Annexure-A GRAZING POLICY, 2026 OF HIMACHAL PRADESH

1. INTRODUCTION & JUSTIFICATION:

1.1 Pastoralism has historically shaped the alpine and sub-alpine landscapes of Himachal Pradesh, contributing significantly to rural livelihoods, cultural continuity, and the ecological functioning of grasslands and forest-grassland mosaics. In 1970, the Grazing Advisory Committee acknowledged that existing permit numbers lacked ecological justification and explicitly recommended that a scientific assessment of pasture carrying capacity be undertaken. Pending such an assessment, a temporary freeze on permits was implemented as a precautionary measure. Grazing governance in the State continues to operate under a regulatory framework frozen since 1970, wherein grazing permits and livestock numbers were capped without any supporting5403 राजपत्र, हिमाचल प्रदेश, 07 जुलाई, 2026/16 आषाढ़, 1948 scientific assessment of pasture dynamics or ecological resilience. More than five decades later, the absence of systematic reassessment despite explicit policy recommendations has resulted in administrative ambiguity, ecological misinterpretation, and socio-economic stress among genuine pastoralists. Contemporary ecological research from Himachal Pradesh, supported by global rangeland science, demonstrates that static, carrying-capacity-based regulation is ill-suited to highly variable mountain ecosystems. Evidence increasingly supports adaptive, resilience-based grazing management, where regulated and monitored grazing sustains grassland productivity, biodiversity, and long-term soil carbon stocks.

1.2 The persistence of pastoral grazing in Himachal Pradesh for over five decades, even under administratively rigid frameworks, strongly suggests that these grasslands operate within resilient regimes. Issuance of grazing permits without real-time adjustments is therefore scientifically untenable and administratively counter-productive. The Government of Himachal Pradesh intends to reform the grazing permit regime in the state by proposing the reforms mentioned in this Memorandum to improve the livelihoods of graziers and to strengthen the rural economy of the state. The Government of Himachal Pradesh, therefore, proposes a comprehensive reform of pastoral grazing governance grounded in scientific evidence, administrative feasibility, and long-term ecological sustainability.

2. SALIENT FEATURES OF THE POLICY:

2.1 The Forest Department will work with the Department of Animal Husbandry to develop a portal where each migratory grazier will register and enter details regarding the name and address of the grazier, the year when the permit was given (or declaration that the grazier does not hold permit), year from when the grazing is done by the grazier, the number of animals grazed, forests where grazing is allowed as per the permit or where grazing is done without permit, etc., within the next 6 months. The graziers who do not have permits may also register alongwith their details and further action on their status including issuance of new permits will be decided by local grazing advisory committee notified by Conservator of Forest following codal formalities. This will be a real-time, state and division-level database of pastoralists, livestock numbers, migratory routes, halting grounds, and pastures. This database can be easily linked with Aadhaar and Him Pariwar details of the grazier and the Bharat Pashudhan portal of the Government of India in order to verify the details of each grazier. The database will also be integrated with the Working Plans and Management Plans of the Forest Department.

2.2 Grant of new permit shall be based on following criteria:—

(i) Assessment of available pasture land for grazing;

(ii) Carrying capacity of forest area from which grazing permit has been applied.

(iii) Estimation of live stock comprising Buffaloes, mule, sheep, goat etc. (iv) Assessment of Wild Life species dependent on grazing.

(vi) Recommendations of Grazing Committee regarding grant of permits on rotational basis in the forest compartments so that regeneration of forest areas is ensured.

2.3 A local grazing advisory committee comprising representatives from migratory and local graziers, panchayats, and representatives from universities and departments such as Forest, Animal Husbandry, Agriculture, Wool Federation, etc., will be notified in each division by the Conservator, with the DFO as the nodal officer. In case of variation in the number of livestock or new allotment, this committee will recommend to the DFO the number of grazing animals to be allowed in forests based on resilience-, adaptive-, and seasonality-based metrics of availability. The concerned DFO can issue a permit after getting the requisite recommendation from the advisory committee. There should be a periodic assessment of permits once every 5 years. Permits may be renewed either in the native Forest Division or the grazing Division, removing jurisdictional ambiguity.

2.4 Issuance and renewal of permits only to active pastoralists dependent on grazing for livelihood; exclusion of absentee permit holders (unused permits) after following due field inspection and inquiry involving the Animal Husbandry Department and local self-government institutions. While estimating grazing availability, the requirements of prey/herbivores (wildlife) should also be kept in view. The system of Pohals, hired by the main permit holder, will be mainstreamed and recognized in the permit system and in the database portal to ensure safety and business-like operations of the grazing enterprise. Based on rationalization of permits, record of rights (wajib ul arj) in working plan and other government records will be updated.

2.5 Explicit protection of migratory routes, halting grounds, and watering points, including the prohibition of tree planting and infrastructure obstruction. In case of any diversion of these areas, forest officials will explore alternative pastures and grazing grounds for the migratory herders so that their livelihoods are not disturbed. All traditional migratory routes, halting grounds, and watering points shall be geo-tagged and protected as critical pastoral infrastructure. Animal Husbandry Department has already initiated a project for "Thematic Mapping of Migratory Routes of Sheep Breeders in H.P." Forest Department shall co-operate in implementation of this project. Plantations older than seven years will be opened for controlled grazing after field verification.

No. 341 MCD/Trade License/2026.—In exercise of the powers conferred under Section 125, 126, 127, 128 read with Section 202 and 214 of the Himachal Pradesh Municipal Act, 1994, I, Rakhi Kaushal, Sr. Executive Officer, Municipal Council Dalhousie, District Chamba, Himachal Pradesh hereby notify the following Trade License Bye-Laws : —

1. Short title, extent and commencement. —

(i) These Bye-Laws may be called the Himachal Pradesh Municipality, (Grant of License for Use of Premises and Storage of Articles in a Premises) Bye-Laws 2026.

(iii) These Bye-Laws shall apply to all shops/premises falling within the Municipal limits which may not be used without license for the purpose specified in Section 125, 126, 127, 128 read with Section 202 and 214 of the Himachal Pradesh Municipal Act, 1994 as per Annexure-I and Annexure-II for storage of any Article within the municipal limits.

2. Definitions. —In these Bye-Laws, unless the context otherwise requires : —

(a) "Act" means the Himachal Pradesh Municipal Act, 1994 (Act No. 12 of 1994) (b) "Authorized Officer" means Executive Officer or any other Officer specifically authorized by the Executive Officer.

(c) "Inspector" means Sanitary Inspector or any other Official of the Municipal Council duly authorized by the Executive Officer.

(d) "License" means a written permission granted by the Executive Officer or any other official /Officer duly authorized by the Executive Officer in favour of the person, owner & occupier for sale/storage of articles specified in Annexure-I & II of these Bye-Laws.

(e) "Licensing Officer" means Executive Officer or any other officer duly authorized by the Executive Officer to grant/renew License under the provisions of these Bye-Laws.

(f) "Premises" means any shop/store/place where the articles specified in Annexure- I & II are kept for sale/storage in the godown/premises.

(g) "Small Scale Business/Trade" means premises covering maximum area of 100 sq. mtr., "Medium Scale Business/Trade" means premises covering area of 100 sq. mtr. to 500 sq. mtr. and "Large Scale Business/Trade" means premises covering area of more than 500 sq. mtr.

(h) "The words and expression not Shopkeeper" means any person running and managing the affairs of the shop/premises/place including its owner/occupier.

(i) Defined under these Bye-Laws shall have the same meaning or sense as are defined in Himachal Pradesh Municipal Act, 1994.

3. Procedure for obtaining License. —

(a) shall automatically come to an end after comple Any person who wants to operate/run any business/trade as specified in Annexure-I and/or store any article as specified in Annexure-II within the areas of the Municipal Council shall apply for license on citizen seva portal online to Executive Officer of the concerned Municipal Council.

(b) Period of License— (1) The License shall be issued for a period maximum upto fifteen years at a time and the License shall automatically come to an end after completion of such period.

(i) The License shall be renewed automatically after expiry of the period of license on deposit of requisite/ prescribed license fee by the applicant. The license shall be renewed without any late fee and extra document within one month after expiry of license. The license shall be renewed with penalty of 50% of license fee within next one month and after that period the license shall not be renewed. In that case a fresh Trade license shall be required to be issued.

(ii) No document is required to be submitted for renewal of License.

5. Transfer of License. —

(i) The license issued under the Bye-Laws shall not be transferred in the name of any person except in case of the death of original licensee wherein it shall be made/transferred in the name of the legal heirs only for the validity period of license on production of supporting documents and shall be decided by Executive Officer keeping in view the circumstances of the case.

(ii) The licensee shall provide online information to the Executive Officer for winding up of his business under such license.

6. License Fee. —

(i) The license fee for grant of license shall be decided by the Executive Officer from time to time. However, the fee will be calculated on annual license fee rate multiplied by number of years the license is requested by the applicant. The fee shall be charged in the following manner :—

In the fairs, fee shall be charged on the following rates : —

(a) Small Shop Rs. 500/- P. Day (b) Medium Shop Rs. 1000/- P. Day (c) Large Shop Rs. 2000/- P. Day

Explanation.—A shop covering an area upto 6 square meters shall be deemed to be a small shop. A shop covering an area from 6 square meters to 15 square meters shall be deemed to be a medium shop. A shop covering an area more than 15 square meters shall be deemed to be a Large shop.

(ii) Fee structure for permission for Shooting of the Films/Documentaries in MC :—

7. Conditions for grant of license. —

(i) The License shall not be valid for any other purpose, except for the items/articles for which it is granted under these Bye Laws.

(ii) The permission shall, unless specified otherwise in the license, be valid in the entire MC limits, subject to such conditions as may be imposed by the Executive Officer.

(iii) The owner/occupier of the premises shall have to produce the license before the Inspector or the licensing officer at any point of time as may be ordered by them.

(iv) The Executive Officer shall have a right to impose or alter any of conditions in the license as may be deemed fit by him/her under the provisions of Section 214 of the Himachal Pradesh Municipal Act, 1994.

(v) The applicant shall submit a self-declaration regarding information submitted by him/her about the premises to be used for business/trade viz. type of business, area, approval of map and nature of property i.e. commercial and domestic etc. to be true to the best of his knowledge and belief.

(vi) The licensee shall maintain proper record of the articles kept for sale or storage in the premises as may be required by the Licensing Officer. Further the licensee shall comply with all the directions and instructions issued to him by the Executive Officer or the Licensing Officer from time to time.

(vii) The licensee will ensure timely payment of Municipal dues.

(viii) Time period for issue of License. —The license shall be issued as per the time lines notified/specified for this service under Public Service Guarantee Act, 2011.

8. Denial of license. —

(a) The license shall not be granted :

(i) to a person suffering from any loathsome infections or contagious diseases.

(ii) to a person convicted for unlawful sale or storage of any articles mentioned in Section 125, 126, 127, 128 read with Section 202 and 214 of the Himachal Pradesh Municipal Act, 1994.

(iii) to a person who has been found to have habitually committed the breach of these Bye-Laws or the terms of the license.

(iv) to a person not below the age of 18 years

(b) (i) Subject to Bye-Laws 9 (1), license to any person, who applies online to the Executive Officer or Licensing Officer in this behalf and tenders the prescribed fee shall be granted by that officer, unless for reasons to be recorded in writing by him.

(ii) The Licensee shall be liable to pay transfer charges @ 500/- per license at the time of effecting transfer of License.

(iii) The licensee shall abide by the terms and conditions of the license and the license shall be displayed at the convenient/conspicuous place/reception of the premises.

(iv) The Inspector or inspecting staff concerned shall have a right to enter and inspect the premises and the licensee shall provide necessary assistance to the inspecting staff at the time of inspection of licensed premises.

(v) The licensee shall not make any encroachment/overhanging projection on public streets and Municipal drains in any manner.

(i) In addition to the penalty as provided under Himachal Pradesh Municipal Act, 1994 any person in possession of the premises found violating any of the provisions of these Bye-Laws shall in the first instance be liable for suspension of license for a period of one week and for repetition of the same violation within two years be liable for a penalty of Rs.1000/- to Rs. 4000/- only.

(ii) If the information submitted by the applicant under self-declaration is found to be false, he/she shall be liable for the penalty of ten times of the license fee and his/ her license will be cancelled.

(iii) In case of repeated violation, the concerned person, owner or occupier, as the case may be shall be liable for cancellation/withdrawal of License which can only be restored on receiving written undertaking accompanied by surety from the person violating these Bye-Laws subject to the satisfaction of the Executive Officer.

And whereas, the draft amendment was published for information of the general public vide notification No. MC/MND/Bye-Laws/2026-3109, dated 30-03-2026, inviting objections and suggestions within a period of (thirty) days from the date of publication;

And whereas, no objection or suggestion has been received from any person within the stipulated period;

Now therefore, in exercise of the powers conferred under section 395 of the Himachal Pradesh Municipal Corporation Act, 1994, the Municipal Corporation Mandi hereby notifies the following amendment to Annexure-'A' of the Municipal Corporation, Mandi (Door to Door Garbage Collection & Disposal Bye-Laws, 2022 shall, which shall come into force from the date of its publication in the official e-Gazette. All other provisions of the Municipal Corporation Mandi (Door to Door Garbage Collection & Disposal) Bye-laws, 2022 shall remain unchanged and continue to be in force.

1. Short title and commencement:—These Bye-Laws may be called the Municipal Corporation Mandi (Door to Door Garbage Collection & Disposal) Amendment Bye–Laws, 2026.
