Whereas, on the basis of indent prepared by Executive Officer,
Municipal Committee, Doda, a notification under section 4 (1) was
issued by Collector, Land Acquisition (ACR), Doda vide No. 508-14/
Acq dated 19-08-2015, for land measuring 3-1/3 Marlas situated at
Village Doda, Tehsil and District Doda ; and
Whereas, the Collector, Land Acquisition (ACR), Doda vide
No. 508-14/Acq has reported that the notification issued under section No. 13] The J&K Govt. Gazette, 29th June, 2017/8th Asad., 1939. 293 –––––––––––––––––––––––––––––––––––––––––––––––––––––– 4 (1) of the J&K State Land Acquisition Act by him was served upon the interested persons for filing objections, if any, to the proposed acquisition, but, no objection was received from the land owners/ interested persons within the prescribed period as required under sections 5 & 5-A of the Land Acquisition Act ; and
Whereas, the report furnished by Collector, Land Acquisition (ACR), Doda, vide above referred letter duly endorsed by District Collector (DC), Doda, vide No. 355/LAC/D/16 dated 10-11-2016, has been examined and it has been found that some of the interested persons filed their objections to the acquisition, which have been considered and found not tenable as the land is required for public purposes.
Whereas, the Government is satisfied that the land particulars whereof are given above, is required for public purpose viz., construction of drain from College Road to H/o Abdul Qayoom R/o Nagri.
Now, therefore, in pursuance of section 6 of the J&K State Land Acquisition Act, Samvat 1990, it is declared that the land measuring 03-1/3 Marlas situated at Village Doda, Tehsil and District Doda, particulars whereof are given above, is required for public purposes viz. for construction of drain from College Road to H/o Abdul Qayoom R/o Nagri. Further, the Collector, Land Acquisition (ACR), Doda is directed under section 7 of the said Act to take orders for acquisition of the said land after giving prescribed notice to the interested person(s) as required under the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible for identification and proper title verification of all types of land involved in the case for making apportionment of compensation amongst all the interested persons/rightful claimants, in accordance with the relevant laws/rules in force, while making the award.

Whereas, on the basis of an indent placed by Project Director, NHAI vide PD/JMU/LA/Udhampur/2016-17 dated 08-04-2016 a notification under section 4(1) was issued by Collector, Land Acquisition (ADC), Udharnpur vide No. LA/ADC/285-93 dated 23-05-2016 for land measuring 88 Kanals and 18 Marlas, situated in Village Lota, Tehsil and District Udhampur.
Whereas, the Collector, Land Acquisition (ACD), Udhampur vide letter No. LA/ADC/471 dated 02-07-2016, has reported that the notification issued under section 4(1) of the J&K State Land Acquisition Act by him was served upon the interested persons for filing objections, if any, to the proposed acquisition but no objection was received from the land owners/interested persons in the prescribed time period as required under sections 5 & 5-A of the Land Acquisition Act ;
Whereas, the report furnished by the Collector, Land Acquisition (ADC),Udhampur vide number mentioned above and endorsed by the Financial Commissioner (Revenue), J&K vide No. FC-LS/LA-4481/2016 dated 25-10-2016, has been examined and it has been found that the land owners did not file any objection to the proposed acquisition ; and
Whereas, the Government is satisfied that the land particulars whereof are mentioned are given above to this notification, is required 296 The J&K Govt. Gazette, 29th June, 2017/8th Asad., 1939. Whereas, the land, specifications whereof are given at
"Annexure-A" to this notification, is required for public purpose viz.
"widening four lanning of National Highway" ;
Whereas, on the basis of an indent placed by Project Director,
NHAI vide PD/JMU/15011/1998 dated 03-10-2005, accordingly a
notification under section 4(1) was issued by Collector, Land Acquisition
(ADC), Ramban vide No. 509-14/ACQ/NH-AI dated 08-11-2016 for
land measuring 308 Kanals situated in Village Ramban, Tehsil and
District Ramban ;

Whereas, the Collector, Land Acquisition (ADC), Ramban
vide letter No. 509-14/ACQ/NH-AI dated 08-11-2016, has reported that
the notification issued under section 4(1) of the J&K State Land
Acquisition Act by him was served upon the interested persons for
filing objections, if any, to the proposed acquisition but no objection was
received from the land owners/interested persons in the prescribed time
period as required under sections 5&5-A of the Land Acquisition Act
;
Whereas, the Collector has further stated that the Hon'ble High
Court had restrained the Collector vide Order dated 03-05-2010 in OWP
No. 477/2010 read with CMP No. 644/2010 from issuing final award
on the acquisition proceedings initiated earlier ;
Whereas, it has also been stated that the earlier acquisition
proceedings have been quashed by the Hon'ble Court vide Order dated
06-10-2016, and it has been ordered that the date of notification under
section 4(1) of the LA Act shall be treated as the date of order passed
by the Hon'ble High Court ;
Whereas, the report furnished by the Collector, Land Acquisition
(ADC), Ramban vide No. 509-14/ACQ/NH-AI dated 08-11-2016 and
endorsed by the Divisional Commissioner, Jammu vide No. 502/2739/
Acq/NHAI/ Rbn/2016/2256-58 dated 21-11-2016, has been examined
and it has been found that the order of the Hon'ble High Court is
applicable to the petitioners, it would not be appropriate to apply the
judgment to some of the land owners as it would embolden the non-
petitioners also to take recourse to litigation, which may further delay
the acquisition process. It has, therefore, been decided to initiate the
fresh proceedings in respect of the entire land irrespective of the
applicability of the judgment or the HHC to the petitioners only, with
a view to obviate the possibility, or further litigation ; and
Whereas, the Government is satisfied that the land particulars
whereof mentioned are given at "Annexure-A" to this notification, is
required for public purpose viz. widening four lanning of National
Highway.

on the subject matter and in pursuance of section 6 of the J&K State
Land Acquisition Act, Samvat, 1990, it is declared that land measuring

Whereas, on the basis of an indent placed by Project Director,
NHAI vide PD/JMU/15011/1998 dated 03-10-2005, accordingly, a
notification under section 4(1) was issued by Collector, Land Acquisition

land measuring 184 Kanals 19 Marlas situated in Village "Chanderkote",
Tehsil and District Ramban.
Whereas the Divisional Commissioner, Jammu vide letter
No. 52/2743/Acq/NH-AI/Chanderkote/Rbn/l6/2259-61 dated 21-11-2016,
has reported that the proceedings under taken earlier by the Collector,
Land Acquisition, Ramban had been challenged before the Hon'ble High
Court which had restrained the Collector from issuance of final award.
It has further been reported that the Hon'ble High Court while quashing
the acquisition proceedings has directed vide its order dated 06-10-2016
to initiate fresh proceedings treating the date of its order dated
06-10-2016, as the date of issuances of notification under section
4(1) of the Land Acquisition Act.
Whereas, in view of the earlier acquisition proceedings having been
quashed, it has been decided to initiate denovo proceedings for entire
land under acquisition, notwithstanding the proceedings having been
quashed to the extant of the petitioners only with a view to obviating
the possibility of fresh litigation as the non-petitioners may also get
emboldened to resort to the litigation process in case part of the law
is subjected to fresh assessment or rates.
Whereas, the Government is satisfied that the land particulars
whereof mentioned are given at "Annexure-A" to this notification, is
required for public purpose viz. "for four lanning of National Highway
by NHAI".
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat, 1990 and in supersession of the declaration
issued earlier, it is declared that land measuring 128 Kanals 09 Marlas
situated in Village "Chanderkote", Tehsil and District Ramban,
particulars whereof are given at "Annexure-A" to this notification is
required for public purpose viz. "for four lanning of National Highway
(NHAI)". Further, the Collector, Land Acquisition (ADC), Ramban is

Whereas the Collector, Land Acquisition (SDM), Gool, vide letter
No. SDM/G/Rly/68-73 dated 30-07-2016 has reported that the
notification issued under section 4(1) of the J&K State Land Acquisition
Act by him was served upon the interested persons for filing objections, 322 The J&K Govt. Gazette, 29th June, 2017/8th Asad., 1939. [No. 13 ––––––––––––––––––––––––––––––––––––––––––––––––––––––
if any, to the proposed acquisition but no objection as received from
the land owners/interested persons in the prescribed time period as
required under sections 5 & 5-A of the Land Acquisition Act ;
Whereas, the report furnished by the Collector, Land Acquisition
(SDM), Gool vide above mentioned duly endorsed by Deputy
Commissioner, Ramban, vide his No. DC/LA/Rbn/16/28-30 dated
04-11-2016, has been examined and it has been found that the land
owners did not file any objection to the proposed acquisition ; and
Whereas, the Government is satisfied that the land particulars
whereof are mentioned above is required for public purpose viz.
"Construction of Protection Work Station Yard, Sangaldan".
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat, 1990, it is declared that land measuring
15 Kanals and 02 Marlas situated in Village "Movelkote", Tehsil Gool,
District Rarnban, particulars whereof are given above is required for
public purpose viz. "Construction of Protection Work Station Yard,
Sangaldan". Further, the Collector, Land Acquisition (SDM), Gool is
directed under section 7 of the said Act to take order for acquisition
of the said land after giving prescribed notice to the interested person(s)
as required under the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible
for identification and proper title verification of types of land involved
in the case and apportionment of compensation amongst all the interested
persons/rightful claimants in accordance with the relevant laws/rules in
force, while making the award.

Whereas, the land specifications whereof are given at
"Annexure-A" to this notification is required for public purpose viz. for
construction of Bhagwah-Bijarni-Lal Draman road by GREF ;
Whereas, on the basis of an indent placed by Officer Commanding,
52 RCC(GREF) C/O 56, APO vide No. 2096/LA/LDDD/84/E2 dated
06-05-2016 a notification under section 4(1) was issued by Collector,
Land Acquisition (ACR), Doda vide No. 124-30/Acq dated 11-05-2016
for land measuring 151 Kanals and 17½ Marlas, situated in Village
"Koti", Tehsil and District Doda ;
Whereas, the Collector, Land Acquisition (ACR), Doda vide letter
No. 517-22/Acq dated 06-08-2016, has reported that the notification
issued under section 4(1) of the J&K State Land Acquisition Act by
him was served upon the interested persons for filing objections, if any,
to the proposed acquisition but some objections were received from
the land owners/interested persons within the prescribed time period
as required under sections 5 & 5-A of the Land Acquisition Act. The
Collector, Land Acquisition, Doda has stated that non-fruit bearing trees
of some of the land owners had not been shown in the original
notification and accordingly, a corrigendum to the same was issued by
him vide No. 408-14/Acq dated 15-07-2016, in which the
details of non-fruit bearing trees in the respective Khasra Nos. stand
indicated ;
Whereas, the report furnished by Collector, Land Acquisition
(ACR) vide letter referred to above duly endorsed by the Deputy
Commissioner, Doda vide No. 295/LAC/D/16 dated 11-08-2016 and FC,
Revenue vide No. FC-LS/LA-4492/2016 dated 17-11-2016 has been

corrective action by the concerned Collector ;

(ACR), Doda is directed under section 7 of the said Act to take order

Whereas, section 22 (1) of Jammu and Kashmir Right to

SRO-106.––In exercise of the powers conferred by
sections 6, 41, 50, 64, 83 and 12 of the Factories Act, 1948,

the following amendments in Jammu and Kashmir Factories
Rules, 1972 ; namely :––
1. In rule 5 after sub-rule (2), the following shall be added as
sub-rule (3) ; namely :––
"(3) Licence shall be granted within a period of 30 days".
2. In rule 7 after sub-rule (3), the following shall be added as
sub-rule (4) ; namely :––
"4 Licence shall be renewed within a period of 30 days".
Now, in pursuance of sub-section (1) of section 115, any person
who desires to object to the aforesaid amendments may submit his/her
objections/suggestions for consideration in writing to the, Commissioner/
Secretary to Government, Labour and Employment Department, Civil
Secretariat within a period of 45 days from the date of issuance of this
notification.
Any objection/suggestion received after the expiry of the said period
will not be entertained.

SRO-217.––In exercise of the powers conferred by proviso to
section 124 of the Constitution of Jammu and Kashmir, the Governor is
pleased to direct that the following amendments shall be made in Jammu
and Kashmir Civil Service Regulations, 1956, namely :––
(I) In Article 230, clause (i) shall be substituted by the
following :––
"A Government servant including the one listed in Schedule-II

after completing 20 years/40 completed six monthly periods
of qualifying service or 45 years of age ; provided that he/she

(II) Sub-clause (ii) of Article 230 shall be deleted.
(III) In Article 240-A (VI) for the words and figures "twenty eight"
and "28 years", wherever occurring, the words and figures
"twenty (20) years" shall be substituted.

SRO-225.––In exercise of the powers conferred by section 78 of the
Disaster Management Act, 2005 (Act No. 53 of 2005), the Government of

namely :––
1. Sub-rule (1) of rule 3 shall be substituted by the
following :––
"(1) The State Disaster Management Authority, with such
powers and functions as defined under section 18 of the Act,
shall comprise,––
(i) Chief Minister Chairperson
(ii) Minister for Disaster Vice-Chairperson

2. Rule 4 shall be substituted by the following, namely :–
"4. The Department of Disaster Management, Relief,
Rehabilitation and Reconstruction shall be the Administrative
Department of State Disaster Management Authority".

4. After rule 6, rule 6-A shall be added, namely :––
"6-A. Divisional Disaster Management Authority.––
(1) Each division of the State shall have a Divisional Disaster
Management Authority, which shall consist of,––

(2) The Divisional Commissioners may co-opt any other
officer, as may be deemed necessary.
(3) The Divisional Disaster Management Authority shall play
a vital role in coordinating with State Authority, State Executive
Committee and District Disaster Management Authorities,
various Government Department, local bodies and other
stakeholders at the Divisional level.
(4) The Divisional Authority shall meet as and when necessary
and at such time and place as may be decided by the
Chairperson. The Divisional Authority shall in normal
circumstances meet at least once in six months.
(5) The Divisional Authority shall ensure preparation and
Operationalisation of Disaster Management Plans for the No. 8-e] The J&K Govt. Gazette, 29th May, 2017/8th Jyai., 1939. 6 –––––––—––––––––––––––––––––––––––––––––––––––––––––––——— Division and also for all the districts, as well as ensure regular
mock drills and updation of Disaster Management Plans.
(6) The Divisional Authority shall identify and strengthen
Lifeline Infrastructure and conduct safety audit of all important
buildings.
(7) The Divisional Authority shall develop multipurpose disaster
resilient community shelters and stockpile emergency rescue
equipments and ensure its equi-distribution.
(8) The Divisional Authority shall coordinate search and rescue
operations, with all stakeholders including Air Force, Army,
SDRF, NDRF, Police, Fire and Emergency Services and
Paramilitary Forces.
(9) The Divisional Authority shall establish Relief Centers
during disasters and facilitate rehabilitation and recovery
process.
(10) The Divisional Authority shall establish and operationalise
Divisional Emergency Operation Centre and maintain close
coordination with State EOCs and District EOCs".
5. Rule 7 shall be substituted by the following, namely :–
"(1) Every District of the State shall have a District Disaster
Management Authority which shall consist of,––
(i) Deputy Commissioner Chairperson
(ii) Addl. Dy. Commissioner Member/CEO
(iii) District Superintendent of Police Member
(vi) Chief Medical Officer Member
(v) Superintending Engineers, R&B, Members

No. 480/2017-BE.––Whereas, the term of office of Mohd. Hamid
Ansari, Vice-President of India, is up to 10th day of August, 2017, in terms
of Article 67 of the Constitution ; and 2 The J&K Govt. Gazette, 4th July, 2017/13th Asad., 1939. [No. 13-4 –––––––––––––––––––––––––––––––––––––––––––––––––––––– Whereas, an election is due to be held, in terms of clause (1) of
Article 68 of the Constitution, to fill the vacancy to be caused by the expiration
of the term of office of the incumbent Vice-President before the expiration
of term of his office ; and
Whereas, under sub-section (3) of section 4 of the Presidential and
Vice-Presidential Elections Act, 1952 (31 of 1952), the Election Commission
of India is required to so appoint the dates for the election to fill the office
of the Vice-President of India that the election will be completed at such
time as will enable the Vice-President thereby elected to enter upon his
office on the 11th day of August, 2017.
Now, therefore, the Election Commission of India hereby––
(A) calls upon the Electoral College, referred to in Article 66 of
the Constitution, to elect a person to fill the above vacancy in
the office of Vice-President of India before the expiration of
the term of the incumbent Vice-President, in accordance
with the provisions of the Constitution, the Presidential and
Vice-Presidential Elections Act, 1952 (31 of 1952), and the
Rules and Orders made thereunder ; and
(B) in pursuance of sub-section (1) of section 4 of the said Act,
appoints––
(a) the 18th July, 2017 (Tuesday), as the last date for making
nominations ;
(b) the 19th July, 2017 (Wednesday), as the date for scrutiny
of the nominations ;
(c) the 21st July, 2017 (Friday), as the last date for the
withdrawal of candidatures ; and
