HIMACHAL PRADESH ELECTRICITY REGULATORY COMMISSION, SHIMLA

NOTIFICATION

Shimla, the 14th July, 2026

No. HPERC-H(1)-11/2015.—WHEREAS, the Himachal Pradesh Electricity Regulatory Commission (hereinafter referred to as "the Commission") notified the Himachal Pradesh Electricity Regulatory Commission (Rooftop Solar PV Grid Interactive System) Regulations, 2015, which were published in the Rajpatra, Himachal Pradesh, on 3rd August, 2015 and amended from time to time;

AND WHEREAS, the Government of India (GoI) has approved the 'PM Surya Ghar: Muft Bijli Yojana' Scheme on 29th February, 2024, so as to increase the share of solar Rooftop capacity and empower residential households to generate their own electricity and which is to be implemented by a National Programme Implementation Agency (NPIA) at the National level and by the State Implementation Agencies (SIAs) at the State level;

AND WHEREAS, under the aforementioned Scheme, the Himachal Pradesh State Electricity Board Ltd. is functioning as the State Implementation Agencies (SIA) for the purpose of implementation of the Scheme in the State of Himachal Pradesh;

AND WHEREAS, the Ministry of Power, Government of India vide letter No. 10/05/2022- UR&SI-II (E-263845) dated 27th August, 2025 has observed that to ensure widespread adoption and timely implementation of Roof Top solar, distribution utilities need to ease out procedural complexities and initiate consumer friendly measures. The Ministry of Power, Government of India has suggested to do away with the requirement of a separate Net Metering Agreement and adopt digital agreement which is a part of the online application form for PM Surya Ghar: Muft Bijli Yojana;

NOW, THEREFORE, in exercise of the powers conferred by sections 61, 66 ,86(1) (e) and 181 of the Electricity Act, 2003 (36 of 2003), read with section 21 of the General Clauses Act,1897 (10 of 1897), and all other powers enabling it in this behalf, the Commission proposes to make the following Regulations further to amend the Himachal Pradesh Electricity Regulatory Commission (Rooftop Solar PV Grid Interactive System) Regulations, 2015, and as required by sub-section (3) of section 181 of the said Act and rule 3 of the Electricity (Procedure for Previous Publication) Rules, 2005, publishes the Draft Amendment Regulations for the information of all the persons likely to be affected thereby; and notice is hereby given that the said Draft Amendment Regulations will be taken into consideration after the expiry of thirty (30) days from the date of publication of this Notification in the Rajpatra, Himachal Pradesh, together with objections or suggestions, if any, received within the stipulated period.

The text of the aforesaid Draft Amendment Regulations is also available on the website of the Commission i.e. http.//www.hperc.org.

The objections or suggestions in this behalf should be addressed to the Secretary, HP Electricity Regulatory Commission, Vidyut Aayog Bhawan, Block-37, SDA Complex, Shimla- 171 009 (H.P.).

DRAFT AMENDMENT REGULATIONS

1. Short title and commencement.—(1) These Regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Rooftop Solar PV Grid Interactive System) (Fourth Amendment) Regulations, 2026.

(2) These Regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Regulation 7.—In Regulation 7 of the Himachal Pradesh Electricity Regulatory Commission (Rooftop Solar PV Grid Interactive System) Regulations, 2015 (hereinafter referred to as the 'Principal Regulaitons'),—

(i) For sub-regulation (1), the following sub-regulation shall be substituted, namely.—

"(1) The eligible consumer may make the application, delivered by post or by hand or through any electronic mode such as online submission and e-mail etc., as per Form-1 or in any other format prescribed in online mode by the Central/State Government or its agencies for implementation of Rooftop solar photovoltaic systems under any Rooftop solar scheme(s) of the Central/ State Government to the authorized office of the Distribution Licensee to install and connect the Rooftop solar system to the distribution system of the Distribution Licensee. The Distribution Licensee shall make available Form-1 on its website and at its authorised offices:

Provided that the Distribution Licensee shall, as far as possible, process all such applications in online mode as a part of web based application processing system evolved, or to be evolved, by the Distribution Licensee for the Prosumers:

Provided further that even where the applications are received in physical form, the same shall be uploaded on the web based application system by the Distribution Licensee for online processing."5828 राजपत्र, हिमाचल प्रदेश, 15 जुलाई, 2026/24 आषाढ़, 1948 (ii) In sub-regulation (3), for the first proviso, the following proviso shall be substituted, namely.—

"Provided that the Distribution Licensee shall also accept a digital Solar Metering Connection Agreement which is part of the online application form and made available through online portal of the Central/State Government or its agencies for implementation of Rooftop solar photovoltaic systems under any scheme of the Central/ State Government."
