Subject : Implementation of the provisions of the Right to Information Act, 2009.
Circular No. 07 - GAD of 2015 Dated 10-02-2015 .
Instructions have time and again been issued , impressing upon all the concerned to ensure voluntary disclosure of information in terms of section 4 ( 1 ) ( b ) of the Right to Information Act, 2009. The issue has also been highlighted on numerous occasions during the CoS meetings held under the Chairmanship of the Chief Secretary. However , it has 446 The J& K Govt . been observed that most of the departments are still deficient with regard to hosting the requisite information on their official websites and in some cases , the official websites are not being updated on regular basis . Besides , some departments continue to be without the official websites thereby defeating the mandate of the Act for ensuring transparency and accountability in the system .
The information , if available on the official websites , would also help in reducing the need for providing the information to the information seekers , who can easily have access to the information hosted on the website .
The issue also came up for discussion , during an interaction of the Commissioner/ Secretary to the Government , General Administration Department , with the State Chief Information Commissioner, J & K , and a statement showing ( forming Annexure to this Circular ) the status of different departments regarding creation of websites , disclosure under section 4( 1) (b ) of the Right to Information Act and appointment of Public Information Officer/First Appellate Authority, was shared by the State Chief Information Commissioner, J & K , with him , indicating the deficiencies in respect of different departments .
Besides the above , it was also indicated that inspite of repeated instructions being issued by the General Administration Department , some officers/ officials have failed to indicate their names and designations while exchanging official communications .
Accordingly, the instructions issued on the subject(s ) , are reiterated and it is impressed upon all the concerned including the Administrative Secretaries , Divisional Commissioners , Heads of Departments and Deputy Commissioners to ensure that-
1. all the departments viz . administrative as well as line departments , disclose information in terms of section 4( 1 ) (b ) of the Right to Information Act, 2009, and their official websites are created/ made functional immediately. They shall also ensure that these websites shall be updated on daily basis .

2. the deficiencies reflected in the statement furnished by the State Information Commission , J & K , in respect of launching ofwebsite, disclosure of information under section 4 ( 1 ) ( b ) of the Right to information Act , 2009 and appointment of Public Information Officers/ First Appellate Authorities , are made good immediately, under an intimation to the General Administration Department .
3. all the officers/ officials shall indicate their names and designation below their signature while initiating or endorsing any note/proposal for consideration of the Competent Authorities and on the communications exchanged with different departments . The other details like telephone numbers , e - mail addresses should also be mentioned on such communications , without fail .

Whereas , after the issuance of notification under section 4 ( 1 ) by the Collector, Land Acquisition , Assistant Commissioner ( Revenue ) . Kathua , land owners / interested persons were informed to file objections , if any, within 15 days from the issuance of the notification under section 4 ( 1 ) , but no objection has been received from them within the stipulated period:
Whereas , this office is satisfied after considering the report and recommendation of the Collector Land Acquisition . Assistant Commissioner ( Revenue ) . Kathua vide his No. DCK / LA / ACR/ 2014-15 / 744 dated 08-10-2014 , land is required for public purpose viz . for construction of road alignment of Gaiterwan to Logate via Janglote at Village Janglote. Now, therefore , it is declared under section 6 of the said Act, that the aforementioned land is needed for public purpose namely for construction of road alignment of Gaiterwan to Logate via Janglote at Village Janglote. Tehsil and District Kathua , land measuring 00 Kanal 10 Marlas .
Further . the Collector, Land Acquisition , Assistant Commissioner (Revenue ) , Kathua is directed under section 7 of the said Act to take order for acquisition of the land of which specification is given above .

(A) Any Vehicle that enters are to stay in the municipal limit of Thannamandi with passenger /goods for Jammu , Rajouri , Thannamandi , Poonch , Surankote , Noweshra etc. shail be charged @ 20/- as Lorry Adda Fee/Tax .
(B) All those Buses playing enroute to and fro Jammu , Rajouri , Thannamandi , Shahdra Sharief, Poonch etc. shall be charged @Rs . 25/- as Lorry Adda Tax.
(C) Thannamandi Bus Stand towards Jammu Poonch , Shopian , Rajouri etc. @ 30/- per day as Lorry Adda Tax /Fee .

(a) The appointee shall give an undertaking in the shape of an affidavit to the effect that in case adverse report about his /her character and antecedents is received from the Additional Director General ofPolice , C.I.D, J& K to whom reference shall be made by the concerned office, his /her appointment shall be itself stand cancelled ub initio and he/she shall have no claim of his /her appointment :
(b) The verification of Qualification Certificates / Reserved Category Certificate (wherever applicable from the concerned issuing authority) , the appointinent shall be cancelled and treated as such ab inito, if any fake/ forged documents were proved at any time during service of the candidate.
The salary of the appointee shall not be drawn and disbursed to him /her unless a satisfactory report in respect of ( a ) and ( b ) above is received.
The appointee shall be on probation initially for a period of two years .

SRO -24.- In exercise of powers conferred by section 85 of the Jammu and Kashmir Value Added Tax Act , 2005 , the Government hereby direct that the following amendment shall be made in the Jammu and Kashmir Value Added Tax Rules , 2005 :--
For the note appended to sub - rule 2AA of rule 28 , the following note shall be substituted namely :--
"Note :-
(i) The assessing authority shall not ask for copies of FIR from the concerned dealer .

Thisnotification shall come into force with immediate effect .
