THE JAMMU AND KASHMIR CURBING THE MENACE OF STRAY DOGS BILL , 2015 .
[L. A. Private Members ' Bill No. 5 of 2015. ]
A Bill to regulate and control the dangerous , menacing or breed of stray dogs in the State .
Be it enacted by the State Legislature in the 66th Year of the Republic of India as follows :-
1. Short title and commencement. ( 1 ) This Act may be called the Jammu and Kashmir Curbing the Menace of Stray Dogs Act, 2015 .
(2) It shall come into force from the date of its publication in the Government Gazette .
2. Definitions ,-
i. " Act " means the Jammu and Kashmir Curbing the Menace of Stray Dogs Act, 2015 ;
ii . "Authority " means any authority as designated by the State Government ;
iii. " Stray Dogs " means the dogs which are not under the control of anybody and are wandering from place to place ;
iv. "Government " means the Government of the State of Jammu and Kashmir .
3. Curbing the population of stray dogs. The Government should make every effort to curb and check the population of stray dogs without any failure and should make use of scientific technology to control such menace .
4. The Authorities of Municipal Corporation and the Municipal Committee besides the members of Panchayati Raj Institutions should The J& K Govt . Gazette , 1st June , 2015/ 11th Jyai . , 1937. 3

be allowed to assign the job of restricting the population of most dangerous stray dogs to such persons as prescribed under rules :
Provided that in extreme cases killing of dogs may also be allowed by the Government, after seeking permission from the Tehsildar concerned .
5. Compensation to the victims ' of dogs . The Government shall pay compensation-
i. to the tune of Rupees ten lacs to the next of kin of the deceased , if any , person is killed by a stray dog ;
ii . to the tune of Rupees five lacs or rupees one lac , as the case may be, if a person is disabled/diseased as to be beyond recovery or is partially disabled by an injury caused by a stray dog.
6. Power to make rules . The Government may by notification in the Government Gazette , make rules for carrying out the purpose of the Act .

STATEMENT OF OBJECTS AND REASONS
It is evident from the last several years that the population of stray dogs have increased manifold resulting in causing many deaths and injuries to a number of persons particularly little kids . People in general and children in particular feel insecure to venture out their homes for day to day work and schools . If this population of the dogs is not checked at this point of time it will prove disastrous for the society as such strict law on the subject is inevitable .

A Bill to amend the Jammu and Kashmir Forest Act, Svt . 1987 (1930 A. D.) .
Be it enacted by the Jammu and Kashmir State Legislature in the 66th Year of the Republic of India as follows : -
1. Short title and commencement . ( 1 ) This Act may be called the Jammu and Kashmir Forest ( Amendment) Act, 2015 .
(2) It shall come into force from the date of its publication in the Government Gazette .
2. Amendment of section 26.In sub- section (2) of section 26 of the Forest Act, Svt . 1987, the words "Divisional Forest Officer " be substituted by words " Judicial Magistrate of the 1st Class " .

STATEMENT OF OBJECTS AND REASONS
While dealing with the confiscation proceedings the Divisional Forest Officer is an authorized officer in terms of section 26 (2) . He is not a law knowing person and therefore is not acquainted with the legal niceties of a case . While terminating any confiscation proceeding though belatedly he assumes the position of a Judge in his own cause and the justice gets derailed. The proceedings are not conducted in judicious manner and the cases get linger on thus prolonging the justice delivery in such cases , which dents the legal principle that justice delayed is justice denied . Therefore , it becomes imperative to vest the powers of being authorized officer in the hands of Judge for the purpose so that the cases are decided as per the provisions of law and expeditiously .
Hence the proposed amendment .

An Ordinance to amend the Jammu and Kashmir Legal Services
Authorities Act, 1997 .
Whereas , the State Legislature is not in session and the Governor is satisfied that circumstances exist which render it necessary for him to take immediate action .
Now, therefore , in exercise of the powers conferred by section 91 of the Constitution of Jammu and Kashmir , the Governor is pleased to promulgate the following Ordinance :-
1. Short title and commencement. ( 1 ) This Ordinance may be called the Jammu and Kashmir Legal Services Authorities
(Amendment ) Ordinance , 2015.
(2) It shall come into force at once.
2. Amendment of section 3 , Act No. XXXIII of 1997.- In section 3 of the Jammu and Kashmir Legal Services Authorities Act, 1997 ( hereinafter referred to as ' the principal Act ' ) , sub - section ( 3 ) shall be substituted by the following , namely :-
"(3 ) The Government may, in consultation with Chief Justice of the High Court , appoint a person belonging to the Higher Judicial Service , not lower in rank than that of a District Judge , as the Member- Secretary of the State Legal Services Authority, to exercise such powers and perform such duties under the Executive Chairman of the State Authority as may be prescribed by the Government or as may be assigned to him by the Executive Chairman of the State Authority. "

Notification SRO - 42 of 2014 dated 28th February, 2014 , the following amendments shall be made :-
"(I) In para 2nd, for the words and figures " 31st March , 2015 " shall be substituted;
(II ) In item 13 , for the words " shall not be entitled to any tax remission for the quarter in which such offence is committed provided that such default/offence is not repeated during the year" , the words " shall be entitled to tax remission for the quarter in which such offence/default is committed subject to the payment of such tax, interest and /or penalty as the case may be provided that the industrial unit shall not be entitled to any tax remission for the quarter in which the offence /default is repeated" shall be substituted . "
This notification shall come into force w. e . f. 01-04-2015 .

SRO - 105 . In exercise of powers conferred by section 4 of the Jammu and Kashmir General Sales Tax Act, 1962 , the Government hereby direct that in Schedule " B " to Notification SRO - 117 of 2007 dated 30-03-2007 , the following amendments shall be made , namely :-
"(I) in the heading , for the words and figures "Goods Chargeable to Tax at the rate of 10 % " , the words and figures " Goods Chargeable to Tax at the rate of 12 % " shall be substituted . " 2 The J&K Govt . Gazette , 31st March, 2015/ 10th Chai . , 1937. [No. 52-k
(II) for the entries 5 , 7 , 19, 21 and 26 , the following entries shall be substituted , namely : -

7. Services provided by advertising agencies other than the Newspapers .
19. Services provided by the Chartered Accountants . Cost and Works Accountants only in the shape of accounting and auditing services .
21. Security and placement services including manpower recruitment and/or supply agency services .
26. Services provided by consultants , including survey, feasibility, exploration and impact assessment including technical testing/ analysis services other than those already included in this schedule . "
(III) After entry 5 , the following entry shall be added , namely : -
"6. Services provided by nursing homes " . "
This notification shall come into force w. e . f. 01-04-2015 .

SRO - 107.- In exercise of the powers conferred by sub - section (2) of section 3 of the Jammu and Kashmir Entry Tax on Goods Act , 2000 (Act No. IV of 2000) , and in supersession of Notification SRO - 22 dated 16th January, 2015 , the Government hereby exempt from the payment ofentry tax leviable under the said Act, on furniture/ office equipment/kitchen equipment/ other goods imported into the State by Hotelier(s ) as replacement The J&K Govt . 2 and refurbishment of furniture/ office equipment/kitchen equipment/other goods destroyed during unprecedented floods of September, 2014 :
Provided that such exemption shall be available only in respect of Hotelier ( s ) who apply to Director, Tourism of the concerned divisions with the list of goods and quantity damaged during unprecedented floods in September, 2014 and the Director, Tourism, aftersatisfying himself by verifying the insurance claims and other relevant documents in support of claims made by the applicants , within seven days from the receipt of application from Hotelier (s ) , shall furnish his recommendation to Commissioner, Commercial Taxes , J & K, who in turn shall dispose off the issue within three days on merit .
This exemption shall be in force till 30th June, 2015.
