Notice Of Adoption Of Existing Land Use Map

No. HIM/TP/PJT/PA-Arki/2014/Vol-I/- 815-837.—Whereas, objections and suggestions were invited vide Notice No. HIM/TP/PJT/PA-Arki/2014/Vol-I/10937-62, Dated 29-03-2022 35-राजपत्र/2026-18-05-2026 (2925)2926 राजपत्र, हिमाचल प्रदेश, 18 मई, 2026/28 वैशाख, 1948 published in Rajpatra on 06-04-2022 with respect to the Existing Land Use Map of Arki Planning Area, under sub-section (1) of Section 15 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977); and whereas, objection and suggestion were received and the modification have been made in the said Existing Land Use Map, wherever, required.

Now, therefore, in exercise of the powers vested under sub-section (3) of Section 15 of the Act ibid, Notice is given that the Existing Land Use Map for Arki Planning Area is hereby adopted with modifications and a copy thereof is available for inspection during office hours in the following offices:—

1. The Director, Town and Country Planning Department, Nagar Yojana Bhawan, Block No. 32-A, Vikas Nagar, Kasumpati, Shimla, Himachal Pradeh.

2. The Town and Country Planner, Divisional Town Planning Office, Solan, District Solan, Himachal Pradesh.

3. The Secretary, Nagar Panchayat, Arki, District Solan, Himachal Pradesh.

The said Existing Land Use Map shall come into operation with effect from the date of publication of this Notice in the Official Gazette of Himachal Pradesh and it shall be conclusive evidence of the fact that the Map has been duly prepared and adopted.

No.SEC(F)10-21-/2020-II-7585-89.—Whereas the Returning Officer-cum-Block Development Officer Surani, district Kangra vide his Letter No. DBS/Election-2026-1540, dated 16-05-26 has informed that the Assistant Engineer Jal Shakti Vibhag Sub-Division Dhaneta vide its letter No. JSV-DNT-Elect.2026-27/276-77, dated 16-05-26 has intimated that Sh. Anil Kumar s/o Sh. Babu Ram a candidate for the post of Pradhan, Gram Panchayat Kopra, Dev. Block Surani is working as Senior Assistant in Jal Shakti Vibhag Sub-Division Dhaneta. He has further informed that the said officer has not been attending the office w.e.f. 02-03-26 without any intimation;

And Whereas, Section 122 (1) (i) of the Himachal Panchayati Raj 1994 provides that a person shall be disqualified for being chosen as office bearer of a Panchayat if he is in the employment or service under any Panchayat or of any other local authority or Co-operative Society or the State Government or Central Government or any Public Sector Undertaking under the Control of the Central or the State Government;

And Whereas, the name of said Sh. Anil Kumar has been included in the list of validly nominated candidates prepared by the concerned ARO. Further, he has also been allotted symbol "Wrist Watch" and his name is placed at Sr. No. 1of the list of contesting candidates;

In view of facts, submitted here-in-above the State Election Commission is of the considered view that the process of scrutiny undertaken for the post of Pradhan in G.P. Kopra by the ARO has been vitiated. Therefore, the State Election Commission in exercise of power vested in it under Article 243K of the Constitution of India, Section 160(1) of the Himachal Pradesh Panchayati Raj Act, 1994 read with the rule 32 (5) of the Himachal Pradesh Panchayati Raj Election Rule, 1994 and all other plenary powers vested in this behalf, hereby invalidates the process of scrutiny undertaken by the ARO in respect of post of Pradhan Gram Panchayat Kopra, Dev. Block Surani, District Kangra.

Further, the State Election Commission hereby directs that the ARO will undertake the process of scrutiny afresh on 17-05-26 at 2.00 P.M. Onwards. Any validly nominated candidate may withdrawal his candidature by 19th May, 2026 before 3.00 P.M. Immediately after the time of withdrawal is over, the ARO shall prepare fresh list of contesting candidates under Rule, 41 on form 24 and the symbol already allotted on the said date to them shall not be changed as the contesting Candidates are already canvassing on the said symbols. The process with regard to allotment of symbol to other contesting candidates (except Sh. Anil Kumar the Govt. servant) is hereby validated to this extent. The ARO will ensure that a due written notice is given to all the contesting candidates including Sh. Anil Kumar, for the scrutiny of nomination paper as per schedule given above. Further, the poll for all the posts in respect of this Panchayat shall be undertaken on 30th May, 2026 between 7.00 A.M. to 3.00 P.M. and Counting in respect of Gram Panchayat Kopra shall be undertaken immediately after the closing of Poll at the Gram Panchayat Head Quarter. The District Election Officer–cum-Deputy Commissioner Kangra will ensure that soon after the list of contesting Candidates is published, same shall also be sent to the Commission through a special messenger intimating the number of electors in Gram Panchayat Kopra in order to carry out printing of fresh ballot paper for the post of Pradhan in the Himachal Pradesh Govt. Printing Press Ghora Chowki Shimla-5.

No. SEC(F)1-45/2024-I-7732.—Whereas the Returning Officer -cum- Block Development Officer, Development Block Rohru, District Shimla, Himachal Pradesh has informed that the2928 राजपत्र, हिमाचल प्रदेश, 18 मई, 2026/28 वैशाख, 1948 Assistant Returning Officer, Gram Panchayat Dalgaon, Development Block Rohru, District Shimla has prepared the list of contesting candidates without following the alphabetic order for the post of Pradhan. Further, he has also allotted the symbols to the contesting candidates in a jumbled manner without following the sequence of symbols notified by the Commission;

And whereas, the State Election Commission is of considered view that the contesting candidates for the post of Pradhan Gram Panchayat Dalgaon have been canvassing on the symbols allotted to them by the Assistant Returning Officer. Therefore, in order to avoid the confusion among the voters it will be appropriate, just and equitable that order of contesting candidates as mentioned in Form-24 and symbols allotted to them are kept unchanged;
