FOREST DEPARTMENT

Shimla-2, the 22nd June, 2026

No. FFE-B-E(3)-116/2017.—WHEREAS, a total of 2183 cases of roads constructed on forest land have been under consideration for obtaining requisite approvals under the relevant/applicable enactment namely the Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980 in the wake of Civil Miscellaneous Petition No. 10892/2025 in CWPIL No. 91 of 2017;

AND WHEREAS, the Hon'ble High Court of Himachal Pradesh in CWPIL No. 91 of 2017 vide order dated 20-03-2026 has observed that it shall be open to the State to take appropriate action in accordance with law regarding the manner in which such cases are to be processed under the relevant enactments;

AND WHEREAS, Section 3(2) of the FRA, 2006 read with the Rules framed thereunder and the guidelines issued by the Government of India provides for diversion of forest land for certain public utility facilities, including roads, subject to fulfillment of prescribed conditions;

NOW THEREFORE, after due consideration of all the facts, circumstances and court orders, it has been decided that all User Agencies shall identify, examine and process the road cases, if any, included in the list of 2183 roads which satisfy the provisions of the FRA, 2006, the Rules framed thereunder and the guidelines/instructions issued by the Government from time to time, competent authority/DFO concerned shall accord the approval thereof in accordance with the FRA and rules frames thereunder and guidelines/instructions of the Govt. of India. Other cases appearing in the said list but not fulfilling the provisions of Section 3(2) of the FRA, 2006 shall continue to be processed in accordance with the provisions of the Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980 and other applicable laws. This notification is issued in public interest.

No. FFE-B-A (3)-1/2026.—The Ministry of Environment, Forest & Climate Change, Government of India, while conveying the Final/Stage-II approval under Section-2(1) (ii) of the Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980 in favour of Himachal Pradesh State Forest Development Corporation Limited for non-forestry use of 13.281 ha. of Unclassed Forest land for dredging/mining in Beas River in Kullu District (Online Proposal No. FP/HP/MIN/QRY/ 523305/2025) on dated 10-04-2026, has stipulated a condition (amongst other conditions) that "the net revenue generated from the sale of minor minerals under this proposal shall be utilized for the implementation of a watershed management plan formulated with community participation. These funds shall be deposited in a separate bank account operated in the name of an SPV/Watershed Management Committee. The watershed management plan shall be approved and executed by the aforementioned SPV/Watershed Management Committee."

Therefore, the Governor of Himachal Pradesh, in pursuance to the above mentioned condition, is pleased to constitute the Watershed Management Committee for the said purpose, consisting of following members:—

No. UD-A(3)-8/2024-Solan.— In exercise of the powers conferred by sub-section (5) of Section 8 of the Himachal Pradesh Municipal Corporation Act, 1994 (Act No. 12 of 1994), the Governor of Himachal Pradesh is pleased to notify and designate the Divisional Commissioners of the respective jurisdictions (Shimla, Kangra and Mandi) as the "Competent Authority" for the purpose of the said sub-section.

The designated Competent Authority shall hear, examine, and decide any question that arises as to whether a Councillor of any Municipal Corporation within their respective territorial jurisdiction has become subject to any of the disqualifications mentioned in sub-sections (1) and (2) of Section 8 of the Act ibid.

No: HPERC/428.—In exercise of the powers conferred under section 61, sub-section (1) of section 62, clauses (a), (b) and (e) of sub-section (1) of Section 86 and clause (zd) of sub-section (2) of section 181 of the Electricity Act, 2003 (36 of 2003), read with section 21 of the General Clauses Act, 1897 (10 of 1897) and all other powers enabling it in this behalf, the Himachal Pradesh Electricity Regulatory Commission, hereby, after previous publication, makes the following Regulations further to amend the Himachal Pradesh Electricity Regulatory Commission (Promotion of Generation from the Renewable Energy Sources and Terms and Conditions for Tariff Determination) Regulations, 2017 (hereinafter referred to as "the RE Tariff Regulations, 2017"), namely:—

REGULATIONS

1. Short title and commencement.—(1) These Regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Promotion of Generation from the Renewable Energy Sources and Terms and Conditions for Tariff Determination) (Eighth Amendment) Regulations, 2026.

(2) These Regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Regulation 2.—In Regulation 2 of the Himachal Pradesh Electricity Regulatory Commission (Promotion of Generation from the Renewable Energy Sources and Terms and Conditions for Tariff Determination) Regulations, 2017, in sub-regulation (1)—

(i) after clause (ba), the following clauses (bb) and (bc) shall be inserted, namely:—

"(bb) 'Biomass' means wastes produced during agricultural, horticulture and forestry operations (for example, straws, stalks, litters and pine needles) or produced as a by-product of processing operations of agricultural produce (e.g., husks, shells, de-oiled cakes), wood produced in dedicated energy plantations or recovered from wild bushes or weeds and the wood waste produced in some industrial operations including such other wastes as may be recognised by the Central Government, as being part of biomass;

(bc) 'Biomass gasification' means the process of incomplete combustion of biomass resulting in the production of combustible gases consisting of a mixture of carbon monoxide (CO), hydrogen (H2) and traces of methane (CH4);"; and (ii) for the existing clause (ac), the following new clause shall be substituted, namely;—

"(ac)'Useful Life' in relation to the project including a dedicated evacuation system shall mean the useful life of the following duration to be reckoned from the Date of Commercial Operation of such project, namely:—

ii. Biomass power project with Rankine cycle technology: 25 years iii. Non-fossil fuel based co-generation project: 25 years iv. Small hydro Project: 40 years v. Municipal solid waste based power project/Refuse 20 years derived fuel based power project:

vi. Solar PV power project/ floating solar project/ 25 years Solar thermal power project:

vii. Biomass gasifier based power project: 25 years viii. Biogas based power project: 25 years ix. Renewable hybrid energy project: Minimum of the Useful Life

of different RE technologies combined for Renewable Hybrid Energy Project for Composite Tariff.

x. Renewable energy with storage project: Same as the Useful Life of the project, assuming that there is no storage."

श्रीमती सुनीता देवी पत्नी राज कुमार, निवासी गांव लहिणीधार, डा0 व तहसील सैंज, जिला कुल्लू (हि0प्र0) ने इस अदालत में ऑनलाईन आवेदन पत्र प्रस्तुत किया है कि उसका नाम राजस्व अभिलेख मोहाल दशाहड़ पटवार वृा बनोगी के रिकॉर्ड में सुनीता गुलेरिया पत्नी राज कुमार दर्ज है, जोकि गलत दर्ज हुआ है। जबकि अन्य दस्तावेजों में उसका नाम सुनीता देवी दर्ज है, जोकि सही है। प्रार्थिया ने ब्यान हल्फिया दिया है कि सुनीता गुलेरिया व सुनीता देवी दोनों नाम उसके ही है। प्रार्थिया राजस्व अभिलेख पटवार वृा बनोगी के मोहाल दशाहड़ में अपना नाम सुनीता गुलेरिया के बजाय सुनीता गुलेरिया उर्फ सुनीता देवी दर्ज करवाना चाहती है। प्रार्थिया ने इस अदालत से प्रार्थना की है, उसका नाम दर्ज करने के सम्बन्धित क्षेत्रीय कानूनगो/पटवारी की लिखित आदेश पारित करने की कृपा की है।

श्री जीवा नन्द पुत्र राम चन्द, निवासी गांव व डॉ0 रोपा, तहसील सैंज, जिला कुल्लू (हि0प्र0) ने इस अदालत में ऑनलाईन आवेदन-पत्र प्रस्तुत किया है कि उसका नाम राजस्व अभिलेख मोहाल सुचैहण पटवार वृा बनोगी में जीवन लाल दर्ज है जोकि गलत दर्ज हुआ है जबकि अन्य दस्तावेजों में उसका नाम जीवा नन्द दर्ज है जोकि सही हैं। प्रार्थी ने ब्यान हल्फिया दिया है कि जीवन लाल व जीवा नन्द दोनों नाम उसके ही हैं। प्रार्थी राजस्व अभिलेख पटवार वृा बनोगी के मोहाल सुचैहण में अपना नाम जीवन लाल के बजाय जीवन लाल उर्फ जीवा नन्द दर्ज करवाना चाहता हैं। प्रार्थी ने इस अदालत से प्रार्थना की है उसका नाम दर्ज करने के सम्बन्धित क्षेत्रीय कानूनगो/पटवारी को लिखित आदेश पारित करने की कृपा की हैं।
