Whereas , on the basis of an indent placed by Project Director , NHAI , PUI , Srinagar vide No. PD/ SGR/ 14022 / LA - Ramban / 43 dated 28-05-2013 , a notification under section 4 ( 1) was issued by Collector , Land Acquisition (ADC) , Ramban vide No. 351-60 / ACQ/ NHAI dated 30-11-2015 for land measuring 04 Kanals situated in Village "Devgole " , Tehsil Banihal , District Ramban under NHAI ; and No. 49 ] The J& K Govt . Gazette , 9th March , 2017 / 18th Phal . , 1938. 573
Whereas , the Collector , Land Acquisition ( ADC ) , Ramban vide No. 489 / ACQ /NHAI dated 05-02-2016 has reported that the notification issued under section 4 ( 1 ) of the J & K State Land Acquisition Act by him , was served upon the interested persons for filing objections , if any , to the proposed acquisition but no objection was received from the land owner / interested persons in the prescribed time period as required under sections 5 & 5 - A of the Land Acquisition Act ; and
Whereas , the report furnished by Collector , Land Acquisition ( ADC ) , Ramban vide letter dated 05-02-2016 duly endorsed by Deputy Commissioner , Ramban vide No. DCR/ SQ/ DC / LA/ 16/ 209 dated 09-02-2016 , Divisional Commissioner , Jammu vide No. 502 / 2572 / Acq/ NHAI / Devgole / Rbn / 16/ 3380-82 dated 26-03-2016 and Financial Commissioner ( Revenue ) , J & K vide No. FC - LS / LA - 4469/2016 dated 20-04-2016 , has been examined and it has been found that the land owners did not file any objection to the proposed acquisition ; and
Whereas , the Government is satisfied that the land particulars whereof are mentioned above , is required for public purpose viz . " Widening of Four Lane National Highway Road by NHAI , PUI , Srinagar.
Now, therefore , in pursuance of section 6 of the J & K State Land Acquisition Act , Samvat 1990 , it is declared that land measuring 04 Kanals situated in Village " Devgole " , Tehsil Banihal , District Ramban , particulars whereof are mentioned above , is required for public purpose viz . " Widening of Four Lane National Highway Road by NHAI , PUI , Srinagar . Further, the Collector , Land Acquisition ( ADC ) , Ramban is directed under section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the interested person ( s ) as required under the Land Acquisition Act/Rules .
However , the Collector concerned shall be personally responsible for identification and proper title verification of all types of land involved in the case and apportionment of compensation amongst all the interested persons / rightful claimants in accordance with the relevant laws/ rules in force, while making the award .

Whereas, the Central Council of Indian Medicine vide communication No. 12-18 /2016 NEET dated 13-02-2016 and Ministry ofAyush , Government of India letter No. R- 13040/ 33 / 2016 - HD ( Tech . ) part dated 25-01-2017 have intimated the J & K BOPEE that it has been decided to merge Ayush Courses in National eligibility National Test (NEET- 2017 ) ; and
Whereas , the J & K BOPEE vide its Notification No. 2- BOPEE of 2017 dated 14-02-2017 has decided accordingly not to conduct any separate test for BUMS /BAMS / BPT including Composite Regional Centre , CRC Courses i . e . BPT, DPO , DRT and DHLS ;
Whereas , a consequence of the above , there shall be no Biology Paper for CET- 2017 to be conducted by the Board for 2017 ;

Notification No. 07 - BOPEE of 2017 dated 21-02-2017 .
Online applications duly affixed with latest coloured photograph , thumb impression and signature are invited from permanent residents of. J & K State who are eligible and desirous of appearing in the Common Entrance Test for admission to Bachelor of Engineering ( B. E. ) Courses for academic session , 2017. The selection of the candidates shall be governed by the J&K Board of Professional Entrance Examination Act , 2002 and the Rules and Regulations thereunder, JK Reservation Act , 2004 and the rules thereunder and guidelines as contained in the Electronic Information Brochure , 2017. The payment of Rs . 800 ( Rupees eight hundred only ) as fee is to be made also online through the Integrated Payment Gateway which can be used to make payment with any National Credit Card /Debit Card /Net Banking . The procedure for filling Application Form and eligibility etc. ofthe candidates has been given in detail in the e - Brochure . The applicants must necessarily, in their own interest , go through this e - Brochure before attempting to fill up the online Application Form.

The applicants are advised to fill the online Application Forms on their own or through a responsible person . The applicants can also avail services at Common Service Centres of J & K State for filling up online Application Forms at nominal charge . They can also avail the services at any National Informatics Centre located at the Office of the Deputy Commissioner of the concerned district .
Submission of Online Application Forms :
The interested candidates have to produce the following self- attested certificates along with original at the time of Counselling or before submission of online Preference Form as the case maybe . However, no Reserved Category Certificate/ State Subject ( PRC issued by the competent authority after the cut- off date i . e . 27-03--2017 ) shall be entertained in any circumstances . The candidates have to upload their Photograph , Signature and Thumb impression on the Application Form positively : -
( i ) Permanent Resident Certificate ;
(ii ) Qualifying Marks Certificate ( where result is declared ) ;
(iii) Date of Birth Certificate ;
(iv) Reserved Category Certificate , if any ( including Sports Certificate ) on the prescribed proforma ( duly renewed wherever anplicable ) : and 189

(v) The candidates can change / modify their online Application Form at any time before it is submitted online . They can check the status of their Application Form on the official website of the BOPEE : If any form is not confirmed for want of required information , the candidate concerned must report in the BOPEE Office . Srinagar or Jammu by or before 3rd April , 2017 failing which his / her Application Form shall be rejected :
( vi ) Note :
( a) The candidates must , after filling up all the required entries , submit their Application Forın by pressing " Submit Application Form " button in the Preview of Provisional Confirmation Page : otherwise their form will not be registered in the database and will not be considered . Mere downloading of the Application Form/ Confirmation Page does not mean that the candidate has submitted his / her Application Form . Eligibility :
1. The Applicant must-
(a) be a permanent resident of J & K State as defined in section 6 of the Constitution of the J & K ;
(b) have passed Higher Secondary Part - II Examination (10+ 2 class ) or equivalent examination from a recognised statutory board . The candidates appearing /appeared in 190 The J & K Govt . Gazette . 9th March , 2017 / 18th Phal . , 1938. [ No. 49
12th class examination can also apply for the Entrance Test :
( c) have obtained 50 % marks in 12th class in case of open merit and 40 % marks in case of reserved category : and
2. The candidates appearing / appeared in the 12th class examination are also eligible to appear in the Common Entrance Test but they must have passed Physics , Chemistry and Mathematics subjects in 12th class examination at the time of counselling and secured percentage of marks as required in ( c) above .
Instructions :
( a) No under process certificate will be accepted ;
( b ) The information provided by the candidates in the Online Application Form cannot be verified from the original documents by the BOPEE officials before the counselling in person or counselling through filling up of online Preference Form for admission of the candidates . The information on the Confirmation Page or on the Admit Card of candidate shall in no case be construed as an acceptance of such information/ category certificate by the BOPEE . Therefore , if at any stage , it is found that a candidate has provided false or incorrect information in respect of any eligibility condition , his /her candidature will be cancelled without any further notice ;
( c) The sports category candidates have to indicate their sports category on the Application Form and upload valid sports certificate(s ) . They are also required to submit their sports certificate(s ) in the Office of the Secretary , Sports Council , Jammu / Srinagar for determining their sports points which will be afterwards officially forwarded by the Council to the BOPEE . The BOPEE , however, shall not be responsible for non - inclusion of any candidate in the list forwarded by the SportsCouncil or for their delay in submission of sports points to the BOPEE :

the Application Form which in no case shall be changed afterwards . The candidate , whose category certificate has not been found valid , will be considered in open merit , if found otherwise eligible without any further notice . In case validity of the Category Certificate has expired after the last date for filling up the online form , the candidates are in their own interest are advised to have the same renewed before the date of counselling.
Note :

The Electronic Admit Card will indicate time , venue and schedule of the Entrance Test . The Electronic Admit Card shall have the space for photograph of the candidate . The candidate has to affix his / her photograph which should then be attested by a Gazetted Officer .

Venue for Conduct of Examination :
The Examination shall be conducted at Jammu / Srinagar simultaneously.
Issuance of Admit Cards and Date of Test :
Information with regard to availability of Online Admit Cards , Venue and Time of the Common Entrance Test will be issued separately in due course of time . The Entrance Test will be held on 28th May (Sunday) . 2017 .
Note : -1 . The online submitted form is purely provisional and is liable to be cancelled at any stage subject to the final verification of the documents and even at any stage where such a document is proved to be fake /false .
Note :-2. Impersonation by any candidate by uploading any other object etc. other than his photograph shall lead him / her to disqualification , besides liable to be prosecuted under law .
Note :--3 . There will be a single paner comprising of 180 questions in Physics , Chemistry and Mathematics ( each subject will be of 60 Marks / questions ) with 0.25 negative marking for each wrong question . The time duration will be 3 hours .

The following shall be added to Rule 36 of J & K Board of Professional Entrance Examinations Regulations , 2016 after sub- rule 36 ( X) :-

examinations by inviting Online Preference Forms without asking the candidates to be physically present for filling up of Preference Forms for counselling . However , all the information regarding such online counselling shall be uploaded on the official website of the BOPEE for information and facilitation of the candidates :
Provided that the seats shall be allotted on the basis of merit - cum - preference , reservation rules and other applicable laws only, as hithertofore and such candidates shall only be considered who fulfill the requirements as laid down by the Board from time to time for such counselling which includes presentation/deposition of documents in original and or photocopies duly attested by the candidates before the Board for determining their eligibility as per rules . Such candidates who fail to produce original documents and or deposit the documents within the prescribed dates shall in no case be eligible to fill in Online Preference Form . "
Note : The candidates would , however , be required to deposit the documents in person and under exceptional circumstance like ill health , out of station on the notified date etc. after satisfaction of the Board of such exceptional circumstances , through duly authorized person as may be decided by the Board .

SRO- 30 .-- In exercise of the powers conferred by section 79 of the Jammu and Kashmir Value Added Tax , 2005 , the Government in order to facilitate voluntary payment of tax arrears payable under the Jammu and Kashmir Value Added Tax , 2005 , directs that :-
(1 ) there shall be remission of 100% of the penalty and the interest on arrears of the tax in respect of all the dealers 2 The J& K Govt . Gazette , 1st Feb. , 2017 / 12th Magha , 1938 . [No. 43 -g
registered under the provisions of Jammu and Kashmir Value Added Tax , 2005 , who pay the arrears of VAT, assessed/ re - assessed up to the accounting year 2015-2016 , in six equal monthly installments , with the first installment to be paid within one month of the publication of this notification.
(2) the remission of interest and penalty shall be available to the following categories of dealers :-
(i ) who have paid their admitted/assessed tax for all the accounting years up to 2015-2016 , in part or in full and deposit the balance payable amount of tax in six equal monthly installments , with the first installment to be deposited within one month of the publication of this notification ;
( ii) such dealers , who have been assessed up to the accounting year 2015-16 , shall simply file a declaration as may be prescribed by the Commissioner for that particular year (s ) along with the proof of payment of 1/6th of the assessed tax arrears .
(3 ) default in payment of first installment shall entail outright disqualification from the scheme . However , default in payment of any subsequent monthly installment shall make the dealer liable for disqualification only if he is not able to furnish proof of the payment of the missed installment along with penalty equivalent to 5% of the unpaid installment amount with the next installment which shall become due . In case of any further default , the dealer shall be liable to pay the entire amount of arrears along with the interest and penalty . All the installments shall have 3

to be deposited within six months from coming into force of the notification .
(4) the benefit of remission under this notification can also be availed by the industrial unit holders registered under Jammu and Kashmir Value Added Tax Act , 2005 .
(5) in respect of the cases where the dealers have challenged the orders passed under any section of the Jammu and Kashmir Value Added Tax Act , 2005 , before any Appellate Authority or Court ( s) , the benefit of scheme shall be available subject to the condition that the concerned dealer files an application before the Competent Authority , along with an affidavit, that he has filed an application for withdrawal of such case( s ) and that there are no proceedings pending before any Appellate Forum or Court ( s ) , as the case may be .
(6) the provisions of clause ( 1 ) to clause ( 5 ) shall also apply to arrears of tax/ or interest/ or penalty under the Central Sales Tax Act , 1956 w . e . f. 2005-06 in all cases where the procedure is regulated under section 9 ( 2) of Central Sales Tax Act , 1956 read with Jammu and Kashmir Value Added Tax Act , 2005 .
(7) all the concerned Assessing Authorities having jurisdiction shall be competent to pass order for waiver of such interest/ penalty , subject , however , to the condition that no proceedings are pending in this regard before any forum including court ( s ) .

issuance of this notification , shall neither be refunded nor adjusted in any manner .

SRO - 37 . In exercise of the powers , conferred by section 79 - A of the Jammu and Kashmir Value Added Tax Act , 2005 , the Government hereby direct that in Notification SRO - 91 dated 16-03-2006 read with Notifications SRO - 42 dated 28-02-2014 , SRO - 111 dated 01-04-2015 and SRO - 211 dated 29-06-2016 , the following amendment shall be made , namely : ---
"In 2nd para, for the words and figures " upto 31st March, 2017, or till the State adopts the proposed Goods and Service Tax regime whichever is earlier " , the words and figures " upto 31st March, 2018 or till the same is superseded by any other notification , whichever is earlier " shall be substituted .
This notification shall come into force w . e . f. 01-04-2017 .

SRO - 38.-In exercise of the powers conferred by section 5 of the Jammu and Kashmir Levy of Tolls Act , Svt . 1995 (Act No. VIII of 1995 ) , and in partial modification of Notification SRO - 22 dated 31-01-2004 , the Government hereby direct that , ---
(i ) for the figures and words " 31st of March , 2017 " , the figures and words " 31st of March , 2018 " shall be substituted.

( ii) clause ( ii ) of Notification SRO - 22 dated 31-01-2004 shall be substituted by the following : --
"there shall be no toll on goods chargeable on finished goods manufactured by the existing or new , local , small , medium , and large scale industrial units ( including prestigious units ) and sent outside the State . "
(iii) Annexure ' A ' of the Notification SRO - 209 dated 29-06-2016 read with Notification SRO - 327 dated 06-10-2016 shall be substituted by the Annexure ' A ' appended to this notification .
The notification shall come into force w . e . f. 03-02-2017 .

Annexure 'A ' of Notification SRO- 38 dated 01-02-2017.
Incoming Raw Material
1. Food Items /Eatables /Fruits that includes Spices , Salt ( except Non- Iodized salt imported as raw material by salt - processing units manufacturing iodized salt) , all kinds of pulses , nuts including grams , dry milk powder , all kinds of oils ( edible and non -edible ) excluding oil seeds . All kinds of fresh fruits .
2. Building materials that includes Marble in any form like slabs , powder, chips , crazy tiles excluding Marble Blocks weighing 1.5 tons and above per piece , Cement of all types and brands , Stones excluding Quartz , Magnesite , Ore Chromites , Dolomite and Limestone and blocks of Kota Stone weighing 1 qtl . and above per piece , Plywood , Sunmica Sheets , Timber all types (other than the one when imported as a raw material by the industrial units engaged in the manufacture of Plywood and Ply- board viz . Face/Core Veneer , Batons , wood of eucalyptus and popular) Ply-board , Glass of all types , all type of tiles .
3. Iron/Metal Goods that includes MS Tor , MS rounds and MS Tor of modified make , untwisted ribbed bars for manufacture of twisted ribbed bars , scrap sheets and circles of copper for mechanized utensil making units ,G. P. Sheets ,G. C. Sheets , MS Sheets , B. P. Sheets , CR/ HR coils and sheets .
4. Packing materials including empty bottles ( except empty beer bottles) .
5. Molasses other than the one when imported as a raw material by industrial units engaged in the manufacture of Poultry and Animal Feed for manufacture of such feed .
6. Fuels that includes LPG , Coal (steam and slack) .

SRO - 39.- In exercise of the powers conferred by section 19 -A of the Jammu and Kashmir Passengers Taxation Act, 1963 , the Government in order to facilitate voluntary payment of tax arrears payable under the Jammu and Kashmir Passenger Taxation Act , 1963 , directs that , ----
1. 100% of interest and penalty shall be remitted in respect of such defaulting transporters who pay the Principal Tax 2

accrued up to 31-03-2016 in six equal monthly installments , with the first installment to be paid within thirty days of the publication of this notification ;
2. the scheme of remission of interest and penalty shall also apply to such transporters who have already deposited Principal Tax for the referred period in full or in part ;
3. if any transporter fails to pay one single installment within the stipulated period for reasons beyond his control , he shall deposit the same along with the installment due in the following month . In case of any further default , the entire amount of arrears along with the interest and penalty shall become recoverable as if the scheme of amnesty so authorized did not exist ;
4. the passenger transport operators desirous of availing of the scheme shall make an application to the Passenger Tax Officer of the concerned division in the format prescribed by the Commissioner , Commercial Taxes , J & K . Such application duly filled should reach to the concerned division within 30 days from the issuance of this notification along with proof of payment of 1/6th of the total amount of Principal Tax .
This notification shall come into force w . e . f. 03-02-2017 . By order of the Government of Jammu and Kashmir .

SRO - 41 . In exercise of the powers conferred by section 10 of the Jammu and Kashmir Passengers Taxation Act , 1963 , the Government hereby exempt from payment of tax leviable under the said Act , the passenger vehicles which remained off road due to law and order situation in the State from 1st July , 2016 to 31st December , 2016 subject to the condition that the owner of the passenger vehicles shall furnish an affidavit to the effect that his/her vehicle actually remained off road during that period .

SRO - 43 .-- In exercise of the powers conferred by sub -section ( 1 ) of section 492 of the Code of Criminal Procedure , Samvat 1989 , the Government hereby appoints Sh . Ravinder Kumar , Advocate, J & K High Court, Jammu as Special Public Prosecutor in the case titled State V/ s . Pankaj Singh Alias Kala and another involving offences punishable under sections 302/34 RPC , FIR No. 123/2003 pending before the Court of Ld . 2nd Additional Sessions Judge, Jammu .
