Whereas, use of High Security Registration Plates (HSRP) has been made mandatory as per Rules 50 and 51 of Central Motor Vehicle Rules, 1989 and Motor Vehicle (New High Security Registration Plates) Order, 2001 of Government of India ;

Whereas, the Hon'ble Supreme Court of India in its decision passed in the case titled Association of Registration Plates V/s. Union of India decided on 31-11-2004 has upheld the constitutional validity of Rule 50 and clause 4 (x) of the Order, 2001 ;
Whereas, the Hon'ble Supreme Court of India in Writ Petition Civil No. 510 of 2005 titled Maninderjit Singh Bitta V/s. Union of India and others read with Hon'ble Court order dated 5th May, 2009 has taken a serious view of delay in the issue of replacement of Non-HSRP with HSR Plates in various States ;
Whereas, in compliance to the provisions and orders of the Hon'ble Supreme Court the system for affixing of HSRP in the State of J&K stands established for all districts ;
Whereas, it has been observed that despite all efforts many vehicle owners are not coming forward for replacing the Non-HSRP with HSR Plates ;
Whereas, on final opportunity was provided to the owners of vehicles in J&K State to affix HSRP on all Moter Vehicles vide this office Notice No. TC/JK/MVD/2015/398-II/933-69 dated 10-09-2015 published in various newspapers of the State on 12-10-2015 and repeated on 27-10-2015 ;
Whereas, it has been decided to initiate action against the defaulters
including the physical removal of Non-HSR Plates from vehicles ;
Whereas, it has been observed that many individuals/agencies are indulging in illegal business of making manual registration plates in the State of J&K and there is every apprehension that the defaulters may manage replacement of Non-HSRP with Non-HSRP plates thereby defeating the purpose and intent of the drive.
Now, therefore, all shopkeepers/vendors who are in the illegal business of making manual number plates and affixing the same on the vehicles are hereby informed through this order to stop their unauthorized business No. 48] The J&K Govt. Short Term Tender Notice
Short terms quotations, affixed with revenue stamp of Rs. 5/- are hereby invited from authorized dealers/suppliers and registered firms for the supply of Computer/Training and Measuring equipment.
Quotations are to be submitted on prescribed tender form which can be obtained along with specifications, list of equipment and terms and conditions on application from Police Telecom. Headquarters, J&K, Jammu, 1st Floor, APHQ Complex, Gulshan Ground, Jammu on payment of tender fee of Rs. 1000/- in cash or money order which will not be refunded and same will be deposited in Government Treasury under Head 0055 Police.
1. Intending tenderers shall furnish quotations, duly sealed and superscripted as "short term tender for Computer/Training and Measuring equipment" mentioning date of submission and name of supplier. The tender shall contain the following items :––
(a) Earnest money of Rs. 25000/- pledged to Staff Officer to
DPT, J&K, Jammu.
(b) A copy of this quotation affixed with revenue stamp of Rs. 5/- duly signed and stamped on every page by the supplier in token of having understood and accepted the specifications, terms and conditions of the quotations.
(c) CST certificate.
(d) VAT clearance certificate up to March, 2015.
The tenders should reach this office by or before 23rd of February,
2016 up to 1030 Hrs.
The quotations so received will be opened on same date i. e. 23rd of February, 2016 at 1500 Hrs. in the office chamber of Staff Officer to DPT, J&K, Jammu. In case of unforeseen circumstances, the date of opening of tenders received, will be next working day.

2. Intending suppliers shall have to deposit earnest money of Rs. 25,000/- in the form of CDR/FDR mentioned in the terms and conditions of the tender, without which tenders will not be considered. However, J&K Government Rules with regard to furnishing of EMD in respect of Registered SSI unit shall be applicable in letter and spirit. The earnest money will be refunded to unsuccessful supplier within one month of the final acceptance of the tender.
3. Tenders received after the prescribed time and date will
be rejected.

Subject :––Issuance of seniority of the Horticulture Development Officers
(HDOs) on the basis of Roster Point and not the merit obtained
in the selection process of the PSC/select list.

Whereas, on the recommendations of the Public Service Commission
made vide their communication No. PSC/DR/Horti/97/2 dated 19-03-2001, 2 The J&K Govt. Gazette, 16th Feb., 2016/27th Magha, 1937. [No. 46-1 ––––––––––––––––––––––––––––––––––––––––––––––—–––—————
97 Horticulture Development Officers (HDOs), under the direct
recruitment quota, came to be appointed vide Government
Order No. 110-Agri. of 2001 dated 16-04-2001, 136-Agri. of 2001
dated 24-05-2001 and 144-Agri of 2001 dated 11-06-2001 ; and
Whereas, due to non-joining of some of the candidates and also on
the directions of the Hon'ble High Court, the recommendations of the
Public Service Commssion were further acted upon and more candidates
appointed as Horticulture Development Officers vide Government
Order No. 99-Agri of 2008 dated 09-04-2008 and Government Order
No. 296-Agri. of 2008 dated 16-10-2008 ; and
Whereas, instead of issuing the appointment orders on the basis of
the merit obtained by the candidates in the PSC, these orders were issued
on the basis of the reservation roster, thereby placing less meritorious
category candidates selected against reservation quota over and above the
meritorious candidates selected against Open Merit ; and
Whereas, after the appointments made in 2001, an initial constitution
of the members of the service, pursuant to the notification of Recruitment
Rules of 2001, was notified vide Government Order No. 329-Agri. of 2002
dated 13-12-2002 in which among others, the names of HDOs appointed
by direct recruitment in 2001 (from S. No. 135 to 239) vide the above
mentioned Government Orders were notified in the same order in which
they figured in the appointment orders, so issued in 2001 ; and
Whereas, vide Government Order No. 257-Agri. of 2003
dated 17-09-2003, the final seniority list of the members of the service
including the HDOs appointed in 2001 was also notified, by placing the
category candidates (HDOs) against the roster points and not in order of
the merit list/select list provided by the PSC. This seniority list was updated
in 2010 vide Government Order No. 04-Agri. of 2010 dated 08-01-2010 in
the same manner as a consequence whereof the category candidates selected
on the basis of the reservation and with an inferior merit continued to be
indicated higher up in the seniority list vis-a-vis the candidates (HDOs)

however, did not include those appointed after 2001 in 2008 vide Government
Order No. 99-Agri. of 2008 dated 09-04-2008 and Government Order
No. 296-Agri. of 2008 dated 16-10-2008 ; and
Whereas, during examination of the matter, it has been observed that
the seniority of the HDOs appointed on the basis of the recommendations
of the PSC in 2001 has been fixed in utter violation of the law and Rule 24
of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956
which provides for the fixation of the inter-se-seniority of the direct recruits
on the basis of the merit obtained in the selection process. Roster maintained
in the department is only for giving effect to the reservation rule which is
not the rule of the seniority as also clarified in Rule 31 of SRO-294 of the
J&K Reservation Rules of 2005 ; and
Whereas, the matter was also taken up with the Law Department
who vide their U. O. dated 23-12-2015 who advised as under :––
"Returned. After conclusion of the selection process, the selection
authority has to draw up the list of selected candidates in order of
merit. Rule 7 of the Jammu and Kashmir Reservation Rules, 2005
illustrates the manner in which a select list is to be prepared. The
appointing authority has to issue the appointment orders of selected
candidates in order of merit as determined by the selection authority.
The roster points indicated in rule 5 of the Reservation Rules are
relevant only for determination of number of vacancies reserved
for different reserved categories. These roster points are not
relevant for determining the seriatum of candidates in which their
names shall appear in the appointment order nor is it relevant for
determining the seniority of appointees. In this arrangement, the
category candidates would appear in the select list/appointment
orders only after the last open merit category candidate. All
reserved category candidates who obtain higher merit than the
last selected open merit candidate would fall in the open merit
category as per the merit they have obtained. In view of the rule
position, the action of the department by issuing appointment orders

law on the subject. There are catena of Apex Court judgments
laying down law on the subject. The seniority list has to be prepared
in accordance with the rule 24 of the Jammu and Kashmir Civil
Services (Classification, Control and Appeal) Rules, 1956 which
provides that the inter-se-seniority of two or more persons appointed
to the same service, class, category or grade simultaneously will,
in case of those recruited direct, except those who do not join
their duties when vacancies are offered to them be, determined
according to positions attained by them in order of merit at the
time of selection.
The saying that "it is never too late to accept a mistake and rectify
it" applies in this case as well. The department is always at liberty
to rectify its mistake and issue afresh seniority list in accordance
with rules governing the field. Wrongful order does not give any
right to the beneficiary to claim perpetual benefits from a wrongful
action. However, before doing the same, the department shall have
to issue a revised tentative senionty list and call for objections
from persons who are likely to be affected by such reframing of
seniority and pass necessary orders after hearing the objections if
any filed by the likely affected persons."
Whereas, the matter was also referred to the General Administration
Department vide U. O. dated 15-01-2016 for conveying approval to the
re-drawal of the seniority in accordance with the rules who vide their U. O.
No. GAD (Ser) Genl/09/2016 dated 16-02-2016 conveyed as under :––
"Returned. The General Administration Department conveys
approval of the Hon'ble Governor to the proposal of the Agriculture
Production Department for re-fixing the seniority of the
Horticulture Development Officers, on the basis of the merit
obtained in the selection process of J&K Public Service
Commission. The department is advised to proceed accordingly."
Whereas, in order to correct the mistakes, it has accordingly, been
decided to issue a fresh tentative seniority list of the HDOs appointed in No. 46-1] The J&K Govt. Gazette, 16th Feb., 2016/27th Magha, 1937. 5 –––––––—–––––––––––––––––––––––––––––––––––––––––––––––———
pursuance of the recommendations of the PSC dated 19-03-2001 strictly in
accordance with the Rule 24 of the Jammu and Kashmir Civil Services
(Classification, Control and Appeal) Rules, 1956 and also to notify the
merit obtained by such candidates in the PSC for better appreciation.
Besides, those appointed subsequently in 2008 pursuant to the Hon'ble
High Court Orders etc. vide Government Order No. 99-Agri. of 2008
dated 09-04-2008 and Government Order No. 296-Agri. of 2008
dated 16-10-2008 have also to be included in the seniority list on the basis
of their date of appointment and the merit obtained in the PSC.
Now, therefore, it is hereby ordered that––
(i) the seniority of the direct recruits, appointed on the
recommendations of the J&K Public Service Commission
communication No. PSC/DR/ Horti/97/2 dated 19-03-2001 vide
Government Order No. 110-Agri. of 2001 dated 16-04-2001,
136-Agri. of 2001 dated 24-05-2001 and 144-Agri. of 2001
dated 11-06-2001, respectively and notified vide Government
Order No. 257-Agri. of 2003 dated 17-09-2003 from
S. No. 128 to 210 and subsequently updated vide Government
Order No. 04-Agri. of 2010 dated 08-01-2010 figuring from
S. No. 128 to 211 is hereby recast and is notified as
Annexure-"A" to this Government Order, in accordance with
order of the merit obtained by them in the PSC, as also indicated
against each and in accordance with Rule 24 of the Jammu
and Kashmir Civil Services (Classification, Control and Appeal)
Rules, 1956 ; and
(ii) the tentative seniority of those appointed vide Government
Order No. 99-Agri. of 2008 dated 09-04-2008 and Government
Order No. 296-Agri. of 2008 dated 16-10-2008 is hereby also
notified in accordance with Rule 24 of the Jammu and Kashmir
Civil Services (Classification, Control and Appeal) Rules, 1956
and the merit obtained by them in the PSC/date of substantive
appointment.

The officers aggrieved, if any, with the tentative position assigned to
them in the seniority may, if they choose to do so, make a representation
along with the facts and material in support of their claim to the Government
within a period of 15 days from the date of issuance of this revised seniority
list for consideration and in case of non-receipt of any representation, a
final seniority list of such members of the service shall be notified.
It is further ordered that––
(i) the seniority of Shri Brij Pal Singh appointed as HDO vide
Government Order No. 296-Agri. of 2008 dated 16-10-2008
shall be notified separately ;
(ii) the seniority of Horticulture Development Officers
(HDOs) appointed in 2010 vide Government Order
No. 18-Agri. of 2010 dated 08-02-2010 on the recommendations
of the PSC vide their Letter No. PSC/DR/1/05-09/HDO
dated 20-01-2010 shall also be notified separately.
The date of birth recorded in the Annexure against the names of the
officers shall not be treated for purposes of service records which shall be
purely as recorded in the service books in accordance with the rules.
This issues without prejudice to the outcome of the writ petitions
pending, if any, before any competent court(s) of law.

SRO-16.––In exercise of powers conferred by section 16 read with
section 18 of the National Food Security Act, 2013, the Government
hereby designate State Consumer Disputes Redressal Commission
(commonly known as State Commission) constituted under section 14 of
J&K Consumer Protection Act, 1987, the State Food Commission for the
purpose of exercising powers under section 16 of National Food Security
Act, 2013.

Subject :––J&K Special Recruitment Rules, 2015–clarification regarding.

Circular No. 09-GAD of 2016
Dated 29-01-2016.
The Jammu and Kashmir Special Recruitment Rules, 2015 have been notified vide SRO-202 of 2015 dated 30th June, 2015. Rule 3 of the said rules provides that these rules shall apply to all the Non-Gazetted posts borne on the establishment of any department or service of the Government and such Gazetted posts, as may be notified by the Government from time 2 The J&K Govt. to time. With a view to harmonize the service conditions of all the Government employees with respect to SRO-202 of 2015 dated 30-06-2015, it is clarified that,––
i. The provisions of the said SRO shall apply to all the posts for which selection is made by the J&K Services Selection Board, Departmental Recruitment Boards or District/Divisional/State Level Selection Committees relating to the selection in Government Departments ;
ii. In view of (i) above, posts borne on the establishment of any department of the Government, the Police, Prisons, Fire and Emergency Services Department and the Ladakh Autonomous Hill Development Councils of Leh and Kargil, shall have to follow the J&K Special Recruitment Rules, 2015 in letter and spirit.
iii. The Managing Directors of the State owned Corporations shall place proposals, in sync with these rules, before their respective Board of Directors for approval so that the appointments, if any, to be made in the PSUs, are in tune with the SRO-202 of 2015. There shall, as such, be no deviation from the Jammu and Kashmir Special Recruitment Rules, 2015 issued under SRO- 202 of 2015.
It is further clarified that the Non-Gazetted posts and notified Gazetted posts of the Higher Education and School Education Departments, advertised after 30th June, 2015, shall be governed by SRO-202 of 2015.

Jammu, the 31st December, 2015.
SRO-461.––Whereas, the Management of M/s Friends Gun Works, Ashok Nagar, Satwari, Jammu terminated the services of its workman namely Rajinder Sah S/o Dhanil Sah R/o Preet Nagar, Jammu ; and
Whereas, the aforesaid workman raised a dispute against the
Management of M/s Friends Gun Works, Ashok Nagar, Satwari, Jammu 2 The J&K Govt. Gazette, 31st Dec., 2015/10th Pausa, 1937. [ No. 40-a
before the Conciliation Officer (Assistant Labour Commissioner),
Jammu ; and
Whereas, all efforts were made by Conciliation Officer during the
conciliation proceedings to settle the dispute but both the parties were
adamant on their stand and not willing to settle the dispute through
negotiation ; and
Whereas, the Conciliation Officer (Assistant Labour Commissioner),
Jammu submitted his failure report recommending the case for its reference
to the Labour Court for adjudication ; and
Whereas, the Government is of the opinion that an industrial dispute
exists between the Management of M/s Friends Gun Works, Ashok Nagar,
Satwari, Jammu and the aforesaid workman ;
Whereas, the Government considers it desirable to refer the said
dispute to the Labour Court for adjudication.
Now, therefore, in exercise of the powers conferred by clause (c)
of sub-section (1) of section 10 of the Industrial Dispute Act, 1947
(XIV of 1947), the Government hereby refers the said dispute to the
Labour Court for adjudication on the following issues :—
1. Whether the Management of M/s Friends Gun Works, Ashok
Nagar, Satwari, Jammu is legally justified in terminating the
services of its workman namely Rajinder Sah ?
2. If not, to what relief, he is entitled ?
