Whereas, on the basis of indent placed by Executive Engineer,
PMGSY Division, Udhampur vide No. PMGSY/Div./Udhampur-II/R/
1484-89 dated 10-12-2013 a notification under section 4 (1) was issued by
Collector, Land Acquisition (ACR), Udhampur, vide No. ACARU/SQ/3253-
61 dated 03-12-2015 for land measuring 16 Kanals 07 Marlas situated in
Village Purani Bhutti, Tehsil Panchari, District Udhampur ;
Whereas, the Collector, Land Acquisition (ACR), Udhampur vide
No. UACR/SQ/2016-17/2028 dated 10-09-2016 has reported that the
notification issued under section 4 (1) of the J&K State Land Acquisition
Act by him was served upon the interested persons for filing objections,
if any, to the proposed acquisition but no objection was received from the
land owners/interested persons in the prescribed time period as required
under sections 5&5-A of the Land Acquisition Act ;

Whereas, the report furnished by Collector, Land Acquisition (ACR),
Udhampur vide referred above duly endorsed by Deputy Commissioner,
Udhampur vide No. DCU/SQ/2056-58 dated 16-09-2016 has been examined
and it has been found that the land owners did not file any objection to the
proposed acquisition ; and
Whereas, the Government is satisfied that the land particulars
whereof are mentioned in "Annexure–A" to this notification is required
for public purpose viz. for construction of road from Malti to Galiote
Phase-VI in Village Purani Bhutti, Tehsil Panchari, District Udhampur,
under PMGSY.
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat 1990, it is declared that the land measuring
16 Kanals 07 Marlas situated in Village Purani Bhutti, Tehsil Panchari,
District Udhampur particulars whereof are given in "Annexure–A" to this
notification is required for public purpose viz. for construction of road
from Malti to Galiote Phase-VI in Village Purani Bhutti, Tehsil Panchari,
District Udhampur under PMGSY. Further, the Collector, Land Acquisition
(ACR), Udhampur is directed under section 7 of the said Act to take order
for acquisition of the said land after giving prescribed notice to the interested
person(s) as required under the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible for identification and proper title verification of all types of land involved in the
case and apportionment of compensation amongst all the interested persons/rightful claimants in accordance with the relevant laws/rules in
force, while making the award.

Whereas, the land specification whereof are given at "Annexure-A" to this notification is required for public purpose, viz. "Construction of Bhagwah-Bijarni-Lal Draman Defence road by GREF" ;
Whereas, on the basis of an indent placed by Officer Commanding, 52 RCC (GREF) vide his No. 2096/LA/LDDD/84/E2 dated 06-05-2016, a notification under section 4 (1) was issued by Collector, Land Acquisition (ACR), Doda vide No. 172-78/Acq dated 19-05-2016 read with corrigendum vide No. 591-97/Acq dated 20-08-2016 followed by fresh notification under section 4 (1) vide No. 523-29/Acq dated 08-08-2016 for land measuring 79 Kanals 03½ Marlas situated in Village Bhagwah, Tehsil and District Doda ;
Whereas, the Collector, Land Acquisition (ACR) vide No. 683-89/Acq dated 08-09-2016 has reported that the notification issued under section 4 (1) of the J&K State Land Acquisition Act by him was served upon the interested persons for filing objections, if any, to the proposed acquisition but no objections was received from the land owners/interested persons in the prescribed time period as required under sections 5&5-A of the Land Acquisition Act ;
Whereas, the report furnished by Collector, Land Acquisition (ACR) vide letter refers to above duly endorsed by the Deputy Commissioner, Doda vide No. 376/LAC/D/16 dated 24-11-2016 has been examined and it has been found that the Collector, Land Acquisition concerned has appropriately taken care of the reservations expresed by the interested persons ; and
Whereas, the Government is satisfied that the land particulars whereof are given at "Annexure–A" to this notification is required for public purpose viz. "Construction of road from Bhagwah-Bijarni-Lal Draman defence
road by GREF".

Whereas, the report furnished by Collector, Land Acquisition (ACR),
Kishtwar vide referred above duly endorsed by Deputy Commissioner,
Kishtwar vide No. DCK/LA/2016/318-22 dated 12-11-2016 has been
examined and it has been found that the land owners did not file any
objection to the proposed acquisition ; and
Whereas, the Government is satisfied that the land particulars whereof are mentioned in "Annexure–A" to this notification is required for public purpose viz. for construction of road from Chalaasoo to Tatani under PMGSY.
Now, therefore, in pursuance of section 6 of the J&K State Land Acquisition Act, Samvat 1990, it is declared that the land measuring 43 Kanals 08½ Marlas situated in Village Loundari, Tehsil Drabshalla, District Kishtwar, particulars whereof are given in "Annexure–A" to this notification is required for public purpose viz. for construction of road from Chalaasoo to Tatani under PMGSY. Further, the Collector, Land Acquisition (ACR), Kishtwar is directed under section 7 of the said Act to take orders for acquisition of the said land after giving prescribed notice to the interested person(s) as required under the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible for identification and proper title verification of all types of land involved in the case and apportionment of compensation amongst all the interested persons/rightful claimants in accordance with the relevant laws/rules in
force, while making the award.

dated 19-07-2016 for land measuring 13 Kanals and 13 Marlas situated in
Village Nowgam, Tehsil Marwah, District Kishtwar ;
Whereas, the Collector, Land Acquisition (ADC), Kishtwar vide
No. ADCK/LA/2016/297-98 dated 01-10-2016 has reported that the
notification issued under section 4 (1) of the J&K State Land Acquisition
Act by him was served upon the interested persons for filing objections,
if any, to the proposed acquisition but no objection was received from the
land owners/interested persons in the prescribed time period as required
under sections 5&5-A of the Land Acquisition Act ;
Whereas, the report furnished by Collector, Land Acquisition (ADC),
Kishtwar vide referred above duly endorsed by Deputy Commissioner,
Kishtwar vide No. DCK/LA/263-67/2016 dated 12-11-2016 has been
examined and it has been found that the land owners did not file any
objection to the proposed acquisition ; and
Whereas, the Government is satisfied that the land particulars
whereof are mentioned in "Annexure–A" to this notification is required
for public purpose viz. for construction of link road from Mulwarwan to

the notification issued under section 4 (1) of the J&K State Land Acquisition
Act by him was served upon the interested persons for filing objections,
if any, to the proposed acquisition but no objection was received within the
prescribed time period as required under sections 5&5-A of the Land
Acquisition Act ;
Whereas, the report furnished by Collector, Land Acquisition
(SDM), Mendhar vide No. referred above duly endorsed by Deputy
Commissioner, Poonch vide No. DCP/LA/365 dated 20-07-2016 has
been examined and it has been found that except one land owner the other
interested persons did not file any objection to the proposed

PUBLIC NOTICE
OF
ELECTION TO THE OFFICE OF VICE-PRESIDENT OF INDIA
WHEREAS, a notification under sub-section (1) of section 4 of the
Presidential and Vice-Presidential Elections Act, 1952, for the holding of an

Election Commission, I, Shumsher K. Sheriff, the Returning Officer for
such election, do hereby give notice that—
(i) nomination papers may be delivered by a candidate or any one of
his proposers or seconders to the undersigned at his office in
Room No. 29, Ground Floor, Parliament House, New Delhi, or if
he is unavoidably absent, to the Assistant Returning Officers, Shri
Mukul Pande, Additional Secretary or Shri Rohtas, Joint Secretary,
Rajya Sabha Secretariat at the said office between 11 A. M. and
3 P. M. on any day (other than a public holiday) not later than the
18th of July, 2017 ;
(ii) each nomination paper shall be accompanied by a certified copy
of the entry relating to the candidate in the electoral roll for the
Parliamentary Constituency in which the candidate is registered
as an elector ;
( iii) every candidate shall deposit or cause to be deposited a sum of
rupees fifteen thousand only. This amount may be deposited in
cash with the Returning Officer at the time of presentation of the
nomination paper or deposited earlier in the Reserve Bank of
India or in a Government Treasury and in the latter case a receipt
showing that the said deposit of the sum has been so made is
required to be enclosed with the nomination paper ;
(iv) forms of nomination papers may be obtained from the above said
office at the times aforesaid ;
(v) the nomination papers, other than those rejected under
sub-section (4) of section 5B of the Act, will be taken up for
scrutiny at the said office in Room No. 29, Ground Floor,

THE JAMMU AND KASHMIR CIVIC LAWS
(SPECIAL PROVISIONS) (AMENDMENT) BILL, 2017
[L. A. Bill No. 5 of 2017.]
A Bill to amend the Jammu and Kashmir Civic Laws
(Special Provisions) Act, 2014.
Be it enacted by the Jammu and Kashmir State Legislature in
the Sixty-eighth Year of the Republic of India as follows :––
1. Short title and commencement.––(1) This Act may be
called the Jammu and Kashmir Civic Laws (Special Provisions)
(Amendment) Act, 2017.
(2) It shall be deemed to have come into force with effect from
1st day of April, 2017.
2. Amendment of section 1, Act III of 2014.––In section 1
of the Jammu and Kashmir Civic Laws (Special Provisions) Act, 2014
(hereinafter referred to as 'the Principal Act'), in sub-section (2), for
the words and figures, "31st day of March, 2017", the words and figures
"30th day of September, 2017" shall be substituted.
3. Amendment of section 3, Act III of 2014.––In section 3 of
the Principal Act, for the words and figures, "31st day of March, 2017",
the words and figures, "30th day of September, 2017" shall be
substituted.
4. Amendment of section 4, Act III of 2014.––In section 4 of
the Principal Act––
(i) in proviso to sub-section (1), for the words, "after coming
into force of this Act", the words and figures, "after

(ii) in sub-section (2), for the words and figures, "31st day of

5. Amendment of section 5, Act III of 2014.––In section 5
of the Principal Act, in clause (a), for the words "on the date of
commencement of this Act", the words and figures, "on 31st of
December, 2016" shall be substituted.

STATEMENT OF OBJECTS AND REASONS
The J&K Civic Law (Special Provisions) Act, 2014 was enacted
which extended to the local areas of Jammu, Srinagar and Katra town.
In pursuance to the section 3 of the Act, the Government had to
formulate a policy to deal with or regulate the unauthorized construction
in the aforementioned local areas. This policy should be ins consonance
with the Master Plan as may be modified as reviewed under the sub-
section (2) of section 12 of the H&U Development Act,
1970.
The mid-term revision of the Master Plans of Jammu, Srinagar
and Katra under J&K Development Act, 1970 has been undertaken
by the department but due to certain unavoidable circumstances the
deadlines projected for completion of the Master Plan could not be
accomplished, thereby causing a delay in finalization of the proposed
policy required under the Act for regularization of unauthorized
construction to the extent possible within the ambit/framework of the
modified Master Plans. Now, the said policy has been framed and also
approved by the State Cabinet.
As the term of the Act consequent to its extension vide
J&K Civic Laws (Special Provision) Amendment Act, 2014 expired
on 31st day of March, 2017, and required further extended up to
30th day of September, 2017 to implement the policy to regulate the
unauthorized construction in the aforementioned local areas.

shown in the draft schedule in writing within thirty days from the date of
publication of this notice under section 70 (3) of Jammu and Kashmir
Municipal Act, 2000.
Now, this notification is issued today the 24th of April, 2017, under
the seal and signature of the undersigned along with the proposed Tax
Schedule of Municipal Committee, Pampore inviting objections, if any,
from the Inhabitants/ Traders of the town to be filed in writing and submitted
in the Office of Municipal Committee within thirty days from the date of
publication of this notification.

Srinagar, the 5th June, 2017.
SRO-230.––Whereas, on 04-05-2012, the guard personnel deployed
on security duty at minority picket Pargochi-B, Shopian were attacked by
five (05) militants who also snatched two (02) service weapons and
ammunition from the guard personnel ; and
Whereas, with regard to the aforementioned incident, a case FIR
No. 129/2012 under sections 307, 395 of RPC, 7/27 Arms Act, sections 16, 2 The J&K Govt. Gazette, 5th June, 2017/15th Jyai., 1939. [No. 9-a –––––––––––––––––––––––––––––––––––––––––––––—–––—————
18 and 38 of the Unlawful Activities (Prevention) Act, 1967 (for short,
"UA (P) Act"), section 3 of Police Enhanced Penalities Ordinance, 2005
(1948 AD) (for short, "PEPO") and section 30 of the Police Act
was registered in Police Station, Shopian and the investigation was
initiated ; and
Whereas, during the course of investigation, all the four police
personnel deployed on the guard duty were arrested by the Investigating
Officer ; and
Whereas, during the course of investigation, on the basis of statements
of witnesses recorded under sections 161 and 164-A of Cr. P. C. and based
on the circumstantial and documentary evidence, the Investigating Officer
has established a prima facie case under section 3 of PEPO and section
30 of the Police Act, against the four police personnel deployed on guard
duty viz., 1) Sg. Ct. Mohammad Abdullah No. 264/Spn, 2) Ct. Mushtaq
Ahmad No. 510/Spn., 3) SPO Mohammad Amin No. 224/Spn. and 4) SPO
Ayash Ahmad No. 114/Spn. ; and
Whereas, during the course of investigation, three persons namely,
Muzamil Bashir @ Umer, Mukhtar Ahmad Dar and Shabir Ahmad Malik
have also been arrested and on the instance of accused Muzamil Bashir, 08
live rounds of SLR and 13 live rounds of 303 have been recovered from an
orchard at Lassipora, Pulwama. Besides, the snatched weapon has also
been recovered from two militants namely Arshid Ahmad Sheikh (one of
the accused persons in instant FIR) and Tawseef Ahmad, who were killed
during an encounter, and on the basis of statements of witnesses recorded
under sections 161 and 164-A of Cr. P. C. and based on the circumstantial
and documentary evidence, the Investigating Officer has also established a
prima facie case under sections 395, 307 RPC, 7/27 Arms Act and sections
16, 18 and 38 of ULA (P) Act against the five militants, out of whom Arshid
Ahmad Sheikh has been killed in an encounter viz., 1) Inam-ul-Haq Malla
@ Waseem S/o Mohammad Iqbal Malla R/o Pehlipora, Shopian

Whereas, the Authority appointed by the State Government under
sub-section (2) of section 45 of the ULA (P) Act has independently
scrutinized the Case Diary file and all other relevant documents relating to
the case and has come to a definite conclusion that a prima facie case
under sections 16, 18 and 38 of ULA (P) Act arising out of FIR No. 129/
2012 of Police Station, Shopian is made out against the accused persons
namely, 1) Inam-ul-Haq Malla @ Waseem S/o Mohammad Iqbal Malla R/
o Pehlipora, Shopian (Active Militant), 2) Mukhtar Ahmad Dar S/o Gh.
Mohammad Dar R/o Haripora, Shopian, 3) Shabir Ahmad Malik S/o
Mohammad Khalil R/o Sugoo, Hindhama, Shopian and 4) Muzamil Bashir
Mir S/o Bashir Ahmad Mir R/o Lassipora, for launching prosecution against
them in the competent court of law ; and
Whereas, after perusing the Case Diary, the relevant documents and
also taking into consideration the observations/views of the Authority
appointed under sub-section (2) of section 45 of the ULA (P) Act, the State
Government is of the view that there is sufficient material and evidence
available against the accused persons (militants) for their prosecution under
the aforesaid provisions of law ; and
Whereas, the State Government is also of the view that there is
sufficient material and evidence available against the other accused police
personnel for according sanction as required under section 5 of the PEPO
for their prosecution under section 3 of PEPO and section 30 of the
Police Act.
Now, therefore, in exercise of powers conferred by sub-section (1)
of section 45 of the ULA (P) Act and section 5 of the PEPO, the State
Government hereby accord sanction for launching prosecution against the

SRO-231.––Whereas, on 05-07-2011, Police Station, Kulgam
reliably came to know that several persons including (l) Tanveer Ahmad
Rather S/o Abdul Rehman R/o Kanelwan, Bijbehara and (2) Chandia Kohli
@ Chandia Gojar R/o Malwan, on the instance of terrorists of banned HM
terrorist outfit and other accomplices, are providing financial assistance to
the terrorists for carrying out terrorist activities ; and 2 The J&K Govt. Gazette, 5th June, 2017/15th Jyai., 1939. [No. 9-b –––––––––––––––––––––––––––––––––––––––––––––—–––—————
Whereas, in this connection, Case FIR No. 137/2011 under
section 17 of the Unlawful Activities (Prevention) Act, 1967 was registered
in Police Station, Kulgam and investigation initiated ; and
Whereas, during the course of investigation, the accused namely
Tanveer Ahmad Rather S/o Late Ab. Rehman R/o Kanelwan, Bijbehera,
Anantnag and Chandia Kohli @ Chandia Gojar S/o Jamal-ud-Din R/o
Malwan, Kulgam were found counting currency notes in suspicious condition
in the hospital premises, both were apprehended on the spot and an amount
of Rupees one lac and nineteen thousand (Indian currency) was recovered
from them and a written letter on HM letter pad mentioning receipts/
distribution details as well instruction was also recovered ; and
Whereas, during preliminary questioning, it was found that the said
amount is a terrorist fund transaction/transported on the instructions of one
Rafiq Ahmad Sheikh @ Basharat, Divisional Commander of Banned Outfit
HM Peer Panchal Regiment, which amount was actually sent by the HM
terrorist Zaffar Ahmad Bhat S/o Sonaullah Bhat R/o Liver, Pahalgam who
is carrying out terrorist activities from across the LoC since last several
years through these accused persons among others. The said amount being
a proceed of terrorism was got retained as per the provisions under section
25 ULA (P) Act by the designated authority and the seized currency notes
have also been got verified for their genuineness through J&K Bank.
The involvement of other accused persons namely (1) Gh. Nabi Lone
S/o Mohd. Akbar Lone R/o Thamankot, Verinag, (2) Mohd.Rafiq
Sheikh @ Basharat S/o Ab. Rehman R/o Nooch Devel, Tehsil Mahore,
(3) Mohd. Bashir Sheikh @ Rashid S/o Habibullah R/o Devel, Tehsil Mahore
and (04) Zaffar Ahmad Bhat S/o Sonaullah Bhat R/o Lever, Pahalgam was
also established in the instant case. All the above named accused
persons were arrested (except accused namely Zaffar Ahmad Bhat
S/o Sonaullah Bhat who is presently at PoK/Pak against whom proceedings
under section 512 Cr. P. C. have been initiated) and latter released on

Whereas, during the course of investigation, on the basis of statements
of witnesses, the seizure memos and other evidence, the Investigating
Officer established a prima facie case against the accused persons
under sections 17, 20 and 21 of the Unlawful Activities (Prevention)
Act, 1967 ; and
Whereas, the Authority appointed by the State Government under
sub-section (2) of section 45 of the Unlawful Activities (Prevention)
Act, 1967 has independently scrutinized the Case Diary file and all the
other relevant documents relating to the case and has come to a definite
conclusion that this is a fit case for accord of prosecution sanction against
the accused persons ; and
Whereas, after perusing the Case Diary, the relevant documents and
also taking into consideration the observations/views of the Authority
appointed under sub-section (2) of section 45 of the Unlawful Activities
(Prevention) Act, 1967, the State Government is of the view that there is
sufficient material and evidence available against the accused persons for
their prosecution under the aforesaid provisions of law.
Now, therefore, in exercise of powers conferred by sub-section (1)
of section 45 of the Unlawful Activities (Prevention) Act, 1967, the State
Government hereby accord sanction for launching prosecution against the
below mentioned accused persons for the commission of offence
punishable under sections 17, 20 and 21 of the Unlawful Activities
