Whereas , the land , specifications whereof are given at Annexure " A " to this notification is required for public purpose viz . construction of road from KM 19th of T01 to Muradpur under PMGSY ; and

Whereas , on the basis of an indent placed by Executive Engineer , PMGSY Division , Rajouri , after completing all codal formalities , a notification under section 4 ( 1 ) was issued by Collector , Land Acquisition (ACR) , Rajouri vide No. AC/LA/ 1020-22 dated 26-03-2016 for land measuring 11 Kanals13 Marlas situated at Village Muradpur , Tehsil and District Rajouri for public purpose for construction of road from KM 19th of T01 to Muradpur under PMGSY ; and 324 The J & K Govt . Gazette , 27th October, 2016/5th Kart . , 1938. [No. 30

Whereas , the the Deputy Commissioner , Rajouri vide No. AC/ LA/ 113-14 dated 10-05-2016 reported that the notification issued by Collector , Land Acquisition ( ACR) , Rajouri under section 4 ( 1 ) of the J& K State Land Acquisition Act , was served upon the land owners/ interested persons for filing objections , if any , to the proposed acquisition but no objection was received within the stipulated period as required under sections 5 & 5 - A of Land Acquisition Act ; and

Whereas , the report furnished by the Deputy Commissioner , Rajouri vide letter referred to above , has been examined and it has been found that the land owners did not file objection within the prescribed period to the proposed acquisition ; and

Whereas , the Government is satisfied that the land particulars whereof are referred to above , is required purely for public purpose viz . construction of road from KM 19th of T01 to Muradpur under PMGSY .

Now , therefore , in pursuance of section 6 of the J & K State Land Acquisition Act , Samvat 1990 , it is declared that the land measuring 11 Kanals , 13 Marlas situated in Village Muradpur , Tehsil and District Rajouri , details whreeof are mentioned in Annexure " A" to this notification is required purely for public purposes viz . construction of road from KM 19th of T01 to Muradpur under PMGSY . Further , the Collector , Land Acquisition (ACR) , Rajouri is directed under section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the interested person (s ) as required under the Land Acquisition Act/Rules .

However , the Collector concerned shall be personally responsible for identification and proper title verification of all types of land involved in the case and apportionment of compensation amongst all the interested persons /rightful claimants in accordance with the relevant laws / rules in force , while making the award .

Whereas , case was lodged by SHO , Doda through incharge Police Post , Khellani vide his No. 74/5 - A/PPK dated 27-06-2014 , in which it was complained that incharge Police Post , Khellani has seized one vehicle bearing registration No. 3033 - JK21A and arrested 2 persons along with MFP Nagchatri (Trillium govanianum ) equalling 125 Kg . being transported illegally on 24-06-2014 ;

Whereas , after following all the codal formalities , the vehicle along with illegal MFP stands confiscated vide No. 325-30 /AO 410 The J& K Govt . Gazette , 27th Oct. , 2016/5th Kart . , 1938. [ No. 30 dated 02-01-2015 read with Corrigendum Order No. 331-36 /AO dated 17-01-2015 ;

Whereas , prescribed time period of appeal before the Court of Session under section 26 - B is over and the confiscated vehicle is free from all encumbrances wherein no application or appeal is pending in any court .

It is , therefore , ordered that the vehicle bearing registration No. 3033 / JK21A , is vested in favour of the Forest Department under sub - section ( 1 ) of section 33 of the Jammu and Kashmir Forest Act , 1987 , with immediate effect .

SRO - 280 .--In exercise of the powers conferred by sub - section ( 1 ) of section 3 of Jammu and Kashmir Ancient Monuments Preservation Act , Samvat 1977 ( 1920 - AD) ( Act No. V of 1977) , the Government hereby declare the " Silk Factory , Solina, Rambagh , Srinagar" along with 52 Kanals and 5 Marlas land falling under Khasra No. 49 as State Protected Monument within the meaning of the said Act.

The said flag of ISIS organization was seized and statements of witnesses were recorded under sections 161 , 164- A Cr. P. C .; and

Whereas , during the course of further investigation, on the basis of statement of witnesses , the seizure memo and other evidence , the Investigating Officer has established a prima facie case against the accused persons under section 13 of the Unlawful Activities (Prevention) Act , 1967 apart from other offence ; and

Whereas , the Authority appointed by the State Government under sub - section (2) of section 45 of the Unlawful Activities (Prevention) Act , 1967 has independently scrutinized the Case Diary file and all other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the accused persons ; and

Whereas , after perusing the Case Diary, the relevant documents and also taking into consideration the observations /recommendations of the Authority appointed under sub - section ( 2 ) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 , the State Government is of the view that there is sufficient material and evidence available against the accused persons for their prosecution under the aforesaid provisions of law .

Now, therefore , in exercise of powers conferred by sub - section ( 1) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 , the State Government hereby accords sanction for launching prosecution against the below mentioned accused persons for the commission of offence punishable No. 22 - c ] The J& K Govt .
