Whereas , the land specifications whereof are given in " Annexure -A " to this notification is required for public purpose viz . construction of Ring Road by NHAI at Village Gurah Singhu , Tehsil Marh , District Jammu ;
Whereas , on the basis of an indent prepared by Project Director , NHAI , 315/1 , Channi Himmat Jammu vide No. PD/ JMU /LA - Jammu /Ring Road/ 2016 / 2096 dated 23-08-2016 , a notification under section 4 ( 1 ) was 906 The J& K Govt . Gazette, 26th Oct. , 2017/4th Kart . , 1939. [No. 30
issued by Collector, Land Acquisition ( SDM) , Marh No. SDM/ M /LH/ Acq/ Road Ring/ 2016-17 / 319-326 dated 06-09-2016 read with Corrigendum No. SDM /M/ 2016-17 / Ring Road/ 622 dated 27-12-2016 and SDM/M/ 2016- 17 /Ring Road/ 647 dated 10-01-2017 for land measuring 119 Kanals , 19 Marlas and 257 Sft . situated at Village " Gurah Singhu" , Tehsil Marh , District Jammu ;
Whereas , the Collector, Land Acquisition ( SDM , Marh ) , Jammu vide No. SDM /M/ Acq /Road Ring/ 2016-17/ 760-61 dated 09-02-2017 has reported that the notification issued under section 4 (1 ) of the J & K State Land Acquisition Act by him was served upon the interested persons for filing objections , if any, to the proposed acquisition , but no objection was received from the land owners/ interested persons within the prescribed period as required under sections 5 & 5 - A of the Land Acquisition Act; and
Whereas , the report furnished by Collector , Land Acquisition ( SDM , Marh) , Jammu vide above referred letter duly endorsed by District Collector ( DC) , Jammu vide No. DCJ/LA/ Ring Road/ Gurah Singhu/ 2016-17/1561-69 dated 16-02-2017 and by Divisional Commissioner , Jammu vide No. 502/ 2832 / Acq /R- R - NHAI and by Divisional Commissioner , Jammu vide No. 502 / 2776 / Acq/ R- R - NHAI/ Gurah Singhu/J/ 17 /3364-67 dated 02- 03-2017 has been examined and it has been found that the land owners did not file any objection to the proposed acquisition ; and
Whereas , the Government is satisfied that the land particulars whereof are given above , is required for public purpose viz . for construction of Ring Road by NHAI in Village Gurah Singhu , Tehsil Marh , District Jammu ;
Whereas , the Indenting Department/ Collector have expressed urgency for taking over the possession of the land.
Now, therefore , in pursuance of section 6 of the J & K State Land Acquisition Act , Samvat 1990 , it is declared that the land measuring 119 Kanals , 19 Marlas and 257 Sft . situated at Village Gurah Singhu , Tehsil No. 30] The J& K Govt . Gazette, 26th Oct. , 2017/ 4th Kart . , 1939. 907
Marh , District Jammu , particulars whereof are given in " Annexure -A" is required for public purposes viz . for construction of Ring Road by NHAI . Further , the Collector, Land Acquisition (SDM) , Marh is directed under section 7 of the said Act to take orders for acquisition of the said land after giving prescribed notice to the interested person ( s ) as required under the Land Acquisition Act/Rules .
Further, in pursuance of section 17 of the Land Acquisition Act , Samvat 1990 , it is also ordered that on expiry of fifteen days from the publication of the notification under section 9 ( 2) of the said Act, the Collector will take possession of the aforementioned land in Village Gurah Singhu , Tehsil Marh , District Jammu required for public purposes , subject to fulfillment of the conditions prescribed under section 9 ( 2) and section 17 -A of the Land Acquisition Act and Rule 63 of the Land Acquisition Rules .
However , the Collector concerned shall be personally responsible for identification and proper title verification of all types of land involved in the case for making apportionment of compensation amongst all the interested persons /rightful claimants , in accordance with the relevant laws /rules in force , while making the award .

Whereas , on the basis of an indent placed by Executive Engineer , PMGSY Division , Udhampur - I vide No. PMGSY/ Div . / Udh - I/ 4525-29 dated 27-02-2012 a notification under section 4 ( 1 ) was issued by Collector, Land Acquisition (ACR) , Udhampu vide No. ACRU/ SQ/2059-67 dated 16-09-2016 for land measuring 58 Kanals and 15 Marlas situated in Village " Battal " , Tehsil and District Udhampur ;
Whereas , the District Collector ( DC ) , Udhampur vide letter No. DCU / SQ/ 3541-43 dated 04-01-2017 has reported that the notification No. 30] The J& K Govt . Gazette, 26th Oct. , 2017/4th Kart . , 1939. 911
issued under section 4 ( 1 ) of the J & K State Land Acquisition Act by Collector , Land Acquisition (ACR) , Udhampur was served upon the interested persons for filing objections , if any , to the proposed acquisition but no objection was received from the land owners/ interested persons in the prescribed time period as required under sections 5 & 5 - A of the Land AcquisitionAct ;
Whereas , the report furnished by the District Collector (DC ) , Udhampur vide No. referred to above duly endorsed by the Divisional Commissioner, Jammu vide No. 502 / 2796/Acq/ PMGSY /Battal /Udh/ 17/3034-36 dated 07-02-2017 has been examined and it has been found that the land owners did not file any objection to the proposed acquisition; and
Whereas , the Government is satisfied that the land particulars whereof are given in " Annexure - A " to this notification is required for public purpose viz . for construction of a road from Battal to Ladiyala situated at Village Battal , Tehsil and District Udhampur under PMGSY ;

Whereas , the Government is satisfied that the land particulars whereof are given above is required for public purpose viz . for construction ofBagla Dal Draman Road in Village Bharath , Tehsil Bharath Bagla , District Doda under PMGSY Scheme .
Now, therefore , in pursuance of section 6 of the J & K State Land Acquisition Act , Samvat 1990 , it is declared that the land measuring 07 Kanals and 07 Marlas situated at Village Bharath , Tehsil Bharath Bagla , District Doda particulars whereof are given above is required for public purpose viz . for construction of Bagla Dal Draman Road in Village Bharath , Tehsil Bharath Bagla, District Doda under PMGSY Scheme . Whereas , vide Notification No. 51 - Rev ( LAJ ) of 2017 dated 14-02-2017 declaration has been issued under sections 6 & 7 of the Land Acquisition Act for land measuring 41 Kanals and 12½ Marlas situated in Village "Kundi " , Tehsil and District Ramban for widening/ four lanning of National Highway by NHAI .
Whereas , Collector, Land Acquisition (ADC) , Ramban vide his letter No. 913-14/ Acq/ NHAI dated 02-03-2017 has now expressed the urgency in taking over possession of the land under acquisition.
Now, in pursuance of section 17 of the Land Acquisition Act , Samvat 1990 , it is ordered that on expiry of fifteen days from the publication of the notification under section 9 (2) of the said Act , the Collector will take possession of the aforementioned land in Village Kundi , Tehsil and District Ramban required for public purpose , subject to fulfillment of the conditions prescribed under section 9 (2 ) and section 17 -A of the Land Acquisition Actand Rules 63 of the Land Acquisition Rules .

SRO - 309 . In exercise of the powers conferred by section 164 of the Jammu and Kashmir Goods and Services Tax Act , 2017 ( Act No. V of 2017 ) , the State Government hereby makes the following amendment in the Jammu and Kashmir Goods and Services Tax Rules , 2017 , namely :-
(i) in sub -rule (4) of rule 24, for the words " within a period of thirty days from the appointed day " , the words and figures " on or before 30th September , 2017 " shall be substituted ;

(ii) rule 34 shall be substituted by the following , namely : -
" 34. Rate of exchange of currency, other than Indian rupees , for determination of value . ( 1 ) The rate of exchange for determination of value of taxable goods shall be the applicable rate of exchange as notified by the Board under section 14 of the Customs Act, 1962 for the date of time of supply of such goods in terms of section 12 of the Act .
(2) The rate of exchange for determination of value of taxable services shall be the applicable rate of exchange determined as per the generally accepted accounting principles for the date of time of supply of such services in terms of section 13 of the Act . " ;
(iii) third proviso to rule 46 , shall be substituted by the following proviso , namely :-
" Provided also that in the case of the export of goods or services , the invoice shall carry an endorsement " SUPPLY MEANT FOR EXPORT/ SUPPLY TO SEZ UNIT OR SEZ DEVELOPER FOR AUTHORISED OPERATIONS ON PAYMENT OF INTEGRATED TAX " or " SUPPLY MEANT FOR EXPORT/ SUPPLY TO SEZ UNIT OR SEZ DEVELOPER FOR AUTHORISED OPERATIONS UNDER BOND OR LETTER OF UNDERTAKING WITHOUT PAYMENT OF INTEGRATED TAX" , as the case may be , and shall , in lieu of the details specified in clause ( e) , contain the following details , namely :-
(i) name and address of the recipient ;
(ii) address of delivery ; and
(iii) name of the country of destination" .

( iv) sub - rule ( 5) of rule 61 shall be substituted by the following , namely :-
" (5 ) Where the time limit for furnishing of details in FORM GSTR- 1 under section 37 and in FORM GSTR - 2 under section 38 has been extended and the circumstances so warrant , the Commissioner may, by notification, specify that return shall be furnished in FORM GSTR - 3B electronically through the common portal , either directly or through a Facilitation Centre notified by the Commissioner" .
(v) after sub - rule ( 5) of rule 61 , the following sub - rule shall be added , namely
" (6) Where a return in FORM GSTR - 3B has been furnished , after the due date for furnishing of details in FORM GSTR- 2 , the following conditions shall be fulfilled :-
(a) Part A of the return in FORM GSTR - 3 shall be electronically generated on the basis of information furnished through FORM GSTR - 1 , FORM GSTR - 2 and based on other liabilities of preceding tax periods and PART B of the said return shall be electronically generated on the basis of the return in FORM GSTR- 3B furnished in respect of the tax period ;
(b) the registered person shall modify Part B of the return in FORM GSTR- 3 based on the discrepancies , if any , between the return in FORM GSTR- 3B and the return in FORM GSTR - 3 and discharge his tax and other liabilities , if any ;
(c) where the amount of input tax credit in FORM GSTR- 3 exceeds the amount of input tax credit in terms of FORM GSTR- 3B , the additional amount shall be credited to the electronic credit ledger of the registered person . " .

(vi) in second proviso to sub - rule (3 ) of rule 83 for the word " sub - section" , the word " sub - rule " shall be substituted ;
(vii) in clause ( E) of sub- rule (4) of rule 89 for the word " sub - section " , the word " clause " shall be substituted ;
(viii) in FORM GST TRAN - 1 in Sl . No. 7 , in Table ( a) , in column (2) , under the heading " HSN ( at 6 digit level) , the words " HSN as applicable " shall be substituted ;
(ix) in FORM GST TRAN - 2 , in SI . No. 4 and 5, in the Table , for the heading of column ( 1 ) , the heading "HSN as applicable " shall be substituted.
This notification shall and shall always deemed to have come into force with effect from 8th of July, 2017 .

SRO - 319 . In exercise of the powers conferred by section 35 of the Inter - State Migrant Workmen ( Regulation of Employment and Conditions of Service) Act , 1979 ( Central Act) , the Government of Jammu and Kashmir intends to make the following amendments in Jammu and Kashmir Inter - State Migrant Workmen ( Regulation of Employment and Conditions of Service) Rules , 1984 , namely :-
1. in clause ( vi ) of sub - rule ( 2) of rule 11 , for the words "Deputy Labour Commissioner ( Central ) " , the words [No. 17 -j
2 The J& K Govt . Gazette , 31st July , 2017/ 9th Srav . , 1939.
"Deputy Labour Commissioner , Jammu /Kashmir " shall be substituted .
2. in sub rule (2) of rule 23 , for the words " send telegrams to " , the words " inform" shall be substituted .
Now, in pursuance of sub - section ( 1) of section 35 , any person who desires to object to the aforesaid amendments may submit his / her objections / suggestions for consideration in writing to the Secretary to Government , Labour and Employment Department , Civil Secretariat within a period of six weeks from the date of issuance of this notification .
Any objection/ suggestion received after the expiry of the said period shall not be entertained .

SRO- 320 . In exercise of the powers conferred by sub- section ( 1 ) of section 30 of the Food Safety and Standards Act , 2006 ( 34 of 2006) , and in supersession of Notification SRO - 192 dated 24th of June , 2015 , the Government of Jammu and Kashmir hereby appoint Dr. Pawan Kotwal , IAS , Principal Secretary to the Government , Health and Medical Education Department , as the Commissioner of Food Safety in addition to his own duties .
