SRO - 153 . In exercise of the powers conferred by section 10 of the Salaries and Allowance of Members of the Jammu and Kashmir State Legislature Act , 1960 , the Governor is pleased to make the following [No. 9 - c 2 The J& K Govt . Gazette , 2nd June , 2014/ 12th Jyai . , 1936.

amendments in the Housing Loan ( to Members of the Jammu and Kashmir State Legislature ) Rules , 1988 , namely :-

1. In rule 2.-

i. for the word and figure " Rs . 2.50 lakhs " , the words and figure "Rs . 5.00 lakhs " shall be substituted ; and

ii . In proviso thereto , for the words and figure " Rs.5 , lakhs " wherever occurring , the words and figure " Rs . 10.00 lakhs " shall be substituted .

2. For rule 5 , the following rule shall be substituted , namely :-

" 5. The recovery of the loan alongwith interest shall be made in monthly instalments not exceeding sixty from the salary bills of the members . However , in case the amount of loan alongwith interest is not liquidated during the tenure of the member, the amount of instalments shall be fixed at such rate to restrict the number of instalments to sixty" .

Whereas , the aforesaid workmen raised dispute against the Management before the Conciliation Officer, Samba ; and

Whereas , all efforts were made during the conciliation proceedings to settle the dispute but both the parties were adamant on their stand and not willing to settle the dispute through negotiations ; and Whereas , the Conciliation Officer , Samba submitted his failure report recommending the case for its reference to the Labour Court for adjudication ; and

Whereas , the Government is of the opinion that an industrial dispute exists between the Management of M / s Reckitt Benckiser ( I ) Ltd. , Bari Brahamana , District Samba and the aforesaid workmen ; and Whereas , the Government considers it desirable to refer the dispute to the Labour Court for adjudication .

Now, therefore , in exercise of the powers conferred by clause ( c ) of sub- section ( 1 ) of Section 10 of the Industrial Disputes Act , 1947 ( XIV of 1947 ) , the Government hereby refers the said dispute to the Labour Court for adjudication on the following issues :-

Whereas , Vide SRO - 154 dated 25-4-2012 , extension of period of four months was granted to the said Arbitrator for making an award ; and Whereas , the Government has considered the matter and decided that further extension in time for making the award by the Arbitrator be granted.

Whereas , the said Arbitrator has requested for further extension in time enabling him to complete the proceedings and make the award ; and Whereas , the Government after examining the matter has decided that extension in the term of Arbitrator be granted .

Now, therefore , in exercise of powers conferred by sub - rule ( 1 ) of rule10 of the Jammu and Kashmir Requisitioning and Acquisition of Immovable Property Rules , 1969 , the Government hereby direct that the time for making the award shall and shall always be deemed to have been extended by a further period of four months .

[ No. 10 - е pleased to direct that the following amendment shall be made in the Jammu and Kashmir Civil Services Regulations Vol - 1 , namely

In Article 226 ( 1 ) ; after the second proviso , the following proviso shall be inserted , namely : -

" Provided further that a Government Servant in service on 01-06-2014 , or appointed on or after that date , shall retire on his attaining the age of 60 years " .

" In Article 37.-

( a ) in clause ( 3 ) , sub - clauses ( i ) , ( ii ) and ( iii ) shall with effect from 01-01-2014 be substituted by the following sub - clauses : - (i ) General Category candidates

1. In rule 9 , for the letters and figure ' Rs . 500 ' , the letters and figure ' Rs . 1000 ' shall , with effect from 1st of February, 2013 , be substituted ; and

2. Rule 10 -A shall be re - cast as under : -

" A Minister when travelling on duty outside India will be entitled to fly business / club class on International Flights but not on domestic flights and in addition to TA , the Minister shall be entitled to outfit allowance of Rs . 2500/ - provided that the same is not allowed more than once during a period of three years ."

2. How to fill up the Scanable Application Form : Before filling up of the ( OMR) Scanable Application Form , the candidate should carefully go through the " Instructions " and the Code List of various Departmental Examinations enclosed with the " Dummy Application Form " . The Application Form should be filled up very neatly, correctly and carefully after selecting the appropriate codes from the Code List against each item , wherever applicable .

3. Submission of Scanable Application Forms : The Application Forms complete in all respects have to be submitted in the Commission Office at Srinagar / Jammu in the " Special Envelope " supplied by the Commission for the purpose or mailed by registered post to the Controller of Examinations , J & K Public Service Commission , Reshamghar Colony , Bakshi Nagar , Jammu / Polo Ground , Srinagar before the last date notified for the purpose .

4. Examination Fee : The Scanable Application Form should be accompanied by a fee of Rs . 400/ - per paper to be paid in cash through the counters of J & K Bank opened in PSC Offices at Jammu/ Srinagar.

Note: Candidates should submit their application forms along with " Eligibility Certificate " recorded therein , by the Competent Authority viz . repective Commissioners .

5. Last date for receipt of Applications Forms : The Scanable Application Forms shall be received at the counters set up for the purpose in Commission Offices located at Polo Ground , Srinagar / Reshamghar Colony, Bakshi Nagar , Jammu on all working days (Monday to Friday ) from 10 A. M. to 3 P. M. up to 07-07-2014 which shall be the last date . Applications received through Speed Post/ Courier services of any type shall be treated as having been received " By Hand " at the Commission's counter. Incomplete/deficient Application Forms shall not be entertained and , ifreceived, through any means , shall be deemed to have been rejected ab intio.

Note : The candidates should , therefore , ensure that their Application Forms reach the Commission Office on or before the prescribed last date. In case the last date is declared a public holiday then the last date for receipt of Application Forms shall be the next working day.

6. Action Against Candidates Found Guilty of Misconduct : Candidates are warned that they should not furnish any particulars that are false or suppress any material information in filling up the Application Forms . Candidates are also warned that they should, in no case , correct or alter or otherwise tamper with any entry in a document or its attested/ certified copy submitted by them , nor should they submit a tampered / fabricated document . If there is any inaccuracy or any discrepancy between two or more such documents or their attested / certified copies . an explanation regarding discrepancy should be furnished .

ix . Misbehaving in any other manner , in the examination hall ; or

x . Harassing or doing bodily harm to the staff employed by the Commission for the conduct of their examination ; or

xi . attempting to commit or , as the case may be , abetting the Commission of all or any of the acts specified in the foregoing clauses may, in addition to rendering himself/ herself liable to criminal prosecution , be liable-

a . to be debarred by the Commission for appearing in the examination , and / or

b . to be debarred either permanently or for a specified period -

i . By the Commission from any examination or selection held by them ;

ii . By the State Government from any employment under them ; and

c. if he / she is already in service under Government , disciplinary action under the appropriate rules .
