The Government hereby directs that the instructions 2 and 3 (c) of Jammu and Kashmir Civil Services ( Verification of Character and Antecedents ) notified vide Government Order No. 1918 - GAD of 1997 472 The J & K Govt . Gazette , 12th Jan. , 2017/ 22nd Pausa , 1938. [ No. 41

dated 09-12-1997 read with Government Order No. 597 - GAD of 1999 dated 26-05-1999 and Government Order No. 681 -GAD of 2000 dated 14-06-2000 shall be substituted respectively with following text :-

2. Character and antecedents verification by the appointing authority. The appointing authority shall issue conditional appointment orders to the selected candidates after receipt of an Attestation Form as per Annexure - I accompanied by an undertaking prescribed in Annexure - IV on a sworn affidavit , clearly mentioning therein that the salary of the selected candidates shall be drawn /disbursed only after receipt of satisfactory character and antecedents verification report . In case of receipt of an adverse report and on confirmation thereof by the State /Division/District Level Screening Committee , as the case may be , the appointment shall automatically stand cancelled without any notice .

3 ( c) . A person convicted by the competent court of an offence involving moral turpitude , heinous offences like murder, rape , dacoity , robbery and offences under NDPS Act shall be regarded not fit for Government Service .

It is further ordered that :-

(i) The Annexure - I to Government Order No. 1918 - GAD of 1997 dated 09-12-1997 shall be substituted by Annexure - I to this order .

( ii) A sworn affidavit as per Annexure - IV be obtained from the selected candidates alongwith attestation form in Annexure - I .

Whereas , on 13-09-2010 , during the maintenance of law and order situation in Khanabal area , some youth including Maroof Ahmad Nath @ Raju while fleeing jumped into River Jehlum and the said Maroof Ahmad Nath drowned in the river . The body of said person was recovered on 18-09-2010 and was carried in the shape of a procession towards Khanabal , then to KP Road and finally towards Delhi Darbar . However , when the procession was stopped from entering Anantnag Town , as restrictions were imposed in that areas , the miscreants resorted to heavy 2

stone pelting and the mob turned violent , resultantly, few shots were , reportedly , fired in air to control the mob , due to which some persons got injured and the procession returned towards Khanabal via Nai Basti . Out of the injured , two persons Bilal Ahmad Najar and another person Noor- ul - Amin Dagga succumbed to their injuries ; and

Whereas , with regard to the aforementioned firing incident near Delhi Darbar , case FIR No. 355/2010 was registered in Police Station , Anantnag ; and

Whereas , subsequently father of one of the aforementioned deceased person approached the Hon'ble Court for registration of a separate case , with the plea that the deceased persons were injured in the firing incident near Ahali Hadees Masjid , Khanabal and not near Delhi Darbar ; and Whereas , in this connection , a separate case FIR No. 361/2012, under section 302 RPC was registered at Police Station , Anantnag , after judicial intervention with the further direction to constitute a Special Investigation Team , and as such investigating was initiated ; and

Whereas , during the course of investigation , conducted by Special Investigation Team constituted in the matter, statement of witnesses was recorded and as many as 27 independent witnesses namely Dy . SP, Noor- ul -Hassan Parray as accused in the said case , highlighting his role in the said incident that had taken place near Ahali Hadees Masjid, Khanabal and the details regarding the deployment of nafree , that was obtained from concerned agencies by the Investigating Officer , also corroborated the fact of posting of the accused in the said area on the date of incident ; and

Whereas , during the course of investigation , on the basis of the statements of witnesses , the seizure memos and other evidence , the Investigating Officer has established , prima facie , a case under section 304 - II of RPC against the accused ; and

Whereas , the appointing authority of Noor- ul- Hassan Parray (Dy. SP) is the Government in the Home Department and the offence has been committed by the accused person while acting or purporting to act in discharge of his official duties and to prosecute him , sanction under section 197 ( 1 ) J & K , Cr. P. C. is mandatory.

SRO - 333.-Whereas , on 13-06-2012 , Police Station , Ganderbal received a reliable information to the effect that some unknown persons have pasted posters of HM outfit at Village Saloora and have threatened Punches , Sarpanches and Political Workers to resign from their posts ; and

Whereas , in this connection , Case FIR No. 103/2012 , under sections 507 , 201 RPC and section 13 of the Unlawful Activities (Prevention) 2

Act , 1967 was registered in Police Station , Ganderbal and investigation initiated ; and

Whereas , during the course of investigation , one accused person namely Mudasir Ahmad Baba S/ o Ghulam Mohammad Baba R/ o Saloora , Ganderbal was apprehended , who confessed that he had pasted the posters in the locality of the said village and on this instance , 04 posters were recovered from his bedroom ; and

Whereas , during the course of further investigation , on the basis of statements of witnesses , recorded under sections 161 and 164 - A Cr. PC , the seizure memo and other evidence , the Investigating Officer has established a prima facie case against the accused person for offence under section 13 of the Unlawful Activities ( Prevention) Act , 1967 , apart from other offences ; and

Whereas , the authority appointed by the State Government under sub - section (2 ) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 has independently scrutinized the Case Diary file and all other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the accused person ; and

Whereas , after perusing the Case Diary , the relevant documents and also taking into consideration the observation/views of the authority appointed under sub - section (2 ) of section 45 of the Unlawful Activities (Prevention) Act, 1967 , the State Government is of the view that there is sufficient material and evidence available against accused person for his prosecution under the aforesaid provisions of law.

Now , therefore , in exercise of the powers conferred by sub - section ( 1 ) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , the State Government hereby accords sanction for launching prosecution against the accused person namely , Mudasir Ahmad Baba No. 28 - d] The J& K Govt . SRO - 334 .--Whereas , on 21-10-2009 , Police Station, Pulwama received information to the effect that some miscreants have pasted posters on various places in which secessionist activities have been highlighted with the object to create disharmony amongst general public against the Union of India ; and

Whereas , in this connection , Case FIR No. 282/2009 , under section 13 of the Unlawful Activities (Prevention) Act, 1967, was registered at Police Station , Pulwama and investigation initiated ; and 2
