The Government further in exercise of the powers confirmed by sub - section (2 ) of section 10 of the said code appoint the aforesaid Executive Magistrate as Additional District Magistrate within his territorial Jurisdiction ofDistrict Kishtwar and shall have all the powers of District Magistrate under the said code .

SRO - 175.-Whereas , the Government vide Notification SRO - 325 dated 19-10-2011 , appointed Principal District and Sessions Judge , Baramulla an Ex - offico Arbitrator to make an award in respect of land measuring 04 Kanals and 12 Marlas situated in village Dobiwan , Tehsil Tangmarg , District Baramulla ; and 2 The J& K Govt . Gazette , 12th June , 2015 /22nd Jyai . , 1937. [No. 11 - b
Whereas , vide Notification SRO - 134 dated 09-04-2012 , the Government extended the time for making the award by the Arbitrator by a further period of four months ; and
Whereas , vide Notification SRO - 57 dated 07-03-2014 , the Government extended time for making the award by the Arbitrator by further period of six months ; and
Whereas , vide Notification SRO - 426 dated 21-10-2014 , the Government extended time for making the award by the Arbitrator by further period of six months ; and
Whereas , the said Arbitrator has requested for further extension in time , enabling him to complete the proceedings and make the award ; and Whereas , the Government has considered the matter and decided that further extension in time for making the award by the Arbitrator be granted.
Now, therefore , in exercise of powers conferred by sub - rule ( 1 ) of rule 10 of the Jammu and Kashmir Requisitioning and Acquisition for Immovable Property Rules , 1969 , the Government hereby direct that the time for making the award shall and shall always be deemed to have been extended by a further period of six months .

Jammu and Kashmir , is pleased to make the following amendments to the Jammu and Kashmir Higher Judicial Service Rules , 2009 , namely :
In rule 8 ,-
1. in clause ( i ) —
(a) in sub - clause ( a) , for the figure " 90 " the figure " 80 " shall be substituted ; and
(b) in sub - clause ( b) , for the figure " 20 " the figure " 40 " shall be substituted ;
2. for clause ( iii ) , the following clause shall be substituted , namely:-
" (iii) the candidate has to obtain 60 % marks out of 40 marks earmarked for viva - voce provided that in case of Scheduled Caste and Scheduled Tribe , the candidate has to obtain 50 % marks out of 40 marks reserved for viva - voce . " ; and
3. after clause ( iii ) , the following clause shall be added , namely:-
" ( iv) after the candidate makes the grade in written examination and viva - voce , selection shall be made on the cumulative grade value obtained in the written examination and viva - voce ."

"Government Instruction No. 2 ,-
A retired ex - serviceman who might have been drawing two pensions one from the Central Government (Defence Service) and the other from the State Government for any pensionable service rendered under the latter , the widow of such a pensioner in the event of death of her spouse shall with effect from 01-06-2015 be allowed two family pensions subject to the fulfillment of other prescribed conditions " .

Whereas , the aforesaid workman raised dispute against the Management of M/ s . Fortune Pharmaceutical India Pvt . Ltd. , E. P. I. P. , 2 The J & K Govt . Gazette , 24th June , 2015/3rd Asad . , 1937. [No. 12- k
Kartholi , Bari Brahmana , District Samba before the Conciliation Officer (Assistant Labour Commissioner ) , Samba ; and
Whereas , all efforts were made by Conciliation Officer during the conciliation proceedings to settle the dispute but both the parties were adamant on their stand and not willing to settle the dispute through negotiation ; and
Whereas , the Conciliation Officer ( Assistant Labour Commissioner) , Samba submitted his failure report recommending the case for its reference to the Labour Court for adjudication ; and
Whereas , the Government is of the opinion that an industrial dispute exists between the Management of M/ s . Fortune Pharmaceutical India Pvt . Ltd. , E. P. I. P. , Kartholi , Bari Brahmana, District Samba and its workman namely Rajni Devi D / o Shoba Ram R/ o Ward No. 6, Ambadker Mohalla , Bari Brahmana ; and
Whereas , the Government considers it desirable to refer the said dispute to the Labour Court for adjudication .
Now, therefore , in exercise of the powers conferred by clause ( c) of sub - section ( 1 ) of section 10 of the Industrial Disputes Act, 1947 (XIV of 1947) , the Government hereby refers the said dispute to the Labour Court foradjudication on the following issues : -
1. Whether the termination of services of Rajni Devi by the Management of M/ s . Fortune Pharmaceutical India Pvt . Ltd. , E. P. I. P, Kartholi , Bari Brahmana, District Samba is legally justified ?

No. 576/3/ 2015/ SDR .-Whereas , under Rules 22 , 30 and 49B read with Rule 70 of the Conduct of Elections Rules , 1961 , the ballot paper to be displayed on the balloting unit of the EVM, ordinary ballot papers , and postal ballot papers shall contain such particulars as the Election Commission may specify ; and 2 The J & K Govt . Gazette , 21st May, 2015/ 31st Vai . , 1937. [No. 8-1
1. Whereas , in terms of above - mentioned rules , the Commission has specified the particulars to be printed on the ballot paper to be displayed on the balloting unit and the postal ballot paper, and on ballot papers for elections from Council Constituencies and at elections by Assembly Members ; and
2. Whereas , the Commission has noted that there are many cases where candidates with same or similar names contest from the same constituency, and although appropriate suffixes are added to the names of candidates in the event of two or more candidates having same name , the Commission considers that additional measures are required for removing confusion in the minds of electors at the time of voting , and further, the Commission considers that photographs of candidates on ballot paper will facilitate the electors in casting their votes and also the candidates in their campaign.
3. Now, therefore , after having considered all aspects of the matter , the Commission, in partial modification of its existing directions under Rule 22, Rule 30 and Rule 49B read with Rule 70 of the Conduct of Elections Rules , 1961 , issued from time to time , hereby specifies that for all elections to be held from 1st May, 2015 onwards , the postal ballot papers , the ordinary ballot papers and the ballot papers to be displayed on the balloting unit of EVM shall , in addition to the particulars as per the existing directions , also contain the photograph of the candidates printed thereon. The photograph of the candidates shall be printed in the panel for the name of the candidates and shall appear to the right side of the name in between the name and symbol of the candidate or the column for marking vote/preference , as the case may be . The specification for the photograph shall be as follows :-
( a) The candidates are required to submit their recent photograph (takenduring the preceding period of 3 months before the date of notification)-
( ii) The photograph should be of stamp size 2 cm.X2.5 cm . (2 cm. in breadth and 2.5 cm . in height ) in white/ off white No. 8-1 ] The J & K Govt . Gazette , 21st May, 2015/ 31st Vai . , 1937. 3
background , with full face view directly facing the camera , neutral facial expression with eyes open . The photo may be in colour or black and white as may be convenient for the candidate .
(iii) Photograph should be in normal clothing . Photograph in uniform is not permitted . Caps /hats should be avoided . Dark glasses also are to be avoided .
4. The above direction shall apply in relation to all elections to the House of the People , Council of States , Legislative Assembly and Legislative Council to be held hereafter.

In exercise of the powers conferred by sub - section ( 1) of section 25 read with section 2(b) ( iii ) of the Right to Information Act , 2009 , the Governor of Jammu and Kashmir ( Competent Authority ) , hereby makes the following
Rules : -
1. Short title and commencement.- (i ) These rules shall be called the Jammu and Kashmir Governor's Secretariat (Right to Information) Rules , 2015 .

( ii ) They shall come into force from the date of publication in the Official Gazette .
2. Definitions . In these rules , unless the context otherwise requires ,-
(i) ' Act ' means the Right to Information Act , 2009 (No. VIII of2009) ;
(ii ) ' Appellate Authority ' means an officer designated , as such , by the Competent Authority ;
(iii) ' Authorized Person ' means Public Information Officer and Assistant Public Information Officer designated , as such , by the Competent Authority ;
(iv) ' Competent Authority ' means the Governor of Jammu and Kashmir ;
(v) ' Form' means the Form appended to these rules ;
(vi ) 'Governor Secretariat ' means Secretariat of the Competent Authority ;
(vii) ' Section ' means a section of the Act ;
(viii) Words and expression used but not defined in these rules shall have the same meaning as assigned to them in the Act .
3. Application for seeking information. (i ) Any person seeking information under the Act shall file an application during working hours of the Governor's Secretariat to the Authorized Person in Form " A " and deposit application fee as per Rule 6 with the Authorized Person .
(ii) The Authorized Person shall duly acknowledge the application in Form "B " :
Provided that a person who makes a request through electronic form shall ensure that the requisite fee is deposited in cash with the Authorized 3

Person within 7 days of his sending the request through the electronic form , failing which his application shall be treated as dismissed .
Explanation :
-For each information sought , separate application shall be made . However , where more than one information sought is consequential or related to one another, the applicant will be permitted to seek the information through one application only .
4. Disposal of application by the Authorized Person . ( i) If the requested information does not fall within the jurisdiction of the Authorized Person , he / she shall transfer the application or such part of it , as is beyond his jurisdiction , to that other authority along with fees , as soon as practicable but not later than five days from the date of receipt of application , and communicate the same to the applicant in Form " C" .
( ii) If the requested information is within the Authorized Person's jurisdiction but falls in one or more of the categories listed/ mentioned in the sections 8 and 9 of the Act , the Authorized Person , on being satisfied , will issue the rejection order in Form "D" .
( iii) If the requested information falls within the Authorized Person's jurisdiction , but does not fall in one or more of the categories listed in sections 8 and 9 of the Act , the Authorized Person , on being so satisfied , shall supply the information to the applicant in Form "E " , falling within his /her jurisdiction . In case the information sought is partly outside the jurisdiction of the Authorized Person or partly falls in the categories listed in sections 8 and 9 of the Act , the Authorized Person shall supply only such information as is permissible under the Act and is within his /her jurisdiction and reject the remaining part giving reasons therefore .
(iv) The information shall be supplied as soon as practicable and in any case not later than 30 days from the date of receipt of the application :
Provided that if the information sought concerns the life or liberty of a person , the same shall be provided within 48 hours of the receipt of the request .

However, the date of the application shall be deemed to be the date of deposit of the entire fee or the balance fee or deficit amount of the fee to the Authorized Person .
A proper acknowledgement shall be obtained from the applicant in token of receipt of information after production of Form " B " .
5. Appeal . ( i ) Any person-
(a) who fails to get a response in Form " C " , " D " or " E " from the Authorized Person within 30 days of submission of Form " A" ; or
(b) is aggrieved by the response received within the prescribed period;
may file an appeal in Form " F " before the Appellate Authority.
(ii) On receipt of the appeal , the Appellate Authority shall acknowledge the receipt of the appeal in Form " G " and after giving the appellant an opportunity of being heard , shall endeavour to dispose it of within thirty days from the date on which it is presented and send a copy of the decision to the Authorized Person concerned .
(iii) In case the appeal is allowed , the information shall be supplied to the applicant by the Authorized Person within such period as ordered by the Appellate Authority . This period shall not exceed thirty days from the date of the receipt of the order.
6. Charging of application fee .-- The Authorized Person shall charge the fee by way of cash or Demand Draft or Banker's Cheque or Indian Postal Order against proper receipt payable to the Authorized Person at the following rates :-
(i) Rs . 10 as application fee for obtaining information under sub - section ( 1 ) of section 6 ;

(ii) Rs . 2 for each page ( in A- 4 or A- 3 size paper) created or copied;
( iii) Actual charge or cost price of a copy in larger size paper ;
( iv) Actual cost or price for samples or models ;
(v) No fee for the first hour for inspection of records ; and a fee of Rs . 5 for every fifteen minutes (or fraction thereof) thereafter ;
(vi) Rs . 50 per diskette for information provided in such form/media ;
(vii) Price fixed for any publication or rupees two per page for photocopy of the extracts from the publication for information provided in printed form:
Provided that no fee shall be charged from the persons falling below poverty line as may be determined by the Competent Authority.
7. Maintenance of Records . The Authorized Person shall maintain records of all applications received for supply of information and the fee charged.
8. Interpretation . If any question of interpretation of these rules arise, the decision of the Competent Authority shall be final .
