Subject :-Ban on Carriage of Goods on Stage Carriage Vehicles .

Dated 11-12-2015 .

Whereas , save for some exceptions , indicated in sub - rule ( 5) of rule 84 of J & K Motor Vehicles Rules , 1991 the statute prohibits the carriage of goods on any Stage Carriage ;

Whereas , only personal luggage of a bona fide passenger travelling in a vehicle can be carried on that Stage Carriage ;

Whereas , notification have been issued from the Transport Commissioner's Office in the past allowing carriage of limited quantity of goods on the Stage Carriages due to deficiency of Goods Carriage Vehicles in the State ;

Whereas , the undersigned is satisfied that availability of Goods Carriage Vehicles in the State suffice the requirement of carriage of goods on vehicles that have been issued exclusive permits for carriage of goods and as such there is no necessitity of any such relaxation now ;

Whereas , carriage of goods on Stage Carriage is creating an unfair competition by the Stage Carriage Vehicles with the goods carriage vehicles ;

Whereas , the carriage of goods on Stage Carriage is dangerous and a potential cause for accidents particularly on the hilly terrain of the State 650 The J& K Govt . Gazette , 3rd March , 2016/ 13th Phal . , 1937. [No. 49

where sharp curves have to be negotiated by the vehicles frequently, and as such has become an issue of concern so far as road safety is concerned ;

Whereas , apart from the concern at various levels in the State Government for curbing the Road Accidents , Hon'ble Supreme Court of India has issued instructions from time to time ;

Whereas , the carriage of goods on Stage Carriage Vehicles is likely to result in leakage of commercial taxes as the owners of goods carriage vehicles alone have to file the returns of goods transported from one place to another with the Commercial Taxes Department and there is no such binding on the owners of Stage Carriage Vehicles to account for the goods carried on such vehicles .

Now , therefore , I , Parvaiz Iqbal Khateeb , IAS , Transport Commissioner , J& K in supersession of all previous orders on the subject issued by the Transport Commissioner , J & K or authority subordinate to him , hereby order that no goods of commercial nature shall henceforth be carried on any stage carriage passenger vehicle operating on local routes and areas in the State of J & K . Only bona fide personal luggage of a passenger travelling in a Stage Carriage shall be allowed to be carried on Stage Carriage Vehicle in accordance with the provisions of rule 84 of J&K Motor Vehicles Rules , 1991 .

Passengers , in their own interest , are advised not to travel in such vehicles as Stage Carriage Vehicles which are found to be violating the conditionalities as set in the J & K Motor Vehicles Rules , 1991 and this order may result in inconvenience to the passengers at odd locations in the event ofunloading of such goods .

Jammu , the 20th January, 2016.

SRO - 20.- Whereas , the Management of Delhi Public School , Jammu has terminated the services of its workman namely Vijay Kumar S/o Late Mohan Lal R/ o Khatruee , Dansal , Teh . and Distt . Jammu ; and Whereas , the aforesaid workman raised a dispute against the Management of Delhi Public School , Jammu before the Conciliation Officer (Assistant Labour Commissioner) , Jammu ; and 2 The J& K Govt . Gazette , 20th Jan. , 2016/30th Pausa, 1937. [ No. 42-1

Whereas , the Conciliation Officer ( Assistant Labour Commissioner) , Jammu submitted his failure report recommending the case for its reference to the Labour Court for adjudication ; and

Whereas , all efforts were made by Conciliation Officer during the conciliation proceedings to settle the dispute but both the parties were adamant on their stand and not willing to settle the dispute through negotiation ; and Whereas , the Government is of the opinion that an industrial dispute exists between the Management of Delhi Public School , Jammu and the aforesaid workman ; and

Whereas , the Government considers its desirable to refer the said dispute to the Labour Court for adjudication.

Now, therefore , in exercise of the powers conferred by clause (c) of sub - section (I) of section 10 of the Industrial Dispute Act , 1947 (XIV of 1947) , the Government hereby refers the said dispute to the Labour Court for adjudication on the following issues :-

1. Whether the Management of Delhi Public School , Jammu is legally justified in terminating the services of its workman namely Vijay Kumar ?

2. If not , to what relief , he is entitled to ?

SRO - 27 .-- In exercise of powers conferred by clause (b) of sub - section ( 1 ) of section 8 of the Jammu and Kashmir Consumer Protection Act , 1987 , the Government hereby nominate from the panel furnished by the concerned Selection Committee , the following two persons as members of District Forum , Jammu : -

1. Ms. Vijay Angral D /o Sh . Ravi Angral R/ o J - 7622 H. No. 347 , Bahu Lane , Shahidi Chowk , Jammu ( Advocate) .

2. Mr. Ghulam Sarwar S/ o Sh . Lal Din R/ o Sunjawan , Jammu (Retd. Superintendant of Police) .

They shall hold office for a term of three years or up to the age of 65 years , whichever be earlier.

SRO - 28 . In exercise of the powers conferred by clause ( b ) of section 3 of the Jammu and Kashmir Grant of Permanent Resident Certificate ( Procedure ) Act, 1963 (Act No. XIII of 1963 ) , and in supersession of all the Notification( s) issued in this behalf, the Government hereby appoint Mr. Hamidullah Mir, Assistant Commissioner (Revenue ) , Srinagar to be the competent authority for purposes of the said Act, within the territorial limits of Tehsils of Khanyar and North Srinagar till Syed Hanief Balkhi , Sub - Divisional Magistrate ( East ) , Srinagar resumes his duties after availing earned leave w. e . f. 04-01-2016 to 15-02-2016 .

SRO - 38 .-- In exercise of the powers conferred by section 5 of the Jammu and Kashmir Levy of Tolls Act , Samvat 1995 , (Act No. VIII of 1995 ) , the Government hereby exempt from payment of 2 The J& K Govt . [No. 45 - f levy of tolls leviable under the said Act , the goods/ material as shown in Annexure -X to this notification to be imported into the State by Area Secretary, Radha Soami Satsang ( Beas ) , Jammu , in connection with the spiritual discourses to be held on 9th and 10th April , 2016, at Jammu subject to the condition that the Area Secretary, Radha Soami Satsang ( Beas ) , Jammu certifies / undertakes that the goods/ materials so imported are exclusively meant for the above said purpose and shall be returned back after conclusion of the event .
