Notification No. 95 - Rev ( LAJ ) of 2016

Dated 03-10-2016 .

Whereas , the land , specifications whereof are given in Annexure " A " to this notification , is required for public purposes viz for widening of Reasi- Arnas Road by GREF ; and Whereas , on the basis of an indent placed by Officer Commanding , 110 RCC , GREF vide No. 2100/ RAM / LA / 110 / E2 dated 17-08-2010 , a notification under section 4 ( 1 ) was issued by Collector, Land Acquisition ( ADC ), Reasi for land measuring 34 Kanals - 01Marla & 01½ Sirsai situated in Village " Gran " , Tehsil & District Reasi ; and Whereas , the notification issued by the Collector , Land Acquisition (ADC ) , Reasi under section 4 ( 1 ) of the J & K State Land Acquisition Act , was served upon the interested persons for filing objections ; and 640 The J & KGovt . Whereas , the Collector , Land Acquisition ( ADC ) , Reasi , vide his letter No. Col / LA/ ADC / RSI / 15 / 354-357 dated 04-09-2015 has informed that some land owners have filed objections with the plea that they have received the land compensation for 20-30 feet width of road earlier acquired but the field staff has shown the width of earlier road as 50 feet ; and

Whereas an opportunity of being heard was given to all the objectors by the Collector , Land Acquisition ( ADC ) , Reasi , and it has been found that objections filed by them are devoid of merit and are liable to be maintainable ; and

Whereas , the report furnished by Collector , Land Acquisition ( ADC ) .

Reasi vide letter referred to above , duly endorsed by Deputy Commissioner . Reasi vide No. DC/ RSI/ 15-16/ 1691-92/ SQ dated 08-09-2015 , Divisional Commissioner, Jammu vide No. 502 / 2490/widening/ Rsi - Arnas - Road/Gran/ 15/1888-90 dated 19-10-2015 and Financial Commissioner ( Revenue ) , J & K vide his No. FC- LS / LA - 4421 / 2015 dated 11-04-2016 , concludes that the objections filed by the land owners are not maintainable and are liable to be rejected ; and

Whereas , the Government is satisfied on the basis of the report as * aforesaid that the land particulars whereof are mentioned in Annexure " A " to this notification , is required for public purpose viz. for widening of Reasi- Arnas Road by GREF .

Now, therefore , in pursuance of Section 6 of the J & K State Land Acquisition Act , Samvat , 1990 , It is declared that the 34 Kanals - 01 Marla and 01½ Sirsai situated in Village " Gran " , Tehsil and District Reasi , details whereof are indicated in Annexure " A " to this notification is required for public purposes i.e. for widening of Reasi - Arnas Road by GREF. Further , the Collector . Land Acquisition ( ADC ) , Reasi is directed under section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the interested person ( s ) as required under the Land Acquisition Act/Rules .

However , the Collector , concerned shall be personally responsible for proper title verification of all types of land involved in the case and No. 52 ] The J & K Govt . Gazette , 30th March , 2017/ 9th Chai . , 1939. 641 apportionment of compensation in respect of all the interested persons / rightful claimants in accordance with the relevant laws/ rules in force , while making final award in the case .

Subject :-Partial modification of under section 144 Cr . P. C. for prohibition of sale of meat and liquor .

Whereas , it has been made to appear to me that sale of meat and liquor had been prohibited in Katra town and Bhawan Vaishno Devi by virture of " Prohibition of Sale of Meat and Liquor " vide Notification 714 The J & K Govt . Gazette , 30th March , 2017 /9th Chai . , 1939. [ No. 52

No. 19 issued by the then Prime Minister under endorsement No. G. B. 211 dated 21st January, 1933 during pilgrimage period i . e . approximately October to December to upkeep the sanctity and sacredness of the Holy Shrine and its adjoining area ;

Whereas , it has further been made to appear to me that now yatra to the Holy Cave had increased manifold and thousands of devotees from all over the country and abroad are visiting the Holy Shrine , every day, throughout the year . Thus , the requirement of prohibition of sale / possession/ consumption of liquor and non - vegetarian food such as Eggs , Chicken , Meat , Mutton , Sea Food , Fish , Prawns , Lobster etc. has become expedient to be extended in time of uphold the religious sentiments of yatris and holiness of the pilgrimage and also to be extended in area to areas adjoining Katra town as whole of the area is used for yatra ;

Whereas , as per directions of Hon'ble High Court in OWP No. 03-03-2014 CMA No. 389/2014 , Tehsildar, Reasi was asked to seek opinion of public of these villages on this issue and send report along with his recommendations , Tehsildar, Reasi had submitted his report along with recommendations .

Now, therefore , taking into consideration the opinion of public ofthese villages and in supersession of all earlier orders , I , Neelam Khajuria , KAS , Sub- Divisional Magistrate , Katra by virtue of powers vested in me under section 144 Cr . P. C. do hereby prohibit sale / possession / consumption of liquor and non - y : getarian food such as Eggs , Chicken , Meat , Mutton , Sea Food , Fish , Prawn , Lobster eic . in the following area of Katra :-

1. Track of Holy Cave to Katra and villages on both sides of track having distance up to 2 Kms . from track .

2. Katra Town , Village Arli , Hansali , Matyal up to Railway Station .

3. Tikri road including Villages Chamba , Serli and Bhagta .

4. Jammu road including Village Kundrorian , Kotli Bajallian , Nomain and up to Maghal .

5. Katra- Reasi road : 100 Meters on the both side of road from Katra to Nau Devian and Aghar Jitto and Nau Devian Markets .

Whereas , vide Notification No. 10 - BOPEE of 2017 dated 3-3-2017 , issued vide endorsement No. BOPEE / Exam / 14/ 2017 dated 3-3-2017 , inter alia a list of candidates considered provisionally eligible under difficult area service / rural area service was notified as Annexure " A " and the list of candidates not considered as of now due to deficiencies / clarifications etc. was given in Annexure " B " to this notification for information and for submission of the documents/ clarifications / representations , as decided by theEligibility Committee in its meeting held on 02-03-2017 and 03-03-2017 and the candidates were asked to submit relevant documents/ representations , if any, up to 7th March , 2017 which date was subsequently extended up to 8th March , 2017 at 4.00 P. M. vide Public Notice No. 07 /BOPEE of 2017 dated 07-03-2017 ;

complained on phone also that many candidates do not qualify for being considered under Rural Service , as they have served within municipal limit and not 20 Km. away from such limits , a requirement under SRO - 294 of2005 ; and

Whereas , documents received within the prescribed period were examined and considered and it has accordingly been decided to issue an updated list of candidates eligible for consideration under Rural Service in terms of SRO - 294 of 2005 dated 21-10-2005 and difficult Area Service under SRO - 401 of 2009 and withhold decisions in respect of some who in whose cases certificates are under scrutiny and a decision in such cases had be taken separately.

Now, therefore ,-

1. A revised list of candidates eligible for consideration of marks under SRO - 401 of 2009 those eligible for consideration under SRO - 294 of 2005 under Rural Service category and those in whose cases decision is withheld for the above reason is hereby notified as Annexure " A " to this notification (Position in remarks ) ;

2. The certificates , which have not been issued by the competent authority viz . the concerned Director ( Health , Kashmir / Jammu ) have not been considered ;

3. The cut of date for determination of eligibility for consideration is 31-10-2016 i . e . the last date for submission of Online application forms for NEET- 2017 as notified earlier ;

4. The certificate issuing authority shall and shall be solely responsible in case any service particular/bio data/ other contents of the certificate are found to be false or fake or if the candidate is not eligible for consideration under SRO - 401 of 2009 / SRO - 294 of 2005 as the certificate issued by the 717 No. 52] The J & K Govt : Gazette, 30th March , 2017/ 9th Chai . , 1939.

competent authorities must have been issued considering the requirements under the relevant SRO's with regard to identification of the area/ the distance from the municipal limit etc. as the case may be , along with the period indicated against the candidates names to have served in such areas ;

5. As a consequence of the above , the changes as may become necessary in the PSML shall be notified separately for purposes of updation of the PSML ;

6. The candidates against whose names remarks have been , recorded are , in their own interest , advised to have these settled by providing necessary documents /evidence latest by 18th of March , 2017 failing which , their consideration under Rural Service/Difficult Area Service will be liable to be changed and may be considered under Open Merit/ Major Category as the case may be ; and

7. This issues without prejudice to the outcome of the writ petition pending, if any, before any competent Court of Law .

All the eligible applicants of B.Ed. ( IASE ) -Kashmir & B.Ed. Special Education ( CRC ) Entrance Test- 2017 are hereby informed that the Online AdmitCards will be available for download from 15th of March , 2017 . Candidates should take note of the following information and strictly follow instructions given hereunder :-

Candidate Identification / Photo ID Proof :

The candidates are required to affix recent passport size photograph on Electronic Admit Card downloaded by them from the official website of the BOPEE and they should carry with them any one of the below mentioned Photo ID Proofs in original positively for their Identification :

Photo Election ID Card / Aadhar Card , PAN Card , Driving License , ID issued by concerned College/ Employer , Passport .

The Centre Supervisor shall also check the identity of the candidates and ensure that only the genuine candidates have been allowed to sit in the examination hall and there is no case of impersonation.

11.30 A. M. They will break open the seal of the Question Booklet and start attempting the questions .

02.00 Ρ. Μ . The candidates will remain in their seats . They will hand over the OMR Answer Sheets to the Invigilator, take the Question Booklet and OMR candidate's copy along with them and leave the examination hall only when they are asked to leave .

Note : After distribution of Answer Sheets , no candidate shall be allowed to go out of the Examination Hall under any circumstances .

Important Guidelines :

The candidates should leave early from their place of residence so as to keep sufficient margin for traffic jam and other unavoidable circumstances . No. candidate will be allowed to enter the Examination Hall after the prescribed time given above .

Tab , Smart Phone , Mobile Phone , Pager , Bluetooth Device and Camera , Calculator or any other communication/electronic vice/ Tablet is not allowed inside the premises of the examination his / here.adidature will be cancelled including ban for future examination/selection . The Board shall not be responsible for any loss /theft of such electronic devices . The candidates are advised to keep their electronic gadgets at their residence .

The present category status of the candidates shown on Admit Card or on any other document of the BOPEE is purely provisional and subject to subsequent verification by the Board and other competent bodies .

cancelled and departmental action / criminal prosecution , wherever applicable , will be recommended/ initiated.

Mere appearing in the Entrance Test cannot be in any way read as a pronouncement by the Board upon the eligibility of a candidate or acceptance of submitted information which shall be determined subsequently.

The candidates are advised to go through the instructions given in the Electronic Brochure more particularly read instructions for filling of the OMR sheet very carefully.

The candidates should check their Question Booklets before attempting any question and should ensure that the Booklet contains 160 questions . In case of any missing question / page /blank page or damaged/defaced Question Booklet , it shall be the sole responsibility of the candidate concerned to report it to the Invigilator and get it replaced by the same series , failing which no complaint can be entertained afterwards .

The candidates are informed that the keys of the question papers will be uploaded on the BOPEE's website on 26th March at around 7 P. M. and they can make representation ( s ) , if any, on the prescribed format available on the official website of the BOPEE , against any question within three days ( i . e . 27 28th & 29th of March , 2017 ) up to 4 P. M. with a documentary proof based on Standard Text Books only , no other proof will be accepted . The candidates interested in making representation shall have to pay a fee of rupees 1000/- which can be paid by Debit Card/ Credit Card/ ATM Card through POS Machines available at the BOPEE Office, Jammu /Srinagar . No representation shall be received/entertained after the prescribed date and time in any case . These representations , in a consolidated form , will be given due consideration by the experts whose decision will be final . On the basis of the decision of these experts , a revised key, if required , will be uploaded again on the Board'sWebsite as and when available . No representation will be entertained on the revised key.

The following Ordinance as promulgated by the Governor on 16th February , 2017 and is hereby published for general information : -

THE JAMMU AND KASHMIR PANCHAYATI RAJ (AMENDMENT ) ORDINANCE , 2017

(Ordinance No. 1 of 2017 )

[ 16th February , 2017. ] Promulgated by the Governor in the Sixty - eighth Year of the Republic of India .

Whereas , the Jammu and Kashmir Panchayati Raj ( Amendment ) Ordinance , 2016 ( Ordinance No. II of 2016 ) was promulgated by the Governor on 12th December , 2016 ;

And whereas , the Bill to replace the said Ordinance could not be introduced in the State Legislature ;

And whereas , after passing of The Jammu and Kashmir Panchayati Raj (Amendment ) Act , 2016 (Act No. XIII of 2016) , certain consequential amendments are required to be made in the Jammu and Kashmir Panchayati Raj Act , 1989 ;

And whereas , the State Legislature is not in session and the Governor is satisfied that circumstances exist which render it necessary for him to take immediate action .

Now , therefore, in exercise of the powers conferred by section 91 of the Constitution of Jammu and Kashmir , the Governor is pleased to promulgate the following Ordinance :-

1. Short title and commencement .- ( 1 ) This Act may be called the Jammu and Kashmir Panchayati Raj (Amendment ) Ordinance, 2017.

(2) It shall come into force with effect from 13th of February , 2017 .

2. Amendment of section 4, Act No. IX of 1989. In section 4 of the Jammu and Kashmir Panchayati Raj Act , 1989 (hereinafter referred to as the ' principal Act ' ) , in sub- section (3 ) , in first proviso thereto , the words , " to be filled by the direct elections " shall be omitted .

3. Amendment of section 36, Act No. IX of 1989 .-- In section 36 of ' the principal Act ' , in sub- section ( 1 ) , the 3 No. 46-2 ] The J&K Govt . Gazette, 16th Feb. , 2017/27th Magha , 1938 . second proviso thereto shall be substituted by the following , namely :-

"Provided further that for purposes of holding general elections under this Act in the year 2017 , the superintendence , direction and control of the preparation of electoral rolls and conduct of, all elections in accordance with this Act shall vest in the Chief Electoral Officer . "

4. Amendment of section 36-D, Act No. IX of 1989.- In section 36 -D of the ' principal Act ' , in sub- section (2) , after clause ( cc) the following proviso shall be inserted , namely :

" Provided that for the purposes of holding general elections under this Act in the year 2017 , the power to determine and delimit halqa panchayats in accordance with this Act shall vest in the Chief Electoral Officer . "

5. Repeal and saving .--( 1 ) The Jammu and Kashmir Panchayati Raj (Amendment ) Ordinance , 2016 (Ordinance No. II of 2016) is hereby repealed.

(2) Notwithstanding any such repeal , anything done or any action taken or any order issued under the aforesaid Ordinance , shall be deemed to have been done , taken or issued under the corresponding provisions of this Ordinance .

Online applications duly affixed with latest coloured photograph , thumb impression and signature are invited from permanent residents of J & K State who are eligible and desirous of appearing in the Common Entrance 2

Test for admission to Bachelor of Engineering ( B. E. ) Courses for academic session , 2017. The selection of the candidates shall be governed by the J& K Board of Professional Entrance Examination Act . 2002 and the Rules and Regulations thereunder , JK . Reservation Act , 2004 and the rules thereunder and guidelines as contained in the Electronic Information Brochure , 2017. These Rules , Regulations and e - Brochure are available on the official websites of the BOPEE www.jakbopee.org/www.jakbopee.net .

Important Information :

1. Online applications for Common Entrance Test ( CET ) for (Β . Ε . ) , 2017.

2. Receipt of online application forms w. e. f. 27-02-2017.

Online Application Forms :

Application forms have to be submitted Online only through BOPEE websites www.jakbopee.org/www.jakbopee.net ( through URL's / Links provided for this purpose ) from 27th February to 27th March , 2017. The payment of Rs . 800 ( Rupees eight hundred only ) as fee is to be made also online through the Integrated Payment Gateway which can be used to make payment with any National Credit Card /Debit Card /Net Banking . The procedure for filling Application Form and eligibility etc. of the candidates has been given in detail in the e - Brochure . The applicants must necessarily, in their own interest , go through this e - Brochure before attempting to fill up the online Application Form .

The applicants are advised to fill the Online Application Forms on their own or through a responsible person . The applicants can also avail of services at Common Service Centres of J & K State for filling up Online Application Forms at nominal charge . They can also avail of the services at any National Informatics Centre located at the Office of the Deputy Commissioner of the concerned district .

Submission of Online Application Forms :

The interested candidates have to produce the following self- attested certificates along with original at the time of Counselling or before submission of Online Preference Form as the case maybe . However, no Reserved Category Certificate/State Subject ( PRC issued by the competent authority after the cut- off date i . e . 27-03-2017 ) shall be entertained in any circumstances . The candidates have to upload their Photograph , Signature and Thumb impression on the Application Form positively :--

( i) Permanent Resident Certificate ;

( ii ) Qualifying Marks Certificate ( where result is declared ) ;

( iii) Date of Birth Certificate ;

( iv) Reserved Category Certificate , if any ( including Sports Certificate ) on the prescribed proforma (duly renewed wherever applicable ) ; and

( v ) The candidates can change / modify their Online Application Form at any time before it is submitted online . They are advised , in their own interest , not to share their login details with any other person , lest he / she may get an opportunity to change important details in the Application Form. They can check the status of their Application Form on the official website of the BOPEE . If any form is not confirmed for want of required information , the candidate concerned must report [No. 46-5 4 The J & K Govt . Gazette , 21st Feb. , 2017 / 2nd Phal . , 1938.

in the BOPEE Office , Srinagar or Jammu by or before 3rd April , 2017 failing which his / her Application Form shall be rejected :

(vi ) Note :

(a) The candidates must , after filling up all the required entries , submit their Application Form by pressing " Subinit Application Form " button in the Preview of Provisional Confirmation Page : otherwise their form will not be registered in the database and will not be considered . Mere downloading of the Application Form / Confirmation Page does not mean that the candidate has submitted his / her Application Form . Please ensure to click " Submit Application Form " button after viewing your Provisional Confirmation Page ;

(b ) The candidates cannot change/modify their Online Application Form after pressing " Submit Application Form " button for final registration in the database , as any change shall not be accepted by the system ;

Eligibility

1. The Applicant must-

( a) be a permanent resident of J & K State as defined in section 6 of the Constitution of the J & K ;

(b) have passed Higher Secondary Part - II Examination (10+2 class ) or equivalent examination from a recognised statutory board . The candidates appearing /appeared in 12th class examination can also apply for the Entrance Test:

(c ) have obtained 50 % marks in 12th class in case of open merit and 40 % marks in case of reserved category ; and

2. The candidates appearing / appeared in the 12th class examination are also eligible to appear in the Common Entrance 5 The J& K Govt . Gazette , 21st Feb. , 2017 / 2nd Phal . , 1938 .

Test but they must have passed Physics , Chemistry and Mathematics subjects in 12th class examination at the time of counselling and secured percentage of marks as required in (c) above .

Instructions :

( a) No under process certificate will be accepted :

( b) The information provided by the candidates in the Online Application Form cannot be verified from the original documents by the BOPEE officials before the counselling in person or counselling through filling up of online Preference Form for admission of the candidates . The information on the Confirmation Page or on the Admit Card of candidate shall in no case be construed as an acceptance of such information / category certificate by the BOPEE . Therefore , if at any stage , it is found that a candidate has provided false or incorrect information in respect of any eligibility condition , his / her candidature will be cancelled without any further notice ;

( c) The sports category candidates have to indicate their sports category on the Application Form . They are also required to submit their sports certificate ( s ) in the Office of the Secretary, J & K State Sports Council , Jammu / Srinagar for determining their sports points which will be afterwards officially forwarded by the Council to the BOPEE . The BOPEE , however , shall not be responsible for non - inclusion of any candidate in the list forwarded by the Sports Council or for their delay in submission of sports points to the BOPEE ;

( d) The candidates having more than one reserved category certificate can get benefit of only one category indicated in the Application Form which in no case shall be changed afterwards . The candidate , whose category certificate has not been found valid , will be considered in open merit , if found otherwise eligible without any further notice . In case validity of the Category Certificate has expired after the last date for filling up the online form , the candidates are in their own interest are advised to have the same renewed before the date of counselling .

Note :

( a ) The information provided by the candidates in the Online Application Form cannot be verified from the original documents by the BOPEE before issuance of merit list . The candidates will have to produce certificates in original in the BOPEE Office . Srinagar or Jammu on the day of counselling . The BOPEE will , thereafter, issue select list for admission of the candidates . The information on the Confirmation Page or on the Admit Card of the candidate shall in no case be construed as an acceptance of that information / category certificate by the BOPEE . Therefore , if at any stage , it is found that a candidate has provided false or incorrect information in respect of any eligibility condition , his / her candidature will be cancelled without any fürther notice :

( b ) The candidates are hereby warned not to resort to any unfair/ fraudulent means or act of impersonation at the time of Entrance Test . In case a candidate is found taking recourse to such acts , criminal prosecution shall be launched against hin /her and his / her abettors . He/ she shall be permanently debarred from appearing in any future in the Entrance Test .

Roll No. Slip/Admit Card :

The notification for downloading of Online / Electronic Adınit Card will be issued separately . The candidates , who fail to download their Admit Card , must report in the Office of the BOPEE , Srinagar / Jammu immediately . The Electronic Admit Card will indicate time , venue and schedule of the Entrance Test . The Electronic Admit Card shall have the space for photograph of the candidate . The candidate Las to affix his /her photograph which should then be attested by a Gazetted Officer .

A candidate will in no case be allowed to appear in the Entrance Test without attested photograph on the Admit Card . The candidates are advised to remain in touch with the official website of BOPEE for updates for Centre notification and for other important information relating to Common Entrance Test , 2017 .

Venue for Conduct of Examination :

The Examination shall be conducted at Jammu / Srinagar simultaneously.

Issuance of Admit Cards and Date of Test :

Information with regard to availability of Online Admit Cards , Venue and Time of the Common Entrance Test will be issued separately in due course of time . The Entrance Test will be held on 28th May (Sunday) , 2017 .

Note :-1 . The online submitted form is purely provisional and is liable to be cancelled at any stage subject to the final verification of the documents and even at any stage where such a document is proved to be fake/ false.

Note :-2. Impersonation by any candidate by uploading any other object . etc. other than his /her photograph shall lead him /her to disqualification , besides liable to be prosecuted under law.

Note :-3 . There will be a single paper comprising of 180 questions in Physics , Chemistry and Mathematics (each subject will be of 60 Marks/Questions ) with 0.25 negative marking for each wrong question . The time duration will be 3 hours .

distribution , sale and use of polythene carry bags , plastic sheets or like , cover made of plastic sheet, plastic packaging and multilayered packaging less than fifty microns in thickness within the territorial limits of the State of Jammu and Kashmir :

"Provided that this notification shall not be applicable to the Healthcare Establishment to the extent of the use of polythene carry bags for handling and disposal of bio medical waste as per Bio -Medical Waste ( Management and Handling ) Rules . "

This notification shall come into force after thirty days from the date of publication in the Government Gazette .

have intimated the J & K BOPEE that it has been decided to merge Ayush Courses in National Eligibility National Test (NEET- 2017) ;

Whereas , the J& K BOPEE vide its Notification No. 2 - BOPEE of 2017 dated 14-02-2017 has decided accordingly not to conduct any separate test for BUMS /BAMS /BPT including Composite Regional Centre , CRCAM Courses i . e . BPT, DPO , DRT and DHLS ; and

Whereas , a consequence of the above , there shall be no Biology Paperfor CET- 2017 to be conducted by the Board for 2017 .

Now, therefore, there shall be a single paper for CET- 2017 for engineering courses only with three sections comprising of Physics , Chemistry and Mathematics as under:-

(2) It shall come into force from the date of its publication in the Government Gazette .

2. Omission of Section 16 - D , Act XX of 1962.-In the Jammu and Kashmir General Sales Tax Act , 1962 ( hereinafter referred to as ' principal Act ' ) , Section 16- D shall be omitted .

3. Amendment of Section 17, Act XX of 1962.In Section 17 of the principal Act , in sub- section ( 1 ) , clause ( i ) appearing after clause (h ) and clause ( viii ) shall be omitted .

Gazette , 9th Feb. , 2017/ 20th Magha , 1938. [ No. 45 - a Khasra No. 302 " as Protected Monument within the meaning of the said Act.

Any person having objection to the issuance of this notification shall file his objections before Secretary to the Government , Department of Culture , within a period of one month from the date of publication of this notification in the newspaper or fixation of this notification at a conspicuous place on the Monument .

File is preponed for today at the request of the parties on the motion of an application for early hearing.

2. Both the parties to the petition have compromised and settled the dispute at Rs . 2,00,000/- ( Two lac only ) towards the satisfaction of all the claims arising out of the employment of No. 45-1 ] The J & K Govt . Gazette , 15th Feb. , 2017 /26th Magha , 1938. 3

the petitioner with the respondents . Both the parties have filed a memorandum of agreement arrived between them , duly signed by them . Statement of the petitioners was recorded separately . The petitoners have been identified by his Ld . Counsel Ajay Kumar respondent has made the payment in terms of agreement arrived between them , in cash to the petitioners .

3. After this settlement workmen / petitioners have left with no of their claims /dues towards the management .

4. Consequence to the compromise arrived between the parties , respondent has paid the agreed amount of Rs . 2,00,000 /- ( Two lac only) in cash to the petitioners accordingly who have received the same outside the court from the management of M/ s . Meera & Co. , Lane - 1 , Industrial Area , Bari Brahmana , Jammu .

5. After this settlement petitioners have left with no cause of action against the management .

6. Since the settlement amount has been received by the workmen and their claim stands disposed off accordingly .

7. In view of the settlement executed between the parties , this court hereby passes this award in terms of the memorandum settlement and holds that no other relief is requested to be granted to the petitioners .

8. Copy of award be sent to the appropriate Government of J & K through its Commissioner / Secretary, Labour Department for information and its publication in the Government Gazette . File shall consign to records after its due completion .
