Notification No. 10 Rev. (LAJ) of 2015

Dated 26-11-2015 .

Whereas , the land specifications whereof are given in Annexure " A " to this notification , is required for construction of a Medical College in Village Arnora , Tehsil and District Doda ; and

Whereas , the Director Health Services , Jammu had placed an indent for acquisition of land for construction of a Medical College at Village Arnora vide Letter No. DHSJ/ PLG / 217 / MC - Doda / MF Land/ 2015-16/ 163-66 dated 27-06-2015, consequent upon which the notification as required under sub - section ( 1 ) of section 4 of the J & K Land Acquisition Act ( SVT ) 1990 was issued by the Collector Land Acquisition (ACR) , Doda vide his No.

404-11 / Acq dated 11-07-2015 for land measuring 160 Kanals situated in Village Arnora , Tehsil and District , Doda calling objections from the interested persons to the proposed acquisition ; and

Whereas , the report of Collector Land Acquisition (ACR) , Doda vide his letter No. 657-62/ Acq dated 17-09-2015 read with No. 652-75 /Acq dated 18-09-2015 , duly endorsed by Deputy Commissioner vide his letter No. 503 /LAC/D/ 15 dated 19-10-2015 and Divisional Commissioner , Jammu vide his letter No. 502 / 2485 /New Medical College/Doda/ 15 / 1985-87 and No.502 / 2485 /New Medical College /Doda/ 15/ 1982-84 dated 27-10-2015 respectively have been examined and it has been found that as many as 18 land owners/ interested persons filed their objections to the proposed acquisition before the concerned Collector ; and Whereas , the Collector Land Acquisition (ACR) , Doda vide his letter dated 18-09-2015 referred to above stated that the objections filed by the interested persons were of varying nature , which included fixation of rates of land at market value , besides acquiring minimum possible land for the said purpose ; and Whereas , the report of the Collector land Acquisition (ACR ) , Doda has been examined and it has been observed that most of the objections were not tenable . The Collector has also reported that none of the land owners would be rendered landless on account of the proposed acquisition , besides , intimating that the rates of land would be determined strictly in accordance with the provisions of the Land Acquisition Act and the Rules thereunder ; and

Whereas , after considering the report of the Collector concerned , duly endorsedby Divisional Commissioner , Jammu vide his letter referred to above , the Government is satisfied , that the land , particulars whereof are mentioned above , is required for public purposes and that there is no alternative but to acquire the said land for construction of the Medical College at Village Arnora , due to non - availability of any other suitable location in Tehsil Doda , for the purpose ; and Whereas , the Government while considering the objections of interested persons regarding suitable compensation and acquisition of minimum requisite area , is of the view that it merits due consideration while finalizing the award ; and No. 41 ] The J& K Govt . Whereas , the Collector Land Acquisition (ACR ) , Doda has also recommended for invoking the provisions of section 17 of the Land Acquisition Act due to the urgency involved in the said acquisition .

Now, therefore , in pursuance of section 5 of the J& K State Land Acquisition Act, Samvat , 1990 , it is declared that the land particulars whereof are mentioned in Annexure " A " to this notification , is needed for public purposes viz . construction of a Medical College at Village Arnora . Further, the Collector Land Acquisition ( ACR) , Doda, is directed under section 7 of the said Act to take order for the acquisition of the said land . However, the Collector Land Acquisition (ACR ) , Doda while awarding suitable compensation to the intetrested persons shall explore the possibility of restricting the proposed acquisition to 120-140 Kanals .

Therefore , in pursuance of section 17 of the J & K State Land Acquisition Act , Samvat, 1990, it is ordered that on expiry of fifteen days from the date of publication of notification under section 9(2) of the said Act, the Collector Land Acquisition (ACR ) , Doda , will take possession of the aforementioned land , situated in Village Arnora , Tehsil and District Doda, required for public purposes , subject to the fulfilment of conditions prescribed under section 9(2) and section 17 - A of the J & K State Land Acquisition Act and rule 63 of the J & K Land Acquisition Rules .

However , the Collector shall be responsible for proper title verification of all types of land involved in the case , in respect of all the interested persons/rightful claimants and apportionment of award money in accordance with the relevant laws/ rules in force , while making final award in the case .

N.

S. Pura now Suchetgarh , District Jammu .

Now, therefore , it is declared under section 6 of the Land Acquisition Act, ( Svt . ) 1990 that the aforementioned land is needed for public purpose . Further , the Collector, Land Acquisition (SDM) , R. S. Pura is directed under section 7 of the said Act , to take order for acquisition of the above specified land.

Whereas , the undersigned duly authorized by the Government vide SRO - 235 and 236 of 2009 dated 11-08-2009 to exercise the powers under sections 6 & 7 of the Land Acquisition Act , 1990 ( Svt . ) is satisfied after considering the report furnished by the Collector, Land Acquisition , Sub -Divisional Magistrate , R. (a) A single firm that meets all qualification requirements setforth in paras 1 ( a) and 1 (b) above .

(b) A joint venture of firms having not more than two partners who shall meet all qualification requirements collectively setforth in 1 ( a) and 1 (b) above . Either of the partners can be designated as lead partner on whose name tender shall be purchased.

(c) All the e - Bids must be accompanied by the scanned copy of the EMD in the form of Bank Guarantee from Nationalised Bank only pledged to the Chief Accounts Officer , Office of the Chief Engineer , S & O Wing , Jammu , J & K Government . No interest would be payable on EMD deposited with the department.

(d) To submit Hard Copy of original instrument of EMD to Chief Engineer , System and Operation Wing , PDD Complex , Narwal , Jammu , J& K before the opening of the Commercial and Technical e -Bid .

(e) The date and time of opening of Financial Bids shall be notified on the Website http://jktenders.gov.in . The Bidder must be either manufacturer of tower material / conductor and other allied material himself or has to procure the above material from the reputed firm having past experience along with relevant test reports of material . The towers shall be designed by the bidder for snow bound area and the drawings be vetted from CEA/PDD.

7. The intending tenderers are advised to visit work site before quoting.

8. The Chief Engineer , System and Operation Wing, Jammu , Power Development Department reserves the right to reject any or all the e - Bid documents without assigning any reasons thereof.

SRO - 419 . Whereas , on 27-07-2010 , Police Station , Kothibagh , Srinagar received a docket from DPO , Srinagar along with a press note published by one Masrat Alam Bhat , an activist of the Hurriyat " G " , in 2 The J& K Govt. Gazette , 24th Nov. , 2015 /3rd Agra . , 1937. [No. 34-1

which he had mentioned that the security forces should leave Kashmir and support Quit Kashmir Movement besides stressing that the security forces are indulging in genocide and suppressing the people of Kashmir which is highly objectionable , incriminatory and prejudicial to the security of the State ; and

Whereas , in this connection , Case FIR No. 52/2010 under section 13 of the Unlawful Activities ( Prevention) Act , 1967 and sections 506 , 124 - A RPC was registered in Police Station , Kothibagh and investigation initiated ; and

Whereas , during the course of investigation , on the basis of statements of witnesses , the seizure memos and other evidence , the Investigating Officer has established a prima facie case against the accused person under section 13 of Unlawful Activities ( Prevention) Act , 1967 apart from other offences ; and

Whereas , the Authority appointed by the State Government under sub - section (2) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the accused person ; and

Whereas , after perusing the Case Diary , the relevant documents and also taking into consideration the observations/ views of the Authority appointed under sub - section (2 ) of section 45 of the Unlawful Activities (Prevention) Act, 1967 , the State Government is of the view that there is sufficient material and evidence available against the accused person for his prosecution under the aforesaid provisions of law .

Now , therefore , in exercise of powers conferred by sub - section ( 1 ) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 , the State Government hereby accords sanction for launching prosecution against the accused person namely Masrat Alam Bhat S/ o Abdul Majeed Bhat No. 34-1 ] The J& K Govt. Whereas , on 08-09-2012 , Police Station , Srigufwara , Anantnag received a reliable information to the effect that on 08-09-2012 , some unknown militants of HM Outfit with intention to create fear and terror among the people and elected Panches and Sarpanches have pasted threatening posters at Village Kallan , Mehind , Nowshera and Sirhama ; and

Whereas , in this connection . Case FIR No. 59/2012 under section 13 ( ii ) of the Unlawful Activities ( Prevention) Act , 1967 was registered in Police Station , Srigufwara , Anantnag and investigation initiated ; and 2 The J& K Govt . Gazette , 27th Nov. , 2015/6th Agra . , 1937. [ No. 35 - a

Whereas , during the course of investigation , few suspects were rounded up whose specimen hand writings were sent to the FSL for being matched with the hand writing on the posters so seized and in terms of FSL opinion, the hand writing of accused , namely Ghulam Mohammad Lone matched with the hand writing of the posters ; and

Whereas , the Authority appointed by the State Government under sub - section ( 2) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the accused person ; and

SRO - 432.- Whereas , on 25-05-2013 , Police Station , Ganderbal received an information to the effect that one Imtiyaz Ahmad Tantray , active worker of HM outfit has been asked to collect Rs . six lacs from an unknown person and handover to another worker of HM namely, Shareen Khan for onward distribution in militant cadres ; and

Whereas , in this connection Case FIR No. 96/2013 under sections 17 , 18 and 21 of the Unlawful Activities (Prevention) Act, 1967 was registered in Police Station , Ganderbal and investigation initiated ; and 2 The J& K Govt . Gazette , 4th Dec. , 2015/ 13th Agra . , 1937. [ No. 36-e

Whereas , during the course of investigation both the accused persons were arrested and on the basis of statements of witnesses , the seizure memos and other evidence , the Investigating Officer has established a prima facie case against the accused persons under sections 17 , 18 and 21 of the Unlawful Activities (Prevention) Act, 1967 ; and

Whereas , the Authority appointed by the State Government under sub - section ( 2) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 has independently scrutinized the Case Diaiy file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the accused persons ; and

Whereas , after perusing the Case Diary , the relevant documents and also taking into consideration the observations /views of the Authority appointed under sub - section (2 ) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , the State Government is of the view that there is sufficient material and evidence available against the accused persons for their prosecution under the aforesaid provisions of law .

Now, therefore , in exercise of powers conferred by sub - section ( 1) of section 45 of the Unlawful Activities ( Prevention) Act , 1967, the State Government hereby accords sanction for launching prosecution against the below mentioned accused persons for the commission of offences punishable under sections 17 , 18 and 21 of the Unlawful Activities ( Prevention) Act , 1967 arising out of FIR No. 96/2013 of Police Station , Ganderbal :-

1. Imtiyaz Ahmad Tantray S/ o Mohammad Maqbool R/ o Saloora, Ganderbal .

2. Shareen Khan S/ o Kishwar Khan R/ o Gutlibagh , Ganderbal .
