस की अवधि.—लाइसेंस एक वर्ष अथवा एक बार में पांच वर्ष की अवधि के लिए जारी किया जाएगा तथा उक्त अवधि की समाप्ति पर लाइसेंस स्वतः समाप्त हो जाएगा।

5. लाइसेंस का नवीनीकरण.—लाइसेंसधारी को लाइसेंस की वैधता अवधि समाप्त होने के पश्चात्‌ उसका नवीनीकरण कराना अनिवार्य होगा। यदि नवीनीकरण हेतु आवेदन लाइसेंस की समाप्ति की तिथि से एक माह के भीतर प्रस्तुत किया जाता है, तो किसी प्रकार का विलंब शुल्क देय नहीं होगा।

6. लाइसेंस का हस्तांतरण.—इन उप-विधियों के अंतर्गत जारी किया गया लाइसेंस किसी अन्य व्यक्ति के नाम हस्तांतरित नहीं किया जाएगा, सिवाय मूल लाइसेंसधारी की मृत्यु की स्थिति में। ऐसी दशा में, वैधता अवधि की शेष अवधि के लिए, आवश्यक दस्तावेज प्रस्तुत किए जाने पर, लाइसेंस केवल विधिक उत्तराधिकारियों के नाम पर हस्तांतरित किया जाएगा। इस संबंध में निर्णय आयुक्त द्वारा प्रकरण की परिस्थितियों को ध्यान में रखते हुए लिया जाएगा।

7. लाइसेंस शुल्क.—(क) लाइसेंस प्रदान किए जाने हेतु देय शुल्क का निर्धारण आयुक्त द्वारा समय-समय पर किया जाएगा। तथापि, शुल्क की गणना वार्षिक लाइसेंस शुल्क दर के आधार पर की जाएगी, जिसे आवेदक द्वारा मांगी गई लाइसेंस की अवधि (वर्षों की संख्या) से गुणा किया जाएगा। शुल्क निम्नलिखित प्रकार से अधिरोपित/वसूल किया जाएगा :–

नगर निगम के अधिकार क्षेत्र के अंतर्गत त्यौहारों/मेलों अथवा किसी अन्य अवसर पर स्थापित लघु/मध्यम/बड़े दुकानों/स्टॉलों से वसूल की जाने वाली शुल्क राशि का निर्धारण आयुक्त, नगर निगम बद्दी द्वारा समय-समय पर किया जाएगा। 1310 राजपत्र, हिमाचल प्रदेश, 25 अप्रैल, 2026/05 वैशाख, 1948 (स्पष्टीकरणाथ.—लघु दुकान/स्टॉल से अभिप्राय अधिकतम 25 वर्ग फुट क्षेत्रफल वाले परिसर से है; मध्यम दुकान/स्टॉल से अभिप्राय 25 वर्ग फुट से 100 वर्ग फुट तक के क्षेत्रफल वाले परिसर से है; तथा बड़े दुकान/स्टॉल से अभिप्राय 100 वर्ग फुट से अधिक क्षेत्रफल वाले परिसर से है।)

(ख) नगर निगम क्षेत्र में फिल्म/चलचित्र/वृत्तचित्र/टीवी धारावाहिक/संगीत एल्बम/विज्ञापन आदि की शूटिंग हेतु अनुमति के लिए शुल्क संरचनाः-

8. लाइसेंस प्रदान करने की शर्तें.—(i) लाइसेंस केवल उन्हीं वस्तुओं/सामग्रियों के लिए मान्य होगा, जिनके लिए इन उप-विधियों के अंतर्गत इसे प्रदान किया गया है। किसी अन्य प्रयोजन हेतु यह मान्य नहीं होगा।

(ii) जब तक लाइसेंस में अन्यथा उल्लेखित न हो, यह अनुमति आयुक्त द्वारा निर्धारित शर्तों के अधीन, नगर निगम की संपूर्ण सीमा में वैध होगी।

( iii) परिसर का स्वामी/अधिभोगी, निरीक्षक अथवा लाइसेंसिंग अधिकारी द्वारा मांगे जाने पर किसी भी समय लाइसेंस प्रस्तुत करने के लिए बाध्य होगा।

( iv) आयुक्त को Himachal Pradesh Municipal Corporation Act, 1994 के अध्याय XVIII के प्रावधानों के अंतर्गत, लाइसेंस में उपयुक्त समझी जाने वाली किसी भी शर्त को लगाने या संशोधित करने का अधिकार होगा।

( v ) आवेदक को परिसर के संबंध में प्रस्तुत की गई जानकारी, जैसे—व्यवसाय/व्यापार का प्रकार, क्षेत्रफल, मानचित्र की स्वी—ति तथा संपत्ति का स्वरूप (वाणिज्यिक अथवा आवासीय आदि) — के सत्य होने संबंधी एक स्व-घोषणा (Self-Declaration) प्रस्तुत करनी होगी, जो उसके ज्ञान एवं विश्वास के अनुसार सत्य होगी।

(vi) लाइसेंसधारी को परिसर में विक्रय अथवा भंडारण हेतु रखी गई वस्तुओं का समुचित अभिलेख, लाइसेंसिंग अधिकारी की अपेक्षा अनुसार संधारित करना होगा। साथ ही, लाइसेंसधारी आयुक्त या लाइसेंसिंग अधिकारी द्वारा समय-समय पर जारी निर्देशों एवं आदेशों का पालन करेगा। (vii) लाइसेंसधारी नगर निगम के सभी देयकों का समय पर भुगतान सुनिश्चित करेगा।

(viii)लाइसेंस जारी करने की समय-सीमा.—लाइसेंस का निर्गमन Himachal Pradesh Public Service Guarantee Act, 2011 के अंतर्गत इस सेवा के लिए अधिसूचित/निर्धारित समय-सीमा के अनुसार किया जाएगा।

9. विलंब शुल्क.—यदि कोई व्यक्ति निर्धारित अवधि के भीतर लाइसेंस का नवीनीकरण कराने में असफल रहता है, तो उसे विलंबित अवधि के लिए निम्नानुसार विलंब शुल्क जमा करना होगा :–

(i) प्रथम माह के लिए – लाइसेंस शुल्क का 50% (ii) द्वितीय माह के लिए – लाइसेंस शुल्क का 75% (iii) एक वर्ष तक – लाइसेंस शुल्क का 100% (iv) दो वर्ष तक – लाइसेंस शुल्क का 125% (v) शेष अवधि के लिए – लाइसेंस शुल्क का 150%1311 राजपत्र, हिमाचल प्रदेश, 25 अप्रैल, 2026/05 वैशाख, 1948 10. लाइसेंस अस्वी—ति.—(1) निम्नलिखित परिस्थितियों में लाइसेंस प्रदान नहीं किया जाएगा,– (क) किसी संक्रामक रोग से पीड़ित व्यक्ति को

(ख) ऐसे व्यक्ति को जो Himachal Pradesh Municipal Corporation Act, 1994 के अध्याय XVIII में उल्लिखित किसी वस्तु के अवैध विक्रय या भंडारण के अपराध में दोषसिद्ध (Convicted) हो चुका हो।

(ग) ऐसे व्यक्ति को, जो इन उप-विधियों अथवा लाइसेंस की शर्तों का बार-बार उल्लंघन करता पाया गया हो।

(घ) 18 वर्ष से कम आयु के व्यक्ति को

(2) (क) उप-विधि 10(1) के अधीन, जो कोई व्यक्ति इस संबंध में आयुक्त या लाइसेंसिंग अधिकारी के समक्ष आवेदन प्रस्तुत करता है तथा निर्धारित शुल्क जमा करता है, उसे लाइसेंस प्रदान किया जाएगा, जब तक कि लिखित रूप में कारण दर्ज करते हुए उसे अस्वी—त न किया जाए।

(ख) लाइसेंस के हस्तांतरण के समय, लाइसेंसधारी को प्रति लाइसेंस `____/- की दर से हस्तांतरण शुल्क देय होगा।

(ग) लाइसेंसधारी लाइसेंस की शर्तों एवं नियमों का पालन करेगा तथा लाइसेंस को परिसर के किसी सुविधाजनक/स्पष्ट रूप से दिखाई देने वाले स्थान या स्वागत कक्ष (Reception) में प्रदर्शित करेगा।

(घ) निरीक्षक या संबंधित निरीक्षण कर्मचारी को परिसर में प्रवेश कर निरीक्षण करने का अधिकार होगा तथा लाइसेंसधारी ऐसे निरीक्षण के दौरान आवश्यक सहयोग प्रदान करेगा। (ङ) लाइसेंसधारी किसी भी प्रकार से सार्वजनिक मार्गों या नगरपालिका नालियों पर अतिक्रमण अथवा बाहर की ओर निकला हुआ प्रक्षेपण (Overhanging Projection) नहीं करेगा। 11. अपराध एवं दंड.—

(1) अपराध.—निम्नलिखित —त्य/त्रुटियां इन उप-विधियों के अंतर्गत अपराध मानी जाएंगी:– (क) नगर निगम बद्दी से वैध व्यापार लाइसेंस प्राप्त किए बिना भाग-I में सूचीबद्ध किसी व्यवसाय/व्यापार/गतिविधि को प्रारंभ करना, संचालित करना या चलाना अथवा भाग-II में सूचीबद्ध किसी वस्तु का भंडारण करना।

(ख) लाइसेंस की अवधि समाप्त होने, निलंबित होने या निरस्त किए जाने के पश्चात्‌ भी व्यवसाय/व्यापार का संचालन जारी रखना।

(ग) लाइसेंस के अनुदान/नवीनीकरण/हस्तांतरण के लिए आवेदन करते समय क्षेत्रफल, गतिविधि की प्र—ति या परिसर की श्रेणी के संबंध में मिथ्या प्रतिपादन सहित कोई भी गलत, भ्रामक, अपूर्ण या असत्य जानकारी प्रदान करना।

(घ) लाइसेंस में निर्दिष्ट किसी भी शर्त का उल्लंघन करना अथवा आयुक्त या लाइसेंसिंग अधिकारी द्वारा समय-समय पर जारी निर्देशों का पालन न करना।

(ङ) निरीक्षण के दौरान निरीक्षक या किसी प्राधि—त अधिकारी को परिसर में प्रवेश करने से रोकना या मना करना, अथवा आवश्यक अभिलेख, दस्तावेज या सहयोग प्रदान न करना।1312 राजपत्र, हिमाचल प्रदेश, 25 अप्रैल, 2026/05 वैशाख, 1948 (च) इन उप-विधियों के अंतर्गत अनुमत स्थिति को छोड़कर, लाइसेंसधारी या उसके विधिक उत्तराधिकारी के अतिरिक्त किसी अन्य व्यक्ति द्वारा लाइसेंस का अनधि—त हस्तांतरण, उधार देना या दुरुपयोग करना।

(छ) नगरपालिका भूमि, सार्वजनिक सड़क, फुटपाथ या नगरपालिका नाली पर अतिक्रमण करना अथवा सामान, बोर्ड, वस्तुएं या अस्थायी/स्थायी संरचना निकालकर अवरोध उत्पन्न करना।

(ज) प्रतिबंधित वस्तुओं का भंडारण/विक्रय करना, या अनुमत मात्रा से अधिक वस्तुओं का भंडारण करना, अथवा नगर निगम या किसी अन्य वैधानिक प्राधिकरण द्वारा निर्धारित सुरक्षा मानकों के अनुरूप न होकर खतरनाक सामग्री का भंडारण करना। (झ) नगर निगम द्वारा जारी किसी लाइसेंस, आधिकारिक अभिलेख या दस्तावेज के साथ छेड़छाड़ करना, परिवर्तन करना या परिवर्तन करने का प्रयास करना।

(ञ) इन उप-विधियों के अनुसार लाइसेंस को परिसर के किसी स्पष्ट एवं –ष्टिगोचर स्थान पर प्रदर्शित न करना।

(ट) सरकार द्वारा समय-समय पर जारी मानकों/निर्देशों का पालन न करना। (ठ) बाल श्रम का उपयोग करना।

(2) दंड.—इन उप-विधियों के अंतर्गत अपराध करने वाला कोई भी व्यक्ति निम्नलिखित दंडों के लिए उत्तरदायी होगा :–

(क) बिना लाइसेंस संचालन करने पर दंड.—लघु श्रेणी व्यवसाय/व्यापार हेतु `5,000/- तक, मध्यम श्रेणी व्यवसाय/व्यापार हेतु `10,000/- तक, तथा बड़े श्रेणी व्यवसाय/व्यापार हेतु `25,000/- तक का जुर्माना, साथ ही वैध लाइसेंस प्राप्त किए जाने तक परिसर को तत्काल बंद/सील किया जा सकता है।

(ख) लाइसेंस की अवधि समाप्त होने के बाद संचालन करने पर दंड.—वार्षिक लाइसेंस शुल्क के 100% के समतुल्य जुर्माना, इसके अतिरिक्त उप-विधि 9 के अंतर्गत देय विलंब शुल्क भी देय होगा।

(ग) लाइसेंस की शर्तों के उल्लंघन पर दंड.—`10,000/- तक का जुर्माना, तथा पुनरावृत्ति की स्थिति में लाइसेंस का निलंबन या निरस्तीकरण किया जा सकता है।

(घ) असत्य जानकारी या मिथ्या प्रतिपादन करने पर दंड.—`20,000/- तक का जुर्माना, तथा लाइसेंस का निरस्तीकरण एवं एक वर्ष तक पुनः आवेदन करने से अयोग्यता। (ङ) निरीक्षण में बाधा पहुँचाने पर दंड.—`5,000/- तक का जुर्माना, तथा आयुक्त द्वारा उपयुक्त समझी जाने वाली अतिरिक्त कार्यवाही।

(च) अनधि—त अतिक्रमण करने पर दंड :–`10,000/- तक का जुर्माना तथा अतिक्रमण को लाइसेंसधारी के व्यय पर हटाया जाएगा। पुनरावृत्ति की स्थिति में परिसर को सील किया जा सकता है।

12. व्याख्या.—इन उप-विधियों की व्याख्या में किसी प्रकार की अस्पष्टता उत्पन्न होने की स्थिति में, सक्षम प्राधिकारी (इस प्रकरण में आयुक्त) का निर्णय अंतिम एवं बाध्यकारी होगा।

13. संशोधन एवं निरसन.—इन उप-विधियों में किसी भी प्रकार का संशोधन, परिवर्तन, जोड़ या विलोपन आयुक्त की अध्यक्षता में गठित एक समिति द्वारा किया जाएगा, जिसमें आयुक्त द्वारा उपयुक्त समझे जाने वाले संबंधित हितधारकों को सम्मिलित किया जा सकेगा।

MUNICIPAL CORPORATION BADDI

NOTIFICATION

Dated, 18th April, 2026

No. M.Corp./Baddi/Bye Laws (Trade License)/2026-(2).—In exercise of the powers conferred under Chapter XVIII read with section 395 of the Himachal Pradesh Municipal Corporation Act, 1994 Municipal Corporation Baddi hereby proposes to make the following Bye- Laws which shall be called "Municipal Corporation Baddi-Grant of Trade License for Use of Premises and Storage of Articles in Premises Bye-Laws- 2026."

The draft of the said Bye-Laws was published in the Official Gazette vide gazette No. 269/GAZETTE/2026 dated 10-03-2026 for inviting objections and suggestions from the general public within a period of thirty (30) days from the date of publication;

And whereas, no suggestions or objections have been received within the stipulated period;

Now, therefore, in exercise of the powers conferred under Chapter XVIII read with Section 395 of the Himachal Pradesh Municipal Corporation Act, 1994, the Municipal Corporation Baddi hereby finally publishes and notifies the Grant of Trade License for Use of Premises and Storage of Articles in Premises Bye-Laws- 2026.

These Bye-Laws shall come into force from the date of their publication in the Official Gazette.

1. Short title, extent and commencement.—(i) These Bye-Laws may be called

"Municipal Corporation Baddi-Grant of Trade License for Use of Premises and Storage

of Articles in Premises Bye-Laws- 2026."

(ii) No person or business operator shall commence or carry on any business activity without a license issued as per the provisions under Section 324 of chapter XVIII & 1st schedule of the Himachal Pradesh Municipal Corporation Act, 1994 and the Bye- Laws made thereunder.

(iii) These Bye Laws shall apply to all shops/premises falling within the Municipal limits of this Corporation which may not be used without license for the purpose specified in Section 324 of chapter XVIII and Part-I and Part-II of 1st schedule of the HimachaI Pradesh Municipal Corporation Act, 1994 for use of premises and/or storage of any Article within the municipal limits. (Part-I and Part-II appended at the end of the By Laws).

2. Definitions.—in these Bye-Laws, unless the context otherwise requires:—

(a) "Act" means the Himachal Pradesh Municipal Corporation Act. I994, (Act No. 12 of 1994).

(b) "Authorized Officer "means Commissioner or any other Officer specifically authorized by the Commissioner Municipal Corporation, Baddi.

Corporation duly authorized by the Commissioner.

(d) "License" means a written permission granted by the Commissioner, or any other official/Officer duly authorized by the Commissioner, in favour of the person, owner & occupier of premises for sale/storage of articles specified in Part-I and II appended at the end of these Bye-Laws.

(e) "Licensing Officer" means Commissioner or any other officer duly authorized by the Commissioner to grant/ renew License under the provisions of these Bye-Laws.

(f) "Premises" means any shop/ store/ place where the articles specified in Part I & II are kept for sale/storage.

(g) "Small Scale Business/Trade" means premises covering maximum area of 25 sq.ft., "Medium Scale Business/Trade" means premises covering area of 25Sq.ft. to 100 sq.ft, and "large Scale Business/Trade" means premises covering area more than 100 sq.ft.

(h) "Shopkeeper" means any person running and managing the affairs of the shop/premises/place including its owner/occupier, but shall not include a trespasser.

(i) The words and expression defined under these Bye-Laws shall have the same meaning or sense as are defined in Himachal Pradesh Municipal Corporation Act 1994.

3. Procedure for obtaining License.—Any person who wants to operate/run any business/trade as specified in Part-I and/or store any article as specified in Part-II within the areas of the Municipal Corporation Baddi shall apply for license through the online portal https://citizenseva.hp.gov.in/hp-udd/. In case of violation of this provision, penalty as prescribed under these Bye Laws shall be imposed.

4. Period of License.—The License shall be issued either for 1 year or for a period of five years at a time and the License shall automatically come to an end after completion of such period.

5. Renewal of License.—The License will have to be renewed by the license holder after the expiry of the validity period of license. The license shall be renewed without any late fee if the application of renewal is applied within 1 month after expiry of the license.

6. Transfer of License.—The license issued under the Bye-Laws shall not be transferred in the name of any person except in case of the death of original licensee wherein it shall be made/ transferred in the name of the legal heirs only for the validity period of license on production of supporting documents and shall be decided by the Commissioner keeping in view the circumstances of the case.

7. License Fee.—(a) The license fee for grant of license shall be decided by the Commissioner from time to time. However, the fee will be calculated on annual license fee rate multiplied by number of years the license is requested by the applicant. The fee shall be charged in the following manner:—

The fees charged from small/medium/large Shops/Stalls put up during festivals/fairs or any other occasion within Municipal Corporation jurisdiction shall be decided by the commissioner, Municipal Corporation Baddi from time to time.

(for reference Small Shop/Stall means premises covering maximum area of 25 sq. ft.,

Medium Shop/Stall means premises covering area of 25 Sq.ft. to 100sq. ft. and large

Shop/Stall means premises covering area of more than 100 Sq. ft.)

(b) Fee structure for permission for Shooting of the Films/Movies/Documentaries/TV Serials/Musical Albums/ Advertisements in MC area:

8. Conditions for grant of license.—(i) The License shall not be valid for any other purpose, except for the items/articles for which it is granted under these Bye Laws.

(ii) The permission shall, unless specified otherwise in the license, be valid in the entire Municipal Corporation limits, subject to such conditions as may be imposed by the Commissioner.

(iii) The owner/occupier of the premises shall have to produce the license before the inspector or the licensing officer at any point of time as may be demanded/ ordered by them.

(iv) The Commissioner shall have a right to impose or alter any of conditions in the license as may be deemed fit by him/her under the provisions of Chapter XVIII of the Himachal Pradesh Municipal Corporation Act, 1994.

(v) The applicant shall submit a self-declaration regarding information submitted by him / her about the premises to be used for business/trade viz. type of business, area, approval of map and nature of property i.e. commercial or domestic etc. to be true to the best of his knowledge and belief.

(vi) The licensee shall maintain proper records of the articles kept for sale or storage in the premises, as may be required by the Licensing Officer. Further, the licensee shall comply with all directions and instructions issued to him by the Commissioner or the Licensing Officer from time to time.

(viii)Time period for issue of License.—The license shall be issued as per the timelines notified/specified for this service under the Public Service Guarantee Act, 2011.

9. Late Fees.—In case the person fails to renew the license within the stipulated period, he/she shall have to deposit late fees for the delayed period as under:

(i) @ 50% of the license amount for the first month, (ii) @ 75% for the second month, (iii) @ 100% up to one year, (iv) @ 125% up to two years, and (v) @ 150% for the remaining period

10. Denial of License:—(1) The license shall not be granted:

(a) to a person suffering from any contagious disease,

(b) to a person convicted for unlawful sale or storage of any articles mentioned in Chapter XVIII of the Himachal Pradesh Municipal Corporation Act, 1994, (c) to a person who has been found to have habitually committed breach of these Bye-Laws or the terms of the license,

(d) to a person below the age of 18 years.

(2) (a) Subject to Bye-Law 10(1), license to any person who applies to the Commissioner or Licensing Officer in this behalf and tenders the prescribed fee shall be granted by that officer, unless refused for reasons to be recorded in writing.

(b) The licensee shall be liable to pay transfer charges @_ /- per license at the time of transfer of license.

(c) The licensee shall abide by the terms and conditions of the license and the license shall be displayed at a convenient/conspicuous place or at the reception of the premises.

(d) The Inspector or inspecting staff concerned shall have the right to enter and inspect the premises, and the licensee shall provide necessary assistance during such inspection

(e) The licensee shall not make any encroachment or overhanging projection on public streets or municipal drains in any manner.

11. Offences and Penalties.—

(1) Offences.—The following acts/omissions shall constitute offences under these Bye-Laws.—

(a) Commencing, carrying on, or operating any business/trade/activity listed in Part-I or storing any article listed in Part-II without obtaining a valid Trade License from the Municipal Corporation, Baddi.

(c) Providing false, incorrect, misleading, or incomplete information at the time of applying for grant/renewal/transfer of license, including misrepresentation regarding the area, nature of activity, or category of premises.

(d) Violating any of the conditions specified in the license or any directions issued by the Commissioner or the Licensing Officer from time to time.

(e) Obstructing or refusing entry to the Inspector or any authorized officer during inspection, or failing to provide required records, documents, or assistance.

(f) Unauthorized transfer, lending, or misuse of the license by any person other than the licensee or his/her legal heir(s) as permitted under these Bye-Laws.

(g) Encroaching upon municipal land, public street, footpath, or municipal drain or causing obstruction by projecting goods, boards, articles, or any temporary/permanent structure.

(h) Storage/selling of prohibited articles or storage of articles in excess of the permitted quantity, or storage of hazardous materials not in compliance with safety norms prescribed by the Municipal Corporation or any other statutory authority.

(i) Tampering with, altering, or attempting to alter any license, official record, or document issued by the Municipal Corporation.

(j) Failure to display the license at a conspicuous place in the premises as required under these Bye-Laws.

(k) Failure to comply to the norms issued by the Government from time to time (l) Use of Child labor

(2) Penalties.—Any person committing an offence under these Bye-Laws shall be liable to the following penalties:

(a) Penalty for operating without a license.—A fine up to `5,000/- for Small Scale, `10,000/- for Medium Scale, and `25,000/- for Large Scale Business/Trade, in addition to immediate closure/sealing of the premises until a valid license is obtained.

(b) Penalty for operating after expiry of license.—A fine equivalent to 100% of the annual license fee, besides the late fee payable under Bye-Law 9.

(c) Penalty for violation of license conditions.—A fine up to `10,000/-, and in case of repeated violations, suspension or cancellation of the license.

(d) Penalty for providing false information or misrepresentation.—A fine up to `20,000/-, and cancellation of license with disqualification from applying for 1 year.

(f) Penalty for unauthorized encroachment.—A fine up to `10,000/- and removal of encroachment at the cost of the licensee. For repeated violations, sealing of premises may be ordered.

(g) Penalty for unauthorized transfer or misuse of license.—A fine up to `15,000/- and cancellation of the license.

(h) Penalty for unsafe or unauthorized storage of articles.—A fine up to `25,000/- and confiscation of hazardous/prohibited materials. The premises may be sealed in the interest of public safety.

12. Interpretation.—In case of any ambiguity in interpretation, orders of the competent authority (Commissioner, in this case will be final).

13. Amendments and Abolishment.—Any amendments to these laws additions or deletions if any will be decided by a committee to be headed by the Commissioner including stakeholders as he/she may deem fit for the purpose.

संख्या ः गृह-सी (ए) 3-2/2026.--हिमाचल प्रदेश के राज्यपाल, दंड विधि संशोधन अधिनियम, 1932 (1932 का अधिनियम संख्यांक 23) की धारा 10 की उप-धारा (1) और (2) के साथ पठित विधायी विभाग, विधि और न्याय मन्त्रालय, भारत सरकार द्वारा जारी अधिसूचना संख्याः एसओ 2790 (ई) तारीख 16 जुलाई, 2024 के अधीन प्रदत शक्तियों का प्रयोग करते हुए, और इस विभाग की अधिसूचना संख्या गृह (जी) एफ (8) 1/77 तारीख 9 मार्च, 1978 और गृह-II (ई) -5-10/80 तारीख 6 सितंबर, 1980 के अनुक्रम में, भारतीय न्याय संहिता, 2023 (2023 का अधिनियम संख्यांक 45) की धारा 351 के अधीन दंडनीय अपराध, जो पूर्वतम भारतीय दंड संहिता, 1860 (1860 का अधिनियम संख्यांक 45) की धारा 506 के अधीन एक अपराध था, को हिमाचल प्रदेश की क्षेत्रीय अधिकारिता सीमाओं के भीतर संज्ञेय और गैर-जमानती अपराध धोषित करते हैं।

No. HOME-C (A) 3-2/2026.—In exercise of the powers conferred under sub-section (1) and (2) of Section 10 of Criminal Law Amendment Act, 1932 (Act No. 23 of 1932) read with Notification No. SO 2790 (E), dated: 16th July, 2024 issued by the Legislative Department, Ministry of Law and Justice, Government of India and in continuation of this Department's Notifications No. Home (G) F (8) 1/77 dated: 9th March, 1978 and Home-II (E) -5-10/80 dated: 6th September, 1980 the Governor, Himachal Pradesh, is pleased to declare that an offence punishable under Section 351 of the Bharatiya Nyaya Sanhita, 2023 (Act No. 45 of 2023), which was earlier an offence under section 506 of Indian Penal Code, 1860 (Act No. 45 of 1860) shall be cognizable and non-bailable within the territorial limits of the State of Himachal Pradesh.
