12. Grant of Licenses :

A. Manufacture/ Bottling :

The existing policy of issuance of Licenses for Distilleries , Breweries and Bottling Plants in the State as laid down vide Government Order No. 99 - F of 2003 dated 07-04-2003 read with Government Order No. 156 - F of2003 dated 22-7-2003 shall continue .

Wholesale Trade :

Thepresent policy of issuing Licenses in Form JKEL - 1 , JKEL - 1A , JKEL - 1B , JKEL - 1W on need basis shall continue .

Retail:

i ) No JKEL - 2 Licenses will be issued till the final disposal of the case pending in the High Court of J & K titles Sandya Devi V/ S State and Ors . and other allied matter . However , Sub Vends shall be permitted in accordance with the provisions of the J & K Excise Act , Svt.1958 and the J& K Liquor Licence and Sale Rules , 1984.

ii ) The present policy for the grant of Licenses for retail sale of IMFL viz . Bar with Hotel ( JKEL - 3 ) , Bar with Banquet ( JKEL - 3 A) , Bar with Restaurant or Cinema Theatre or Dak Bungalow ( JKEL - 4 ) , ( JKEL -4A ) , ( JKEL -4B ) , ( JKEL - 4C ) and Club ( JKEL - 7 ) etc. shall continue .

13. Fixation of Maximum Retail Price :

The Maximum Retail Price ( MRP ) of all types of Liquor including JK Desi Whisky and Beer shall be fixed by the Excise Commissioner for the year 2014-15 .

14. All Liquors to be ENA based

IMFL manufactured locally or imported from outside the State (other than Foreign Liquor bottled in origin / bottled in India or Malt whisky) shall be ENA based only and use of rectified spirit as a base in , manufacture / sale of Liquor for consumption in civil market and CSD / PMF shall remain banned .

15.Restriction on import of Economy / Cheap brand :

There shall be a ban on import of Economy / Cheap brands into the State.

16. Affixation of Security Hologram on JK Desi Whisky & IMFL :

In order to safeguard against spurious , adulterated liquor as well as smuggled liquor , the manufacturers of JK Desi Whisky and IMFL as well as Importers ( JKEL - 1A , JKEL - 1B and JKEL - 1W ) of IMFL/ Wine etc. shall continue to affix security Hologram approved by the Excise Department in the manner prescribed.

17. Penalties in violation of Hologram procedure :

The penalities for violation if any, made by the Licensee in use of Hologram will be the same as applicable in the J & K Excise Act , Smvt, 1958 and the rules framed thereunder .

SRO- 203.- Whereas , Shri ( 1 ) Javid Ahmad Quarishi , (2 ) Mohd Ashraf Magray, ( 3 ) King Pal Singh , (4 ) Ms. Surjeet Kour, and (5 ) Mohammad Yousuf Ahangar have worked in the Indian Telephone Industries ( ITI ) , Hyderpora , Peer Bagh , Srinagar since 1998 on casual basis ; and

Whereas , the aforesaid workmen were regularized by the management in Category " B " meant for non Graduate , Matric Plus , after serving for 14 to 15 years in the Indian Telephone Industries ; and [No. 14-a 2 The J&K Govt . Gazette , 3rd July , 2014/ 12th Asad. , 1936.

Whereas , one Shri Rajinder Kumar Pandita a similarly circumstanced workman was regularized in category " C " by the management , instead of Category " B " ; and

Whereas , aggrieved by the discrimination in promotion/ regularization the aforesaid workmen raised a dispute and approached the Conciliation Officer ; and

Whereas , the Conciliation Officer has submitted his failure report recommending adjudication of the dispute by the Labour Court ; and Whereas , the Government is of the opinion that an industrial dispute exists between the management of ITI , Hyderpora , Peer Bagh and the said workmen ; and

Whereas , the Government considers it desirable to refer the dispute to the Labour Court/Industrial Tribunal for its adjudication .

Now, therefore , in exercise of the powers conferred by clause (c) of sub- section 1 of section 10 of the Industrial Disputes Act , 1947 ( XIV of 1947 ) , and in supersession of notification SRO - 40 dated 14th February, 2008 , the Government hereby refer the said dispute to the Labour Court/ Industrial Tribunal for adjudication in respect of the following issues :-

1. Whether , Sh . Rajinder Kumar Pandita, a colleague of the applicants/ aggrieved workmen , does qualify to be placed under Category " C " ?

2. If so , to what extend relief can be granted to the aggrieved workmen /applicants ?

SRO - 208.- In exercise of the powers conferred by section 56 of the Jammu and Kashmir Value Added Tax Act, 2005 , and in supersession of Notification SRO - 161 dated 13th April , 2010 , the Government hereby 2 The J& K Govt. Gazette , 3rd July, 2014/ 12th Asad. , 1936. [No. 14 - f

direct that there shall be following composition of tax in respect of brick kiln owners in lieu of tax payable under section 13 of the Act :-

1. Dealers registered under the J& K VAT Act , 2005 (Non- Importer)

2. Dealers registered under the J& K VAT Act , 2005 and CST Act 1956 (Importer )

a . Dealers importing coal up to value of Rs . 40 lakh

b . Dealers importing coal upto the value of Rs . 60 lakh

Rs . 1 lac per annum to be deposited in four equal quarterly installments .

Rs . 1.60 lac per annum to be deposited in four equal quarterly installments .

Rs . 2.00 lac per annum to be deposited in four equal quarterly installments .

The composition tax scheme is subject to following conditions , namely :-

i. That the composition scheme shall not be applicable to the dealers who import coal above the value of Rs . 60.00 lac during the financial years and be liable to tax as per the VAT schedule ;

ii . That the composition amount shall be payable in four quarterly installments and shall be paid within one month from the expiry of each quarter ;

iii . That the dealer shall not collect any sum by way of tax on the sale ofgoods;

iv . That the dealer shall not issue a tax invoice in VAT- 50 while making sale of goods in the State to another VAT dealer for resale or use in manufacture or for processing of goods for sale ;

v. That no input tax credit shall be available to the dealer purchasing goods from the dealer availing this composition scheme ;

vi . That for failure to pay the composite tax in time, the dealer shall besides being liable to penalty under the provisions of the Act also forfeit his claim of benefit of the composite tax scheme and be liable to tax under section 13 of the Act for the year in which such default/offence is committed ;

vii . That in case a brick kiln is intended to be closed for the whole year , the dealer who is liable to pay the composite tax shall inform the Assessing Authority concerned in writing within 15 days before the closure ;

viii . That in case of failure to furnish information about closure of kiln in the manner prescribed in stipulation 7 above , it shall be presumed that the kiln has been functioning normally and the dealer shall be liable to pay composite tax as usual ;

ix. That the Government may at any time withdrawn facility of payment of composite tax in lieu of tax .

This notification shall come into force with immediate effect .

THE TELECOM REGULATORY AUTHORITY OF INDIA ( AMENDMENT) ORDINANCE , 2014

[28th May, 2014 ] Promulgated by the President in the Sixty - fifth Year of the Republic of India .

AnOrdinance further to amend the Telecom Regulatory Authority of India Act , 1997 .

Whereas , Parliament is not in session and the President is satisfied that the circumstances exit which render it necessary for him to take immediate action .

Now, therefore, in exercise of the powers conferred by clause ( 1 ) of Article 123 of the Constitution , the President is pleased to promulgate the following Ordinance :-

1. Short title and commencement . ( 1 ) This Ordinance may be called the Telecom Regulatory Authority of India (Amendment ) Ordinance , 2014 .

(2) It shall come into force at once .

2. Amendment ofsection 5.-In the Telecom Regulatory Authority of India Act , 1997 , in section 5 ,-

(i ) for sub - section (8 ) , the following sub - section shall be substituted , namely :-

" (8 ) The Chairperson and the whole- time members shall not , for a period of two years from the date on which they cease to hold office as such , except with the previous approval of the Central Government , accept

(a) any employment either under the Central Government or under any State Government ; or

(b) any appointment in any company in the business oftelecommunication service . " ;

(ii ) the Explanation at the end shall be omitted .

In the Andhra Pradesh Reorganisation Act , 2014 , in section 3 , for the words , brackets , letters and figures " Khammam ( but excluding the revenue villages in the Mandals specified in G. O. Ms. No. 111 Irrigation and CAD ( LA IV R & R- I ) Department , dated the 27th June , 2005 and the revenue villages of Bhurgampudu , Seetharamanagaram and Kondreka in Bhurgumpadu Mandal ) " , the words and brackets " Khammam ( but excluding the Mandals ofKukunoor, Velairpadu and Bhurgampudu but not including its revenue villages of Pinapaka , Morampalli Banzar , Bhurgampad , Nagineniprolu , Krishansagar , Tekula , Sarapaka , Iravendi , Mothepattinagar , Uppusaka , Sompalli and Nakripeta under the Palvancha Revenue Division , and the Mandals of Chintoor , Kunavaram , Vararmachandrapuram and Bhadrachalam but not including the revenue village of Bhadrachalam under the Bhadrachalam of Revenue Division) " shall be sustained .

Award

1. This tribunal has received a reference by virtue of a notification dated 9th December , 2010 wherein SRO - 454 was issued by the Government of J & K and referred the dispute to this tribunal for adjudication .

2. Both the parties to the petition have submitted that they are ready for compromise . Time was granted for negotiation . They have submitted a memorandum of agreement wherein the dispute between the parties have been settled at Rs . one lac only towards the satisfaction of all the claims arising out of the employment of the petitioner with the respondent .

Statements of parties were recorded besides obtaining their signature on the margin of the order sheet .

3. After this settlement of workman / petitioner has left with no of his claims/dues towards the management .

4. Consequence to the compromise arrived between the parties , respondent has paid a Cheque No. 042394 dated 11-06-2014 to the petitioner who has received the same in the court and has also executed an receipt towards the full and final settlement of all dues which include earned wages , encashment of leave , notice pay , retrenchment , compensation , bonus , gratuity and all other dues which could accrue during the employment with the management of M / s Kamakhya Oil Company .

5. Memorandum of settlement sign by the parties has been filed by the parties and shall form the part of the file .

6. After this settlement petitioner has left with no cause of action against the management .

7. Since the settlement amount has been received by the workman and his claim stands disposed off accordingly.

8. In view of the settlement executed between the parties , this court hereby passes this award in terms of the memorandum settlement and holds that no other relief is required to be granted to the petitioner .

THE JAMMU AND KASHMIR WATER RESOURCES ( REGULATION AND MANAGEMENT ) ( AMENDMENT ) ORDINANCE , 2014 .

[31st July, 2014. ] India . Promulgated by the Governor in the Sixty - fifth year of the Republic of [No. 18-1 2 The J & K Govt . Gazette , 31st July , 2014/ 9th Srav . , 1936 .

AnOrdinance to amend the Jammu and Kashmir Water Resources (Regulation and Management ) Act , 2010 .

Whereas , the State Legislature is not in session and the Governor is contented that the circumstances do exist which render it necessary for him to take immediate action .

Now, therefore , in exercise of the powers conferred under Section 91 of the Constitution of the Jammu and Kashmir, the Governor is pleased to promulgate the following Ordinance , namely :----

1. Short title and commencement.( 1 ) This Ordinance may be called , "The Jammu and Kashmir Water Resources ( Regulation and Management ) (Amendment), Ordinance , 2014 " .

(2) It shall come into force with immediate effect .

2. Amendment in section 185 -A, Act No. XXI of 2010. In the Jammu and Kashmir Water Resources ( Regulation and Management ) Act , 2010 , in section 185 - A , for sub- section ( 2 ) , the following shall be substituted , namely : --

" (2) The fund , so created , shall be operated upon by the Administrative Secretary, Finance Department , for the purpose of being utilized for establishment of Hydel Projects , Hydroelectric Projects , Multipurpose Hydroelectric Projects , buying back Hydroelectric Power Projects already established in the State , capital investment in electric transmission and distribution network within the territory of the State and the purchase of power by the State Government or its entities , with the prior approval of the Government . "

Administrative Department vide letter No. Rev./LAK/03/2014 dated 10-03-2014 has conveyed the approval of Hon'ble Minister of State (Independent Charge ) , Revenue for the issuance of corrigendum to the notification issued by this office under sections 6 & 7 of the Land Acquisition Act vide endorsement No. FC - LS / LA - 2584/ 07 dated 10-12-2007 for the land measuring 126 Kanals 07 Marlas and 06 % Sarsai situated at Village Bumthan , Tehsil And District Anantnag for 4 - Laning of National Highway.

Now, the land measuring 120 Kanals 18 Marlas and ½ Sarsai detailed in the enclosed Arninexture - A is notified under sections 6 & 7 of the Act situated in Village Bumthan instead of 126 Kanals 07 Marlas and 06% Sarsai .

However , the Collector concerned shall be responsible for proper title verification of all types of land involved in the case , in respect of all the interested parties / land owners / rightful claimants in accordance with relevant law/ rules in force .
