सामाजिक समाघात निर्धारण अध्ययन को सामाजिक समाघात निर्धारण इकाई द्वारा कार्यान्वित किया गया था और नियम 4 के अधीन अधिकथित इकाई अर्जन समाहर्ता द्वारा गठित टीम द्वारा प्रारम्भिक जांच रिपोर्ट प्रस्तुत की गई। सामाजिक समाघात निर्धारण रिपोर्ट/प्रारम्भिक जांच का संक्षेप निम्नलिखित प्रकार से है :

हिमाचल प्रदेश सरकार द्वारा भूमि अर्जन, पुनर्वासन और पुनस्र्थापन में उचित प्रतिकार और पारदर्शिता के अधिकार अधिनियम, 2013 (2013 का 30) की धारा 4 के अधीन सामाजिक प्रभाव आकलन (एसआईए) करने के लिए, अधिसूचना तारीख 12-06-2025 द्वारा सामाजिक प्रभाव आकलन इकाई को अधिसूचित किया गया था। सामाजिक प्रभाव आकलन इकाई द्वारा सामाजिक प्रभाव आकलन (एसआईए) रिपोर्ट का अध्ययन किया गया और सरकार को इस बारे रिपोर्ट प्रस्तुत की गई। हिमाचल प्रदेश सरकार की अधिसूचना तारीख 01-11-2025 द्वारा अधिसूचित विशेषज्ञ समूह द्वारा, एसआईए रिपोर्ट का मूल्यांकन किया गया, जिसमें परियोजना की सामाजिक स्वीकायर्ता, तकनीकी व्यवहारिकता, आर्थिक सु–ढ़ता, क्षेत्रीय विकास और जन कल्याण हेतु मामले में भूमि अर्जन, पुनर्वासन और पुनस्र्थापन में उचित प्रतिकर और पारदर्शिता के अधिकार अधिनियम, 2013 के उपबन्धों के अनुसार उचित और वैध मुआवजे के संदाय के अध्यधीन भूमि अधिग्रहण प्रस्ताव के अनुमोदन और कार्यान्वयन की सिफारिश की गई है। इस विभाग के पत्र तारीख 05-02-2026 के द्वारा सामाजिक प्रभाव आकलन (एसआईए) की रिपोर्ट और विशेषज्ञ समूह की मूल्यांकन रिपोर्ट की प्रतियां सम्बन्धित जिला समाहर्त्ता, नाहन, जिला सिरमौर, हिमाचल प्रदेश और उप-मण्डल मजिस्ट्रेट, पौंटा साहिब, जिला सिरमौर, हिमाचल प्रदेश को प्रभावित क्षेत्रों में प्रकाशन हेतु उपलब्ध करावाई गई हैं।

प्रस्तावित भूमि अधिग्रहण के कारण किसी भी परिवार के विस्थापित होने की संभावना नहीं है। अतः यह अधिसूचित किया जाता है कि उक्त प्रयोजन हेतु अर्जित की जाने वाली प्रस्तावित भूमि के ब्यौरे निम्न प्रकार से हैं :

यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-11 के उपबन्धों के अन्तर्गत जारी की जाती है। भूमि की योजना का निरीक्षण भूमि अर्जन समाहर्ता के कार्यालय में किसी भी कार्य दिवस में किया जा सकेगा।

हिमाचल प्रदेश के राज्यपाल पूर्वोक्त अधिनियम में धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए इस उपक्रम में कार्यरत सभी अधिकारियों, उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उप-धारा द्वारा अपेक्षित अथवा अनुमतः अन्य सभी कार्याें और समस्त अन्य कार्यों, जो उक्त अधिनियम की धारा-12 के अधीन यथा उपबन्धित कार्य के समुचित निष्पादन के लिए अपेक्षित हो, करने हेतु अधि—त करते हैं।

अधिनियम की धारा-11(4) के अधीन कोई भी व्यक्ति इस अधिसूचना के प्रकाशन की तारीख से सम्बन्धित समाहर्ता के पूर्वानुमोदन के बिना ऐसी भूमि पर कोई भी लेन-देन संव्यवहार नहीं करेगा या भूमि का कोई भी संव्यवहार अर्थात्‌ क्रय/विक्रय आदि कारित नहीं करेगा या कोई विल्लंगम सृजित नहीं करेगा।4475 राजपत्र, हिमाचल प्रदेश, 15 जून, 2026/25 ज्येष्ठ, 1948 कोई भी हितबद्ध व्यक्ति जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आक्षेप हो तो वह इस अधिसूचना के प्रकाशित होने के 60 दिन की अवधि के भीतर अधिनियम की धारा 15 के अधीन, लिखित रूप में भू-अर्जन समाहर्ता (दक्षिण क्षेत्र), हिमाचल प्रदेश लोक निर्माण विभाग, विंटरफिल्ड, जिला शिमला-3 के समक्ष दायर कर सकेगा।

4. कोई भी हितबद्ध व्यक्ति जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आपत्ति हो तो वह इस अधिसूचना के प्रकाशित होने के साठ दिन की अवधि के भीतर लिखित रूप में भू-अर्जन समाहर्ता (शिमला क्षेत्र), लोक निर्माण विभाग, जिला शिमला (हि0प्र0) के समक्ष अपनी आपत्ति दायर कर सकता है। 5. यह अधिसूचना माननीय उच्च न्यायालय, हिमाचल प्रदेश में इस मामले में दायर LPA के अन्तिम आदेशानुसार प्रभावी मानी जाएगी।

संख्याः ईडीयूसी-ए03/4/2023-ईडीयू-सी (152585).--हिमाचल प्रदेश के राज्यपाल, निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार अधिनियम, 2009 की धारा 38 द्वारा प्रदा शक्तियों का प्रयोग करते हुए, अधिसूचना संख्याः ईडीयूसी-ए03/4/2023-ईडीयू-सी(152585) तारीख 24-07-2025 द्वारा अधिसूचित और राजपत्र (ई-गजट), हिमाचल प्रदेश में तारीख 28 जुलाई, 2025 को प्रकाशित "हिमाचल प्रदेश निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार नियम, 2025" का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारंभ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार (प्रथम संशोधन) नियम, 2026 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृत्त होंगे।4479 राजपत्र, हिमाचल प्रदेश, 15 जून, 2026/25 ज्येष्ठ, 1948 2. नियम 9 का संशोधन.--हिमाचल प्रदेश निःशुल्क बाल शिक्षा का अधिकार नियम, 2025 (जिसे इसमें इसके पश्चात्‌ 'उक्त नियम' कहा गया है) के नियम 9 के उप-नियम (9) के पश्चात्‌ निम्नलिखित उप-नियम अन्तःस्थापित किया जाएगा, अर्थात्‌ :—

3. प्ररूप का संशोधन.--उक्त नियमों से संलग्न प्ररूप-2 में,-

(i) "तीन वर्ष" शब्दों का लोप किया जाएगा; और

(ii) शर्त 5(i) में, "किसी कक्षा में फेल नहीं किया जाएगा" शब्दों के पश्चात्‌ निम्नलिखित शब्द और अंक अन्तःस्थापित किए जाएंगे, अर्थात:—

",सिवाय ऐसी रीति से तथा ऐसी शर्तों के अध्यधीन, जैसा कि नियम 10क में यथा उपबंधित है,"।

No. EDUC-A03/4/2023-EDU-C(152585).—In exercise of the powers conferred by section 38 of the Right of Children to Free and Compulsory Education Act, 2009, the Governor, Himachal Pradesh is pleased to make the following rules further to amend the "Right of Children to Free and Compulsory Education, Himachal Pradesh Rules, 2025" notified vide Notification No. EDUC- A03/4/2023-EDU-C(152585) dated 24-07-2025 and published in Rajpatra (e-Gazette), Himachal Pradesh on 28-07-2025, namely :—

1. Short title and commencement.—(1) These rules may be called the "Right of Children to Free and Compulsory Education, Himachal Pradesh (1st Amendment) Rules, 2026.

(2) They shall come into force from the date of their publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of Rule 9.—In the Right of Children to Free and Compulsory Education, Himachal Pradesh Rules, 2025 (hereinafter referred to as the 'said rules'), after sub-rule (9) of rule-9, the following shall be inserted, namely :—

"(10) The period of recognition shall be for such time as may be notified by the State

Government from time to time."

3. Amendment of Form.—(i) In Form No.- II appended to the said rules,

(i) the words "of three years" shall be deleted ; and

(ii) In condition 5(i), after the words " held back in any class" the following shall be inserted, namely:—

"'except in such manner and subject to such conditions as provided in rule

10A,".
